Minutes for the Planning Commission Meeting of Thursdav, June 27, 2019 Chair Kleissler called the meeting to order at 7:01 p.m. PRESENT: Arcand, Derr, Fry, Kleissler, Lessard, Luchsinger, Mulvihill ABSENT: Tjernlund. Approval of Minutes for the Planning Commission Meeting of May 23, 2019 Commissioner Derr made a motion, seconded by Commissioner Fry/Lessard to approve minutes for the meeting of May 23, 2019. All ayes. Motion carried. Public Hearing: Darin Moxness — Minor Subdivision and Variance Request for 14032 Flay Avenue North. Weber provided background on the minor subdivision and variance request to create two parcels out of one 0.63 acre parcel located on the corner of 140th Street North and Flay Avenue North. The subject lot was previously platted as two lots, lots 5 and 6, block 1, in Traeger's Addition Plat 2. The lots were combined in 2012 and now sits vacant due to a house fire in 2017. The property is zoned central residential district (CR -3), but also falls within the shoreland district. The proposed lots meet the minimum lot size requirement for the CR -3 zoning district of 8,400 square feet. The shoreland district requires a minimum lot size of 15,000 square feet and the proposed lots are 14,875 and 12,560 square feet, therefore a variance is required. Weber provided additional details on the conditions of approval listed in the resolution. Staff recommended the Planning Commission open the public hearing and hear public comment. Staff recommended approval of the minor subdivision and variance request subject to the criteria listed in the draft resolution. Chair Kleissler invited the applicant, Darin Moxness, 10040 140th Street, Hugo, MN 55038, came forward and addressed the Planning Commission. Commissioner Arcand asked whether the outline of the houses are actual plans that will go on the lots. Moxness stated that Parcel A will have a split level home on the lot and that Parcel B is a slab on grade due to the soil boring done on the property. The applicant also stated that he talked to the surrounding property owners and they were in favor of creating two lots. The lots will be sold after the homes are built and will not be rentals. Request for site plan approval for a climate controlled self -storage building and a front yard setback variance for the property located at 5560 152nd Street North. DATE: August 16, 2019, for the Planning Commission Meeting of August 22, 2019 ZONING: General Industrial (I-3) LAND USE: Industrial (I) 120 -DAY REVIEW DEADLINE: October 9, 2019 1. DESCRIPTION OF REQUEST: The applicant is requesting approval of a site plan to construct a building totaling approximately 16,600 square feet for a three-story climate controlled storage facility. The applicant is also requesting approval of a variance from the front yard setback requirements to construct the building 0 feet from the roadway easement on the west side of the property, where 30 feet is required by ordinance. The building will be 39 feet from the west property line, consistent with the other existing buildings on the property. The 3.27 acre lot is generally located north of 152nd Street and east of Forest Boulevard within the Peloquin Industrial Park. 2. CONTEXT: A. Surrounding Land Use and Zoning The properties to the east and south are part of the Peloquin Industrial Park. The properties are zoned General Industrial (I-3) and are generally occupied by industrial businesses, however there are some single family homes located within the General Industrial zoning district to the south. The properties to the north are zoned General Business (C-2) and are occupied by single family homes. The property to the west, across TH 61, is zoned Single Family Detached Residential Gopher State Storage Site Plan and Variance Page 2 (R-3) and currently has a single family home with some agricultural activities occurring on the property. B. Existing Site Characteristics The 3.27 acre property does contain some challenges in regards to an existing drainage ditch, floodplain, high ground water, wetlands, right-of-way dedication, and a sanitary sewer pipe going through the property. The stormwater management facilities have been constructed on the property and the buildable area is generally flat. There are four existing buildings on the property. 3. BACKGROUND: In 2017, the City Council approved a site plan approving the construction of 7 one-story buildings for a total of 21,700 square feet for a ministorage facility. The buildings were proposed to be a variety of sizes with varying unit sizes. The property was proposed to be developed in two phases. Four buildings have been constructed on the property with the first phase. The site is managed completely electronically with no property management on site. 4. ANALYSIS: A. Level of City Discretion in Decision -Making The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. The City's discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that they meet the standards in the ordinance. B. Consistency with Ordinance Standards Site Plan The applicant would like to revise the previously approved site plan and replace the remaining proposed 3 buildings with a three-story climate controlled storage facility with a footprint of approximately 16,600 square feet. The building is generally in the area where the three buildings and drive aisles were proposed. The applicant has stated that the proposed building would contain approximately 400 units of various sizes. Gopher State Storage Site Plan and Variance Page 3 Building Height The General Industrial zoning district has a maximum building height of 50 feet. The building height will be approximately 48 feet at the highest point. The average height is approximately 44 feet. The proposed plan complies with the height requirements. The existing buildings on the property are