APPROVING A CONDITIONAL USE PERMIT TO ALLOW A SHARED
DRIVEWAY FOR THE PROPERTIES GENERALLY LOCATED SOUTH OF
140TH STREET NORTH AND WEST OF KEYSTONE AVENUE NORTH
WHEREAS David Lutz and James and Sharon Lutz have requested approval of a
conditional use permit to allow a shared driveway for the properties generally located
south of 140t' Street North and West of Keystone Avenue North.
WHEREAS, the subject properties are legally described as Section 25, Township 031,
Range 021, GOV LOT 3 253121, HUGO
WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly
called public hearing on September 23, 2021, and recommends approval subject to the
conditions listed in the conditional use permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
conditional use permit for a shared driveway on properties generally located south of
140'b Street North and West of Keystone Avenue North, subject to the following
conditions;
1. The Easement and Maintenance Agreement for the shared driveway shall be
recorded at Washington County.
2. The applicant shall apply for a driveway permit at the time of building permit.
ADOPTED by the City Council this 4ffi day of October 2021.
