G.2 Approve Hiring of Jim Compton, Jr. as New Fulltime Fire Chief
The City received 13 applications for the fulltime Fire Chief position and held interviews on
October 4 and October 9. The interview team included City Administrator Bryan Bear, Public
Works Director Scott Anderson, Finance Director Anna Wobse, Community Development
Director Rachel Juba, Sergeant Joe Zerwas, Mayor Tom Weidt, and Council Member Mike
Miron. After careful consideration, the interview team is recommending Council approve the
hiring of Jim Compton, Jr. as the new fulltime Fire Chief effective November 20, 2023.
G.3 Approve Donation to the Hugo Fire Department from the Oneka Ridge Golf Course
The Oneka Golf Course would like to donate $1,400 to the Hugo Fire Department for AEDs. All
donations to the Fire Department need to be approved by Council. Staff recommends Council
approve the $1,400 donation from the Oneka Ridge Golf Course.
G.4 Approve Resolution Approving Encroachment Agreement for 5841 130th Lane North –
Johnstone
Richard and Pamela Johnstone have requested an encroachment agreement to construct a fence
within a drainage and utility easement on property located at 5841 130th Lane North. The Senior
Engineering Technician has reviewed the location of the fence and is comfortable with the
request. Staff is recommending approval of the resolution approving an encroachment agreement
for 5841 130th Lane North.
G.5 Approve Resolution Approving Encroachment Agreement for Adelaide Landing
Master Association
The Adelaide Landing Master Association has requested an encroachment agreement to allow
construction of a fence within a drainage and utility easement on several properties located in the
Adelaide Landing 6th Addition Development. The proposed location for the fence includes the
east property line of seven residential lots, the right-of-way of 132nd Street North, and a portion
of the platted Outlot A. The Senior Engineering Technician has reviewed the location of the
fence and is comfortable with the request. Staff is recommending approval of the resolution
approving an encroachment agreement for Adelaide Landing Master Association.
G.6 Approve Extension of Comprehensive Plan Amendment, Site Plan, Conditional Use
Permits, Variance, and Minor Subdivision for Hugo Estates
At its November 7, 2022, meeting, Council approved a Comprehensive Plan Amendment, Site
Plan, Conditional Use Permits, Variance, and Minor Subdivision for Hugo East / Arbor
Meadows development for apartments and manufactured homes to be located north of the Hugo
Estates Trailer Park at 15057 Forest Boulevard. TPP, LLC c/o Summit Management, LLC is
requesting a two-year extension on the approvals while they continue to work on construction
plans. While it still may happen, they are requesting a two-year extension on approved plans
with a new deadline of November 7, 2025. Staff recommends Council approve a two-year
extension for Hugo East/Arbor Estates Development.
H.1 Public Hearing on the Birch Tree Ponds Area Street Project Assessments
On March 6, 2023, City Council awarded the contract for the 2023 Birch Tree Ponds Area Street
Improvements to Northwest Asphalt, Inc. At the September 14, 2023, meeting, Council adopted
a resolution declaring costs to be assessed for the 2023 Birch Tree Ponds Area Street
Improvements and scheduled the assessment hearing on the proposed assessments for October
16, 2023. The Notice of Assessment Hearing has been published in the official newspaper and
mailed to the owners of each parcel described in the assessment roll at least two weeks prior to
the hearing. As part of the assessment hearing, staff will give a PowerPoint presentation
identifying the improvements, costs, and detail payment options. Staff recommends the Mayor
open the public hearing to take all comments and approve the resolution adopting assessments
for the 2023 Birch Tree Ponds Area Street Improvements.
J.1 Approve Resolutions Approving Feasibility Study and Set Public Hearing for the 125th
and Dellwood Ridge Development Street Improvement Project
The 2024 125th Street and Dellwood Ridge Neighborhood Street Improvement Project consists
of roadway reclamation and paving of 125th Street, and complete roadway reconstruction and
storm improvements in the Dellwood Ridge Neighborhood area. The roadway reclamation and
paving will include 125th Street North from Goodview Avenue North to 122nd Street North
(CSAH 7). Work on Upper Heather Avenue North from 125th Avenue North to Heather Avenue
North and Heather Avenue North from 125th Avenue North to 120th Street North (CSAH 7) will
involve complete reconstruction and storm improvements. The total estimated cost for the
project is approximately $3,931,412 which incorporates 2023 construction costs and includes a
10% construction contingency and indirect costs in the amount of 30% of the estimated
construction costs. Funding for the project will be provided through assessments to benefiting
properties, County funds and City Street Funds. Staff recommends Council approve the
resolution accepting the feasibility report and setting the public hearing for November 20, 2023.
M.1 Reminder - White Bear Lake Hearing on Tuesday, October 17, 2023
The Council has scheduled a meeting to attend the evidentiary hearing in the matter the White
Bear Lake Lawsuit (OAH Master Docket No. 8-2022-37733) beginning on Tuesday, October 17,
2023, in Room 2040 (on the Mezzanine Level of the Stassen Building) at the Saint Paul offices
of the Office of Administrative Hearings. The hearing shall begin at 9:30 a.m.