approximately 19 feet tall. Building Coverage and Lot Coverage The ordinance limits the lot area to be covered by a building up to 40% and covered by impervious surface up to 80%. The proposed site plan complies with the coverage requirements. Phasing Plan The site plan is showing the building to be constructed in two phases. The first phase is proposed to be approximately 12,000 square feet and the second phase is proposed to be approximately 4,600 square feet. Staff recommends that the project be complete as one phase. As an alternative, the Planning Commission could simply approve phase one and any other phases would require site plan approval by the Planning Commission. If there is a desire to approve only phase one, staff would recommend architectural elements to be added to the building. There is more discussion related to architecture/building material under the Architecture/Building Material section of the staff report. Architecture/Building Materials The applicant is proposing a three-story climate controlled storage facility that has a flat roof. The entrance is on the south side of the building. There are offsets horizontally and vertically to break up the massing of the building. The corner details have windows showing storage unit doors. Staff recommends that no signage or images be allowed to be displayed in the windows. The plan shows an entrance canopy on the south side of the building that is colored red. The building materials proposed include precast concrete panels of various brown colors and various textures and red architectural metal. The existing buildings on site are constructed with integrally colored rock face block that are a buff and reddish color. The existing buildings have a pitched roof design. The gabled ends have reddish siding and the roofs are copper color. Since the applicant has changed the site plan and building design, it is a goal to ensure the proposed building is cohesive with the existing buildings and character of the area. Staff has been working with the applicant on the building design over the past several months. While staff believes there has been progress made on the architecture and an effort to design the building with quality materials and attractive details, it is not cohesive with the existing building on site in regards to building materials, colors, and proportion. Staff compared the proposed building Gopher State Storage Site Plan and Variance Page 4 materials and colors with the existing buildings and the proposed colors and materials do not match. It is in staff's opinion that there is more work on the building scale/massing, architecture, and building materials in order for the project to be cohesive and blend in with the existing buildings and surroundings. Staff recommends adding the materials used on the existing buildings on the proposed building. Staff would like to continue to work closely with the applicant on these items. Setbacks The proposed development complies with the 30 -foot front (south side) and side yard setbacks. The ordinance requires a side yard setback equal to the height of the building, in no case less than 10 feet. The building height is proposed to be approximately 48 feet at the highest point. 39 feet of right-of-way adjacent to TH 61 was dedicated to the City with the previous site plan approval. The right-of-way easement was required as part of the TH 61 corridor plan, which requires a 150 foot wide corridor for future expansion of the road. Since the right-of-way easement was dedicated, setback of the building is measured from the easement line, not the property line. The applicant is requesting approval of a variance from the front yard setback requirements to construct the building 0 feet from the right-of-way easement on the west side of the property, where 30 feet is required by ordinance. The building will be 39 feet from the west property line, consistent with the other existing buildings on the property. VARIANCE STANDARDS: The Board must review the requested variances with the standards outlined in Section 90-38 of the land use regulations. Staff used these standards to review the variance request and finds the following: (1) Law. The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term "Practical Difficulties" as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and; The property does have constraints due to regards to an existing drainage ditch, floodplain, high ground water, wetlands, right-of-way dedication, and a sanitary sewer pipe going through the property. This does limit the buildable area of the property. A Gopher State Storage Site Plan and Variance Page 5 three story building with a maximum height is allowed on in the zoning district as well as the use proposed. Placing a building in that location is a reasonable use of the property. b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and; The property has constraints due to the natural features on the property and the limited buildable area on the site. The right-of-way easement further limits the buildable area if all setback were meet, creating a very small area to build. The right-of-way easement was required to be dedicated with the approval of the previous site plan, creating a new setback requirement for the site. The building is 39 feet from the west front property line. c. Character of Neighborhood. The variance, if granted, will not alter the essential character of the neighborhood. The new proposed three story building would be in line with the existing buildings on the property. There are homes in the area that are a similar distance from Highway 61 as the proposed building. However, because of the scale of the building it is much taller than the adjacent buildings, it is not in character with the surrounding area. Because of the buildings proximity to the road the height of the building is not in character of the surrounding area. Staff recommends a few items be considered for the building to be more in character with the surrounding area: 1. The building could be lowered to two -stories making it more proportionate to the existing building and surrounding buildings. 