G.2 Approve Annual Performance Review for City Clerk Michele Lindau Michele Lindau was hired as the new City Clerk in the City of Hugo on January 1, 2008. Michele was originally hired by the City of Hugo as a part time employee in 1997 and a full time employee beginning May 1, 1999. City Administrator Bryan Bear recommends Council approve the annual performance review for City Clerk Michele Lindau. G.3 Approve Annual Performance Review for Public Works Worker Paul Christianson Paul Christianson was hired as a Public Works Worker on September 27, 2004. Public Works Director Scott Anderson recommends Council approve the annual performance review for Public Works Worker Paul Christianson. GA Approve Annual Performance Review for Finance and Public Works Administrative Assistant Amber Lozier Amber Lozier was hired as the Finance and Public Works Administrative Assistant on October 8, 2018. Amber Lozier had worked for the City as a temporary scanning technician since February, 2015, helping to scan documents for the Laserfiche project. Finance Director Ron Otkin recommends Council approve the Annual Performance Review for Amber Lozier. G.5 Approve Resolution Approving Preliminary Tax Lew for 2020 At its September 5, 2019, mid -year budget workshop, the City Council listened to a presentation from Finance Director Ron Otkin highlighting revenues and expenditures to -date as well as projections for the 2020 fiscal year. It was the consensus of the Council that the 2020 preliminary tax levy include additional funds, over and above the levy needed to keep a flat tax rate, for the potential issuance of bonds to finance improvements to Lions Park. The total proposed 2020 property tax levy of $8,313,784 will push the urban tax rate to 39.221% of tax capacity while the rural tax rate will increase to 35.329% of tax capacity. The Finance Director believes this levy is sufficient to fund the operating and capital budgets in 2020 and meets the objectives of the City Council and recommends the City Council approve the Resolution Approving the Preliminary Tax Levy Payable in 2020. G.6 Approve Quote from Excel AV Group for Upgrades in Council Chambers and Oneka Room Staff has solicited quotes for AV upgrades in the Council Chambers and the Oneka Room. Upgrades to the Council Chambers would include replacing the screens and projectors with monitors, adding a monitor for the podium presenter, upgrading the document camera, and upgrading the video inputs and switchers. Upgrades in the Oneka Room would include a motorized dropdown screen, ceiling mounted projector, and a switcher to accommodate various inputs to the system. Three quotes were received ranging from $75,605 to $48,865. The Finance Department confirmed there are sufficient funds in the budget to cover these projects. Staff recommends Council approve the low quote from Excel AV Group in the amount of $48,865. G.7 Approve Special Event Permit for Haunted Trail Events During October Kenneth Short, 5115 Sherwood Dr. S., Motley, MN, has applied for a Special Event Permit to hold a haunted trail walk to be known as "Hellwoods" to take place on the Woodloch Stable (Ramberg) property, 5676 170th Street North, and on approximately 35 acres of the Macalus property adjacent to the activity area on the Ramberg site. A Special Event Permit is required because there are expected to be 2,500 attendees over the month of October, there will be amplified sound, and it will extend after dark. This will be the third year this event has been held, and there have been no problems in the past. Staff recommends Council approve the Special Event permit for the haunted trail to be known as "Hellwoods" subject to conditions in the staff memo. G.8 Approve Resolution for No Parking on CSAH 7 In response to a resident's inquiry, staff examined the parking situation along CSAH 7 on the south side of Sunset Lake between Ingersoll Avenue and slightly south of 125th Street. The curve in the road and existing shoulder width makes it difficult for people to park along the road safely. Public Works Director Scott Anderson spoke to the County Traffic Engineer who agreed, and he asked the City to pass a no parking resolution and make a request to the County to install the signs. Staff recommends Council approve the resolution restricting parking along CSAH 7 in the area south of Sunset Lake. G.9 Approve Release of the Letter of Credit for OP3 Prairie Village LLC for Waters Edge ith Addition OP3 Prairie Village LLC has requested the City release their letter of credit for the Water's Edge 5th Addition Development. City staff has inspected the work and finds it acceptable. Staff recommends Council approve the release of the letter of credit being held for the constructed improvements in the Water's Edge 5th Addition Development. G.10 Approve Release of the Letter of Credit for OP3 Prairie Village LLC for Prairie Village 4th Addition OP3 Prairie Village LLC has requested the City release their letter of credit for the Prairie Village 4th Addition Development. City staff has inspected the work and finds it acceptable. Staff recommends Council approve the release of the letter of credit being held for the constructed improvements in the Prairie Village 4th Development. G.11 Approve Pay Voucher No. 5 for Water Tower No. 4 Improvement Proiect CB&I has submitted Pay Voucher No. 5 for work done on the Water Tower No. 4 improvement project. Staff finds it acceptable for work certified through August 23, 2019. Staff recommends Council approve payment of Voucher No. 5 in the amount of $402,779.28. G.12 Approve Pay Voucher No. 3 for 1301h Street Improvement Proiect Dresel Contracting, Inc., has submitted Pay Voucher No. 3 for work done on the 130th Street improvement project. Staff finds it acceptable for work certified through August 31, 2019. Staff recommends Council approve payment of Voucher No. 3 to Dresel Contracting, Inc., in the amount of $461,695.85. G.13 Approve Resolution Approving Site Plan and Variance for Gopher State Storage Minnesota Built Hugo Minnesota, LLC, is requesting approval of a site plan to construct a building with a footprint of approximately 16,600 square feet for a three-story climate controlled storage facility. The applicant is also requesting approval of a variance from the front yard setback requirements to construct the building 0 feet from the roadway easement on the west side of the property, where 30 feet is required by ordinance. The Planning Commission will consider this request on Thursday, September 12, 2019. Staff will provide an update to the City Council of the Planning Commission discussion and recommendation at its Monday, September 16, 2019, meeting. I.1 Metropolitan Council Water Efficiency Grant Application The Metropolitan Council is implementing a water efficiency grant program for municipalities looking to run their own grant or rebate programs. The Metropolitan Council will provide 75% of the program cost while municipalities must provide the remaining 25%. Staff is asking for approval to submit an application to the Metropolitan Council Water Efficiency Grant Program with the understanding that the City of Hugo is responsible for a local match. K.1 Yellow Ribbon Network Update Council Member Chuck Haas and Council Member Phil Klein will report to Council on the Yellow Ribbon Network activities held recently. L.1 Burger Night Tuesday, September 24, 2019 Council has scheduled a meeting to