Hugo Beyond the Yellow Ribbon Network President Chuck Haas
President Chuck Haas was in attendance to provide the Council an update on the Hugo Yellow
Ribbon Network activities. He began by saying the leadership of the YRN begins with Council’s
support and he referred to the certificates of appreciation that were mounted on the back wall of
the Council Chambers saying they were emblematic of the that support. Over the past three
months, the YRN participated in 17 different events including pheasant hunts, care packaging
events, Unit Family Days, burger nights, Veteran’s Rodeo, Shoot for the Troops, Lions golf
event, and provided financial aid to a number of military families. Over the past there months,
they had served over 2,000 service members and put in over 500 hours of volunteer time. The
YRN was recognized at the state level when a certificate of appreciation was presented to them
at the State Fair this year. Haas shared pictures of past events. Future events include the Secret
Santa Program, Washington County Shop with a Cop, University of MN concession stand at the
MN Gopher Games, and Bingo and meat raffles at the Hugo American Legion and Sal’s Angus
Grill.

Approve Annual Performance Review for Accounting Clerk Amber Lozier
Amber Lozier was hired as the Finance and Public Works Administrative Assistant on October
8, 2018. On November 15, 2022, Amber was promoted to Accounting Clerk. Adoption of the
Consent Agenda approved the Annual Performance Review for Accounting Clerk Amber Lozier.
Approve Annual Performance Review for Finance Director Anna Wobse
Anna Wobse was hired as the City’s Accounting Clerk on October 27, 2008, and worked in
accounts payable and payroll functions. In March 2018, Council approved Anna as the new
Finance Coordinator and in October, 2021, as the new Finance Director. Adoption of the
Consent Agenda approved the annual performance review for Finance Director Anna Wobse.

Approve Donation to the Hugo Fire Department from the Hugo American Legion
The Hugo Lions Club wanted to donate $1,000 to the Hugo Fire Department for equipment and
training. Donations to the Fire Department needed to be approved by the City Council. Adoption of
the Consent Agenda approved the donation of $1000 from the Hugo American Legion to the Hugo
Fire Department.
Approve Recommendation from the EDA to Sponsor Kidz ‘n Biz Festival
At its September 19, 2023, meeting, the EDA voted unanimously to recommend Council approve
the sponsorship of the Kidz ‘n Biz Festival in the amount of $1,000 as requested by the Hugo
Area Business Association. Adoption of the Consent Agenda approved the sponsorship of Kidz
‘n Biz for $1,000.
Approve Pay Request No. 2 from Arnt Construction for 159th St/TH61 Improvements
Arnt Construction Company had submitted Pay Request No. 2 in the amount of $644,308.83 for
work certified through September 27, 2023, on the TH61/159th Street Roundabout Improvement
Project. Underground utility work was completed and concrete curbs were currently being
installed in the main portion of the roundabout. Adoption of the Consent Agenda approved
payment to Arnt Construction Company in the amount of $644,308.83.
Approve Hiring of Jim Roettger as a Temporary Seasonal Public Works Worker
City Administrator Bryan Bear added this to Consent Agenda to get approval to hire Jim
Roettger as a Temporary Seasonal Public Works Worker. Jim has been a volunteer firefighter
with the Hugo Fire Department since 2009. Adoption of the Consent approved the hiring of Jim
Roettger.
Recap of Neighborhood Meeting on 125th St. and Dellwood Ridge Street Project
A neighborhood meeting was held on Wednesday, September 27, 2023, to present information
and get feedback on a proposed 2024 street improvement project that included 125th Street (from
Goodview Avenue to County Road 7), and Heather Avenue North and Upper Heather Avenue
North in the Dellwood Ridge Development. City Engineer Mark Erichson provided an update
saying there was a decent turnout. Individual meetings had been set with several property
owners. Prior to the neighborhood meeting, Mark said he received a number of calls, and all had
positive comments regarding the project. At the October 16, 2023, Council meeting, staff will be
requesting approval to accept the feasibility study and set public hearing for November 20, 2023.
Reminder – Hugo Citywide Bus Tour on Saturday, October 7, 2023
City Administrator Bryan Bear reminded Council the Hugo Citywide Bus Tour was scheduled for
Saturday, October 7, 2023, beginning and ending at the Public Works Facility. Bus will begin
loading at 9:45 a.m. for a 10 a.m. departure and return at approximately noon for a barbeque lunch.

