G.2 Approve Annual Performance Review for Public Works Worker Jeff Maas Jeff Maas was hired by the City of Hugo on July 24, 2006, as a Public Works Worker. Public Works Director Scott Anderson recommends Council approve the annual performance review for Public Works Worker Jeff Maas. G.3 Approve Contract with Oertel Architects for the Public Works Facility Staff has been working with Oertel Architects to prepare plans and specifications for the construction of a new Public Works facility located at the Irish Avenue Park property. Oertel Architects has prepared a standard agreement that outlines how they will assist the city in the delivery of the new facility once all approvals are in place. Staff recommends council approve the contract with Oertel Architects. G.4 Approve Application for Water Surface Use Permit for David Strub on Sunset Lake On behalf of residents living on Sunset Lake, resident David Strub has made application to the City of Hugo for a water surface use permit to allow residents to water ski on the slalom course on the lake. Washington County Sheriff’s Department has provided the application form that has been completed by David Strub. City staff recommends Council approve the application for a water surface use permit for a water skiing course on Sunset Lake. H.1 Public Hearing on Capital Improvement Plan and Bonds Minnesota statutes allow cities to issue capital improvement plan bonds for certain public improvements, including public works facilities. The statutes require that a hearing be held to gather public input regarding the proposed 5-Year Capital Improvement Plan and the possible issuance of bonds. The Finance Director will present the plan to the Council. Following the public hearing staff recommends the City Council adopt a Resolution Giving Preliminary Approval for the Issuance of G.O. Capital Improvement Plan Bonds in an Amount Not to Exceed $8,000,000 and Adopting the Capital Improvement Plan. I.1 Approve Site Plan for Public Works Facility The City of Hugo Public Works Department is proposing to construct an approximately 60,600 square foot Public Works Facility on the south side of Irish Avenue Park located off of 140th Street North (CSAH 8). The Irish Avenue Park property is approximately 125 acres in size with the building and site improvements taking up approximately 10 acres. The area includes space for an approximately 45,000 square foot expansion of the building in the future. Staff finds that the proposal meets all the requirements necessary for the City to approve the site plan as outlined in the City Code, if the conditions are met in the attached resolution. Staff recommends adoption of the resolution for the site plan for the Public Works Facility to be located Irish Avenue Park located at 14420 Irish Avenue North. I.2 Approve Resolution Authorizing Advertisement for Bids for Public Works Facility Oertel Architects will have the final design and bidding documents for the new Public Works facility completed by July 16th. Bid packets would be available for distribution on July 20th. A bid opening date of August 11th is expected. Staff recommends Council authorization for the advertisement of bids for the construction of the new Public Works facility located at the Irish Avenue Property. L.1 Update on the Yellow Ribbon Network Council Member Chuck Haas and Phil Klein will report to Council on the Yellow Ribbon Network activities held recently. N. City Engineer Mark Erichson presented potential alignments of 147th Street on the north side of Lions Park. Some of the alignments included a trail as shown in the Trails Plan. The Council discussed the options and directed staff to continue looking into constructing a trail on the north side of 147th Street with a future road project. Update on COVID-19 City Response City Administrator Bryan Bear provided an update on how the City was responding to the Governor’s orders regarding the coronavirus pandemic. Bear explained the rules of virtual meetings and the Governor’s Order 20-74 that was issued the previous week, moving the Stay Safe Plan into Phase III. The City’s soccer fields were being played on every day under a special Open to Play Plan that contained state and federal guidelines. Park Play Days was occurring at Hanifl Fields with small groups. Portable restrooms were now available at City parks. Restaurants were beginning to open, and City services remained available. Phase III of the Stay Safe Plan provided attendance limits on gatherings, requirement to adopt a COVID-19 Preparedness Plan, requirement to work from home if possible, and it strongly encouraged government meetings be held remotely. The City had prepared a plan to allow staff to come back to work safely. The plan ensured sick workers stay home, and it contained social distancing and work hygiene protocols. It also included specific provisions for the Public Works Department and the Fire Department. Staff was preparing an agreement for users of the City’s community facilities to allow for a maximum of 25% capacity with safely provisions. Bear talked to Council about how the state of emergency allowed remote meetings during a pandemic and makes exceptions to State Statute requirements on how they can be conducted. If not in a state of emergency, remote meetings needed to comply with the statute requiring Council Minutes HUGO CITY COUNCIL MEETING REMOTE MEETING MONDAY, JUNE 15, 2020 – 7 P.M. Hugo City Council Meeting Minutes for June 15, 2020 Page 2 of 5 members be in a public place or a place the public has access to. Bear stated that the Council could have in-person meetings but rules would apply. Some of the public may not want to attend in person, but some would, which could cause overcapacity of social distancing. Next meeting Council meeting was scheduled for July 6, and Council needed to decide if it would be held in person or remote. Bear also asked Council to provide guidance on the use of community rooms. Council discussed the requirements staff had proposed for the use of the community rooms. There was concern by the Council regarding the safety of staff with people using the facilities during work hours. Bear reminded them that staff had the option to