Paul Christianson was hired as a Public Works Worker on September 27, 2004. Public Works
Director Scott Anderson recommends Council approve the annual performance review for Public
Works Worker Paul Christianson.
G.3 Approve Hiring of Joseph Hinzman as New Administrative Intern
At its August 15, 2022, meeting, Council approved the job description and advertisement for an
administrative intern. Staff has conducted interviews and recommends Council approve the
hiring of Joseph Hinzmen as the new administrative intern starting October 24, 2022.
G.4 Approve Annual Performance Review for Finance Director Anna Wobse
Anna Wobse was hired as the City’s Accounting Clerk on October 27, 2008, and has worked in
accounts payable and payroll functions. In March 2018, Council approved Anna as the new
Finance Coordinator and in October, 2021, as the new Finance Director. City Administrator
Bryan recommends Council approval of the annual performance review for Finance Director
Anna Wobse.
G.5 Approve Final Payment to Ebert Construction for the Public Works Facility
Staff recommends the City Council approve the final payment in the amount of $482,307.40 to
Ebert Construction for the construction of the City of Hugo Public Works facility.
G.6 Approve Final Payment to Ebert Construction for Material and Storage Building
Staff recommends the City Council approve the final payment in the amount of $37,860.03 to
Ebert Construction for the construction of the City of Hugo salt and materials building.
G.7 Approve Pay Request No. 2 to Iseler Demolition, Inc. for Water Tower No. 2
Demolition
Work Performed by Iseler Demolition, Inc has been completed. Final Payment includes the
contract reduction for turf restoration as approved at the last City Council meeting. Staff
recommends City Council accept the improvements and make final payment to Iseler
Demolition, Inc. in the amount of $612.00.
G.8 Approve Update to Everton Avenue Alternative Urban Areawide Review (AUAR)
In January, 2002, the Council adopted the Everton Avenue Neighborhood Final Alternative
Urban Areawide Review (AUAR) as part of the Everton Avenue Neighborhood
Study. Minnesota Rules 4410.3610, Subd. 7, requires the document to be reviewed and updated
every five years until all development in the study area has received final approval. The last
update to the plan was in October 2017. All required agencies have commented and no revisions
are required. Staff recommends Council approve the resolution adopting the Everton Avenue
AUAR update.
J.1 Receive Feasibility Study and Set Public Hearing for Birch Tree Ponds Neighborhood
Council had previously authorized staff to prepare a feasibility study for the 2023 Birch Tree
Ponds Area Street Improvements and the City held a neighborhood meeting to discuss the
project. The feasibility study has been completed with total project costs estimated at
$2,113,700. Staff will present the findings at the October 17th City Council meeting and request
the Council accept the feasibility study and set the Public Hearing for November 21, 2022.
J.2 Hopkins Schoolhouse Update
At its February 7, 2021 meeting, Council listened to an update from the Hopkins Schoolhouse
Committee and learned of their desire to save the schoolhouse. There was consensus of the
Council that the committee should reach out to the community to see if there was an ambitious
group to save the schoolhouse. The Committee was given a six-month deadline. A meeting was
held on April 23, 2022, to gather those interested in saving the schoolhouse. The meeting
resulted in a group that has been working on a plan since. This group met with staff on October
6, 2022. City Administrator will provide the Council an update.
J.3 Update on Annual Bus Tour
The City held its annual bus tour on Saturday, October 1, 2022. City Administrator Bryan Bear
will provide a recap of the tour.
N.1 Schedule Commissioner Interviews for Monday, November 14, 2022
At its October 3, 2022 meeting, Council requested staff propose a date on which to hold
commissioner interviews. Staff is recommending Council schedule interviews for Monday,
November 14, 2022, at 7 p.m.
N.2 Schedule Santa Party for Wednesday, December 7, 2022
The second annual Santa Party will be held on Wednesday, December 7, 2022, from 5-7 p.m. at
the Peder Pedersen Pavilion. This event is sponsored by the City and will include a visit from
Santa, Children’s Performing Arts, and a lighting ceremony. Staff recommends Council
schedule a meeting to attend the Santa Party.
N.3 Schedule Annual Holiday Party for Thursday, December 15, 2022
Annually, the City holds a holiday party in appreciation of commissioners, board members, and
City staff. Staff recommends Council schedule the 2021 Holiday Party for Thursday, December
15, 2022, at the Peder Pedersen Pavilion beginning with social hour at 5:30 followed by dinner at
6:30 p.m.

There were approximately 50 people that met at the new Peder Pedersen Pavilion for a short tour
before boarding the bus. The tour ended back at the Pavilion where lunch was served.

The City of Hugo had been contacted by a member of a Toastmasters group in White Bear Lake
requesting the City of Hugo proclaim the month of October as Toastmasters month. Adoption of
the Consent Agenda approved the proclamation proclaiming October as Toastmasters Month.
Approve Donation to the Hugo Fire Department from the Hugo American Legion
The Hugo Lions Club requested to donate $1,000 to the Hugo Fire Department for equipment and
training. Donations to the Fire Department must be approved by the City Council. Adoption of
the Consent Agenda approved the donation of $1,000 from the Hugo American Legion to the
Hugo Fire Department.

Approve Resignation of Roger Clarke from the Hugo Parks Commission
Commissioner Roger Clarke had submitted his resignation from the Parks Commission due to
other commitments. Roger had served on the Parks Commission from June, 2003 through
December, 2012 and again since May 2017. Adoption of the Consent Agenda approved the
resignation of Roger Clarke from the Hugo Parks Commission effective immediately.
Approve Renewal of Mining Permit for Mike Atkinson
The Mining Permit for Mike Atkinson on his property located on the south side of 147th Street
between Irish and Hyde Avenue expired on August 2, 2022. Atkinson had applied for a renewal of
the permit for another two years. For the past several years, the site had been used to stockpile
material, with no mining activity taking place. When the permit was renewed in 2012, the Council
allowed the Atkinsons to move forward with the Mining Permit renewal process without all the
conditions being met until the time mining operations began again, due to the cost of meeting
those conditions. The requirements not being met are to biannually provide a topographic map of
the site, calculation of stockpiled material, amount of granular material left on site to be mined,
and a reclamation plan. Staff found very minimal activity on the site to require those conditions be
met for the renewal of his permit. Adoption of the Consent Agenda approved the Mining Permit
for Mike Atkinson for property located on 147th Street North with the condition that all
requirements in the permit be met when mining activity begins again.
Approve Pay Request No. 2 to Miller Excavating, Inc. for the 140th Street Extension Project
Miller Excavating, Inc. had submitted Pay Request No. 2 in the amount of $190,595.88 for work
certified through September 15, 2022, on the 140th Street Extension Project. Substantial
completion had occurred on the project and just punch-list items remain. Adoption of the Consent
Agenda approved payment to Miller Excavating, Inc. in the amount of $190,595.88.
Approve Pay Request No. 1 to North Valley, Inc. for the Oneka Parkway Project
North Valley, Inc. had submitted Pay Request No. 1 in the amount of $583,565.34 for work
certified through September 15, 2022, on the Oneka Parkway Project. Substantial completion had
occurred on 1 of the 3 phases of the project, and significant work had been completed on the 2nd
phase. Work had also begun on the new signal system at Oneka Parkway and Frenchman Road.
Adoption of the Consent Agenda approved payment to North Valley, Inc. in the amount of
$583,565.34.
Approve Pay Request No. 1 and Change Order No. 1 for Iseler Demolition, Inc. for Water
Tower No. 2 Demolition
The water tower had successfully been removed. The quantities completed to date had been
reviewed and agreed upon by the contractor, and staff recommended Council approve Pay Request
No. 1 from Iseler Demolition, Inc. in the amount of $79,515.00. The amount reflected work
certified through August 8, 2022, with a 5% retainage applied. In addition, Iseler Demolition had
submitted Change Order No. 1. This change order authorized a deduction of $3,573.00 from the
Contract price for the City of Hugo to restore the site per the specifications with an independent