City Administrator Bryan Bear reminded Council a meeting was scheduled to attend the Fire
Department Open House on Saturday, October 7, 2023, from 11 a.m. – 3 p.m.
Santa Party on Wednesday, December 6, 2023
City Administrator Bryan Bear informed Council the third annual Santa Party will be held on
Wednesday, December 6, 2023, from 5-7 p.m. at the Peder Pedersen Pavilion.
Miron made motion, Petryk seconded, to schedule a meeting to attend the Santa Party on
Wednesday, December 6, 2023.

Schedule Holiday Party for Thursday, December 7, 2023
Annually, Council holds a holiday party in appreciation for staff and commissioners. Staff
recommends Council schedule the holiday party for Thursday, December 7, 2023, at the Peder
Pedersen Pavilion.
Petryk made motion, Strub seconded, to schedule the Holiday Party for Thursday, December 7,
2023.

Adjourn to Executive Session - White Bear Lake Homeowners Association Lawsuit
Pursuant to Minn. Stat. 13D.05 Subd. 3(b) the Council may adjourn to executive session to
discuss upcoming hearings related to the lawsuits filed by the White Bear Lake Homeowners
Association and their demanded domestic water restrictions. City Attorney David Snyder and
City Administrator Bryan Bear recommended Council move to Executive Session in order to
provide them an update on the restrictions to various municipal water permits (OAH Master
Docket No. 8-2002-37733).
Weidt made motion, Klein seconded to adjourn into Executive Session at 7:26 p.m.

Return to Regular Session
Strub made motion, Miron seconded, to enter back into regular session at 8:27 p.m.
City Attorney explained the Council had just met in Executive Session pursuant to Minn. Stat.
13D.05 Subd. 3(b) regarding attorney client privilege to discuss litigation in connection with the
White Bear Lake Homeowners’ lawsuits as the matters are set for legislative hearings. The trial
is set for October 17, 2023, that concerns the demands of the White Bear Lake Homeowners

Association and the White Bear Lake Restoration Association to impose severe restrictions on
domestic water supply for cities in the east metro. Restrictions include a watering ban should
White Bear Lake level drop below 923.5 feet. It was also demanded that City adopt a gallons per
day water consumption limitation of 75/90 gallons for residential and commercial water use per
day. Snyder explained, in the Executive Session, he had updated the Council and advised them
the trial is set for October 17, and invited Council and anyone interested to attend electronically
or in person. Present in the executive session were the City Clerk, entire Council, City
Administrator, and the City Attorney.
Weidt appreciate the update saying the City of Hugo and Council over the last ten years has
taken it very seriously to use the City’s water judiciously to help reduce the water that is taken
out of the aquifer for irrigation. Many new developments use stormwater to irrigate, and settling
with the conditions in this lawsuit would take the City backwards. The ban of residential
irrigation would make it impossible to use the City’s stormwater systems where the City has
saved over 100 million gallons of water a year from being pulled out of the aquifer. He
supported moving forward with this quest to have sensible rules to make an effect on
maintaining the recreational uses that are so important to the homeowners around White Bear
Lake while protecting the water uses of all other residents. Encourage Council and City Attorney
to continue to move forward on this path.
Petryk thanked Dave Snyder and Bryan Bear for their hard work saying they have become
leaders and probably have the most expertise in this area. She said there would be severe
repercussions by agreeing to settlements that some cities have. Hugo’s wells have little or no
impact on the lake and for Hugo to be included it this type of legal action is unacceptable.
Petryk made, Klein seconded, to schedule the trial date of October 17, 2023, as a meeting for the
Council to attend.

