Minutes for the Planning Commission Meeting of Thursday, February 27, 2020 Chair Kleissler called the meeting to order at 7:00 p.m. PRESENT: Arcand, Derr, Fry, Kleissler, Mulvihill, Tjernlund. Approval of Minutes for the Planning Commission Meeting of January 23, 2020 Commissioner Arcand made a motion, seconded by Commissioner Tjernlund to approve minutes for the meeting of January 23, 2020. All ayes. Motion carried. The Meadows at Hugo Sketch Plan, Golden Valley Land Company Staff provided a background on The Meadows at Hugo Sketch Plan that was submitted by Golden Valley Land Company. The applicant had previously attended the Parks Commission meeting on March 20, 2019 and the Planning Commission meeting on March 28, 2019 and received feedback from staff as well as the Commissioners. The applicant has since submitted a new sketch plan and staff provided an overview of the changes. The applicant requested that the Planning Commission provide feedback on the overall layout of the sketch plan, lot sizes, and setbacks for the site. Matt Pavek from Civil Site Group addressed the Planning Commission on behalf of the applicant. Pavek stated that the development team has been working the DNR to address the shoreland overlay district requirements and believes the sketch plan reflects those requirements. Pavek also highlighted that they have added trail connections, saved additional wetlands, and altered the layout with the new sketch plan submitted. They are specifically looking for setback flexibility with their PUD request. The plan shows 50 foot lots with 5 foot side yard setbacks. The proposed villa products will be 40 feet wide and 70 feet deep. The applicant stated that should they remove lots from the sketch plan, they will not meet the density requirements. Pavek asked the Planning Commission to discuss the proposal. The Planning Commission continued to discuss the project and asked the applicant clarifying questions. Chair Kleissler stated that she would like to see images of the proposed homes. Pavek stated that a builder has not been identified for the project. They are expecting a slab on grade, villa style product that are single story with the option to have a loft. Staff mentioned that without building elevations, staff is not comfortable making a recommendation on the product type. However, staff believes a product that features a garage that is flush with the front of the home is more desirable than a garage -forward design. February 27, 2020 PC Minutes Page 2 Among their discussion, the Planning Commission gave the following suggestions: • Angling the lots that are along the ditch on the east side of the site. • The developer construct the public street through the City -owned property to the southwest of the site at the developer's expense. • Add character along the eastern road of the development. • Keep the villa products at one -level or one and a half level. • Remove one or more lot to make more space. • Changing the Comprehensive Plan to support the utility change. Agenda Number D.2 CITY OF HUGO COMMUNITY DEVELOPMENT DEPARTMENT PLANNING AND ZONING APPLICATION STAFF REPORT TO: Hugo Planning Commission FROM: Emily Weber, Community Development Assistant SUBJECT: Charles and Marykay Haas. Zoning amendment request to rezone from the Long Term Agricultural Zoning District to the Agricultural Zoning District for the property located at 15500 Keystone Avenue North. DATE: March 30, 2020 for the April 9, 2020 Planning Commission Meeting. ZONING: Long Term Agricultural District (LA) REVIEW DEADLINE: June 17, 2020 1. DESCRIPTION OF REQUEST: Charles and Marykay Haas are requesting to rezone their property from the Long Term Agricultural Zoning District to the Agricultural Zoning District. 2. BACKGROUND: The Minnesota Agricultural Land Preservation Program was established with the passage of the Agricultural Land Preservation Policy Act of 1984, which consists of tools for agricultural land preservation at the local level and a program to create awareness of agricultural land preservation and conservation tools. With this act, counties adopting agricultural land preservation plans can offer agricultural preserves, which limits the use of the land to agriculture or forestry. In return, property owners that opt into the program receive property tax credits and protection for normal agricultural practices. The program also provides tax relief for agricultural and conservation land by requiring the City Assessor to base any assessment on the land's agricultural value, protecting the property from substantial tax levy increases, and protecting the land from special assessments. In order to offer the benefits of agricultural preserves to property owners, a county must have an approved agricultural land preservation plan. An agricultural land preservation plan is a part of a comprehensive land use plan that designates land for long-term agricultural use, while providing Haas Zoning Amendment Page 2 for expected growth around urbanized areas. Hugo has zoning and subdivision provisions outlined in the City Code that restricts properties zoned Long Term Agricultural to agricultural use and require low residential densities at one dwelling unit per 40 acres. In 2004, the applicant was approved for a zoning amendment from the Agricultural Zoning District to the Long Term Agricultural Zoning District in order to enter into the Minnesota Agricultural Land Preservation Program. In order to be removed from the Agricultural Land Preservation Program, the local zoning authority, which is the City of Hugo in this case, needs to approve the zoning amendment from the Long Term Agricultural Zoning District to the Agricultural Zoning District and sign off on the request submitted by the landowner for termination of the current agricultural preserve program. Charles and Marykay Haas would like to rezone their property from the Long Term Agricultural Zoning District to the Agricultural Zoning District. 