contractor. Adoption of the Consent Agenda approved Pay Request No. 1 and Change Order No. 1
from Iseler Demolition.
Approve Reduction in Letter of Credit for Meadows of Hugo 1st Addition
The Meadows at Hugo 1st Addition had had significant work completed to date and Centra Homes,
LLC had requested a reduction in the letter of credit. The current letter of credit for the 1st
Addition was in the amount of $1,468,192. Staff had inspected the work completed to date and
recommended reducing the letter of credit by $1,096,439 based on the value of work remaining to
be completed. The remaining value of the letter of credit would be in the amount of $371,753,
which was 10% of the original amount. Adoption of the Consent Agenda approved the reduction in
the letter of credit for Meadows of Hugo 1st Addition.
Approve Rezoning, CUP, Site Plan, and Variances for Premier Bank
This was removed from the Consent Agenda by Mayor Weidt.
Community Development Director explained Premier Banks was requesting approval for site plan,
zoning amendment, CUP, and two variance applications for the property located at 5616 147th
Street North. The proposal included an approximately 4,500 square foot commercial building with
a drive-through on the 0.76-acre parcel. The property was zoned Future Central Business (FCB)
and was located in an area of the City where development was guided by the downtown plan and
design guidelines. The applicant had requested to rezone the property to Central Business (C-1)
accommodating the commercial use and a CUP to allow for the drive-through entry point to be
located within 200 feet of residentially-zoned properties. Additionally, the applicant had requested
two variances be approved. The first was to allow for a reduction in vehicle stacking space in the
drive-through lane, and the second was to allow for the drive-through access point to be located on
a residential street. Juba reviewed the site plan with the Council. At its September 22, 2022,
meeting, the Planning Commission held a public hearing and voted unanimously to recommend
approval of the applications.
Weidt asked about the option to move the driveway from Flay Avenue to 147th Street. Juba
replied they did review a possible access on 147th street but felt the one chosen off Flay Avenue
was a safer access point. City Engineer Mark Erickson further explained the issue with traffic
turning east onto 147th Street was problematic with short site distances and times.

Oneka Parkway Improvement Project Assessment Hearing
On July 5, 2022, the City of Hugo awarded a construction contract for the completion of the 2022
Oneka Parkway Improvements Project. At the September 5, 2022, regular Council meeting, the
Council adopted a resolution declaring the costs to be assessed, ordered the preparation of the
proposed assessment roll for the 2022 Oneka Parkway Improvements Project and scheduled the
assessment hearing on the proposed assessments for October 3, 2022.
City Engineer Mark Erichson talked about the components of the project and explained the partial
roadway reconstruction, urban roadway mill and overlay portion, and intersection improvements at
Oneka Parkway and Frenchman Road. He stated they were looking at having the signal
operational at the end of the year. He reviewed the process as outlined by State Statute 429 saying
the Notice of Assessment Hearing had been published in the official newspaper and mailed to the
owners of each parcel described in the assessment roll at least two weeks prior to the hearing.
Erichson reviewed how the assessments costs were calculated and the cost per unit according to
the City’s assessment policy. The rates per foot per construction type were added together for the
frontage on Oneka parkway and divided by the number of townhomes resulting in $421.61 per
unit. Assessments would be over a five-year period at 4.25%, and could be prepaid within 30 days
of this hearing in full. He said paving is scheduled for October 12 and 13, and the signal is to be
up and operational by the end of the year.
Mayor Weidt opened the public hearing.
Richard Hogan, 5075 149th Street North, Unit #2, wanted to note it would be $84.32 plus current
association fees of $315 a month. This would be going up to $400 for one month for five years.
The $15,000 for the association cost would also drizzle down to the property owners. He said he
likes the stop light at the corner. He talked about the curves in the road and asked that the
developer or Council consider more straight streets in the future to make it easier for plowing and
fixing the roadway.
Debra Schreiner, 15042 Farnham Avenue North, talked about the assessment being put on the
association and not the other houses. She felt that any household that has a student that attends
Oneka Elementary should be assessed as well as the buses that use the road. It should not just be
an association thing for the City road. She said it was not an association road and many benefit.
She added that she doesn’t even use the road and definitely opposes it.
Weidt pointed out the association was only being assessed for 14% of the total project costs.
City Attorney Dave Snyder explained the purpose of this hearing and explained how other cities
do road projects. The bulk of this assessment was being spread to other people, not those that are

on the roadway. He talked about the broad area of the City’s participation in the cost and the
Council’s discretion on how it is applied, pointing out the assessment cost had been driven down
dramatically.
John Bredemus, 15174 Farnham Avenue North, said he has lived in Hugo for six years and taxes
have gone up a lot. He had never been assessed in any other city he lived in, and he wondered why
Vadnais Heights and Anoka never did it. He said all of the new construction to the north have
heavy duty trucks tearing up the road, and he asked if developers had been assessed for damage
done to the roads. He also asked about the senior policy, and there was talk about the paving of
Farnham.
Snyder explained how roads are assessed, and Erichson explained there would be a future
assessment to these same homes at a future date for Farnham Ave. It would be a small amount of
money for a mill and overly and would be substantially less. The homes to the north that would be
assessed would be at a much higher rate. Erichson explained the senior deferral program.
Dana Coleman, 15420 Foster Drive North, asked about the light and pedestrian ramps. She
questioned why they only had 30 days to pay.
Erichson explained the ramps were for handicapped accessibility. He explained there was a
deadline to have the material submitted to Washington County to get on the tax rolls, and it could
be paid if full in the subsequent years following.
Rick Bieniek, 5161 Farnham Drive N., stated the project looks nice, but there were issues with
signage by the school and some street lights out from Heritage Parkway to Farnham. He asked if
the wellhouse was being assessed and asked about other funding for the project. He said he liked
having the traffic control light, and he asked if it was known why the concrete fell apart, and he
questioned sidewalk maintenance.
Erichson replied the streets were not on the state aid system. There is money the City gets
annually from gas tax, but many components are not eligible. He said he did not have a
breakdown on it, but could get Bieniek the information. He talked about the deterioration of the
road saying no scientific study had been done, but it was likely bad concrete. There is now strict
sampling required by MnDOT. He pointed out that Freedom Trail was taken care of, and the City
has talked about a trail rating system.
Michelle Wolf, 5014 Evergreen Dr. N, Unit #1, asked about the HOA’s portion of it and whether
residents would be paying for that too. She said she agreed with what others said about the school;
people outside of the community are using the road. She said her taxes have gone up extremely
since she moved there in 2009.
Miron asked about limitations on who the City can assess for projects. Snyder replied government
agencies can only assess to the extent the property can be shown to benefit by the improvements.
Costs contributed by the City lowers the assessment.

Richard Hogan stated that no one is directly on the road. He also expressed disappointment at
Pulte Homes saying the City should use extreme discretion if considering Pulte as a developer in
the City.
Al Czaia,15362 Freedom Drive North, said he has lived in the City for three years. He previously
worked for St. Paul where they assess for 100% of their projects. He asked if they would be
getting a bill in mail.
Erichson replied the Finance Director would be sending a mailer to inform property owners about
assessments.
There were no other comments and Weidt closed the public hearing.
There were two written objections to go on the record. One was from Debra Schreiner stating her
objection to the assessment. Another letter was from James Donaldson, 1540 Foster Drive North,
objecting to the assessment stating extensive damage was the result of new construction, and those
benefiting from the road should pay for it.
Miron talked about the costs of the project and pointed out the traffic signal and trail maintenance
did not increase the assessed cost to the residents.
Klein asked about curves in the road and the reason they are there. Erichson explained that curves
are often a strategy to reduce the speeds on the road.
Miron talked about how the assessment could have been applied to the HOA, but the feedback
from previous meetings was that the preferred way was to assess property owners. He asked if that
was Erichson’s recollection, and Erichson replied that it was.
Klein made motion, Petryk seconded, to approve RESOLUTION 2022-65 ADOPTING
ASSESSMENTS FOR THE 2022 ONEKA PARKWAY IMPROVEMENTS.

Downtown Hugo Preliminary Plat and PUD
Community Development Director Rachel Juba explained Dennis Properties, LLC, was requesting
approval of a preliminary plat and planned unit development (PUD) to subdivide and master plan
property located on the west side of Egg Lake, east of TH61, to allow construction of five
buildings for a total of approximately 63,000 square feet. The PUD general plan was proposed for
the entire 4.2 acres of the property and would replace the previous PUD General Plan that was
approved in 2020. The property is owned by the City of Hugo, and there was a purchase
agreement with the applicant.
Juba reviewed the plan explaining there was a mix of uses including a restaurant, retail space and
offices. The plan also included a waterfront boardwalk. The preliminary plat included four lots
with building on each lot. An owners’ association would be created.