Klein said the City has been recognized in water conversation efforts both state and federally,
and have done everything to be proactive in water conservation. He said the community has
been extremely supportive. The City should not be punished for the things it has done and needs
to be proactive on this to keep our water conservation efforts in place

SUMMARY FOR REVIEW
At the September 2, 2023, meeting the City Council met in Executive Session pursuant to
Minn. Stat. 13D.05 Subd. 3(b) regarding attorney-client privilege to discuss upcoming
hearings relating to the lawsuits filed by the White Bear Lake Homeowners Association and
their demanded domestic water restrictions including a demand for a residential watering ban.
After entering back into regular session, Council scheduled a meeting to attend the hearings
on October 17, 2023.

The Hugo City Council attended the Citywide Bus Tour held on Saturday, October 7, 2023.
There were approximately 30 people that met at the new Public Works Facility for a short tour
before boarding the bus. The tour ended back at Public Works where a BBQ lunch was served.

1. DESCRIPTION OF REQUEST:
The applicant has requested an encroachment agreement to allow construction of a fence within a
drainage and utility easement on property located at 5841 130th Lane North. The Senior
Engineering Technician has reviewed the location of the fence and is comfortable with the
request.
2. CONCLUSION/RECOMMENDATION:
Staff has reviewed the request and recommends that the City Council approve the resolution
approving an encroachment agreement for the properties located at 5841 130th Lane North.

APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW
CONSTRUCTION OF A FENCE WITHIN A DRAINAGE AND UTILITY
EASEMENT ON THE PROPERTY LOCATED AT 5841 130TH LANE NORTH
WHEREAS, an application has been filed by Richard and Pamela Johnstone that requests
approval of an encroachment agreement to allow construction of a fence within a drainage
and utility easement on the property located at 5841 130th Lane North, legally described as
follows;
Lot 9, Block 7, Adelaide Landing, Washington County, Minnesota.
WHEREAS, the City Council has fully considered the request for the encroachment
agreement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO, MINNESOTA, that it should and hereby does approve the encroachment
agreement on property located at 5841 130th Lane North.

ENCROACHMENT AGREEMENT
THIS AGREEMENT is made this 16th of October, 2023 by and between the CITY OF
HUGO, a Minnesota municipality (hereinafter “City”) and, Richard Johnstone and Pamela
Johnstone, a married couple, (hereinafter “Owners”), and their successors in title.
WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”)
along the westerly, northerly, and easterly portion of the Owner’s property, which is legally
described as:
Lot 9, Block 7, Adelaide Landing, Washington County, Minnesota; and,
WHEREAS, Owner is desirous of constructing a fence partially within the easement area;
and,
WHERAS, the City will permit the placement of a fence in the area described herein subject
to the terms and conditions hereof.
NOW, THEREFORE, in consideration of the premises and for good and valuable
consideration, the receipt of which is acknowledged, the City will permit the encroachment on its
easement as set forth herein and subject to the conditions set forth below:
1. Owner and their successors in title may install and maintain a fence within the
Easement, and the fence shall be constructed in accordance with the plans on file with the City of
Hugo.
2. No plantings, trees, permanent improvements or structures other than the fence may
be maintained or placed in the easement area.
3. Owner shall maintain the fence in good repair and shall not permit it to be expanded,
lengthened or to impair the City’s easement or its rights thereunder in any respect.
4. The encroachment granted to Owner herein is subject to the existing easement rights
of the City as granted in various easements.
5. The City will notify Owner if it requires removal or relocation of the fence or any part
of it. Thereafter, Owner shall remove the fence according to the direction of the City and if Owner
fails to do so, the City may enter upon the land and remove as much of the fence as required and cast
it upon the adjoining lands. In such an event, the City shall not be liable to Owner for any costs, loss
or damage whatsoever, and may assess the property for all of its costs incurred in removing the
fence, and Owner waive all formalities, requirements and defenses arising from or relating to
Minnesota Statutes Section 429 relating to or arising from the work done by the City.
6. To the fullest extent permitted by law, Owner agrees to release, defend, protect,
indemnify, save and hold harmless the City, its agents, directors, employees, shareholders and
contractors against any and all claims, costs and liabilities, including the costs of defense for
damages, injury or death arising from or in any way connected to the installation, maintenance,
repair, removal and/or presence of the fence, regardless of whether such harm is to Owner, the City,
the employees or officers, guests or invitees of either or any other person or entity, except Owner
shall not be liable under this paragraph for loss or damage to the extent resulting from the negligen ce
of the indemnified parties.
7. The permission granted herein is limited exclusively to the proposed fence within the
specified portion of the easement area of the City’s Easement. Owner shall not alter the grade or
permit such alteration anywhere upon the land upon which the City has reserved its easement rights
without proper express written consent of the City.
8. Owner shall, at all times, use their best efforts to conduct all of their activities on said
Easement in such a manner as to not interfere with or impede the operation of the City’s Easement
and related activities in any manner whatsoever, and shall follow the direction of the City.
9. This Agreement shall run with the land and inure to the benefit and be binding upon
the parties hereto, their heirs, successors and assigns.
10. Owner shall be responsible for the costs of recording this Agreement with the
Washington County Recorder.

