APPROVING A VARIANCE FOR NORTHERN STATES POWER COMPANY,
MINNESOTA CORPORATION,dba XCEL ENERGY,FOR TRAINING
TRANSMISSION LINES ON THE PROPERTY LOCATED AT 13620 FENWAY
BOULEVARD NORTH
WHEREAS, Northern States Power Company, Minnesota Corporation, dba Xcel Energy,
has requested approval of a variance to allow the height of training transmission lines to
be up to 105 feet, where 50 feet is required by ordinance on the property legally
described as;

WHEREAS, the Planning Commission has reviewed said variance at a duly called a
public hearing on November 10, 2022, and recommends approval subject to the findings
listed in this resolution.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
variance for Northern States Power Company, Minnesota Corporation, dba Xcel Energy,
to allow training transmission lines to be up to 105 feet, where 50 feet is required by
ordinance with the following findings:
1. The proposed variance is permissible by law.
2. The applicant is requesting to construct several non-energized transmission lines for
training purposes that vary in height and reach up to 105 feet.
3. The applicant is requesting to use the property in a reasonable manner by constructing
transmission lines of similar height to existing energized utility poles throughout the
City.
4. The property is uniquely shaped and surrounded by mature wooded areas to the west
and south, screening the facilities from adjacent land uses. The wooded areas and
location of the proposed building would provide screening to the transmission lines.
The need for a variance is due to unique circumstances.
5. The site surrounded by other business park uses and industrial uses. Additionally, the
property is screened and buffered from nearby residential developments by existing
wooded areas and the proposed training building, therefore the requested variance
would not significantly alter the character of the surrounding area.
6. There are practical difficulties in meeting the zoning requirement.
7. The spirit and intent of the ordinance is to allow a certain building height without
adversely impacting the character of established areas and ensuring the building is
consistent with the surrounding development. The height of the transmission lines

will not adversely impact the character of the area and will be consistent with the
surrounding development. The granting of the variance will keep with the spirit and
intent of the ordinance.
8. Outdoor training facilities are allowed in the Business Park(BP) district with
approval of a conditional use permit. The applicant has applied for a conditional use
permit.
9. The project does not proposed to impact the floodplain.
10. The property is served with municipal sewer and water.