The applicant was asking for PUD flexibility from the shoreland ordinance regulations, parking
regulations, and minimum rear yard setback requirements. In exchange, the landscaping plan,
design standards, and architecture would exceed ordinance standards and a main street atmosphere
would be created in the Central Business District. There would be access to Egg Lake and
improvements to the water and habitat on the lake. Juba reviewed the comments received by the
DNR who stated there would be unacceptable impacts to the lake and no benefits. Staff felt, since
this site was being redeveloped, there would be improvements and no negative impacts.
Juba stated the EDA considered the application last month and there would be more to come as
talks continue. At its September 8, 2022, meeting, the Planning Commission held a public hearing
and considered the request. There were two people that spoke during the public hearing with
questions and concerns on parking, stormwater management, and shoreland regulation
flexibility. The Planning Commission agreed the project met the requirements to approve the
applications. The Planning Commission unanimously recommended approval of the preliminary
plat and PUD, subject to the conditions listed in the resolutions.
Denny Trooien, owner of Dennis Properties, stated he had been working on this for a couple years.
He said he enjoyed working with staff and asked for favorable approval.
Strub asked about phases and if this first phase could stand on its own, or will it look like they
started and never finished.
Denny replied he was still working on those details with Rachel and are in discussions on how the
phasing will go.

WHEREAS, an AUAR Update has been completed for the project pursuant to Minnesota Rules

associated with the Everton Avenue Neighborhood study area;
WHEREAS, the AUAR was updated pursuant to Minnesota Rule 4410.3610;
WHEREAS, the AUAR Update was distributed for the required 10-day comment period;
WHEREAS, comments received on the AUAR Update have generated information adequate to
determine mitigation measures associated with the potential development in this area;
WHEREAS, the comments received and the City’s responses to these comments are included in
the public record for the AUAR;

I. INTRODUCTION AND PURPOSE
The Everton Avenue Neighborhood study area is approximately 2.3 square miles (1,500 acres) and
is located near the western border of the City of Hugo (see Figure 1). It is bounded by 165th Street
on the north, Highway 61 (TH 61) on the east, CSAH 8 on the south, and Elmcrest Avenue on the
west.
The City of Hugo adopted the Everton Avenue Neighborhood Final Alternative Urban Areawide
Review (AUAR) in January 2002 and completed an update to the AUAR in 2007, 2012 and 2017.
Pursuant to Minnesota Rules 4410.3610 Subp. 7, for the AUAR to remain valid as the environmental
review document for the area, the document needs to be updated every five years until all
development in the study area has received final approval. Since undeveloped areas still remain in
the study area and the AUAR will expire in 2022, the purpose of this document is to update the
AUAR pursuant to Minnesota Rules.
The 2002 AUAR, 2007 Update, 2012 Update and 2017 Update included an analysis of the existing
conditions as well as two development scenarios as follows:
Option A - Existing Condition
Option B - 2002 Approved Comprehensive Plan
Option C - Concept developed based on public input
To implement Option C, a Comprehensive Plan Amendment was required. This amendment was
approved by the Metropolitan Council in 2002 and the City has moved forward with development in
conformance with Option C. Option C is in conformance with the current Comprehensive Plan.
The January 2002 adopted AUAR, and subsequent updates are available for review on the City’s
web-site at http://www.ci.hugo.mn.us/auar. This report is intended to serve as an update of the
AUAR and includes a review of the areas that have and have not developed, an update to the
environmental analysis as needed, and a review of the mitigation measures.
II. APPROVED DEVELOPMENT/CURRENT CONDITIONS
Figure 2 shows the location of the approved developments within the study area. Of the 1,500 acres
in the study area, 725 acres have been developed. Since the 2017 AUAR update, additional
development has been approved as follows:
• Additional commercial development occurred in Victor Gardens North and Frenchman Place.
• Oneka Place by D.R. Horton is in development in the southern portion of Area D along with
some dedication of new road right-of-way.
• Water’s Edge is fully developed.
• The Northeastern corner of Area B (Figure 2) obtained a Conditional Use Permit and Hugo
Elementary School is in construction.
The City’s Comprehensive Plan was updated to reflect the land uses outlined in Option C of the
original AUAR. All of the developments that have been approved are within the thresholds of Option
C and the City’s Comprehensive Plan.

III. AREAS REMAINING TO BE DEVELOPED
Of the 1,500 total acres, there are approximately 775 acres remaining in the study area that have not
been approved for development. These areas are shown in (Figure 2) and discussed below:
Area A: This area includes the existing large lot residential uses located on the western edge of the
study area. This area is anticipated to remain as it is in its current condition, in conformance with the
2002 AUAR. This area has been excluded from the Metropolitan Urban Service Area (MUSA) area in
the Comprehensive Plan.
Area B: This area includes the Post Office and the Flay Avenue wetland complex. It is guided for
medium-density residential. Much of this area is currently wetland and is not developable. A
conditional use permit was obtained for the northeastern corner and a new elementary school is
being constructed on the upland portion of this area. Construction is scheduled to be complete in Fall
2022. This is in conformance with the 2002 AUAR.
Area C: This area is currently guided for both commercial and medium density residential/
commercial uses located adjacent to the north side of CSAH 8/Frenchman Road. Oneka Parkway
starts in this area as the main north-south collector. Wagner’s Greenhouse is located within this
area. A health facility, daycare and multi-family residential units have been constructed in this area.
The LaValle Fields Development is under construction east of Oneka Parkway, adjacent to the public
ditch and existing wetlands. These developments are in conformance with the 2002 AUAR.
Area D: This area includes agricultural and large lot residential properties located along the northern
edge of the study area. Much of this area is guided for medium- and low-density residential with an
area of Industrial use in the northeast corner and has not yet developed. The Prairie Village
development has been fully developed since the 2012 AUAR Update . Meadows of Hugo and Oneka
Place are in development.
Timeline: The 2002 AUAR anticipated development of this area occurring between 2002 – 2012. As
indicated, approximately 48 percent of the study area has been developed. The remaining area
could develop between five- and ten-years dependent on market conditions.
IV. UPDATE TO THE ENVIRONMENTAL REVIEW
The DNR Natural Heritage Database information was updated for this AUAR Update. A formal
Minnesota Department of Natural Resources (MNDNR) Natural Heritage Information System (NHIS)
request was submitted on April 18, 2022, and a response was received on September 20, 2022
(Appendix B). The following records of special status species or rare habitats are within 1 mile of
the project area:
• A bristle-berry (Rubus stipulatus) – state endangered plant species in the vicinity of the project.
This species is typically found in wetlands within the Anoka sandplain that are open, sunny, and
dominated by fine-leaved sedges and rushes.
• Swamp blackberry (Rubus semisetosus) – a state threatened species in the vicinity of the
project. This species is typically found in savannas in moist sand along the margins of
groundwater-fed swales or marshes.

• Blanding’s turtle (Emydoidea blandingii) – state threatened reptile species within the project area
and nearby the project area to the south and east. Typically found in wetland complexes or other
calm, shallow water near adjacent sandy uplands.
• Wilson’s phalarope (Phalaropus tricolor) – state threatened bird species documented outside of
the project area to the north in a wetland location. Typically found in grass -dominated wetlands,
including flooded pastures and stormwater ponds.
• Lance-leaf violet (Viola lanceolata var. lanceolata) – state threatened plant species located
outside of the project area to the north. Typically found in low, moist, sandy meadows or swales.
• St. Lawrence grapefern (Botrychium rugulosum) – state plant species of concern located outside
of the project area to the north. Found in low, moist habitats in forest openings.
The sewer and water system were reviewed in relation to the existing conditions, past development,
and the AUAR. The City’s Comprehensive Sewer and Water plans can accommodate the study
area. The City’s Drinking Water Supply Management Area (DWSMA) is located within the
southeastern portion of the study area, within development Areas B and C. This area is noted as
vulnerable to contamination and development within Areas B and C will be consistent with the City’s
Wellhead Protection Plan.
Storm water management regulations continue to change. The study area is subject to the Rice
Creek Watershed District (RCWD) rules, administered by the City of Hugo. The RCWD adopted new
rules in 2020. Additionally, Total Maximum Daily Load (TMDL) studies have been completed or are
in process of being developed that could affect the study area. These changes are noted in the
revised mitigation measure in Section V.
Based on this analysis, the area has developed in conformance with the 2002 AUAR and
subsequent updates. The areas that are anticipated to develop will be in conformance with the
AUAR and updates, and the mitigation measures. The land use plan for the area is based on Option
C in the 2002 AUAR.
V. MITIGATION SUMMARY AND UPDATE
The mitigation measures developed in the AUAR process are outlined below, including a progress
update:
1. All permits identified in the AUAR and noted by the commenting agencies will be secured by
private properties/developers or the City, as appropriate, for all development areas within the
Everton Avenue development area. The permits are listed under Item #8 of the AUAR.
Permits were secured for past projects and will continue to be obtained for future
projects.
2. Completed: The City has amended their Comprehensive Plan to be consistent with the
information and conclusions of this AUAR, which will guide the permitted land use, z oning,
utility extensions, and other development activities. The amended Comprehensive Plan is
currently awaiting approval from the Metropolitan Council. The City’s Comprehensive Plan
was approved by Met Council and this item has been completed. Item removed as it
has been completed

