F.1 Sheriff Department Annual Report – Sheriff Dan Starry Sheriff Dan Starry will present to Council the Sheriff’s Department’s Annual Report for 2018. F.2 Presentation of GFOA Award for Excellence in Financial Reporting - Finance Director Ron Otkin Finance Director Ron Otkin has received notification from the Government Finance Officers Association of the United States and Canada that the Hugo Finance Department has received their 24th Certificate of Achievement for Excellence in Financial Reporting. As Council is aware, this certificate is the highest form of recognition in governmental accounting and financial reporting, and its attainment represents a significant accomplishment by a government and its management. G.1 Approve Claims Roster Staff recommends Council approve the Claims Roster as presented. G.2 Approve Annual Performance Review for Public Works Worker Rick Kieffer Rick Kieffer was re-hired by the City of Hugo on May 31, 2005 returning after a short period of time in the private sector. Over the past 14 years, Rick has worked under the direction of Public Works Director Scott Anderson who recommends Council approve the Annual Performance Review for Public Works Worker Rick Kieffer. G. 3 Approve Donation to the Hugo Fire Department from the Centennial Youth Hockey Association The Centennial Youth Hockey Association conducts gambling at the Blue Heron Grill and has donated $1,500 to Hugo Fire Department. The Gambling Control Board requires approval of contributions to a unit of government. Staff recommends Council approve the donation from the Centennial Youth Hockey Association of $1,500 to the Hugo Fire Department. G.4 Approve Special Event Permit for Outdoor Tent Party at Blue Heron on June 21-22, 2019 The Blue Heron Bar and Grill, 14725 Victor Hugo Boulevard, has applied for a Special Event Permit for their annual outdoor tent party to be held on Friday, June 21 and Saturday, June 22, 2019. A Special Event Permit approved by Council is necessary because alcohol will be sold outdoors, over 200 people are expected to attend, it will extend after dark, and there will be amplified music. Bands will play from 8:30 p.m. - midnight on each day. The music will be outdoors in a tent adjacent to the west entrance of the building. This event has been held for the past five years with no major impact to surrounding residents or businesses. Staff recommends Council approve the Special Event Permit for the Blue Heron Grill Tent Party subject to the conditions in the memo to Council. G.5 Approve Application for Water Surface Use Permit for David Strub on Sunset Lake On behalf of residents living on Sunset Lake, resident David Strub has made application to the City of Hugo for a water surface use permit to allow residents to water ski on the slalom course on the lake. Washington County Sheriff’s Department has provided the application form that has been completed by David Strub. City staff recommends Council approve the application for a water surface use permit for a water skiing course on Sunset Lake. G.6 Approve Application for Water Surface Use Permit for Mike Ball on Round Lake On behalf of residents living on Round Lake, Resident Mike Ball has made application to the City of Hugo for a water surface use permit to allow residents to water ski on the slalom course on the lake and put a water ski jump on the lake. Washington County Sheriff’s Department has provided the application form that has been completed by Mike Ball. City staff recommends Council approve the application for a water surface use permit for a water skiing course on Round Lake. G.7 Approve Closing of City Offices on Friday, July 5, 2019 The City’s Personnel Policy allows for each employee to take one day of their choosing as a personal holiday. Staff is requesting to take their personal holiday on the day following Independence Day. Staff recommends Council close City Offices on Friday, July 5, 2019, to allow all staff to take that day as their personal holiday. G.8 Approve Resolutions Approving Waters Edge 6th Addition PUD and Preliminary Plat   Hugo Ventures, LLC, is requesting approval of a preliminary plat and PUD amendment to revise the Waters Edge preliminary plat and PUD general plan to create 37 single family villa style (slab on grade patio homes) lots and 1 outlot (common space), where 104 townhome units where previously approved. The development would be known as “Waters Edge 6th Addition”. The overall net density for this phase of the project will be approximately 4 units per acre. At its May 9, 2019, meeting, the Planning Commission held a public hearing and considered the request. There was one resident, besides the applicant, that spoke during the hearing. The Planning Commission generally liked the plan and had a few general questions. The Planning Commission unanimously recommended approval of the resolution for preliminary plat and PUD amendment for Waters Edge 6th Addition, subject to the conditions listed in the resolution. G.9 Approve Resolution Approving a Variance for 7755 125th St. N. -Wlaschin Matt Wlaschin, 7755 125th Street North requested approval of a variance from the height regulations for a proposed accessory building on his property. The variance request is to allow a maximum of 25 feet in height where 20 feet is allowed by ordinance. At its May 9, 2019 meeting, the Board considered the variance request and held a public hearing. Staff provided background on the request and recommended approval. There was no one that spoke during