work from home and could make a choice on what they were comfortable with. Council agreed the rooms belonged to the public and should be made available. Council next discussed whether to continue meeting remotely or hold meetings in the Council Chambers. Bear explained that remote meetings were dependent on whether there was an active state of emergency. As soon as that was lifted it, it would problematic because the public had the right to witness anyone’s participation, and the public would need to be allowed into all places a council member was attending from. Council generally agreed to continue meeting remotely until the state of emergency was lifted and revisit the issue at the next meeting on July 6, 2020. Approval of the City of Hugo COVID-19 Preparedness Plan Under the last Executive Order released by Governor Walz, critical sector businesses, which includes cities, were required to adopt COVID-19 Preparedness Plan by June 29. Additional guidance for critical businesses would be provided on or before June 15. Staff had drafted a plan in preparation for the June 29 deadline knowing it may need to be changed. Included in the plan was a stipulation for the City Administrator to approve amendments to the plan. Weidt made motion, Haas seconded, to approve the City of Hugo COVID-19 Preparedness Plan. Hugo City Council Meeting Minutes for June 15, 2020 Page 3 of 5 Approve Pay Voucher No. 10 for Water Tower No. 4 Project Staff had received Pay Voucher No. 10 from CB&I, LLC, for work completed to date on the Water Tower No. 4 project. Staff found it acceptable for work certified through June 20, 2020. Adoption of the Consent Agenda approved Pay Voucher No. 10 in the amount of $484,331.54 Approve Resolution Approving Variance for Rear Yard Setback at 12160 Falcon Avenue Richard and Cynthia Degnan, had applied for a variance from the rear yard setback requirement for a proposed accessory building on their property at 12160 Falcon Avenue North. The request was to allow the accessory building to be built 10 feet from the rear lot line where 30 feet was required by ordinance. The property was approximately one acre and located within the Large Lot Single Family Residential (R-1) zoning district. A public hearing was held at the Board of Zoning Appeals and Adjustments meeting on May 28, 2020. There were no comments on the request, and the Board agreed it met all the criteria necessary for approval. Adoption of the Consent Agenda approved RESOLUTION 2020-27 APPROVING A VARIANCE FROM THE SETBACK REQUIREMENTS FOR AN ACCESSORY BUILDING LOCATED AT 12160 FALCON AVENUE NORTH. Approve Reduction in Letter of Credit for Oneka Place 3rd Addition Oneka Place 3rd Addition had substantial work completed and the developer had requested a reduction in the letter of credit. The letter of credit was in the amount of $557,141. Staff had inspected the work completed to date and recommended reducing the letter of credit to 10% of the original letter of credit of $2,131,352. Adoption of the Consent Agenda approved the reduction in the letter of credit for Oneka Place 3rd Addition to $213,135. Approve Reduction in Letter of Credit for Adelaide Landing 3rd and 4th Addition Adelaide Landing 3rd and 4th Additions had substantial work completed, and the developer had requested a reduction in the letter of credit for both the 3rd and 4th Additions. The letter of credit for the 3rd Addition was in the amount of $225,150. Staff had inspected the work completed to date and recommended Council approve the reduction in the letter of credit to 10% of the original letter of credit of $842,744. The letter of credit for the 4th Addition was in the amount of $334,767. Staff had inspected the work completed to date and recommended Council approve the reduction in the letter of credit to 10% of the original letter of credit of $463,267. Adoption of the Consent Agenda approved the reduction in the letter of credit for Adelaide Landing 3rd Addition to $84,274 and to $46,326 for the 4th Addition. Approve Access License Agreement with Rice Creek Watershed District The Hugo City Council had attended an informational meeting on October 8, 2019, about a repair project of Judicial Ditch 3 by Rice Creek Watershed District. Rice Creek Watershed District had requested temporary use of the main entrance to Clearwater Creek Preserve Park for access to the ditch for the purposes of the repair project. Adoption of the Consent Agenda approved the Access License Agreement with Rice Creek Watershed District. Hugo City Council Meeting Minutes for June 15, 2020 Page 4 of 5 Approve Scheduling of Public Hearing on Bond Issuance for Monday, July 6, 2020 Staff had been working with engineers and architects on designing a new public works facility at Irish Avenue Park. Concurrently, administrative procedures needed to be followed if capital improvement plan bonds were going to be issued to finance this facility. State statutes required that a public hearing be held to take comment on the proposed capital improvement plan and subsequent bond issuance. Adoption of the Consent Agenda approved a public hearing to be held on Monday, July 6th at 7:00 p.m. at which the public is encouraged to participate. Victor Place PUD Amendment and Site Plan Planner Kendra Lindahl provided information on the request from Pratt Ordway Properties for approval of a PUD amendment and site plan to allow construction of a single story, 13,879 square foot office/retail building. The development would be primarily located on Lot 2, Block 1, Victor Gardens Commons and partially on Outlot A, Victor Gardens South Village. The two parcels would be combined at the County following Council approval. A public hearing was held at the Planning Commission on May 28, 2020, where they voted 4-2 to recommend approval of the PUD amendment and site plan resolution without condition 5.a. that required the applicant mirror the south roofline on the north elevation. The Commission was split 3-3 on the roofline discussion. Residents that spoke at the public hearing were mainly concerned about traffic and access, and staff will be following up with them separately. One letter had been received in support of the project. Lindahl reviewed the