3. The City will comply with its own standards, ordinances, plans, and policies referred to in the
AUAR in the review and approval of all development activities within the Everton Avenue
AUAR study area. This activity has occurred and will continue to occur.
4. Based on EQB rules, the City will update the Everton Avenue AUAR based on Minnesota
Rules 4410.3610 Subpart 7 if after five years all development in the study area has not been
approved by the RGU, or if certain conditions or assumptions change, including land use
classifications and/or development densities. This is being accomplished through this
AUAR Update.
5. Developers or City will be required to obtain the necessary permits for any development
scenario. It is anticipated that the permitting process will be one tool for the implementation
of the mitigation outlined in this AUAR. It is anticipated that many of the permits will be the
responsibility of the developer to obtain including wetland alteration permits and stormwater
management permits as the City is not anticipating constructing the stormwater
management plan as a City project. It will be the responsibility of the project proposer to
obtain all necessary permits. This activity has occurred and will continue to occur.
6. The City of Hugo will continue to cooperate with the City of Lino Lakes, as appropriate, to
minimize environmental impacts and work towards compatible land uses along the Cities’
borders. The two cities continue to coordinate as necessary.
7. Development in the study area is required to conform to State standards associated with
dealing with hazardous materials or storage tanks that may be encountered during
construction activity. This activity has occurred and will continue to occur.
8. Wetlands within each proposed development site will be delineated by a trained wetland
professional in accordance with the 1987 Corps of Engineers Wetlands Delineation Manual
and the regional supplements. The developers will be responsible for obtaining these
delineations. This activity has occurred and will continue to occur.
9. Any wetland impacts will be subject to the Wetland Conservation Act and Section 404 rules
involving sequencing and mitigation. This activity has occurred and will continue to
occur.
10. REVISED: Wetland mitigation will be completed either on-site or through the purchase of
bank credits as required by State and Federal rules. The original AUAR indicated
mitigation would be on-site, as the State rules guided mitigation to be on site. Since
that time, the WCA rules have changed to favor purchase of banking credits.
Therefore, this item has been revised.
11. The greenway corridor as generally shown on Figure 9 (in the 2002 AUAR) will be
preserved and maintained to provide habitat to mitigate for areas that may be lost through
development and impacts associated with the collector roads. This corridor will also act to
preserve significant existing natural resources within the study area such as the forested
areas along portions of the ditch. The City will continue to work to implement this
measure.
12. The City intends to implement the greenway corridor through a variety of mechanisms. The
City has a 10 percent park dedication requirement that will be used to obtain greenway
corridor as development plans are reviewed and approved. Further, grant applications and
direct purchase could be used as funds and willing sellers become available. The greenway
will also be implemented through negotiations with developers at the time of development

reviews. Density bonuses are also available to developers who preserve natural resource
features such as the greenway or buffers around wetlands. The City will continue to work
to implement this measure.
13. Through zoning and MUSA boundary determinations, the ten-acre lots will be maintained
under Option C. This will assist in the maintenance of the grassland and wetland complexes
near Elmcrest Avenue by preventing higher density development in this area. This activity
has occurred and will continue to occur.
14. Blanding’s turtles have been reported in some locations of the study area. The City will
provide the Blanding’s turtle information sheets to the contractors working in the study area.
Further, the City will consider oversizing culverts to provide crossings for Blanding’s turtles
provided that the size of the culvert does not conflict with the requirements of the Rice Creek
Watershed District and the City’s stormwater model. This activity has occurred and will
continue to occur.
15. If Blanding’s turtles are encountered during construction activity, the contractor will be
required to move turtles that are in harm’s way. Guidance will also be provided indicating
that if turtles are in harm’s way, they should be moved the closest safe area. Turtles that are
not in imminent danger shall be left undisturbed. This activity is ongoing.
16. UPDATED: Silt fence will be removed after the disturbed area has been revegetated to
minimize impact to turtle movement. Additionally, alternative sediment control measures that
reduce impact to Blanding’s turtles and other wildlife should be considered with develo pment
plans. This activity is ongoing
Since development of the original AUAR, the DNR has established additional
requirements for projects in the vicinity of known blandings turtle occurrences,
including requirement for the use of ‘bio-netting’ or ‘natural-netting’ erosion control
blanket, avoidance of impacts to aquatic resources suitable for hibernation between
October 15 and April 15, maintenance drawdowns of stormwater basins prior to
September 15, and site checks for turtles prior to construction.
17. REVISED: Wetland impacts will be subject to State and Federal wetland rules. Impacts are
also subject to the City’s shoreland and floodplain zoning ordinances. Wetland impacts will
first be avoided as feasible. If avoidance is not feasible, wetland impacts will be minimized
and reduced. Any remaining wetland impacts will be mitigated within the study area in
accordance with the Wetland Conservation Act. The original AUAR indicated mitigation
would be on-site, as the State rules guided mitigation to be on site. Since that time,
the WCA rules have changed to favor purchase of banking credits. Therefore, this
item has been revised.
18. Prior to providing outlets to landlocked areas, the City will evaluate the impact of these
outlets on downstream areas in conformance with City policies. City policy states the
following:
“The City of Hugo may provide an outlet to landlocked basins, provided that the discharge
rate from these basins does not exceed the critical duration 100-year storm, that it can be
demonstrated that this discharge will not significantly impact the downstream flood profile,
wetlands will not be drained (unless exempt as per the Wetland Conservation Act), and dead
water storage to retain runoff from back-to-back 100-year, 24-hour rainfall events is
provided. This activity has occurred and will continue to occur.

19. Outlets will be required to conform to the RCWD policies. This activity has occurred and
will continue to occur.
20. Stormwater will be treated to RCWD and City standards, which includes NURP treatment.
Rate control and treatment will be provided through the use of a regional system associated
with the ditch in cooperation with on-site treatment to meet the RCWD and City standards.
The developers will be required to implement the stormwater management plan outlined as
part of Option C in this AUAR. This is ongoing, and portions of the system have been
constructed as part of the approved developments.
21. UPDATE: The City will review TMDL studies when completed and revise City practices
and/or the AUAR as needed. The Centerville and Peltier Lakes TMDL study has been
completed. This study identifies phosphorus as the pollutant causing the impairment
in the lakes and has resulted in the need to reduce the external phosphorus loading
from Hardwood Creek or Clearwater Creek by between 46 and 62 percent. A number
of possible projects to address this load reduction have been identified in the
November 2011 report “Capital Improvement Plan for Stormwater Projects within the
City of Hugo” (WSB). Four possible projects in this study are located within the
Everton Avenue AUAR study area. The City’s 2018 Water Resource Management
Plan identifies water quality problems and outlines corrective actions and stormwater
projects. Water reuse systems have been constructed along CASH 8 and within
Waters Edge Development. Two possible projects in the study are still pending within
the Everton Avenue AUAR study area.
The Upper Mississippi River Bacteria TMDL study has been completed. This study
identifies E. coli as the pollutant causing impairment in the river and has resulted in
the need to reduce the external E. coli loading to Rice Creek between 4.8 and 44
percent. The City of Hugo already has a number of existing ordinances related to pet
waste and septic systems. The City has also applied for, and received, several
inflow/infiltration grants to fund the costs of improving existing sanitary sewer and
extensions of the municipal system.
22. Completed: The City shall update the DNR water appropriations permit for the City’s wells.
This has been completed. Item removed as it has been completed
23. Temporary dewatering permits may be needed for construction. The developers shall be
responsible for obtaining all necessary permits for this work. This activity has occurred
and will continue to occur.
24. Construction of additional wells will occur as demand dictates in accordance with Minnesota
Department of Health and State standards. This activity has occurred and will continue
to occur.
25. As wells become obsolete, wells shall be abandoned and sealed in accordance with
Minnesota Department of Health guidelines. This has been done for the properties that
had wells when the developments occurred and will continue for any future
developments.
26. COMPLETED: The City shall obtain the necessary FEMA floodplain revisions to lower the
floodplain elevation in the study area based on the errors in the current FEMA study. This
base flood elevation has been revised with FEMA. Item removed as it has been
completed.