the public hearing. The Board agreed that the request met the criteria necessary to approve the variance and recommended approval of the resolution for the variance request to the City Council. G.10 Approve Reduction in Credit for The Preserves on Sunset Lake The Preserve on Sunset Lake, has had significant work completed to date and the developer, Shlayba, Inc. is requesting an initial reduction in the letter of credit. The current letter of credit is in the amount of $632,724. Staff has inspected the work completed to date and recommends reducing the letter of credit to $320,000 based on the value of the work remaining to be completed. G.11 Approve Pay Voucher No. 2 for the Water Tower No. 4 Improvement Project CB&I, LLC, has submitted Pay Voucher No. 2 for the Water Tower No. 4 improvement Project. Staff has inspected the work and found it to be satisfactorily complete for work certified through April 30, 2019. Staff is recommending approval of Payment Voucher No. 2 to CB&I, LLC for the Water Tower No. 4 Improvement Project. K.1 Update on the Yellow Ribbon Network Council Member Chuck Haas and Phil Klein will report to Council on the Yellow Ribbon Network activities held recently. L.1 Waters Edge “Flip the Switch” Celebration on Thursday, May 23, 2019 Council has scheduled a meeting to attend the ceremonial “Flip the Switch” event at Waters Edge when they will be turning on their stormwater reuse irrigation system and promote Phase II of the project. It has been suggested the event be held on Wednesday, May 22, 2019, at 3:30 p.m. L.2 Reschedule Victor Garden HOA Workshop to Monday, June 10, 2019 At its May 6, 2019, meeting, Council scheduled a workshop for June 24th with the Victor Gardens North Village HOA to discuss issues raised at the April 15, 2019 Council meeting. The HOA requested the meeting be rescheduled to Monday, June 10th at 7 p.m. Staff recommends Council reschedule the meeting to June 10, 2019 L.3 Schedule Hugo Yellow Ribbon Network 10th Anniversary, Tuesday, June 25, 2019 The Hugo Yellow Ribbon will be celebrating their 10th anniversary on Tuesday, June 25, 2019 at City Hall in the Oneka Room. Social Hour begins at 6 p.m. with a ceremony to follow at 7 p.m. Staff recommends Council schedule this as a meeting if they choose to attend. RSVPs are requested. L.4 Vacancy on Carnelian-Marine-St. Croix Watershed District The Washington County Board of Commissioners will be accepting applications for the Carnelian-Marine-St. Croix Watershed District Board of Managers. Applicants must reside in the Watershed District. Applicants should apply with Washington County Office of Administration by July 16, 2019. M.1 Executive Session - City Administrator Performance Review Council has scheduled the City Administrator’s Performance Review as an executive session immediately following the regular Council meeting. All Ayes. Motion carried. Donation to Yellow Ribbon Network – Bayport Gambling Manager Kelly Green The Bayport American Legion conducts gambling at Sal’s Angus Grill. Members of the Hugo Yellow Ribbon work during Bingo at Sal’s by selling meat raffle tickets. Bayport Legion Gambling Manager Kelly Green presented a donation of $4,500 from raffle proceeds to the Yellow Ribbon Network. Council Member Haas thanked the Bayport Legion, Sal’s, and Barb Connelly for her organization in making the meat raffles happen. Presentation of Commissioners Award - Commissioner Miron Washington County Commissioner Fran Miron presented the Commissioners Award to Council Member Becky Petryk for her work on the Transportation Advisory Board on behalf of Washington County. Petryk served over ten years on the 32-member TAB, many years alongside Commissioner Miron. Commissioner Miron explained their concern that the County would not receive a fair distribution of regional funding under the solicitation process. Petryk stepped up to defend a fairer scenario resulting in additional funding for the County. The County was to receive $500,000, but instead received $5 million. Petryk stated she was able to make the case due to very valuable data she received from City staff and the County. Good Neighbor Days – Lions Members Dan Balthazor The Hugo Good Neighbor Days Festival will be held Thursday, June 6th - Sunday, June 9th in Lions Park. The Hugo Lions Club will run the event similar to past years to include a parade, music, food, beer garden, petting zoo, carnival rides, and fireworks. Lions Member Dan Balthazor explained they would be adding an additional petting zoo, additional band, bean bag tournament, vendor craft fair, and they were working on getting inflatables for the kids. Lions Member Jason Schwieger talked about the addition of “Rib Fest” cook-off with meat being Hugo City Council Meeting Minutes for May 6, 2019 Page 3 of 9 donated by Grundhofers Old Fashioned Meats. They talked about the increased membership in the club and how new members were adding new ideas to make it a more family-friendly event. They stated the goal of the club was to meet the $1 million mark in money distributed throughout the community through the Lions Club. Haas made motion, Klein seconded, to co-sponsor the event by waiving the Special Event Permit fee and providing police protection services for the event, as in the past. All Ayes. Motion carried. Adoption of the Consent Agenda approved the renewal of the 2 a.m. license for the Blue Heron Grill. Approve Renewal of 2 a.m. License for Sal’s Angus Grill Since May, 2010, Sal’s Angus Grill has held a license that permits