Minutes for the Planning Commission Meeting of Thursday,July 14, 2022 Chair Kleissler called the meeting to order at 7:00 pm. PRESENT: Arcand, Derr, Kleissler, Petty, Lessard STAFF: Rachel Juba, Community Development Director Shayla Denaway, Parks Planner Pledge of Allegiance. Approval of Minutes for the Planning Commission Meeting of May 26, 2022 Commissioner Petty made a motion, seconded by Commissioner Arcand to approve minutes for the meeting of May 26, 2022. Ayes: Arcand, Derr, Kleissler, Petty Abstain: Lessard Motion carried. Public Hearing: Integrity Land Development, Inc. Preliminary Plat for a residential development to be known as "Goodview Estates" for property located at 13452 Goodview Avenue North Staff provided a background on the request submitted by Integrity Land Development for preliminary plat approval for 58 lots and 2 lots on approximately 70 acres with 36.7 buildable acres. The outlots within the plat contain stormwater ponds and wetlands. The net density of the project is 1.6 units per acre. Road connections will be made to the stub streets to the north, Goodview Avenue, and connection to the south for future development. The proposed single family lots comply with the Single Family Detached Residential (R-3) zoning district ordinance standards. This includes the 10,400 square foot lot size and 80 foot lot width minimums. The density, setbacks, building height, and landscaping requirements are also met. The lighting plan has not been submitted but staff will continue to work with the applicant. Access will occur from Goodview Avenue and two stub streets located off of 135t" in Birch Tree Ponds. The applicant has provided right-of-way along Goodview Avenue and trail easement to accommodate a future trail along the west side of Goodview Avenue, consistent with the Comprehensive Plan. The applicant will also pay escro to cover the future costs of the trail and conversion of Goodview Avenue to an urban section along their property. The applicant is proposed to pay the park dedicate fee for the development. The park dedication fee is $3,400 per lot for a total of$197,200.00. The fee will be paid as part of the development agreement with the final plat. The developer is also planning to construct a gravel trail with asphalt entrys meandering through the development. July 14, 2022 PC Minutes Page 2 The development is proposing to use stormwater re-use. The Technical and Evaluation Panel will be issuing a notice of decision on the drainage and grading plans. Watermain and sanitary sewer is proposed to be extended south from Birch Tree Ponds. Staff found that the development was consistent with comprehensive land use regulations, the subdivision regulations, and met the criteria necessary to approve a rezoning of the property. Staff recommended the Planning Commission open the public hearing and hear public comment. Staff recommended approval of the rezoning and preliminary plat, subject to the findings in the resolution. Commissioner Arcand asked about Goodview Avenue and the escrow. Juba explained that the escrow would be collected that would pay for a future upgrade including curb and gutter and a trail by the linear foot. Chair Kleissler Chair Kleissler invited the applicant to address the Commission. Todd Ganz, President of Integrity Land Development, introduced himself and asked for questions. Commissioner Arcand asked if the development was separated due to wetlands. Ganz explained that the TEP looked at an east west connect and recommended not follow the old road bed but keep it as a wetland. Commissioner Arcand asked about the three ponds and if all of those ponds would be used for irrigation. Ganz stated that two of the ponds are, the west pond and east pond, and that the north pond is just a catch storm pond. Ganz shared that he hoped to stock the ponds for fishing. He also shared information about the soil borings. He estimated that the land will be raised on the west side 10 feet and 6 feet on the east side to make the sewer connections work. Juba clarified that the outlot with the trail on it will be city-owned. Commissioner Petty asked if the homes will be walk-out villas and what the builders will be. Ganz stated that he has two builders now that are looking to do full walk-outs with different homes. He talked about establishing rules with the builders for homes. Commissioner Arcand asked if the price point of the homes is known at this time. Ganz shared that the average home price will be $750,000, made comparisons to Adelaide Landing, and stated that the homes will be in the Mahtomedi School District. Chair Kleissler opened the public hearing at 7:22pm. Dan Sittler, 6110 135th Street, asked three questions. One was about the one exit onto 135th street for the new homes on the west side of the development. He was concerned about everyone funneling through the neighborhood. His second concern was about construction traffic, based on experience with Adelaide Landing. Hi third concern was that 135th street was built 30 years ago and is in marginal shape and will need to be fixed after construction. July 14, 2022 PC Minutes Page 3 Jay Manke, 13514 Goodview Avenue N, showed where his property was and said that he had 500' that was affected and that he was concerned about how close the homes will be. He stated that he is also concerned about elevations and where the water will go. He also asked for a buffer of trees and reminded that Goodview Avenue is brand new. Jaclyn Zakrzewski, 