F.1 Donation by Hugo American Legion to the Yellow Ribbon Network The Hugo American Legion will be presenting a donation to the Hugo Yellow Ribbon Network. G.1 Approve Claims Roster Adoption of the Consent Agenda approved the Claims Roster as presented. G.2 Approve Annual Performance Review for Public Works Worker Adam Greeder In 2007, Adam Greeder was hired by the City of Hugo as one of its summer seasonal maintenance workers in the Hugo Public Works Department. On October 6, 2008, Adam became part of the department as a full-time employee as an apprentice for the Public Works Maintenance Worker. Public Works Director Scott Anderson recommends Council approve the annual performance review for Public Works Worker Adam Greeder. G.3 Approve Hiring of Connor Coenen and Tim Stoltzman as Temporary Public Works Seasonal Employees Staff is requesting authorization to hire Connor Coenen and Tim Stoltzman as a temporary seasonal employees for the public works department. Each fall, with the start of the school year, several seasonal employees leave employment with the City to attend college. This year is no exception. Staff has recently spoke to Mr. Coenen and Mr. Stoltzman who are both interested in assisting the City as a seasonal parks employee. The addition of these two, as seasonal employees, will assist the Public Works Department in continuing the maintenance of park property and other City owned properties into the fall until such time that park grounds maintenance has stopped for the season. GA Approve Donation from Hugo American Legion to the Hugo Fire Department The Hugo American Legion has donated $200 to the Hugo Fire Department for training and equipment. Donations to the Fire Department must be approved by the City Council. Staff recommends Council accept the donation of $200 from the Hugo Legion. G.5 Approve Statement of Work from OPG-3 for Online Permitting OPG-3 has developed a statement of work to implement online permitting through the City's current PermitWorks program using Laserfiche forms. Earlier this year, the City worked with Accela on their online system but found did not fit the needs of the Building Department. Since then, OPG-3 has developed a solution at a fixed cost of $22,200 with no annual fee. This is a considerably lower cost than the other solutions considered by staff and will fulfill the department needs while utilizing the current permitting software. Staff recommends Council approve the SOW with OPG-3 for an online permitting solution. G.6 Approve Proclamation Proclaiming October as Toastmasters Month The City of Hugo has been contacted by a member of a Toastmasters group in White Bear Lake requesting the City of Hugo proclaim the month of October as Toastmasters month. Staff recommends Council approve the proclamation proclaiming October as Toastmasters Month. G.7 Approve Reduction in Cash Escrow for Oneka Place Oneka Place has had significant work completed to date, and the developer is requesting a reduction in the cash escrow. The current letter of credit and cash escrow is in the amount of $1,200,881. Staff has inspected the work completed to date and recommends reducing the cash escrow by $1,009,277.40 based on the value of the work remaining to be completed. The remaining value of the combined letter of credit and the cash escrow will be in the amount of $191,603.60 which is 10% of the original amount. Staff recommends Council approve the reduction in cash escrow for Oneka Place. G.8 Approve Leave of Absence for Firefighter Billy Lusk Firefighter Billy Lusk is requesting a Leave of Absence for personal reasons. Lusk has been on the Fire Department since August, 2018. Fire Chief Kevin Colvard recommends Council approve the Leave of Absence for Billy Lusk effective September 27, 2019 through October 11, 2019. H.1 Receive Bids and Award Contract for the Water's Edge Stormwater Reuse — Phase 2 Improvement Project On September 26', one bid was received for the Water's Edge Stormwater Reuse — Phase 2 Improvement Project. Peterson Companies Inc. submitted the only bid in the amount of $610,000. The Engineers Estimate was $585,000. Staff has worked with the participating homeowner's associations to prepare agreements outlining cost responsibilities and is a separate agenda item for your consideration. Staff recommends approving the Resolution receiving bids and awarding a contract for the Water's Edge Phase II Water Reuse Project. I.1 Approval of Water Reuse Agreements with Waters Edge, Prairie Village, and Prairie Village Villas Homeowner's Association Staff has worked closely with the Water's Edge, Prairie Village, and Prairie Village Villas Homeowners Association on preparing agreements related to the cost sharing responsibilities associated with the Water's Edge Stormwater Reuse — Phase 2 Improvement Project. Staff recommends approval of the Resolution approving stormwater reuse agreements with Water's Edge Homeowners' Association, Prairie Village Homeowners `Association and the Prairie Village Villas Homeowners' Association. J.1 Discussion on RCWD Watershed Management Plan 60-Day Review Period Comments The Rice Creek Watershed District (RCWD) has been preparing an update to its Watershed Management Plan (WMP) over the last several months. Staff has been involved in attending meetings and providing input and comments along the way as they developed the plan. The RCWD has provided a draft Watershed Management Plan for a 60-day review comment period. Comments are due October 9, 2019. Staff has drafted a letter to provide comments to the RCWD on the plan. Staff will present the comments for review and approval by the City Council at the meeting. L.1 Yellow Ribbon Network Update Council Member Chuck Haas and Council Member Phil Klein will report to Council on the Yellow Ribbon Network activities held recently. MA Rice Creek Watershed District JD3 Informational Meeting on Tuesday, October 8, 2019 Rice Creek Watershed District will be holding an informational meeting on Tuesday, October 8, 2019, at 6:30 p.m. at Hugo City Hall to provide information on the Judicial Ditch 3 repair project. This has been posted as a meeting if Council would like to attend. M.2 Press Publications Open House on Wednesday, October 9, 2019 The Council has been invited to attend the Open House at Press Publications (The Citizen) on Wednesday, October 9, 2019 from 4-6 p.m. at 4779 Bloom Ave., White Bear Lake. This has been posted as a meeting if Council would like to attend. M.3 Vacancies on Carnelian -Marine -St. Croix Watershed District and Brown's Creek Watershed District Carnelian -Marine -St. Croix Watershed District and the Brown's Creek Watershed District has notified the City of district manager vacancies. The County Board will select district managers from lists of nominees submitted by the municipalities. Applications can be found on the County website. Approve Annual Performance Review for City Clerk Michele Lindau Michele Lindau was hired as the new City Clerk on January 1, 2008. Michele was originally hired by the City as a part time employee in 1997 and a full time employee beginning May 1, 1999. Adoption of the Consent Agenda approved the annual performance review for Public Works Worker Paul Christianson. Approve Annual Performance Review for Finance and Public Works Administrative Assistant Amber Lozier Amber Lozier was hired as the Finance and Public Works Administrative Assistant on October 8, 2018. Amber Lozier had worked for the City as a temporary scanning technician since February, 2015, helping to scan documents for the