proposed site plan and recommended approval of it. She presented the elevations of the building and went into detail on the roof line explaining the north elevation and the south elevation are not the same. Looking through the rooflines, you could see the back of the other elevation. Staff had recommended the roofline be revised to comply with the Victor Garden PUD standards, and the Planning Commission recommended to approve as presented. Applicant Len Pratt was in attendance with his partner John Ordway. Len explained the only point of entry was on the south side of the building. The north side was on CSAH 8, and if you looked at the elevation, the building sat below the road, and people drive at 45 miles an hour. He said it was a subjective decision to leave as is, and the Planning Commission had concurred after discussion. The building tenant would be KidsAbilities, who is currently a tenant of Pratt Ordway in Shoreview and are in need of space. It was Pratt’s opinion the elevations looked good. Haas made motion, Klein seconded, to approve RESOLUTION 2020-28 APPROVING PLANNED UNIT DEVELOPMENT (PUD) AMENDMENT AND SITE PLAN FOR “VICTOR PLACE” (PID 19-031-21-24-0077 AND 19-031-21-23-0154). Recap on Lions Park Feasibility Study Workshop Earlier this evening, Council held a workshop to review the Lions Park Feasibility Study as it pertained to streets. Bear explained it was timely because the City may need to move forward obtaining easements if they are needed for construction. He requested Council schedule a joint workshop with the Parks Commission on Monday, June 29 or Wednesday, July 1. Motion carried. Update on the Yellow Ribbon Network Council Member Phil Klein reported to Council on the Yellow Ribbon Network activities held recently. Haas talked about the certificate of appreciation they received from the National Guard for serving meals to those helping with the civil disturbances, and he showed pictures. He also had pictures of those receiving care packages and slippers hand-knit by a Korean War veteran. The YRN helped a couple who was in transition and received a thank you from a family who received some financial assistance. The YRN was providing support to soldiers at Camp Ripley who will be deployed next month. A $5,000 check was received from the White Bear Lions Club. Hass noted that it was the fourth donation they had made. Klein provided a reminder that Burger Night was cancelled. City Administrator Performance Review on Tuesday, June 16, 2020 The Council had scheduled the annual performance review for City Administrator Bryan Bear for Tuesday, June 16, 2020, at 3 p.m. Bear asked the Council to discuss how they would like to hold this meeting. Council agreed to hold the meeting remotely. Public Works Director Scott Anderson provided a summary of the facility needs study completed in February. Community Development Director Rachel Juba reviewed the site plan application for the public works facility at the south side of Irish Avenue Park. The public service building is allowed in the zoning district as a permitted use. Residents shared their thoughts and asked questions, and they were encouraged to continue to work with staff directly as the project proceeds. Introduction A Capital Improvement Plan (CIP) is a document designed to anticipate future capital improvement expenditures so that they may be purchased in the most efficient and cost effective method possible. The City of Hugo, Minnesota (the "City") believes the capital improvement process is an important element of responsible fiscal management. Major capital expenditures can be anticipated and coordinated so as to minimize potentially adverse financial impacts caused by the timing and magnitude of capital outlays. This coordination of capital expenditures is important to the City in achieving its goals of adequate physical public assets, preservation of public assets and sound fiscal management. 2. Purpose In 2003, Minnesota Statutes 475.521 was created to allow cities to issue bonds for certain public facilities without requiring a referendum of the electorate. The statute also gave cities the authority to provide a general obligation pledge to the repayment of the bonds Minnesota Statutes 475.521 defines capital expenditures as "the acquisition or betterment to public lands, buildings, or other improvements used as a city hall, town hall, library, public safety, or public works facility," with a useful life of five or more years. For the purposes of M.S. 475.521, capital improvements do not include "light rail transit or related activities, parks, roads/bridges, administrative buildings other than city or town hall, or land for those facilities." The purpose of this document is to satisfy the requirements in M.S. 475.521 and issue bonds for the purpose described in Sections 4 and 5. 3. Capital Improvement Planning Process The City Council authorizes the preparation of the Capital Improvement Plan (CIP). City staff is instructed to assemble the capital expenditures to be undertaken within the next five years. The City Council then reviews the expenditures according to their priority, fiscal impact, and available funding. From this information, a preliminary capital improvement plan is prepared. The City Council then prepares a plan based on the available funding sources. If bonding is necessary, the City works with its financial advisor to prepare a bond sale and repayment schedule. In subsequent years, the process is repeated as expenditures are completed and as new needs arise. For a municipality to use its authority to finance expenditures under M.S. 475.521, it must meet the requirements outlined in the statutes. Specifically, the governing body must approve the sale of capital improvement bonds by a 3/5ths majority of its membership. In addition, the City must hold a public hearing for public input. Notice of such hearing must be published in the official newspaper of the municipality at least 14, but not more than 28 days prior to the date of the public hearing. The governing body approves the CIP following the public hearing. Although a referendum is not required, a reverse referendum is allowable. If a petition bearing the signatures of at least 5 percent of the votes cast in the last general election requesting a vote on the issuance of bonds is received by the municipal clerk within 30 days after the public hearing, a referendum vote on the issuance of the bonds shall be called. 