attend Burger Night on Tuesday, September 24, 2019, at 5 p.m. at the Hugo American Legion. The Department of Defense will be presenting Hugo with the Seven Seals Award. L.2 Movie Night Fridav, September 27, 2019 Outdoor Movie Night will be held on Friday September 27, 2109, at the Hanifl Fields. The movie showing will be "Aladdin". Approval of Agenda Weidt made motion, Klein seconded, to approve the agenda as amended by adding the scheduling of Burger Night next month and the HBA Breakfast next Tuesday. All Ayes. ISD 624 Bond Referendum — Superintendent Wayne Kazmierczak and Assistant Superintendent for Finance and Operations Tim Wald White Bear Lake School District Superintendent Dr. Wayne Kazmierczak and Assistant Superintendent for Finance and Operations Tim Wald presented information to Council on the bond referendum that will be going to the voters on November 5 related to facility improvements. Kazmierczak explained the driving factors for the $326 million bond referendum were in response to the new strategic plan, taking into consideration enrollment, safety and security, aging facilities, and the future of educational programming. The strategic planning process took place over a seven month period with 90 community members and several subcommittees. The plan impacts all the buildings throughout the district and would reduce the number of transitions between schools. A 375,000 square foot addition would be added to the north campus in White Bear Lake for all 9-12 grade students, and a new elementary school would be constructed in Hugo. Impact to voters would be $23 a month on the average home value of $275,000. They answered questions from the Council on how they were engaging the public moving forward saying they have done mailings, and there was an advocacy group working separately from the district. Kazmierczak said there are community meetings, and they are willing to speak to anyone about this. He invited people to reach out to him. Approve Amendment to JPA with Lino Lakes for Elmcrest Ave/Cedar St. Improvement Project At its March 19, 2019, meeting, Council approved a resolution entering into a Joint Powers Agreement with the City of Lino Lakes for a project to improve 24th Avenue/Elmcrest Avenue and East Cedar Street. Bids were open August 15th at Lino Lakes, and the Hugo Council considered them at their August 19th meeting. Council agreed the bids were too high, likely due to the time of year, and approved a resolution rejecting all bids. Lino Lakes City Council rejected the bids at their August 26, 2019, meeting. Council had directed staff to draft an amendment to the Joint Powers Agreement so the project would be rebid in the fall of 2019 and constructed in the spring of 2020. Adoption of the Consent Agenda approved the amendment to the Joint Powers Agreement with the City of Lino Lakes. Approve Special Event Permit for Octoberfest Celebration on Saturday, October 5, 2019 at Hugo Legion The Hugo American Legion had applied for a Special Event Permit to hold a craft show and Oktoberfest on Saturday, October 5, 2019. A Special Event Permit approved by Council was necessary because alcohol will be sold outdoors, there may be more than 200 people in attendance, it will extend after dark, and there will be amplified music. Vendors will be open from 9 a.m. to 2 p.m., and there will be music and a bean bag tournament until 7 p.m. Alcohol will be served outside in a confined area. The Legion had worked out details with neighboring Hugo City Council Meeting Minutes for September 3, 2019 Page 3 of 5 properties for parking. The event was held for the first time last year with no problems staff is aware of. Adoption of the Consent Agenda approved the Special Event Permit for the Hugo Legion for their Oktoberfest Event subject to the conditions in the staff memo. Approve Resolution Approving Variance for Rosemary Way Apartments MWF Properties had requested approval of a variance to allow an apartment building to be 45 feet and 7 inches tall at the highest point of the building (roof ridge), where 35 feet was required by ordinance. On April 15, 2019, the City Council approved a site plan and Conditional Use Permit for a three-story building with 45 units to be known as Rosemary Apartments. The property is located on Rosemary Way and west of Everton Avenue in the Frenchman Place development. At its Thursday, August 22, 2019, meeting, the Board held a public hearing and considered the request. The Board agreed that it met the criteria necessary to approve the request and unanimously recommended approval to the City Council. Adoption of the Consent Agenda approved RESOLUTION 2019-35 APPROVING A VARIANCE FOR MWF PROPERTIES FOR AN APARTMENT BUILDING ON THE PROPERTY LOCATED NORTH OF ROSEMARY WAY AND WEST OF EVERTON AVENUE NORTH. Approve Reduction in Letter of Credit for Adelaide Landing 311 and 4' Addition Adelaide Landing 3rd and 4th Additions had significant work completed to date, and the developer was requesting a reduction in the letter of credit for both the 3rd and 4t1i Additions. The current letter of credit for the 3rd Addition was in the amount of $842,744. Staff had inspected the work completed to date and recommended Council approve the reduction in the letter of credit to $225,150 based on the value of work remaining to be completed. The current letter of credit for the 4th Addition was in the amount of $463,267. Staff had inspected the work completed to date and recommended Council approve the reduction in the letter of credit to $334,767 based on the value of work remaining to be completed. Adoption of the Consent Agenda approved the reduction in the letters of credit. Yellow Ribbon Network Report Council Member Chuck Haas and Council Member Phil Klein reported to Council on the Yellow Ribbon Network activities held recently. Haas shared pictures of a recent packing event held in White Bear Lake hosted by Loukes who raised over 1,000 pounds of care package items. A thousand cupcakes set in the shape of a flag were donated by Grandmas Bakery. The White Bear Lions paid for the postage. The last Burger Night sponsor was Xcel Energy, and they served 160 burgers. Haas talked about Xcel's Dollars for Doing program where the company matches employee donations. Haas attended the MN State Fair Military Appreciation Day to tell the Yellow Ribbon story and gain support for the troops. Jdog donated a chair to a veteran. The YRN helped organize a pheasant hunt for 24 soldiers in the St. Cloud area. On September 28th, the Fry Group will be hosting their Ribfest. All donations will go to the YRN. Also on March 28t1i is the Military Youth Hunt at Wild Wings. The YRN will be sponsoring a family pre -deployment picnic and will be providing lunch for 2,500 people. SEPTEMBER 5.2019 — 7 P.M. Mayor Weidt called the meeting to order at 7:00 p.m. PRESENT: Haas, Klein, Miron, Petryk, Weidt ABSENT: None STAFF PRESENT: City Administrator Bryan Bear, Finance Director Ron Otkin, Finance Coordinator Anna Wobse, Parks Planner Shayla Syverson, City Clerk Michele Lindau Finance Director Ron Otkin began by talking about a recent news article regarding the City of Plymouth that used budget surpluses to cover the cost of a new maintenance facility. He explained this was done by conservatively budgeting revenues and contingency budgeting for expenditures. He stated that Hugo has been using this method for decades, which assures either a balanced budget or a