HomeMy WebLinkAbout2021.06.07 RESO 2021-37 Oneka Lake Reserve Pre Plat, PUDRESOLUTION 2021-37 APPROVING A PRELIMINARY PLAT AND PLANNED UNIT DEVELOPMENT (PUD) FOR ONEKA LAKE RESERVE LLC, FOR "ONEKA LAKE RESERVE" ON PROPERTY LOCATED NORTH OF 150TH STREET NORTH AND ACROSS FROM GENERATION AVENUE NORTH WHEREAS, Oneka Lake Reserve, LLC has requested approval of a preliminary plat and Planned Unit Development (PUD) to allow 40 twnhomes and one outlot on the property legally described as follows: Oneka Lake Townhomes 2nd Addition WHEREAS, the Planning Commission has reviewed the preliminary plat and Planned Unit Development (PUD) at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Oneka Lake Reserve, LLC., for a preliminary plat and planned unit development (PUD), subject to the following conditions: 1. A preliminary plat and planned unit development general plan are approved to allow the creation of 40 townhome units, 1 outlot, and a public park, in accordance with the plans and application received by the City on June 6, 2020 and revised plans dated March 15, 2021, April 3, 2021, and May 6, 2021, except as amended by this resolution. 2. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 3. The preliminary plat approval is contingent upon approval of the requested Planned Unit Development. 4. The developer shall comply with all conditions in the City Engineer's Memo dated May 6, 2021. 5. PUD Flexibility is granted to allow the following: PUD Minimum front setback from 150r' Street 25 feet Minimum front yard setback from private drive 15 feet Minimum side and setback 15 feet Minimum side and setback between buildin s 20 feet Minimum rear setback 25 feet Minimum rear to side setback between buildings W 23 feet Resolution 2021-37 Page 2 6. The phasing plan shall be revised per any amendment required with this resolution. The preliminary phasing plan is generally approved per plans dated April 30, 2021. Any major revisions to the phasing plan shall require PUD amendment. Minor modifications shall be reviewed and approved by staff. a. Phase 1 shall include: i. All improvements shown in phase one. ii. Final grading for the park. iii. A sidewalk from 150t' Street North to the sidewalk in the development at an intersection crossing on the private drive. iv. The stormwater use system shall be installed. v. All the landscaping shall be installed. b. Phase 2 shall include: i. All other improvements. 7. Guest parking shall comply with the Americans with Disabilities Act as may be applicable. 8. No parking will be allowed on the private drives, unless it is the in the designated parallel parking areas for guest parking. 9. The private drives must comply with City standards for private drives. 10. No signage is proposed at this time. Should signage be desired, the applicant must apply for a sign permit with details ensuring compliance with ordinance requirements. 11. Prior to approval of the final plat, the applicant must comply with the following conditions: a. The developer must obtain all necessary Federal, State, and local Permits. b. The developer must obtain all necessary stormwater management and WCA permits from the City. c. The plans shall be revised to show the lot lines in the preliminary plat submitted on April 30, 2021. The park shall be on outlot in the plat. d. The plans shall be revised to include a revised sidewalk location in the public park from 150th Street to an intersection crossing on the private drive. e. The grading for the expansion of the pond to the north shall be further evaluated to reduce the impact on the adjacent properties, including preserving tress in that area. f. The buildings shall comply with the following: Resolution 2021-37 Page 3 i. Colors proposed within the development shall provide more color variety and contrast on individual buildings and within the development. A color palette must be submitted for city review and approval. ii. Garage doors must be painted to match the color of the unit. iii. Garage doors must be prefinished to minimize maintenance. g. Landscape plans shall be revised to include additional trees on the north side of the property. The plan shall be submitted for review and approval by staff. h. All mechanical equipment shall be screened with materials compatible with the building and project landscaping. The plans must submitted for review and approval by City staff. i. A lighting plan must be updated to match the site plan and submitted for review and approval by City staff. The plan shall include cut -sheets of the street lights proposed. j. The building elevations should be dimensioned in order to ensure this requirement is being met. k. The stormwater use plans shall be submitted for review and approval by City staff. A stormwater reuse agreement shall be completed with the Final Plat. 1. A cross walk from the sidewalk on the west side Generation Avenue, north to the public park shall be added. Flashers may be evaluated for the crosswalk. Installation shall be completed by the developer. m. A complete set of revised plans addressing the conditions of approval shall be submitted for city approval. 12. Prior to release of the final plat and resolution for filing at Washington County, the applicant must comply with the following conditions: a. The homeowner's association documents shall be submitted for review and approval by City staff. b. The homeowner's association documents shall include language to ensure that the enclosed garage spaces are maintained for vehicle parking and that parking of snowmobiles, boats, RVs and other recreational vehicles in the driveway is discouraged. The covenants should be drafted to prohibit the storage of anything in the garage or driveway that would prevent the storage and parking of vehicles. c. The developer/HOA shall be responsible for the maintenance of the sidewalks and shared driveways. Resolution 2021-37 Page 4 d. Cross access agreements shall be provided for the shared driveways. These easements shall be provided for City review and approval and filed with the final plat. e. A development agreement will need to be signed and executed in a form satisfactory to the City. f The City's development fees will apply to this project. The fee amounts will be calculated and included as part of the Development Agreement. 13. Prior to issuance of building permits, the applicant must comply with the following conditions: a. All development fees shall be paid. b. Final plat and development agreement shall be recorded at Washington County. c. The development shall meet all of the conditions in the development agreement regarding issuance of building permits. ADOPTED by the City Council this 6t' day of June, 20" .
