Minutes for the Planning Commission Meeting of Thursday, September 9, 2021 Acting Chair Arcand called the meeting to order at 7:00 pm. PRESENT: Arcand, Derr, Fry, Kleissler, Lessard, Luchsinger, Mulvihill, Petty ABSENT: Kleissler, Lessard, Luchsinger STAFF: Rachel Juba, Community Development Director Emily Weber, Community Development Assistant Pledge of Allegiance. Approval of Minutes for the Planning Commission Meeting of July 9, 2021 Commissioner Derr made a motion, seconded by Commissioner Luchsinger to approve minutes for the meeting of July 9, 2021 with corrections as mentioned. Ayes: All Nay: None. Motion carried. Public Hearing: Short Term Rental Facilities — Prohibited Ordinance Staff provided a background on the proposed ordinance update. Staff has received complaints on a short term rental facility that has been listed on the website Vacation Rentals by Owner (VRBO). The Washington County Sheriff's Department has also received numerous complaints on the property related to noise, parties, and the transient nature of short term rentals. Staff defined short term rentals and presented research completed on regulations adopted by other cities in the area. Staff stated that the Ordinance Review Committee had a discussion on short term rental facilities and that the City Council directed staff to draft an ordinance prohibiting short term rental facilities. Staff recommended that the Planning Comission hold a public hearing and take all comments. Staff recommended approval of the ordinance for short term rentals. The Commissioners discussed the language used in the ordinance and clarified that the ordinance does not apply to rental of community rooms or bed and breakfast facilities. Acting Chair Arcand opened the public hearing at 7:11pm. No one came forward to speak. Acting Chair Arcand closed the public hearing at 7:12pm. Public Hearine: Revisions to Adeauate Public Facilities Ordinance Staff provided a background on the existing adequate public facility ordinance and defined adequate public facilities. Staff recommended the Planning Commission hold the public hearing and take all comments. Staff recommended approval of the revisions to the adequate public facilities ordinance. Acting Chair Arcand opened the public hearing at 7:16pm. No one came forward. Acting Chair Arcand closed the public hearing at 7:16pm. Motion by Commissioner Petty, seconded by Commissioner Mulvihill, to approve the revisions to the adequate public facilities ordinance. Motion carried. Conditional use Kermit request for a shared driveway on properties generally located south of 140t Street North and West of Keystone Avenue North. DATE: September 16, 2021, for the Planning Commission Meeting of September 23, 2021 LAND USE: Agricultural (AG) ZONING: Agricultural (AG) REVIEW DEADLINE: October 16, 2021 1. DESCRIPTION OF REQUEST: The applicant is requesting approval of a conditional use permit (CUP) for a shared driveway between two parcels. Parcel A is currently landlocked and get accesses though Parcel B to the south to Keystone Avenue North. The driveway has been in place for several years and the applicant is requesting formal approval with the CUP. Both property owners have signed the application and an easement and maintenance agreement. 2. CONTEXT: A. Surrounding Land Use and Zoning The properties are zoned Agricultural (AG) and are guided as Agricultural in the 2040 Land Use Plan. Both properties are over 20 acres and are currently vacant. The surrounding properties are also zoned AG and are large lots that are either vacant or occupied by single family homes. B. Natural Characteristics of Site The properties are along the east side of South School Section Lake. They include vegetation and wetlands along the western portion of the sites. LEVEL OF DISCRETION IN DECISION -MAKING: The City's discretion in approving or denying a conditional use permit is limited to whether or not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets these standards, the City must approve the conditional use permit. 4. ANALYSIS: A. Consistency with Ordinance Standards Staff used these standards to review the application and found that the request meets all applicable standards as follows: 1. The proposed use is permissible by law. The proposed use is allowed by conditional use permit. 2. The proposed use is keeping with the spirit and intent of the ordinance. The proposed use is allowed in the AG zoning district and will keep with the spirit and intent of the ordinance, which is intended to allow a shared driveway by a CUP as long as they comply with the regulations. 3. The proposed use is compatible with the City s Comprehensive Plan and the character of the surrounding area. The use is existing and is compatible with the Comprehensive Plan and the shared driveway will not alter the character of the area. There are shared driveways in the area that provide access to land locked parcels. 4. The proposed use has adequate drainage, water supply, electrical, gas, and sewage treatment facilities. The proposed use has adequate drainage, water supply, and utilities. A driveway permit will be required. 5. The proposed use has adequate road access. The property will have adequate road access to Keystone Avenue North. 6. Technical Evaluation of Floodplain. The applicant is not proposing to impact any floodplain. 7. The proposed use should not increase the potential for flood damage. Lutz Shared Driveway CUP The proposed use would not obstruct the floodplain or increase the potential for flooding. 8. The proposed use will not damage or reduce the benefits the public receives from public waters. The proposed use would not damage or reduce the benefits from any public waters. 