27. Once the floodplain revisions are approved, the City will work towards revising the floodplain
ordinance, if necessary. The City will continue to work on this item.
28. No development within the floodplain will be permitted by the City as indicated in the City’s
floodplain ordinance. If encroachment within the floodplain is proposed, both the City and the
Rice Creek Watershed District require compensatory mitigation at a 1:1 ratio for the lost
storage. This measure has been followed and will continue to apply.
29. COMPLETED: Structures will not be constructed within areas that are proposed to be
removed from the floodplain until the floodplain revisions are approved. The City will
continue to work with FEMA to complete these revisions. Item removed as it has been
completed.
30. Development within the study area shall be required to conform to the City’s shoreland
zoning and floodplain ordinance. This measure has been followed and will continue to
apply.
31. UPDATED: Erosion and sedimentation control will be required to conform to City and RCWD
standards. Erosion control measures will be included in the developer’s agreement. Erosion
control measures will be consistent with Best Management Practices as outlined by the
Minnesota Pollution Control Agency. This measure has been followed and will continue
to apply.
The City will also encourage developers incorporate native plants and seed mixes into
vegetation plans.
32. The filling of large areas of unsuitable soil for residential construction will not be permitted
within the study area. This measure has been followed and will continue to apply.
33. The City does not intend to discharge untreated stormwater to natural wetland complexes or
designated stream corridors as part of development within the study area. However, if
impacts to wetlands are proposed as part of development, they will be evaluated in
accordance with the Wetland Conservation Act. This measure has been followed and will
continue to apply.
34. City policy and the RCWD require that post-development discharge rates not exceed pre-
development discharge rates. Development will be required to meet these standards. This
measure has been followed and will continue to apply.
35. UPDATED: The City will work with the RCWD to address the District’s interest in providing
volume control standards to the two-year, 24-hour rainfall event. This measure has been
followed where soil conditions allowed. With the new 2020 RCWD Rules, the City will
follow the 2020 RCWD Rules for new development to implement volume control
standards of up to 1.1-inch of runoff from new impervious surfaces for non-public
linear development. Public linear projects will be required to provide the larger of
either of 1.0-inches of runoff from the new impervious surface or 0.5-inches of runoff
off of the sum of new and reconstructed impervious. The City will continue to work
with RCWD to renew the joint Memorandum of Understanding transferring the
permitting authority to the City. The original Memorandum of Understanding
transferring permitting authority was completed and does not outline a renewal
process.

36. The stormwater management plan outlined in Option C will be implemented by the
developers with oversight and review provided by the City. Through the use of this large,
centralized, regional stormwater management system in combination with some on-site
ponding, discharge rates can be maintained at pre-development rates for the study area,
including the collector roadways. This measure has been followed and will continue to
apply.
37. The developer shall be responsible to make certain that the site is graded ap propriately to
ensure adequate stormwater management is available to the extent necessary and will be
required to obtain the necessary permits for stormwater management and grading. This
measure has been followed and will continue to apply.
38. The RCWD requires stormwater treatment and infiltration. Any new development is required
to meet the most updated rules of the RCWD. This measure has been updated with this
AUAR update to remove old RCWD permit requirements.
39. It is anticipated that ditch blocks will be used along the regional system to prevent the
draining of adjacent wetlands. By maintaining the existing stormwater runout elevations, the
adjacent wetlands are not anticipated to be impacted. While the regional stormwater
management plan has been developed to minimize impact to wetlands, some wetlands may
be excavated or otherwise impacted once final plans are developed. Impacts to these
wetlands will be analyzed under sequencing standards and if impacts cannot be avoided,
they will be mitigated in accordance with the Wetland Conservation Act and Section 404 of
the Clean Water Act (U.S. Corps of Engineers). This measure has been followed where
needed and will continue to apply.
40. UPDATED: MPCA standards will be enforced for on-site sewage systems. Compliance will
be monitored as required. It is assumed that no new on -site sewage systems will be
constructed in the area. Reconstruction or rehabilitation of existing systems will be allowed
in areas of Large Lot Residential land uses. It is expected that any reconstruction or
rehabilitation of existing systems would be done in accordance with applicable standards . If
existing Subsurface Sewage Treatment Systems (SSTS) systems are discontinued, or if
unused SSTS are discovered, they will be properly abandoned and a County permit for
septic system abandonment will be obtained. This measure has been followed and will
continue to apply.
41. The study area (except the large lot areas) will be served by municipal sewer that flows to
the MCES Interceptor with eventual treatment at the MCES Wastewater Treatment Plant
facilities. Municipal sewer will be constructed as part of private development in the study
area. This measure has been followed and will continue to apply.
42. COMPLETED : A sanitary sewer lift station will be constructed by the development projects
in the northwestern portion of the study area. This item has been completed. Item
removed as it has been completed.
43. Many of the soils in the study area are classified as poorly drained. While these soils do not
always meet wetland criteria, they do pose constraints for construction. Housing
developments are anticipated to be clustered to avoid hydric soils. Construction will also
include slab-on-grade techniques to avoid problems in the study area associated with poorly
suited soils. The filling of large areas of unsuitable soils for residential construction will not
be permitted within the study area. This will be enforced through City plat review. This
measure has been followed and will continue to apply.

44. The developer will be required to obtain soil borings to determine the suitability of soils for
construction. This measure has been followed and will continue to apply.
45. Mitigation includes the development of a spill response plan. For industrial and commercial
areas, spills will be reported to the fire chief and/or applicable City Staff. The fire chief and/or
applicable City Staff will in turn notify any other appropriate officials depending on the nature
of the spill. This measure has been followed and will continue to apply.
46. The individual waste hauler companies shall make residential and commercial recycling
programs available to landowners within the C ity of Hugo. General municipal waste will be
removed by these waste hauler companies. This measure has been followed and will
continue to apply.
47. Tanks and other potential pollutant sources will be removed in accordance with State
standards if they are encountered as part of development. This activity is ongoing.
48. The City of Hugo will monitor the volume and distribution of traffic from new development
within the Everton AUAR study area and will not permit new development to proceed before
necessary roadway improvements are completed. This activity is ongoing.
49. COMPLETED: The extension of 147th Street to the southwest would serve as a northern
bypass of downtown Hugo. This new roadway would also require intersection improvements
at 147th Street and TH 61. These improvements would include the widening of the roadway
to accommodate higher traffic volumes, turn lanes, and the potential relocation of the
Frenchman Road (CSAH 8)/TH 61 traffic signal. The reconstruction of this intersection wou ld
greatly assist in improving the operation and safety conditions that would potentially be
realized with the forecast traffic volumes. The design details of the roadway and the
intersection improvements will be further evaluated as additional developmen t plans are
proposed. The intersection improvements at TH 61/147th have been completed as
noted in the 2007 AUAR. Since then, the ROW for 147th Street has been obtained. This
roadway project has been completed.
50. COMPLETED: Congestion along Frenchman Road (CSAH 8) will be mitigated in the future
by the reconstruction and anticipated expansion of CSAH 8 from TH 61 to I-35E.
Washington County, in cooperation with the City of Hugo, City of Lino Lakes, and Anoka
County, is currently in the planning and preliminary design phase of a project that is
anticipating construction of a four-lane highway by 2005. The roadway project has been
completed.
51. COMPLETED: Intersection improvements at the intersection of Elmcrest Avenue and CSAH
8 have already been considered and designed as part of the Victor Gardens Subdivision.
This intersection improvement is anticipated to be complete in 2002-2003. Additional
improvements to Elmcrest Avenue, north of CSAH 8, are anticipated as development in the
AUAR study area occurs. These improvements may include surfacing, striping, right-of-way
preservation, and access control. Implementation of these mitigation measures along
Elmcrest Avenue would require cooperation between the City of Hugo and the City of Lino
Lake. This work has been completed.
52. All intersection improvements will be designed in a manner to ensure a level of service
(LOS) D or better. Furthermore, turn lane queue lengths will be designed and constructed
with adequate capacity to ensure minimal interference and disruption for through lane
operations. This activity is ongoing.

