Staff recommends approval of the minutes of the Parks Commission meeting of June 15, 2022.

Oneka Prairie
Southwind Holdings, LLC has submitted a sketch plan application requesting approval of a residential
development to be known as “Oneka Prairie”. The development consists of 59 single family units, outlots,
sidewalks/trails, and a tot lot. The developer is proposing to dedicate a combination of land and fee to satisfy
park dedication and to construct amenities on the proposed tot lot. Staff recommends input be given on the
proposed park site plan and that the proposed park dedication of .66 acres plus fee be approved.

Goodview Estates
Integrity Land Development has submitted an application requesting approval of a Preliminary Plat for a
residential development to be known as “Goodview Estates”. The development consists of 59 single family
units and a trail. Because the development meets the subdivision regulations and is consistent with
comprehensive land use regulations, the city must approve the preliminary plat. The developer is proposing
to pay fees to satisfy park dedication. Staff recommends acceptance of the park dedication proposal.

Irish Avenue Park Complaint
The Rupnows, at 8340 140th Street, addressed the Commission at the June 15, 2022 meeting regarding dogs
at Irish Avenue Park. Staff has been in discussions with the Rupnows regarding dogs and construction of
Public Works. The Rupnows shared stories of aggressive dogs at the park as well as dogs entering their
property and killing their chickens. The Commission asked to continue the discussion at their next meeting.
Lions Park Updates
The Council reviewed proposed park signage at its July 5, 2022 meeting and directed staff to prepare mock
ups with the name “Hugo Volunteer Park” and naming the building in honor of Peder Pedersen. Pedersen
was instrumental in the purchase of the bernin property and what is not Irish Avenue Park. He served on the
Parks Commission for many years, is long serving member of the Lions Club, and is a well-known community
volunteer. The signage and naming is on the July 18, 2022 Council agenda. It is likely that the park will be
named “Lions Volunteer Park” and building “Peder Pedersen Pavilion”. Staff will provide an update on
Council discussions.

Staff has been working on revisions to the City’s Policy Regulating the Use of Public Facilities. The Council will
review recommended changes to the policy. Future Council discussions will include the fee schedule,
recreation scheduling software, and staffing.
Staff will provide an update on the construction progress of the building and park.
THE DRAFT SIGNAGE AND FACILITY RENTAL POLICY DRAFT ARE ATTACHED.
Upcoming Meetings and Events
Staff recommends dates be set for a Bernin property tour and social event. The Hugo Business Association
will be hosting Kidz ‘N Biz on Saturday, September 24.

Clarke called the meeting to order at 7:00 pm.
1. Approval of Minutes from the February 16, 2022 Meeting
Moore-Arcand made a motion, Rauschendorfer seconded to approve the minutes of the April 20, 2022
Parks Commission meeting.
All ayes.
Motion approved.
2. Irish Avenue Park Complaint
Members of the Rupnow Family shared concerns of unleashed dogs at Irish Avenue Park, which they live
adjacent to. They reported that dogs have killed the chickens they keep on their property and
aggressively approached them at the park. The attacks happen when owners are not present and at
times are not aware that their animals have left park property. Several emails have been sent to the
City Hall informing of the chickens being killed and other concerns.
Scott Anderson, Public Works Director informed new park rules signage was installed, fence was
repaired and installed on the shared property line and that the park trail has been rerouted to guide
park users away from the property line. Park rules includes that dogs must be under control at all times.
The Ruppnows have a chicken coop that is not fenced and would like to continue to let their chickens
free roam the 10 acres of their land.

Shayla Denaway, Parks Planner provided a summary of police reports of the Irish Avenue Park area
showing animal incidents with deer, bears, and dogs. Poultry has opportunity to be in danger with any
predator when free range is done without any enclosures.
Roger Clarke informed when he used to volunteer at a dog park there were many incidents that would
occur and curtesy reminders were needed often to keep animals in closer proximity to owners and have
control.
St. Pierre informed some dog breeds need more exercise than a leash can provide and Irish Avenue is an
important resource for this type of dog.
Tennyson shared concern for dogs charging, jumping or attacking unwanted while just being in the park
and this issue would keep her from using the space.
Schmid apologized to the Rupnow family that this has happened to them with one or two dog owners
not following the rules of the park and agreed that dogs should be leashed.
Rauschendorfer didn’t feel that any issues should happen with dogs that don’t belong on your property.
Discussion was brought up on can you shoot a dog on your property if it is attacking or killing poultry.
Scott Anderson, Public Works Director looked up the rules on this and said yes if attacking poultry.
Clarke asked if all Parks Commission members could take some time to reflect on the discussion and
have additional discussion in July regarding potential solutions.
3. Neighborhood Park Improvement Plan
Shayla Denaway, Parks Planner gave a presentation on the Capital Improvement Plan and neighborhood
park improvements. Following requests from residents, a fence will be installed the pickleball courts at
Arcand Park. Two adaptable swings were purchased and one was installed at Arbre Park prompted by a
resident request. A grant was awarded for $36,000 to install water saving irrigation controllers at the
parks and city properties that do not already have them.
4. Schedule Bernin Property Tour
Denaway updated on the Bernin property. Currently the dwelling is vacant but personal items are still
being cleared. The lease was extended to August to help with this process of removal. Parks
Commissioners previously requested to walk the site with consideration of future planning of the
property.
Anderson informed that the roof of the home has leaks and they helped with a squirrel infestation issue
last fall. It is not likely that the property is viable for continued rental.