2020-2024 Capital Improvement Plan Page 3 4. Project Summaries The expenditures to be undertaken with this CIP and financed under M.S. 475.521 are as follows: • 2020 Expenditures *Public Works Facilities $13,739,000 • 2021 Expenditures *None • 2022 Expenditures *None • 2023 Expenditures *None • 2024 Expenditures *None In 2020 the City intends to construct public works facilities on city owned property at Irish Avenue Park. The estimated construction cost of the project is $13,739,000. The maximum amount the City expects to issue bonds for is $7,200,000. 2021 Expenditures thru 2024 Expenditures *None The City's comprehensive 2020-2024 Capital Improvement Plan, including the capital projects not financed under M.S. 475.521 is provided in the appendices to this document. 5. Minnesota Statute 475.521 Criteria M.S. 475.521 outlines eight criteria that must be met prior to a city issuing bonds under this authority. Under these criteria, the City has considered the following eight points for each project: 2020 Public Works Facilities 1. Condition of the City's infrastructure and need for the project. The Public Works Facility is currently inadequate in form and function to serve the growing needs of its citizens. 2. Demand for the improvement. The City conducted a space needs study, which identified the need for additional vehicle storage, maintenance and employee office space. 3. Cost of the improvement. Construction is estimated at $13,739,000. The maximum amount the City expects to issue bonds for is $7,200,000. 4. Availability of public resources. The City has used cash to this point to fund the space needs study and architectural process in order to get valid cost estimates. The primary source of funds for this project will be a tax levy, therefore the debt service payments on the new bonds will be levied on property tax payers within the City. 5. Level of overlapping debt - See table 6. Cost/benefits of alternative uses of funds. Due to the immediate need for upgraded Public Works facilities to continue efficient operations of the City, there are no better alternatives for funds designated for this project. 2020-2024 Capital Improvement Plan Page 4 7. Operating costs of the proposed improvements. The annual operating cost of the new facility is expected to be approximately $100,000. The annual operating cost in the current facility is approximately $85,000. 8. Options for shared facilities with other cities or local governments. It was determined by the Council that sharing facilities of this type will not meet the City's current and future needs. Overlapping Debt (Preliminary) Overlapping debt consists of all the taxing jurisdictions within the City of Hugo and is a measure of the total debt burden with the City. The other taxing jurisdictions include Washington County, ISD 624, ISD 831, ISD 832, ISD 834 and the Metropolitan Council. The statutes state that the total amount that can be used for debt service in any one year cannot exceed 0.16% of taxable market value for the City. The City currently does not have any outstanding debt issued under M.S. 475.521. The statutory maximum annual debt service payment allowed is approximately $3,065,370. The maximum annual debt service payment on the proposed $7,200,000 CIP Bonds is estimated to be approximately $532,767. Given the estimated debt service payments, the City will not exceed the statutory limit. Proposed Public Works Facility to be Located at Irish Avenue Park - 14420 Irish Avenue North DATE: July 2, 2020, for the Planning Commission Meeting of July 6, 2020 ZONING: Agricultural (AG) COMPREHENSIVE PLAN: Agricultural (AG) 1. PLANNING COMMISSION UPDATE: At its June 28, 2020, meeting the Planning Commission considered the request. They had questions on access improvements, access to Irish Avenue Park, and how does this blend in with the existing park. The Planning Commission liked the design of the building and generally agreed the plans were good. There were no residents that attended the Planning Commission meeting. The Planning Commission unanimously recommended approval of the site plan to the City Council for the Public Works Facility. 2. DESCRIPTION OF REQUEST: The City of Hugo is proposing to construct an approximately 60,600 square foot Public Works Facility on the south side of Irish Avenue Park located off of 140th Street North (CSAH 8). The Irish Avenue Park property is approximately 125 acres in size, however the site that the Public Works Facility will be on is approximately 40 acres, with the building and site improvements taking up approximately 10 acres. The area includes space for an approximately 45,000 square foot expansion of the building in the future. The Public Works Facility is considered a public service building and is allowed in the zoning district as a permitted use. The facility will include a salt storage building, material storage building, and outdoor storage of gravel, dirt, and rocks. There will be a fence around the perimeter of the site and landscaping. Public Works Facility – Irish Ave Park Page 2 3. BACKGROUND: Irish Avenue Park is a former gravel pit, asphalt production plant, and rock crushing facility. This was a private business. There were several complaints from the neighboring properties because of the impacts of the use related to noise and traffic. There were also guidelines the business needed to comply with that were not being followed, including the restoration of the mined areas to their natural state by 2004. The adjacent neighborhoods wanted to see the site restored. The City held a neighborhood meeting in 2007 to discuss the issues related to the property and the possible re-use of the property. There were a few options stated at the meeting that included development of the site in 10 acre lots and the possibility of the property to become a community park starting with low impact parks uses and having more active uses in the future like ballfields. The neighborhood favored