F.1 Update on Yellow Ribbon Network-Chair Chuck Haas Hugo Yellow Ribbon Network Chair Chuck Haas will provide an update on recent activities of the YRN. F.2 Hugo Business Association Easter Egg Hunt Special Event Permit – President Julie Larson The Hugo Area Business Association is requesting a Special Event Permit to hold an Easter Egg Hunt at Hanifl Fields on Saturday, April 9, 2022. A Special Event Permit approved by Council is required because there will be over 600 in attendance and amplified sound. HBA President Julie Larson will be in attendance to explain the event to Council and request Council co-sponsor the event by waiving the $75 SEP fee. G.1 Approve Claims Roster Staff recommends Council approve the Claims Roster as presented. G.2 Approve Matt Derr as Vice-Chair of the Planning Commission Former Planning Commission Vice-Chair Scott Arcand retired at the end of his term on December 31, 2021, after serving over 12 years on the Commission. Matt Derr had submitted a letter of interest to be the next Vice-Chair. At its March 10, 2022, meeting, the Planning Commission nominated Matt to fill the position. Staff recommends Council approve the appointment of Matt Derr as the new Vice-Chair of the Planning Commission. G.3 Approve Agreement with Lakes Center for Youth and Families Over the past several years, the City has entered into an agreement with the Lakes Center for Youth and Families to support programs for Hugo families relating to counseling, intervention, and enrichment. Through this agreement, the City sponsors LCYF by providing financial support. In the 2022 budget, Council approved $15,000 in funding for their services. Staff recommends Council approve the agreement with Lakes Center for Youth and Families. G.4 Approve Agreement with Northeast Youth and Family Services Over the past several years, the City has entered into an agreement with the Northeast Youth and Family Services to support programs for Hugo families relating to counseling, intervention, and enrichment. Through this agreement, the City sponsors NYFS by providing financial support. In the 2022 budget, Council approved $15,000 in funding for their services. Staff recommends Council approve the agreement with Northeast Youth and Family Services. G.5 Approve Resolution Approving Wards, Precincts, and Polling Locations Every ten years upon completion of the United States census, cities are required to use the census data to confirm or reestablish ward boundaries to ensure equal representation. At the Council redistricting workshop on March 14, 2022, Council reviewed the data which showed all three wards increased nearly the same in population. Staff recommended Council keep the same ward boundaries and reestablish precinct boundaries and polling locations to make voting more manageable. Staff recommends Council approve the resolution confirming the City’s existing ward boundaries and reestablishing new precinct boundaries and polling places. G.6 Approve Ordinance Rezoning 15500 Keystone Avenue North – Haas Charles and Marykay Haas have submitted a zoning amendment request to rezone from the Agricultural Zoning District to the Long Term Agricultural Zoning District for the property located at 15500 Keystone Avenue North. At its March 10, 2022 regularly scheduled meeting, the Hugo Planning Commission considered the zoning amendment request and held a public hearing. No one came forward to speak. Staff provided background and recommended approval of the request. The Planning Commission agreed that the request met the criteria necessary to approve the application and recommended approval of the zoning amendment to the City Council. G.7 Approve Application for Met Council Water Efficiency Grant Application The Metropolitan Council will implement a water efficiency grant program effective July 1, 2022 to June 30, 2024. Grants will be awarded on a competitive basis to municipalities that manage municipal water systems. The Council will provide 80% of the program cost while the municipality would be responsible for the remaining 20%. Staff is proposing to apply for $50,000, which would require the City to contribute $12,500. Should funds be awarded, staff is proposing to use the grant money to implement a rebate program that would update the irrigation systems in up to eight City parks and the Hugo Fire Hall. The proposed irrigation system updates are expected to reduce water usage by 62% due to the increased efficiency of the devices. Staff recommends the City Council approve staff’s request to submit an application to the Metropolitan Council Water Efficiency Grant Program with the understanding that the City of Hugo is responsible for a local match of $12,500. G.8 Approve Extension of Purchase Agreement for City Owned Property Denny Trooien, of Dennis Properties has the purchase agreement on the City owned property in downtown. Mr. Trooien provided an update to the EDA on the proposed project at their meeting on March 15, 2022. Mr. Trooien also requested the EDA consider a purchase agreement amendment to extend the closing dates and construction completion dates. The existing closing date for the first phase is May 20, 2022. He is requesting the first phase closing date be September 20, 2022, with the availability to extend with written notice to January 31, 2023. He is also requesting a one-year extension on the closing date for the second phase. He is requesting the completion of the first phase construction to be extended from December 31, 2022, to December 31, 2023. Mr. Trooien stated that he has been working on marketing and has submitted development applications to the City for approval of the project, but it has taken longer than expected working through environmental regulations. The EDA discussed next steps with Mr. Trooien. He stated he would like to continue to work with staff on refining the plans and get scheduled for a Planning Commission meeting date. Staff recommended approval of the purchase agreement amendment. The EDA unanimously