Clarke remined asbestos or lead issues could also be involved now that the original owners are vacated
this will also need to be evaluated.
Discussion determined approximate date for Bernin Property tour on August 17 at 6:00 before the
regularly scheduled meeting.
5. Updates
Public Works: Landscaping will begin June 25, 2022 and irrigation will follow. Security cameras are
installed and will go live on June 21, 2022.
Lions Park: Playground is almost complete and landscaping is starting in 2 weeks.
North Star Wetland Banking: The Council approved the proposal from WSB and is working with the
School District.
5. Adjournment
Schmid made a motion, Moore-Arcand seconded to adjourn the meeting at 8:54 pm.

SUBJECT: Southwind Holdings, LLC. – Sketch Plan for 16345 Everton Ave. N
known as “Oneka Prairie”
DATE: July 15, 2022 for the Parks Commission meeting of July 20, 2022
1. INTRODUCTION:
A sketch plan application has been received from Southwind Holdings LLC. The Parks
Commission should provide input on what would be acceptable and desirable in this
location. The Parks Commission may choose to recommend approval of the park
dedication request at this time.
2. DESCRIPTION OF REQUEST:
The properties are generally located north and east of Oneka Parkway and south of 165th
Street. The property is approximately 25 acres and located north of Oneka Place and
contains 3.66 acres of wetland. The properties to the east, north, and west are large lots
with occupied homes. The applicant is proposing 59 single family lots for a net density
of 2.75 units per acre.
The parcels is located in the Future Urban Service (FUS) zoning district and are guided
for Low Density Residential (LD). Southwind Holdings LLC will be applying for a
Planned Unit Development (PUD) and preliminary plat approval and extend city services.
Lot widths will range from 65 feet to 99 feet with 30’ setbacks. There will be a mix of
home sizes with all lots having look-out or walk-outs.
The developer is planning to extend Oneka Parkway and Fair Oaks Avenue North from
the south and blend the development with Oneka Place to the south.

3. PARK DEDICATION:
The applicant is required to dedicate land, pay a fee, or a combination of land and fee to
satisfy park dedication per Sec. 90-324 of the City Code. The applicant is required to
dedicate 10% of the developable acres for park land with a density of less than 3.99 units
per acre. With 21.4 buildable acres, 2.14 acres of land would be required to be dedicated.
The developer is proposing to dedicate a combination of land and fee. The developer is
proposing to dedicate a tot lot that is 29,089 square feet or .66 acres which would satisfy
30% of the requirement. To satisfy the remaining requirement, 70% of the fee would be
paid per unit.

The developer is proposing to construct amenities on the future city park including a
shelter, playground, and sidewalk loop in exchange for PUD flexibility. The site plan
also includes trees as a buffer to adjacent homes. There is a wetland shown on the
proposed park. Wetlands are not given credit for park dedication and this may result in
an adjustment to the final calculations. The Parks Commission should provide feedback
on the proposed site plan and amenities as it is anticipated that it will become a city park.
4. CONSISTENCY WITH COMPREHENSIVE PLAN:
Parks
This development is in Neighborhood Park Service Area 3 which does not have any parks
in it at this time. The property is not in an area identified as a greenway. Frog Hollow
and Oneka Elementary are the closest recreational amenities. Due to the size of the
proposed development, it is difficult to include a neighborhood park. It is likely that a
more sizeable neighborhood park would be constructed to the east with future
development. A future park in this location could be a part of a greenway corridor and
connect to city-owned park land to the south.
Trails
The developer is proposing to continue the trail and sidewalks on Oneka Park. They are
also proposing to extend the trail on the west side of Fair Oaks Avenue North and extend
it to the east to connect to future trails. Sidewalks are proposed along all remaining

streets. This is in keeping with the neighborhood to the south and allow for connections
to future development.
5. STAFF RECOMMENDATION:
Staff recommends discussion on the proposed tot lot site plan and acceptance of the park
land dedication.

