ADJOURNMENT BACKGROUND MEMO FOR THE CITY COUNCIL MEETING ON MARCH 18, 2024 D.1 Approval of Minutes for the City Council Meeting on March 4, 2024 Staff recommends Council approve the minutes for the City Council meeting held on March 4, 2024, as presented. F.1 Lakes Center for Youth and Family – Community Outreach Coordinator Linda Madsen and Executive Director Jamie Prettner Lakes Center for Youth and Family (LC4YF) is one of two organizations that provide mental health services to Hugo residents, and Council allocates funding in the budget to support these programs. Linda Madsen has presented to Council in the past as the Executive Director of LC4YF. Linda retired from that position and is now the part-time Community Outreach Coordinator. Jamie Prettner is the new Executive Director. Both Linda and Jamie will be in attendance to present the LC4YF annual report. F.2 Washington County Assessors Update - Appraisers Dan Squyres and Tyson Terry Washington County Residential Property Appraiser Tyson Terry will provide Council an update on the County and Hugo property assessments in preparation for the Local Board of Appeals and Adjustments meeting on April 4, 2024. Commercial Appraiser Dan Squyres will also be in attendance. G. 1 Approval of Claims Staff recommends Council approve the Claims Roster as presented. G.2 Approve Special Event Permit for Legion Family Day on April 27, 2024 The Hugo American Legion Auxiliary has applied for a Special Event Permit to hold a festival on Saturday, April 27, 2024. A Special Event Permit approved by Council is necessary because alcohol will be sold outdoors, there may be more than 200 people in attendance throughout the day, and there will be amplified music and event announcements. The event will include a BBQ contest, raffles, and games for children and adults. The event will begin at 6 a.m. for the BBQ teams to set up and will end at 6 p.m. Staff recommends Council approve the Special Event Permit for the Hugo American Legion Family Day on April 27, 2024. G.3 Approve Lawful Gambling Exempt Permit for the Chain of Lakes Rotary Event on May 3, 2024 The Chain of Lakes Rotary has applied for a Lawful Gambling Permit to hold raffles during their event on May 3, 2024, at the Pede Pedersen Pavilion. Lawful Gambling Permits are issued by the State after approval from the City. Staff recommends Council approve the Lawful Gambling Exempt Permit for the Chain of Lakes Rotary. G.4 Approve Temporary Liquor License for the Chain of Lakes Rotary Event on May 3, 2024 The Chain of Lakes Rotary has applied for a Temporary Liquor License to serve alcohol during their event on May 3, 2024, at the Pede Pedersen Pavilion. Temporary Liquor Licenses are issued by the State after approval from the City. Staff recommends Council approve the Temporary Liquor License for the Chain of Lakes Rotary subject to receipt of the Certificate of Liability Insurance for the serving of alcohol. G.5 Approve Resolution Approving Encroachment Agreement for 4702 Fable Hill Parkway North – Teich and Moe Daniel Teich and Molly Moe have requested an encroachment agreement to construct a fence and rock pathway within a drainage and utility easement on property located at 4702 Fable Hill Parkway North. The Senior Engineering Technician has reviewed the location of the fence and rock pathway and is comfortable with the request. Staff is recommending approval of the resolution approving an encroachment agreement for 4702 Fable Hill Parkway North. H.1 Public Hearing on Drainage and Utility Easement Vacation at 12796 Ethan Avenue The applicant, Raj Alexander, is requesting vacation of a portion of drainage and utility easement located over a portion of his property at 12796 Ethan Avenue North. The City maintains drainage and utility easements over wetlands on site. The applicant had a wetland delineation completed in 2023 that revealed upland in an area indicated in a previous delineation to be wetland. The requested vacation is to remove the easement over the upland to allow for the construction of an accessory building. Staff is comfortable with the request to vacate the portion of the drainage easement. Staff Recommends that the City Council approve the notice to vacate the portion of the drainage easement over 12796 Ethan Avenue North. M.1 Reminder Local Board of Appeal and Equalization on April 4, 2024 The Council will meet as the Local Board of Appeal and Equalization on April 4, 2024, in the Oneka Room at City Hall from 5:30 p.m. – 7:30 p.m. N. Council Meeting Minutes for March 4, 2024 Page 2 of 7 Washington County Update – Attorney Kevin Magnuson Washington County Attorney Kevin Magnuson explained he met the Council and staff for the first time at a Hugo Area Business Breakfast. He lives in Lake Elmo with his wife, son, and daughter in a house previously owned by his parents. He was in private practice for 20 years. The previous County Attorney, Pete Orput, encouraged him to run for office. He said the culture of the Office is to do the basic things in the right way and to be there to help but not at the expense of public safety. Kevin said they are