APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW
CONSTRUCTION OF A FENCE AND LANDSCAPING WITHIN A DRAINAGE
AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT 4599
EMPRESS WAY NORTH
WHEREAS, an application has been filed by Ashley Carlson and Daniel Barton that
requests approval of an encroachment agreement to allow construction of a fence and
landscaping within a drainage and utility easement on the property located at 4599 Empress
Way North, legally described as follows;
Lot 26, Block 4, Heritage Ponds,Washington County, Minnesota
WHEREAS, the City Council has fully considered the request for the encroachment
agreement.
NOW,THEREFORE,BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO,MINNESOTA,that it should and hereby does approve the encroachment
agreement on property located at 4599 Empress Way North.
ADOPTED by the City Council this 21st day of August, 2023.