drainage and utility easement on several properties located in the Adelaide Landing 6th Addition
Development. The fence will be owned and maintained by the Adelaide Landing Master
Association. The proposed location for the fence includes the east property line of seven
residential lots, the right-of-way of 132nd Street North, and the platted Outlot A. The portion of
the fence within the 132nd Street North right-of-way will be relocated at the time of the street’s
extension to the east, as included in the encroachment agreement. The Senior Engineering
Technician has reviewed the location of the fence and is comfortable with the request.
2. CONCLUSION/RECOMMENDATION:
Staff has reviewed the request and recommends that the City Council approve the resolution
approving an encroachment agreement for the properties located in Adelaide Landing 6th

On March 6, 2023, City Council awarded the contract for the 2023 Birch Tree Ponds Area Street
Improvements to Northwest Asphalt, Inc. Proposed improvements for the 2023 Birch Tree Ponds
Area Street Improvements project include street improvements and drainage improvements along
the following roadways:
Bituminous mill and overlay on Fountain Avenue South of Egg Lake Road
Partial Street Reconstruction on Foxhill Avenue North, 138th Street North, Geneva
Avenue North, 135th Street North, 135th Court North, Freeland Avenue North, Freeland
Court North, and Fountain Avenue North of Egg Lake Road
At the September 14, 2023 regular Council meeting, the Council adopted a resolution declaring
costs to be assessed for the 2023 Birch Tree Ponds Area Street Improvements and scheduled
the assessment hearing on the proposed assessments for October 16, 2023. The Notice of
Assessment Hearing has been published in the official newspaper and mailed to the owners of
each parcel described in the assessment roll at least two weeks prior to the hearing. As part of
the assessment hearing, staff will give a PowerPoint presentation identifying the improvements,
costs and detail payment options. Staff recommends the Mayor open the public hearing to take
all comments and approve the resolution adopting assessments for the 2023 Birch Tree Ponds
Area Street Improvements.
Staff has prepared a resolution adopting the assessments for the 2023 Birch Tree Ponds Area
Street Improvements for your consideration in accordance with the requirement of state statutes
Chapter 429 for assessments to benefitting properties. A copy of the assessment roll is attached
for your reference.

RESOLUTION ADOPTING ASSESSMENTS FOR THE
2023 BIRCH TREE PONDS AREA STREET IMPROVEMENT PROJECT
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and
heard and passed upon all objections to the proposed assessment against abutting property
generally located along Fountain Avenue South of Egg Lake Road to cul-de-sac (mill &
overlay), Fountain Avenue North from Egg Lake road to cul-de-sac, Foxhill Avenue North from
Egg Lake Road to the cul-de-sac, 138th Street North from Foxhill Avenue North to Geneva
Avenue North, Geneva Avenue North from Egg Lake Road to its terminating point at 138th
Street North, 135th Street North from Geneva Avenue North to a point terminating 200 feet west
of 135th Court North, 135th Court North from 135th Street North to cul-de-sac, Freeland Avenue
North from 138th Street North to 135th Street North, Freeland Court North from Freeland Avenue
North to cul-de-sac.
The improvements include reconstruction of the existing roadways, spot replacement of new
concrete curb and gutter, storm sewer and drainage improvements, and repaving of the roadway.
NOW, THEREFORE, IT BE RESOLVED, by the City Council of the City of Hugo,
Minnesota, as follows:
1. Such assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein, and
each tract of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of
10 years, the first of the installments to be payable on or before the first Monday in
January 2024, and shall bear interest at the rate of 5.25% per annum from the date of the
adoption of this assessment resolution. To the first installment shall be added interest on
the entire assessment from the date of this resolution until December 31, 2023. To each
subsequent installment when due shall be added interest for one year on all unpaid
installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property, with
interest accrued to the date of payment, to the city finance director, except that no interest
shall be charged if the entire assessment is paid within 30 days from the adoption of this
resolution; and he may, at any time thereafter, pay to the city finance director the entire