Laserfiche project. Adoption of the Consent Agenda approved the Annual Performance Review for Amber Lozier. Approve Resolution Approving Preliminary Tax Lew for 2020 At its September 5, 2019, Midyear Budget Workshop, the City Council listened to a presentation from Finance Director Ron Otkin highlighting revenues and expenditures to -date as well as projections for the 2020 fiscal year. It was the consensus of the Council that the 2020 preliminary tax levy include additional funds, over and above the levy needed to keep a flat tax rate, for the potential issuance of bonds to finance improvements to Lions Park. The total proposed 2020 property tax levy of $8,313,784 will push the urban tax rate to 39.221% of tax capacity while the rural tax rate will increase to 35.329% of tax capacity. The Finance Director believed this levy was sufficient to fund the operating and capital budgets in 2020 and met the objectives of the City Council. He recommended Council approve the Resolution Approving the Preliminary Tax Levy Payable in 2020. Adoption of the Consent Agenda approved RESOLUTION 2019-36 APPROVING PRELIMINARY TAX LEVY PAYABLE IN 2020. Approve Quote from Excel AV Group for Upgrades in Council Chambers and Oneka Room Staff had solicited quotes for AV upgrades in the Council Chambers and the Oneka Room. Upgrades to the Council Chambers would include replacing the screens and projectors with monitors, adding a monitor for the podium presenter, upgrading the document camera, and upgrading the video inputs and switchers. Upgrades in the Oneka Room would include a motorized dropdown screen, ceiling mounted projector, and a switcher to accommodate various inputs to the system. Three quotes were received ranging from $75,605 to $48,865. The Finance Department confirmed there are sufficient funds in the budget to cover these projects. Adoption of the Consent Agenda approved the low quote from Excel AV Group in the amount of $48,865. Approve Special Event Permit for Haunted Trail Events During October Kenneth Short, 5115 Sherwood Dr. S., Motley, MN, had applied for a Special Event Permit to hold a haunted trail walk to be known as "Hellwoods" to take place on the Woodloch Stable (Ramberg) property, 5676 170th Street North, and on approximately 35 acres of the Macalus Hugo City Council Meeting Minutes for September 16, 2019 Page 4 of 7 property adjacent to the activity area on the Ramberg site. A Special Event Permit was required because there are expected to be 2,500 attendees over the month of October, there will be amplified sound, and it will extend after dark. This would be the third year this event was held, and there were no known problems in the past. Adoption of the Consent Agenda approved the Special Event permit for the haunted trail to be known as "Hellwoods" subject to conditions in the staff memo. Approve Resolution for No Parking on CSAH 7 In response to a resident's inquiry, staff examined the parking situation along CSAH 7 on the south side of Sunset Lake between Ingersoll Avenue and slightly south of 125th Street. The curve in the road and existing shoulder width makes it difficult for people to park along the road safely. Public Works Director Scott Anderson had spoken to the County Traffic Engineer who agreed, and he asked the City to pass a no parking resolution and make a request to the County to install the signs. Adoption of the Consent Agenda approved RESOLUTION 2019-37 REQUESTING WASHINGTON COUNTY RESTRICT PARKING ALONG COUNTY ROAD 7 FROM INGERSOLL AVENUE TO APPROXIMATELY 730 FEET SOUTHWEST OF 125TH STREET. Approve Release of the Letter of Credit for OP3 Prairie Village LLC for Waters Edge 5th Addition OP3 Prairie Village, LLC, had requested the City release their letter of credit for the Water's Edge 5th Addition Development. City staff had inspected the work and found it acceptable. Adoption of the Consent Agenda approved the release of the letter of credit being held for the constructed improvements in the Water's Edge 5th Addition Development. Approve Release of the Letter of Credit for OP3 Prairie Village LLC for Prairie Village 4th Addition OP3 Prairie Village, LLC, had requested the City release their letter of credit for the Prairie Village 4th Addition Development. City staff had inspected the work and found it acceptable. Adoption of the Consent Agenda approved the release of the letter of credit being held for the constructed improvements in the Prairie Village 4th Development. Approve Pay Voucher No. 5 for Water Tower No. 4 Improvement Proiect CB&I had submitted Pay Voucher No. 5 for work done on the Water Tower No. 4 improvement project. Staff found it acceptable for work certified through August 23, 2019. Adoption of the Consent Agenda approved payment of Voucher No. 5 in the amount of $402,779.28. Approve Pay Voucher No. 3 for 130" Street Improvement Proiect Dresel Contracting, Inc., had submitted Pay Voucher No. 3 for work done on the 130th Street improvement project. Staff found it acceptable for work certified through August 31, 2019. Hugo City Council Meeting Minutes for September 16, 2019 Page 5 of 7 Adoption of the Consent Agenda approved payment of Voucher No. 3 to Dresel Contracting, Inc., in the amount of $461,695.85. Approve Resolution Approving Site Plan and Variance for Gopher State Storage Minnesota Built Hugo Minnesota, LLC, had requested approval of a site plan to construct a building with a footprint of approximately 16,600 square feet for a three-story climate controlled storage facility. The applicant had also requested approval of a variance from the front yard setback requirements to construct the building 0 feet from the roadway easement on the west side of the property, where 30 feet was required by ordinance. The Planning Commission considered the request on Thursday, September 12, 2019, and unanimously recommended Council approve the request. Approval of the Consent Agenda approved RESOLUTION 2019-38 APPROVING A SITE PLAN FOR A STORAGE FACILITY ON PROPERTY LOCATED AT 5560 152ND STREET NORTH and RESOLUTION 2019-39 APPROVING A VARIANCE FROM THE FRONT YARD SETBACK REQUIREMENTS IN THE GENERAL INDUSTRIAL (I-3) ZONING DISTRICT FOR MINNESOTA BUILT HUGO MINNESOTA, LLC, ON THE PROPERTY LOCATED AT 5560 152" d STREET NORTH. Metropolitan Council Water Efficiency Grant Application Community Development Assistant Emily Weber explained the Metropolitan Council was implementing a Water Efficiency Grant Program for municipalities looking to run their own grant or rebate programs. The Met Council would provide 75% of the program cost and the City would provide the remaining 25%. Grants would be made available in amounts ranging from $2,000 to $50,000 with the goal to support changes to improve water use efficiency. Emily provided background on a previous grant the City received through the Clean Water Fund in 2015. With those grant funds the City offered rebates to residents who purchased water saving products to replace inefficient ones. She explained that with this Water Efficiency Grant, the City could purchase 350 smart irrigation controllers at a discounted rate and offer them to residents for $30 to replace their current controllers. If 350 residents replaced their controllers, three million gallons of water could be saved annually. She proposed to request a grant in the amount of $48,750 with the understanding Hugo would be responsible to provide the local match of $16,250. Through the program, the City could get back $10,500 of the investment. Emily requested Council approval to submit the Water Efficiency