6105 135th Street, said that she lives on one of the stub streets and is concerned about the traffic coming through. She said that the traffic flow is very fast compared to 30 years ago and was told that there wouldn't be homes behind her due to the wetlands. She said that she always has a sump pump going and has drainage issues in her back yard. She said she is concerned with water, the basements, and the elevation of the new road connection. Jordan Fry, 6035 135th Street North, stated that he is concerned about traffic and the condition of 135th Street. He asked about the culvert and the amount of water in it and his yard. Jodie Heeman, 13327 Goodview Avenue North, asked if the trees along Goodview will remain. She stated that she was concerned about future responsibility for Goodview Avenue construction and traffic noise and safety. Barb Connolly, 13475 Goodview Avenue North, shared that she is concerned about Goodview Avenue speeding and wanted to know about future development of Goodview Avenue. Ray Bahm, 6310 132nd Street, expressed that he is concerned about traffic on Goodview Avenue and 132nd Street. He reported issues with speeding. Becky Hagle, 13292 Goodview Avenue North said that she has talked with the City and Sheriff's Department about speeding on Goodview Avenue and would like to see the results of the traffic counts were. Craig Paulson, 13427 Goodview Avenue North stated that he didn't know how the new access will handle traffic. He reported speeding instances that he has witnessed. Lauren Stacken, 5915 135th Street, reported enjoying the nature behind her property and concerns about the traffic, Ann, 5965 135th Street North, reported wildlife sightings on the property and expressed concerns about fast traffic and asked about construction damage on Goodview Avenue. Michael Menne, 13403 Fondant Avenue, asked the developer to comment on the trees that would be clear cut and a buffer. He recommended to Commission that comments on traffic be addressed with a traffic survey. July 14, 2022 PC Minutes Page 4 Juba addressed the technical concerns and questions. She clarified where the development was in relation to the other properties. Juba showed where the wetlands were and confirmed the limitations they had on potential road connections. Juba shared information about traffic construction requirements and that the Birch Tree Ponds neighborhood is on the City's Street Improvement CIP and that there will be a neighborhood meeting in the near future. She said that the City Engineer is comfortable with the amount of traffic that will be on 135t" Street and Goodview Avenue but will pass on concerns of speeding to the Sherriff's Department. She confirmed that work is continuing on the drainage and grading plans and that the development is not allowed to impact drainage on adjacent properties. She shared information on the City's low floor elevation requirements. Staff is working with the developer on grading to allow for trees on the north side to remain as a buffer. The developer is required to keep the streets in a good condition. Juba confirmed that development occurs as property owners choose to sell their property. She noted that the developer is not asking for flexibility from the zoning ordinance and since they are meeting all requirement, the City must approve their project. Juba confirmed that Goodview Avenue will be improved with development but that state law prohibits the City from requiring the developer to improve streets that is not adjacent to their property. Todd Ganz discussed the trees on the property, shared an interest in keeping as many as possible, and identified locations where they will remain. He discussed the existing and planned stormwater management and also said that the builders he is working with are requesting a fence along the north property line. Commissioner Arcand asked about the swales and the drain tile in the new yards. Ganz confirmed that those will go to the ponds. Jordan Fry, 6035 135t" Street North ,asked about the creek and if it goes to the north pond. Ganz showed where it is and said that it will continue to go into the north pond and then also to the other ponds. There was back and forth from the audience on how portions of project will drain. Commissioner Lessard asked for more information on the fence. Ganz showed where it is planned to go. Anne Manke, 13514 Goodview Avenue, asked if the fence was negotiable and asked for trees. Jaclyn Zakrzewski, 6105 135t" Street North, asked for clarification on the land being up and the position of the houses and the fence. Ganz discussed that the levels of the back yards will be the same and commented on the location of the fence and swale. Jay Manke, 13514 Goodview Avenue, asked about the number of levels. Ganz clarified that it will be a combination of 1 and 2 story walk-outs. July 14, 2022 PC Minutes Page 5 Barb Connelly, 13475 Goodview Avenue North, shared that he has been here since 1966 and about the changes she has seen. She thanked the Planning Commission for taking the time to listen to the concerns. Ganz clarified where and when construction traffic will happen and that the majority of it will be off of Goodview Avenue. Paul John Heeman, 13327 Goodview Avenue, asked about the timeline. Todd Ganz said that depending on approvals they plan to be 75% done by November. Commissioner Arcand asked when the buildout will be done. Ganz said that the builders anticipate all of the homes to be done in 3-4 