Adjournment BACKGROUND MEMO FOR THE EDA MEETING OF TUESDAY, FEBRUARY 18, 2020 3. APPROVAL OF MINUTES Staff recommends approval of the minutes from the January 21, 2019 EDA meeting as presented. 4. UPDATE ON THE CATTLE HOUSE Tony Harmening has applied for a preliminary plat, PUD, and site plan for the Cattle House restaurant to be located on the city owned property along Egg Lake. The applicant has entered into a purchase agreement with the City and is proposing to build a family style restaurant and event center on the property. Staff will provide an overview of the materials submitted. 5. UPDATE ON DOWNTOWN REDEVELOPMENT Staff will provide an update on downtown redevelopment at the meeting. MINUTES FOR THE EDA MEETING OF JANUARY 21, 2020 Chair Weidt called the meeting to order at 5:26 pm. PRESENT: Denaway, Gallivan, Houle, Klein, Petty, Puleo, and Weidt. ABSENT: Petty and Puleo. STAFF: Bryan Bear, City Administrator Rachel Juba, Community Development Director Emily Weber, Community Development Assistant APPROVAL OF MINUTES FOR THE EDA MEETING OF DECEMBER 17, 2019 Commissioner Klein made a motion, Commissioner Houle seconded, to approve minutes for the EDA meeting of December 17, 2019. All Ayes. Motion carried. REVIEW AND DISCUSS ONEKA COMMONS SKETCH PLAN Staff presented a letter brought to the EDA by the applicant, Peter Stalland, which states that he would like to table the Oneka Commons Sketch Plan application at this time. Due to the letter, the EDA did not discuss the sketch plan in depth. REVIEW AND APPROVE 2020 EDA GOALS Staff reviewed the goals that were discussed at the previous meeting. Staff noted that completing the 165a' Street Study and evaluating the results was added to the 2020 goals. The EDA continued their discussion on the future of the city and what they hope to see, but kept the 2020 goals as presented. Commissioner Denaway made a motion, seconded by Commissioner Klein, to approve the 2020 goals as presented by staff. All ayes. Motion carried. UPDATE ON DOWNTOWN REDEVELOPMENT Staff provided an update on downtown redevelopment. This included the recently submitted site plan, preliminary plat, and PUD applications for the Cattle House Restaurant located on the previously marketed city -owned property along Egg Lake. Tony Harmening has signed the purchase agreement for the property and is working with staff on the proposed restaurant. Emily Weber, Community Development Assistant Applicants Narrative — January 17, 2020 A 4,975 SF Cattle House Restaurant is proposed as phase 1 of the city owned property on Hwy 61 and Egg Lake. The restaurant will be a family style steakhouse and bar with a brand that reflects a local and organic menu for gathering families and events. The building is designed to accommodate a future 200 capacity event center that would share the kitchen facility. The developer/ owner Tony Harmening has extensive catering experience that will be beneficial in orchestrating community gatherings. A large outdoor wood deck is overlooking the lake and the building is situated to take advantage of the views. The restaurant interior has an industrial barn -like feel with heavy timber beams and large open ceilings. The exterior architecture is designed with a large sloped roof that opens up to the lake reflective of prairie -style. Large overhead glass doors open up to the deck and window patterns with upper transoms reinforce the prairie - style. The massing takes its cues from the grain silos across the highway. The barnwood facades feature living walls of vines growing on trellises that promote the organic nature of the business. High quality materials such as stone, timbers, glass and barnwood siding combine for a rustic/industrial vibe. Decorative light fixtures, ornamental trees and extensive landscaping reinforce the streetscape pedestrian edge along Highway 61. Pedestrian connections are provided throughout the development. Along the lake edge is a variety of walking surfaces including wood plank and concrete, and features multiple opportunities for interacting with the lake with benches and a seasonal dock. The trail system is designed to connect to future developments. The restaurant would be surrounded by recreational activities such as outdoor volleyball, horseshoes and corn hole toss in the summer and broomball, snowmobiling and fire pit in the winter. On off-peak hours a farmers market with local vendors could occur in the parking lots that could reinforce the organic and local branding of the restaurant. These activities would be a benefit for both the restaurant and the community. The site plan is master planned for further future development. The plan takes advantage of views and access to the lake as well as maintaining views of the lake from Hwy 61. Several structures are placed along Hwy 61 for an urban character, while other buildings are situated on the lake amenity. The architecture of the future buildings would incorporate the same palette of materials established with the restaurant in various Parking is shared throughout the site and offers easy access for all uses. The main access to the future phases is aligned 1461h Street with future access designed into the plan as the east and west sites become available for development. Inspection