the establishment to stay open until 2 a.m. This license is renewed annually with approval by the City Council. Adoption of the Consent Agenda approved the renewal of the 2 a.m. license for Sal’s Angus Grill. Approve Hiring of Public Works Seasonal Employees In the 2019 General Fund Budget, Council approved funding for six seasonal employee positions. Staff had spoken to several employees from last year who would like to return again this year. One position was filled by two employees each working part time. Therefore, a total of seven employees were needed to fill the six seasonal positions. Seasonal Public Works Employees assist with mowing, garbage/litter removal, park maintenance, boulevard maintenance and general public works maintenance. Adoption of the Consent Agenda approved the hire/re-hire of seasonal employees Jack Menne, Roland Guareschi, Marty Schwartz, Frank Weiss, Daniel Flaherty, Paxton Zirpel, and Zachary Kenoyer for the Public Works Department. Approve Temporary On-sale Liquor License for the Lions Club for Good Neighbor Days The Hugo Lions Club had applied for a temporary On-Sale Liquor License to serve beer and Bloody Marys at the Hugo Good Neighbor Days Festival June 6-9, 2019. Adoption of the Consent Agenda approved the temporary On-Sale Liquor License for Good Neighbor Days. Approve Off-Site Gambling Permit for Hugo Legion for Good Neighbor Days Bingo The Hugo American Legion had applied for an Off-Site Gambling Permit to conduct Bingo at Hugo Good Neighbor days on June 6-9, 2019, at Lions Park. Adoption of the Consent Agenda approved the Off-Site Gambling Permit for Good Neighbor Days. Hugo City Council Meeting Minutes for May 6, 2019 Page 5 of 9 Approve Resolution for Planned Unit Development (PUD) Amendment for Adelaide Landing OP5 Adelaide (Excelsior Group) had requested approval of a PUD Amendment to change the 70- foot wide single family lots to 65-foot wide single family lots. With the proposed PUD amendment and the previous PUD modifications, their total proposed lots would be 324, where 319 was approved with the original PUD request. The PUD amendment is consistent with the City’s Comprehensive Plan and the approved Adelaide Landing PUD. The Planning Commission had agreed that the proposed amendment was reasonable and would not noticeably change the overall plan for the PUD. The Planning Commission unanimously recommended approval of the PUD amendment for OP5 Adelaide (Excelsior Group) for the development to be known as “Adelaide Landing”, subject to the conditions listed in the resolutions. Adoption of the Consent Agenda approved RESOLUTION 2019-21 APPROVING PUD AMENDMENT FOR OP5 ADELAIDE (EXCELSIOR GROUP) FOR “ADELAIDE LANDING” ON PROPERTY LOCATED EAST OF HIGHWAY 61 AND NORTH OF 130TH STREET. Approve Resolution for Board of Trustees Request for Increase in Lump-Sum Pension The Board of Trustees for the Hugo Firefighter’ s Relief Association had formally requested City Council ratification of an increase of $100 per year of service in their lump-sum pension benefit. The Finance Department had reviewed this request and found it to be financially feasible and consistent with the Pension Fiscal Policy adopted in April, 2012. Adoption of the Consent Agenda approved to ratify the Board of Trustees’ request for a $100 increase in their lump-sum pension benefit and corresponding change to their by-laws. Accept Donation from the Bayport American Legion to the Hugo Fire Department The Bayport American Legion conducts gambling at Sal’s Angus Grill and had donated $5,000 to Hugo Fire Department. The Gambling Control Board requires Council approval of contributions to a City. Adoption of the Consent Agenda approved the donation from the Bayport American Legion of $5,000 to the Hugo Fire Department. Accept Donation from the Hugo American Legion to the Hugo Fire Department The Hugo American Legion and has donated $200 to Hugo Fire Department from its gambling proceeds. The Gambling Control Board requires Council approval of contributions to a City. Adoption of the Consent Agenda approved the donation from the Hugo American Legion of $200 to the Hugo Fire Department. 130th Street Roundabout Improvement Project City Engineer Mark Erichson informed Council that bids for the 130th Street Improvement Project were received on April 30, 2019. A total of four bids were received with bids ranging from $2,650,716.57 to $3,188,066.71. The engineers estimate was $2,814,416.00. The low bidder was Dresel Contracting, Inc., who staff is familiar with and have had great success with on past projects. Erichson talked about what the project consisted of, and he reviewed the project schedule showing construction starting in mid-June, 2019, and final completion planned for November 2019. Hugo City Council Meeting Minutes for May 6, 2019 Page 6 of 9 Klein asked about the center of the roundabout. Erichson replied that it would be planted with grasses as outlined the contract. The development team may do a more intense planting. In that case, they would be responsible for the maintenance Miron made motion, Klein seconded, to approve RESOLUTION 2019 – 22 A RESOLUTION RECEIVING BIDS AND AWARDING A CONTRACT FOR THE 130TH STREET IMPROVEMENT PROJECT. All Ayes. Motion carried. Approve Award of Bid for 2019 Dust Control Project Public Works Director, Scott Anderson informed Council that Bids for the 2019 Dust Control Project were opened on May 1, 2019. There are approximately 25 miles of gravel roads and dust control has been applied to all of