2. Refine the architecture and building materials to be cohesiveiblend in with the existing buildings on the property. It is in staff's opinion that the variance, if granted, would not be in character of the surrounding area. Because the variance would not be in character of the surrounding area, it is in staff's opinion that there is not practical difficulties in meeting the ordinance standard. (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City's Comprehensive Plan. The spirit and intent of the ordinance is to have buildings a reasonable distance from the property lines and roads. The new proposed three story building would be in line with the existing buildings on the property. There are homes on the area that are a similar distance from Highway 61 as the proposed building. Allowing a building to be setback to align with the existing buildings would meet the spirit and intent of the ordinance. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. The use is allowed in the zoning district. Gopher State Storage Site Plan and Variance Page 6 (S) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. Part of the property is within the floodplain overlay district. The applicant will be required to obtain approval from FEMA with the project. The project is not expected to increase flood levels in the area. (6) Septic and Well Compliance. The sewage treatment system and water system of'the subject property is in compliance with city and state codes. The property can be served by City sewer and water. It is in staff's opinion that the project does not meet all the requirements necessary to approve the variance request. Street Access and Vehicle Circulation The site has access from 152nd Street North. There is one entrance into the site with a secure entrance for storage renters. The applicant as added a vehicle turnaround area on the northern portion of the drive aisles and parking areas. The applicant included the area for large vehicles and vehicles with trailers to turnaround more easily to access the storage units and entrance of the proposed storage building. Since the site plan has short dead end drive aisles due to the constraints of the site, this is a good addition to the site plan. The applicant is showing a 22 foot drive aisle, where 24 feet is required by ordinance. The drive aisle width shall be revised to be a minimum of 24 feet wide. Fencing/Screening The applicant is not proposing any outdoor storage. The applicant is proposing to replace the existing black chain link fence between the buildings along the west side of the property with decorative architectural black fence (like wrought iron fencing). The applicant has provided details of the style of fence. The applicant shall replace the existing chain link fence along the west property line with decorative architectural black fence. The area of the site containing the buildings and parking/driveways is proposed to be enclosed with black chain link fence. The plans shall be updated to show the fence locations. The applicant is proposing to have roof top mechanical equipment. The plans show the equipment to be screened by a five foot parapet on the east side of the building. It is unclear if this is for the rest of the sides of the building. The applicant should show the parapet height on other elevations. If the parapet remains at approximately five feet, staff would be comfortable Gopher State Storage Site Plan and Variance Page 7 with the screening method of the equipment. Prior to the issuance of a building permit, all roof top mechanical equipment shall be screened. The trash enclosure is proposed to be located adjacent to the building on the east side. It is proposed to match the integrally colored rock face block that are a buff and reddish color on the existing buildings. It is different material than the proposed building. The gate is proposed to be a reddish color to match the red on the building. Staff recommends that the gate be a brownish color to blend in with the materials uses for the trash enclosure. Landscaping and Lighting Section 90-181 of the Zoning Ordinance provides landscaping requirements for industrial developments. In order to meet the landscape requirements for the proposed site, 18 overstory deciduous trees, 10 coniferous trees, 10 ornamental trees, and 72 shrubs would be required to be installed. The applicant is not proposing to alter the existing landscape buffer on the east side of the property that borders the ditch. Because of this, the City has reduced the number of required trees by 10%. The applicant is proposing to install 10 overstory deciduous trees, 10 coniferous trees, 7 ornamental trees, and 69 shrubs. The landscape plan will need to be revised to include 7 more trees to meet the required number of trees. The landscape plan shall be revised to show areas that will be sodded and seeded. The applicant has stated the property will be irrigated to water the plants and grass. Because of the sewer easement and right-of-way dedication, the applicant has proposed landscaping and stormwater management within the easement areas. Staff is comfortable with this request and will add condition that an encroachment agreement is executed with the applicant. The ordinance requires lighting to consist of cut-off fixtures and for light cast on adjacent property and roads not to exceed 1/2 foot candle measured at the property line or 1 foot candle measured at the street's centerline. The applicant has proposed wall mounted downcast light fixtures on the building. It is