53. Construction of local collector streets and frontage/backage roads will minimize the need for
local trips on regional arterials such as TH 61 and CSAH 8. Collector roadways will need to
be improved or constructed based on the timing and location of specific development. The
City of Hugo will continue to monitor traffic volumes and traffic operations to determine when
additional improvements will be necessary. This activity is ongoing.
54. COMPLETED :Construct the north-south collector street between 165th Street and the
extension of 147th Street as a two-lane roadway. Additional capacity requirements may be
necessary at the southern end of the roadway where daily traffic volumes are forecast to be
12,000 – 15,000. Oneka Parkway has been constructed between CSAH 8/Frenchman
Road and 159th Street.
55. COMPLETED: Construct the east-west collector street (extension of 159th Street) between
Highway 61 and Elmcrest Avenue as a two-lane roadway. This has been completed,
although the roadway changes to Heritage Parkway and is not a direct extension o f
159th.
56. The City of Hugo will continue to support improvements along TH 61 including intersection
improvements, safety improvements, and capacity improvements. Such improvements
would add needed capacity and safety improvements to accommodate Mn/DOT’s
Transportation Studies Plan (TSP) that lists TH 61 as a Preservation Corridor. No additional
public access points are being requested along TH 61 as a result of the proposed
development within the Everton Avenue AUAR study area. The access and corridor plan
has been completed with MnDOT, Washington County, Washington County Rail
Authority, and the City for TH 61 corridor within Hugo.
57. Currently, there are no transit routes utilizing any of the roadways within the study area.
There is a park-n-pool lot located near CSAH 8/14 and I-35E in the City of Lino Lakes. As
development in the Everton Avenue AUAR study area and the City of Hugo occurs, further
consideration will be given to establish connections to transit services. The Rush Line transit
corridor is another opportunity to provide transit service to the northeastern suburbs and
could assist in reducing the volume of trips that may be made by automobiles. Connecting
people and neighborhoods to these transit corridors will be considered during subdivis ion
review and approval. This activity is ongoing.
58. UPDATED: The City updated their Trail and Sidewalk Plan in 2019 (Figure 3). There is a
regional trail along Frenchman Road and City sidewalks and trails within portions of the
study area. Additional proposal trails are planned within the study area. Trail connections will
continue to be made as additional development occurs.
59. Access along all roadways will be managed to ensure traffic operations and safety is
protected. Access spacing guidelines, such as those identified in the Hugo Transportation
Plan, will be used as guidance for future access points. This activity is ongoing.
60. The capacity of the ditch and other water conveyance systems will be accounted for to
ensure that stormwater storage capacity is maintained during the design of the collector
roads. This measure has been followed and will continue to apply.
61. Implementation of transportation related mitigation measures will be assured through the
City, which will require and regulate infrastructure improvements through the City review,
approval, and permitting process. Funding for the proposed improvements will be provided
from several sources including development agreements, site assessments, Washington

County (for improvements to CSAH 8), and the City of Hugo. This measure has been
followed and will continue to apply.
62. Noise mitigation is not proposed at this time. All City and County roads in the project area
are exempt from state noise standards. The only nearby roads that are not exempt from
State noise standards are I-35E and TH 61. Noise levels along the collector roadways are
not anticipated to exceed state noise standards, nor are they anticipated to be greater than
noise levels that are commonly experienced within a residential area. Noise mitigation, if any
is provided, would be the responsibility of the individual developers of the residential
properties in the study area. This has not been an issue, but this measure still applies.
63. UPDATED: The greenway corridor and trail system shall be implemented with City
oversight. Developers shall be responsible for implementing trails associated with the
greenway and areas within the study area. The County shall be responsible for an y trail
development associated with County road reconstruction per Washington County’s Cost
Participation Policy. This measure has been followed and will continue to apply.
64. The City of Hugo shall cooperate with the City of Lino Lakes to develop appropriate trail
connections between the two cities. There is a trail along CSAH 8 that connects the two
cities. If development occurs along the border of the cities, this will continue to be
evaluated.
65. Through City plan review, the City shall require appropriate screening of developments
adjacent to land use changes and natural resources as deemed necessary by the City. This
measure has been followed and will continue to apply.
66. The City shall provide municipal services to the study area. These services include storm
sewer systems, sanitary and water service, and City streets. These services will be
constructed as part of development. This measure has been followed and will continue
to apply.
67. The City shall continue to implement its CIP to locate and provide community facilities to its
residents. This measure has been followed and will continue to apply.
68. UPDATED: The City shall continue to work with the White Bear School District to address
the needs for additional elementary schools. Oneka Elementary School was constructed
within Waters Edge and Heritage Ponds. Hugo elementary is being converted into an
early childhood education center and North Star Elementary is developed west of
Forest Boulevard North/Hwy 61.
69. The City recommends that developments consider stormwater reuse in an effort to reduce,
reuse and replenish water within the city.
70. UPDATED: Any solid or hazardous waste is discovered during development will be properly
managed at an appropriately permitted waste disposal facility.
71. UPDATED: a habitat assessment for state-protected species a bristle-berry, swamp
blackberry, and lance-leaf violet will be conducted in any undisturbed areas that will be
impacted by proposed developments. If necessary, a DNR take permit for protected species
will be obtained.

The City of Hugo issued the Draft Everton Avenue Neighborhood AUAR Update for review to the
EQB’s distribution list on September 6, 2022. The comment period ended on September 20, 2022 and
the city received comments from the MN Department of Natural Resources, Washington County, and
Washington Conservation District regarding the Everton Avenue Neighborhood AUAR Update. Each
comment, and the city’s responses are provided below. Agency comment letters are attached.
Department of Natural Resources
Comment 1: Rare Species: Please see the attached DNR Natural Heritage letter that contains
requirements to avoid impacts to state-listed species. Please include this letter with
DNR’s comments in the Record of Decision.
Response: The City reviewed the DNR’s Natural Heritage letter and updated the
AUAR to reflect the protected species present in the vicinity of the project area.
Mitigation measure 71 was added to reflect the need for a habitat assessment for
bristleberry, swamp blackberry, and lance-leaf violet prior to development of
undisturbed areas. Mitigation measure 16 was also updated to reflect the
requirements for avoidance of blandings turtles.
Comment 2: Stormwater: As the project area continues to be developed, it will greatly increase the
amount of impervious surfaces as well as the amount of road salt used in the project
area. Chloride released into local lakes and streams does not break down, and
instead accumulates in the environment, potentially reaching levels that are toxic to
aquatic wildlife and plants. Consider promoting local business and city participation in
the Smart Salting Training offered through the Minnesota Pollution Control Agency.
There are a variety of classes available for road applicators, sidewalk applicators,
and property managers. More information and resources can be found at this
website. Many winter maintenance staff who have attended the Smart Salting training
— both from cities and counties and from private companies — have used their
knowledge to reduce salt use and save money for their organizations. We also
encourage cities and counties to consider how they may participate in the Statewide
Chloride Management Plan and provide public outreach to reduce the overuse of
chloride. Here are some educational resources for residents as well as a sample
ordinance regarding chloride use.
Response: The city appreciates the need to chloride management and will consider
implementing the DNR’s recommended measures. Mitigation measure 72 has been
added to the AUAR to reflect this consideration.