them twice per year since 2008. The City had received mostly positive feedback from residents. The City cost shares with May Township for Keystone Avenue and also works with the City of Grant in the bidding process. Anderson announced the low bidder was Northern Salt at $0.878 per gallon, and he recommended the contract be award to them. Haas made motion, Klein seconded, to award the bid to Northern Salt, Inc., to apply calcium chloride at $0.878 per gallon. All Ayes. Motion carried. Update on Gravel Roads City Engineer Mark Erichson explained that for a number of years, Hugo has had performance issues with a number of its gravel roads. In 2018, the City Council authorized further evaluation of these gravel roads and a number of work sessions followed. Erichson explained the process they went through to evaluate the roads, and he reviewed their findings. This resulted in a recommendation to reclaim the gravel roads (mix the layers of existing gravel within the road structure), yielding a better gradation of material. Council had authorized test sections to be completed in 2018 on Ingersoll Ave, 175th Street, Inwood Ave, and 180th Street (1.67 miles). The approach taken to correct the issue was to clean up the aggregate structure, modify the approach to dust management, increase the cross slopes to shed water, and incorporate compaction into the blading process. This had positive results, and the roads were performing well. The 2018 project cost $12,000 plus staff time and traffic control. There was a remaining 5.5 miles of problematic gravel roadways at an estimated cost of $40,000, plus staff time and traffic control, that staff was recommending to move forward with in 2019. Miron asked about the dust control on the roads, how it performed, and when it would be done. Public Works Director Scott Anderson replied the plan was to reduce dust control and adjust the application up or down dependent on how the roads performed. Timing would be subject to the Public Works Department work load, and Anderson stated the weather was a big factor. The plan was to put chloride down in mid-June and possibly again in mid-August. Hugo City Council Meeting Minutes for May 6, 2019 Page 7 of 9 Weidt made motion, Miron seconded, to move forward with receiving quotes for reclaiming the remaining 5.5 miles of problematic gravel roads. Discussion on “No Parking” Resolution for Rosemary Way At the April 15, 2019, City Council meeting, Council considered the Site Plan and Conditional Use Permit for the Rosemary Apartments. During the discussion, a comment regarding parking on Rosemary Way had come up from an individual in the audience. City Engineer Mark Erichson explained that Rosemary Way was currently designed as a 32-ft wide roadway and was part of the City’s State Aid Roadway system. Currently, there were not any parking restrictions along Rosemary Way. A number of options exist such as leaving the roadway with no parking restrictions, restrict parking on only one side, and restrict parking on both sides. Rosemary Way is a state aid roadway; however, the width doesn’t meet their requirements for parking on both sides of the roadway and the long-term plan for Rosemary Way, as identified in the Comprehensive Plan, would not include parking along Rosemary Way. He recommend Council approve a no parking resolution and post Rosemary Way as no parking. Update on the Yellow Ribbon Network Council Member Chuck Haas and Phil Klein reported to Council on the Yellow Ribbon Network activities held recently. April’s Burger Night was sponsored by the Washington County Sheriff’s Department. St. Johns Men’s Club will be the May sponsors. Haas shared photos of Girl Scout cookie recipients along with items donated by John Udsteun. The YRN received a “thank you” for assisting a solider in a medical emergency. They also assisted in getting someone help with lawn care, and they provided meals for a sick mom with four kids whose husband was in the Navy. Lions Jayne Hurt was able to get more 3M Command Hooks for care packages, which are high in demand. June 25, 2019, will be the 10th year anniversary of the Hugo Yellow Ribbon, and a celebration will be held at City Hall. Schedule Annual Performance Review for City Administrator Bryan Bear City Administrator Bryan Bear has been employed with the City since May 3, 2004. Bryan served as the Community Development Director until being appointed the City Administrator on November, 7, 2011. Bear recommended Council schedule his annual performance review. PLANNING COMMISSION UPDATE: At its May 9, 2019, meeting the Planning Commission held a public hearing and considered the request. There was one resident, besides the applicant that spoke during the hearing. The residents had concerns about increased traffic at the Heritage Parkway and Education Drive intersection in front of Oneka Elementary School. She asked if there was going to be more traffic control in the area. Staff stated that there are school zone signs in the area that flash during school hours and the sheriff’s department has done extra patrol in the area recently. Staff does not expect a large amount of additional traffic with the development. Staff recommended approval of the applications. The Planning Commission generally liked the plan and had a few general questions. The applicant noted that the development would have its own sub-association as part of the Waters Edge Master Association. The Planning Commission unanimously recommended approval of the applications of