Grant application to the Metropolitan Council. Council asked about installation, how it worked, who can purchase them, and how it would be promoted. Emily responded that it takes 15 to 30 minutes to install, and it works by taking into consideration the forecast and types of soil. They can only be purchased by Hugo residents and homeowner associations as replacement to their current irrigation meters. The City would promote it through the City newsletter, social media, The Citizen, and utility bill inserts. Weidt made motion, seconded by Klein, to direct staff to submit the Water Efficiency Grant Program application to the Metropolitan Council. All Ayes. Motion carried. Hugo City Council Meeting Minutes for September 16, 2019 Page 6 of 7 Yellow Ribbon Network Update Council Member Chuck Haas and Council Member Phil Klein reported to Council on the Yellow Ribbon Network activities held recently. The YRN received a Certificate of Appreciation from the Air Force for participating in an event for the 133rd Air Wing. Food was donated by Spencer Grundhofer, and 125 people were served. Xcel had a workday for a military family that the YRN connected them with. The American Legion donated $200 to the YRN. Meat raffles will begin at Sal's on October 5th. The Oakdale Fleet Farm and Fridley Senior Assisted Living were collecting items for care packages. The YRN was able to provide emergency financial help for an air force pilot, and they helped an active military member with travel expenses to visit their six-month old son in the hospital. Volunteers were going to a deployment ceremony on Saturday. Mueller Memorial was the next Burger Night sponsor. Pheasant Forever will be holding a youth pheasant hunt at Wild Wings, the same day the Fry Group will be sponsoring Rib Fest. A Welcome Home event will be held in St. Cloud on Sunday, and there are 30 soldiers attending. National Manufacturing Day at Wilson Tool on Friday, October 4, 2019 Miron added this to the agenda to schedule a meeting for Friday, October 4, 2019, from 8:30 a.m. to 2:30 p.m. at Wilson Tool to celebrate National Manufacturing Day. Wilson Tool is located at 12912 Farnham Avenue North. Petryk made motion, Klein seconded, to schedule a meeting to attend National Manufacturing Day at Wilson Tool on Friday, October 4, 2019. Burger Night Tuesday, September 24, 2019 City Administrator Bryan Bear reminded Council a meeting was scheduled to attend Burger Night on Tuesday, September 24, 2019, at 5 p.m. at the Hugo American Legion. The Department of Defense will be presenting Hugo with the Seven Seals Award. Movie Night Friday, September 27, 2019 City Administrator Bryan Bear informed Council Outdoor Movie Night will be held on Friday September 27, 2109, at the Hanifl Fields. The movie showing will be "Aladdin". The Emergency Vehicle Show will be at 6:30 p.m. and the movie will begin at 7:30 p.m. Klein made motion, Haas seconded, to schedule a meeting to attend Outdoor Movie Night on September 27, 2019. City Administrator Bryan Bear recommended Council schedule the 2019 Holiday Party for Thursday, December 12, 2019, at the Hugo American Legion beginning with social hour at 5:30 p.m. followed by dinner at 6:30 p.m. Klein made motion, Petryk seconded, to schedule the holiday party for Thursday, December 12, 2019, at the Hugo American Legion. This SOW will be a part of a Professional Services Agreement between OPG-3 and Hugo. Project Scope and Objective OPG-3 has developed an online permitting solution for use with the Permit Works application. The solution makes permit applications available online, is tightly integrated with Permit Works to: • Dynamically build out the application based on user input • Determine necessary approval based on permit types • Automatically calculate permit fees and accept online payment • Generate and email permit documents as attachments Note: Stormwater permits are not included in this SOW as they are a "non-standard" permit type in Permit Works. Stormwater permits can be added at an additional cost. The solution requires Laserfiche Avante, Rio or Subscription, Forms Professional and the Laserfiche Forms Portal. OPG-3 has developed a templated framework so the solution can be implemented quickly for a fixed bid cost. Cities can choose to limit the scope of the system by choosing which types of permits are made available but changes to the framework may require additional development at additional cost. In addition to the core solution framework developed by OPG-3, Hugo would like to add the following capabilities: • Correct property owner name — if the name of the property owner that is automatically populated from the Permit Works database is incorrect, the form will provide contact information and prompt the applicant to call the city and correct the name in Permit Works • State of Minnesota Waiver information will appear on forms where applicable Change Management Process It may become necessary to amend this SOW for reasons including, but not limited to, the following: • Changes to the project schedule, scope or budget • Changes in priorities (external or internal to the project) that impact the project • Environmental or architectural impediments not previously identified • Lack of access to personnel, facilities, or systems necessary to complete project as scoped In the event that it is necessary to change this SOW, the following process will be followed: A Project Scope Change Request (PSCR) will be used to communicate change. The PSCR must describe the change, the reasons for the change, and the effect the change will have on the project, which may include scheduling changes, pricing, etc. A PSCR will be initiated by OPG-3 but must be executed by both parties to make it effective and binding on the parties. Phases will run in parallel where possible. Estimated project timeline is 8 weeks. Phase 1— Confirmation of Laserfiche infrastructure and initial setup OPG-3 will confirm the prerequisite Laserfiche components are installed and configured as appropriate. If any components need to be upgraded, OPG-3 will perform the upgrade as part of the project. OPG-3 will also determine the version of Permit Works in place. If an upgrade is necessary, the City will need to arrange that with Permit Works. If Hugo prefers, and provides access, the OPG-3 project team can take the lead with Hugo personnel assisting. Core Activities Include: • Work with Hugo to develop promotion plan. • Promote solution to production. • Functional testing of individual components, testing of solution using Test Scripts. • Remediate any issues within scope as necessary. Deliverables: • Laserfiche solution deployed in production and ready for end users. • Two weeks of Stabilization support after Promotion to Production. Assumptions Driving Effort: • The OPG-3 project team will continue to support the solution for two weeks after Promotion to Production while transferring support responsibilities to the OPG-3 Support Team. Phase 5 —Training, Knowledge Transfer and Transition to Support Once the solution has been promoted to production and is ready for use, OPG-3 will provide training for users and administrators. Deliverables: • Recorded demonstrations to show each step of the processes. • Knowledge Transfer sessions with OPG-3 Support on solution for post -project support. • System documentation. • User and Administrative training onsite. Assumptions Driving Effort: • Hugo will work with OPG-3 to help develop appropriate training materials for end -users. • Hugo will coordinate attendance of Hugo personnel