HomeMy WebLinkAbout2022.11.07 CC Minutes Call to Order Mayor Weidt called the meeting to order at 7:00 p.m. COUNCIL PRESENT: Klein, Miron, Petryk, Strub, Weidt COUNCIL ABSENT: None OTHERS PRESENT: City Administrator Bryan Bear, City Engineer Mark Erichson, City Attorney Dave Snyder, Community Development Director Rachel Juba, City Clerk Michele Lindau Minutes for October 17, 2022, Council Meeting Klein made motion, Petryk seconded, to approve the minutes for the City Council meeting held on October 17, 2022, as presented. All Ayes. Motion carried. Approval of Agenda Weidt made motion, Klein seconded, to approve the agenda as presented. All Ayes. Motion carried Hugo Lions Club Donation to the Washington County Dive Team Jason Schweiger from the Hugo Lions Club talked about annual Ribfest the Club held in September. Donation were collected for the Washington County Dive Team. Jason spoke briefly about the families affected. Jason said Ribfest was a success in spite of the bad weather. He thanked the Council for their ongoing support of the Lions Club. The Lions presented a check in the amount of $5,050 to the Dive Team. Mayor Weidt said the Council appreciates what the Lions do and the events they sponsor. He said he looks forward to a continued partnership. Washington County Sheriff Dan Starry thanked the Lions for holding the event. Starry said the Dive Team plays a crucial role that serves the function of bringing closure to families as quickly as possible. The dive team is not highlighted enough and Starry talked about Jim Anderson, a Dive Team member who had been there since 1996. Jim had worked at the 35W bridge collapse and had volunteer over 2,000 hours to the County. Starry said he was grateful to the Lions Club because the money will go to good use for equipment for the Dive Team, and he thanked the Council for their support. The Mayor called for a short break. Approve Annual Performance Review for Public Works Worker Kraig Pettee Kraig Pettee was hired as a Public Works Worker starting November 12, 2018. Kraig had worked the three previous summers as a seasonal worker. Adoption of the Consent Agenda approved the annual performance review of Public Works Worker Kraig Pettee. Approve Snowmobile Trail Applications for Hugo Snowmobile Club and Rice Creek Trail Association The Hugo Snowmobile Club and the Rice Creek Trail Association had submitted their respective Snowmobile Trail Applications for the 2022-2023 snow season. Adoption of the Consent Agenda approved the Snowmobile Trail Applications for the Hugo Snowmobile Club and the Rice Creek Trail Association. Approve Renewal of Auto Dismantling License for Hugo Auto and Truck Parts The City of Hugo received an application for the bi-annual Auto Dismantling License for Mike Brandt, dba Auto and Truck Parts. As a requirement of the license, City staff conducts annual Hugo City Council Meeting Minutes for November 7, 2022 Page 3 of 5 inspection of the auto dismantling company for compliance with city, county, and state code. On October 31, 2022. Hugo City staff completed the inspection and found it to be in compliance with City Code as well as County regulations. Adoption of the Consent Agenda approved the biannual Auto Dismantling License for Hugo Auto & Truck Parts. Approve Resolution Approving Variance for Accessory Building at 12776 Goodview Ave. N. - Wolfe Susan E. Wolfe, 12776 Goodview Avenue North, had requested a variance to construct a 1,500 square foot accessory building for the storage of vehicles. The requested variance is to allow for the accessory building to be placed in front of the principal building relative to the street. The Board of Zoning held a public hearing on October 27, 2022, and unanimously recommended approval. Adoption of the Consent Agenda approved RESOLUTION 2022-70 APPROVING A VARIANCE FROM THE ACCESSORY BUILDING PLACEMENT REQUIREMENT FOR PROPERTY LOCATED AT 12776 GOODVIEW AVENUE NORTH. Approve Pay Request No. 2 to for the 2022 Oneka Parkway Improvement Project North Valley, Inc. had submitted Pay Request No. 2 in the amount of $1,005,382.63 for work certified through October 21, 2022, on the Oneka Parkway Project. Substantial completion had occurred on all phases of the project. Punch-list items and signal work at Frenchman Road/Oneka Parkway remained. Adoption of the Consent Agenda approved payment to North Valley, Inc. in the amount of $1,005,382.63. Approve Pay Request No. 7 for the 2021 Downtown Improvement/Lions Park Project Peterson Companies, Inc. had submitted Pay Request No.7 in the amount of $351,149.10 for work certified through October 31, 2022, on the 2021 Downtown Improvement/Lions Park Project. Substantial work had been completed on the project. The contractor needed to install the playground fence to make the project complete and finish punch-list items. This pay request was inclusive of all project change orders for the duration of the project for both the downtown street improvements and Lions Park projects. Adoption of the Consent Agenda approved payment to Peterson Companies, Inc. in the amount of $351,149.10. Approve Release of the Letter of Credit for DR Horton for Clearwater Cove 4th Addition DR Horton, developer, had requested the City release their letter of credit for the Clearwater Cove 4th Addition Development. City staff had inspected the work and the warranty period had expired. Adoption of the Consent Agenda approved the release of the letter of credit being held for the constructed improvements in the Clearwater Cove 4th Addition Development. Approve Rezoning Ordinance and Resolutions Approving Comprehensive Plan Amendment, Site Plan, Conditional Use Permits, Variance, and Minor Subdivision for Hugo Estates The TPP, LLC, c/o Summit Management, LLC, had requested approval of a comprehensive plan amendment, rezoning, site