APPROVING PUD GENERAL PLAN FOR FENWAY LAND COMPANY FOR
"RICE LAKE RESERVE" ON PROPERTY LOCATED EAST OF GOODVIEW
AVENUE NORTH AND NORTH OF EGG LAKE ROAD (CSAH 8)
WHEREAS, Fenway Land Company, has requested approval of a PUD general plan to
allow approximately 93 single family residential lots and 3 outlots on the 51.5 acre
property legally described as follows:

WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly
called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Fenway Land Company, subject to the following conditions:
I. A PUD general plan is approved to allow the creation of approximately 93 single
family residential lots and 3 outlots. The development shall be constructed in
accordance with the application and plans received by the City on October 23, 2019,
November 15, 2019, and December 4, 2019, except as amended by this resolution.
2. Approval is contingent upon City Council approval of the requested rezoning of the
51.5 acre property and preliminary plat.
3. The PUD general plan is approved based on the finding that the proposed project is
consistent with the City's Comprehensive Plan.
4. The developer shall comply with all conditions in the City Engineer's letter dated
December 12, 2019 and all red-lined comments provided to the applicant.
5. PUD flexibility is granted to allow:
a. Flexibility to allow a minimum lot size of 7,089 square feet, where 10,400 square
feet is required.
b. Flexibility to allow a minimum lot width of 55 feet, were 80 feet is required by
ordinance.
c. Flexibility to allow a minimum front setback of 20 feet for corner lots for the side
of the home, where 30 feet is required.
d. Flexibility to allow a minimum side yard setback of 7.5 feet, where 10 feet is
required.
e. Flexibility to allow a maximum impervious coverage of a lot to be 55%, where
50% is required.

7. The preliminary phasing plan is generally approved per plans dated October 22, 2019.
The phasing plan shall be revised to include all improvements, such as stormwater
management and trails. Any major revisions to the phasing plan shall require PUD
amendment. Minor modifications shall be reviewed and approved by staff.
a. Phase 1 shall include:
i. Access to Egg Lake Road (CSAH 8) shall be reviewed and
approved by Washington County. A permit for the connection shall
be issued.
ii. A neighborhood gathering space central to the overall
development, including amenities.
iii. Street C shall be constructed to the connection of Street B.
b. Phase 2 shall include: N/A
c. Phase 3 shall include:
i. The connection to Egg lake Road (CSAH 8) shall be constructed.
8. The building setbacks and impervious surface coverage requirements for the PUD are
as follows:

9. A stormwater re-use system, as shown in the plans, shall be constructed with the
development. The final plans shall be reviewed and approved by staff. The system
will be installed by the applicant, and owned/operated/maintained by the
homeowner's association. A stormwater reuse agreement shall be reviewed an
approved by staff and recoded at Washington County.

10. The developer has indicated that an HOA will be established for the development to
own/operate/maintain community areas, landscaping, and the water re-use system.
The HOA documents shall be reviewed and approved by staff prior to the recording
of the final plat for the Phase 1.
11. The developer must comply with the following, prior to Final Plat and Final PUD
Plan application approval:
Landscaping and Lighting
a. The applicant shall include additional coniferous (evergreen) trees along the south
side of Lot 20, Block 4, to provide a buffer from Egg Lake Road (CSAH 8).
b. The applicant shall include additional landscaping at the entrance off of
Goodview Avenue creating a defined main entrance into the development.
c. The applicant shall include additional landscaping around a portion of the lift
station.
d. The monument sign location, design, and landscaping, shall be reviewed and
approved by staff prior to installation.
e. A final landscape plan shall be reviewed and approved by Staff.
a. The exact locations and design of the street lights will be evaluated with each
final plat application. The street lights be decorative and shall comply with the
City standards for street lighting within the public right-of-way.
Signage
a. Final design, location, and landscaping of the entrance monument signage for the
development shall be reviewed and approved by staff.
Streets/Access
a. The developer shall address all comments in the Washington County comment
letter dated November 7, 2019.
i. Plans for street connections to CSAH 8 shall be reviewed and
approved by the Washington County
ii. All permits required from Washington County shall be issued.

Architecture
a. The developer shall develop and implement architectural review and design
guidelines for all residential buildings. Architectural design guidelines shall be
reviewed approved by City staff.
Open Space and Trails
a. The preliminary plat and PUD general plan shall be revised to include a
neighborhood gathering space in the general location of Lots 1-3, Block 3, are
shown in the plan as previously proposed.
i. The plans shall include landscaping and amenities.
b. The plans shall be revised to include a trail along Street A south to Egg Lake
Road (CSAH 8). The trail shall be installed and paid for by the developer.
Miscellaneous
a. The applicant shall revise the lot depth for Lot 1, Block 1, to be in compliance
with the rear yard setback of 30 feet.