and maintenance of the erosion and sediment control BMP's before and during construction. Training must be in conformance with the NPDES Construction Permit requirements. Project Description The 4.237 acre project site is located on the east side of US Highway 61 at 1461h Street North. The site is directly adjacent to Egg Lake. The site has been cleared of all buildings as a precursor for redevelopment. Prior to clearing the site approximately 44% was covered with impervious surfaces. The proposed development includes a 5,000 square feet (sf) restaurant, 3,870 sf event center and three retail buildings totaling 10,100 sf, along with associated parking and other site amenities. This report only addresses the first 2 phases of the development which includes the restaurant, event center and Spgsoximately 60 stalls. The stormwater solution for the first phase will be utilized for the future phases. Topsoil over apparent undocumented fill soils were encountered extending to depths ranging from approximately 2.0 to 9.0 feet below the existing ground surface. The soils encountered beneath the undocumented fill soils generally consisted of poorly graded sand (SP), poorly graded sand with silt (SP- SM), and silty sand (SM) soils. The undocumented fill soils encountered in the soil borings are not considered suitable for direct support of the foundations and slabs. Stormwater Management System Overview See Stormwater Management Plan incorporated herein by reference for details on system design, flow rates and volumes and system capacities. In general to achieve rate and volume control it is proposed to construct the entire parking lot utilizing porous bituminous pavement. The grading plan shows a typical grade of 0.5% on the pavement which will facilitate 100% infiltration of rainfall events up to the 10 year 24 hour storm and surface overflow for the 100 year event. The portion of the building with a flat roof will drain via an internal drain system and discharge onto turfed areas on the north and east sides of the building. See Operations and Maintenance Manual for post construction system maintenance requirements. Erosion Prevention, Measures - General The Contractor (Operator) is responsible for all erosion prevention measures for the project including but are not limited to the following: 1. The Contractor (Operator) shall plan and implement appropriate construction practice and construction phasing to minimize erosion and retain vegetation whenever possible 2. All areas not to be disturbed shall be delineated with flags, stakes, signs, or other means necessary to protect these areas before construction begins on the site. 3. All drainage ditches and/or swales shall have temporary or permanent stabilization within 24 hours of connecting to a surface water or 24 hours after construction activity in the ditch/swale has temporarily or permanently ceased. 4. All pipe outlets shall have temporary or permanent energy dissipation within 24 hours of connecting to a surface water. 5. All exposed soils shall be stabilized as soon as possible to limit soil erosion. In no case shall un- worked areas, including stock piles, have exposed soils for more than 14 days without providing temporary or permanent stabilization. (7 days for projects with a receiving water that is impaired or special) Sediment Control Measures and Timing - General The Operator (Contractor) is responsible for all sediment control measures for the project. Sediment control measures include but are not limited to the following: 1. Sediment control measures shall be established on all down gradient perimeters before any up - gradient land disturbing activities begin. These measures shall remain in place until final stabilization has been established. 2. On slopes with 3:1 or steeper grades there shall be no unbroken slope length greater than 75 feet. 3. All storm drain inlets and culvert inlets shall be protected by an appropriate BMP during construction until all sources with potential for discharging to the inlet has been stabilized. Inlet and culvert protection shall conform to the MnDOT Specifications 2573 and 3891. 4. Stock piles shall be provided with an effective sediment perimeter control and shall not be placed in any type of surface water or drainageway. 5. Vehicle tracking shall be minimized with effective BMP's. Where the BMP's fail to prevent sediment from tracking onto streets the Contractor shall conduct street sweeping to remove all tracked sediment. 6. The Operator is responsible for identifying the need for temporary sediment basins based on actual field conditions to protect downstream resources. Temporary sediment basins shall be constructed before up gradient vegetation is disturbed and maintained until the risk of damage to downstream resources is mitigated by other means. Dewatering and Basin Draining Activities - General The Operator is responsible for adhering to all dewatering and surface drainage regulations, including but not limited to the following: 1. Whenever possible water from dewatering activities shall discharge to a temporary and/or permanent sediment basin. 2. If water cannot be discharged to a sedimentation basin, it shall be treated with other appropriate BMP's, to effectively remove sediment. 