unclear if the lighting plan meets the requirement of 1 foot candle at measured at the street's centerline. The plans shall be revised show the foot candle calculation measures that the street centerline and meet the requirements under City Code section 90-181 Lighting. The lights shall be of a color that matches the building materials used on the proposed building. Parking Section 90-253 of the City Code provides parking requirements. The existing use, did not require parking spaces. Users of the site will pull up next to their units, unload/load, and leave the site. Further, the City Code does not outline parking requirement for climate controlled storage facilities. The City Code states any use that is not listed in the parking ordinance shall be assigned a parking requirement by the Community Development Director or designee. The applicant is showing seven designated parking stalls for the use. It is in staff's opinion that the peak parking space demand on the property is likely very low. Staff is comfortable with the number of parking spaces provided. Gopher State Storage Site Plan and Variance Page 8 Trails Hardwood Creek Trail is on the west side of TH 61. The applicant is not proposing any sidewalks or trails with this development. Signage The Peloquin Industrial Park monument sign is located on this site. The applicant has stated that they plan to keep the sign on the property and may, at a later date, propose a new monument sign for the Industrial Park. Staff recommends that the applicant propose a monument sign design and location with this project. The applicant is showing signs on the building. Staff did not review the proportions of the signs on the building. A sign permit application will be required before the installation of any sign on the property or building. The signs will not be approved as part this request. Drainage/Grading The applicant has submitted their stormwater management plan for the site that meets the appropriate requirements for the overall development. A stormwater pond was previously constructed to meet stormwater management requirements than can accommodate the proposed changes to the site plan. Staff is still working on technical details on the stormwater management plan that may result is small revisions to the stormwater management plan. It is not expected to change the overall layout of the site plan. Utilities Water service will be connected to the existing watermain on the west side of the proposed building and the sanitary sewer service will be extended from the existing sanitary sewer on the east side of the proposed building. Wetlands In December 2016, the Technical Evaluation Panel (TEP) approved a wetland delineation for the site. The applicant is not proposing to impact any wetlands on site. Park Dedication Park dedication fees do not apply to industrial properties. Gopher State Storage Site Plan and Variance Page 9 5. CONCLUSION: It is in staff's opinion that the project does not meet all the requirements necessary to approve the applications. Staff believes that there are a few items to work through and plan revisions to be completed as outlined in the staff report. Most of these items are related to the architecture and building material. While staff believes there has been progress made on the architecture and an effort to design the building with quality materials and attractive details, it is not cohesive with the existing building on site in regards to building materials, colors, and proportion. Staff recommends the Planning Commission provide direction to staff on the plans. Staff recommends a few items be considered for the building to be more in character with the surrounding area: 1. STAFF RECOMMENDATION: Staff recommends the Planning Commission open the public hearing and take comments. Staff recommends that the Planning Commission provide comments to the applicant on the site plan and variance application plans. Staff recommends the Planning Commission table the requests until September 12, 2019, for staff to meet with the applicant and continue to work on items related to the architecture/building materials and revisions to the plans. We have reviewed the following information related to this application: Hugo Mini Storage Phase II Civil Plans, prepared by Advanced Engineering Concepts, dated July 12, 2019 Hugo Climate Control Storage - Preliminary Site Plan, prepared by CNH Architects, dated June 27, 2019 Based on the review of the documents, we offer the following comments related to this application: Civil Plans We are working directly with the applicant's engineer to finalize the grading, site, and utility plans, specifications, and details. We will issue the drainage permit and construction plan approvals once the remaining issues identified in the redline comments have been addressed. We do not expect that any remaining plan changes will have a significant impact on the plans. Water service will be connected to the existing watermain on the west side of the proposed building and the sanitary sewer service will be extended from the existing sanitary sewer on the east side of the proposed building. Stormwater Management 3. The applicant has submitted their Stormwater Management Plan for the site, meeting the appropriate storage, rate control, treatment, and volume reduction for the overall development. A stormwater pond was previously constructed to meet stormwater management requirements than can accommodate the proposed changes to the site plan. 4. The applicant will need to provide an as -built of the constructed stormwater pond. 5. Submit LOMR/CLOMR application and FEMA approval for the new building. The State Storage Group is a multi -state enterprise offering storage services in 25 locations across 8 states. The proposed 3 -story building would be built instead of three, one-story