recommended approval of the purchase agreement to the City Council. G.9 Approve Ross Hoernemann as Safety Captain on the Hugo Fire Department Ross Hoernemann currently serves as the Training Captain and the Administrative Captain on the Fire Department. Fire Chief Jim Compton is requesting to appoint Ross as the Safety Captain while he continues to hold a second position as the Administrative Captain. Staff recommends Council approve the appointment of Ross Hoernemann as the Safety Captain effective April 1, 2022. G.10 Approve Jason Palmquist as Training Captain on the Hugo Fire Department With the appointment of Ross Hoernemann from Training Captain to Safety Captain, there is a vacancy in the Training Captain position. Fire Chief Jim Compton is requesting Council appoint Jason Palmquist to fill this vacancy. Staff recommend Council approve the appointment of Jason Palmquist as Training Captain effective April 1, 2022. G.11 Approve Resolution Approving Encroachment Agreement for 6593 145th Circle North Brad and Mary Dinndorf have requested an encroachment agreement to allow construction of a fence within a drainage and utility easement on property located at 6593 145th Circle North. Staff has reviewed the request and recommends that the City Council approve the encroachment agreement for Brad and Mary Dinndorf at 6593 145th Circle North. G.12 Approve Resolution Approving Encroachment Agreement for 12560 Foxhill Avenue North Terrance Reetz has requested an encroachment agreement to allow construction of a fence within a drainage and utility easement on property located at 6593 145th Circle North. Staff has reviewed the request and recommends that the City Council approve the encroachment agreement for Terrance Reetz at 12560 Foxhill Avenue North. H.1 Public Hearing on Oneka Parkway Improvement Project On September 7, 2021, City Council authorized the preparation of a feasibility study for the 2022 Oneka Parkway Improvement Project. Staff held a neighborhood meeting on February 16, 2022, and the City Council accepted the competed study at the February 22, 2022, City Council meeting and called for a Public Hearing to be held on March 21st, 2022. The 2022 Oneka Parkway Improvements Project consists of bituminous mill and overlay from Frenchman Road (CSAH 8) to Farnham Avenue, partial street reconstruction from Farnham Avenue to Heritage Parkway, construction of a right-turn-lane northbound on Oneka Parkway at CSAH 8, and construction of a traffic signal at the intersection of Oneka Parkway and CSAH 8. Funding for the project will be provided through assessments to benefiting properties, County funds, and City MSA/Street Funds. Staff will detail the proposed improvements and findings of the feasibility study with a PowerPoint presentation for the public hearing. Staff recommends approval of the resolution ordering the project and authorizing the preparation of plans and specifications for the 2022 Oneka Parkway Improvement Project. J.1 Discussion and Approval of Letter of Support for Hardwood Creek Trail Extension   Washington County studied the feasibility of constructing the final extension of the Hardwood Creek Regional Trail from Fenway Blvd N and 130th St N to 120th St N (Ramsey County Rd J). Two concepts were identified and the study included cost estimates and public engagement. Washington County is applying for Metropolitan Council Regional Solicitation funding to help construct the missing portions of the Hardwood Creek Regional Trail in Hugo. A letter of support has been drafted indicating that the City of Hugo is supportive of construction and complete of the Hardwood Creek Regional Trail. Furthermore, if Washington County receives Regional Solicitation funding, the City of Hugo is committed to snow removal for the proposed segments of trail as required. Staff recommends approval of the draft letter of support for the grant application. N. Minutes for the February 22, 2022, Executive Session Petryk made motion, Klein seconded, to approve the minutes for the City Council Executive Session held on February 21, 2022, as presented. Hugo Building Annual Report Community Development Assistant Emily Weber presented to Council the 2021 Annual Building Report. In 2021, there was a total of 45 planning applications submitted, 189 single family home permits issued, and 60 multi-family home permits issued. The median price for new construction was just under $500,000. The Building Department conducted 6,310 inspections in 2021 in Hugo and Scandia. They also are inspectors for Lake Elmo and Lino, but there were no inspections last year. As of February, 2022, there were 197 single family lots available and no multi-family lots. Emily reviewed projects approved and ongoing from last year, which included six residential developments and six non-residential construction projects. Washington County Update - Washington County Commissioner Fran Miron Washington County Commissioner Fran Miron provided Council an update on activities in Washington County. He thanked the City for their partnership in the environmental center site in Hugo, and he talked about the new site planned for opening in 2023 saying they were in the Minutes HUGO CITY COUNCIL MEETING HUGO CITY HALL MONDAY, MARCH 7, 2022 – 7 P.M. Hugo City Council Meeting Minutes for March 7, 2022 Page 2 of 6 process of negotiating an agreement with Forest Lake for a site on the east side of 61 that should serve the residents of Hugo very well. The Woodbury Site was very popular, and they are adding space to expand services. Fran talked about the drop off for food scraps, which is 20% of the trash, and he talked about ways the County was working to meet state goals on recycling. Fran provided information on the Hardwood Creek Regional Trail Feasibility Study to complete the trail to the county line. This would be in collaboration with the Metropolitan Council, and there was hope for regional funding for the connection. He talked about the substantial increase in home values saying residents