committed to training law enforcement officers and work closely with the Sheriff’s Office for on-demand training. Kevin shared information on the East Metro Human Trafficking Taskforce that was started in 2016 and is a combination of local law enforcement, federal law enforcement, Homeland Security and the Washington County Offices who collaborates to fight human trafficking. In 2023, there were 43 human trafficking cases investigated in Washington County. Many of those cases were connected to runaways, and there is a focus on youth and parent education to work on the runaway situation. The Attorney’s Offices is trying to do more public speaking and engagement and will do presentations on whatever people want to talk about He shared that in 2023, there were 1,118 criminal complaints filed, which was down from 1,346 in 2022 and 1,246 in 2021. The downward trend could be to the backlog during Covid that brought the numbers up and new employees that took over cases. Numbers were higher for specific types of cases over the Covid years. Cases now are more complex with all the digital evidence collected, and a new computer system and staffing will help them with that. In 2023, there were six murders. Fleeing from police had skyrocketed, and there were 102 incidents in 2023 where they were charged. Auto theft had also been a problem with 46 cases in 2023. Kevin talked about some of the large drug cases that had successful results. Kevin talked about how the Covid years have affected juveniles, and he predicted that generation will struggle with a different criminal attitude, so they were working on diversion. They are seeing more mental health and chemical dependencies issues, and there are not enough treatment facilities. Kevin said he is on the legislative task force to make recommendations on how to get some relief for that. He talked about the veteran diversion program started by Pete Orput saying a lot of the work was done by volunteers. Mayor thanked him for coming and said Pete Orput would be proud he was carrying on the things he started. He encouraged Kevin to reach out to the Hugo Area Business Association and attend one of their meetings. Hopkins Schoolhouse Progress Report – Liz Cinqueonce City Administrator Bryan Bear reminded Council that last summer, Council approved the 15- year lease agreement with the newly formed Hopkins Schoolhouse and Heritage Center (HSHC) Committee. The building and property are located at 5970 170th Street North. It is owned by the City and is operated by the group under this agreement. The agreement established milestones that serve as a guideline on the restoration of the schoolhouse. Members of the committee were in attendance to report to Council on their progress in the last year and provide information on their next milestones. Council Meeting Minutes for March 4, 2024 Page 3 of 7 HSHC Board President Liz Cinqueonce began by thanking the Council for allowing the project to move forward and said the Council’s confidence in them made a difference in their fundraising and what they were able to accomplish. Highlights in 2023 included finalizing the agreement with the City that included partnership with the Forest Lake Historical Society, which serves as the fiscal host until the non-profit has been formed. Liz explained that once the determination letter from the IRS was received there were steps to take to become a non-profit. Once that happens, the agreement would transition to the HSHC. There are nine board members and currently 35 volunteers. A group of MBA students had worked on their business plan. Restoration activities included trash removal, and some artifacts were cataloged. Precise Exterior and The Sealant Technicians repaired the roof and chimney. The soffit was repaired by Northern Bedrock, and Floyd Petty completed the painting of it. The stairs did not get done, but the poured concrete will happen in the spring. Trail cameras were installed. Volunteers provided input on the site plan for the schoolhouse grounds. Liz talked about how they met, or didn’t meet, their Measures of Success. Enough money was raised through fundraising to complete the roof, chimney, and soffits. They were still working on money for siding. They saw interest from the community increase when things started happening on the site. They expected the repairs on the window and siding to be completed this fall. Other unexpected accomplished included interest by Connexus Energy to bring power to the site. Materials had been secured for glass block windows, display cases were donated by Rolseth Drug in Forest Lake, and the Petty’s were gathering donations for a garage sale. Fourteen of their 20 Measures had been completed. Four of the uncompleted were due to the IRS determination. A video was presented of the proposed site that showed 11 parking spaces, watering station for horses and dogs, hitching post for horses, picnic area with bike racks, shelter with trash receptacles, and enclosures for portable restrooms. Also included on the drawing was a building the Snowmobile Club had talked about last year, though there had been