surplus that can be used for capital items. It was his recommendation to continue using this technique. He is estimating a budget surplus of $173,556 and is recommending this be transferred to the building maintenance fund. He proposed using part of these building maintenance funds in 2020 for repairs to the parking lot, sidewalks, and exterior of the building at the fire station. Ron explained that building permit fees are a primary source of revenue. This will be a topic at the next legislative session due to a report from the Housing Affordability Institute claiming cities are overcharging permit fees, driving up the cost of new homes, and that not all cities are filing the required reports. Ron stated that Hugo has complied with reporting requirements since they began in 2002, and that cumulatively over 17 years the revenue from building permits haven't completely covered the cost of providing inspection services. Ron noted that Washington County estimates the City's market value and tax capacity will increase by 10%. To keep a flat tax rate, the proposed levy cannot exceed $7,757,651. Ron presented a proposed 2020 tax levy equaling that amount. He reviewed the City's bonded debt stating the City will be making the final payments on all but one bond issue next February leaving a gross bonded debt of $445,000. The debt service levy will drop to $63,235 in 2020. Ron reviewed the street Capital Improvement Project stating the roadways had been reviewed and the new street CIP showed Goodview Avenue needed to be done next year. He anticipated the City will be able to finance all projects under the estimated schedule. He reviewed the five year financing plans for the equipment purchasing fund and storm water fund. He explained the park levy for 2020 will remain at $92,000 unless it is increased by Council. These funds are used primarily for neighborhood parks. The fire relief levy will be banked into a separate special revenue fund and that no municipal contribution is required in 2020. Ron talked about the expansion to Public Works saying the space needs study is very preliminary. Ron stated the proposed levy includes $274,626 to begin a revenue stream for a possible bond issue to finance expansion and improvements to the facilities. Hugo City Council Meeting Minutes for September 7, 2019, Midyear Budget Review Page 2 of 3 Ron reviewed the general budget and personnel costs, and recommended redirecting funds from the planner position to a building department position for a person to shadow Building Official Chuck Preisler, who will be retiring in November, 2020. No changes will be made to the high deductible health plan but insurance premiums will be increasing by 10.5%. The general budget also includes additional funds for law enforcement and street department materials. For the second consecutive year $200,000 has been set aside for flat tax rate stabilization. Ron reviewed non -tax levy revenues, which included eliminating gaming fees. Ron proposed a total tax levy of $7,757,651, which would not increase the flat tax rate of 36.33%. Ten percent ($767,665) of the total tax levy is being paid for through fiscal disparities. To keep the same tax rate, the tax on a median value home will increase by $72.68, which is still lower than most surrounding communities. Parks Planner Shayla Denaway presented to Council the Parks Commission community park funding priorities. Lions Park has the highest priority with improvements estimated to cost $7,700,000. Five phases were identified in the feasibility study, and there was discussion that roadway and stormwater could be done with development or other funds. Plans for Irish Avenue Park included interim improvements totaling $250,000 to enhance current use. There was no master plan for that park, and there was a need to initiate discussions with neighbors. A master plan for Clearwater Creek Preserve was approved last year, and the Parks Commission would like to proceed with Phase A (trails, boardwalk, signage, and seating) and Phase D (bridge and boardwalk/trail to Fenway Boulevard). The total cost would be $1,850,000. Other phases would best be done when 140ffi Street is extended. Ron discussed with Council the possibility of increasing the proposed tax levy to include a revenue stream for park improvement bonds of approximately $7.2 million. The revenue stream needed to fund this bond issue would be $556,133. Ron stated he was looking for a maximum tax levy to certify to the County. The levy can be lowered in December after the Truth in Taxation hearing, but it cannot be increased. Council also discussed the timing of improvements to Lions Park. City Administrator Bryan Bear talked about the last time a road project in that area was talked about, the residents on 145th Street were not in favor of it, so that street could be eliminated. The other street and stormwater improvements related to the park could possibly be paid for through development or other funds. The CIP did not include those streets but they could be added. The adjacent land has not developed partly due to the street and infrastructure costs. A cost -share could help move the project forward. It would be a timing issue. Council Member Petryk talked about the White Bear School District Levy to be brought to the voters in November, and if that passes, residents would also see an increase in school district taxes. She also questioned if all amenities planned for the park were necessary and if the City needed to bond that much for the park. Shayla replied that the plan is a few years old and needed to be revisited. Mayor Weidt asked for consensus to add $556,133 to the 2020 preliminary tax levy to begin the revenue stream for a $7.2 million bond issue for community parks. At the mid -year budget workshop it was the consensus of the City Council that the 2020 preliminary tax levy provide additional funds for the potential issuance of Tax Abatement Bonds to finance improvements to Lions Park and for the potential issuance of Capital Improvement Bonds to finance improvements to the Public Works Facilities. The total proposed 2020 property tax levy of $8,313,784 will increase the urban tax rate to 39.221% of tax capacity while the rural tax rate will increase to 35.329% of tax capacity. The proposed tax levy is broken down into the following major categories: Required Levies Debt Service Levy $ 63,235 Discretionary Levies General Fund Levy $ 5,650,000 Stormwater Utility Levy $ 278,788 Firefighter's Relief Levy $ 18,002 Equipment Purchasing Levy $ 221,000 Park Improvement Levy $ 92,000 Future PW Facility Bonds $ 274,626 Future Lions Park Abatement Bonds $ 556,133 Capital Improvement Levy $ 1,160,000 Total Discretionary Levies $ 8,250,549 Total Certified Tax Levy $ 8,313,784 Debt Service Tax Levies This levy is required under the terms of the 2011 Improvement Bond bondholder agreement. These taxes are used to make principal and interest payments on general obligation bonds issued by the city. The total levy for debt service in 2020 is $63,235. 