could expect a significant increase. Fran spoke about the T.H. 61 Corridor Study and jurisdictional transfers saying turn backs come with money associated with them, which become part of the negotiations with the state. Requests for Proposals (RFPs) were going out that week, and the City would be included in the selection process. Klein asked about the technology corridor. Fran responded that it had not been as successful as hoped. Part of the vision was a regional economic development opportunity that would have had an impact on all communities. Petryk thanked him for the yard waste site in Hugo and helping her provide information to the Transportation Advisory Board. Fran said the long-term site to the north would provide the same convenience to Hugo residents as those using the environmental center (in Woodbury). It could impact the Citywide cleanup events, and a decision needed to be made on whether they would continue those events. He talked about the TAB and their role in distributing grants for transportation projects. Weidt thanked Commissioner Miron for the update. Adoption of the Consent Agenda approved the annual performance review for Building Department Receptionist Debi Close. Approve Performance Review for Senior Engineering Technician Liz Finnegan Liz Finnegan was hired in March, 2019, as the new Senior Engineering Technician after the retirement of Steve Duff in January, 2018. Adoption of the Consent Agenda approved the performance review for Senior Engineering Technician Liz Finnegan. Approve Public Works Mechanic Job Description Staff had updated the job description for the Public Works Mechanic position to reflect the current needs of the Public Works Department. Adoption of the Consent Agenda approved the updated Public Works Mechanic Job Description. Approve Advertisement for Public Works Mechanic Position The Public Works Department had a mechanic position vacancy. Adoption of the Consent Agenda approved the advertisement for a Public Works Mechanic to fill that position. Approve Public Works Worker Job Description Staff had updated the job description for the Public Works Worker position to reflect the current needs of the Public Works Department. Adoption of the Consent Agenda approved the updated Public Works Worker Job Description. Approve Advertisement for Public Works Worker Position The Public Works Department had a maintenance worker position vacancy. Adoption of the Consent Agenda approved the advertisement for a Public Works Worker to fill that position. Approve Resolution Approving Property Line Adjustment for 6900 137th Street North and 7032 137th Street North – City of Hugo The City of Hugo had requested approval of a property line adjustment for two City properties located at 6900 137th Street North and 7032 137th Street North. The properties included the existing Hugo Public Works building, Rice Lake Park, and Hanifl Fields Athletic Park. The proposed property line adjustment would result in the existing public works facility being on a separate parcel from all fields and park facilities. Staff found that the property line adjustment complied with all applicable regulations in the City Code. Adoption of the Consent Agenda approved RESOLUTION 2022-10 APPROVING A Hugo City Council Meeting Minutes for March 7, 2022 Page 4 of 6 PROPERTY LINE ADJUSTMENT FOR CITY OF HUGO FOR PROPERTIES LOCATED AT 6900 137TH STREET NORTH 7032 137TH STREET NORTH. Approve Purchase Agreement with ISD624 for Public Works Facility-6900 137th Street The City of Hugo was vacating the existing Public Works facility located at 6900 137th Street North and had been working with the White Bear Lake Area School District on a purchase agreement to convey the existing PW facility and the 10-acre lot to the WBL School District. The purchase price for the property was $1,000,000.00 and included the condition that the City had the right to repurchase the property in the future should there be a need. The purchase agreement included corresponding easements and would allow continuing public access to the Rice Lake Centre. Adoption of the Consent Agenda approved the purchase agreement to convey the existing Hugo Public Works facility located at 6900 137th Street North to the WBL School District for a purchase price of $1,000,000.00. Approve Cooperative Agreement with DOT and White Bear Lake School District for TH61 and 152nd Intersection Improvements White Bear Lake School District had received bids for the intersection improvement at TH 61 and 152nd Street. The project was fully funded by the school district and consisted of turn lane additions and signalization. Construction was anticipated to begin in April and would be completed prior to school starting in the fall of 2022. Highway 61 would remain open during construction. As part of improvements located on a State Trunk Highway, Cooperative Construction Agreements were required by the Minnesota Department of Transportation. In this case, White Bear Lake School District was a party to the agreement due to their involvement in the project. Specifically, the agreement outlined the School District responsibilities related to costs, construction, plans and specifications, right-of-way, etc. The City would be responsible for maintenance of pedestrian facilities, minor signal system maintenance and power to the signal facilities. These were standard agreements they had for all communities. Adoption of the Consent Agenda approved RESOLUTION 2022 – 11 APPROVING COOPERATIVE CONSTRUCTION AGREEMENT WITH THE STATE OF MINNESOTA DEPARTMENT OF TRANSPORTATION AND WHITE BEAR LAKE SCHOOL DISTRICT FOR THE CONSTRUCTION OF A NEW SIGNAL SYSTEM AT THE ELEMENTARY ENTRANCE AT THE INTERSECTION OF TH 61 AND 152ND STREET. Approve Amendments to the Personnel Policy Regarding Personal Leave Pay In review of the City’s Personnel Policy, it was found that certain language pertaining to personal leave time and employee termination should be eliminated, specifically language that requires the employee to