no recent conversations with them. The volunteer who put the plan together owned a landscape design company and was donating the labor and plans for making this come to life. She acknowledged formal approval of the site plan would be needed from the City Council. Liz talked about the goals they had for 2024 that included completing the 2023 goals, advancing progress on the site, and raising community engagement and fundraising. Restoration plans for this year were to replace stairs, windows, siding and side door, and running basic electric to the site. They also wanted to have an approved site plan for the grounds and continue with grounds cleanup. They were also looking for engagement from students and other history groups. Planning components included ADA compliance by adding a ramp and the preparation of plans for septic system, well, and plumbing inside the building, and other structural components. Klein asked if they were working with the Hugo Historical Commission. Liz replied that Commission Member Brad LeTourneau was a member of the Board of Directors and took the lead on the plans that were presented. He was also an ex-officio member of the Forest Lake Historical Society. Klein also inquired whether they approach Anderson Windows for donations. Liz replied they were on their list, and the HSHC was also considering having community members purchase a window for the school. Council Meeting Minutes for March 4, 2024 Page 4 of 7 Weidt congratulated them on the work they had done so far saying it was good to see progress. He encouraged them to keep pushing forward and keeping the Council up do date. He said the plans look great and it is exciting to see. Community Development Department Annual Report-Associate Planner Max Gort Associate Planner Max Gort presented to Council the 2023 Community Development Annual Report. This report had also been presented to the Planning Commission and the EDA. Max compared the population estimate from the Metropolitan Council of 16,354 and the historical trend of Hugo’s population increasing by 350 residentS every year. This would put Hugo’s population of 17,000 in 2024. Max provided information from the past ten years that showed the total number of planning applications submitted went down to 41 in 2023 from a total of 59 applications in 2022. There was a spike in applications during the pandemic years. He reviewed the types of planning requests that showed the number of applications for plats and PUDs to be at the highest in the past ten years. There were 121 permits issued for single family homes, which was fairly average except during the pandemic years. The Building Department performed slightly less inspections in 2023 with a total of 3,797. Of that total, 527 of them were in Scandia. There was a total of 161 single family units available and he presented a map that showed most were in the Oneka Prairie and the Shores of Oneka Lake developments. In 2023, there were four large residential projects approved, and some were still in motion. Non- residential projects included Premier Bank and Xcel Training Center Expansion. The developer withdrew his application for the City owned downtown property, and the City would be working with the DNR to address issues raised there. In 2023, staff worked with MnDOT on the Highway 61 Visioning Study, revised the Solar Ordinance, and did improvements at the Oneka Parkway and CSAH 8 intersection and the 159th Street and TH61 intersection. This year, the City will need to work on the Cannabis Ordinance, which needs to be done by January 1, 2025, and on revisions to some residential ordinances. Approve Retirement of Building Inspector Terry Hagstrom Terry Hagstrom was hired by the City and began employment as a Building Inspector on July 12, 2021. Terry had submitted his letter of retirement. Adoption of the Consent Agenda approved the retirement of Building Inspector Terry Hagstrom effective March 29, 2024. Approve Performance Review for Senior Engineering Technician Liz Finnegan Liz Finnegan was hired in March 2019, as the City’s Senior Engineering Technician. Adoption of the Consent Agenda approved the performance review for Senior Engineering Technician Liz Finnegan. Approve Donation to the Hugo Fire Department from the Hugo American Legion The Hugo American Legion had requested to donate $1,000 to the Hugo Fire Department from pull-tab proceeds for equipment and training. All donations to the Fire Department needed to be approved by the Council. Adoption of the Consent Agenda approved the donation of $1,000 to the Hugo Fire Department Approve Lawful Gambling Exempt Permit for Ducks Unlimited for Bingo at Sal’s Angus Grill Forest Lake Ducks Unlimited, a nonprofit organization, had applied for a Lawful Gambling Exempt Permit to conduct Bingo and raffles at their Banquet at Sal’s Angus Grill on Sunday, March 24, 2024. This permit would be issued by the MN Gambling Control Board after approval by the City. Adoption of the Consent Agenda approved the Lawful Gambling Exempt Permit for Ducks Unlimited. Approve Lawful Off-Site Gambling Permit for Merrick, Inc, for Bingo