The 2024 125th Street and Dellwood Ridge Neighborhood Street Improvement Project
consists of roadway reclamation and paving of 125th Street, and complete roadway
reconstruction and storm improvements in the Dellwood Ridge Neighborhood area.
The roadway reclamation and paving will include 125th Street North from Goodview
Avenue North to 122nd Street North (CSAH 7). Work on Upper Heather Avenue North from
125th Avenue North to Heather Avenue North and Heather Avenue North from 125th
Avenue North to 120th Street North (CSAH 7) will involve complete reconstruction and
storm improvements.
The total estimated project cost for the 2024 125th Street and Dellwood Ridge
Neighborhood Street Improvement Project is approximately $3,931,412 which
incorporates 2023 construction costs and includes a 10% construction contingency and
indirect costs in the amount of 30% of the estimated construction costs. Enclosed is a
copy of the feasibility report.

1. Executive Summary
The proposed improvements for the 2024 125th Street and Dellwood Ridge Neighborhood Street
Improvement Project consist of roadway reclamation and overlay, complete roadway reconstruction, and
storm sewer improvements in Hugo, MN.
Roadway reclamation and overlay improvements are proposed along 125th Street North from Goodview
Avenue North to 122nd Street North and complete roadway reconstruction and storm improvements
proposed along Upper Heather Avenue North and Heather Avenue North.
A map of the proposed street improvements is located on Figure 1 in Appendix A. Most of the project is
zoned Rural Residential (RR) including both Heather Avenue, Upper Heather Avenue, properties north of
125th Ave, and properties west of Upper Heather Ave. The remaining portion of the project area including
the portion south and east of Heather Ave is zoned as Planned Unit Development (PUD).
The total estimated project costs for the 2024 125th Street and Dellwood Ridge Neighborhood Street
Improvement Project is $3,931,500. The project costs include a 10% contingency and 30% indirect costs.
Funding for the project will consist of City Street Capital Improvement Plan (CIP) Funds and Special
Assessments to benefitting properties. A detailed Opinion of Probable Cost can be found in Appendix B
for improvements along 125th Street North, and in Appendix C for improvements along Upper Heather
Avenue North and Lower Heather Avenue North.
The project schedule proposed includes construction beginning spring 2024, with substantial completion
by fall 2024.
The project is feasible, necessary, and cost effective from an engineering standpoint and should be
constructed as proposed herein.

2. Introduction
2.1 Authorization
On July 10, 2023, the Hugo City Council authorized the preparation of a feasibility report for the
2024 125th Street and Dellwood Ridge Neighborhood Street Improvement Project.
2.2 Scope
This feasibility report includes street improvements and limited drainage improvements along the
following existing roads:
125th Street North
Heather Avenue North
Upper Heather Avenue North
These improvements will incorporate roadway reclamation and overlay, complete roadway reconstruction,
and storm sewer improvements within the roadway reconstruction area.
2.3 Data Available
Information and materials used in the preparation of this report include the following:

2.4 Project History
The 2024 125th Street and Dellwood Ridge Neighborhood Street Improvement Project is identified in the
City’s Capital Improvement Plan (CIP) to address the deteriorating condition of the roadway. The CIP
provides a schedule for the various roadway improvements that are necessary to maintain the City streets
in an effective and efficient manner.