plan, and conditional use permits for a three story approximately 60,000 square foot apartment building and expansion of the manufactured home community with 16 Hugo City Council Meeting Minutes for November 7, 2022 Page 4 of 5 additional homes for the property. The applicant had also requested a variance to allow the apartment building to be 39 feet in height, where 35 feet is allowed by the ordinance, in addition to approval of a subdivision of the property to have the apartments on a separate parcel. The common driveways and facilities would have a shared access and use agreement for all of the parcels. The property is 7 acres with no wetlands on site. The overall density of the project would be ten units per acre, meeting the proposed zoning district regulations. At its October 27, 2022, meeting the Planning Commission held a public hearing and considered the request. The applicant and two residents spoke during the public hearing. There were some questions about drainage, tree preservation and trespassing. The Planning Commission agreed that the proposed project was a good use of the property and fit in with the surrounding area. The Planning Commission unanimously recommended approval of the applications to the City Council, subject to all conditions listed in the resolutions. Adoption of the Consent Agenda approved ORDINANCE 2022 – 517 AMENDING CHAPTER 90 (ZONING ORDINANCE) OF THE CITY CODE TO CLASSIFY CERTAIN LANDS LOCATED EAST OF HIGHWAY 61 AND SOUTH OF 152ND STREET NORTH, and RESOLUTION 2022-71 APPROVING A COMPRHENSIVE PLAN AMENDMENT CHANGING MAP 3-1, 2040 LAND USE PLAN, and RESOLUTION 2022-72 APPROVING FINDINGS OF FACT FOR REZONING TPP. LLC c/o SUMMIT MANAGEMENT, LLC FOR PROPERTY LOCATED SOUTH OF 152ND STREET AND EAST OF HIGHWAY 61, and RESOLUTION 2022-73 APPROVING A SITE PLAN AND CONDITIONAL USE PERMITS FOR TPP, LLC, C/O SUMMIT MANAGEMENT, LLC, FOR AN APARTMENT BUILDING AND EXPANSION OF THE HUGO ESTATES MANUFACTURED HOME COMMUNITY ON THE PROPERTY LOCATED EAST OF HIGHWAY 61 AND SOUTH OF 152ND STREET NORTH, and RESOLUTION 2022-74 APPROVING A VARIANCE FOR TPP, LLC, C/O SUMMIT MANAGEMENT, LLC, FOR AN APARTMENT BUILDING ON THE PROPERTY LOCATED EAST OF HIGHWAY 61 AND SOUTH OF 152ND STREET NORTH, and RESOLUTION 2022-75 APPROVING A MINOR SUBDIVISION FOR TPP, LLC, C/O SUMMIT MANAGEMENT, LLC, ON THE PROPERTY LOCATED EAST OF HIGHWAY 61 AND SOUTH OF 152ND STREET NORTH. Approve Purchase Agreement for 15230 Greene Ave. N. (Bruce Bernin Trust) At their meeting of October 19, 2022, the Parks Commission discussed the purchase of a .46-acre property located at 15320 Greene Avenue North. The property was currently owned by the Bruce A Bernin Trust and was recently listed for sale. It is located immediately south of the City-owned future park property on Greene Avenue that was previously purchased approximately 20 years ago and leased back to the Bernins. The .46-acre residential lot would allow for flexibility in locating the park entrance, ease of utility connections, and a better buffer between the park and the residential neighborhood. The Parks Commission recommend purchase of property through the Special Park Fund. It was discussed that if it was not possible to incorporate the property into the master plan of the future park, the residential lot could be sold in the future. Staff worked on an offer and presented it to the seller, which was accepted. Staff had signed the purchase agreement contingent on City Council approval. Adoption of the Consent Agenda approved the purchase agreement for the property located at 15320 Greene Avenue North with a purchase price of $145,000. Hugo City Council Meeting Minutes for November 7, 2022 Page 5 of 5 Approve Quote from Arnt Construction for Demolition of Buildings at 6540 Greene Ave. N. (Bernin Property) Staff had received quotes from four contractors for the demolition of the buildings located at 6540 Greene Avenue North. Adoption of the Consent Agenda approved a contract in the amount of $62,500.00 with Arnt Construction for the demolition work at 6540 Green Avenue North.. Approve Purchase of New Brush Truck for the Hugo Fire Department Included in the City’s 2023 budget was funding for the purchase of a new brush truck for the Fire Department. This would replace a 1997 Jeep Wrangler. Due to the current market conditions and shortage of parts worldwide, the department had been advised by Midway Ford that this vehicle could take 6 to 8 months or even longer to receive after order. Therefore, Fire Chief Jim Compton had requested approval now in order to ensure it could be received in a timely manner in 2023. The cost of this vehicle was as expected, and staff had budgeted in the capital improvement plan appropriately for the replacement. Adoption of the Consent Agenda approved the ordering of a 2023 Ford F350 Super Duty from Midway Ford Commercial Fleet and Government Sales. Reminder - General Election on Tuesday, November 8, 2022 City Administrator Bryan Bear reminded Council the General Election would be held on Tuesday, November 8, 2022. Polls would be open from 7 a.m. to 8 p.m. Information on voting could be found on the MN Secretary of State website, the City of Hugo website, or by calling City Hall. Reminder and Schedule Time for Commissioner Interviews on Monday, November 14, 2022 City Administrator Bryan Bear reminded Council commissioner interviews were scheduled for Monday, November 14, 2022. There were ten applicants. Staff had prepared a schedule for Council with a starting time of 5 p.m. Reminder and Schedule Tim – Board of Canvassing on Tuesday, November 15, 2022 City Administrator Bryan Bear reminded Council the Board of Canvas was scheduled to meet on Tuesday, November 15, 2023, at 5 p.m. in the Council Chambers for the purpose of certifying the 2022 election results.