be in good standing with the City at time of termination of employment. Adoption of the Consent Agenda approved the amendment to the City’s Personnel Policy. Approve Pay Request No. 7 to Schreiber Mullaney for the Lions Park Pavilion Schreiber Mullaney had submitted Pay Request No. 7 for the new Pavilion in Lions Park in the amount of $787,621.21. The quantities completed to date had been reviewed and agreed upon by the architect, contractor, and City staff. The amount indicated above reflected the work certified through February 25, 2022, with a 5% retainage applied. The total retainage being Hugo City Council Meeting Minutes for March 7, 2022 Page 5 of 6 held to date would be $105,521.62. Adoption of the Consent Agenda approved Pay Request No. 7 in the amount of $787,621.21 to Schreiber Mullaney Construction for the construction of the City of Hugo Lions Park Pavilion. Approve Pay Request No. 17 to Ebert Construction for the Public Works Facility Project Ebert Construction had submitted pay request No. 17 for payment for the City of Hugo Public Works Facility project in the amount of $216,130.36. The quantities completed to date had been reviewed and agreed upon by the architect, contractor and City staff. The amount indicated above reflected the work certified through February of 2022, with a 5% retainage applied. Total retainage being held for the project to date was $466,168.08. Adoption of the Consent Agenda approved Pay Request No. 17 in the amount of $216,130.36 to Ebert Construction. Approve Variance from Shoreland Setback for 12582 Ingersoll Ave. -Tennyson Ranell and Dan Tennyson had requested two variances for the reconstruction of an accessory building on the property located at 12582 Ingersoll Avenue North. One was to allow the building to be 6.9 feet from the Ordinary High Water (OHW) mark of Sunset Lake, where 100 feet was required by ordinance. The second variance request was to allow the building to be 19.8 feet from the front property line, where 40 feet was required by ordinance. At its Thursday, February 24, 2022, meeting the Board of Zoning held a public hearing and considered the request. There was no one that spoke during the public hearing except the applicant. The Board of Zoning agreed the requests met the standards necessary to approve the variances and unanimously recommended approval. Strub had removed this from the Consent Agenda stating he had received notification of the request. Petryk made motion, Klein seconded, to approve RESOLUTION 2022-12 APPROVING VARIANCES TO ALLOW RECONSTRUCTION OF AN ACCESSORY BUILDING WITHIN THE FRONT YARD AND SHORELAND SETBACK REQUIREMENTS OF SUNSET LAKE FOR THE PROPERTY LOCATED AT 12582 INGERSOLL AVEUNE NORTH. Ayes: Klein, Petryk, Weidt Abstain: Strub Motion carried. Approve Resolution Approving Plans and Specifications for 140th Street Project and Advertise for Bids Previously, the Council had authorized staff to prepare plans and specifications for the 140th Street Extension Project that would extend the road approximately 600 feet west of the existing 140th Street road segment lying west of Fenway Avenue. Proposed improvements for the project would include construction of watermain, storm sewer, and street construction. This project had previously been added to the City Streets Capital Improvement Plan (CIP) and the extension would facilitate expansion of the Schwieters campus development. Plans and Specifications had been prepared for the 140th Street Extension Project and were ready to be advertised for bidding Community Development Assistant Emily Weber provided background and explained the funding for the project would be split with the developer. The project cost totaled $420,700. Hugo City Council Meeting Minutes for March 7, 2022 Page 6 of 6 The City’s portion would be $184,100 and the developer would be assessed for $236,600. They would be paying for the watermain, and the City would be paying to oversize it. Staff was requesting the Council approve the plans and specifications and authorize advertisement for bids. The contract would be awarded in April, 2022. Petryk made motion, Klein seconded, to approve RESOLUTION 2022-13 APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR THE 140TH STREET EXTENSION PROJECT. All Ayes. Redistricting Workshop on Monday, March 14, 2022 City Administrator Bryan Bear reminded the Council they scheduled a workshop on the redistricting of City wards and precincts for Monday, March 14, 2022, at 5:00 p.m. at Hugo City Hall. Schedule Bus Tour for Saturday, October 1, 8, or 15, 2022 City Administrator Bryan Bear recommended Council select a date on which to hold the Citywide Bus Tour. Zoning amendment request to rezone from the Agricultural Zoning District to the Long Term Agricultural Zoning District for the property located at 15500 Keystone Avenue North. DATE: March 16, 2022 for the City Council Meeting on March 21, 2022 ZONING: Agricultural District (AG) LAND USE: Agricultural (AG) REVIEW DEADLINE: April 9, 2022 1. PLANNING COMMISSION UPDATE: At its March 10, 2022 regularly scheduled meeting, the Hugo Planning Commission considered the zoning amendment request to rezone from the Long Term Agricultural Zoning District to the Agricultural Zoning District submitted by Charles and Marykay Haas and held a public hearing. No one came forward at the public hearing. Staff provided background and recommended approval of the request. The Planning Commission agreed that the request met the criteria necessary to approve the application and recommended approval of the zoning amendment to the City Council. 2. DESCRIPTION OF REQUEST: Charles and Marykay Haas are requesting to rezone their property from the Agricultural Zoning District to the Long Term Agricultural Zoning District. 