Hugo Estates
TPP, LLC has submitted an application requesting approval of a Conditional Use Permit for a residential
development to be known as “Hugo Estates”. The development consists of a 54 unit apartment building and
16 manufactured home sites. The proposal expands the existing Hugo Estates manufactured home
community located at 15057 Forest Boulevard North. The developer is proposing to pay fees to satisfy park
dedication. Staff recommends acceptance of the park dedication proposal.

Continued Discussion on Irish Avenue Park Complaint
The Rupnows, at 8340 140th Street, addressed the Commission at the June 15, 2022 meeting regarding dogs
at Irish Avenue Park. Staff has been in discussions with the Rupnows regarding dogs and construction of
Public Works. The Rupnows shared stories of aggressive dogs at the park as well as dogs entering their
property and killing their chickens. The Commission asked to continue the discussion at their next meeting.
The agenda item was tabled at the July 20, 2022 meeting to allow additional Commissioners to participate in
the discussion.

Project Updates
Staff will provide updates on ongoing projects including the trail on Freedom Trail, Bernin property, and
Arcand Park pickleball fence.
Parks Chair Discussion
Staff and Council received a resignation from the Parks Commission from Roger Clarke. The Council approved
the resignation at their October 3, 2022 meeting. Staff recommends discussion on the Chair seat and that a
recommendation be made to the Council for a new Chair. A chairperson is to be appointed annually from the
membership of the Commission by the Mayor, with approval of the City Council.

Clarke called the meeting to order at 7:00 pm.
1. Approval of Minutes from the July 20, 2022 and August 17, 2022 Meeting
St Pierre made a motion, McGinnity seconded to approve the minutes of the July 20, 2022 and August
17, 2022 Parks Commission meeting.
All aye.
Motion approved.
2. Update Bernin Property
Scott Anderson, Public Works Director updated on the Bernin property at 6540 Green Ave N. The Family
has vacated the site and requested a sugar maple tree try to be preserved with future planning. Site
debris removal has started and no trespassing signage is posted on all structures. Hugo City Council and
City Staff visited the site and noted that the buildings are in disrepair. They are concerned that, with no
habitancy, the property could become a nuisance parcel and subject to vandalism. The Hugo City
Council authorized evaluation of the structures.
McGinnity made a motion, Moore-Arcand seconded to agree with City Council and City Staff to remove
the structures on the property while trying to preserve the maple tree requested to be remembrance
from the family.

Scott Anderson, Public Works Director informed that WSB & Associates drafted a demolition
management process to be reviewed by the City Council. If approved, the next step would be to solicit
bids for demolition.
Moore-Arcand requested trail signage currently in place stay until removal is required when demolition
occurs.
All Parks Commission members agreed.
3. Parks Update
Lions Volunteer Park Grand Opening is September 22, 2022.
Kidz N Biz is on September 24, 2022 at Oneka Elementary School.
City Bus Tour October 1, 2022.

Shayla Denaway led a tour of Lions Volunteer Park and the Peder Pedersen Pavilion.

SUBJECT: Hugo Estates. Conditional Use Permit Request for “Hugo Estates”
consisting of a 54 unit apartment building and 16 manufactured homes
located at 15135 and 15069-15099 Forest Boulevard North
DATE: October 12, 2022 for the Parks Commission meeting of October 19, 2022
1. DESCRIPTION:
TPP, LLC has submitted an application requesting approval of a Conditional Use Permit
for a residential development with a 54 unit apartment building and 16 manufactured
home sites on 7 acres to be known as “Hugo Estates”. The properties are located north of
and will be a part of the existing Hugo Estates Community located at 15057 Forest Blvd.
N. and managed by Summit Management.
The approval request also includes a Minor Subdivision, Comprehensive Plan
Amendment, Zoning Amendment, and a variance which will be reviewed by the Planning
Commission.
2. PARK DEDICATION:
The developer is required to dedicate land, pay a fee, or a combination of land and fee to
satisfy park dedication per Sec. 90-324 of the City Code. The applicant is proposing to
pay a park dedication fee for the development. At the current fee of $3,400 per unit, the
total dedication would be $238,000. The fee will be paid at the time the property is
subdivided.
4. CONSISTENCY WITH PARK PLAN
Parks/ Open Space
This development is in Neighborhood Park Service Area 10 which includes Oneka Ponds
Park and city-owned properties. The community is immediately north of Hugo

