Chair Kleissler called the meeting to order at 7:00 pm.

Approval of Minutes for the Planning Commission Meeting of April 28, 2022
Commissioner Petty made a motion, seconded by Commissioner Derr to approve minutes for the
meeting of April 28, 2022.
Ayes: Derr, Kleissler, Petty
Abstain: Arcand
Motion carried.
Public Hearing: Cathleen Pastorius- Request for a lot split for the property located at 5342 142nd
Street North.
Staff provided a background on the request submitted by Cathy Pastorius for a lot split of property
located at 5342 142nd Street North. The applicant is requesting approval of a lot split to create two lots
out of a 1.23 acre lot. The proposed lots are 0.73 acres and 0.50 acres. The property was platted with
the Oneka Estates development located north of the Bald Eagle Industrial Park. Sewer and water
connections will come from 142nd Street and SAC and WAC fees will need to be paid in addition to the
park dedication fee. A grading plan will have to be submitted to the City prior to the issuance of a
building permit for the proposed lot. The properties are in the Single Family Detached Residential (R-3)
zoning district which requires a minimum lot size of 10,400 square feet and a minimum lot width at the
front setback line of 80 feet. Both proposed lots meet the minimum standards outlined in the zoning
code.
Staff recommended the Planning Commission open the public hearing and hear public comment. Staff
recommended approval of the lot split, subject to the conditions in the resolution.
Chair Kleissler Chair Kleissler invited the applicant, Cathleen Pastorius, at 5342 142nd Street North,
Hugo, MN 55038 to address the Commission. They did not wish to comment.
Chair Kleissler opened the public hearing at 7:03pm. No comments were received.

Commissioner Petty made a motion, seconded by Commissioner Arcand, to approve the lot split,
subject to the conditions on the resolution

Public Hearing: M/I Homes of Minneapolis/St. Paul, LLC- Preliminary plat and PUD General Plan for a
residential development to be known as “The Shores of Oneka Lake.”
Staff provided a background on the request of a Preliminary Plat and Planned Unit Development (PUD)
for a residential development to be known as “The Shores of Oneka Lake” located east of Highway 61
and west of Oneka Lake. The property totals 131.66 acres and is comprised of three parcels with 95.99
buildable acres. The preliminary plat includes 218 residential lots, and 10 outlots. The existing
property guided Low Density Residential and will have a density of Density of 2.27 units per buildable
acre. The apartments shown on outlot C were not a part of the approval request. The applicant is
showing a combination of single family homes, villa homes, and twinhomes in four phases. A
roundabout will be constructed at 159th Street which they have requested a permit for from MNDOT.
Previous sketch plans have been reviewed on this site and feedback highlighted the importance of
access to Highway 61 and preservation of trees and natural resources. An Environmental Assessment
Worksheet was completed for these properties in 2006 and since this project is similar, but smaller, a
new EAW will not be required.
The applicant is requesting PUD flexibility for lot size, setbacks, and shore land regulations. In
exchange, they are providing public open space along Oneka Lake, trails, preservation of existing trees,
stormwater reuse irrigation, and architectural anti-monotony design guidelines. The Parks Commission
approved the developer’s proposal to dedicate 3.89 acres of park land adjacent to Oneka Lake and the
payment of the fee for the remaining requirement totaling $441,014.
Staff recommend approval of the PUD and preliminary plat for M/I Homes for the development to be
known as “The Shores of Oneka Lake”, subject to the conditions listed in the resolutions.
John Rask with M/I Homes addressed the Planning Commission. Commissioner Arcand asked about
the lake shore. Rask discussed construction of a paved city trail on the ice ridge, natural plantings, and
expansion of existing park areas, all to be discussed further with the Parks Commission. Commissioner
Arcand asked about monument signage. Rask stated that none are planned now, just additional
landscaping at entrances.

Jeff Tews, 15488 Goodview Trail North, asked about the tree line at the south end of the development.
Juba highlighted the areas of tree preservation, where construction will take place, and the power line
easement. Tews asked if the main access point will be at 159th. Juba discussed that neighborhood
traffic patterns are unknown, but that the developer is requesting a construction access off of Highway
61. Tews asked about damage to the roads of the existing roadways. Juba shared information about
the city’s road improvement program. Tews asked about barriers to the businesses on Highway 61.
Juba re-stated that additional landscaping will be provided as a buffer to the industrial properties.
No further comments were received.
Chair Kleissler closed the public hearing at 7:37pm.
Commissioner Derr asked about the maintenance responsibility of the proposed trails. Juba stated
that the city will maintain the trails, especially when constructed on property dedicated to the City.
Commissioner Petty asked about the access to Highway 61 serving the neighborhoods to the south.
Juba shared that the outlet was required with development of this site and will serve neighborhoods to
the south
Chair Kleissler asked about timing of construction of the bridge and roundabout. Juba stated that
construction of the ditch culvert and the roundabout are proposed to be with the first phase and that
prior to issuance of building permits of the second phase that the roundabout will need to be in
operation. Mass grading of the site will occur.
Commissioner Petty asked what the timing of the phases looked like. Rask shared that grading of
phase one will occur as early as August, phase two in 2023, and phase three in 2024 or 2025 depending
on absorption. The development is likely to take 5 years based on market demand.
Derr stated that the development flows nicely with the development to the south and they have done
a good job with the site constraints.
Commissioner Arcand made a motion, seconded by Commissioner Derr, to approve the PUD and
preliminary plat for M/I Homes for the development to be known as “The Shores of Oneka Lake”,
subject to the conditions listed in the resolutions.

New Business: Liberty Classical Academy- Site plan for property located at 10158 122nd Street
North.
Juba presented background the site plan proposed for additional parking and a main entrance canopy
addition to the former Withrow Elementary School building. Liberty Classical Academy private school

has purchased the property and the school will be used for their pre-k through 2nd grade education
program. The parking lot extension allows for stacking student during drop off as busing is not
planned. The canopy is proposed to be expanded by 1,800 square feet with materials that
complement the existing building. The application is in keeping with the city code.
Staff recommends approval of the site plan request submitted by Liberty Classical Academy, subject to
the conditions listed in the resolution.
Chair Kleissler invited the applicant to address the Commission.
Morgan Trainer, representing Liberty Academy, discussed that they are excited about the opportunity
to utilize the abandoned building to grow Liberty Academy in Hugo. Interior renovations have been
the priority but the expansion of the parking lot and canopy allows for better parent drop off and a
new face to the building.
Commissioner Arcand asked if this project allows for expansion of the Academy. Trainer stated that
the new building in Hugo allows for pre-k to second grade to move to Hugo and expand enrollment.
Third through twelve grade will stay in White Bear Lake.
Commissioner Petty shared that she is happy to see the Withrow building back in use. Trainer shared
that they have received positive feedback from the neighborhood.
Derr asked the applicant to be sensitive to the neighbors and consider landscaping to screen the
stacking cars.
Commissioner Derr made a motion, seconded by Commissioner Petty, to approve the site plan request
submitted by Liberty Classical Academy, subject to the conditions listed in the resolution.
All ayes.

Juba reminded that there will be a neighborhood meeting for residents in the Future Central Business
District on June 9th at 6:00pm.