the park uses over development of the property. The City sued the gravel pit operator to restore the property. A settlement agreement resulted in the property being restored in 2008. In 2009, the property was available for sale and the City purchased the property. The Parks Chapter of the Comprehensive Plan at the time identified an area in eastern Hugo for a location of a community park. The Parks Commission was looking for 80 acres of land for a community park. They purchased the 125 acres of property and completed an extensive clean-up of the junk cars, garbage, debris, and structures that were left behind. After the property was purchased and cleaned, the City held another neighborhood meeting in September 2009. The goal was for the property to be enjoyed by the public. It was stated at the meeting the long-term uses (15 years from the date of purchase) would be ballfields, athletics, lights, noise, traffic; the short term uses were stated to be a dog park, equestrian uses, archery, trails, and other passive park uses. In the Comprehensive Plan it states that because of the growth of the City an expansion of the Public Works Facility may be needed. In 2019, the City Council created goals and included completing a space needs study for the Public Works Facility to determine the current and future needs. The study identified the need for more space to meet the current and future needs. The study considered expanding the existing Public Works Facility. It determined that an expansion could meet the needs for the next 15 years, but does not allow the long term expansion beyond 15 years. The existing building was not designed to be readily expanded; an expansion would result in several scattered additions to the building and due to the constraints of the site (size, wetlands, etc.) it is limited on where the additions could be. The study then considered a new facility location. This could allow for more cost effective future expansion planning, more efficient building design, and flexibility in layout. The City Council approved its budget and financing plan to allow for an expanded or relocated Public Works Facility. After discussions with the Parks Commission and City Council it was decided to evaluate and start drafting plans to relocate the Public Works Facility to the south end of Irish Avenue Park. The Parks Commission goals for 2020 include starting to master plan Irish Avenue Park with improving access and addition of amenities in the park. With or without the Public Works Facility, this process is expected to take place this year including meeting with surrounding neighborhood. This staff report will focus on the Public Works Facility relocation only. Public Works Facility – Irish Ave Park Page 3 Parks Commission Update During its last couple meetings the Parks Commission has been discussing the location of the Public Works Facility at Irish Avenue Park. They generally like the proposed location and provided the following comments on the proposed site plan: • Ensure the trails within the park are relocated/rerouted and remain an amenity to the park. • Allow parking at the Public Works Facility for access to the park. o Add a walking path from the parking lot to the access to the park. • Screen outdoor storage areas and provide a landscape buffer around the Public Works Facility from the park area. o They wanted to make sure the view from the park to the Public Works Facility remain as natural as they can. • Agreed there is enough room on the remaining portion of the property to implement the vision of the community park for more active park uses. Public Works Facility Neighborhood Meetings Update The City Council held neighborhood meetings on March 4, 2020, and June 18, 2020, to discuss the Public Works Facility planning. There were several residents that asked questions and provided comments. Below is a summary of the comments: • The passive trails in the area should be relocated and the remaining passive trails to the north should remain in place. • Concerns on traffic along 140th Street (CSAH 8). • Some residents wondered why the City would be planning for the location of the Public Works Facility when master planning for Irish Avenue has not been completed yet. • There were some suggestions to move the building to a different location on the park property. • Encouraged buffers from adjacent properties. There have been suggestions about berms for further screening and buffering. • Some residents have concerns of the use being in the area and some did not want the use in the park. It was explained by the Public Works Director that there were other properties considered for the relocation of the facility. This site made sense because it is centrally located in the City, was a property the City already owned, and allowed for expansion opportunities far into the future for the facility. The Parks Commission will be working on a master plan for Irish Avenue Park this year. The location on the site was intentional to allow the access to be on a County Road that can accommodate more traffic than a local road. Public Works Facility – Irish Ave Park Page 4 4. CONTEXT: A. Surrounding Land Use and Zoning The properties to the north, east, and south are zoned Agricultural (AG) and are occupied by homes on large lots or are vacant large lots. The properties to the west are zoned Rural Residential (RR) and occupied by homes on large lots. B. Natural Characteristics of Site The property is a former gravel pit, asphalt production plant, and rock crushing facility, which has been restored. It is a community park with passive park uses including trails. The area for the Public Works Facility has varied terrain and several wooded areas. There is a small amount of wetlands on the property. The wetlands are not proposed to be impacted with this project. 