at Good Neighbor Days Merrick currently conducts Purse Bingo at the Hugo Legion. Merrick was working with the Hugo Lions Club to hold Bingo under their gambling permit during Good Neighbor Days on June 8-9 at Lions Park. An Off-Site Gambling Permit approved by Council was necessary for Merrick, Inc. to do this. Adoption of the Consent Agenda approved the Off-Site Gambling Permit for Merrick, Inc. Approve Letter of Support for Federal Grant for MN Commercial Railway MN Commercial Railway was applying for a Consolidated Rail Infrastructure and Safety Improvements (CRISI) program grant through the Federal Railroad Administration (FRA) to replace aging '70s era locomotives with new diesel locomotives that would significantly reduce emissions, fuel consumption and engine-related noise levels. MN Commercial Railway had requested Council provide a letter of support for the grant. Adoption of the Consent Agenda approved a letter to the Federal Railroad Administrator in support of the grant for MN Commercial Railway. Council Meeting Minutes for March 4, 2024 Page 6 of 7 Approve Final Plat and Development Agreement for Oneka Shores 3rd Addition M/I Homes had requested approval of a final plat and development agreement in order to plat 77 lots and 1 outlot on parcels located north of Goodview Avenue and east of Highway 61 along the west side of Oneka Lake. The City Council reviewed and approved the preliminary plat and PUD for The Shores of Oneka Lake at its June 6, 2022, meeting. This request would plat 77 lots for the third phase of the development. The lots met the minimum lot standards and requirements outlined in the regulations for The Shores of Oneka Lake PUD. Adoption of the Consent Agenda approved RESOLUTION 2024-07 APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR M/I HOMES OF MINNEAPOLIS/ST. PAUL, LLC, FOR THE SHORES OF ONEKA LAKE 3rd ADDITION. Approve Final Pay Request No. 3 for 2023 Birch Tree Ponds Street Improvement Project Northwest Asphalt, Inc. had submitted Pay Request No. 3 in the amount of $126,908.21 for work certified through November 30, 2023, on the 2023 Birch Tree Ponds Street Improvement Project. The punch-list had been completed and this was the final pay application for the project. Adoption of the Consent Agenda approved payment to Northwest Asphalt, Inc. in the amount of $126,908.21 and formally accept the project. Approve Purchase of Zero Turn Mower for the Public Works Department The Public Works Department had requested approval to purchase a 2024 Ferris Zero Turn Mower and EZ dump hopper to replace the 2006 Toro Mower that had reached its end of useful life. Money for the purchase was included in the 2024 CIP budget. Adoption of the Consent Agenda approved the purchase of the mower and dump hopper from L.T.G. Power Equipment in the amount of $22,221.55. Approve Plans and Specifications and Authorize Advertisement for Bids for 125th St and Dellwood Ridge Improvement Project Previously the Council had authorized staff to prepare plans and specifications for the 2024 125th Street and Dellwood Ridge Neighborhood Street Improvement Project. City Engineer Mark Erichson explained that plans and specifications had been prepared and were ready to be advertised for bidding. Staff would place the advertisement for bids which was required to run for a minimum of 21 days. Plans and Specifications were available for review at City Hall. Consideration of awarding a construction contract will occur at a future City Council meeting. Staff recommended approval of the resolution approving plans and specifications and authorizing advertisement for bids for the 2024 125th Street and Dellwood Ridge Neighborhood Street Improvement Project. Petryk made motion, Klein seconded, to approve RESOLUTION 2024-08 APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE 2024 125th STREET AND DELLWOOD RIDGE NEIGHBORHOOD STREET IMPROVEMENT PROJECT. Council Meeting Minutes for March 4, 2024 Page 7 of 7 Schedule Council Workshop for Monday, April 22, 2024 City Administrator Bryan Bear informed Council that staff wanted to hold a workshop with the Council to discuss bridges, cannabis and shoreland ordinances, and Fire Department staffing structure. He recommended Council schedule the workshop for Monday, April 22, 2024, at 6 p.m. at the Pede Pedersen Pavilion. Klein made motion, Petryk seconded, to schedule a workshop for Monday, April 22, 2022, at 6 p.m. All Ayes. Motion carried. Schedule Citywide Spring Cleanup on Saturday, May 4, 2024 City Administrator Bryan Bear informed Council that staff had been working with Washington County on the Spring Cleanup Dates and recommended the date of May 4, 2024, for the Citywide cleanup at the Public Works facility. Weidt made motion, Petryk seconded to schedule cleanup event for Saturday, May 4, 2024. All Ayes. Motion carried. Schedule Bus Tour for Saturday, October 5, 2024 City Administrator Bryan Bear informed Council that staff was recommending the annual bus tour be held on Saturday, October 5, 2024, beginning at 10 a.m. Beginning and ending locations were not yet determined. Rick Peterson, Chair of the