Sec. 90-324. - Park dedication.
General dedication standards. In order to develop a system of parks within the community to serve
the public's health and recreational needs, a percentage of the net buildable acreage based on the
density of all land subdivided for residential purposes shall be dedicated to the city as public
parkland. The city finds that the more dense a development is, the more demand for park land it
creates since lots can be smaller affording less private recreational space and more occupants per
acre. The following formula will be used to determine the dedication requirement where a land
dedication is required:
Density Percentage of Land to be Dedicated (of the buildable land)
0—3.99 units per acre 10 percent
4.00—5.99 units per acre 11 percent
6.00—7.99 units per acre 13 percent
8.00—9.99 units per acre 15 percent
10.00 < units per acre 17 percent
The land so dedicated shall be subject to approval by the city council in accordance with the city's
Comprehensive Plan for parks. At the city council's discretion, a parkland dedication fee may be accepted
or required instead of or connection with land dedication. The parkland dedication fee shall be set annually
by the city council and adopted as part of the city's fee schedule. The parkland dedication fee shall be
charged for each dwelling unit originated by the subdivision or development of any property in the city, not
including any dwelling unit that may be in existence at the time of the adoption of the ordinance from which
this article is derived, or which is subject to an approved development agreement with the city that includes
a parkland dedication provision.
Appeal process. The parkland dedication fee may be appealed to the city council before the city
council makes a decision on the final plat and shall be calculated as follows: The percentage of land
to be dedicated will be multiplied by the fair market value of the net buildable acreage.
The fair market value shall be determined by the city council, following their review of a current
appraisal submitted to the city at the developer's expense. The appraisal shall be made by appraisers who
are approved members of the SREA or MAI, or equivalent real estate appraisal societies.
If the city receives written notice of a dispute over the parkland dedication fee before approval of the
final plat, the developer shall pay the fee into an escrow account pending a decision of an appeal of the
fee. If an appeal is not filed within 60 days following approval of the final plat, or if the person aggrieved by
the fee does not prevail on the appeal, then the funds paid into escrow must be transferred to the city.

SUBJECT: Integrity Land Development, Inc. Request for Preliminary Plat for
“Goodview Estates” consisting of 59 single family homes and 2 outlots on
approximately 70 acres located at 13452 Goodview Avenue North.
DATE: July 15, 2022 for the Parks Commission meeting of July 20, 2022
1.DESCRIPTION:
Integrity Land Development has submitted an application requesting approval of a
Preliminary Plat for a residential development for 59 lots and 2 outlots on approximately
70 acres to be known as “Goodview Estates”. The property includes wetlands and 36.7
acres of buildable land for a net density of 1.6 units per acre.
The property is located at 13452 Goodview Avenue North and is zoned Single Family
Detached Residential (R-3). To the north is the Birch Tree Pond neighborhood and to the
west and south is the Adelaide Landing neighborhood. These properties are zoned
Planned Unit Development (PUD) and R-3. The properties to the east are Future Urban
Service (FUS) and are five acre lots occupied by single family homes.
The City’s discretion in approving or denying a preliminary plat is limited to whether or
not the proposed plat meets the standards outlined in the Comprehensive Land Use
Regulations. If it meets these standards, the City must approve the preliminary plat. The
lot widths will be a minimum of 80 feet wide. Lot size, setbacks and other requirements
are met. Staff finds that the development is consistent with comprehensive land use
regulations, the subdivision regulations, and meets the criteria necessary to approve a
preliminary plat.
2.PARK DEDICATION:
The developer is required to dedicate land, pay a fee, or a combination of land and fee to
satisfy park dedication per Sec. 90-324 of the City Code. The applicant is proposing to

pay a park dedication fee for the development. At the current fee of $3,400 per unit, the
total dedication would be $197,200. The fee will be paid as part of the development
agreement with the final plat.
4. CONSISTENCY WITH PARK PLAN
Parks/ Open Space
This development is in Neighborhood Park Service Area 8 which includes Arcand Park
in Adelaide Landing. The development is not in a Greenway. A gravel trail is proposed
to be constructed within the development that the city may extend to Arcand Park.
Trails
The Existing and Proposed Trails Map does not show a trail in the area. City Code does
not require sidewalks along roads where the lots are 80 feet in width or larger.
The applicant is proposing a meandering off-street trail with access from two points in
the development. The trail will be constructed of asphalt as it leaves the development and
then convert to gravel. The trail is proposed to extend through a City owned outlot in
Adelaide Landing for access to Arcand Park. The City will continue to work on the exact
location of the trail.
5. STAFF RECOMMENDATION:
Staff recommends approval of the payment of park dedication fees for Goodview Estates.