structures that have yet to be built from the original project, approved in 2017. When completed, the proposed building would contain approximately 400 units of various sizes. The existing site is a 3.3 acre lot zoned I-3 Industrial, with self storage being a permitted use in this zone. The proposed building has a 16,686 s.f. footprint, which, when added to the existing buildings, creates a lot coverage of buildings of 20%. The proposed impervious surface area, including the turnaround, creates a total impervious area coverage of 35%. The Landscape plan will address the planting requirements in the yards on all four sides. A single existing entrance will remain to the south onto 152nd Street North. The exterior of building includes architectural precast panels with strongly contrasting textures and colors. A limestone colored aggregate and matrix will be selected to best match the colors of the existing one story buildings. This predominant color will have a flat, exposed aggregate texture. This same color, given a much rougher corduroy texture, will be used at the base of the walls around most of the building, and up the stair tower, as an accented vertical element. A horizontal accent band will be created in the precast wall panels using a third texture, a flat troweled surface, that will receive a dark stain. This stained flat surface will also be used at the corner `towers'. The corner `towers' are accented in additional ways. They are offset 5 feet horizontally and vertically, to break up the massing and create a more traditional design element. In addition, they are clad with horizontal architectural metal panels with a deep groove profile. The metal panels are maroon in color to match the siding color on the existing storage buildings. The 5' space created in the offset is utilized internally to create display type windows showing storage unit doors as an indicator of the function of the building to passersby. The perspective rendering shows the interest the different materials and massing provides, creating a very nice -looking building while also meeting all the material and offsets requirements of the ordinance. In addition, an entrance canopy identifies the entry clearly, and provides shelter from the elements while loading and unloading. The civil engineering drawings indicate the grading, paving and drainage approach for the project. The proposed building will not add significantly to the impervious surface of the site, because this portion of the site was intended to be covered by impervious surfaces in the previous approved development plan. The existing drainage pond on the north side of the site will accommodate any increased impervious surfacing that is being proposed. The turnaround for trailered and emergency vehicles will add impervious surface that has been added to the site stormwater design. The proposed building is accessed from the existing entrance off 152nd Street North on the south side of the property. Additional dedicated parking stalls, and both a turnaround and NO Parking / Drive Lane have been added to ensure larger trailered, and emergency vehicles, can access the entrance of the proposed building. Self storage should generate a low level of parking demand. The 7 dedicated parking stalls should more than accommodate the traffic to this building. The site lighting will include all new highly efficient LED light fixtures with moderate lighting levels appropriate for this use. All light fixtures are building mounted, fully shielded, dark sky compliant and provide strong cut-off at the lot edges generally reaching less than 1 footcandle at the property line. We are applying for a variance from the 30' building setback requirement from the Forest Boulevard / Highway 61 R.O.W along the west side of the property. This would allow us to place the proposed 3 story building in alignment with the previously approved structures on the site, and to complete the build out of the property with a footprint similar to the previously approved site plan setbacks from 2017. Per requirements of Sec. 90-38 Variance C, we understand that: 1) it is permissible by law to allow this variance, noting that the existing storage buildings on site are located within the 30' building setback, 2) this is a reasonable use of the self storage business previously approved, and that a condition unique to this project is that the setback from Forest Boulevard / Highway 61 was changed as a condition of the previous development plan. If the full site had been completed according to that plan, no variance would have been required. We would like the opportunity to adjust the final build out of the site to meet the current market interest in climate -controlled storage. This would allow the business to better serve the community, and to accomplish this on one compact site. The proposed 3 story building also enhances the architectural character of the property, and better presents itself as part of the industrial zone in which it sits. 3) this keeps the spirit of the industrial zone, with low traffic flows, and warehouse function, but increases the street presence of the business toward Forest Avenue, 4) this is a permitted use in the industrial zone I-3, 5) all civil engineering has been done to meet stormwater and floodway requirements, 6) and that the water and sewer requirements will be met through connections to municipal utilities, and that the loads for both will be quite low for a building this size. In conclusion, the proposed Gopher State Storage climate -controlled building will provide for an attractive building and site to help meet the storage needs of Hugo residents. With the very low traffic generation and activity, the use will be a good fit for Forest Boulevard, while helping to create an attractive gateway to the industrial zone beyond.