5. ANALYSIS: A. Site Plan The site plan complies with the ordinance standards as follows: Building Setbacks The proposed building meets all setback requirements in the Agricultural zoning district. Building Height The height of the majority of the building is proposed to be 25 feet, with the highest point at 33 feet. This height complies with the 35 foot maximum height in the Agricultural zoning district. Building Coverage and Lot Coverage In the Agricultural zoning district buildings shall be allowed to cover up to 20% of the property and the impervious surface shall be allowed to cover up to 35% of the property. The proposed buildings and pavement complies with this regulation. Parking The parking ordinance does not outline specific parking requirements for a Public Works Facility. However, staff used the parking requirements for office and warehouse uses to determine the amount of parking required. The area for the Public Works Facility (phase 1), without the building expansion (phase 2), is required to have 66 total parking spaces. With the building expansion would require 122 total parking spaces. Public Works Facility – Irish Ave Park Page 5 The plans shows 38 proposed parking spaces. There is additional space to the east of the parking lot to expand the parking area or to show “proof of parking”. There is also additional area in the paved areas around the building for additional parking. There is plenty of space for additional parking on site and staff does not see this as an issue. The plans shall be revise to include the required amount of parking or proof of parking for phase 1 and show where parking would be located for phase 2. The Public Works has approximately 21 employees, including summer seasonal workers, today. It is expected that as the City grows additional employees will be hired in the future. Lighting The ordinance requires lighting to consist of cut-off fixtures and for light cast on adjacent property and roads not to exceed ½ foot candle measured at the property line or 1 foot candle measured at the street’s centerline. The ordinance also required the light fixtures, whether pole mounted or wall mounted to be cut-off fixtures. The plan is proposing LED lights for both the pole and wall mounted fixtures. The lighting plan meets ordinance standards. Landscaping There are several trees on the property that exceeds the requirements for the number of deciduous, coniferous, and ornamental trees. However, staff is recommending additional landscaping for the site. Section 90-181 of the Zoning Ordinance provides landscaping requirements for developments. The site plan includes tree and shrub locations and species. The ordinance provides two ways of calculating the required amount of trees and shrubs. One based on the square footage of the building and one based on the perimeter of the site, whichever is greater. In this case staff used the square footage of the building. In order to meet the landscape requirements, 31 overstory deciduous trees, 31 coniferous trees, 31 ornamental trees, and 203 shrubs are required to be installed. The applicant is proposing 37 overstory deciduous trees, 32 coniferous trees, 28 ornamental trees, and 161 shrubs. Staff is comfortable with counting some of the existing trees and proposed landscape planting substitutions and believes it meets the intent of the landscape ordinance for the amount of landscaping. The plan shows a landscape buffer along the outside of the fence and around the perimeter of the site. There are existing large trees along the west and south sides of the site. Staff does have recommendations for placement of landscaping. In reviewing the landscape plan and grading plan, there may be some conflicts in regards to slopes in the grade for landscaping. It is unclear if this was taken into consideration when the landscape plan was designed. It is a large property, so staff believes there will be solution without having a huge impact on the plans. Staff also recommends additional landscaping along 140th Street (CSAH 8) including the addition of Public Works Facility – Irish Ave Park Page 6 evergreen trees. Other minor revisions will be required, such as trees species and relocation of landscaping, as staff continues to work with the applicant on the landscape plan. Fencing and Screening The plans show a perimeter fence around the Public Works Facility area. The plans do not specify what type of fence will be used or what height the fence will be. Staff is recommending the fence be a black vinyl coated chain link fence. The ordinance allows the following heights for fences: Front Yard: 6 feet Side and Rear Yard: 8 feet The applicant will need to comply with these regulations. The fence can be set on the property lines and no setbacks are required. The applicant has stated that the west side of the property will have some exterior storage of materials (gravel, rock, dirt, etc) on a gravel surface. Exterior storage is allowed in the Agricultural zoning district. There is an exception for properties zoned Agricultural that exterior storage can be on the ground, instead of on an impervious (paved, concrete) surface. The applicant needs to revise the plans to outline the area that will be used for exterior storage of materials. It is in staff’s opinion that the applicant has done a good job screening and buffering the area from the adjacent properties by existing trees, proposed landscaping, and distance from the property lines. The applicant is showing the parapet wall from the roof line of the building to vary between 1 and 3 feet in height. Roof top mechanical requirement is shown on the building elevations in the low points of the roof. The plans show that the majority of the roof top mechanical equipment will be screened with the parapet. All roof top mechanical equipment shall be adequately screened from view. Staff will inspect the roof top mechanical equipment during construction, if the equipment is not screen, staff will require another form of screening. This is listed as a condition of approval. Architecture and Building Materials In August 2011, the City Council adopted the Commercial and Industrial Design Guidelines. The guidelines allow flexibility on four-sided architecture for industrial buildings. The design of the building meets the intent of the guidelines. The building material for the manufacturing/warehouse building consists of integrally colored precast tip-up concrete panels, with varying finished design for an architectural feature. The intent is to ensure the building is constructed of quality materials that require