Elementary School which has a playground, hockey rink, and ball diamond. Immediately
east of the community is a vacant property. In 2021, 40 townhomes to be known as
Oneka Lake Reserve was proposed on that site and approved. The development has not
been constructed. The approval included a small city park with a small playground and
small shelter which would be adjacent to the community. North Star Elementary, on the
west side of Highway 61, offers a playground, ball fields and more.
Trails
The Existing and Proposed Trails Map does not show a trail in the area.
The developer has shared an interest in working with the Hugo Good Neighbors Food
Shelf, located northeast of the proposed apartments, to provide a pedestrian route to
Francesca Avenue North and 152nd Street. There is a controlled intersection at 152nd
Street N and Highway 61. On the west side of Highway 61 is North Star Elementary and
the Hardwood Creek Regional Trail.
With the approval of Oneka Lake Reserve, a sidewalk was proposed on the north side of
150th Street which would connect to the south east corner of the Hugo Estates
Community.
5. STAFF RECOMMENDATION:
Staff recommends approval of the payment of park dedication fees for Hugo Estates.

Hugo East Project Narrative
Summit Management is a renowned property management and development firm that owns and
operates several properties throughout the state of Minnesota. With over 25 years of expertise in
the industry and serving thousands of residents annually, Summit Management prides itself on
providing exceptional management services and outstanding properties and amenities.
The existing Hugo Estates Community located at 15057 Forest Blvd. N. in Hugo, MN is owned
by Erin Lambert (TPP, LLC) and managed by Summit Management. Summit Management has
seen great success in maintaining affordable housing for Hugo residents while also ensuring the
Hugo Estates community is one which all residents can be proud to have as a part of the
community.
The proposed location is currently a 6-acre vacant multifamily lot with a single-family home that
will be demolished. The proposed Hugo East project will be constructed alongside the existing
Hugo Estates Community and will consist of an additional 16 manufactured home sites that will
expand the existing community, plus a new state of the art 54-unit, three story apartment building.
The exterior materials of the apartment building will be a mixture of brick, steel siding, trim and
window shutters, with decks and screening incorporated around the entire building. The colors
will consist of earth tones that complement the palette of the surrounding neighborhood. (See
colored rendering attached as Exhibit A).
Some of the proposed uses and amenities of the 54-unit apartment building include the following:
• Spacious, bright apartments
• Full kitchens with all appliances in every unit
• Washer and dryer in every unit
• Maintenance of apartments, common spaces and all appliances
• Digital cable TV programming / Internet Access
• Utilities including gas, electric, water, waste and recycling
• Individual climate control in every apartment
• Community Room
• Exercise Room
• Outdoor patio with grills and lounge space
The manufactured homes sites will be occupied by high quality manufactured homes with attached
garages, each having its own green space accompanied by manicured landscaping. (See colored
rendering attached as Exhibit B). The projected approximately 25 residents of the additional 16
home sites will have access to the storm shelter located in the existing Hugo Estates Community,
which has remaining available capacity for up to 181 additional individuals.

Sec. 90-324. - Park dedication.
General dedication standards. In order to develop a system of parks within the community to serve
the public's health and recreational needs, a percentage of the net buildable acreage based on the
density of all land subdivided for residential purposes shall be dedicated to the city as public
parkland. The city finds that the more dense a development is, the more demand for park land it
creates since lots can be smaller affording less private recreational space and more occupants per
acre. The following formula will be used to determine the dedication requirement where a land
dedication is required:
Density Percentage of Land to be Dedicated (of the buildable land)
0—3.99 units per acre 10 percent
4.00—5.99 units per acre 11 percent
6.00—7.99 units per acre 13 percent
8.00—9.99 units per acre 15 percent
10.00 < units per acre 17 percent
The land so dedicated shall be subject to approval by the city council in accordance with the city's
Comprehensive Plan for parks. At the city council's discretion, a parkland dedication fee may be accepted
or required instead of or connection with land dedication. The parkland dedication fee shall be set annually
by the city council and adopted as part of the city's fee schedule. The parkland dedication fee shall be
charged for each dwelling unit originated by the subdivision or development of any property in the city, not
including any dwelling unit that may be in existence at the time of the adoption of the ordinance from which
this article is derived, or which is subject to an approved development agreement with the city that includes
a parkland dedication provision.
Appeal process. The parkland dedication fee may be appealed to the city council before the city
council makes a decision on the final plat and shall be calculated as follows: The percentage of land
to be dedicated will be multiplied by the fair market value of the net buildable acreage.
The fair market value shall be determined by the city council, following their review of a current
appraisal submitted to the city at the developer's expense. The appraisal shall be made by appraisers who
are approved members of the SREA or MAI, or equivalent real estate appraisal societies.
If the city receives written notice of a dispute over the parkland dedication fee before approval of the
final plat, the developer shall pay the fee into an escrow account pending a decision of an appeal of the
fee. If an appeal is not filed within 60 days following approval of the final plat, or if the person aggrieved by
the fee does not prevail on the appeal, then the funds paid into escrow must be transferred to the city.