3. Existing Conditions
3.1 Surface
The project area is surrounded primarily by residential properties that contain landscaping, trees, and
numerous other private improvements beyond the edge of the roadway and within the City right-of-way.
125th Street exists as 24-foot, asphalt paved, rural residential roadway (meaning no curb and gutter) and
Upper Heather Avenue and Heather Avenue exist as 32-foot-wide, asphalt paved with bituminous curb in
poor condition.
Both roadways are experiencing various severities of distresses including alligator, block, transverse, and
longitudinal cracking, along with localized drainage issues.
3.2 Storm Sewer
Stormwater is collected in existing drainage ditches along both sides of the roadway of 125th Street and
conveyed to ponds adjacent to the roadway. Stormwater is directed to stormwater basins on 125th Street,
where it will continue to flow along the road and into the spillways or catch basins along Upper Heather
and Heather Avenue. Due to deteriorating bituminous curb on Upper Heather Avenue and Heather
Avenue, stormwater runs along and within the roadway. Upper Heather features four catch basins which
lead to flared end sections that discharge water into stormwater basins. Heather Avenue has no catch
basins and all water at intersections is guided into the ditches using concrete spillways.
3.3 Municipal Utilities
3.3.1 Sanitary Sewer
Properties are currently served by individual, onsite septic systems.
3.3.2 Watermain
Properties are currently served by individual, on site wells.

4. Proposed Improvements
4.1 Surface
Improvements proposed are intended to improve the design strength of the pavement system and provide
a street surface with an extended life. Improvements along 125th Street North from Goodview Avenue
North to 122nd Street North consist of a bituminous pavement reclamation matching the existing
pavement width. Reclamation is the process by which the existing deteriorating roadway surface is
reused as aggregate roadway base for the new street section.
Reconstruction of Upper Heather Avenue and Heather Avenue is intended to improve the design strength
of the pavement system and provide a street surface with an extended life for the City of Wyoming.
Reconstruction of the roadways will include removal of the existing asphalt surface, removal and
replacement of the existing aggregate section, new asphalt pavement, and installation of concrete curb
and gutter. In addition, the roadway will be narrowed from the existing 32-foot-wide roadway to a 28-foot-
wide roadway (as measured from face of curb to face of curb).
Street grades are proposed to very closely match the existing grades to minimize construction impacts to
adjacent properties. Minor adjustments to some of the existing roadway vertical profiles will be proposed
to improve pavement drainage conditions where feasible.
Roads cores will be taken as a part of final design to determine the existing class 5 and pavement
thickness. This will determine the necessary reclamation depth and if there is need for additional
subgrade preparation.
The typical sections for both existing and proposed street improvements are included in Appendix A.
4.2 Storm Sewer
The proposed project will maintain the existing drainage patterns and discharge points to the greatest
extent possible. Deficient culverts will be replaced with reinforced concrete pipe (RCP) as necessary to
convey storm water runoff.
The existing storm sewer system along Upper Heather Avenue and Heather Avenue will be improved by
the addition of catch basins along the roadway to better accommodate area drainage and the extension
of new storm sewer where facilities do not currently exist.
4.3 Watermain
Water main improvements are not proposed to be included with this improvement project.
4.4 Sanitary Sewer
Sanitary sewer improvements are not proposed to be included with this improvement project.

4.6 Construction Access/Staging
The contractor will be responsible for providing access to all existing properties throughout the project.
The proposed methods of construction are the responsibility of the contractor. Adequately signed detours
will be identified to direct traffic around the construction zone and notify users of the increased truck and
construction activity. Detours will be used only if absolutely necessary to ensure the safety of residents
and construction workers alike.
4.7 Public Involvement
A public meeting was held on Wednesday, September 27, 2023, to provide initial project information to
property owners and residents within the project area. Residents were encouraged to share their
knowledge of the project area, specifically any known areas of concern.
As part of the Chapter 429 process, once the feasibility study is accepted, a public hearing will be
scheduled. Impacted residents will be invited to hear more details about the project and provide public
testimony regarding the proposed project.
Prior to construction, an additional public informational meeting will be held to further inform the property
owners of the proposed improvements, project timeline, assessment policy, and what to expect during
construction.