3. BACKGROUND: The Minnesota Agricultural Land Preservation Program was established with the passage of the Agricultural Land Preservation Policy Act of 1984, which consists of tools for agricultural land preservation at the local level and a program to create awareness of agricultural land preservation and conservation tools. With this act, counties adopting agricultural land preservation plans can offer agricultural preserves, which limits the use of the land to agriculture or forestry. In return, Haas Zoning Amendment Page 2 property owners that opt into the program receive property tax credits and protection for normal agricultural practices. The program also provides tax relief for agricultural and conservation land by requiring the City Assessor to base any assessment on the land’s agricultural value. In order to offer the benefits of agricultural preserves to property owners, a county must have an approved agricultural land preservation plan. An agricultural land preservation plan is a part of a comprehensive land use plan that designates land for long-term agricultural use, while providing for expected growth around urbanized areas. Hugo has zoning and subdivision provisions outlined in the City Code that restricts properties zoned Long Term Agricultural to agricultural use and require low residential densities at one dwelling unit per 40 acres. In order to be considered for the MN Agricultural Land Preservation Program, the property must be zoned Long Term Agricultural. The applicant would like to enter into the Agricultural Land Preservation Program and therefore is requesting to be rezoned from Agricultural to Long Term Agricultural. 4. LEVEL OF DISCRETION IN DECISION MAKING: The City has discretion in approving or denying rezoning applications, based on whether or not the proposal meets the standards outlined in the Comprehensive Plan and Zoning Ordinance requirements. If the City finds that all the applicable standards are met, the rezoning application must be approved. Alternatively, if the City finds that any of the applicable standards are not met, the application may be denied. 5. CONTEXT: A. Surrounding Land Use and Zoning The subject property is zoned Term Agriculture (AG) and the land use is identified as Agricultural. The properties to the north, west, and east are zoned Agricultural (AG). All surrounding properties are identified as Agricultural in the 2040 Land Use Plan. B. Natural Characteristics of Site The 79.41 acre site has a single family home and one accessory structure located on it. The rest of the property is a mix of wetland and natural vegetation. 6. ANALYSIS: Staff has analyzed this rezoning based on the four criteria in the City ordinance under Section 90-40, Zoning Amendments: 1. The requested amendment is in compliance with the City’s Comprehensive Plan. The City’s Comprehensive Plan identifies the subject property as agricultural. The requested amendment would not change the land use of the property. The property is Haas Zoning Amendment Page 3 located in the east part of the City, which is planned for agricultural and rural residential uses. 2. The proposed zoning classification is appropriate for the property given the topographic, environmental and cultural limitations of the site. The property consists of a single family home and is primarily natural vegetation and wetlands. While the property is not used for traditional agricultural pursuits, is does contain high quality natural areas and trees. The Long Term Agricultural (LA) zoning would be appropriate for the property. 3. Existing public infrastructure is adequate to handle the development that can reasonable be foreseen on the site. The property is served by well and septic. Municipal sewer and water is not available to this area of the City. By changing the zoning from AG to LA, the minimum lot size would change from 10 acres to 40 acres. No development is proposed on the site and the existing access to the property is adequate for the use. 4. The proposed zoning classification will not have unreasonable negative impacts on adjacent properties. The rezoning will not negatively impact the adjacent properties. The property will remain in agricultural and open space uses consistent with other properties in the zoning district. 5. The floodplain designation on the official zoning map shall not be removed from floodplain areas unless it can be shown that the designation is in error or that the area has been filled to or above the elevation of the regulatory flood protection elevation and is contiguous to lands outside the floodplain. The floodplain areas are not proposed to be impacted. 7. CONCLUSION AND PLANNING COMMISSION RECOMMENDATION: Staff found the application meets the criteria outlined in the City Code. The Planning Commission discussed the request and held a public hearing. The Planning Commission recommends approval of the zoning amendment request to rezone the property located at 15500 Keystone Avenue North from the Agricultural Zoning District to the Long Term Agricultural Zoning District. OVERVIEW: The Metropolitan Council will implement a water efficiency grant program effective July 1, 2022 to June 30, 2024. Grants will be awarded on a competitive basis to municipalities that manage municipal water systems. The Council will provide 80% of the program cost while the municipality would be responsible for the remaining 20%. Municipalities will use the combined Metropolitan Council funds to run their own grant or rebate programs. Grants from the Metropolitan Council will be made available in amounts ranging from $5,000 to $50,000. Grantees will be required to provide estimated water savings achieved through this program for Clean Water, Land & Legacy Amendment reporting purposes. The goal of the water efficiency grant program is to support technical and behavioral changes that improve municipal water use efficiency. Grants are only for water efficiency programs offering rebates or grants to property owners who are customers of the municipal water supply system and must be a replacement of a specified water using device with approved devices that use substantially less water. For example, replacing an old toilet or irrigation controller with a newer, more water efficient device. 