Comment 3: Blanding’s turtles, a protected state-listed threatened species, have been
documented within the project area. Stormwater features may be colonized by
Blanding’s turtles in the area, therefore we recommend incorporating measures to
avoid impacting this species into stormwater management. In years when the
stormwater features will be dredged to remove excess sediment, please draw down
water levels by September 15th in order to allow turtles to find overwintering habitat
elsewhere.
Response: Mitigation measure 16 was also updated to reflect the requirements for
avoidance of blandings turtles.
Comment 4: We recommend that projects incorporate native plants and seed mixes into
development landscaping and stormwater features to the greatest degree possible in
order to provide pollinator habitat. The Board of Water and Soil Resources (BWSR)
provides many excellent resources on their Lawns to Legumes website.
Response: The city will encourage developers to implement the use of native
plantings and seed mixes in vegetated areas of developments. Mitigation measure 31
was updated to include this recommendation.
Washington County
Comment 1: If wells not in use are located during project development, these would need to be
sealed according to Minnesota Department of Health regulations to mitigate potential
groundwater contamination.
Response: Mitigation measure 25 includes the requirement for well abandonment.
This has been done for the properties that had wells when the developments
occurred and will continue for any future developments.
Comment 2: There are records for individual Subsurface Sewage Treatment Systems (SSTS)
within the areas remaining to be developed. If the use of any existing septic systems,
tanks, or components is to be discontinued they will need to be properly abandoned.
If any unused SSTS or septic tanks are discovered during development, they will
need to be properly abandoned. A County permit for septic system abandonment is
required and an abandonment form must be submitted to the Washington County
Department of Public Health and Environment (Department). If development occurs
where wastewater will be generated and in area where municipal sewer services are
not available a septic system permit must be applied for though the Department.
Response: Mitigation measure 40 has been updated to reflect the need for
abandonment and the County permit.
Comment 3: If any solid and hazardous waste, including waste resulting from historic dumping, is
discovered during development it must be properly managed at an appropriately
permitted waste disposal facility.
Response: Mitigation measure 70 has been added to the AUAR update to indicate
requirement to manage solid or hazardous waste appropriately.
Comment 4: It is stated in #63 of Section ‘V. Mitigation Summary and Update’, that “The County
shall be responsible for any trail development associated with County road
reconstruction.” This scenario will be applied per Washington County’s Cost
Participation Policy – Transportation Policy #8001 – and therefore it is requested that
“per Washington County’s Cost Participation Policy” be added at the end of the above
referenced sentence.

with the city as Local Government Unit for the Wetland Conservation Act to review

Response: The City will coordinate a review meeting to review the road alignment
with the TEP.

North, Freeland Court North and Fountain Ave North of Egg Lake Road. Work on Fountain
Avenue North South of Egg Lake Road will involve mill and overlay improvements.
The total estimated project cost for the 2023 Birch Tree Ponds Area Street
Improvements is approximately $2,113,700 which incorporates 2022 construction costs
and include a 5% construction contingency and indirect costs in the amount of 20% of
the estimated construction costs. Enclosed is a copy of the feasibility report.

A RESOLUTION RECEIVING THE FEASIBILITY REPORT AND
SETTING THE PUBLIC HEARING FOR THE
2023 BIRCH TREE PONDS AREA STREET IMPROVEMENTS
WHEREAS, pursuant to resolution of the Council adopted July 5, 2022, a report was prepared by WSB,
with reference to the improvement of the Birch Tree Ponds subdivision streets including Foxhill Avenue
North, 138th Street North, Geneva Avenue North, 135th Street North, 135th Court North, Freeland
Avenue North, Freeland Court North and Fountain Ave north and south of Egg Lake Road; and
WHEREAS, the following improvements are proposed:
Partial road reconstruction for Foxhill Avenue North, 138th Street North, Geneva Avenue North,
135th Street North, 135th Court North, Freeland Avenue North, Freeland Court North and
Fountain Ave north of Egg Lake Road
Mill and overlay improvements on Fountain Ave south of Egg Lake Road
and to assess benefited properties for all or a portion of the improvement, pursuant to Minnesota Statutes,
Chapter 429; and
WHEREAS, the City Council has been advised by the City Engineer that said street improvements are
feasible, and should best be made as proposed, and the City Engineer’s report to this effect has heretofore
been received by Council, and filed with the City Clerk on October 17, 2022; and
WHEREAS, the City Council deemed it necessary and expedient that the City of Hugo, Minnesota,
construct certain improvements, to-wit: 2023 Birch Tree Ponds Area Street Improvements, in the City as
described in and in accordance with the feasibility report prepared by the City Engineer; and
WHEREAS, the statute provided that no such improvements shall be made until the Council has held a
public hearing on such improvements following mailed notice and two publications thereof in the official
newspaper stating time and place of the hearing, the general nature of the improvement, the estimated
costs thereof, and the area proposed to be assessed, in accordance with the law; and
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Hugo that the public
hearing be scheduled to consider 2023 Birch Tree Ponds Area Street Improvements, to be held on
Monday, November 21, 2022, at 7:00 o’clock p.m. or as soon thereafter as possible, at Hugo City Hall,
14669 Fitzgerald Avenue North.
This resolution was adopted by the City Council of the City of Hugo on the 17th day of October 2022, by
a vote of Ayes and Nays.

1. Executive Summary
The proposed improvements for the 2023 Birch Tree Ponds Area Street Improvements consists of partial
roadway reconstruction, mill and overlay improvements, and spot curb and gutter replacement as
conditions warrant of existing roads in Hugo, MN. The partial reconstruction improvements will include,

A map of the proposed street improvements is located on Figure 1 in Appendix A. The portion of
Fountain Ave N that is north of Egg Lake Rd is zoned Central Residential (CR-3), while the remaining
portion of the project area is zoned as Single Family Detached Residential (R-3).
The cost of the street project is estimated to be $2,113,700. The project costs include a 5% contingency

The project schedule proposed includes construction beginning as soon as June 2023, with substantial
completion by late summer 2023.
The project is feasible, necessary, and cost effective from an engineering standpoint and should be
constructed as proposed herein.

2. Introduction
2.1 Authorization
On July 5, 2022, the Hugo City Council authorized the preparation of a feasibility report for the
2023 Birch Tree Ponds Area Street Improvements.
2.2 Scope
This feasibility report includes street improvements and limited drainage improvements along the
following existing roads:
Fountain Avenue North (South of Egg Lake Road) - mill and overlay
Fountain Avenue North (North of Egg Lake Road)
Foxhill Avenue North
138th Street North
Geneva Avenue North
135th Street North (terminate to west of 5815 135th Street North) – including 2 stub streets
135th Court North
Freeland Avenue North
Freeland Court North
These improvements will incorporate a partial roadway reconstruction and spot curb and gutter
replacement when conditions warrant.

2.4 Project History
The 2023 Birch Tree Ponds Area Street Improvements is identified in the City’s Capital Improvement Plan
to address the deteriorating condition of the roadway.

3. Existing Conditions
3.1 Surface
The existing streets within the Birch Tree Ponds Area are asphalt paved residential streets. Except for
Fountain Avenue North, road widths are 28 feet, with surmountable curb and no sidewalk. The northerly
section of Fountain Avenue North is 28 feet in width with bituminous curb and no sidewalk while the
southerly section of Fountain Avenue North is 30 feet in width with surmountable curb and no sidewalk.
The roadway drainage is conveyed by storm sewers to stormwater ponds within the project area.
3.2 Storm Sewer
Stormwater is collected in existing curb catch basins on either side of the roadway. These discharge to
stormwater basins within the project area. A majority of the existing storm sewer structures have
deteriorated and require replacement.
3.3 Municipal Utilities
3.3.1 Sanitary Sewer
The sanitary sewer system in the Birch Tree Ponds Area consists of 8” to 15” polyvinyl chloride
pipe (PVC). Public Works conducted a review of the existing sanitary sewer components, such as
manholes and pipe, and found no deficiencies. Sewer televising is scheduled to be completed to
ensure there are not any corrections needed as part of this project.
3.3.2 Watermain
The watermain system in the Birch Tree Ponds Area consists of a 6” to 8” ductile iron pipe (DIP).
Public Works has completed a review of the existing watermain components, such as gate valve
locations, gate valve condition, and hydrant conditions. There have been watermain breaks in
the area since the watermain was installed. Minor changes to the system that include a limited
amount of additional of valves, valve bolt replacement and three hydrant extensions have been
included.