for training sessions. • Training will occur throughout this project as the OPG-3 and Hugo teams work alongside each other. • OPG-3 may deliver a final update to the System documentation prior to project closeout if such an update is necessary. This potential final System documentation update is not a deliverable of this Phase. OPG-3 will make available, and provide access to (e.g., within two to three business days), necessary personnel to ensure project success, including: a. A designated project manager to help schedule meetings, facilitate project governance, coordinate document requests, provide status updates and other tasks. b. Experienced OPG-3 engineering personnel. c. Personnel to perform preliminary testing during development and prior to UAT. Personnel will be made available per the project schedule and plan. 2. OPG-3 will work with Hugo to provide any necessary technical resources and support. This includes escalating any issues to Laserfiche Support and Laserfiche Development as necessary. Project Assumptions 1. The scope of the engagement will include the Services described in this SOW. Any additional scope requests will be provided in a separate SOW or change order. a. The Services will focus exclusively on Laserfiche and Laserfiche-related products to support the system and solution, except where explicitly noted in this SOW. 2. If after OPG-3's request for acceptance on project closeout, Hugo does not respond in writing within five business days, or Hugo's refusal of such approval in the five-day period is not reasonable, Hugo will be deemed to have accepted. 3. All Laserfiche Software Products, Professional Services and Support are sold subject to the terms and conditions of Laserfiche's Software License Agreement, which accompanies the software. By accepting this Statement of Work, Hugo accepts all of these terms and conditions, which will not be varied except in writing signed by both parties. Hugo will make available, and provide access to (e.g., within two to three business days), necessary personnel to ensure project success, including: a. A designated project manager to help schedule meetings, facilitate project governance, coordinate document requests, and other tasks. b. IT personnel such as system administrators, database administrators, or help desk. c. Subject matter specialists to provide information on Hugo's business processes. d. Personnel to execute the test scripts and document results for User Acceptance Testing ("UAT"). Personnel will be made available per the project schedule and plan. 2. Hugo will work with OPG-3 to provide any necessary technical resources and support. This includes: a. Providing requested documentation and acceptance of key deliverables within two to three business days. If Hugo does not respond in writing to OPG-Ts request for acceptance within three business days of OPG-Ts request, or Hugo's refusal of such approval within the three-day period is not reasonable, Hugo will be deemed to have accepted. b. Providing any access to the Hugo environment that the OPG-3 team will need to develop the solution. 3. Hugo will be responsible for providing all hardware and licensing all software components necessary for completing Services. This includes: a. Windows Server 2012112 (or higher) and SQL Server Standard/Enterprise 2012 (or higher) licenses. b. SSL certificates for all servers that require them. c. Licenses for all software and systems on the Hugo network with which the Laserfiche system will integrate. Changes or additions to scope may lead to increased cost — any changes that result in additional cost or timeline will be agreed to in writing. Payment Plan All Services will be performed in accordance with this mutually accepted SOW. To provide initial funding for the project and simplify billing, an initial payment of 50% of the cost of the SOW will be billed upon execution of the document. The balance of Services will be billed monthly. Invoices are due upon receipt. If Hugo disputes any portion of an invoice, Hugo will pay the undisputed portion when due. Changes to project scope or effort required to complete specific work items due to unforeseen complications or issues outside of OPG-3's control will go through the Change Management Process and will be approved by Hugo. Peterson Companies, Inc. submitted the only bid in the amount of $610,000. This is higher than the Engineer's Estimate of $585,000. The low interest and somewhat higher bid amount are likely due to the specialized nature of the project as well as the general low level of competition in the Z current bidding environment. Peterson Companies, Inc. is qualified in this type of specialty work, and as general contractor, performed well on Phase I of the Water's Edge Reuse project. It is recommended that the Contract be awarded to Peterson Companies, Inc. Financing for this project is somewhat unique. First, a significant grant has been obtained from Rice Creek Watershed District in the amount of $187,500. All the remaining project construction and delivery costs are being borne by the Homeowners' Associations (HOAs) that are served by N the project. Agreements spelling out the cost sharing responsibilities have been signed by the three HOAs. These 25-year agreements also spell out that the HOAs will pay for 100% of the 10 anticipated operation, maintenance, rehabilitation and electrical costs, as well as a portion of the pond cleaning costs that are anticipated sometime in the life of the 25-year agreement. The benefit to the HOAs comes in the form of cheaper irrigation costs. Comparing the amount z that would be spent on irrigation water at present day water rates over the 25-year period, the HOAs are expected to save approximately $1.4 million, even after all the construction and O&M cost participation. On the City side, there are two benefits. First there is an expected minimum of a 24 million gallons that won't be pumped from the aquifer each year. Second, the reuse system o_ "treats" stormwater, by disposing of it via the irrigation system. Therefore, this project presents Q multiple benefits to all the signatories of the agreements. RECITALS Whereas: A. Stormwater ponds (the "Ponds") are located on property owned by the City and legally described as: Outlot A, Waters Edge South Third Addition, Washington County, Minnesota (the "City Outlots"). B. The City desires to allow stormwater to be pumped out of the Ponds to provide irrigation water to certain common elements within the Waters Edge residential community (the "Common Elements") which are identified on Exhibit A attached hereto and incorporated herein. The HOA desires to utilize some of the stormwater for non -potable irrigation purposes as set forth herein. C. This agreement is intended to supersed and replace the previously signed Stormwater Reuse Agreement (Waters Edge Reuse System Phase 1- or WERSP 1), as well as a proposed expansion of the existing system (Waters Edge Reuse System Phase 2 or WERSP 2). Upon execution and recording of this agreement the prior Agreement is null and void and this agreement shall succeed it. A Stormwater Re -Use Distribution System (the "Distribution System"), including without limitation the Stormwater Re -Use Pump system (the "Pump"), has been constructed under WERSP 1. An expansion of these facilities has been designed and will be installed by the City Page 1 in locations as generally depicted on Exhibit B attached hereto and incorporated herein, which Distribution System and Pump allow stormwater from the Ponds to be used to