preliminary plat and PUD amendment for Waters Edge 6th Addition, subject to the conditions listed in the resolution. Page 2 2. DESCRIPTION OF REQUEST: The applicant is requesting approval of a preliminary plat and PUD amendment to revise the Waters Edge preliminary plat and PUD general plan to create 37 single family villa style (slab on grade patio homes) lots and 1 outlot (common space), where 104 townhome units where previously approved. The overall net density for this phase of the project will be approximately 4 units per acre. 3. BACKGROUND: The originally approved Waters Edge preliminary plat and PUD general plan included a total of 605 units on approximately 185 acres with an overall net density of 4.3 units per acre. The development was approved in 2002. The project is a mix of housing styles including single family detached homes, patio homes (villa), manor townhomes, and village townhomes. Each housing styles have their own Homeowners Association (HOA) and are part of the Master HOA for Water Edge. This property is approximately 13 acres and was final platted as “Waters Edge 4th Addition” creating 16 townhome lots which allowed for 120 townhome units including 6-unit and 8-unit buildings. The streets, utilities, lighting, and some landscaping has been installed for the development. However, only 16 units in two buildings were constructed, leaving 14 townhome lots and 104 units vacant and not built. 3. CONTEXT: A. Surrounding land Use and Zoning The properties to the north and east are zoned PUD and are occupied by townhomes, single family homes, and patios homes (villas) in the Waters Edge residential development. The properties to the south are zoned Agricultural (AG) and are occupied by large lots and single family homes. The properties to the west are zoned PUD and are occupied by townhomes and single family homes in the Heritage Ponds residential development. B. Natural Characteristics of Site The property has been previously graded for three-story 6 to 8 unit townhome buildings. The streets, utilities, lighting, and some landscaping has been installed. The property will need to be graded for the proposed single family villa style (patio) homes. 4. ANALYSIS: A. Level of Discretion in Decision Making The City has relatively high level of discretion in approving a PUD amendment. A PUD amendment must be consistent with the City’s comprehensive plan. The City may impose Page 3 reasonable requirements in a PUD not otherwise required if the City deems it necessary to promote the general health, safety, and welfare of the community. The City’s discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the subdivision regulations in the City Code. If it meets these standards, the City must approve the preliminary plat. B. Consistency with Ordinance Standards Preliminary Plat and Planned Unit Development (PUD) Amendment The use of the PUD zoning allows the developer zoning ordinance flexibility to create a master planned development. The PUD zoning is tied to a specific PUD general plan. This project is tied to the Waters Edge PUD general plan. The 2030 Comprehensive Plan shows the land use being Low Density Residential (LD). The PUD amendment is consistent with the Comprehensive Plan in terms of land use and density. It is in staff’s opinion that the Waters Edge PUD general plan has offered a creative and efficient method to planning the site, all which meets the intent of the PUD ordinance. The proposed PUD amendment is to allow 37 single family villa style home (patio homes), where 120 three-story 6 to 8 townhome units were approved. There are patio homes in the Waters Edge development and there are regulations for patio homes for the development. The density is proposed to the less than what was originally approved, but still complies with the minimum density required. Since the approval of the Waters Edge development in 2002, the housing market has changed quite a bit. The construction of townhomes has slowed down significantly. The applicant would like to build single family villa style homes (patio homes), instead of the approved townhomes. Lot Sizes The PUD district does not have minimum standards for lots sizes for the Waters Edge development. The maximum development density for a PUD in the R-3 zoning district is 4 units per 1 acre. The density range for the Low Density Residential (LD) land use is 2 to 4 units per acre. The applicant is proposing a residential net density of approximately 4 units per acre, which fits the requirements of a PUD. Although the development allows flexibility on lot sizes and setbacks, the density meets the ordinance standards. Setbacks Setbacks for the home styles where established the Waters Edge PUD approval in 2002. The patio homes would be located on envelope lots and surrounded by a common lot. The proposed units would comply with the following standards: Page 4 Minimum front yard setback from private drive curb 25 feet Minimum side yard setback 10 feet Minimum side yard setback (internal) 15 feet between buildings Minimum rear yard setback 25 feet Minimum rear yard setback (internal) 15 feet between buildings Rear yard and setback around perimeter of the site (exterior property lines) for Lots 20 - 23 25 feet However, lots 20 – 23 do not meet the rear yard or perimeter setback of 25 feet from the exterior property lines. The area behind the four lots is a wetland and stormwater management area. This area will be not be built on and will be preserved. Staff is comfortable with the request to