5. Financing
5.1 Opinion of Probable Cost
A detailed Opinion of Probable Cost can be found in Appendix B for the project to be completed on 125th
Street North, and in Appendix C for the project to be completed on Upper Heather Avenue North and
Heather Avenue North. The opinion of probable cost is based on projected construction costs for 2023
and includes a 10% contingency factor and 30% indirect costs. The indirect costs include engineering,
legal, and administrative costs associated with the project. The project costs are summarized as follows:

5.2 Funding
Funding for the project will be provided through assessments to benefitting properties and City Street and
Utility Funds. The proposed funding is outlined as follows:
5.3 Preliminary Assessment Roll
Assessments will be levied to the benefiting properties as outlined in Minnesota Statute 429 and the
City’s Assessment Policy. A detailed preliminary assessment roll is included in Appendix D. Based on
the City Code Section 30-2, the assessment rate on the respective project types are as follows:
Complete Reconstruction $5200.00/UNIT
Roadway Reclamation/ Overlay $3400.00/UNIT
Corner properties are assessed at one-half unit per adjacent project roadway. So, if only one of the
roadways adjacent to a property is being improved, the total assessment will be only one-half of a unit at
this time. The per unit assessment was determined using the City of Hugo 2023 Fee Schedule for
roadway reconstruction and rehab. Proposed assessments for the project apply to 62.5 total units for the
proposed assessment project total of $258,500.

6. Necessity and Effectiveness
The improvements proposed in this study are necessary, cost-effective, and feasible. The improvements
proposed within the project area provides the City of Hugo with a cost-effective means of continuing the
City’s Street improvement efforts and providing an adequate means of transportation for residents. These
improvements will provide a longer-lasting street section needing less maintenance over the expected
service life. The proposed improvements constitute a project large enough to provide a competitive
bidding environment, economy of scale, and are therefore deemed to be cost-effective. Based on the
information contained within this report, the proposed improvements as described can be considered
necessary, cost-effective, and feasible from an engineering standpoint.

8. Feasibility and Recommendation
The proposed improvements for the 2024 125th Street and Dellwood Ridge Neighborhood Street
Improvement Project consist of roadway reclamation and overlay, complete roadway reconstruction, and
storm sewer improvements
The estimated cost of the street improvement project is $3,931,500.
Based on the information contained within this report, the proposed improvements as described can be
considered necessary, cost-effective, and feasible from an engineering perspective. WSB recommends
construction of the proposed improvements as detailed in this report. The economic feasibility of this
project will be determined by the City Council.

A RESOLUTION RECEIVING THE FEASIBILITY REPORT AND
SETTING THE PUBLIC HEARING FOR THE
2024 125th STREET AND DELWOOD RIDGE NEIGHBORHOOD STREET IMPROVEMENT
PROJECT
WHEREAS, pursuant to resolution of the Council adopted July 10, 2023, a report was prepared by
WSB, with reference to the improvement of 125th Street and the Dellwood Ridge neighborhood. The
Dellwood Ridge neighborhood includes Upper Heather Avenue North and Heather Avenue North.
WHEREAS, the following improvements are proposed:
Complete road reconstruction for Upper Heather Avenue North and Heather Avenue North
Roadway reclamation and overlay on 125th Street North
and to assess benefited properties for all or a portion of the improvement, pursuant to Minnesota
Statutes, Chapter 429; and
WHEREAS, the City Council has been advised by the City Engineer that said street improvements
are feasible, and should best be made as proposed, and the City Engineer’s report to this effect has
heretofore been received by Council, and filed with the City Clerk on October 16, 2023; and
WHEREAS, the City Council deemed it necessary and expedient that the City of Hugo, Minnesota,
construct certain improvements, to-wit: 2024 125th Street and Dellwood Ridge Neighborhood Street
Improvement Project, in the City as described in and in accordance with the feasibility report
prepared by the City Engineer; and
WHEREAS, the statute provided that no such improvements shall be made until the Council has
held a public hearing on such improvements following mailed notice and publication thereof in the
official newspaper stating time and place of the hearing, the general nature of the improvement, the
estimated costs thereof, and the area proposed to be assessed, in accordance with the law; and
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Hugo that the public
hearing be scheduled to consider : 2024 125th Street and Dellwood Ridge Neighborhood Street
Improvement Project, to be held on Friday, November 20, 2023, at 7:00 o’clock p.m. or as soon
thereafter as possible, at Hugo City Hall, 14669 Fitzgerald Avenue North.
This resolution was adopted by the City Council of the City of Hugo on the 16th day of October 2023,
by a vote of Ayes and Nays.