2. BACKGROUND: The City of Hugo has participated in the Metropolitan Council water efficiency grant programs previously in the past. In 2016, the City of Hugo was awarded money from the Clean Water Fund and offered a rebate program to residents who purchased WaterSense labeled toilets, irrigation controllers, or clothes washing machines and replaced old, inefficient products. In 2019, the City of Hugo used the funds to purchase 309 Rachio 3 Smart Irrigation Controllers and offered them to residents at a discounted price of $30. Page 2 3. 2022 GRANT APPLICATION: Staff is proposing to submit an application to the Metropolitan Council Water Efficiency Grant Program. The proposed grant amount from the Metropolitan Council is $50,000, with the understanding that Hugo is responsible to provide a local match of $12,500. 4. PROPOSED GRANT PROGRAM: If awarded the funds, staff is proposing to use the rebate program to update the irrigation systems in various City parks and properties. The irrigation systems would be updated with US EPA WaterSense labeled irrigation controllers and associated valves and sensors. With the grant program, expenses eligible for reimbursement are the out-of-pocket cost of the devices and its installation. Staff is estimating that at each proposed location, the estimated cost to update the irrigation controller, associated valves and sensors, and installation cost is between $7,000 and $8,000. This estimate is based off of the cost of similar projects and staff expects that the City would be able to update up to eight irrigation systems within City properties. Staff is proposing to apply for $50,000, which would require the City to contribute $12,500. The local match for this program would be funded by the money set aside in the Neighborhood Park Improvements fund in the Parks Capital Improvement Plan. Should the grant be approved and funds awarded, staff is proposing that the following parks and City properties be evaluated for the proposed irrigation system update: Hugo Fire Hall Diamond Point Park Oakshore Park Aspire Park Val Jean Park Arbre Park Heritage Ponds Park McCollar Park In total, the above properties used 3,828,000 gallons of water, not including Fire Hall usage, to irrigate in 2021. The proposed system updates are expected to reduce water usage by 62% due to the increased efficiency of the devices, which would result in 2,373,360 gallons of water saved based on last year’s usage. 5. CONCLUSION: Staff is asking for approval to submit an application to the Metropolitan Council Water Efficiency Grant Program with the understanding that the City of Hugo is responsible for a local match of $12,500. Grants will be awarded on a competitive basis to municipalities that are served by a municipal water system. The Council will provide 80% of the program cost; the municipality must provide the remaining 20%. Municipalities will use the combined Council and municipality funds to run their own grant or rebate programs. Grants will be made available in amounts with a minimum of $5,000 and a maximum of $50,000. Grantees will be required to provide estimated water savings achieved through this program for Clean Water, Land & Legacy Amendment reporting purposes. Legislative Directive - Minnesota 2021 Session Law $625,000 the first year and $625,000 the second year are for the water demand reduction grant program to encourage municipalities in the metropolitan area to implement measures to reduce water demand to ensure the reliability and protection of drinking water supplies. Fiscal year 2022 appropriations are available until June 30, 2023, and fiscal year 2023 appropriations are available until June 30, 2024. Grant Program Goal The goal of the water efficiency grant program is to support technical and behavioral changes that improve municipal water use efficiency in the seven-county metropolitan area. Grant applications will be reviewed and ranked by the MCES Water Supply Planning Unit staff. The remaining $250,000 of this funding has been allocated to a different municipal water efficiency grant project. Grants are only for water efficiency programs offering rebates or grants to property owners who are customers of the municipal water supply system and who replace specified water using devices with approved devices that use substantially less water. 2 Grants will be awarded to municipalities in amounts ranging from $5,000 to $50,000 for providing rebates or grants to property owners. Municipalities will be responsible for the design and operation of their rebate or grant program and its details. Grant payments to the municipality will be for 80% of approved program amounts. The municipality must provide the remaining 20% of the granted/rebated amount to the property owner. Municipality rebates or grants are eligible for reimbursement on device replacements conducted July 1, 2022 through June 30, 2024. Agreements shall require that municipalities: • Entirely pass through grants received (as is being done by MCES) • Verify purchase of devices to receive grants • Retain records and cooperate with any audits • Conduct all communications with property owners and ensure all written communications to property owners include both the Clean Water, Land and Legacy Amendment and the Metropolitan Council’s logo • Provide quantitative information for state reporting purposes Eligible water efficiency devices consist of the following: • Toilet replacement with a US EPA WaterSense labeled toilet • Irrigation controller replacement with a US EPA WaterSense labeled controller, either weather-based or soil moisture-based • Clothes washing machine replacement with a US DOE Energy Star labeled clothes washing machine • Irrigation spray sprinkler body replacement with a US EPA WaterSense labeled spray sprinkler body • Irrigation system audit by an Irrigation Professional certified by a US EPA WaterSense program • Residential dishwasher replacement with a US DOE Energy Star labeled residential dishwasher Expenses eligible