HomeMy WebLinkAbout2020.01.06 RESO 2020-9 Preliminary Plat for Rice Lake Reserve RESOLUTION 2020-9 APPROVING PRELIMINARY PLAT FOR FENWAY LAND COMPANY FOR "RICE LAKE RESERVE" ON PROPERTY LOCATED EAST OF GOODVIEW AVENUE NORTH AND NORTH OF EGG LAKE ROAD (CSAH 8) WHEREAS, Fenway Land Company, has requested approval of a preliminary plat to allow construction of approximately 93 single family lots and 3 outlots on the 51.5 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Fenway Land Company, for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 93 single family home lots and 3 outlots, in accordance with the application and plans received by the City on October 23, 2019, November 15, 2019, and December 4, 2019, except as amended by this resolution. 2. Approval is contingent upon City Council approval of a rezoning to PUD for the 51.1 acre site. 3. The developer must comply with Resolution 2020-8, for the PUD. 4. The developer must comply with all conditions outlined in the City Engineer's memos dated December 12, 2019 and all red-lined comments provided to the applicant. 5. Park Dedication is proposed to be satisfied by fee. The park dedication fee shall be paid for each lot platted at the amount of$2,400.00. 6. A stormwater re-use system, as shown in the plans, shall be constructed with the development. The final plans shall be reviewed and approved by staff. The system will be installed by the applicant, and owned/operated/maintained by the homeowner's association. A stormwater reuse agreement shall be reviewed an approved by staff and recoded at Washington County. 7. The developer has indicated that an HOA will be established for the development to own/operate/maintain community areas, landscaping, and the water re-use system. The HOA documents shall be reviewed and approved by staff prior to the recording of the final plat for the Phase 1. Resolution 2020-9 Page 2 8. The gp development landscaping planned for the shall be installed all at the same time p duringeach phase. The developers shall take proper precautions to protect the trees p p p p P as the homes are being built. 11. The developer must comply with the following, prior to Final Plat and Final PUD Plan application approval: Landscaping and Lighting a. The applicant shall include additional coniferous (evergreen) trees along the south side of Lot 20, Block 4,to provide a buffer from Egg Lake Road (CSAH 8). Resolution 2020-9 Page 3 b. The applicant shall include additional landscaping at the entrance off of Goodview Avenue creating a defined main entrance into the development. c. The applicant shall include additional landscaping around a portion of the lift station. d. The monument sign location, design, and landscaping, shall be reviewed and approved by staff prior to installation. e. A final landscape plan shall be reviewed and approved by Staff. f. The exact locations and design of the street lights will be evaluated with each final plat application. The street lights be decorative and shall comply with the City standards for street lighting within the public right-of-way. Signage a. Final design, location, and landscaping of the entrance monument signage for the development shall be reviewed and approved by staff. Streets/Access a. The developer shall address all comments in the Washington County comment letter dated November 7, 2019. i. Plans for street connections to CSAH 8 shall be reviewed and approved by the Washington County ii. All permits required from Washington County shall be issued. Architecture a. The developer shall develop and implement architectural review and design guidelines for all residential buildings. Architectural design guidelines shall be reviewed approved by City staff. Open Space and Trails a. The preliminary plat and PUD general plan shall be revised to include a neighborhood gathering space in the general location of Lots 1-3, Block 3, are shown in the plan as previously proposed. i. The plans shall include landscaping and amenities. b. The plans shall be revised to include a trail along Street A south to Egg Lake Road (CSAH 8). The trail shall be installed and paid for by the developer. Resolution 2020-9 Page 4 Miscellaneous a. The applicant shall revise the lot depth for Lot 1, Block 1, to be in compliance with the rear yard setback of 30 feet. b. The developer must obtain all necessary stormwater management and WCA permits from the City. c. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. d. The Homeowners Association (HOA) documents for review and approval by staff. e. The developer shall obtain all necessary local, state, and federal permits. 12. Prior to the release of a final plat for recording, the developer must comply with the following conditions: f. The City's development fees will apply to this project. The fee amounts will be calculated and included as part of the Development Agreement. A development agreement shall be executed and all fees shall be paid. g. Park Dedication shall be paid for each lot platted in the amount of$2,400 per lot. 13. Prior to the issuance of building permits, the developer must comply with the following conditions. a. The applicant shall record the final plat, development agreement and all other documentation at Washington County and provide the City with proof of recording.