minimum maintenance. The applicant has provided elevations that show coloration and patterning in design of the concrete panels. The concrete is proposed to be earth tones, such as light browns. The front has significant glass and the entrance is clearly defined. There are windows on all sides of the building. The applicant is proposing wood and stone accent materials along the front and west Public Works Facility – Irish Ave Park Page 7 side of the building, which adds some natural materials to the building. The exterior doors and overhead doors are proposed to be compliment the exterior color. Staff will work with the applicant on the proposed color on the overhead doors. The applicant has provided material samples and staff will continue to work with the applicant on the materials and color choices to ensure compatibility. The salt storage building and material storage building are proposed to use the wood accent materials and concrete materials very similar to the Public Works Facility. The applicant has stated that the salt storage building may be revised to simply be a salt barn (canvas covered) like most salt storage buildings. Streets and Access The site has access from 140th Street (CSAH 8). The access location will require an access permit to be issued by Washington County. Washington County provided comments in a letter dated June 18, 2020. They noted that some improvements to the road, such as an eastbound center lane and westbound right turn lane, will be required. This will need to be designed by the applicant and submitted to the County for review and approval. All other items in the letter shall be considered. Utilities The proposed building will be served by a septic system and individual well for the site. The well is designed to accommodate building interior sprinkler (fire suppression) needs. The well will accommodate future uses as well, such as for irrigation for ball fields and other potential park facilities. The septic design will need to be shown on the plans, as well as the backup system area. Stormwater Management The site is proposing to provide stormwater management with an infiltration basin at the south end and a biofiltration basin at the north end. Additional information is required to confirm requirements are met however it appears the proposed stormwater management features are adequately sized to meet rate control and water quality requirements based on the information submitted. Stormwater reuse is not proposed for the property at this time since the ponds will not hold much water. 6. STAFF RECOMMENDATION: Staff finds that the proposal meets all the requirements necessary for the City to approve the site plan as outlined in the City Code, if the conditions are met in the attached resolution. Staff recommends approval of the site plan for the Public Works Facility to be located Irish Avenue Park located at 14420 Irish Avenue North. Public Works Facility – Irish Ave Park Page 8 7. Rud & Sons, Inc. • Stormwater Management Report: Hugo Maintenance Facility dated June 10, 2020 prepared by Kimley Horn. • Report of Geotechnical Exploration and Review: Hugo Public Works Facility dated May 22, 2020. • Washington County Review letter dated June 18, 2020. Based on the review of the above documents, we offer the following comments related to this application: Grading, Street, and Utility Plans 1. Access to the site extends from 140th Street (CR 8). Washington County has provided comments related to the access from the county road. A number of key county comments have been included in this memo below. 2. The next submittal will need to include erosion control plans and a Stormwater Pollution Prevention Plan. Due the amount of disturbed area, the project will require an NPDES permit. 3. The proposed site will be served by an individual well for site. The well is designed to accommodate building sprinkler needs. The well will accommodate future uses as well, such as for irrigation for ball fields and other potential park facilities. A DNR water appropriation permit will be required once use is planned to exceed 10,000 gallons per day. Sanitary sewer and storm sewer should be kept a minimum of 50-ft from the well. This may require some modification to the storm sewer layout. 4. The septic design will need to be shown on the plans (back up area as well). These areas should be identified on the plans and in the field to protect from compaction. Temporary fencing of these areas should be placed during site improvements. 5. Detailed redline comments have been provided on the plans and sent to the applicants engineer so they can be addressed in future submittals. The site is proposing to provide stormwater management with an infiltration basin at the south end and a biofiltration basin at the north end. Additional information is required to confirm requirements are met however it appears the proposed stormwater management features are adequately sized to meet rate control and water quality requirements based on the information submitted. Stormwater reuse is not utilized for this site considering we are able to infiltrate stormwater. 7. Stormwater plan and model comments have been provided to applicant and will need to be addressed in future submittals for documentation and permitting purposes. Wetland 8. We received a wetland delineation report and Joint Application requesting approval of the wetland boundaries and types on June 1, 2020, which was noticed to the Technical Evaluation Panel on June 3, 2020. The area delineated will be expanded slightly and the subsequent report amended to accommodate a slightly larger project area than what was originally completed. This amendment will be distributed to the TEP early the week on J8une 22nd and a subsequent site visit the week of June 22nd or 29th. The comment period ends June 20th. 9. The applicant should demonstrate that hydrology to wetlands will be maintained with the installed stormwater features. 10. The application is expected to be approved as is or with little change, and there is no anticipate wetland impacts based on the current site plans. County Comments 11. The Washington County Comprehensive Plan 2040 identifies 120 feet of future right-of-way along this section of CSAH 8. There is currently 100 feet of right-of-way. Although this is not a subdivision plat, the county requests a minimum 10-foot dedicated roadway easement. Staff will discuss this further with Washington County. 