HUGO BOARD OF ADJUSTMENTS AND APPEALS
JUNE 9, 2016
Chairperson Weidt called the meeting to order at 6:30 p.m.
PRESENT: Patzner, Weidt.
ABSENT: Boland.
ALSO PRESENT: Rachel Juba, Planner
Rachel Leitz, Community Development Assistant
Approval of Minutes
Weidt made a motion, Patzner seconded, to approve the minutes for July 23, 2015, as presented.
All Ayes. Motion carried.
Barnhart — Variance requests for side yard setback located at 5368 145' Street North
Community Development Assistant, Leitz, presented on a variance request to allow a three foot
side yard setback, where City ordinance requires a ten foot side yard setback, to expand a finished
porch on the applicant's home. Ms. Barnhart also has a garage that doesn't meet current ordinance
standards. She has stated that this garage will be removed and construction of a new one will occur
to meet ordinance standards, therefore the Board is only considering one variance request.
Leitz described the criteria staff uses to evaluate variances, most notably: reasonable use, unique
circumstances, character of neighborhood, and spirit and intent. Leitz stated that the unique
circumstance for this request was that setbacks for zoning districts are set for required minimum
lot widths. The minimum lot width in this zoning district is 80 feet. The property is unique in
that it is a narrow lot (50 feet wide) with an existing home that has been constructed three feet
from the west side property line.
It was in staff's opinion that there are practical difficulties in meeting the requirement for a ten
foot side yard setback. Leitz concluded saying that staff recommends approval of the variance
request for the side yard setback of three feet in order to construct the proposed porch addition.
Chairperson Weidt asked the applicant what year the house built.
April Barnhart stated the home was constructed in 1926 and she has lived there since 1998. She
said that adding this four season porch will help with renovations to the home as there are
difficulties with smaller door frame widths and other elements that make the older home difficult
for modern appliances and other features.
Patzner asked for clarification that the porch would be constructed so it would be flush with the
current home and would not extend further into the side yard setback.
Leitz stated that was correct.
Chairperson Weidt opened the public hearing at 6:36 p.m.
No one stepped forward.
Chairperson Weidt closed the public hearing at 6:37 p.m.
Patzner made a motion, seconded by Weidt, to recommend approval to the City Council of the
variance to allow the three foot side yard setback where ordinance standards requires a ten foot
side yard setback.
All Ayes. Motion carried.