9. The use of watercraft on public waters. The proposed use would not involve the use of watercraft on public waters. 10. All structures shall be screened from view of public waters. The proposed use is not a structure visible from public waters. 11. Wetland impacts. The driveway is existing and does not impact any wetlands. 12. All state and local permits shall be acquired for the conditional use. The applicant would be responsible for obtaining all state and local permits. 13. Adequate screening and buffering from non -compatible uses and public rights -of -way. The proposed use is not visible from non -compatible uses. There is no need to screen the driveway from the public right-of-way. 5. STAFF RECOMMENDATION: It's in staff s opinion that the request meets all the items required for conditional use permit Staff recommends approval of the shared driveway CUP subject to the conditions listed in the attached draft resolution to the Planning Commission. DESCRIPTION OF REQUEST: The applicant is requesting approval of an interim use permit (IUP) for a farmhand living quarter to be allowed on the property. On properties 20 acres or more in size, located in the future urban service, rural residential, agricultural, and long term agricultural districts a second dwelling shall be allowed for living quarters for a farmhand. The property is approximately 38 acres in size and is being used for a dairy farm operation. The dairy farm is operated by the applicants with their son's and their families. The applicants would like to build farmhand living quarters as a second dwelling on the property to open up the existing farm house to their son and his family. 2. CONTEXT: A. Surrounding Land Use and Zoning The property zoned Agricultural (AG) and is guided as Agricultural in the 2040 Land Use Plan. The property is approximately 38 acres and is a dairy farm operation. LEVEL OF DISCRETION IN DECISION -MAKING: The City's discretion in approving or denying an interim use permit is limited to whether or not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets these standards, the City must approve the interim use permit. 4. ANALYSIS: A. Consistency with Ordinance Standards Staff used these standards to review the application and found that the request meets all applicable standards as follows. On properties 20 acres or more in size, located in the future urban service, rural residential, agricultural, and long term agricultural districts a second dwelling shall be allowed for living quarters for a farmhand. The second dwelling shall only be allowed with approval of an interim use permit upon finding that the following conditions have been met: 1. The primary use of the property shall be a bona fide agricultural operation of sufficient size to necessitate the assistance of a farmhand. The property is currently operated as an agricultural dairy farm. This is a large operation with existing assistance from employees and family members. 2. The living quarters shall be for employees hired to conduct work on the farm or members of the family. The living quarters will be occupied by members of the family that assist on the farm. 3. The living quarters shall not be used or rented out for any purpose other than agriculture. This is listed as a condition in the interim use permit. 4. The living quarters shall meet all zoning and building code requirements. This is listed as a condition in the interim use permit. S. There shall be no variances involved in the request. No variances are requested with this application. 6. Within 12 months of the date that agricultural operations on the property cease, the second dwelling shall be removed or the property shall be subdivided and meet all code requirements. DATE: September 16, 2021 for the Planning Commission Meeting of September 23, 2021. ZONING: Central Business District (C-1) 60-DAY REVIEW DEADLINE: October 22, 2021 1. DESCRIPTION OF REQUEST AND BACKGROUND: Lakeview Family Dentistry is requesting site plan approval for an approximately 4,400 square foot addition to be constructed on to the existing building on site. The existing building is 1,957 square feet and operates as a dental clinic. The site is adjacent to Egg Lake and falls within the Shoreland Overlay District. The applicant is also requesting two variances from the Shoreland Overlay District requirements. A variance is requested from the maximum imperious surface coverage to allow an impervious surface coverage of 50.6%, where a maximum of 25% is required. An additional variance is requested to allow the proposed addition to be setback 61.4 feet from the OHW level of Egg Lake, where 100 feet is required by City ordinance. The site plan for the existing building was approved on April 6, 1992 and was originally built as a dental clinic. The owner has since changed but the use remains the same. The applicant is proposing to continue the same use on site. 2. CONTEXT: A. Surrounding Land Use and Zoning The property and all surrounding sites are zoned Central Business District and are guided as Mixed Use in the 2040 Land Use Plan. Existing Conditions The property is 0.85 acres and is adjacent to Egg Lake with wetlands located on the eastern portion of the site. There is an existing dental clinic on site that has access to Highway 61. 