2020 Proposed Tax Levy Page 2 General Operating Levy The levy for general operating purposes is $5,650,000, an increase of $280,974 from the previous year. This levy is used, along with non -property tax revenues, to fund general government, public safety, public works, and other city operations. The increase is needed to balance the general fund with no structural deficit (i.e. transfers from other funds). The increase in this levy will be used primarily for the following purposes: The proposed tax levy contains a $200,000 appropriation to provide for flat tax rate stabilization should the taxable market value of property decline due to an economic downturn. It also provides for step increases, a 3% cost -of -living adjustment, and health insurance premiums for eligible employees for the 2020 calendar. Storm Water Improvement Levy This levy is needed to fund water reuse projects and improvements to our drainage systems, including the repair and/or replacement of catch basins. Eventually funds will be needed to maintain our system of drainage ponds. This levy is in the amount of $278,788. Fire Relief Levy This levy is used to accumulate funds to meet the city's future pension obligations for the Hugo Firefighter's Relief Association. Taxes are levied in an amount equal to the PERA employer percentage as applied to total fire department wages and salaries. These funds are placed in a special revenue fund and can be only be used to make mandatory contributions to the pension fund. The levy for 2020 is $18,002. Equipment Purchasing Levy This levy, in the amount of $221,000, is needed to replace big ticket equipment items in the Public Safety and Public Works Departments that exceeded their useful life. These items include plow trucks, pickup trucks, dump trucks, and firefighting vehicles. Park Improvement Levy This levy, first instituted in 2007, is used to finance capital improvements to the city's neighborhood park system. The proposed park improvement levy for next year is $92,000. 2020 Proposed Tax Levy Page 3 Levies for Future Bond Issues The proposed levy includes $830,759 to begin revenue streams for the eventual issuance of bonds to expand our Public Works Facilities and for improvements to Lions Park. This levy represents the annual tax levy needed to make the bond payments on approximately $10,780,000 of new debt. Capital Improvement Levy This levy, first instituted in 2006, is used to defray a portion of the city's share of street reconstruction projects. The proposed levy for 2020 is $1,160,000. When combined with state construction aid, these funds will allow us to continue improving our network of streets without the need to issue additional debt. Certified Property Tax Levy To recap, the total amount of property taxes to be certified to the county for inclusion in the truth -in - taxation notices amounts to $8,313,784, the particulars of which have been identified above. Fiscal Disparities Fiscal Disparities is a program designed by the state legislature to distribute a portion of growth in commercial and industrial tax values to cities in the seven -county metropolitan area. Historically, the City of Hugo has been a "winner' in that we receive more value from the pool than we contribute. Washington County has certified the payable 2020 amount of $767,665, an increase of $54,127 from the previous year. This amount serves to lower the total property tax dollars paid by residents of the city. The county estimates an increase in the total tax capacity of 10.03%. Thus, the preliminary levy needs to be set at the maximum amount that the Council determines is appropriate. Conclusion The tax levy (as proposed herein) provides for a balanced operating budget while meeting the Council's objectives to begin revenue streams for improvements to the public works facilities and Lions Park. The tax levy provides funds to maintain a flat tax rate should the total taxable value of properties in the city decrease due to a downturn in the local economy. The city can continue neighborhood street reconstruction projects while buying down our existing debt. BACKGROUND: Kenneth Short has applied for a Special Event Permit to hold haunted trail walks, to be known as "Hellwoods" during the month of October at Woodloch Stables and the adjacent Macalus property. Hugo City Code requires a Special Event Permit approved by Council for any event that expects over 200 people in attendance, includes amplified music or sound, and/or extends after dusk. 2. DESCRIPTION OF EVENT: "Hellwoods" is a Halloween event to take place on the Woodloch Stable (Ramberg) property, 5676 170th Street North, and on approximately 35 acres of the Macalus property adjacent to the activity area on the Ramberg site. The event will take place on Fridays and Saturdays during the month of October and possibly Thursday, October 31st and the first weekend in November, dependent on sales. The event is'expected to draw approximately 2,500 people. "Hellwoods" is for individuals 14+ years of age and consists of a 35-45 minute haunted walk through the woods on an established trail. The haunted trail will be open from dust with no entry after 11 p.m. All visitors will be off the premises by midnight. Below are details of the event. • Cost Admission fee for the Woods of Terror will be $20/person. There is no charge for parking. • Traffic/Parking Parking on the site should be sufficient to move cars off the street and into the parking lot efficiently. The parking lot will be located on the event property. Parking will be prohibited along 170th Street. If there are issues with traffic backup on 170th Street, the City will require an amendment to their plan to provide for more parking and/or more parking attendants. There will be a lighted walkway from the lot to the activity area. • Structures, Tents, and Generators No permanent structures will be constructed as part of this event. The main office will be a movable shed and contain first aid equipment, and other items that need to be secure. The number of tents, sizes, and locations has not yet been determined. All areas containing generators will all be roped off to the public, and electrical permits will be secured from the City as necessary. • Bathroom facilities/Waste Management Applicant will provide five porta potties with wash stations, which is recommended for a crowd of 750 people. Additional porta potties will be added if necessary. Applicant will hire a waste management company for proper waste disposal. • Food and Liquor No alcohol will be permitted on the premise and those suspected of being under the influence will be turned away. Pop and water will be available for sale. • Security No security issues are anticipated; however, the property owners, City of Hugo, or the Washington County Sheriff's Office has the ability to require deputies to be hired if warranted. Activities related to this event will monitored, and changes to this permit regarding security will be made if necessary • Medical/Emergency Management First aid kits will be available onsite. Vehicle access will be available to all areas to allow for emergency response. All staff have radio contact throughout the area and weather will be monitored. Excessive rain or lightening will close the event. Fire extinguishers will be available at all campfire locations. • Wetland Permit There are no anticipated impacts to wetlands on the property according to the submitted site plan. The applicant and property owner are aware that a wetland permit will be necessary prior to any activity in the wetland areas. 3. REQUIREMENTS: The applicant has provided the City the completed permit and permit fee. In accordance with this permit, the applicant shall conduct the event as described in the application herein and meet the following conditions: Prior to the Event 1. The applicant will provide the City a signed Hold Harmless Agreement. 