provide irrigation water to the Water's Edge Irrigation System (the "Irrigation System") Common Elements. The City and the HOA wish to enter into this Agreement, governing the use of the water from the Ponds, the Distribution System and the Pump and the Irrigation System. NOW, THEREFORE, for valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereby agree as follows: 1. Use of Stormwater. The City hereby permits the HOA to utilize the stormwater from the Ponds to provide irrigation water to the Common Elements, all in accordance with the terms and conditions of this Agreement. The Pump and electrical controls will be installed and stored within the City Outlots, right of way or easements. In the event a permanent easement is required in order to construct or maintain elements of the distribution system, the HOA shall grant the city the necessary easements in form reasonably acceptable to the City. Under this agreement the HOA understands there are many factors that impact water availability including but not limited to precipitation, pond capacity, irrigation system efficiency, functionality, climate and other user demands and service requirements. This agreement does not grant sole ownership or rights to the stormwater to the HOA. The parties agree that no representation or warranty regarding availability, interruption or regularity of water delivery through the system is created by this agreement nor is an ongoing right to water delivery created by this agreement. The Distribution System has the capacity to potentially accommodate future users, and future users may also, in the discretion of the City, be granted permission to utilize the stormwater from the Ponds. 2. Communication. City and HOA shall reasonably endeavor to notify each other of any construction, maintenance, or operational changes to the distribution system or the irrigation system prior to work taking place, including annual maintenance and work done by third party contractors. Also a copy of an operation and maintenance manual shall be provided to the HOA by the City prior to final completion of the WERSP 2. In the event of any proposed additional uses or material changes to the system or irrigated area by either party, City and HOA will meet to discuss and review the agreement prior making changes. 3. Duration of Agreement. The term of this Agreement shall be twenty- five (25) years from the date of execution, subject to extensions and termination as set forth herein. 4. Cost. The HOA recognizes the City's financial commitment to the installation and maintenance ofthe Distribution System and Pump forthe purpose of stormwater reuse. The HOA, its successors, and assigns shall be required to purchase stormwater from the City at a rate of $59,500 per year (paid prior to December 31) increased annually by the lesser of 3% every year or the cost of using treated drinking water from the City's municipal system for irrigation purposes. In the event that the HOA uses treated drinking water from the City's municipal water supply system, the HOA shall pay the Page 2 fee (stated above) for stormwater use in addition to the cost of treated drinking water used from the City's municipal water supply system, billed at the City's water rate during that time period. 5. Pumping Requirements. Notwithstanding anything herein to the contrary, the HOA shall be required to use the Distribution System and Pump to irrigate the Common Elements with stormwater. The HOA may only use treated drinking water from the City's municipal water supply system for irrigation purposes when the following conditions apply: a. There is a deficiency with the Distribution System or Pump that causes the Irrigation System to become inoperable during the period of inoperability. b. The pond falls four (4) feet in elevation and remains so for at least twenty-four (24) hours. In either of these cases, the HOA shall be required to contact the City, in writing, and request the Distribution System be switched to irrigate with treated drinking water from the City's municipal water supply system during the period of inoperability. Notwithstanding the foregoing paragraph 4 (b), after a period of three years from the execution of this agreement, both parties will consider and evaluate and negotiate in good faith the matter of whether the 4-foot pond -reduction limitation in section 4(b) may be increased or decreased. If the 4-foot pond -reduction limitation is decreased, it may only be decreased up to two (2) feet. 6. Irrigation. The HOA shall be exempt from any watering restrictions of the City relating to irrigation, provided that the HOA is exclusively re -using stormwater via the Distribution System for irrigation purposes during the period of any claimed violation. This exemption shall not apply if the HOA is using treated water from the City's municipal water supply system for irrigation purposes. 7. License for Maintenance. The HOA shall allow the City or its representative contractors such access over its property, that of its members and over its common areas as is reasonably needed to construct, maintain, repair, and/or replace the Distribution System and the Pump, and perform maintenance on the pond and storm system infrastructure. The HOA shall coordinate and perform full- system draining and blow-out for winterization purposes, with assistance from the City provided as needed. The HOA shall test the backflow preventers every year before start-up of the Irrigation System. All maintenance and repair and replacement of the Irrigation System shall be the responsibility of the HOA and it shall be maintained in reasonable working condition. It shall be the HOA's responsibility to ensure water quality is adequate for irrigation prior to system start-up each spring. Annual water sampling results shall be provided to the city each year. Notwithstanding the foregoing, in no event shall the City be responsible to defend, indemnify or reimburse the HOA or its owner/members turf degradation, consequential damages or property damage as a result of water quality or supply issues, interruption or otherwise by reason of its provision of or failure to provide the services offered by it under this agreement. 8. HOA turn -on, notification, and treatment responsibilities. The HOA has sole Page 3 responsibility to turn the system on each year and turn the system back to reuse water from potable water in the event the system is turned off or temporarily switched over to the potable source. Any additional expenses associated with the use of potable water due to failure to switch over or otherwise operate the system in the most cost effective manner shall be the responsibility of the HOA. The HOA acknowledges that the water provided via the distribution system is non -potable. The HOA shall comply with any health risk notification requirements and shall regularly notify existing members of the Waters Edge community and new residents moving into the community that the water is non -potable using newsletters, fliers, signage, markings, or other means to ensure residents of the area serviced by the Distribution System are made aware of the nature and risks of improper use of water from this system. In the event additional treatment requirements are directed by another regulatory authority or based on new findings, the following shall apply: If either party learns of new treatment requirements, it shall notify the other party of the new requirements and both parties will review possible responses to address the requirements. The agreement and annual HOA fee will be subject to amendment in the event additional costs result. 