3. All discharge points shall be protected from erosion and scour. 4. Discharge water shall be dispersed over an effective energy dissipation measure. 5. All water from dewatering shall be discharged in a manner that does not cause nuisance conditions, erosion, or inundation of wetlands. Water shall not be discharged to adjacent residential properties. It must be discharged to the public street. Final Stabilization -, General The Operator is responsible for ensuring final stabilization of the site, including but is not limited to the following: 1. All soil disturbing activities have been completed. 2. All exposed soils have been uniformly stabilized. 3. All drainage ditches, ponds and all storm water conveyance systems have been cleared of sediment and stabilized to preclude erosion. The contractor will remain responsible for establishment of at least 80% perennial vegetation coverage and the removal of temporary BMP's. Temporary Sediment Basin During construction the contractor shall excavate and maintain temporary sediment basins as needed to prevent sediment from reaching the storm drainage system, permanent filtration areas, wetlands and other environmentally sensitive areas or impeding access to the site by tenants. Construction Sequencing Contractor shall comply with the following sequence. The Contractor may make adjustments to the sequence if needed) to address their means and methods and unanticipated field conditions. Note: this section is subject to revision after construction sequencing is determined. 1. Install inlet protection in downstream structures. 2. Install perimeter silt fence and other barriers at a minimum as indicated on the plan. The contractor is responsible for any additional sediment control that is needed to prevent sediment from leaving the site. 3. Install rock construction entrance. Move as needed during construction. 4. Do not strip topsoil in parking areas. Limit construction traffic within the parking lots to the extent practical. 5. Perform earthwork for building, install utilities. 6. Construct building. 7. Restrict access to the site during parking lots construction. 8. Strip and salvage topsoil from parking lots. Perform excavation and embankment necessary to bring parking lots to subgrade elevation. Remove any non -granular soils encountered. 9. Scarify and recompact subgrade to a depth of 12". 10. Install curbs, sidewalks, aggregate base and pavement. 12. Install permanent landscaping. Do not store any landscape materials on pavement surface. 13. Remove sediment barriers as building construction and permanent landscaping is completed. 14. Vacuum pavement surface when all construction except striping has occurred. 15. Stripe parkiing lot 16. Monitor vegetation and reinstall as needed until fully established. 17. File NPDES Notice of Termination ("NOT") with MPCA within 30 days of final stabilization. Inspection and maintenance All inspections, maintenance, repairs, replacements and removal are to be considered incidental to the BMP bid items. The Contractor (Operator) is responsible for completing required inspections maintenance and observation of weather conditions and rainfall amounts to ensure compliance with the permit requirements. The Contractor (Operator) shall observe the construction site once every seven (7) days during active construction and within 24 hours after a rainfall event greater than 0.5 inches in 24 hours. The Contractor (Operator) shall keep a summary maintenance/construction observation report to be recorded after each site visit/observation. The Contractor (Operator) shall submit a copy of the written inspections monthly to the Owner. Records shall include the following: 1. Date and time of inspections 2. Name of person conducting inspection 3. Findings and recommendations for corrective actions if necessary 4. Corrective actions taken 5. Date and arnount of rainfalls greater than 0.5 inches in 24 hours 6. Mention of any changes made to the SWPPP 7. A site map indicating active construction areas and land disturbing activities. The Contractor (Operator) must keep the SWPPP, all inspection reports and amendments onsite. The Contractor (Operator) shall designate a specific location to keep the records whenever construction activity is in progress. All erosion prevention and sedimentation control BMP's must be inspected to ensure integrity and effectiveness. All nonfunctional BMP's must be repaired, replaced or supplemented with functional BMP's. The Contractor (Operator) must investigate and comply with the following inspection and maintenance requirements: 1. Pollution Prevention Management Measures The Contractor (Operator) shall be responsible for all pollution prevention management measures. The Contractor (Operator) is responsible for informing all visitors and/or personnel on -site of the pollution prevention management measures. All pollution prevention management measures are to be considered incidental to the overall project bid, unless otherwise noted. Pollution prevention management measures include but are not limited to the following: 1. The Contractor (Operator) is responsible for the proper disposal, in compliance with MPCA disposal requirements, of all solid or liquid waste and hazardous materials on -site. 2.