2. The applicant will provide a Certificate of Liability Insurance showing the City of Hugo as additionally insured for this event. 2 3. The applicant will secure an electrical permit from the City. 4. No advertising signs for the event are allowed off the property without appropriate approval. 5. No permanent structures will be constructed as part of this event. All props, tents, and canopies will be properly installed and secured and kept away from flames. Applicant will provide staff information on these items for approval. 6. Applicant will work with the City to determine if an electrical permit is necessary for the use of the generators. 7. A walk-through of the site will be scheduled with City staff, including the Hugo Fire Marshal and Washington County Sheriff's Office. 8. The applicant will comply with all additional recommendations made by staff, the Hugo Fire Marshal, and/or the Washington County Sheriff's Office. 9. Trails will be clear of all obstacles and mulch will be placed in areas as necessary. 10. Applicant will provide area for overflow parking 11. Applicant will provide location of campfire(s), tiki lights, and other possible fire hazards for approval of the Fire Marshal. During the Event 12. The applicant shall conduct the event in accordance with the approved plans submitted with the application. 13. Parking area will be monitored, and parking attendants will direct traffic to approved locations. 15. All areas containing recreational fires will be monitored at all times by a staff member. 16. All campfires will comply with the Hugo Fire Department's rules for recreational fires. 20. All amplified sound from the event will be at a level to not be heard off the property. 21. All signage will be removed immediately after the event. 24. All trash will be removed from the site, including all parking areas and any trash left on public streets from the event. 4. CONCLUSION/RECOMMENDATION: This event was held the past two years with no impacts to the health, safety, and welfare of the residents of Hugo and participants of this event. In the past, many rodeo events with large crowds have been held on Woodloch Stable property and staff feels it is a suitable site for the "Hellwoods" event. The event will be regularly monitored for impacts to neighbors and traffic and/or unsafe conditions, and the applicant may be required to make changes or shut down the event. Minor changes to this permit may be approved by City staff. Changes staff deems to be significant will require Council review and approval. There was a great turn out with over 2,000 customers and had no accidents or injuries. Hellwoods trail will be on Fred Macalus 35 wooded acres adjacent to Spooktacular's event and parking. There will be overflow parking at Dead Broke Arena of 250 extra parking spots. Request for site plan approval for a climate controlled self -storage building and a front yard setback variance for the property located at 5560 152nd Street North. DATE: September 12, 2019, for the City Council Meeting of September 16, 2019 ZONING: General Industrial (1-3) LAND USE: Industrial (I) 120-DAY REVIEW DEADLINE: October 9, 2019 The Planning Commission will consider this request on Thursday, September 12, 2019. Staff will provide an update to the City Council of the Planning Commission discussion and recommendation at its Monday, September 16, 2019, meeting. 1. UPDATE FROM AUGUST 22, 2019, PLANNING COMMISSION MEETING: Staff provided background on the request and recommended that the item be tabled to allow the applicant to work with staff on the architecture and building material. The Planning Commission recommended that the project be completed in one phase and that the applicant work with staff on revisions to ensure the proposed building is cohesive with the existing buildings on the property. The Planning Commission tabled the request until September 12, 2019. The applicant has been working with staff over the last couple weeks on the items outlined in the staff report and as recommended by the Planning Commission. The applicant has revised the plan to include the following: • The project will be completed in one phase. • The tip -up concrete panel colors have been revised to match the rock -faced block colors on the existing buildings. Architectural metal will also be added to the existing buildings to be more cohesive with the proposed building. • The applicant has revised the architecture along the west side of the building to break up the massing of the building. • The applicant has added base details to the main entrance of the building. • The exact colors and textures of the building materials shall be reviewed and approved by staff prior to the issuance of a building permit. The applicant has made changes to the architecture and building materials and has done a good job working on making the project cohesive. The applicant is proposing to build the project in one phase to complete the architectural details of the building. 2. DESCRIPTION OF REQUEST: The applicant is requesting approval of a site plan to construct a building with a footprint of approximately 16,600 square feet for a three-story climate controlled storage facility. The applicant is also requesting approval of a variance from the front yard setback requirements to construct the building 0 feet from the roadway easement on the west side of the property, where 30 feet is required by ordinance. The building will be 39 feet from the west property line, consistent with the other existing buildings on the property. The 3.27 acre lot is generally located north of 152" d Street and east of Forest Boulevard within the Peloquin Industrial Park. 3. CONTEXT: A. Surrounding Land Use and Zoning The properties to the east and south are part of the Peloquin Industrial Park. The properties are zoned General Industrial (I-3) and are generally occupied by industrial businesses, however there are some single family homes located within the General Industrial zoning district to the south. The properties to the north are zoned General Business (C-2) and are occupied by single family homes. The property to the west, across TH 61, is zoned Single Family Detached Residential (R-3) and currently has a single family home with some agricultural activities occurring on the property. B. Existing Site Characteristics The 3.27 acre property does contain some challenges in regards to an existing drainage ditch, floodplain, high ground water, wetlands, right-of-way dedication, and a sanitary sewer pipe going through the property. The stormwater management facilities have been constructed on the property and the buildable area is generally flat. There are four existing buildings on the property. BACKGROUND: In 2017, the City Council approved a site plan allowing the construction of 7 one-story buildings for a total of 21,700 square feet for a ministorage facility. The buildings were proposed to be a variety of sizes with varying unit sizes. The property was proposed to be developed in two phases. Four buildings have been constructed on the property with the first phase. The site is managed completely electronically with no property management on site. 5. ANALYSIS: A. Level of City Discretion in Decision -Making The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. The City's discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that they meet the