9. Equipment Failure. In the event there is a deficiency with the Distribution System or the Pump which causes the system to become inoperable, the City shall e n d e a v o r t o correct the deficiency within thirty (30) days after the HOA gives written notice to the City specifying the deficiency, or as soon thereafter as reasonably possible. The HOA shall be billed based on a pro rata share for the use of treated drinking water from the City's municipal water supply system used for irrigation purposes. 10. Credits. The HOA recognizes the City's intent to use any excess volume and water quality credits created by the Distribution System as a means of meeting volume and water quality requirements for City road and other projects under Rice Creek Watershed District stormwater management rules. Notwithstanding the foregoing, the HOA has no obligation to create any such excess credits or to operate the Distribution System in any manner other than in accordance with the requirements of this Agreement. 11. Default. In the event the HOA fails or refuses to maintain, repair and/or operate the Irrigation System as required herein, the HOA shall correct the deficiency within thirty (30) days after the City gives written notice to the HOA specifying the deficiency, or as soon as reasonably possible otherwise. If the HOA fails to timely correct the deficiency, then the City may, with ten (10) days written notice and without regard to the requirements or formalities of Minnesota Statutes Chapter 429, perform such work to maintain, repair, and/or operate the Irrigation System and assess the HOA and the properties within it for the cost of such work. The HOA on behalf of itself and its members, waives the requirements of Minn. Stat. 429. This shall not be the exclusive cost -recapture mechanism or remedy for the City. 12. Extension. Except to the extent otherwise provided in this Agreement following the initial twenty -five-year term, this Agreement will be automatically extended for successive one-year periods (subject to the "Termination" section below), on the same terms and conditions as in effect immediately prior to the then -current expiration date, unless either party gives the other notice of non -extension at least three months before Page 4 the then -current expiration date. 13. Termination. If either party materially breaches any provision of this agreement and if such breach is not cured within thirty (30) days after receiving written notice thereof (or within such other time is specified in this agreement), the non -breaching party shall have the non-exclusive right to terminate this agreement thereafter, upon written notice. 14. Miscellaneous. This Agreement contains the entire agreement between the City and the HOA regarding the subject matter hereof. This Agreement may be signed in any number of counterparts, each of which shall be considered an original, but which together shall constitute one and the same instrument. This Agreement may be amended only by a written instrument signed by the parties hereto. This Agreement shall run with the land. 15. Authorization. The parties represent and warrant that the undersigned are duly authorized to execute this Agreement and to bind the respective parties to the terms of this Agreement. The HOA confirms that its approval of this agreement is by proper vote of its members or board, where required, and its execution of it is the free act and deed of the HOA. No third party beneficiary status is conferred on any other person or firm under this agreement and the same is expressly disclaimed by the parties hereto. RECITALS A. Stormwater ponds (the "Ponds") are located on property owned by the City and legally described as: Outlot A, Waters Edge South Third Addition, Washington County, Minnesota (the "City Outlots"). B. The City desires to allow stormwater to be pumped out of the Ponds to provide irrigation water to certain common elements within the Waters Edge 5"' Addition (the "Common Elements") which are more particularly described as the greenspace on Oneka Parkway right of way located between Prairie Trail North and the Northern Plat boundary of Waters Edge 5' Addition, and the common space elements within Waters Edge 5' Addition (the "Common Elements"). C. A distribution system has been constructed as part of the Waters Edge Phase I Water Reuse Project and is being expanded to serve more of the Waters Edge development and the Prairie Village development including the Waters Edge 5t" Addition, as part of the Waters Edge Phase II Water Reuse Project. This distribution system will be used, in part, to provide irrigation water to the Common Elements. This Agreement pertains solely to new and existing irrigation infrastructure being installed or already Page 1 installed as part of the distribution system in Waters Edge 5" Addition that will be installed or operated in such a way so as to provide non -potable water as a replacement for potable water used for irrigation purposes serving the Common Elements in and adjacent to the Waters Edge 5" Addition development (the "Distribution System"). Upon execution of this Agreement the HOA may receive the benefits including the cost savings of using a non -potable water source, and shall be a party responsible for a share of the costs associated with constructing and operating this irrigation system. The City and the HOA wish to enter into this Agreement, governing the use of the water from the Ponds, and Distribution System. NOW, THEREFORE, for valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereby agree as follows: Use of Stormwater. The City hereby permits the HOA to utilize reasonably available stormwater from the Distribution System to provide irrigation water to the Common Elements, all in accordance with the terms and conditions of this Agreement. In the event a permanent easement is required in order to construct or maintain elements of the Distribution System over portions of the Common Elements, the HOA shall grant the City the necessary easements. Under this Agreement the HOA understands there are many factors that impact water availability including but not limited to precipitation, pond capacity, irrigation system efficiency, climate and other users. This permission does not grant sole ownership or rights to the stormwater to the HOA. The Ponds have the capacity to potentially accommodate future users, and future users may also be granted permission to utilize the stormwater from the Ponds. 2. Communication. City and HOA shall endeavor to notify each other of any construction, maintenance, or operational changes to the Distribution System or internal irrigation system prior to work taking place, including annual maintenance. Also a copy of an operation and maintenance manual shall be provided to the HOA by the City upon final completion of the Distribution System improvements. In the event of any proposed additional uses or material changes to the system or irrigated area by either party, City and HOA will meet to discuss and review the agreement prior making changes. 3. Duration of Agreement. The term of this Agreement, a period of twenty- five (25) years from the date of execution, subject to extensions and termination as set forth herein. 