3. LEVEL OF DISCRETION IN DECISION MAKING: The City has discretion in approving or denying rezoning applications, based on whether or not the proposal meets the standards outlined in the Comprehensive Plan and Zoning Ordinance requirements. If the City finds that all the applicable standards are met, the rezoning application must be approved. However, if the City finds that any of the applicable standards are not met, the application may be denied. 4. CONTEXT: A. Surrounding Land Use and Zoning The subject property is zoned Long Term Agriculture (LA) and the land use is identified as Agricultural. The properties to the north, west, and east are zoned Agricultural (AG). All surrounding properties are identified as Agricultural in the 2040 Land Use Plan. B. Natural Characteristics of Site The 79.41 acre site has a single family home and one accessory structure located on it. The rest of the property is a mix of wetland and natural vegetation. 5. ANALYSIS: Staff has analyzed this rezoning based on the four criteria in the City ordinance under Section 90-40, Zoning Amendments: 1. The requested amendment is in compliance with the City s Comprehensive Plan. The City's Comprehensive Plan identifies the subject property as agricultural. The requested amendment would not change the land use of the property. The property is located in the east part of the City, which is planned for agricultural and rural residential uses. Haas Zoning Amendment Page 3 2. The proposed zoning classification is appropriate for the property given the topographic, environmental and cultural limitations of the site. The property consists of a single family home and is primarily natural vegetation and wetlands. While the property is not used for traditional agricultural pursuits, is does contain high quality natural areas and trees. The Agricultural zoning would be appropriate for the property. 3. Existing public infrastructure is adequate to handle the development that can reasonable be foreseen on the site. The property is served by well and septic. Municipal sewer and water is not available to this area of the City. By changing the zoning from LA to AG, the minimum lot size would change from 40 acres to 10 acres. Because the subject property does not have frontage on a public road, any splitting of the property would require a variance. No development is proposed on the site and the existing access to the property is adequate for the use. 4. The proposed zoning classification will not have unreasonable negative impacts on adjacent properties. The rezoning will not negatively impact the adjacent properties. The property will remain in agricultural and open space uses consistent with other properties in the zoning district. S. The floodplain designation on the official zoning map shall not be removed from floodplain areas unless it can be shown that the designation is in error or that the area has been filled to or above the elevation of the regulatory flood protection elevation and is contiguous to lands outside the floodplain. The floodplain areas are not proposed to be impacted. 6. RECOMMENDATION: Staff finds the application meets the criteria outlined in the City Code and recommends approval of the zoning amendment request to rezone from the Long Term Agricultural Zoning District to the Agricultural Zoning District for the property located at 15500 Keystone Avenue North. DATE: April 1, 2020 for the April 9, 2020 Planning Commission Meeting. ZONING: General Business (C-2) REVIEW DEADLINE: May 15, 2020 1. DESCRIPTION OF REQUEST: Sullivan Day Construction is requesting site plan approval on behalf of TGK Automotive for an approximately 2,900 square foot addition on the existing building located at 13891 Forest Boulevard North. 2. BACKGROUND: TGK Automotive gained site plan approval in 2018 for an 11,337 square foot auto repair building located at 13891 Forest Boulevard North. The building was designed to accommodate a future expansion. The property was previously zoned Neighborhood Service (NS) and was rezoned to General Business (C-2) at that time. Approval of the rezoning request was contingent on proper transitions between the land uses and that the impact on the surrounding residential properties is minimized. 