Minutes for the Planning Commission Meeting of Thursday, May 23, 2019 Chair Kleissler called the meeting to order at 7:01 p.m. PRESENT: Arcand, Derr, Fry, Kleissler, Lessard, Mulvihill, Tjernlund. ABSENT: Luchsinger. STAFF: Rachel Juba, Community Development Director Emily Weber, Community Development Assistant Chair Kleissler read aloud the poem, Little Green Tents by Walt Mason, followed by a moment of silence in recognition of Memorial Day. Pledge of Allegiance. Approval of Minutes for the Planning Commission Meeting of May 9, 2019 Commissioner Arcand made a motion, seconded by Commissioner Derr, to approve minutes for the meeting of March 28, 2019. Lessard Abstained. Six ayes. Motion carried. Public Hearing: Steve Bona — Conditional Use Permit application for a recreational lake access lot for a single user. Staff provided background on the property located at 12862 Ethan Avenue North for a lake access lot that would include a parking lot and dock. The property is located on the northeast side of Bald Eagle Lake and is guided as low density residential in the 2030 land use plan. The properties to the north, east, and south are zoned single family detached residential (R-3) and the surrounding properties are occupied by single family homes or are vacant at this time. Juba stated that lake access lots are allowed as a conditional use in the Shoreland Overlay District per the City Code. The lake access lot is proposed to be used by a single user and will not be rented or have boat slips for third party use. There will not be any vehicle or boat storage allowed on the property and the parking area shall be asphalt. Juba continued with background on the property and stated that the property was platted as a lot within the Woods of Bald Eagle development and at that time, this property was deemed unbuildable. There are significant wetlands on the property and in order to make the property buildable for a home site, some wetlands would need to be filled. The applicant is not proposing to fill any wetlands with the lake access lot. Juba stated that the applicant is requesting to use the property in a reasonable manner and meets the spirit and intent of the ordinance. It is in staff's opinion that the lake access lot use is compatible with the City's Comprehensive Plan and character of the area. Juba provided details on the ten conditions of approval that are listed in the resolution. May 23, 2019 PC Minutes Page 2 The application meets the requirements for approval of a conditional use permit and staff recommended approval of the conditional use permit subject to the conditions listed in the resolution and draft conditional use permit. The applicant, Steve Bona, was there to address the Planning Commission and answer any questions. Chair Kleissler asked if the applicant had an updated rendering of the parking lot. Bona said that they have not revised the plan yet, but plan on the space being for two cars. The engineer drawing was provided to show that no wetlands are being impacted. Chair Kleissler opened the public hearing at 7:1 1pm. Chair Kleissler closed the public hearing at 7:12pm. Commissioner Derr stated that it will be good use of the property. Chair Kleissler asked the applicant if there will be any signage on the property and worried that the lot will start to look like a public lot. Bona stated that signage is possible and that they would be willing to put up a private property sign. Kleissler also asked the applicant if they intended to have a fire pit on the property. Bona answered by saying the lot is intended for recreational use and the owners would like to have the option to have a fire pit and picnic table on the lot. Kleissler asked staff if that would be allowed. Juba clarified that the application shows a parking lot and dock but does not show a fire place or picnic table. Kleissler clarified that she wanted a full understanding of the intended use on the property. Juba responded that a fire pit and picnic table would be an acceptable use, but adding a tent or trailer for camping would not be a permitted use. Juba also stated that the Planning Commission can add a condition to the resolution. The Planning Commission discussed the intended use of the property and came to the understanding that a fire pit and picnic table is an acceptable use of the property as long as there are no structures. Commissioner Arcand made a motion to add to the Steve Bona Conditional Use Permit for a recreational lake access lot for a single user under the conditions that a fire pit and picnic table is an acceptable use of the property. Lessard seconded. All ayes. Motion carried. Commissioner Fry made a motion to approve the Steve Bona Conditional Use Permit for a recreational lake access lot for a single user, subject to the conditions listed in the resolution and draft conditional use permit, in addition to the added condition. Seconded by Tjernlund. All ayes. Motion carried. May 23, 2019 PC Minutes Page 3 Public Hearin: Apple Academy — Site Plan and Conditional Use Permit applications for a daycare facility. The applicant is requesting approval of a site plan and CUP to allow construction of a 9,948 square foot daycare facility located along Highway 61 and south of 140th Street North. Two parcels will be combined at Washington County to create one parcel for the daycare. The applicant is also seeking approval of an easement vacation, which will be reviewed at a City Council meeting. Staff provided background on the property, which is zoned General Business (C-2) and complies with all C-2 lot standard. Juba stated that the