APPROVING PRELIMINARY PLAT FOR GOLDEN VALLEY LAND
COMPANY FOR "THE MEADOWS AT HUGO" ON PROPERTY LOCATED
NORTH OF 159TH STREET NORTH AND WEST OF HIGHWAY 61
WHEREAS, Golden Valley Land Company, has requested approval of a PUD general
plan to allow 87 single family residential lots and 5 outlots on 40.07 acres on property
legally described as follows:

WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly
called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Golden Valley Land Company, for a preliminary plat, subject to the
following conditions:
1. A preliminary plat is approved to allow the creation of 87 single family home lots
and 6 outlots, in accordance with the application and plans received by the City on
December 4, 2020, January 28, 2021, and February 4, 2021, except as amended by
this resolution.
2. Approval is contingent upon City Council approval of a rezoning to PUD for the
32.93 acres shown on the PUD General Plan.
3. The developer must comply with Resolution 2021-10 for the PUD.
4. The developer `must comply with all conditions outlined in the City Engineer's
memos dated February 5, 2021 and all red -lined comments provided to the applicant.
5. Park Dedication is proposed to be satisfied by fee. The park dedication fee shall be
paid for each lot platted at the amount of $2,400.00.
6. The developer has indicated that covenants will be established for the development
to implement architectural design guidelines. The covenants shall be reviewed and
approved by staff prior to the recording of the final plat for the Phase 1.
7. The developer must comply with the Shoreland Overlay District requirements
through the The Meadows at Hugo's PUD General Plan as approved by the DNR.

9. Outlot Use and Ownership:
A. Outlot F is to remain under current ownership and will continue to be zoned
Future Urban Service. The outlot shall be combined with the parcel to the
east and will be rezoned with fature development. There will be no access to
Outlot F from the west and shall only be allowed from the east.

10. The landscaping planned for the development shall be installed all at the same time
during each phase. The developers shall take proper precautions to protect the trees
as the homes are being built.
11. The developer must comply with the following, prior to Final Plat and Final PUD
Plan application approval:
Landscaping and Lighting
a. All trees shall be located outside of the public right of way.
b. The applicant shall add additional trees to provide screening along the south
property lines of Lots 1-4, Block 1.
c. The exact locations and design of the street lights will be evaluated with each
final plat application. The street lights shall be a decorative, lantern style and

shall comply with the City standards for street lighting within the public
right-of-way.
Streets/Access
a. The developer shall be required to extend Farnham Avenue North through
City -owned property at their expense.
i. The developer shall provide a legal description and right of way
document for the public road constructed on the City -owned
property.
b. The developer is required to provide a curb cut to allow access to the City
water tower, as indicated on the approved plan set.
Covenants
a. The developer shall establish covenants to implement architectural design
guidelines for all residential buildings. The covenants shall be reviewed
approved by City staff.
Wetlands
a. The wetland mitigation plan shall be reviewed and approved by the
Technical Evaluation Panel.
Utilities
a. The developer shall obtain approval of a permit from the Rice Creek
Watershed District to allow a ditch crossing for the utility connection to the
east.
Miscellaneous
a. The developer must obtain all necessary stormwater management and WCA
permits from the City.
b. The developer shall obtain all necessary local, state, and federal permits.
11. Prior to the release of a final plat for recording, the developer must comply with the
following conditions:
a. The City's development fees will apply to this project. The fee amounts will
be calculated and included as part of the Development Agreement. A
development agreement shall be executed and all fees shall be paid.

b. Park Dedication shall be paid for each lot platted in the amount of $2,400.00
per lot.
c. The developer shall obtain the appropriate easement documents for a 50-foot
easement along the north property line as well as a 50-foot easement through
the adjacent property to the east. This easement shall follow the northern
property lines from the adjacent property and extend north to 165th Street
North in order to accommodate for future utility extensions.
d. The developer shall submit a construction plan set that is consistent with the
preliminary plat dated February 4, 2021.
The developer must receive written approval from the Metropolitan Council
for the Comprehensive Plan Amendment.
f. The developer shall have their proposed covenants approved by staff to
include language on architectural design, accessory building requirements,
and water conservation practices.
12. Prior to the issuance of building permits, the developer must comply with the
following conditions.
a. The applicant shall record the final plat, development agreement and all other
documentation at Washington County and provide the City with proof of
recording.