have these lots be a minimum of 15 feet from the perimeter property line for lots 20 – 23. Landscaping Section 90-181 Landscaping of the City Code provides requirements for landscaping in residential developments. The ordinance requires a minimum of 2 deciduous shade trees in the front yard of each home site. The applicant is asking for flexibility from the landscape requirements. The applicant is proposed a mix of deciduous shade trees, coniferous (evergreen) trees, and ornamental trees around the homes site and in the common areas for a total of 133 trees. This totals 3.6 trees per home site, exceeding the number of trees required. It is in staff’s opinion that this is a good alternative to the City Code requirements and believes the intent of the City is meet. There are 97 existing trees along the west and south property lines that where installed by the previous developer and will remain. This was part of the overall Waters Edge PUD landscape plan. Staff did not use these existing trees in the count for proposed landscape flexibility. Staff recommends that the plan be revised to remove trees that may interfere with utilities or drainage. This is listed as a condition in the resolution. The plan shall be reviewed and approved by staff prior to final plat approval. Lighting Street lighting has already been installed along the private streets. Streets/Access The private streets have already been installed for the development. No street construction is proposed except minor curb work. Cross access and maintenance agreements for the streets shall be recorded with the final plat. Page 5 Sidewalks and Trails Sidewalks have already been installed along the south side of Education Drive (private street). There are no additional sidewalks proposed for the development. The developer has proposed to dedicate a 12 foot trail easement starting from the north side of lot 20 and along the west property line to connect to Elmcrest Avenue. The trail is not proposed to be built with the project. At this time there is not a trail along Elmcrest Avenue. It is in staff’s opinion that the trail easement is in a good location and at the time the properties to the south develop, it would provide good connections to parks in the area and the Oneka Elementary School. It will also provide access to the commercial services along County Road 8. Grading/Drainage/Wetlands There is some grading that is proposed for the development. The building pads were graded assuming the three-story townhomes would be built. There will be dirt removed from the building pads and grading will occur for the proposed single family villa style homes (patio homes). Stormwater management facilities have already been installed to accommodate the development with previous phases. An analysis has been performed to ensure the stormwater management facilities have been designed and built to serve the proposed development. The overall impervious surface coverage is less that what was previously approved. The City Engineer has determined that the stormwater facilities are appropriately sized to serve the proposed development. There are several retaining walls proposed with the development. The retaining shall be maintained by the HOA. Any retaining was over 48 inches will be required to have a fence along the top. Staff recommends a decorative style fence. Staff has added as a condition of approval that the fence design be decorative and approved by staff prior to installation. No wetland impacts are proposed with the development. Utilities Sanitary sewer, storm sewer and watermain has already been installed for the development. However, in order to serve the proposed single family villa style homes (patio homes) private sanitary sewer, storm sewer and watermain. The previous utilities that were installed were constructed to have one main connection to each 6 and 8 unit townhome building. Each proposed unit will need individual connections requiring the change for private utilities. The HOA will be responsible for the private utilities. Page 6 Water Re-use Water reuse will be utilized as part of this development. Water for irrigation will be delivered to the site from the Water’s Edge Phase II Stormwater Reuse Improvement Project. Architecture The applicant has provided four building designs for the single family villa style home (patio homes). The applicant has also provided a design and color palette for the homes. The PUD requires no adjacent home have the same front elevation and that the buildings shall have varied and interesting detailing. Each home shall utilize architectural accent features such as dormers, bay windows, arched windows, etc. The building designs that the applicant has submitted are a good start to meeting the intent of the PUD requirements. Staff will continue to work with the applicant on the home design prior to final plat approval. The design shall be reviewed and approved by staff. Homeowners Association It is staff’s understanding that the proposed single family villa style homes (patio homes) will be part of the Master HOA for the Waters Edge Development, but will have their own sub- association. The HOA will be responsible for maintenance of the private streets/sidewalks and utilities, landscaping, retaining walls, and common space. Park Dedication Park dedication requirements have been fulfilled with the first phase of this development when the park land was dedicated to the City. No additional dedication is due with this phase. 