years. Jay Manke asked for clarification on construction traffic on the old driveway near his home. Todd Ganz said that the existing driveway will be used for two weeks and then the new street. Ray Bahm told the developer to keep trucks off of 132nd Street. Jodie Heeman asked how many homes are going in on Goodview Avenue. Juba stated that it is 28 homes on the east side. Chair Kleissler closed the public hearing at 8:23pm. Commissioner Lessard confirmed that they heard concerns around traffic and construction restrictions and that those should be passed on to the Sherriff's Department. Commissioner Derr expressed that he understands that it is a challenging lot but that the builder has done good job working with the land available. Commissioner Derr made a motion, seconded by Commissioner Petty to approve the preliminary plat subject to the terms and conditions listed for Goodview Estates. All ayes. Motion carried. Old Business Juba gave an update on the Future Central Business zoning district neighborhood meeting on June 91n 2022. Discussion topics included how do they feel about the zoning, what they would like to see happen, and what is desire of the neighborhood. The neighborhood was unaware of the zoning of their property and was clear that they do not want commercial uses in the area. The Premiere Bank sketch plan applicant did talk at the neighborhood meeting and there were mixed feelings about their July 14, 2022 PC Minutes Page 6 plan. Some members in the neighborhood stated they wanted to be zoned residential. Juba has not seen revisions from Premier Bank at this time and they are still considering their application. BACKGROUND: The Shoreland District is an overlay district in the City of Hugo. Overlay districts are areas within the City that have special regulations applied to them because of their unique characteristics. Overlay districts are superimposed over the underlying zoning districts and the regulations for each apply to the subject property. The Shoreland District of the City is land that is within 1,000 feet of the ordinary high water (OHW) level of the lakes, ponds, and flowages, and within 300 feet of the OHW level of the rivers and streams listed in the shoreland classification table in the ordinance. All of the land lying within the Shoreland District are subject to the regulations in the shoreland ordinance. 2. OVERVIEW OF SETBACK REVISIONS: Staff will be completing a larger zoning code revision to the shoreland ordinance, but wanted to start with the revisions to the structure setbacks. The larger zoning code revision will take a longer times to complete. The structure setbacks in the shoreland ordinance are more restrictive than the State Statutes regarding shoreland setbacks that the DNR uses. The setbacks are from the OHW of lakes, ponds, flowages, rivers, and streams. The setbacks vary depending on the classification of the waterbody. The dock may not be over six feet wide in relation to the shoreline. 3. No dock, platform,deck,or similar structure shall be located within or over the banks of a creek or stream. 4. The dock may not block a navigable channel. 5. The dock may not extend more than 75 feet past the ordinary high-water level into a lake in the case of a private dock, nor more than 100 feet past the ordinary high-water level in the case of a commercial or public dock.A variance may be granted in accordance with section 90-38 to allow access to navigable waters. 6. The treadway of the dock may not be more than two feet above the ordinary high-water level of the waterbody over which it is constructed. 7. No walls, roof,or enclosed structure may be constructed on any dock. b. One stairway for achieving access up and down bluffs and steep slopes to shore areas.The stairway may not be greater than four feet in width,and may not have a landing exceeding 32 square feet area. (Prior Code, § 1155-020.1) CITY OF HUGO COMMUNITY DEVELOPMENT DEPARTMENT PLANNING AND ZONING APPLICATION STAFF REPORT TO: Hugo Planning Commission FROM: Rachel Juba, Community Development Director SUBJECT: Southwind Builders,LLC— Sketch Plan for a single family residential development located on the property at 16345 Everton Avenue North DATE: July 21, 2022, for the Planning Commission Meeting of July 28, 2022 ZONING: Future Urban Service (FUS) LAND USE: Low Density Residential (LD) REVIEW DEADLINE: August 16, 2022 1. BACKGROUND: The property is generally located north of the Oneka Prairie development.The property is currently vacant,relatively flat, and has some site constraints due to wetlands. The property is located north of the Oneka Place development at the end of Oneka Parkway. The applicant would like to receive feedback on the project in regards to general layout, lot sizes, setbacks, and road construction. 