4. Proposed Improvements
4.1 Surface
Partial road reconstruction is proposed for the following roads in the Birch Tree Ponds Area:
Foxhill Avenue North (Egg Lake Road – Cul de Sac)
138th Street North (Foxhill Avenue North – Geneva Avenue North)
Geneva Avenue North (Egg Lake Road – 135th Street North)
135th Street North (Geneva Avenue North – just west of 135th Court North)
135th Court North (135th Street North – Cul de Sac)
Freeland Ave North (135th Street North – Cul De Sac)
Freeland Court North (Freeland Avenue North – Cul de Sac)
Fountain Avenue North (north of Egg Lake Road)
2 stub streets off of 135th Street North
Improvements on 135th Street North will end at the point where old pavement joins with new pavement
for the Adelaide Landing subdivision to the west of Birch Tree Ponds after parcel 5815 135th Street.
Mill and overlay improvements are proposed on the southerly segment of Fountain Avenue North. A
geotechnical evaluation indicated that this segment of Fountain Avenue North is recommended for mill
and overlay improvements.
The proposed improvements include the removal and replacement of portions of deficient concrete curb
and gutter along the full length of the project extents as condition warrants All roads were cored to
determine the existing class 5 and pavement thickness. The coring locations and logs, included in
Appendix D
The basic geometry of the roadway is not proposed to be significantly changed in any portion of the
project, either horizontally or vertically. The typical section for all road segments of the roadway is
included in Appendix A and match the existing roadway section.
4.2 Storm Sewer
The existing storm structure castings will be adjusted to match the new roadway elevations. Numerous
storm structures will be removed and replaced that have deteriorated.
4.3 Watermain
Several isolation valves will be added that will allow public works to limit the number of properties that
would shut off in the event of a watermain break. Valves will be adjusted to match new roadway
elevations. Three hydrant extensions will be included to improve ease of operation.
4.4 Sanitary Sewer
Castings and manhole lids will be removed and replaced on a limited amount of deficient castings to
reduce inflow and infiltration of stormwater into the sanitary sewer system.
4.5 Permits/Approvals
The anticipated permits and approvals required, and the respective regulatory agencies are listed below.

4.6 Construction Access/Staging
The contractor will be responsible for providing access to all existing properties throughout the project.
The proposed methods of construction are the responsibility of the contractor. Adequately signed detours
will be identified to direct traffic around the construction zone and notify users of the increased truck and
construction activity. Detours will be used only if absolutely necessary to ensure the safety of residents
and construction workers alike.
4.7 Public Involvement
A public meeting was held on September 29, 2022, to provide initial project information to property
owners and residents within the project area. Residents were encouraged to share their knowledge of the
project area, specifically any known areas of concern.
As part of the Chapter 429 process, once the feasibility study is accepted, a public hearing will be
scheduled. Impacted residents will be invited to hear more details about the project and provide public
testimony regarding the proposed project.
Prior to construction, an additional public informational meeting will be held to further inform the property
owners of the proposed improvements, project timeline, assessment policy, and what to expect during
construction.

5. Financing
5.1 Opinion of Probable Cost
The total project cost for the Birch Tree Ponds Area Street Improvements is estimated to be $2,113,700.
A detailed opinion of probable cost is included in Appendix B of this report. The opinion of probable cost
is based on projected construction costs for 2022 and includes a 5% contingency and 20% indirect costs.
The indirect costs include engineering, legal, and administrative costs associated with the project. The
project costs are summarized as follows:

5.2 Funding
Funding for the project will be provided through assessments to benefitting properties and City Street and
Utility Funds. The proposed funding is outlined as follows:
5.3 Preliminary Assessment Roll
Assessments will be levied to the benefiting properties as outlined in Minnesota Statute 429 and the
City’s Assessment Policy. A detailed preliminary assessment roll is included in Appendix C. Based on
the City Code Section 30-2, the assessment rate on the respective project types are as follows:
Partial Reconstruction $4100.00/UNIT
Urban Roadway Overlay $2100.00/UNIT
Corner properties are assessed one-half unit per adjacent project roadway. So, if only one of the
roadways adjacent to a property is being improved, the total assessment will be only one-half of a unit at
this time. The per unit assessment was determined using the City of Hugo 2023 Fee Schedule for
roadway reconstruction and rehab. Proposed assessments for the project apply to 173 total units for the
proposed assessment project total of $672,900.00

6. Necessity and Effectiveness
The improvements proposed in this study are necessary, cost-effective, and feasible. The partial
reconstruction and mill and overlay of streets within the Birch Tree Ponds Area provides the City of Hugo
with a cost-effective means of continuing the City’s Street improvement efforts and providing an adequate
means of transportation for residents. These improvements will provide a longer lasting street section
needing less maintenance over the expected service life. The proposed improvements constitute a
project large enough to provide a competitive bidding environment, economy of scale, and are therefore
deemed to be cost-effective. Based on the information contained within this report, the proposed
improvements as described can be considered necessary, cost-effective, and feasible from an
engineering standpoint.

WSB is pleased to submit this report detailing the results of our field pavement investigation and
recommendations for pavement rehabilitation.
Our field investigation included documenting the existing pavement conditions, obtaining
pavement cores, power or hand auger through any existing aggregate base and measure and
visually classify both the aggregate base and the immediate underlying subbase or subgrade
material.
Based on the field data obtained and summarized in our report, we are providing
recommendations on reconstruction or rehabilitation techniques that we feel would be both viable
and bring the most value to meet the project goals. The recommendations provided are based
solely on our understanding of those goals therefore many other pavement rehabilitation
techniques may also be feasible.
An aerial map with the approximate core locations and a summary table of the field data obtained
at each location are presented in this report. Photographs of the pavement cores obtained, along
with photographs of existing pavement surface conditions at those locations can be found in the
Appendix.

Project Understanding:
We understand the City of Hugo is seeking to improve their existing bituminous pavements in the
Birch Tree Ponds Area through reconstruction or rehabilitation construction techniques. We
understand our services were requested to aid the design team in preparing projects plans and
specifications. The proposed pavement rehabilitation area includes multiple residential streets in
the City of Hugo. We have assumed the streets receives standard daily traffic for residential
streets.
Field Exploration:
WSB performed the field exploration on August 25, 2022. A total of seventeen (17) locations were
cored and bored within the proposed pavement rehabilitation area. The approximate locations
investigated and presented are shown in Figure 1.

Summary of Field Exploration:
The seventeen (17) cores obtained is this area had bituminous depths ranging from 2.5 inches to
4.5 inches, with a wear or top lift ranging from 1 to 2 inches, and a base layer ranging from 1.25
inches to 2.5 inches. The condition of the cores obtained were classified for each apparent lift of
asphalt, and all cores and lifts were classified as a range from fair to good condition with fair
cores showing raveling and cracking throughout the cores. The aggregate base appeared to be
sand with various amounts of gravel, reddish brown, brown, or light brown in color, and ranged in
depths from 7 inches to 13 inches. The subbase in general was identified as fine-medium grained
sand, brown in color. The Project Area exhibited various amounts of patching, block cracking and
stripping of chipseal layer, and transverse and longitudinal cracking throughout. Refer to field
notes for more detailed distresses for each sample location.

Recommendations for Rehabilitation:
Based on the conditions of the existing bituminous and subsurface data gathered by WSB, we
are recommending the reconstruction technique below be considered.
Pavement thicknesses do not allow for a mill and overlay option due to shallow pavement depths.
We recommend full depth pavement removal and replacement. This would entail of the complete
removal and disposal of the existing bituminous pavements. The underlying base should be
compacted, shaped and proof rolled immediately prior to bituminous paving.
In general, existing aggregate base appeared to be finer than typical requirements for MnDOT
Class 5 aggregate base. Additional clean coarse gravel could be added and blended in to existing
aggregate base.
The deciding factor between these possible options may be largely dependent on the price
differences at the time of bidding, project timelines and contractor availability. We would expect
both options presented will provide a long-term solution with similar maintenance requirements
and total life expectancies.
Key Considerations:
The import or export of any excess base aggregates associated with the recommended
rehabilitation techniques should be considered. The quantity will be highly dependent on
designed profiles and structure limitations such as utility structures and any adjacent curb/gutter
or driveway tie in elevations.
Any unstable base soils discovered during a proofroll would likely require sub cutting and
replacement. Potential costs associated with these corrections should be anticipated.
Pavement Design:
The new bituminous pavement section and mix type should be designed and specified by a Civil
Engineer in consideration of the loads, climate, desired life expectancy and other key factors.
Limitations:
The field data presented should be considered approximate and only valid for the location
investigated. We have assumed smooth transitions of the similar materials between locations
when formulating the recommendations provided.
Our recommendations are based solely on the data obtained through our limited field
investigations and our experience with similar reconstructive and rehabilitation work for the locale.
We consider local contractor experience and industry costs associated with the various
rehabilitation techniques available in conjunction with project specific details.