for reimbursement are the out-of-pocket cost of the device and its installation only, not to include any owner labor costs. Proposal Selection Criteria In the event that funds requested exceed funds available, the following criteria will be used to determine the amount granted to a given municipality: • Municipalities with identified water supply issues in Master Water Supply Plan Community Profiles or Local Water Supply Plans • Municipalities’ ratio of peak monthly water use to winter monthly water use • Municipalities’ average residential per capita water use • The order in which applications are received and until grant funds are completely committed Funding Process and Reporting Requirements • Utilizing forms provided by MCES, the following information must be reported on a quarterly basis: o Number, type and amount of rebates or grants provided to property owners, along with each property address o Estimated annual gallons of water saved per device installation o Municipality matching funds disbursed o Number of unmet funding requests from property owners, if any • Upon review and confirmation of the above information, MCES will process a grant payment in the amount of 80% of approved total rebates or grants for the reporting period. • MCES will provide confirmation of grant balances available upon request and reserves the right to amend grant agreements, in collaboration with grantee municipality, if quarterly reporting indicates rebate or grant programs will not fully utilize grant awards within the grant period. WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”) along the easterly portion of the Owner’s property, which is legally described as: Lot 1, Block 2, FOX MEADOWS SECOND ADDITION, Washington County, Minnesota; and, WHEREAS, Owner is desirous of constructing a fence partially within the easement area; and, WHERAS, the City will permit the placement of a fence in the area described herein subject to the terms and conditions hereof. NOW, THEREFORE, in consideration of the premises and for good and valuable consideration, the receipt of which is acknowledged, the City will permit the encroachment on its easement as set forth herein and subject to the conditions set forth below: 1. Owner and their successors in title may install and maintain a fence within the Easement, and the fence shall be constructed in accordance with the plans on file with the City of Hugo. 2. No plantings, trees, permanent improvements or structures other than the fence may be maintained or placed in the easement area. 3. The City will notify Owner if it requires removal or relocation of the fence or any part of it. Thereafter, Owner shall remove the fence according to the direction of the City and if Owner fails to do so, the City may enter upon the land and remove as much of the fence as required and cast it upon the adjoining lands. INTRODUCTION: Washington County is applying for Metropolitan Council Regional Solicitation funding to help construct the final extension of the Hardwood Creek Regional Trail in Hugo. Staff recommends approval of the draft letter of support for the grant application. 2. BACKGROUND: The Hardwood Creek Regional Trail is a 12 mile multiuse trail, stretching through Forest Lake and Hugo. A master plan was approved for the Hardwood Creek Regional Trail in 2013, after extensive public engagement. From the north to south, the existing trail follows the Burlington Northern Railroad corridor, adjacent to Highway 61, from the Chisago County border in the north, to 140th Street in Hugo. Between 140th Street and Falcon Court, an alignment is identified in the master plan to provide a route to get around a part of the corridor where rail use will remain active for an undefined period of time. Washington County is leading a feasibility study to construct the trail from Fenway Blvd N and 130th St N to 120th St N (Ramsey County Rd J). Washington County has discussed the study and alignments with Wilson Tool and received a letter of support for the project. Public engagement has also included the impacted neighborhoods, including the Bald Eagle Estates Townhome Association. There have been questions about vegetation removal and comments have been generally supportive of the project. 3. PROPOSED PLANS: Washington County’s feasibility study includes conceptual alignments and cost estimates. One alignment was identified for the trail segment between 130th Street and Falcon - 2 - HCRT Letter of Support March 21, 2022 Court, based on discussions with the property owner, Wilson Tool International. Two reasonable concepts were identified for the southern segment along Falcon Avenue. All concepts meet all design standards for roadways and regional trails. Concept A Concept A maintains the existing width of Falcon Ave and Falcon Ct, which requires the trail to narrow from 10 feet to 8 feet in some locations and less buffer space between the road and the trail. Concept B Concept B requires slight narrowing of Falcon Ave and Falcon Ct, but provides a 10-foot paved trail throughout. The Hugo Parks, Recreation, and Open Space Commission reviewed the concepts at their meeting of November 17, 2021. The Commission had a slight preference for Concept A and was supportive of continued discussions and construction of the missing segments of the Hardwood Creek Regional Trail. 4. REGIONAL SOLICITATION: One of the funding tools for construction of the trail is the Metropolitan Council’s Regional Solicitation. Washington County intends to apply, for funding to construct Segment 1. Federal funds are anticipated to be available in this solicitation for program years 2026 and 2027. With or without an award of Regional Solicitation funding, discussion would continue with the City of Hugo and Washington County to select the preferred conceptual alignment, based on cost, street impacts, and continued public engagement. Funding of construction would likely be a partnership between Washington County and the City of Hugo. Additionally, coordination with Hugo’s Street Capital Improvement Plan is needed if changes to Falcon Avenue are desirable. 