2. SKETCH PLAN: The applicant is planning to develop a parcel of land that is 24.83 acres,with 3.66 acres of wetland. The plan shows 59 proposed single family lots and a small neighborhood park.The plan also shows stormwater ponding areas, trail connections, and road connections. The development will have a stromwater reuse system for irrigation. A home owners association is proposed for the development.The applicant would be asking for flexibility form the zoning code through a Planned Unit Development (PUD). The sketch plan was completed to get comments from the various commissions and Council prior to moving forward with the formal development approval process. Current Zoning and 2040 Land Use The property is currently zoned Future Urban Service (FUS) and is guided as Low Density Residential(LD)in the 2040 Land Use Plan. The allowed net density is up to 4 units per acre with a PUD. The development is proposed to be 2.8 units per acre, which meets the density requirements. Oneka Prairie Sketch Plan Planned Unit Development The developer has proposed requesting approval of a PUD for the development. PUD's offer enhanced flexibility to develop a site through the relaxation of zoning district standards. The use of the PUD zoning also allows for a greater variety of uses, internal transfers of density, construction phasing and a potential for lower development costs. In exchange for this enhanced flexibility, the City has the expectation that the development plan will result in a significantly higher quality and more sensitive proposal than would have been the case with the use of other, more standard zoning districts. The applicant is proposing flexibility on lot size, lot width, and setbacks. See table below. Parks/Trails This development is in Neighborhood Park Service Area 3 which does not have any parks in it at this time. The property is not in an area identified as a greenway. Frog Hollow and Oneka Elementary are the closest recreational amenities. Due to the size of the proposed development, it is difficult to include a neighborhood park. It is likely that a more sizeable neighborhood park would be constructed to the east with future development. A future park in this location could be a part of a greenway corridor and connect to city-owned park land to the south. The developer is proposing to continue the trail and sidewalks on Oneka Park. They are also proposing to extend the trail on the west side of Fair Oaks Avenue North and extend it to the east to connect to future trails. Sidewalks are proposed along all remaining streets. This is in keeping with the neighborhood to the south and allow for connections to future development. The applicant is required to dedicate land,pay a fee, or a combination of land and fee to satisfy park dedication per Sec. 90-324 of the City Code. The applicant is required to dedicate 10% of the developable acres for park land with a density of less than 3.99 units per acre. With 21.4 buildable acres, 2.14 acres of land would be required to be dedicated. Oneka Prairie Sketch Plan The developer is proposing to dedicate a combination of land and fee. The developer is proposing to dedicate a tot lot that is 29,089 square feet or .66 acres which would satisfy 30% of the requirement. To satisfy the remaining requirement, 70% of the fee would be paid per unit. Park Stequired Dedication Land OR Fee'160posed Calculations 1ji 10% of the developable acres 2.14 acres .66 acres and $3.400 per unit $200,600 $146,420 The developer is proposing to construct amenities on the future city park including a shelter, playground, and sidewalk loop in exchange for PUD flexibility. The site plan also includes trees as a buffer to adjacent homes. There is a wetland shown on the proposed park. Wetlands are not given credit for park dedication and this may result in an adjustment to the final calculations. At its July 20, 2022, the Parks Commission provided feedback on the proposed sketch plan and amenities as it is anticipated that it will become a city park. They generally liked the park layout and the proposed amenities. They recommended approval of the proposed park dedication request by the applicant. Landscaping The developer has not submitted a landscape plan. In exchange for PUD flexibility, the City could expect a landscape plan that goes beyond the minimum requirements to provide street trees, entrance streetscaping,plantings around a monument sign, plantings in openspace, etc. Streets &Access The property is located north of Empress Avenue North(constructed as part of the Oneka Place Development), south of 165ffi Street and east of the extension of Oneka Parkway. Thea applicant is proposing to extend Oneka Parkway 700 feet to the north. An existing 100-ft right-of-way exists for the construction of Oneka Parkway. Additional right-of-way is not necessary to be dedicated. The remaining portion of Oneka Parkway is proposed to be constructed as adjacent properties develop. Two new access points along Oneka Parkway are proposed. There will be a new access point into the development coming from the extension of Fairoaks Avenue that was constructed as part of the Oneka Place Development. The plan also shows streets that could connect to the north and east for future developments on adjacent properties. No lots will be allowed to have driveway access to Oneka Parkway. Oneka Prairie Sketch Plan Utilities Sewer and water is available from the south property, however a sanitary sewer lift station is required to be installed and is identified in the Comp Plan to somewhere along Oneka Parkway. It is a trunk lift station that will serve several other properties and will be designed, installed, and paid for by the City. The sanitary service coming from Fairoaks Avenue to the south has limited depth to serve the western portion of the development. A majority of the development will be served by the new lift station. Wetlands The developer has applied for approval of a wetland delineation through the City. They are currently going through the City's Technical Evaluation Panel (TEP) for approval of their wetland delineation on the site. A wetland replacement plan would need to be applied and approved by the TEP if the developer plans to impact any wetlands on the site. This will be evaluated as the project moves forward. Stormwater Management/Water Re-Use The developer is proposing to have a stormwater management plan through the construction of ponds within the site. Staff will be working with the developer, as this projects moves forward, as it relates to stormwater management and infiltration. The developer has also indicated that they will be evaluating the potential of using stormwater, for irrigation purposes, within the development. If the system is feasible, from a water availability and design standpoint, it will require additional review and analysis as the project moves forward. 