Board Chief of Police, Forest Lake Police Department Lakes Center for Youth and Families, located in Forest Lake, Minnesota, has a rich history of serving its community’s youth, adults, and families with a comprehensive range of programs and services. Established in 1976, the center was founded in response to the vision of Forest Lake Police Chief, Jim Trudeau, and other leaders, who recognized the need for a proactive intervention program to divert young people and first- time offenders away from the traditional court system. Lakes Center for Youth and Families continues to uphold its mission of ensuring the success of youth, adults, and families through programming in Counseling, Intervention, and Enrichment to meet the ever-changing needs of our community. ............................................................................ 46 3 | Page INTRODUCTION The Washington County Assessor Division has prepared this 2024 Assessment Report for use by the County Board, City Councils, Town Boards, residents, and staff. This report includes specific information regarding the 2024 assessment, as well as general information about both the appeals and assessment process. Minnesota statutes establish specific requirements for the assessment of property. The law requires that all real property be valued at market value, which is defined as the usual or most likely selling price as of the January 2nd assessment date. The estimated market values established through the 2024 assessment are based upon actual real estate market trends of Washington County properties from October 1, 2022, through September 30, 2023. From these trends, our mass appraisal system is used to determine individual property values. Detailed discussion of the sales analysis can be found in the “Sales Analysis” section of this report. The summaries breaking down the adjustments made in each community, by property use, can be found in the “Past and Current Year Adjustments/Parcel Count” section of this report. Property owners who have questions or concerns regarding the estimated market value that has been established for their property are encouraged to contact the property appraiser responsible for their area. In most cases, an interior inspection of the property will be necessary. For detailed discussion regarding the appeals period, please refer to the section of this report titled “Other Assessment Related Information.” Lisa Young, S.A.M.A. Washington County Assessor 4 | Page SALES ANALYSIS SECTION Sales Analysis The assessment function is governed by Minnesota State statute. The law requires that all real property be valued at market value, which is defined as the usual or most likely selling price as of the assessment date of January 2nd of each year. Assessors are historians and measure the market based on sales which have occurred previous to the assessment date. Assessors do not create the value or predict what the market will do; rather, the assessor’s job is to follow the patterns set by the real estate market. Information on the sales of real estate is of paramount importance to the assessors in a market-based property tax system. Sales information is required to be submitted electronically using the program developed by the Minnesota Department of Revenue. This program is known as the Electronic Certificate of Real Estate Value (eCRV). The Department of Revenue requires all County Assessors to utilize a specified time period for sales analysis. This time period of 12 months is from October 1st through September 30th preceding the assessment date. Sales within this time period will be used to determine the changes in assessed value that may be needed in each community for the impending assessment. For example, the sales that occurred between October 1, 2022, and September 30, 2023, are used to establish the January 2, 2024, assessed values. The assessor’s office is charged with setting estimated market values for tax purposes at actual market value. The relationship between sales prices to estimated market value is called the sales ratio. The target median ratio range is set by the assessor’s office for all Washington County communities (for all classes of property); the range established for the 2024 assessment is 93%-96%. We make every effort to make certain that each municipality in Washington County falls within this range. In this way, we ensure an equitable distribution of the property tax burden for all Washington County taxpayers. Sales Statistics Defined In addition to the median ratio, we have the ability to measure other statistics to test the accuracy of the assessment. Some of these are also used at the state level. The primary statistics used are: Median Ratio This is a measure of central tendency. The median of a sample is the value for which one-half (50%) of the observations (when stratified) will lie above that value and one-half will lie below that value. The median is not susceptible to extreme observations referred to as outliers. We use this ratio, much like the mean, not only to measure our assessment level, but also to analyze property values by