development will be accessed through the TGK Automotive site. Staff is still working with the applicant on the final design of the building architecture. The site plan must be revised to comply with a 6 -foot height minimum for exterior play areas. Staff also recommends all freestanding lighting comply with 20 -foot maximum height regulations. The applicant is proposing one freestanding monument sign and one wall sign and will need to apply for a sign permit. The parking lot shows 40 parking spaces, which is the required amount. There is also proof of parking provided for 15 additional spaces. The landscape plan shows landscaping within the parking lot, around the building foundation, and around the play area in the back. The landscaping plan complies with landscape standards. The applicant is proposing to create a stormwater management pond and infiltration basin for stormwater management. The pond will drain north to the drainage of TGK Automotive site. Drainage easements must be dedicated over the entire stormwater pond, connecting to the existing stormwater easement on the TGK Automotive site. The applicant is proposing to reroute an existing sanitary sewer main. A vacation of easement will be required. A development contract and financial guarantee will be required for the removal and relocation of the sanitary sewer. The applicant will also be required to have cross access agreements with the subject site landowner and the landowner of the TGK Automotive site. Juba noted that City staff has asked the developer to clarify the process to obtain the right for Parcel C, the property to the south of the subject property, to cross the strip of property with the private road easement in-between the two. Daycare facilities are allowed as a conditional use withing the C-2 General Business District, provided the use is found to comply with the 12 findings in the code. Staff finds that the applications meet all requirements necessary to approve a site plan and CUP and recommends approval of the site plan and CUP for Apple Academy, subject to the findings and conditions listed in the resolution. Commissioner Arcand asked staff who owns the strip of property between the parcels. Juba responded that the piece of land between the parcels does not have an owner and that it is a gap between legal descriptions. Juba stated that Premier Bank has found who the underlying owner is and how to get the right to cross the property. Arcand also asked why there is no access to Highway 61 from the subject site. Juba stated that the City works with MnDOT to limit the number of accesses to Highway 61 and acquiring the proper amount of right of way for when Highway 61 expands to four lanes. The Planning Commission continued to discuss access points on Highway 61 and potential traffic problems that may arise from additional traffic flow to and from the daycare facility. May 23, 2019 PC Minutes Page 4 Chair Kleissler invited the applicant and representatives to come forward. Renee Hallie, Apple Academy owner and Diane Leverentz from Classic Construction came forward to address the Planning Commission. Commissioner Fry asked if TGK Automotive was involved in the discussion and if they are okay with allowing access. Leverentz stated that yes they are and all the parcels along that stretch are working together. Kleissler asked why the color rendering and samples don't match. Leverentz stated that they haven't committed to all subcontractors and colors may vary slightly. Chair Kleissler opened the public hearing at 7:46pm Chair Kleissler closed the public hearing at 7:46pm. Commissioner Derr stated that it will fit in and that it is exciting to see that area develop. Commissioner Lessard also stated that it is a good fit for the area. There are some concerns with the added parking on the west side along the highway, but with future changes it may not be an issue. Leverentz stated that the only additional parking added would be for staff. Commissioner Arcand likes the project but is concerned about the extra traffic along Highway 61. Juba stated that the parcel is zoned commercial so any development on that parcel will create additional traffic. MnDOT provides feedback on all development along Highway 61. Commissioner Tjernlund stated additional traffic regardless of what is developed. The Planning Commission continued to discuss potential traffic problems and whether turn lanes can be added. Hallie came forward and stated that her other daycare facilities don't see problems with their traffic flow. Generally, the parents that are dropping off their kids in the morning are also commuting along the same route so the flow is continuous. Commissioner Tjernlund made a motion to approve the Apple Academy Site Plan and Conditional Use Permit applications for a daycare facility. Lessard seconded. All ayes. Motion carried. Adiournment The next Planning Commission meeting will be June 27, 2019. There will be a Board of Zoning meeting June 13, 2019. DATE: June 21, 2019 for the Planning Commission meeting on June 27, 2019. ZONING DISTRICT: Central Residential District (CR -3) 2030 LAND USE: Low Density Residential (LD) REVIEW DEADLINE: August 7, 2019 1. DESCRIPTION OF REQUEST: The applicant is requesting approval of a minor subdivision for the creation of two lots out of one 0.63 acre lot located at 14032 Flay Avenue North. The variance request is to allow a variance in lot sizes of the proposed lots. The minimum lot size required in the Central Residential (CR -3) zoning district is 8,400 square feet, which the proposed lots meet. However, the property is within the Shoreland District, which requires a minimum lot area of 15,000 square feet. The proposed lot sizes are 14,875 square feet for Parcel A and 12,560 square feet for Parcel B, therefore a variance is required. 