HomeMy WebLinkAbout2022.20.19 RESO 2022-92 PUD General Plan for Oneka Prairie RESOLUTION 2022-92 APPROVING PUD GENERAL PLAN FOR SOUTHWIND HOLDINGS,LLC, FOR "ONEKA PRAIRIE" ON PROPERTY LOCATED NORTH OF ONEKA PARKWAY AND NORTH OF EMPRESS AVENUE NORTH WHEREAS, Southwind Holdings, LLC, has requested approval of a PUD general plan to allow approximately 59 single family residential lots and 7 outlots on a 24.83 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Southwind Holdings, LLC, subject to the following conditions: 1. A PUD general plan is approved to allow the creation of approximately 59 single family residential lots and 7 outlots, in accordance with the application and plans received by the City on August 9, 2022, August 19, 2022, August 23, 2022, September 16, 2022,November 30, 2022, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested rezoning of the 24.83 acre property and preliminary plat. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. The developer shall comply with all conditions in the City Engineer's letter dated December 1,2022, and red-lined comments provided to the developer. 5. PUD flexibility is granted to allow: a. Flexibility to allow various lot sizes with a minimum lot size of 7,800 square feet, where 10,400 square feet is required. b. Flexibility to allow various lot width with a minimum lot width of 65 feet, where 80 feet is required. c. Flexibility to allow a minimum front setback of 20 feet for a corner lot side yard, # where 30 feet is required. d. Flexibility to allow a minimum side yard setback of 7.5 feet,where 10 feet is required. e. Flexibility to allow a minimum right-of-way width of 54 feet,where 60 feet is required. I Resolution 2022-92 Page 2 6. The development is proposed to be in one phase. No phasing plan was provided or approved. 7. The building setbacks and impervious surface coverage requirements for the PUD are as follows: Proposed Lot Size 7,800 square feet 9,427 average) Lot Width 80 feet Front Yard 30 feet 20 feet on Setback corner lot side of house Side Yard Setback 7.5 feet Rear Yard Setback 30 feet Impervious 50% Surface 8. A stormwater re-use system, as shown in the plans, shall be constructed with the development. The final plans shall be reviewed and approved by staff. The system will be installed by the applicant, and owned/operated/maintained by the homeowner's association. A stormwater reuse agreement shall be reviewed an approved by staff and recorded at Washington County. 9. The developer has indicated that an HOA will be established for the development to own/operate/maintain landscaping within the outlots, landscaping along Oneka Parkway, and the water re-use system. The HOA documents shall be reviewed and approved by staff prior to the recording of the final plat. 10. The developer must comply with the following, prior to Final Plat and Final PUD Plan application: Landscaping and Lighting a. The final landscape plans must be submitted for review and approval by staff. b. The developer shall enter into an encroachment agreement for access and maintenance of the landscaping in the right-of-way and outlots. Streets/Access a. Oneka Parkway shall be constructed to the north property line and all the way to the lift station. Resolution 2022-92 Page 3 Park Dedication a. Park Dedication is to be satisfied with land dedication of Outlot C and park dedication fee of$2,686 per unit. The plans show construction of amenities in the park including a shelter, playground, and sidewalk loop in exchange for PUD flexibility. The Parks Commission shall review and approve the improvements/amenities prior to construction.
