HomeMy WebLinkAbout2020.05.04 RESO 2020-22 PUD for Shores of Egg LakeRESOLUTION 2020-22 APPROVING PUD GENERAL PLAN FOR ANTHONY HARMENING, FOR "SHORES OF EGG LAKE" ON PROPERTY LOCATED SOUTH OF 147TH STREET NORTH AND EAST OF HIGHWAY 61 (FOREST BOULEVARD NORTH) WHEREAS, Anthony Harmening, has requested approval of a PUD general plan to allow the development of a an approximately 5,700 square foot restaurant with an approximately 4,000 square foot event center and three retail buildings totaling approximately 10,100 square feet on a 4.2 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Anthony Harmening, subject to the following conditions: 1. A PUD general plan is approved to allow the development of a restaurant with event center and three retail buildings. The development shall be constructed in accordance with the application and plans received by the City on January 17, 2020, and April 10, 2020, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested rezoning of the 4.2 acre property and preliminary plat. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. The developer shall comply with all conditions in the resolution for the site plan and preliminary plat (Resolution #2020-24 and Resolution #2020-23 5. The developer shall comply with all conditions in the City Engineer's letter dated April 1, 2020. 6. The developer shall comply with all items in the MnDOT letter dated February 26, 2020. All access points require a permit to be issued from MnDOT. 7. The dock and boardwalk shall be reviewed and approved by the MnDNR and the Technical Evaluation Panel (TEP). 8. Architectural design guidelines shall be reviewed and approved by staff. Resolution 2020-22 Page 2 9. PUD flexibility is granted to allow: a. Flexibility to allow a minimum shoreland setback of 49 feet, where 125 feet is required. b. Flexibility for reduced parking space requirements for shared parking throughout the PUD to allow 174 parking spaces, where 192 parking spaces are required by ordinance. c. Flexibility to allow parking side yard setback to be 4.3 feet where 5 feet is required by ordinance. 10. The preliminary phasing plan is generally approved per plans dated April 10, 2020. Any major revisions to the phasing plan shall require PUD amendment. Minor modifications shall be reviewed and approved by staff. a. Phase 1 shall include: i. An approximately 5,700 square foot restaurant building. ii. All improvements shown in the phase 1 plan, including trails and boardwalks. b. Phase 2 shall include: i. Three retail buildings totaling approximately 10,000 square feet. ii. A 4,000 square foot event center. iii. All improvements shown in the phase 2 plan, including trails and boardwalks. 11. Phase 2 shall be required to apply for site plan, and other applicable applications, to be reviewed and approved by the Planning Commission and City Council. 12. The developer has not provided calculations that would allow additional food service/restaurants in the proposed PUD in the retail buildings. If there are food service/restaurant uses proposed at a later date, the parking space requirements shall be further evaluated for review and approval by the City. 13. The building setbacks and impervious surface coverage requirements for the PUD are as follows: Front Setback 10 feet (min) Side Setback 0 feet (min) 4.3 feet for parking lot 30 feet Rear Setback min Lot Impervious 50% (max) 25% in shoreland overlay Resolution 2020-22 Page 3 14. A stormwater re -use system shall be further evaluated. If it is feasible, it shall constructed. 15. As the future phases are constructed the developer shall have a commercial association created to maintain the common areas, including parking, lighting, landscaping, and boardwalks.