5. RECOMMENDATION: Staff recommends approval of the attached letter of support for Washington County’s application for Regional Solicitation funding to construct the missing segments of the Hardwood Creek Regional Trail. This document is written to summarize the methods and techniques used in this engagement effort and the feedback received from the public. Promotion of Engagement Opportunities The County used a postcard mailing to adjacent residents to promote an online engagement event described in the section below. A copy of this postcard in included in Appendix A. Online Engagement Format The online engagement event was hosted on a dedicated website created using Adobe Spark software: https://arcg.is/1WXOi90. A link to the website using a QR code was included on the mailed postcard. The content of the engagement event included: · A summary of the overall HWCRT corridor and previous Master Planning efforts · Map of the project area and highlights of key project goals · Layouts for the two design concepts under consideration · Frequently asked questions · A comment field for specific feedback or selection of a preferred design concept Public Response to the Online Engagement Event According to County staff, the online engagement had 170 views for the 12-day period, with 5 users leaving specific comments. The comments received are included in Appendix B. Online Engagement Results The comments received through the online engagement event had mixed results. Three respondents expressed a preference for a 10-foot-wide trail, while one other indicated that an 8-foot trail is sufficient. All five respondents expressed support for the addition of a trail along the proposed route. Other Feedback The online engagement event also provided the option to submit a comment directly to the County Project Manager. The comment received through this method is also included in Appendix B. Page | 2 Hardwood Creek Regional Trail Feasibility Study – 130th Street to 120th Street Public Engagement Summary Meetings with Individual Property Owners The proposed trail will have the most direct impact on two private property owners: Wilson Tool International and the Bald Eagle Townhome Estates. The following sections detail direct interactions that County staff and their representatives had with these property owners. Wilson Tool International The project team held two meetings with Wilson Tool International (WTI) representatives. The first meeting was held in July 2021 to discuss alternatives to route trail along Farnham Avenue. This scenario would have required narrowing of Farnham Avenue, which created concerns for WTI with truck queueing and other safety concerns. A second meeting occurred in September 2021 with WTI to review a revised trail alignment based on feedback from their representatives. Members of the project site walked around the property and discuss where the trail would lie relative to existing buildings and parking lots. WTI fully supports the revised alignment and sent the County the letter included in Appendix C to document their support and approval. Bald Eagle Townhome Association County representatives made repeated attempts to speak with association representatives about the project and proposed alternatives. Appendix C contains a table summarizing the three conversations that County staff had with association members. Sandberg, P.E., Director, County Engineer Washington County Response Resident Letter on Hardwood Creek Regional Trail Feasibility Study 2/22/22 Washington County staff received a resident letter on February 22, 2022. Staff followed up via phone. This is a brief summary of the county’s response. • Ramsey County is conducting a design study for the extension of the Bruce Vento Regional Trail that will connect to the Hardwood Creek Regional Trail (at County Road J) on the west side of Highway 61. More information can be found here: Ramsey County project page. Ramsey County is also actively pursuing a funding for this trail segment. • The feasibility study provides a broad estimate of the proposed project impacts, noting sections of vegetation within the corridor will likely need to be removed. Specifics on this will be identified during a future final design phase. The county is aware of the community concerns will work to minimize impacts, especially to high value (large, old growth) trees during construction. The county expects vegetation between the trail and railroad to remain in most cases. Additionally, vegetation plantings may be considered if the buffer does not naturally fill-in. • The city is aware of the comments to regarding Falcon Ave and Falcon Ct improvements. The city and county anticipate the railroad to be active for several decades. Because of this, the project is prioritizing more long-term solutions over interim solutions, in order to provide a safe accessible trial connection for users. • The feasibility study in just another step in the Hardwood Creek Regional Trail extension project. Additional engagement, especially with impacted homeowners, will be done during a future final design phase. Alex Fiorini, P.E. Based on the preliminary design, it is anticipated that the implementation of the proposed trail extension will require temporary right-of- way easements from BNSF during construction. The County has been working productively with BNSF to produce an acceptable design and we will continue to participate in that effort. It appears that remaining design problems are likely to have feasible solutions that will satisfy both parties. BNSF will not make any commitment to allowing this use of its right-of-way until final designs have been approved and BNSF and the County have executed agreements covering the terms and conditions of use. However, at the moment BNSF believes that the project can move forward with a reasonable likelihood of a successful agreement. Please contact me with any questions.
