HomeMy WebLinkAbout2020.01.06 RESO 2020-4 Variance for Street Frontage at 17530 Henna Ave RESOLUTION 2020-4 APPROVING A VARIANCE FR OM ROM THE STREET FRONTAGE REQUIREMENTS FOR A PARCEL LOCATED AT 17530 HENNA AVENUE NORTH WHEREAS Wayne Scanlan has requested approval of a variance request to allow a yn q pp q parcel to have 0 feet of road frontage, where 300 feet is required by ordinance for the property legally described as follows: See Attached WHEREAS, the Planning Commission has reviewed said variance at a duly called public hearing on December 19, 2019, and recommends approval with the following findings and conditions: 1. Parcel ID 03.031.21.32.0002(parcel D) and 03.031.21.23.0002 (parcel A) shall be combined into one lot. 2. The proposed variance is permissible by law. 3. The applicant is proposing to use the property for a single family home. This is reasonable use of the property as it is consistent with how the properties have been used for several years. 4. Parcel A has a separate tax identification number and has been used as a separate parcel for several years. Although the property has a covenant against it to be combined with parcel C, it is unique in that is has a home on it and has been used as a separate parcels for several years. 5. The variance will not noticeably change the character of the area. 6. There are practical difficulties in meeting the ordinance standards. 7. The spirit and intent of the ordinance is to ensure parcels in the FUS zoning have adequate street frontage for access to the parcel. The property does have approval cross parcel B with a shared driveway to access the parcel. The property has adequate access to a public street and meets the spirit and intent of the ordinance. 8. The property is not located within a floodplain area. 9. The property is served by well and a septic system. 0 Resolution 2 2 -4 0 0 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the variance request for Wayne Scanlan to allow a parcel to have 0 feet of road frontage, where 300 feet is required by ordinance.