3. ANALYSIS: A. Level of City Discretion in Decision -Making The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. The City's discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that they meet the standards in the ordinance. B. Variance from Maximum Impervious Surface Coverage The Shoreland Overlay District requires that no more than 25% of a lot within the district may be covered by impervious surface. The existing lot has an impervious surface coverage of 30.6% and the proposed site plan has an impervious surface coverage of 50.6%. The applicant is requesting a variance to allow an impervious surface coverage of 50.6%, where 25% is required by ordinance. Staff used the standards outlined in Section 90-38 of the City Code and found the following: (1) Law. The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term "Practical Difficulties" as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and; The applicant is proposing to use the property in a reasonable manner that is consistent with the use of the existing building. It is reasonable to add on to an existing business. The property is subject to a maximum impervious surface coverage of 25% because it is within the Shoreland Overlay District. However, standard C-1 zoning allows up to 90% of the lot to be covered by impervious surface. It is reasonable for a commercial property to need additional impervious surface to meet the minimum parking requirements. Lakeview Family Dentistry — Site plan and variance requests Page 3 b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and, The property is unique in that it is legal nonconforming and the existing impervious surface of the lot exceeds the maximum impervious surface requirement per ordinance, and therefore any modification to the existing building requires a variance. Additionally, the property is uniquely shape, limiting the design and layout of the site. c. Character ofNei,-hborhood. The variance, ifgranted, will not alter the essential character of the neighborhood. Other neighboring properties are also legal nonconforming to the zoning district requirements and have similar uses and impervious surface coverage. The property is also located within the Downtown District and the applicant is proposing to match the existing architectural details of the building, meeting the Downtown Design Guidelines. The proposed site plan will not alter the essential character of the neighborhood and will continue to conform to the Downtown Design Guidelines. It is in staff s opinion that there are practical difficulties in meeting the impervious surface coverage requirement outlined in the Shoreland Overlay District. The applicant's request to add on to an existing building is reasonable and the expansion is intended to meet the needs of the growing business. The property is unique in that the existing building does not conform to the Shoreland Overlay District standards, although it conforms to the C-1 zoning district standards. The proposed addition and site plan will be of matching materials to the existing building and therefore will not alter the character of the neighborhood. (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City's Comprehensive Plan. The spirit and intent of the ordinance is to allow central business district properties to have a sufficient amount of parking and buildable area on site to accommodate business operations. The C-1 zoning district allows up to 90% of a lot to be covered by impervious surface coverage to ensure adequate parking for various users. The proposed impervious surface percent is still well below what is allowed in the C-1 zoning district, meeting the spirit and intent of the ordinance. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. The use of the site is permitted in the C-1 zoning district. (S) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. The property is not located within a FEMA designated floodplain. However, the building addition will be required to meet building code regulations regarding low floor separation from Lakeview Family Dentistry — Site plan and variance requests Page 4 the groundwater elevation. (6) Septic and Well Compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The property is served by City sewer and water. It is in staff s opinion that the application meets the criteria outlined in the City Code to approve a variance. C. Variance from the Ordinary High Water (OHW) Level Building Setback Requirement The Shoreland Overlay District requires a 100 foot building setback requirement from the OHW level of Egg Lake. The applicant is proposing a building setback of 61.4 feet from the OHW level of Egg Lake, therefore requiring a variance. Staff used the standards outlined in Section 90-38 of the City Code and found the following: (1) Law. The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The proposed site plan meets all other setback requirements. b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and; The property is unique in that the shape, size, and location of the existing building limit the location of the proposed addition. The location of the addition is also limited due to the parking requirements that are necessary to meet the expanded business use. The proposed building location is located in the most feasible area due to existing circumstances. Lakeview Family Dentistry — Site plan and variance requests Page 5 c. Character ofNeiahborhood. The variance, ifgranted, will not alter the essential character of the neighborhood. The variance request does not alter the essential character of the neighborhood as the proposed addition is consistent with the Downtown Design Guidelines. Additionally, there are other properties that fall within the Egg Lake Shoreland Overlay District with similar building proximities to the OHW level. It is in staff s opinion that there are practical difficulties in meeting the building setback requirement from the OHW level of Egg Lake. It is reasonable for the applicant to expand their existing business and the proposed building addition will not alter the character of the neighborhood. The property has unique circumstances that make meeting the ordinance requirements difficult and the location of the existing building limits the location of the proposed addition. (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City's Comprehensive Plan. The spirit and intent of the ordinance is to ensure that buildings are located a reasonable distance away from the OHW level of water bodies and to limit the impact on natural resources. The City Ordinance requires that the building setback from the OHW level is 100 feet. The MN State Statute Chapter 6120 requires the OHW level building setback of 75 feet on sewered lots along recreational development lakes, which is less restrictive than City standards. It is in staffs opinion that 61.4 feet is a reasonable setback from the OHW level of Egg Lake and the proposed building additional will not impede on the natural elements of the site. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. The use of the site is permitted in the C-I zoning district. (5) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. The property is not located within a FEMA designated floodplain. However, the building addition will be required to meet building code regulations regarding low floor separation from the groundwater elevation. (6) Septic and Well Compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The property is served by City sewer and water. It is in staff s opinion that the application meets the criteria outlined in the City Code to approve a variance. Lakeview Family Dentistry — Site plan and variance requests Page 6 D. Site Plan The application complies with the ordinance standards as follows: Building Setbacks The proposed site plan meets the building setbacks from the front, side, and rear lot lines for the C-1 zoning district requirements. The applicant is requesting a variance from the ordinary high water level building setback in the Shoreland Overlay District requirements. Building Height The C-1 zoning district has a maximum building height of 35 feet. The site plan meets this requirement. Building Coverage and Lot Coverage The C-1 zoning district has a maximum impervious surface coverage of 90%, however, the Shoreland Overlay District has a maximum impervious surface coverage of 25%. The proposed site plan has an impervious surface coverage of 50.6%, requiring a variance. The applicant is requesting a variance from the impervious surface lot coverage requirements. Landscaping Section 90-181 of the Zoning Ordinance provides landscaping requirements for commercial development. The site plan includes tree and shrub locations and species. The ordinance provides two ways of calculating the required amount of trees and shrubs. One based on the square footage of the building and one based on the perimeter of the site, whichever is greater. In this case staff used the perimeter of the site. In order to meet the landscape requirements, 10 deciduous trees, 5 coniferous trees, 5 ornamental trees, and 32 shrubs are required to be installed. The applicant is using existing and new landscaping to meet the landscaping requirements. The site plan exceeds the City's landscaping requirements. Lighting The ordinance requires lighting to consist of cut-off fixtures and for light cast on adjacent property and roads not to exceed 1/2 foot candle measured at the property line or 1 foot candle measured at the street's centerline. The ordinance also required the light fixtures, whether pole mounted or wall mounted to be cut-off fixtures. The applicant is proposing downcast pole fixtures and meets the lighting requirements. Streets and Access The site is located along the east side of Highway 61 and has existing access. The applicant is not proposing to expand the access but is proposing to expand the parking lot. If needed, the applicant shall have a driveway permit issued by MNDOT. Lakeview Family Dentistry — Site plan and variance requests Page 7 Parking Section 90-253, Parking and Loading of the City Code determines the number of parking spaces required per site. Parking is determined by gross floor area. There are 32 stalls required for the site and the applicant is proposing 32 stalls, meeting the parking requirements. Building Architecture The City of Hugo adopted Downtown Design Guidelines in 2007, which aims to create a sense of arrival in the downtown area of Hugo. The Downtown Design Guidelines emphasize prairie style architecture with hipped roofs, which is a proposed element of the site plan. The applicant is proposing to construct the addition with similar materials and color to the existing building. The existing building is constructed of wood siding and the applicant is proposing to match the existing siding with a fiber cement material. Staff is comfortable with the proposed architectural materials. The applicant is required to submit a material sample board, which will be evaluated and approved administratively. Trash Enclosure The applicant is proposing a trash enclosure in front of the proposed building addition. The trash enclosure is proposed to be of the same materials as the addition and surrounded by landscaping. Staff has asked the applicant to consider alternative locations for the trash enclosure, however, acknowledges that there are site limitations. Staff will continue to work with the applicant on final location of the trash enclosure. Signage The applicant is not proposing to change the existing monument sign on site. The applicant is proposing an entrance sign to be located near the main entrance of the site. The entrance sign is proposed to be surrounded by landscaping. Staff is comfortable with the proposed signage. Grading The applicant is proposing to use the property to the north in order to complete construction of the proposed addition. This requires grading to