4. Cost. The HOA recognizes the City's finangial commitment to the installation and maintenance of the Distribution System for the purpose of stormwater reuse. The HOA, its successors, and assigns shall be required to purchase stormwater from the City at a rate of $2 , 2 5 0 per year (paid prior to December 31) increased annually by 3% every year. In the event that the HOA uses treated drinking water from the City's municipal water supply system, the HOA shall pay the fee (stated above) for stormwater use in addition to the cost of treated drinking water used from the City's municipal water supply system, billed at the City's applicable water rate during that time period. 5. Pumping Requirements. Notwithstanding anything herein to the contrary, the HOA shall be required to use the Distribution System to irrigate the Common Elements with stormwater. The HOA may only use treated drinking water from the City's municipal water supply system for Common Element irrigation purposes when the following conditions apply: a. There is a deficiency with the Distribution System that causes the irrigation Page 2 system to become inoperable, and then only during the period of inoperability. b. The Ponds fall to an elevation the does not allow the system to be operated. In either of these cases, the City shall duly notify the HOA. Upon receipt of such notice, the HOA in ay e 1 e ct t o contact the City, in writing, and request the Distribution System be switched to irrigate with treated drinking water from the City's municipal water supply system during the period of inoperability. 6. Irrigation. Provided that it is in compliance with this Agreement, the HOA shall be exempt from any watering restrictions of the City relating to irrigation, s o 1 o n g a s the HOA is re -using stormwater via the Distribution System for irrigation purposes during the period of any claimed violation. This exemption shall not apply if the HOA is using treated water from the City's municipal water supply system for irrigation purposes. 7. Maintenance. The HOA shall allow the City or its representative contractors such access over the Common Elements as is reasonably needed to construct, maintain, repair, and/or replace the Distribution System. The HOA shall coordinate and perform full- system draining and blow-out for winterization purposes for the Distribution System, with assistance from the City provided as needed. The HOA shall test the backflow preventers for the Distribution System every year before start-up of the Distribution System. All other maintenance and repair and replacement of any private irrigation systems feeding off the Distribution System shall be the responsibility of the HOA. It shall be the HOA's responsibility to ensure water quality is adequate for irrigation prior to system start-up for the Distribution System each spring. In no event shall the City be responsible for turf degradation, consequential damages or property damage as a result of water quality or supply issues or otherwise by reason of its provision of or failure to provide the services offered by it under this Agreement. HOA turn -on, notification, and treatment responsibilities. The HOA has sole responsibility to insure the Distribution System is turned on each year and to turn such system back to reuse water from potable water in the event such system is turned off or temporarily switched over to the potable source. Any additional expenses associated with the use of potable water due to failure to switch over or otherwise operate the system in the most cost- effective manner shall be the responsibility of the HOA. The HOA acknowledges that the water provided via the Distribution System is non -potable. The HOA shall comply with any health risk notification requirements and shall regularly notify existing members of the Prairie Village Villas community and new residents moving into the community that the water serving the Common Elements is non -potable. In the event additional treatment requirements are directed by another regulatory authority or based on new findings, the following shall apply: If either party learns of new treatment requirements, it shall notify the other party of the new requirements and both parties will review possible responses to address the requirements. The agreement and annual HOA fee will be subject to amendment in the event additional costs result. 9. Equipment Failure. In the event there is a deficiency with the Distribution System which causes the system to become inoperable, the City shall e n d e av o r t o correct the deficiency within thirty (30) days after the HOA gives written notice to the City specifying the deficiency, or as soon thereafter as reasonably possible. The HOA shall be billed based on a pro rata share for the use of treated drinking water from the City's municipal water supply system used for irrigation purposes. Page 3 10. Credits. The HOA recognizes the City's intent to use any excess volume and water quality credits created by the Distribution System as a means of meeting volume and water quality requirements for City road and other projects under Rice Creek Watershed District stormwater management rules. Notwithstanding the foregoing, the HOA has no obligation to create any such excess credits or to operate the Distribution System in any manner other than in accordance with the requirements of this Agreement. 11. Default. In the event the HOA fails or refuses to comply with this Agreement, the HOA shall correct the deficiency within thirty (30) days after the City gives written notice to the HOA specifying the deficiency, or as soon as reasonably possible otherwise. If the HOA fails to timely correct the deficiency, then the City may, with ten (10) days written notice and without regard to the formalities of Minnesota Statutes Chapter 429, c o r r e c t t h e d e f i c i e n c y and assess the HOA and the properties within it for the cost of such work or bring other correction or remedies actions. 12. Extension. Except to the extent otherwise provided in this Agreement following the initial twenty -five-year term, this Agreement will be automatically extended for successive one- year periods (subject to the "Termination" section below), on the same terms and conditions as in effect immediately prior to the then -current expiration date, unless either party gives the other notice of non -extension at least three months before the then -current expiration date. 13. Termination. If either party materially breaches any provision of this Agreement and if such breach is not cured within thirty (30) days after receiving written notice thereof, the non -breaching party shall have the right to terminate this Agreement thereafter, upon written notice. Notwithstanding any termination, any outstanding water supply fee shall be paid. 14. Miscellaneous. This Agreement contains the entire agreement between the City and the HOA regarding the subject matter hereof. This Agreement may be signed in any number of counterparts, each of which shall be considered an original, but which together shall constitute one and the same instrument. This Agreement may be amended only by a written instrument signed by the parties hereto. This Agreement shall run with the land. 15. Authorization. The parties represent and warrant that the undersigned are duly authorized to execute this Agreement and to bind the respective parties to the terms of this Agreement. A Distribution System has been constructed as part of the Water's Edge Phase I Water Reuse Project and is being expanded in the Water's Edge Development and Prairie Village 3rd and 46 Addition as part of the Water's Edge Phase II Water Reuse Project. In reviewing the plan a few items were identified for comment. Below are comments for the RCWD to consider for their final plan update: 1. General: Appendix K in the Table of Contents references the 2016 RCWD Future Conditions Model. The City suggests revising this Appendix if the model has been updated since then. Additionally, the plan references the development of a regional stormwater management plan related to the Future Conditions Model. The City suggests adding this item to the Implementation Table (Table 4.3) and discussing how cities will be involved with this effort. 