3. LEVEL OF DISCRETION IN DECISION MAKING: The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. TGK Auto Site Plan Phase II Page 2 4. CONTEXT: A. Surrounding Land Use and Zoning The subject property is zoned General Business (C-2) and the land use is identified as Commercial (COM) in the 2040 Land Use Plan. The properties to the north and south are also zoned C-2. The property to the west, across Highway 61, is zoned General Industrial (I-3) and is occupied by industrial users. The properties to the east are zoned Low Density Multiple Family Residential (R-4) and are occupied by the Pineview Meadows Development. B. Natural Characteristics of Site The property is approximately 3 acres in size and has wetland on the northeast portion of the site. There is an existing building on site. 5. SITE PLAN: The applicant is requesting site plan approval for an approximately 2,900 square foot addition on the existing auto repair building on site. The application complies with the ordinance standards as follows: Building Setbacks The City Code requires a 30 foot front yard setback, 30 foot side yard setback, and 30 foot rear yard setback. The site plan meets all setback requirements. Parking The City Code states that an auto repair business is required to have 1 parking space for every 250 square feet of floor area. There are 46 existing parking spaces on site. With this calculation and the new proposed addition, the applicant is required to have 57 parking spaces for the retail building. The applicant is proposing 69 parking spaces. The site plan is showing 12 new parking spaces to the south, 12 new parking spaces to the east, and 6 new parking spaces to the north. The applicant has stated that there is a need for the additional parking. Staff is comfortable with the proposed parking with the condition that the applicant provide additional landscaping on the east side of the site in order to adequately screen the site from the residential neighborhood. Building Coverage and Lot Coverage The ordinance limits lot area to be covered by a building up to 40% and lot area to be covered by impervious surface up to 70%. The building will cover 11 % of the lot and impervious surface will be 44%. The proposed site plan complies with the coverage requirements. TGK Auto Site Plan Phase II Page 3 Lighting There are no new light poles proposed for the site, however, there are exterior wall lights proposed for the side of the building. The lights are proposed to be downcast fixtures. Staff will continue to work with the applicant on the fixture types and locations to ensure that they are directed away from the properties to the east. All lighting for the project shall be downcast, cut- off fixtures to direct light away from adjoining properties and public streets. Landscaping The landscaping on site meets the City's landscape requirements for a commercial development. The applicant is proposing to transplant the 10 existing trees on the east side of the site in order to accommodate for the additional parking spaces created. The trees will be transplanted further east in order to continue screening the building from the neighboring residential uses. Should the transplanted trees die during relocation, the applicant will be required to replace the trees with trees of similar size and maturity. This is listed as a condition of approval. Staff is also recommending that additional evergreen trees be added to the east side of the site in order to provide adequate screening of the parking spaces. Fencing and Screening The applicant is not proposing any fencing for this site. In addition to the existing mature trees along the east property line, the applicant is proposing to transplant the recently planted trees on the east side of the site. This will continue to screen the building from the residential uses to the east. The applicant is proposing to keep the existing trash enclosure on the northeast portion of the building. Architecture and Building Materials The existing building complies with the City's construction standards and guidelines for commercial buildings. The proposed addition will be of the same materials and colors of the existing building and will be cohesive to the overall site. Ponding and Stormwater Management The applicant is proposing to expand the stormwater management features that were constructed with the initial TGK Automotive repair building in order to accommodate the additional impervious surface that is being added to the site. The Stormwater Management Plan submitted meets the requirements for the site. Drainage and utility easements shall be dedicated to the City over the expanded stormwater pond area along with an amended stormwater maintenance agreement. TGK Auto Site Plan Phase II Page 4 Utilities The existing utilities on site can adequately accommodate for the expansion. Streets and Access The existing access to the site is sufficient. The applicant has recorded cross access and maintenance agreements benefitting the properties to the north and south, allowing the neighboring properties to gain access to their sites. 6. CONCLUSION: Staff has reviewed the site plan for consistency with the applicable standards outlined in the City Code and finds that the application is consistent with the standards with the conditions of approval as recommended in the attached resolutions. 7. Additional detailed red -lined comments have been provided to the applicant's engineer. These comments will need to be addressed prior to approval of the construction plans. Stormwater Management 3. The applicant is proposing to expand the stormwater management features that were constructed with the initial TGK construction project to accommodate the additional impervious surface. 4. Required freeboard from groundwater, 100-year high water levels, and emergency overflow elevations with respect to the lowest floor elevation are met. 5. Stormwater management requirements for this site have been satisfied. 6.