be done on the adjacent property. The applicant is proposing a temporary construction agreement for work on the adjacent property. Staff is requiring the applicant to provide the executed agreement between both property owners and has listed that as a condition of approval. The applicant is required to address all redlined comments that have been provided to them by the City Engineer, which is listed as a condition of approval. Lakeview Family Dentistry — Site plan and variance requests Page 8 Utilities The existing building is served by City sewer and water. These connections will be expanded to the proposed addition. Water service to the new expansion will be done internally and the sanitary sewer will have a new connection to the sanitary sewer main that runs north and south along the east side of the site. The applicant is required to address all redlined comments that have been provided to them by the City Engineer, which is listed as a condition of approval. Wetlands and Stormwater Management The applicant is not proposing any wetland impacts. The applicant is proposing to meet stormwater quality and rate control requirements through the use of infiltration basins on site. The basins are sized appropriately to meet the City's water quality and the Rice Creek Watershed District's rate control requirements. A stormwater maintenance agreement and drainage and utility easements are required for the stormwater basins on site. Park Dedication Park Dedication is not required for commercial and industrial developments. 4. CONCLUSION: It is in staff s opinion that the site plan request for Lakeview Family Dentistry meets all requirements necessary to approve the proposed addition to the existing building located at 14475 Forest Boulevard North. Staff finds that the applicant meets the requirements necessary to approve a variance request to allow an impervious surface coverage of 50.6%, where 25% is required. Staff also finds that the applicant meets the requirements necessary to approve a variance request to allow the proposed addition to be setback 61.4 feet from the OHW level of Egg Lake, where 100 feet is required by City ordinance. 5. RECOMMENDATION: Staff recommends that the Planning Commission approve the site plan and variance requests for Lakeview Family Dentistry for property located at 14475 Forest Boulevard North, subject to the conditions listed in the resolutions. Based on the shoreland district rules, no more than 25% of a lot or parcel in the shoreland district may be covered by an impervious surface. The existing impervious surface coverage of the lot is 30.6%. A variance is requested from the maximum impervious surface coverage for the proposed building addition. Lakeview Family Dentistry Variance Required Findings, Page 2 of 2 Lakeview Family Dentistry 14475 Forest Blvd IN, Hugo, MN Land Use Application — Variance Request Findings September 3, 2021 VARIANCE FROM EGG LAKE ORDINARY HIGH WATER (OHW) SETBACK The existing Lakeview Family Dentistry facility is located adjacent to Egg Lake and therefore is located in the shoreland district. Egg Lake has a shoreland classification of Recreational Development (RD) with a required setback of 100-ft from the OHW elevation. Per Minnesota Department of Natural Resources, the OHW for Egg Lake is 926.66 on NAVD88 datum (926.50 on NVGD29 datum). A variance is requested from the 100-ft setback from the OHW elevation for the proposed building addition. The requested variance proposes a 61.4-ft setback from the OHW at the northeast corner of the addition and a 73.2-ft setback from the OHW at the southeast corner of the addition. The requested variance meets the required findings as follows: (1) Law. The variance as requested is permissible by law. The requested variance is permissible by law. (2) Practical difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The property owners have also spent extensive time pursuing alternative options, including different properties, to avoid a variance request. Due to parking requirements and the limitations of a narrow, angular lot, the best feasible expansion option to meet the needs of increased business demand is to expand to the north and east/west which subsequently encroaches into the 100-ft setback. The proposed building footprint prioritizes expanding to the west to the greatest extent possible and expands eastward only as required to meet minimum program requirement. The design proposal is one in which considerations have been made to best use the land with the least amount of encroachment, where a similar size addition completely to the east would have been preferred but is not practical given the constraints noted above. Once built, there will be no viable future opportunity to expand construction to the east. C. Character of neighborhood. The variance, if granted, will not alter the essential character of the neighborhood. Hugo continues to experience residential growth, increasing demand for services in the community. Further development of this property is intended to support and participate in this positive community growth while respecting its context. The building exterior follows the design language of the existing structure, maintaining a prairie style aesthetic in line with local traditions and the City of Hugo Downtown Design Guidelines. This project will support the City of Hugo's development plan of the downtown district and plans for development north of the property on Egg Lake. Furthermore, the proposed expansion on this property supports the City's development plan by ensuring residents are provided services locally in their community. (3) Spirit and intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the city's comprehensive plan.