municipality, type of dwelling and value range. These 5 | Page studies enable us to track market trends in neighborhoods, popular housing types and classes of property. Arithmetic Mean Ratio The mean is the average ratio. Unlike the median, the mean is influenced by outliers. We use this ratio not only to measure our assessment level, but also to analyze property values by municipality, type of dwelling and value range. These studies enable us to track market trends in neighborhoods, popular housing types and classes of property. Within the county, we strive to achieve a ratio within the 93%-96% range for the median and mean. This allows us a margin to account for a fluctuating market and still maintain ratios within state mandated guidelines. Coefficient of Dispersion (COD) The COD is used to measure the accuracy of the assessment. The COD indicates the spread of the ratios from the mean or median ratio. The goal of a good assessment is a COD of 10 to 20. A COD under 10 is considered excellent and anything over 20 will result in an assessment review by the Department of Revenue. Price-Related Differential (PRD) The PRD is used to measure value related inequities in the assessment, referred to as regressivity or progressivity. Appraised values are regressive if high value properties are under appraised relative to low value properties and progressive if high value properties are over appraised relative to the low value properties. The PRD is found by taking the mean (average) ratio of the sample and dividing it by the weighted (aggregate) mean ratio. The acceptable range is .98 to 1.03. 6 | Page Arm’s-Length Transactions The Department of Revenue requires all County Assessors to utilize a specified time period in their sales analysis. This time period is 12 months from October 1st through September 30th, preceding the assessment date. Sales within this time period will be used to determine the changes in the prior years assessed value in each community for the impending assessment. The sales that occur within this October 1st through September 30th time period, each year, are closely scrutinized by the appraisers within the Assessor Division. Evidence suggesting a forced sale, foreclosure, a sale to a relative, or anything other than an arm’s-length transaction requires the sales to be disqualified from the sales study. This is important, because the real estate sales information constitutes the statistical basis for determining the annual adjustments that are made to the valuation models. An arm’s-length transaction is any transaction in which buyers and sellers of a product act independently and have no relationship to each other. The concept of an arm's-length transaction is to ensure that both parties in the deal are acting in their own self-interest and are not subject to any pressure or duress from the other party. Permit) 37 | Page Appraiser Activity: Permit & Quintile Review Counts Current state law mandates that all property must be re-assessed each year and reviewed once every five years (aka quintile). Staff also inspect properties that have taken out a construction permit during the course of the year. During 2023 (for the 2024 assessment), the Assessor Division appraisers and locally hired assessors reviewed 28,708 properties. The Court’s judges have expertise in tax laws and apply that knowledge in a manner to ensure that taxpayers are assessed in a fair and equitable way. The tax petition process is a complicated and ever changing part of our business. The entire process continues to consume a large amount of our Commercial/Industrial/Apartment appraiser workload. The table below provides a summary of the petition filings in Washington County over the last five payable years. Petitions related to taxes payable 2023 decreased in the number of petitions filed by 8.8% or 15 petitions. The only property type that showed an increase in filings is the apartment class. Total value under petitions filed for pay2023 increased roughly 28.8% when compared to the previous year. The residential value under petition had a substantial decrease. The total value under petition increase is a result of the apartment class. These properties have experienced substantial value increases over the last several years. Chapter 273). These requirements have not changed during the past year. The laws require the following: 1. All real property is to be valued at market value, which is defined as the usual or most likely selling price at the time of assessment. Special qualified exclusions such as the Veterans’ Exclusion are subtracted from the market value to arrive at the taxable value. 2. Property is classified according to state law, and the tax capacity is calculated. 