HomeMy WebLinkAbout1961.02.21 CC MinutesEXTRACT OF MINUTES OF MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF HUGO, MINNESOTA Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Hugo, Minnesota, was held at the Village Hall in said Village on Tuesday, February 21, 1961, at 7:00 o'clock P.M., with -the following members present: Maslowski, Marier, Burkhard, Letourneau and the following members absent: Wenzel The Clerk then presented affadavits of publication of notices of this meeting to contractors for the receipt of bids for the construc- tion of 1,I.aterworks Improvement No. 1960-1 with the exception of well bids for which bids have previously been received. Said affadavits were examined, approved and ordered filed and the Clerk announced that he had received 25 sealed bids according to said notices to contractors which, upon being opened, were found to be as follows: BIDDER SCHEDULE PRICE Mech. Pump House 2,731.00 St. Paul, Minnesota After consideration of all bids received for Waterworks Improvement No. 1960-1, including well bids received on February 6, the engineer reported on his tabulation of said bids and made his recommendation. After consideration of said bids, Member Marier intro- duced the following resolution and moved its adoption: RESOLUTION AWARDING A CONTRACT FOR CONSTRUCTION OF A WELL FOR WATER`�ORKS IMPROVEMENT NO. 1960-1. BE IT RESOLVED By the Village Council of the Village of Hugo, Minnesota as follows: (1) That it is hereby found, determined and declared that the two lowest bids submitted by responsible contractors for the well portion of Waterworks Improvement No. 1960-1, according to plans and specifications and according to the notice to contractors, are as follows: LOWEST BIDDER PRICE Tri-State Drilling Co. Wayzata, Minnesota $ 6,275.00 SECOISD LOWEST BIDDER Mueller Bros. Gaylord, Minnesota $ 6,835.00 (2) That the contract for said work is hereby awarded to the lowest responsible bidder and the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder on behalf of the Village upon said bidder furnishing a satisfactory cor- porate surety bond conditioned upon the satisfactory performance of the work according to plans and specifications and otherwise as required by law. (3) That the bid deposits of the two lowest responsible bidders shall be retained by the Clerk and the bid deposits of all other bidders shall be returned forthwith. The motion for the adoption of the foregoing resolution was duly seconded by Member Letourneau ; and upon a vote being taken, the following members voted in favor thereof: Maslowski, Burkard, Marier and Le-L-ourneau and the following members voted against the same: None whereupon said resolution was declared passed and adopted. -3- Member Marier introduced the following resolution and moved its adoption: RESOLUTION AWARDING CONTRACTS FOR THE BALANCE OF WATERWORKS IMPROVEMENT NO. 1960-1, DETERMINING THE TOTAL COST OF SAID IMPROVEMENT AND CALLING FOR THE SALE OF BONDS. BE IT RESOLVED By the Village Council of the Village of Hugo, Minnesota, as follows: (1) It is hereby found, determined and declared that the lowest two bids submitted for each schedule of work advertized for Waterworks Improvement No. 1960-1, according to plans and specifications and notices to contractors, are as follows: BIDDER SCHEDULE Erickson P1bg. & Htg. Pump House 2,731.00 St. Paul, Minnesota (2) The Mayor and Clerk are authorized and directed to enter into contracts on behalf of the Village with the lowest responsible bidder for each schedule of work bid upon said bidders furnishing satis- factory corporate surety bonds conditioned upon the satisfactory perfor- mance of the work according to plans and specifications and otherwise as required by law. (3) The Clerk is authorized and directed to retain the bid deposits of the two lowest bidders for each schedule of work and to re- turn the bid deposits of all other bidders forthwith. we (4) It is hereby found, determined and declared that the total cost of constructing 1�aterworks Improvement No. 1960-1, in- cluding costs of contracts let, future contract costs, land and ease- ment costs, engineering, legal and fiscal service, contingent expense and $8,750 for interest during construction, is $181,242.00, of which not less than $130,000 will be assessed against properties specially benefited by said improvement, which assessments may be paid in ten (10) equal annual installments with interest at the rate of 6/ per annum from date of adoption of said assessments to December 31 of the year in which the first payment is payable, to be added to the first installment, and one year's interest to be added to each subsequent installment. It is estimated that not less than $21,242 of said assessments will be prepaid and available for construction costs. (5) It is found and determined that it is necessary and expedient for -the Village to borrow money and issue its general obliga- tion waterworks improvement bonds in the amount of $160,000, and this Council shall meet at the -time and place specified in the form of notice hereinafter contained for the purpose of receiving sealed bids for and awarding the sale of said bonds. The Clerk is authorized and directed. -to cause notice of said meeting to be published in the official news- paper and in Commercial West, published in Minneapolis, Minnesota, at least once not later than -ten (10) days prior to the date of said meeting, which notice shall be in substantially the following form: --5_- NOTICE OF BOND SALE $160, 000 WATERWORKS IMPROVEMENT BONDS VILLAGE OF HUGO, MINNESOTA NOTICE IS HEREBY GIVEN That the Village Council of -the Village of Hugo, Min- nesota, will meet at the Village Hall in said Village on Tuesday, March 21, 1961, at 8:00 o'clock P.M., C.S.T. -to receive bids and award the sale of $160,000 general obligation, negotiable coupon Waterworks Improvement Bonds of the Village which shall be in denominations of $1,000 each, shall be dated May 1, 1961, shall bear interest at the rate -or rates designated by the successful bidder expressed in integral multiples of 1/10 or 1/4 of 1% per annum payable on February 1, 1962, and semiannually thereafter on August 1 and February 1 of each year; and shall mature serially on February 1 in the years and amounts as follows: $5,000 in the year 1963; $10,000 in each of the years 1964, 1966, 1968 and 1970; $15, 000 in each of the years 1965, 1967, 1969, 1971 and 1972; $4, 000 in each of the years 1973 through 1977, inclusive and $5,000 in the years 1978 through 1981, inclusive; with bonds maturing in -the years 1973 through 1981 subject to redemption and prepayment at the Village's option, in inverse numerical order, on February 1, 1972 or any interest payment date thereafter at a price of 102% of par plus accrued interest. Both principal and interest will be payable at any suitable banking institution in the United States designated by the successful bidder, and the Village agrees to pay the customary and reasonable charges of said paying agent. The Village agrees to furnish within 40 days after award and without expense to the purchaser, anywhere in the State of Minnesota, the printed and executed bonds together with the unqualified approving legal opin- ion of Messrs. Briggs and Morgan of St. Paul, Minnesota. Sealed bids marked "Bid for $160, 000 VQaterwor]cs improvement Bonds" must be received by the Village Clerk prior to the time of said meeting or by the undersigned Fiscal :gent prior to 2:00 P.M. the date of sale. Each bid must be unconditional except as to legality, which may be conditioned upon the opinion of -the above -named attorneys, and must be accompanied by a cashier's or certified check in the amount of $3,200 payable to the Village Treasurer, -to be forfeited as liquidated damages should the bid be accepted and the bidder fail to comply therewith. Bids will be preferred according to lowest net interest cost deducting any premium offered. Interest rates may be split not more than four ways, provided that each rate specified shall include all bonds With common maturity dates. Bids may specify that all or some bonds shall bear an additional interest rate represented by supplemental coupons for any portion of the term of the bonds, but the total amount of interest represented by said supplemental coupons shall not exceed $2,400. No bid for less than par and accrued interest from date of bonds to date of deli- very will be considered and oral bids will not be received. The Council reserves the -right to waive informalities and to reject any and all bids.