standards in the ordinance. B. Consistency with Ordinance Standards Site Plan The applicant would like to revise the previously approved site plan and replace the remaining proposed 3 buildings with a three-story climate controlled storage facility with a footprint of approximately 16,600 square feet. The building is generally in the area where the three buildings and drive aisles were proposed. The applicant has stated that the proposed building would contain approximately 400 units of various sizes. Building Height The General Industrial zoning district has a maximum building height of 50 feet. The building height will be approximately 48 feet at the highest point. The average height is approximately 44 feet. The proposed plan complies with the height requirements. The existing buildings on the property are approximately 19 feet tall. Building Coverage and Lot Coverage The ordinance limits the lot area to be covered by a building up to 40% and covered by impervious surface up to 80%. The proposed site plan complies with the coverage requirements. Gopher State Storage Site Plan and Variance Page 4 Architecture/Building Materials The applicant is proposing a three-story climate controlled storage facility that has a flat roof. The entrance is on the south side of the building. There are offsets horizontally and vertically to break up the massing of the building. The corner details have windows showing faux storage unit doors. Staff recommends that no signage or images be allowed to be displayed in the windows. The plan shows an entrance canopy on the south side of the building that is colored red. The building materials proposed include precast concrete panels of brown/buff colors with various textures and red architectural metal. The existing buildings on site are constructed with integrally colored rock face block that are a brown/buff and reddish color. The existing buildings have a pitched roof design. The gabled ends have reddish siding and the roofs are copper color. The garage doors on the buildings are red. Since the applicant has changed the site plan and building design, it is a goal to ensure the proposed building is cohesive with the existing buildings and character of the area. The Planning Commission recommended that the applicant work with staff on revisions to the plans to ensure the proposed building is cohesive with the existing buildings on the property. The applicant has been working with staff over the last couple weeks on the items outlined in the staff report and as recommended by the Planning Commission. It is in staff s opinion that there has been progress made on the architecture and an effort to design the building with quality materials and attractive details that are cohesive with the existing building on site in regards to building materials and colors. Gopher State Storage Site Plan and Variance Page 5 Setbacks The proposed development complies with the 30-foot front yard (south side) and side yard (east and north) setbacks. The ordinance requires a side yard setback equal to the height of the building, in no case less than 10 feet. The building height is proposed to be approximately 48 feet at the highest point. 39 feet of right-of-way adjacent to TH 61 was dedicated to the City with the previous site plan approval. The right-of-way easement was required as part of the TH 61 corridor plan, which requires a 150 foot wide corridor for future expansion of the road. Since the right-of-way easement was dedicated, setback of the building is measured from the easement line, not the property line. The applicant is requesting approval of a variance from the front yard setback requirements to construct the building 0 feet from the right-of-way easement on the west side of the property, where 30 feet is required by ordinance. The building will be 39 feet from the west property line, consistent with the other existing buildings on the property. VARIANCE STANDARDS: The Board must review the requested variances with the standards outlined in Section 90-38 of the land use regulations. Staff used these standards to review the variance request and finds the following: (1) Law. The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term "Practical Difficulties" as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and; The property does have constraints due to regards to an existing drainage ditch, floodplain, high ground water, wetlands, right-of-way dedication, and a sanitary sewer pipe going through the property. This does limit the buildable area of the property. A three story building with a maximum height is allowed on in the zoning district as well as the proposed use. Requesting a building to be placed the proposed location is a reasonable use of the property. Gopher State Storage Site Plan and Variance Page 6 b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and, The property has constraints due to the natural features on the property and the limited buildable area on the site. The right-of-way easement further limits the buildable area if all setback were meet, creating a very small area to build. The right-of-way easement was required to be dedicated with the approval of the previous site plan, creating a new setback requirement for the site. The building is 39 feet from the west front property line at the same setback as the existing buildings. c. Character ofNeiahborhood. The variance, ifgranted, will not alter the essential character of the neighborhood. The proposed three-story building would be in -line with the existing buildings on the property. There are homes in the area that are a similar distance from Highway 61 as the proposed building. However, the building it is taller than the adjacent buildings. The proposed building materials and architecture breaks up the large massing of the building and helps the building be more cohesive with the existing buildings. In the General Industrial (I-3) zoning district 50 foot tall buildings are allowed. At the time other properties in the industrial park are developed/redeveloped, 50 foot tall building could be proposed. It is in staff s opinion that the variance, if granted, would be in character of the surrounding area. It is in staff s opinion that there are practical difficulties in meeting the ordinance standard. (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City's Comprehensive Plan. The spirit and intent of the ordinance is to have buildings a reasonable distance from the property lines and roads. The new proposed three story building would be in -line with the existing buildings on the property. There are homes on the area that are a similar distance from Highway 61 as the proposed building. Allowing a building to be setback to align with the existing buildings would meet the spirit and intent of the ordinance. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. The use is allowed in the zoning district. (5) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. Part of the property is within the floodplain overlay district. The applicant will be required to Gopher State Storage Site Plan and Variance Page 7 obtain approval from FEMA with the project. The project is not expected to increase flood levels in the area. (6) Septic and Well Compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The property can be served by City sewer and water. It is in staffs opinion that the project meets all the requirements necessary to approve the variance request. Street Access and Vehicle Circulation The site has access from 152nd Street North. There is one entrance into the site with a secure entrance for storage renters. The applicant as added a vehicle turnaround area on the northern portion of the drive aisles and parking areas. The applicant included the area for large vehicles and vehicles with trailers to turnaround more easily to access the storage units and entrance of the proposed storage building. Since the site plan has short dead end drive aisles due to the constraints of the site, this is a good addition to the site plan. Fencing/Screening The applicant is not proposing any outdoor storage. The applicant is proposing to replace the existing black chain link fence between the buildings along the west side of the property with decorative architectural black fence (like wrought iron fencing). The applicant has provided details of the style of fence. The area of the site containing the buildings and parking/driveways is proposed to be enclosed with black chain link fence. The plans shall be updated to show the fence locations. The applicant is proposing to have roof top mechanical equipment. The plans show the equipment to be screened by a five foot parapet on the east side of the building. It is unclear if this is for the rest of the sides of the building. The applicant should show the parapet height on other elevations. If the parapet remains at approximately five feet, staff would be comfortable with the screening method of the equipment. Prior to the issuance of a building permit, all roof top mechanical equipment shall be screened. The trash enclosure is proposed to be located adjacent to the building on the east side. It is proposed to match the integrally colored rock face block that are a buff and reddish color on the existing buildings. It is different material than the proposed building. The gate is proposed to be a reddish color to match the red on the building. Landscaping and Lighting Section 90-181 of the Zoning Ordinance provides landscaping requirements for industrial developments. In order to meet the landscape requirements for the proposed site, 18 overstory Gopher State Storage Site Plan and Variance Page 8 deciduous trees, 10 coniferous trees, 10 ornamental trees, and 72 shrubs would be required to be installed. The applicant is proposing to keep the trees and landscape buffer on the east side of the property that borders the ditch. Because of this, the City has reduced the number of required trees by 10%. The applicant is proposing to install 10 overstory deciduous trees, 10 coniferous trees, 7 ornamental trees, and 69 shrubs. The landscape plan will need to be revised to include 7 more trees to meet the required number of trees. The landscape plan shall be revised to show areas that will be sodded and seeded. The applicant has stated the property will be irrigated to water the plants and grass. Because of the sewer easement and right-of-way dedication, the applicant has proposed landscaping and stormwater management within the easement areas. Staff is comfortable with this request and will add condition that an encroachment agreement is executed with the applicant. The ordinance requires lighting to consist of cut-off fixtures and for light cast on adjacent property and roads not to exceed 1/2 foot candle measured at the property line or 1 foot candle measured at the street's centerline. The applicant has proposed wall mounted downcast light fixtures on the building. It is unclear if the lighting plan meets the requirement of 1 foot candle at measured at the street's centerline. The plans shall be revised show the foot candle calculation measures that the street centerline and meet the requirements under City Code section 90-239 Lighting. The light fixtures shall be of a color that matches the building materials used on the proposed building. Parking Section 90-253 of the City Code provides parking requirements. The existing use, did not require parking spaces. Users of the site will pull up next to their units, unload/load, and leave the site. Further, the City Code does not outline parking requirement for climate controlled storage facilities. The City Code states any use that is not listed in the parking ordinance shall be assigned a parking requirement by the Community Development Director or designee. The applicant is showing seven designated parking stalls for the use. It is in staff s opinion that the peak parking space demand on the property is likely very low. Staff is comfortable with the number of parking spaces provided. Trails Hardwood Creek Trail is on the west side of TH 61. The applicant is not proposing any sidewalks or trails with this development. Signage The Peloquin Industrial Park monument sign is located on this site. The applicant has stated that they plan to remove the existing pylon sign and will propose a new monument sign at a later time. Gopher State Storage Site Plan and Variance Page 9 The applicant is showing signs on the building. Staff did not review the proportions of the signs on the building. A sign permit application will be required before the installation of any sign on the property or building. The signs will not be approved as part this request. Drainage/Grading The applicant has submitted their stormwater management plan for the site that meets the appropriate requirements for the overall development. A stormwater pond was previously constructed to meet stormwater management requirements than can accommodate the proposed changes to the site plan. Staff is still working on technical details on the stormwater management plan that may result is small revisions to the stormwater management plan. It is not expected to change the overall layout of the site plan. Utilities Water service will be connected to the existing watermain on the west side of the proposed building and the sanitary sewer service will be extended from the existing sanitary sewer on the east side of the proposed building. Wetlands In December 2016, the Technical Evaluation Panel (TEP) approved a wetland delineation for the site. The applicant is not proposing to impact any wetlands on site. Park Dedication Park dedication fees do not apply to industrial properties. 6. CONCLUSION: The applicant has made changes to the architecture and building materials and has done a good job working on making the project cohesive with the existing buildings. The applicant is proposing to build the project in one phase to complete the architecture of the building. It is in staff's opinion that there has been progress made on the architecture and an effort to design the building with quality materials and attractive details that are cohesive with the existing building on site in regards to building materials and colors. It is staff opinion that the applicant meets the requirements necessary to approve the site plan and vanance request. 7. STAFF RECOMMENDATION: Staff recommends approval of the site plan and variance requests for the three-story climate controlled storage facility located at 5560 152nd Street North. The new proposed three story building would be in line with the existing buildings on the property. There are homes on the area that are a similar distance from Highway 61 as the proposed building. Allowing a building to be setback to align with the existing buildings would meet the spirit and intent of the ordinance. 7. The use is allowed in the zoning district. 