APPROVING A VARIANCE FOR VICTOR LAND HOLDINGS, LLC FOR
THREE OFFICE/WAREHOUSE BUILDINGS ON THE PROPERTY LOCATED
NORTHEAST OF 130TH STREET NORTH AND FENWAY BOULEVARD
NORTH
WHEREAS, Victor Land Holdings, LLC, has requested approval of a variance to allow a
higher percentage of metal on a the building than required by ordinance, on the property
legally described as;

WHEREAS, the Planning Commission has reviewed said variance at a duly called a
public hearing on December 19, 2020, and recommends approval subject to the findings
listed in this resolution.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
variance for Victor Land Holdings, LLC, to allow a higher percentage of metal on a the
building than required by ordinance with the following findings:
1. The applicant shall revise the architectural plans to incorporate brick, block, or
stone to the base of the building at least 3 feet in height on each side of the
buildings to be reviewed and approved by staff.
2. The proposed variance is permissible by law.
3. According to the ordinance, 20% of the fagade of building are allowed to be
metal. Metal is an allowed material up to a certain percent. The applicant would
like to use a higher percentage of metal. The proposed metal is architectural and
high quality rather than the use of metal that ordinance is generally designed to
prevent (i.e., tin shed/pole barn). The property owner is proposing to use the
property in a reasonable manner.
4. The proposed architectural metal panels are unique in that they are not the type of
metal that is that the ordinance is generally designed to prevent (i.e., tin
shed/pole barn). The proposed material is high quality and has gradually been
used more on commercial and industrial projects. The property is unique as it is
located in an area that has existing metal buildings (pole barns). The applicant is
proposing to use a high quality metal and the buildings are not designed to be
pole barns.
5. Because of the unique location of the site along 13e Street there is an
opportunity to use innovative building materials that might not meet the strict
intent of the ordinance in regards to it being metal. The proposed building
material is high quality and the building design is attractive, which meet the

intent of the ordinance to ensure high quality design and building materials for
commercial and industrial buildings
6. The property is located on the northeast corner of 130t' Street and Fenway
Boulevard. It is adjacent to existing metal buildings and across the street from a
townhome development that that uses vinyl siding for the exterior. Allowing the
use of the high quality architectural metal panels will provide a good transition
between these uses and will not alter the essential character of the neighborhood.
7. The purpose and intent of the guidelines and ordinance are to ensure high quality
design and building materials for commercial and industrial buildings and to
improve the overall quality of development in the City. The ordinance was
created to prevent the construction of tin sheds and pole barns and the use of low
quality metal products.
8. The proposed architectural metal panels are high quality, the building design is
attractive, and the architectural details break-up the building, meeting the spirit
and intent of the ordinance.
9. Office/warehouse buildings are allowed in the I-3 zoning district.
10. The property is not within a floodplain.
11. The property will be served by City sewer and water.