3. The tax capacity is multiplied by the tax rate (the total of county, school, city, and miscellaneous levies) to determine the amount of property tax. The annual property assessment focuses on the very first step of this process - establishing an estimated market value for each parcel of property. Market values are assessed locally by either a county employed appraiser or a locally hired assessor. The work of both county and local assessors is monitored by the County Assessor, whose work is in turn monitored by the Minnesota Department of Revenue. The monitoring agency is authorized by law to adjust the property assessment to help ensure county-wide and state-wide equalization of property assessments. The County Assessor has established the standard that all Washington County communities, with at least six (6) sales in their sales study, has a community median ratio in the range of 93%-96% of actual market values in relationship to time-adjusted sales prices. At times, local assessment levels have been adjusted by the County Assessor or the State of Minnesota. State law also requires that each individual property be reviewed by the assessor at least once every five years. Each community has a rotating revaluation schedule to ensure that this requirement is met. What is market value? Minnesota Statue 273.03 defines market value as “… the usual selling price at the time of assessment.” The Assessor’s Office works throughout the year to estimate market values of each property for the following January 2 assessment date. 41 | Page How is market value determined? Review Property: Approximately every fifth year, an appraiser working under the supervision of the County Assessor will review the property. Any property that had a building permit issued in a given year is reviewed and the new value is calculated as of January 2nd following the construction. Gather Information: The appraiser gathers information on all characteristics of the property that affect market value, such as size, age, quality of construction, basement finish, and extra features, such as fireplaces, walk-out basements, et cetera. Compute Value: The characteristics are entered into a computerized system (CAMA). Information on actual market sales is used to establish the building and component rates used to calculate the property’s market value. The market value estimated by the appraiser should be very close to the amount the property would sell for, if placed on the open market. Why may market value change from year to year? Property values change continuously depending on the economic conditions affecting the local market. In addition to market changes, physical changes made to a property can also affect its market value. All factors are considered in estimating the value of property. 42 | Page Appeals Process In Minnesota, property tax laws provide the legal parameters that govern the work of assessors. These statutes lay down a cycle of assessment activities that are conducted on an annual basis. Each year, assessors are required to work on a number of tasks that include listing, valuing, and classifying all taxable properties; processing both real and personal property transfers; analyzing market data; monitoring assessment levels for several different classes of property; and arranging and conducting an appeals process. The latter of these activities is a key part of the assessment cycle that provides property owners with an opportunity to review and, if necessary, challenge their estimate of market value and/or classification that will be used for taxation purposes in the following year. At what point in the assessment cycle does the appeals process begin? The appeals process begins in March and extends through June. When property owners receive their Valuation Notices during the month of March, they should read them carefully for instructions about deadlines, filing procedures, meeting dates and times. If they are not clear, they should call the assessor’s office for clarification and additional information because a missed deadline, an incorrect filing, or the failure to attend a scheduled meeting can cause an appeal to be dismissed. What steps should property owners take to appeal their assessments? There are two avenues of appeal that property owners may take to challenge their assessments. The first route is referred to as the three-step appeal and the second is known as the one-step appeal. These steps are illustrated in the flow chart on the following page. How should property owners begin their appeal? Property owners are encouraged to contact their appraiser to discuss their property assessment concerns. An informal meeting can be scheduled to review the property, examine market data, answer questions, and clarify the valuation and classification practices used. This discussion can also be handled by telephone, mail, or e-mail during regular business hours. 