8. Primarily, the overall expression has migrated away from a more modernist expression with floating geometric shaped box elements. The general architectural language was changed to one using more traditional elements, albeit simplified, and appropriate for this site and use. This architectural approach is more in keeping with some of the other commercial developments in the City of Hugo. To that end, the corner boxes at each end of the west elevation were redesigned as `towers'. This allowed for variation in parapet height, as well as allowed the fagades to step in an out. Strong corner elements are a common approach in traditional building, accenting the place where two sides of the building come together, and add depth, shadow, and three-dimensional expression. In addition, the bottom 4' of the wall has been changed to a corduroy pattern, cast into the panel at fabrication. Again, this is a common approach in traditional building, to make the lowest part of the wall of a rougher material or texture where the building touches the ground. This provides contrast and helps set off the upper parts of the wall as more refined. To match the existing buildings, the precast wall panels will be designed in consultation with the fabricator and the City Planner, to find a concrete, aggregate and pigment mix which approximates the field color of the rock faced block on the existing one-story buildings. The copper color of the existing roofs will also be matched in the wall parapet caps, to help integrate the two buildings for color and material. The proposed maroon colored horizontal metal panels will be added to the gable ends of the one-story buildings, to provide a better a match between the two buildings as well. And finally, the proposed darker accent color, a concrete stain, will be color -matched to the color of the horizontal band of rock faced block on the existing one-story buildings. In conclusion, the proposed Gopher State Storage climate -controlled building will use materials that are either match exactly, or are chosen in the same color palette to approximate the colors of the existing buildings. The Ownership team will continue to work with Staff to ensure the final color selections are appropriate for the site and its surrounding. OVERVIEW: The Metropolitan Council will implement a water efficiency grant program effective September 30, 2019 to June 30, 2022. Grants will be awarded on a competitive basis to municipalities that manage municipal water systems. The Council will provide 75% of the program cost; the municipality must provide the remaining 25%. Municipalities will use the combined Metropolitan Council funds to run their own grant or rebate programs. Grants will be made available in amounts ranging from $2,000 to $50,000. Grantees will be required to provide estimated water savings achieved through this program for Clean Water, Land & Legacy Amendment reporting purposes. The Water Efficiency Grant Program will be administered by Metropolitan Council Environmental Services (MCES) and will be funded with $750,000 appropriated by the 2019 Minnesota Legislature. The goal of the water efficiency grant program is to support technical and behavioral changes that improve municipal water use efficiency. Grants are only for water efficiency programs offering rebates or grants to property owners who are customers of the municipal water supply system and who replace specified water using devices with approved devices that use substantially less water. For example, replacing an old toilet or irrigation controller with a newer, water efficient device. 2. BACKGROUND: The Metropolitan Council administered a water efficiency grant program from 2015 to 2017 using $500,000 from the Clean Water Fund. The City of Hugo was one of 19 municipalities to participate in the previous program. With the money funded, Hugo provided a program that offered rebates to residents who purchased WaterSense labeled toilets, irrigation controllers, or clothes washing machines and replaced old, inefficient products. Page 2 3. 2019 GRANT APPLICATION: Staff is proposing to submit an application to the Metropolitan Council Water Efficiency Grant Program. The proposed grant amount from the City is $48,750, with the understanding that Hugo is responsible to provide a local match of $16,250. This money has been set aside in the water utility fund. If the grant is awarded, the City could use the money to offer a grant program to residents. 4. PROPOSED GRANT PROGRAM: Staff has come up with a proposed water efficient program for the grant. The awarded funds could be used to purchase 350 smart irrigation controllers and allow residents to purchase controllers at a discounted rate. By replacing a standard clock timer with an Environment Protection Agency (EPA) WaterSense labeled irrigation controller, an average household can save up to 8,800 gallons of water annually. If 350 Hugo households replace their irrigation controllers with an EPA WaterSense labeled controller, three million gallons of water can be saved a year. A typical smart irrigation controller has a retail price of $230, however, the City could receive a 20-40% discount when buying in bulk. Residents would be able to purchase the controller for $30 at City Hall. Through the program, the City could make back up to $10,500 of the $16,250 invested. The City would market the program through flyers sent out in the water utility bills, the spring newsletter, an article in the Citizen newspaper, and additional marketing online. Devices: The Rachio 3 Smart Irrigation Controller is EPA WaterSense certified and uses local weather and landscape conditions to tailor watering schedules to actual conditions on site, instead of irrigating using a controller with a clock and preset timer. The City is proposing to purchase 300 8-zone and 50 16-zone Rachio 3 Smart Irrigation Controllers for a total of 350 controllers, which will be available for residents to purchase. Eligibility Criteria to Purchase a Rachio 3 Smart Irrigation Controller: • Must be a resident of the City of Hugo. • Must have a currently functional irrigation system. • The existing controller must have been installed prior to 2019. • Must have in -home Wi-Fi strength at your existing controller by making sure that your smartphone picks up at least two bars. • Must have a smartphone, which is necessary to program and to operate the controller. Guidelines: • Installation and programming of the new controller is the responsibility of the property owner. Page 3 • The City reserves the right to inspect the irrigation controller for proper installation. • Smart controllers will be distributed on a first come, first served basis and at the discretion of the City of Hugo. The City reserves the right to refuse any application for any reason it sees fit. • Limit one controller per property address. • If the resident's controller is located outside, you will need to purchase an outdoor enclosure. The City is not responsible for providing an outdoor enclosure. • The City is not responsible for sensor performance or water savings. No warranty or guarantee is provided. • The City has the right to discontinue or amend the grant program at any time. 5. CONCLUSION: Staff is asking for approval to submit an application to the Metropolitan Council Water Efficiency Grant Program with the understanding that the City of Hugo is responsible for a local match.