5. CONCLUSION/RECOMMENDATIONS: Staff believes that the layout of the proposed development is generally good. The applicant has done a good job providing a park area with amenities and trail connections. The developer is also planning to evaluate a stormwater re-use system that uses water from the stormwater ponds to irrigate the development, which is a system that is fitting with the City's "Reduce, Reuse, Replenish"initiative. The plan meets the intent of the comprehensive plan in regards to land use, parks, and transportation. Staff recommends the Planning Commission provide feedback to the applicant on the following: 1. If the project is to be phased, a staging plan will be required to be shown with utility work being identified to occur within the final platted area only. If grading is different from the phasing plan for utilities or final plat area, a plan addressing temporary drainage measures outside the platted area will be required. Stormwater Management/Wetlands 9. Volume control/water quality standard will be required, which is 1.1 inches off new impervious surfaces.Water reuse will be the preferred BMP option for the site for volume reduction. If an additional BMP is to be used, the TP removal factor from RCWD Rule C, Table C1. must be applied. 10. Peak stormwater runoff rates for the proposed project must not exceed existing rates for the 2-year and 10-year 24-hour rainfall events using Atlas 14 rainfall depths. 11. Based on the 7 subsection items as listed in the PUD criteria we are answering them as follows; Oneka Prairie PUD Purpose and Intent: (1)The proposed 25-acre development, located at 16345 Everton Ave N, referred to as Oneka Prairie, is a continuation of the mixed housing development to the south, known as Oneka Place. Oneka Prairie protects, preserves and enhances the existing onsite wetlands and open spaces. With these new homesites and streetscape; it is in keeping with the scale, character and general height of the existing neighborhood. Oneka Prairie will expand the supply of housing in the City of Hugo. (2) The preliminary plan for Oneka Prairie will provide 60 buildable lots; with a mixture of sizes to allow flexibility in the individual home designs. The smallest lot width will be 65 feet and the largest will be 88 feet. The side yard setbacks will be 7.5 feet from each property line. The front and rear setbacks will be 30 feet at the minimum. All of the lots will have lower levels and will be walkout or look out style. (3)The site plan design consists of gentle winding streets, a generous cul-de-sac, varied lot sizes as noted in the paragraph above. Great care has been taken in this design to avoid impacting existing wetland areas. Additionally based on our refined wetland delineation we are able to enhance some of the wetland areas to create storm water ponding that will be used to supply the individual homes exterior watering needs. By doing this our neighborhood, will lessen the burden on the domestic ground water aquifers that serve the City and the surrounding communities. Each homesite will be assessed a small annual fee to support this aspect and keep it viable. (4) The goal of our plan is to provide a development with expanded and varying single family lot sizes, aesthetic visual interest, along with balancing the feasibility of the project. (5) To enhance our neighborhood, and based on some future feasibility discussions with staff, we feel that a small neighborhood pocket park would add to the ambience of this community. We have identified out lot G located in the center of the neighborhood as an ideal location. This location will make it easily accessible to all of the new residents. (6) In order to facilitate the ease of traffic flow in the area our plan shows a continuation of the existing surface streets from the south as traditional access points. Additionally, we will provide future access to the north and east when those areas develop in the future. (7)The Oneka Preserve neighborhood is designed to be compatible with other neighborhoods in the City. Our goal is to follow and provide a consistent land use that will compliment what is already in place in the surrounding neighborhoods. By providing a continuation of the bituminous trail and concrete sidewalk along the Oneka Parkway extension, continuing the bituminous trail along Fair Oaks to the North and East, as well as providing a sidewalk on the East-West streets all residents will be able to enjoy a walk, or bike ride, be it to visit new friends or simply to go to the park. Lastly, by preserving the existing wetland areas and allowing nature to continue to exist in the open spaces provided throughout the neighborhood, Oneka Prairie will be a unique new neighborhood for future residents to live in.
