HomeMy WebLinkAbout2020.05.04 RESO 2020-24 Site Plan for Cattle House RestaurantRESOLUTION 2020-24 APPROVING A SITE PLAN FOR CATTLE HOUSE RESTAURANT ON PROPERTY LOCATED SOUTH OF 147TH STREET NORTH AND EAST OF HIGHWAY 61 (FOREST BOULEVARD NORTH) WHEREAS, Anthony Harmening, has requested approval of a site plan for an approximately 5,700 square foot restaurant building on property that is legally described as follows: See Attached WHEREAS, the Planning Commission has reviewed said site plan and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve site plan for TGK Automotive, under the following conditions: 1. A site plan is approved in accordance with the plans submitted on January 17, 2020, and April 10, 2020, except as amended by this resolution. 2. Prior to the installation of any signs, the developer shall obtain a sign permit. 3. Any expansions of the building will require review and approval by the Planning Commission and City Council. 4. The improvements on the property shall be maintained by the developer. 5. A stormwater re -use system shall be further evaluated. If it is feasible, it shall constructed. Prior to the issuance of a building permit: 5. All items on the Engineer's memo and "red -line" detailed engineering comments that have been sent directly to the developer's engineer dated April 1, 2020, shall be addressed. 6. All items in the MnDOT comment letter dated February 26, 2020, shall be addressed. An access permit shall be issued by MN DOT. 7. An eight foot easement shall be dedicated for right of way for the future expansion of TH 61. 8. A trail easement shall be dedicated to the City for the trail along the lake and connections to the south and north. Resolution 2020-24 Page 2 9. The boardwalk and dock shall be reviewed and approved by the MnDNR and the Technical Evaluation Panel (TEP) Architecture/Building Material 10. The developer shall provide a material samples and proposed colors for all building materials for review and approval by staff. 11. The developer shall provide construction details and material samples for the deck for review and approval by staff. If railings are installed, the details and design shall be reviewed and approved by staff. 12. The developer shall provide details for the awning for review and approval by staff. 13. The developer shall provide details and building materials for the boardwalk and dock for review and approval by staff. 14. The developer shall provide details for the glass for review and approval by staff. 15. The elevations shall be revised to include a stone sill, or comparable material, between the stacked stone and other building materials to provide a transition between the different materials. 16. Architectural design guidelines shall be reviewed and approved by staff. Streets and Access 17. A cross access and parking easement shall be dedicated across the property for the benefit of adjoining properties to the north and south. The easement language is subject to review and approval of staff. 18. The developer shall work with the property owner to the north along Highway 61 on access. Miscellaneous 19. The developer shall continue to work with City staff on the lighting plan and type of lighting fixtures. The final plan shall be reviewed and approved by staff. 20. A stormwater re -use system shall be further evaluated. If it is feasible, it shall contracted. Resolution 2020-24 Page 3 21. The developer shall continue to work with the City on the location of the trail and what portions will be constructed with the development. 22. The developer shall continue to work with the City on the location of the trash enclosure. Prior to issuance of a Certificate of Occupancy: 23. Landscaping shall be fully installed per approved landscape plan. 24. All of the improvements shall be constructed per the approved plans. 25. All roof top mechanical equipment must be screened from view of adjacent properties. Staff shall perform an inspection when equipment is installed to ensure compliance with City code. 26. Drainage and utility easements shall be dedicated to the City over the stormwater management facilities. 27. The developer will be responsible for maintaining stormwater facilities and vegetation proposed as a part of the project. A maintenance agreement between the City and the developer shall be reviewed and approved by the City then recorded against the property. ADOPTED by the City Council this 4th day of May, 2020.