2. General: Resolution on all figures is poor and they look blurry which makes them hard to read and not significantly valuable when trying to look at more zoomed in areas. 3. Section 2.4 Climate and Precipitation: Add discussion regarding Atlas 14 rainfall events and how precipitation has changed over the years and how it will affect the watershed in the future. 4. Table 2.1 Lake Statistics: Please add what city each waterbody is located in. 5. Section 2.5.1.1 RCWD Lakes Classification System: Discuss or add a reference if located somewhere else in the report about how to guide and manage the difference types of lakes. 6. Section 2.5.1.2 Impaired Waters: The City suggests using the 2020 impaired waters list to keep the plan as up to date as possible. 7. Table 2.5 RCWD Impairments: Please add what city each impaired waterbody is in. 8. Figure 2.112017 RCWD Floodplain: The data sources for this figure indicate the models used was from 2009, 2010, and 2011. Have these models been updated since then? If so, please update the figure to reflect the latest model information. Additionally, please specify if these floodplains use the Atlas 14100-year rainfall event. 9. Table 3-1 District Issues Table: Please consider making water quality management a higher priority for the District. 10. Table 3-2 Existing District Facilities: Please add which city each facility is located in and any maintenance agreements that exist with that specific City. 11. Section 3.2.4 Flooding: Please add a discussion on Atlas 14 rainfall values and changing rainfall patterns and how that affects flooding within the District in the present and future. 12. Section 3.2.4.2. Impacts of land use changes: The City strongly encourages the District to delete this section. We would encourage the district to share information about flood prone areas, volume constrained locations, and other difficult drainage areas. The draft plan's emphasis on land use as the solution to these issues is presumptuous. The City (as the land use authority) would welcome all comments on land uses that are proposed with the City's comprehensive plan. Drainage issues are only one of a multitude of competing factors that determine proper land uses for a parcel. Until there is extensive study and conversation with municipalities about the District's desire to influence land use, we encourage,the District to eliminate any language that might sound like a predetermination to deny drainage permits due to authorized land uses. Clearly, the district can deny a drainage permit that doesn't meet district rules. This section appears pointless in its current form. 13. Section 3.2.5 Water Quality Management: Chloride and other emerging contaminants (such as E. coli) should be listed as an issue in this section. It seems these are going to become more of a concern in the future and the District should discuss how they will start handling these. 14. Table 3-3 RCWD Excess Nutrient TMDLs: Please add what city each waterbody is located in. 15. Section 3.2.5.5 Surface Water Monitoring: Discuss in greater detail what the revisions to the chloride management efforts will be in terms of monitoring and management. This could possibly be added to the Implementation Table to mark as a higher priority for the District. 16. Section 3.2.5.6 Thank you for recognizing the benefits of stormwater re -use to the regional drainage network. We appreciate the partnership with RCWD to build some of these systems. The City has multiple additional stormwater re -use retrofit projects it would like to build. Increased funding for these projects from partners such as RCWD will accelerate construction of these projects. 17. Section 3.2.6.2. Funding Distribution: The first factor listed for prioritizing funding is... location. The plan also states that decisions need to be made by geographic needs. Some clarity is needed here to explain how decisions are made to prioritize the needs of one location over another. We would encourage the District to incorporate some form of geographic equity within the plan to ensure that all portions of the region benefit from district projects in an equitable way. 18. Section 3.2.8.3. Permitting and Enforcement: The final policy listed in this section enables cities to assume responsibility to administer district rules. This program as administered by the City of Hugo is efficient. It streamlines the approval process, reduces redundancy, saves time, reduces development costs, promotes business activity within the city, and should also result in significant cost savings to the RCWD. The District should consider passing along a portion of these savings to the participating municipalities. 19. Section 3.2.9.2: Communication and outreach. The final "policy" in this section appears to be a statement. It is not a policy, and is out context. It is also opposed to the general theme of this section which focuses on sharing, openness, and transparency. 20. Table 4-1 Annual Budget: Suggest including funding to assist in City BMP maintenance projects. This could be related to water quality implementation prioritization. 21. Section 4.2.2 Modeling and Planning Program: Comprehensive Stormwater Management Plans can also allow for regional volume reduction projects (stormwater reuse) that generate volume reduction credits. If not in this section, some discussion and policy language should be added to talk about this opportunity and any additional work that will be completed by the district. Additional language regarding implementation of this credit system and how it works is encouraged. 22. Section 4.2.5 Water Quality Grant Program: Chloride and other emerging contaminants should be mentioned. 23. Section 4.2.13. Permit Review, Inspection and Coordination: The estimated cost of this program ($900,000 to $1,250,000) is significant. This cost would undoubtedly be even higher if this District performed this service within the City of Hugo. For the most part, the City of Hugo doesn't use this service, and therefore benefits very little from it, however, the City's taxpayers still pay for it. We encourage the District to evaluate the cost recovery methods for implementation of this expensive program. The District should also evaluate how to expand the successful Hugo model to other cities, further reducing costs. It may be beneficial to apply the philosophy the District uses for projects to programs. When the District implements projects, it uses ad valorem revenue for projects when benefits are shared District -wide. When benefits accrue locally, the cost is borne locally. 24. Table 4-3 Implementation Table: Item 14 list cities as partners in maintaining District facilities. Provide additional detail on how cities are to be partners in maintaining District owned facilities. 25. Table 4-3 Implementation Table Items 71-87: Please list which Cities each of the projects is located in and to what aspect the cities will be involved in the project. 26. Appendix H List of City Projects: Projects listed in Hugo's Implementation Table from the WRMP are missing from this list.