5. CONCLUSION: Staff has reviewed the preliminary plat and PUD amendment for consistency with the standards outlined in the Comprehensive Plan and Waters Edge PUD general plan, and finds that the proposed PUD amendment is consistent with the standards. 6. STAFF RECOMMENDATION: Staff recommends approval of the preliminary plat and PUD amendment, subject to the conditions listed in the resolution. 7. PLANNING COMMISSION RECOMMENDATION: The Planning Commission generally liked the plan and had a few general questions. Sincerely, Fred Stelter Fred Stelter Water’s Edge Sixth Addition Compliance with Multi-family Design Guidelines April 16, 2018 The following discusses how the proposed Villa homes for Waters Edge Sixth Addition will comply with the various design standards found in Section III of the City of Hugo Multi-family Development Design Guidelines adopted December 19, 2005. A. GENERAL This section stresses creative site planning and quality architecture to avoid monotony. The proposed PUD Amendment will provide a new villa style home to the Waters Edge Community and thus variety from the existing adjacent row townhomes. The proposal is for three base model homes and the amended plat allows for some homes to have patios and others three car garages. A large color palette for the exterior will also provide diversity with no usage of the same color palette for any adjacent home allowed. Also, no same model of home will be allowed adjacent to another to further break up any potential monotony of the homes. B. SITE PLANNING BASICS This section stresses placement of building to avoid a monotonous, barrack-style of development and minimizing transitions from existing developments to minimize impacts. The PUD Amendment changes the design concept from 106 units of row townhomes to 37 villa style single family homes. This greatly reduces the impact on the existing townhome units that have been built and breaks up the potential monotony of adding similar row townhome units with the variety of each villa home with the large potential color palette and variety of home models. C. BUILDING SETBACKS This section discusses setbacks and certain desired building designs for window and porches for multi-family units to create a better sense of community. The proposed villa homes have a number of windows on all sides and a small front porch area and so incorporate this suggestion. The setbacks for the entire Waters Edge development were previously approved and will be complied with unless otherwise noted to accommodate certain lots. D. BUILDING MASS This section discusses that the units should be articulated to break-up the building façade on all elevations and how it might be accomplished. The proposed villa units will have a variety of elements that break up the façade including columns, porches, window and dormers. Additionally, the use of a stone façade on a portion of the first level will further accomplish this goal. The building materials proposed will include Smartside siding and stone on the front side of the villa unit and vinyl siding on the other three sides. E. ARCHITECTURE This section discusses a variety of architectural elements. The proposed architecture elements for the front side of the villa units to use stone accent on the lower portion and Smartside lap siding combined with the variety of models and color palette will provide a unique design for the units. Vinyl lap siding will be used on the other three sides with a variety window sizes and shapes to further enhance the architectural design and appeal. F. TRAFFIC AND PEDESTRIAN CIRCULATION This section discusses the street design. The Waters Edge development street design was previously approved and the streets are built. The proposed villa design utilizes the existing streets and so the garages will face the private street frontage. The existing streets also provide for a circular flow thru the development and so is of good design for traffic flow. A proposed trail easement will be incorporated into the west side of the proposed development area to allow for future addition of a trail. G. STREETS, PUBLIC SPACE AND AMENITIES The PUD for the entire Waters Edge development was previously approved which included the street design, driveway setback minimums, parking spaces, mailbox clusters, common open space and amenities which included the club house and pool. Accordingly, these items are complied with under that PUD approval. Additional items that are relevant in this section relate to garages and landscaping. The villa home design has the garages even with the front of the home with the front door entrance set back to allow for a small porch area. This avoids a garage forward or “snout-nose” design which is highly discouraged in the design guidelines. Given the existing street design it is not possible to not have the garages face the street. All garages will be at least two-car designs. The HOA documents will include language discouraging overnight parking in driveways or use of garages as storage units. The proposed separate landscaping plan for the new villa homes provide a variety of trees and shrubs to meet the requirements. (Master) Board of Directors has met and discussed the plans presented by Fred Stelter that involves the undeveloped areas adjacent to Waters Edge Village Homes. Agenda Number G.9 CITY OF HUGO COMMUNITY DEVELOPMENT DEPARTMENT PLANNING AND ZONING APPLICATION STAFF REPORT TO: Bryan Bear, City Administrator FROM: Emily Weber, Community Development Assistant SUBJECT: Matt Wlaschin – Variance from the height regulations for an accessory building located at 7755 125th Street North. DATE: May 16, 2019 for the City Council Meeting on May 20, 2019. ZONING: Rural Residential (RR). REVIEW DEADLINE: June 17, 2019. 