12. The access drive along CSAH 8 should be aligned with the driveway on the south side of the roadway east of the currently proposed location. A Washington County Access permit will be required. 13. Based on the anticipated daily traffic volumes for the maintenance facility, we expect that an eastbound center left turn lane and a westbound right turn lane will be required along CSAH 8. Such improvements, while important, may have impacts to adjacent properties and/or significant trees, and thus the design and alignment of these improvements should be carefully considered. 14. The developer or the City must submit the drainage report and conclusions to our office for review of any downstream impacts to the county drainage system. Along with the drainage calculations, the conclusions that the volume and rate of stormwater run-off into the county right-of way will not increase as part of the project. 15. Any grading within County right-of-way will require a Washington County Right-of-Way Permit. 16. All utility connections for the development require Washington County Right-of-Way permits. Hugo, MN 55038 RE: Comments the Proposed City of Hugo Maintenance Facility Ms. Juba: Thank you for providing Washington County with the plans for the City of Hugo maintenance facility located north of County State Aid Highway (CSAH) 8 (140th Street) between Irish Avenue North and Hyde Avenue North in the City of Hugo. The project includes a new maintenance facility, driveway, and parking storage lot. Future improvements will include a community room and additional parking areas. Based on the plans provided, we have the following comments: • The 2019 traffic count along the section of CSAH 8 is 2650 average annual daily trips (AADT). The Washington County Comprehensive Plan 2040 does not project traffic counts to increase significantly over the planning period. • The Washington County Comprehensive Plan 2040 identifies 120 feet of future right-of-way along this section of CSAH 8. There is currently 100 feet of right-of-way. Although this is not a subdivision plat, the county requests a minimum 10 foot dedicated roadway easement. • The access drive along CSAH 8 should be aligned with the driveway on the south side of the roadway east of the currently proposed location. A Washington County Access permit will be required. • Based on the anticipated daily traffic volumes for the maintenance facility, we expect that an eastbound center left turn lane and a westbound right turn lane will be required along CSAH 8. Such improvements, while important, may have impacts to adjacent properties and/or significant trees, and thus the design and alignment of these improvements should be carefully considered. • The developer or the City must submit the drainage report and conclusions to our office for review of any downstream impacts to the county drainage system. Along with the drainage calculations, the conclusions that the volume and rate of stormwater run-off into the county right-of way will not increase as part of the project. • Any grading within County right-of-way will require a Washington County Right-of-Way Permit. • All utility connections for the development require Washington County Right-of-Way permits. Typically, these are the responsibility of the utility companies. Thank you for the opportunity to comment on this project. SITE DESCRIPTION The Maintenance Facility site is located north of 140th Street North between Irish Ave N and Hyde Ave N in the City of Hugo. Proposed improvements include a new building, entrance driveway and parking/storage lot. The site is proposing to create 7.33 acres of new impervious surface. Future improvements include a community room and additional parking areas. These improvements are included in the proposed stormwater management approach and are included in the 7.33 acres of new impervious. The existing site generally drains in two directions; to the north and to the south. Proposed site conditions will generally follow existing drainage patterns. STORMWATER MANAGEMEN T REQUIREMENTS The Maintenance Facility site will trigger the following stormwater management rules, that the City of Hugo enforces, and issues permits for, based on Rice Creek Watershed District (RCWD) stormwater requirements. A stormwater permit is required for any development that creates 10,000 square feet or more of new impervious surface. Volume Control/Water Quality Water quality volume is required for 1.1 inches off the proposed new impervious for the site. A TP removal factor of 0.65 must be applied where infiltration is not feasible and biofiltration is used. Based on soil borings, a biofiltration basin is proposed to treat the north drainage and an infiltration basin is proposed to treat drainage to the south. Pretreatment structures will be added in any locations where stormwater discharges into the basins. Proposed stormwater runoff rates for the 100- year 24-hour Atlas 14 rainfall event must not exceed 0.1 cfs/acre of the total site runoff, or 3.94 cfs. The total site area is 39.38 acres. The proposed stormwater basins will be designed to meet the rate control requirements. Such plans and specifications, a copy of which is on file at City Hall, are hereby approved. 2. The City Clerk shall prepare and cause to be inserted in the official paper and the Finance and Commerce an advertisement for bids upon the making of such improvement under such approved plans and specs. The advertisement shall be published twice, shall specify the work to be done, and shall state that bids will be opened on Tuesday, August 11, 2020, at City Hall, Hugo, MN. Any bidder whose responsibility is questioned during consideration of the bid will be given an opportunity to address the Council on the issue of responsibility. No bids will be considered unless sealed and filed with the clerk and accompanied by a cash deposit, cashier’s check, bid bond or certified check payment to the clerk for 5% of the amount of such bid.