43 | Page Appeals Process: What are the options? Appeal to your Local Board of Appeal & Equalization (LBAE) or attend one of four regional Open Book meetings (meeting times & locations are listed on your valuation notice). •Appeal in person, by letter, or by designated representative. •If your appeal is not addressed to your satisfaction, or you and the County staff cannot agree to a change in valuation or classification, continue to the next step. Appeal to the Washington County Board of Appeal & Equalization (CBAE). •You must have first appealed to your LBAE (unless your property is in an Open Book community) Check your valuation notice to verify. •The CBAE meets in June - Call the Assessor’s Office at 651-430-6175 by May 1, 2024, to make an appointment. •If you still do not feel your concerns have been addressed to your satisfaction, you may next appeal to the Minnesota Tax Court. Appeal in the Minnesota Tax Court •Appeals may be filed up until April 30th of the year when the taxes are due. •The Tax Court can be contacted at 651-539-3260 for more information on procedures, forms, and filing fees. WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”) along the southerly, westerly, northerly, and easterly portion of the Owner’s property, which is legally described as: Lot 3, Block 4, Washington County, Minnesota; and, WHEREAS, Owner is desirous of constructing a fence and rock pathway partially within the easement area; and, WHERAS, the City will permit the placement of a fence and rock pathway in the area described herein subject to the terms and conditions hereof. NOW, THEREFORE, in consideration of the premises and for good and valuable consideration, the receipt of which is acknowledged, the City will permit the encroachment on its easement as set forth herein and subject to the conditions set forth below: 1. Owner and their successors in title may install and maintain a fence and rock pathway within the Easement, and the fence and landscaping shall be constructed in accordance with the plans on file with the City of Hugo. 2. No plantings, trees, permanent improvements or structures other than the fence and approved rock pathway may be maintained or placed in the easement area. 3. Owner shall maintain the fence and landscaping in good repair and shall not permit it to be expanded, lengthened or to impair the City’s easement or its rights thereunder in any respect. 4. The encroachment granted to Owner herein is subject to the existing easement rights of the City as granted in various easements. 5. The City will notify Owner if it requires removal or relocation of the fence and rock pathway or any part of it. Thereafter, Owner shall remove the fence and rock pathway according to the direction of the City and if Owner fails to do so, the City may enter upon the land and remove as much of the fence and rock pathway as required and cast it upon the adjoining lands. In such an event, the City shall not be liable to Owner for any costs, loss or damage whatsoever, and may assess the property for all of its costs incurred in removing the fence, and Owner waive all formalities, requirements and defenses arising from or relating to Minnesota Statutes Section 429 relating to or arising from the work done by the City. 6. To the fullest extent permitted by law, Owner agrees to release, defend, protect, indemnify, save and hold harmless the City, its agents, directors, employees, shareholders and contractors against any and all claims, costs and liabilities, including the costs of defense for damages, injury or death arising from or in any way connected to the installation, maintenance, repair, removal and/or presence of the fence, regardless of whether such harm is to Owner, the City, the employees or officers, guests or invitees of either or any other person or entity, except Owner shall not be liable under this paragraph for loss or damage to the extent resulting from the negligence of the indemnified parties. 7. The permission granted herein is limited exclusively to the proposed fence and landscaping within the specified portion of the easement area of the City’s Easement. Owner shall not alter the grade or permit such alteration anywhere upon the land upon which the City has reserved its easement rights without proper express written consent of the City. 8. Owner shall, at all times, use their best efforts to conduct all of their activities on said Easement in such a manner as to not interfere with or impede the operation of the City’s Easement and related activities in any manner whatsoever, and shall follow the direction of the City. 9. This Agreement shall run with the land and inure to the benefit and be binding upon the parties hereto, their heirs, successors and assigns. 10. PROPOSED MOTION: Move approval of the attached notice vacating the drainage and utility easements located over 12796 Ethan Avenue North. 2. DESCRIPTION OF REQUEST: The property is located in the Woods of Bald Eagle Development on the shore of Bald Eagle Lake. The property is 1.93 acres in size with approximately 1.29 acres of wetlands. The City maintains drainage and utility easements over the wetlands on site. The applicant, Raj Alexander, completed a new wetland delineation in 2023 that adjusted the boundary of wetland from the previous delineation, creating a new portion of upland on the property that was previously delineated as wetland. The applicant is requesting vacation of the portion of easement that lies over this upland previously thought to be wetland. The easement vacation will allow for the applicant to have enough space to construct an accessory building. Staff is comfortable with the applicant’s request to vacate the drainage easement. 3.