Clarke called the meeting to order at 7:00 pm.
1. Approval of Minutes from the April 20, 2022 Meeting
Moore-Arcand made a motion, Rauschendorfer seconded to approve the minutes of the April 20, 2022
Parks Commission meeting.
All ayes.
Motion approved.
2. Irish Avenue Park Complaint
Members of the Rupnow Family shared concerns of unleashed dogs at Irish Avenue Park, which they live
adjacent to. They reported that dogs have killed the chickens they keep on their property and
aggressively approached them at the park. The attacks happen when owners are not present and at
times are not aware that their animals have left park property. Several emails have been sent to the
City Hall informing of the chickens being killed and other concerns.
Scott Anderson, Public Works Director informed new park rules signage was installed, fence was
repaired and installed on the shared property line and that the park trail has been rerouted to guide
park users away from the property line. Park rules includes that dogs must be under control at all times.
The Ruppnows have a chicken coop that is not fenced and would like to continue to let their chickens
free roam the 10 acres of their land.

Shayla Denaway, Parks Planner provided a summary of police reports of the Irish Avenue Park area
showing many animal incidents with deer, bears, and dogs. Poultry has opportunity to be in danger with
any predator when free range is done without any enclosures.
Roger Clarke informed when he used to volunteer at a dog park there were many incidents that would
occur and curtesy reminders were needed often to keep animals in closer proximity to owners and have
control.
St. Pierre informed some dog breeds need more exercise than a leash can provide and Irish Avenue is an
important resource for this type of dog.
Tennyson informed agreement of concern for dogs charging, jumping or attacking unwanted while just
being in the park and this issue would keep her from using the space.
Schmid apologized to the Rupnow family that this has happened to them with one or two dog owners
not following the rules of the park and agreed that dogs should be leashed.
Rauschendorfer didn’t feel that any issues should happen with dogs that don’t belong on your property.
Discussion was brought up on can you shoot a dog on your property if it is attacking or killing poultry.
Scott Anderson, Public Works Director looked up the rules on this and said yes if attacking poultry.
Clarke asked if all Parks Commission members could take some time to reflect on the discussion and
have additional discussion in July regarding potential solutions.
3. Neighborhood Park Improvement Plan
Shayla Denaway, Parks Planner gave a presentation on the Capital Improvement Plan and neighborhood
park improvements. Following requests from residents, a fence will be installed the pickleball courts at
Arcand Park. Two adaptable swings were purchased and one was installed at Arbre Park prompted by a
resident request. A grant was awarded for $36,000 to install water saving irrigation controllers at the
parks and city properties that do not already have them.
4. Schedule Bernin Property Tour
Denaway updated on the Bernin property. Currently the dwelling is vacant but personal items are still
being cleared. The lease was extended to August to help with this process of removal. Parks
Commissioners previously requested to walk the site with consideration of future planning of the
property.
Anderson informed that the roof of the home has leaks and they helped with a squirrel infestation issue
last fall. It is not likely that the property is viable for continued rental.

Clarke remined asbestos or lead issues could also be involved now that the original owners are vacated
this will also need to be evaluated.
Discussion determined approximate date for Bernin Property tour on August 17 at 6:00 before the
regularly scheduled meeting.
5. Updates
Public Works: Landscaping will begin June 25, 2022 and irrigation will follow. Security cameras are
installed and will go live on June 21st, 2022.
Lions Park: Playground is almost complete and landscaping is starting in 2 weeks.
North Star Wetland Banking: The Council approved the proposal from WSB and is working with the
School District.