1. BOARD OF ZONING UPDATE: At its May 9, 2019 meeting, the Board considered the variance request and held a public hearing. Staff provided background on the request and recommended approval. There was no one that spoke during the public hearing. The Board agreed that the request met the criteria necessary to approve the variance and recommended approval of the resolution for the variance request to the City Council. 2. DESCRIPTION OF REQUEST: The applicant is requesting a variance from the height regulations to allow a maximum of 25 feet in height for the proposed accessory building. The City Code requires that no accessory building can exceed the height of the principal building (home) on the property. The height of the principal building is 20 feet, therefore a variance is required. The property is six acres and is located within the Rural Residential (RR) zoning district. 3. LEVEL OF CITY DISCRETION IN DECISION-MAKING: The City’s discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that they meet the standards in the ordinance. 4. ANALYSIS: Wlaschin Variance Page 2 2 A. Surrounding Land Use and Zoning The properties to the north are zoned RR and are generally occupied by single family homes on two acre parcels. The properties to the east, south, and west are zoned PUD and are large, five to ten acre lots that will be occupied by single family homes. The area is classified as Large Lot Residential (LD) in the 2030 Land Use Plan. B. Accessory Structure Height Variance The City Code requires that no accessory building can exceed the height of the principal building (home) on the property. The height of the principal building is 20 feet. The applicant is requesting a variance to allow a maximum of 25 feet in height for the proposed accessory building. 5. VARIANCE STANDARDS: The Board must review the requested variances with the standards outlined in Section 90-38 of the land use regulations. Staff used these standards to review the variance request and finds the following: (1) Law. The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term “Practical Difficulties” as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and; Accessory buildings are allowed in the RR zoning district. The applicant is proposing to use the property in a reasonable manner. b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and; The property is unique in that it is a large lot (six acres) and is surrounded by parcels similar in size or larger. The property has a primary structure that is a one level, walk out style home with a height of 20 feet. There are two story homes in the area and they are allowed in the zoning district. The property is also unique from the surrounding properties because of the substantial stand of trees. There are full grown evergreen trees that significantly cover the length of the property, screening much of the property from public view. c. Character of Neighborhood. The variance, if granted, will not alter the essential character of the neighborhood. Wlaschin Variance Page 3 3 Accessory buildings are common within this area and are allowed in the RR zoning district. The surrounding development has lot sizes from five to ten acres and will generally have primary structures that are two-story buildings, allowing for large accessory buildings on the properties. There are existing accessory structures in the area that are similar in size and height of the applicant’s proposed accessory building. The proposed height variance would not noticeably alter the character of the area. (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City’s Comprehensive Plan. Accessory buildings are common in the RR zoning district. The intent of the ordinance is to allow a property owner to have a reasonably sized accessory building on the property and to regulate the height of accessory buildings based on the height of the primary structure on the property. This prevents accessory buildings from dominating the appearance of the property. The property is six acres and is allowed, by Code, up to three accessory buildings with a maximum combined size of 4,000 square feet. The proposed accessory building will be located behind the primary structure. The property has a large area of full grown evergreen trees along the length of the property and is well screened from public view. The proposed accessory building will be located east of the trees, and with additional landscape screening planted along the east side of the proposed building, the structure will not be easily seen from the surrounding properties. It is the staff’s opinion that the proposed building would not dominate the appearance of the property and would be keeping with the spirit and intent of the ordinance. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. Accessory structures are a permitted use in the RR zoning district. (5) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. The property is not located within a FEMA designated floodplain. (6) Septic and Well Compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The property is served by well and septic systems. Any additional septic system installed must comply with city and state codes. 6. CONCLUSION: It’s in staff’s opinion that the applicant meets all the criteria necessary to approve the variance request. 7.
