APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW
CONSTRUCTION OF A WINDOW WELL AND FENCE WITHIN A DRAINAGE
AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT 14320
GRANTAIRE LANE NORTH
WHEREAS, an application has been filed by Nick Heinle, Prairie Homes, LLC, that
requests approval of an encroachment agreement to allow construction of a window well
and fence within a drainage and utility easement on the property located at 14320 Grantaire
Lane North, legally described as follows;
Lot 10, Block 3, Victor Gardens East, Washington County, Minnesota.
WHEREAS, the City Council approved a variance request at its September 5`t`, 2023
meeting to allow a window well to encroach an additional 1 foot, 8 inches into the allowed
side yard setback.
WHEREAS, the City Council has fully considered the request for the encroachment
agreement.
NOW,THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO,MINNESOTA,that it should and hereby does approve the encroachment
agreement on property located at 14320 Grantaire Lane North.
ADOPTED by the City Council this 18t'day of September, 2023.