2. BACKGROUND: In 1976, the subject lot was previously platted as two lots, lots 5 and 6 block 1, in Traeger's Addition Plat 2. The two lots were then combined by the previous owner in 2012. The parcel now sits vacant as the original home burned down in 2017. 3. CONTEXT: A. Surrounding Land Use and Zoning The property is currently zoned Central Residential District (CR -3) and is a vacant lot on the corner of 1401h Street North and Flay Avenue North. The 2030 Land Use Plan lists the property as Low Density Residential (LD). The surrounding properties are zoned CR -3 and are occupied by single family homes. Properties to the west are zoned General Business District (C-1). Moxness Minor Subdivision & Variance B. Natural Characteristics of Site The property is relatively flat and has a ditch running along the western property line. 4. LEVEL OF DISCRETION IN DECISION-MAKING: The City has limited discretion in approving or denying minor subdivision applications. The City's discretion is limited to whether or not the proposed minor subdivision meets the standards outlined in the Zoning Ordinance. If it meets these standards, the City must approve the subdivision. The City's discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that they meet the standards in the ordinance. 5. ANALYSIS: A. Consistency with Ordinance Standards Minor Subdivision and Variance Area Requirements and Construction Limitation Minimum lot or parcel size 8,400 sq. ft. Minimum lot width at front setback line 80 ft. Minimum lot width for corner lots 80 ft. Minimum lot depth 100 ft. Minimum front yard building setback 25 ft. Minimum side yard building setback 10 ft. Minimum rear yard building setback 25 ft. Maximum building height 35 ft. Maximum lot area to be covered by buildings 30% Maximum lot area to be covered by impervious surface 50% .4etha.rkv The applicant is showing a side yard setback of 9.6 feet on Parcel A and a side yard setback of 8.5 feet on Parcel B. The minimum side yard building setback is 10 feet per the zoning district requirements. The applicant will need to revise their plans to meet the setback requirements. Staff feels that the applicant will easily be able to make the necessary adjustments and staff has added a 10 foot setback requirement as a condition of approval. Both Parcel A and B meet the minimum rear yard and front yard building setback requirements. Moxness Minor Subdivision & Variance Lot Size The CR -3 zoning district requires a minimum lot size of 8,400 square feet with a minimum lot width at front setback line of 80 feet and minimum lot depth of 100 feet. The applicant is requesting to subdivide a 27,435 square foot parcel to create two parcels that are 14,875 and 12,560 square feet in size. Both proposed parcels meet the minimum lot width at front setback line and the minimum lot depth. Although the proposed parcels meet the CR -3 minimum lot size, the property is within the Shoreland District. The Shoreland District of the City is any land that is within 1,000 feet of the ordinary high water (OHW) levels of lakes, ponds, and flowages and within 300 feet of the OHW level of the rivers and streams classified in the City. The subject property is approximately 925 feet from the OHW level of Egg Lake, falling within the Shoreland District. The Shoreland District requires a minimum lot size of 15,000 square feet and the proposed lots are 14,875 and 12,560 square feet, therefore, a variance is required. Variance for Lot Size The applicant is requesting to create two parcels that do not meet the minimum lot size required in the Shoreland District. Proposed Parcel A is 14,875 square feet and proposed Parcel B is 12,560 square feet, where 15,000 square feet are required. Staff used these standards to review the variance request and finds the following: 1. Law. The variance as requested is permissible bylaw. The requested variance is permissible by law. 2. Practical difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term "Practical Difficulties" as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and; The applicant is requesting to split the subject property into 14,875 and 12,560 square feet parcels. Each parcel meets the CR -3 zoning district lot size requirement and will be occupied by single family homes that are required to meet all setback requirements. The applicant is requesting to use the property in a reasonable manner. b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and; The property is unique in that it was previously platted as two lots in the Traeger's Addition Plat 2 in 1976 and was then combined by the property owner in 2012. The original plat intended to have a single family home on each parcel. The proposed parcels Moxness Minor Subdivision & Variance meet the CR -3 zoning district requirements, however, they are also within the Shoreland District. The proposed parcels are of similar size to the surrounding properties and are intended to blend in with the original platted neighborhood. C. Character of the Neighborhood. The variance, if granted, will not alter the essential character of the neighborhood. The property is zoned CR -3 and is characterized as Low Density Residential. The surrounding properties are occupied by single family homes and are of similar size to the proposed parcels. The subdivision would create two lots that will be visually consistent with the surrounding area and will not alter the character of the area. 3. Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the city's comprehensive plan. The spirit and intent of the Shoreland District is to reasonably manage development within the District and to minimize wetland and water body impact. There is enough room on both properties for the elements typically found on residential parcels to remain outside of wetland boundaries. The subdivision meets the spirit and intent of the ordinance. 4. Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. The variance, if granted, will not allow any prohibited use in the district. A minor subdivision that creates a residential lot is allowed in the CR -3 zoning district. 5. Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. The property is located within a FEMA designated floodplain. The building area on both parcels will be out of the floodplain. The applicant is not proposing to impact the floodplain or wetlands. 6. Septic and well compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The proposed parcels will be connected to City sewer and water. Utilities The property is the Metropolitan Urban Service Area (MUSA) and was previously connected to City sewer and water. Both parcels will be connected to City sewer and water and connections are available. The applicant will have to determine the location of the connections. Any Moxness Minor Subdivision & Variance disturbance of the roadway or curb are at the owners expense and will be repaired per City standards. Gradin The applicant is showing the low floor elevation at 930.2 feet and the floodplain elevation at 925.4 feet. Provided the grading plan submitted by the applicant, the applicant is required to make a minor grading edit between the house pads to improve drainage. The City is recommending the applicant also submit a plan showing erosion control measures given its proximity to the public ditch. Streets and Access The proposed parcels have access to Flay Avenue North. No access from CSAH8/1401h Street North should be allowed now or in the future. Although there is an existing driveway on the subject property, each proposed parcel will have individual driveways. The applicant is showing a driveway width of 32 feet on Parcel A and a width of 21 feet on Parcel B. The minimum driveway width in urban residential zoning districts is 12 feet and a maximum of 24 feet. The applicant will need to revise the driveway design on Parcel A to comply with the maximum width of 24 feet at the property line and will be listed as a condition of approval. The applicant is showing easements over the public ditch and floodplain on the property. Side yard drainage and utility easements of 5 feet are not shown and will need to be added for Parcels A and B. Staff will include this in the conditions of approval. The applicant will need a 10 foot roadway, drainage, utility, and trail easement along CSAH 8/140th Street North to account for future County Road expansions mandated by Washington County and will be consistent with the City's Comprehensive Plan regarding future trail needs. Park Dedication and Open Space Park dedication is required of all land subdivided for residential purposes. The applicant will not be dedicating parkland with this project, and would therefore be responsible for the parkland dedication fee, currently set at $2,400 per lot. The applicant is only responsible to pay for the creation of one lot prior to the recording of the minor subdivision. 6. STAFF RECOMMENDATION: It's in staff's opinion that the request meets all the items required for a minor subdivision and variance. Staff recommends approval of the minor subdivision and variance subject to the conditions listed in the attached draft resolution to the Planning Commission. ATTACHMENTS: 1. Location Map 2. Damage to the street and curb will be repaired to City standard at the expense of the applicant. 8. Prior to recording the minor subdivision: a. The park dedication shall be cash -in -lieu of dedication for a total of $2,400. b. All required drainage and utility easements shall be dedicated to the City over the existing public ditch and floodplain on the property. c. The applicant shall dedicate a 5 foot side yard drainage and utility easements for Parcels A and B. d. A 10 foot wide roadway, drainage and utility, and trail easement shall be dedicated to the City and Washington County along 1401h Street North. Based on the review of the revised preliminary plan documents, we offer the following comments related to this application: Site Grading 1. A minor grading edit should be made between the house pads to improve drainage. This edit has been provided to the applicant. Stormwater Management 2. Stormwater management requirements are not required due to the size of the proposed project. We do recommend the applicant submit a plan showing erosion control measures given its proximity to the public ditch. Transportation/ROW 3. Access Locations: Access locations are shown on Flay Avenue. No access from 140th Street/CSAH 8 should be allowed now or in the future. Driveway widths are limited to 24 - ft in width at the property line. 4. Easements — Side yard drainage and utility easements are not shown and will need to be added for parcels A and B. The 10 -ft easement along 140th Street should be an easement accommodating roadway, drainage, utility and trail. This will account for future County Road expansion and be consistent with the comprehensive plan regarding future trail networks. Services to both parcels were provided in the original development prior to the lots being combined.
