HomeMy WebLinkAbout2022.20.19 RESO 2022-91 Pre Plat for Oneka Prairie RESOLUTION 2022-91 APPROVING PRELIMINARY PLAT FOR THE SOUTHWIND HOLDINGS,LLC, FOR"ONEKA PRAIRIE" ON PROPERTY LOCATED NORTH OF ONEKA PARKWAY AND NORTH OF EMPRESS AVENUE NORTH WHEREAS, Southwind Holdings, LLC, has requested approval of a preliminary plat to allow construction of 59 single family lots and 7 outlots on 24.83 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Southwind Holdings, LLC, for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 59 single family home lots and 7 outlots,in accordance with the application and plans received by the City on August 9, 2022, August 19, 2022, August 23, 2022, September 16, 2022, November 30, 2022, except as amended by this resolution. 2. Approval is contingent upon City Council approval of a rezoning to PUD for the 24.83 acre site. 3. The developer shall comply with Resolution 2022-92 for the PUD. 4. Oneka Parkway shall be constructed to the north property line and all the way to the lift station. 5. Park Dedication is to be satisfied with land dedication of Outlot C and park dedication fee of $2,686 per unit. The plans show construction of amenities in the park including a shelter, playground, and sidewalk loop in exchange for PUD flexibility. The Parks Commission shall review and approve the improvements/amenities prior to construction. 6. The preliminary plat plans dated November 21, 2022, and November 23, 2022, shall be revised to include the following revisions, to be reviewed and approved by staff a. The wetlands shall be updated on each plan set to be consistent, including existing wetlands and proposed impacts. b. Outlot G shall be dedicated as right-of-way. c. The drainage and utility easements shall be dedicated for wetlands on lots. Resolution 2022-91 Page 2 7. The developer has indicated that an HOA will be established for the development to own/operate/maintain landscaping within the outlots, landscaping along Oneka Parkway, and the water re-use system. The HOA documents shall be reviewed and approved by staff prior to the recording of the final plat. 10. Prior to commencement of any grading, the developer shall comply with the following conditions: a. The developer shall revise plans per items number 5. b. The developer shall obtain all necessary stormwater management and WCA permits from the City. c. The development shall obtain the necessary permits from the Army Corp of Engineers for the wetland replacement plan. d. The developer shall comply with all conditions in the City Engineer's letter dated December 1, 2022, and red-lined comments provided to the developer. I Resolution 2022-91 Page 3 11. Prior to the release of the final plat for recording,the developer shall comply with the following conditions. a. The developer shall comply with the City standards for street lighting within the public right-of-way. The street lights shall be a decorative style light. a. The developer shall comply with all conditions in the City Engineer's letter dated December 1, 2022, and red-lined comments provided to the developer. b. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. c. The developer shall obtain all necessary stormwater management and WCA permits from the City. d. The development shall obtain the necessary permits from the Army Corp of Engineers for the wetland replacement plan. e. The developer shall obtain all necessary local, state, and federal permits. f A stormwater reuse agreement shall be reviewed and approved by staff and recorded at Washington County. g. The Homeowners Association (HOA) documents for review and approval by staff. h. The City's development fees will apply to this project. The fee amounts will be calculated and included as part of the Development Agreement. A development agreement shall be executed and all fees shall be paid. i. A formula has been developed to determine the amount that the water trunk fee can be reduced based on the water reuse system, which results in a 35% reduction in the trunk fee. This provision will be included in the development agreement for each phase. 12. Prior to the issuance of building permits, the developer shall comply with the following conditions. a. The applicant shall record the final plat, development agreement and all other documentation at Washington County and provide the City with proof of recording. Resolution 2022-91 Page 4 13. Prior to the issuance of a certificate of occupancy for buildings, the developer shall comply with the following conditions. a. The lift station shall be constructed and functioning.
