HomeMy WebLinkAbout2024.06.03 RESO 2024-24 Liberty Classical Site Plan, CUP, DA RESOLUTION 2024-24 APPROVING A SITE PLAN, CONDITIONAL USE PERMIT,AND DEVELOPMENT AGREEMENT FOR LIBERTY CLASSICAL ACADEMY SCHOOL TO ALLOW AN ADDITION ON THE EXISTING SCHOOL LOCATED AT 10158 122ND STREET NORTH WHEREAS, Liberty Classical Academy has requested approval of a site plan and conditional use permit (CUP) for an approximately 33,500 square foot addition and additional parking to be constructed on to the existing school on property located at 10158 122nd Street North that is legally described as follows: See attached. WHEREAS, the Planning Commission has reviewed said site plan and CUP on May 9, 2024, and recommends approval subject to the conditions listed in this resolution. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the site plan and CUP for Liberty Classical Academy with the following findings and conditions: Finding: 1. The use is permissible by law. 2. The spirit and intent of the ordinance is to allow a school in the AG zoning district as a conditional use. The performance standards requires the school to have its principal entrance from a state highway, county road, or city collector street. The school's principal access will be from County Road 57/Keller Avenue. The project meets the spirit and intent of the ordinance. 3. The property is guided as Public/Quasi Public and Agricultural in the 2040 Comprehensive Plan. The types of development anticipated to be located in Public/Quasi Public include schools, libraries, community centers, places of worship, play fields, and parks. The types of development anticipated to be located in Agricultural include farms, horse stables and riding areas, livestock, such as cows and pigs, and open space. 4. School are allowed in the Agricultural zoning district and the Public/Quasi Public land use in the 2040 Comprehensive Plan. The location has been a school for several years. The applicant is requesting approval of an approximately 33,500 square foot addition. The total square footage is approximately 66,500 square feet, typical size of an elementary school. The applicant is preserving trees and providing transitions from property lines to the school. The school is compatible with the comprehensive plan and character of the surrounding areas. 5. The school will have adequate drainage, water supply, electrical, gas, and septic service. Resolution 2024-24 Page 2 6. The access to the school will be from CR 57/Keller Avenue and is controlled and managed by Washington County. The applicant has been working with Washington County on the access location and intersection improvements that will include corresponding turn lanes. The school has adequate road access. 7. There is floodplain is located on the north east portion of the site and is not proposed to be impacted. 8. The use is not proposing to create dangers downstream or block bridges, culverts, or other hydraulic structures. 9. The proposed use will not damage or reduce the benefits the public received from public waters. They are not proposing any impacts to wetlands or water bodies. 10. The proposed use is not proposing to have access to a waterbody. 11. The building addition is not located in the shoreland overlay district. 12. The project is not proposing any wetland impacts. Conditions: 1. A site plan is approved to allow construction of an approximately 33,500 square foot square foot addition with the plans dated March 6, 2024, March 29, 2024, and April 29, 2024. 2. The applicant shall obtain all necessary local, state, and federal permits. 3. The site plan and CUP is subject to approval by May Township for the stormwater facilities and septic system located on May Township. If not approved, the plan will need to be revised to relocate the stormwater facilities and septic system. The plans shall be reviewed and approved by the City. 4. The applicant shall preserve as many trees along County Road 57/Keller Avenue as they can. The applicant shall include additional landscaping around the parking areas and along Keller Avenue. The landscape plan shall be reviewed and approved by staff. 5. The plans shall be revised to show proof of parking. The parking shall be constructed at any time deemed necessity by the City. The revised plan shall be reviewed and approved by staff. 6. The plans shall be revised to move the new proposed parking area to the north. The plan shall be reviewed and approved by staff. 7. The applicant shall enter into a development agreement with the City including financial securities for the public improvements required. Resolution 2024-24 Page 3 Prior to Grading Approval: 8. All items on the Engineer's memo and "red-line" detailed engineering comments that have been sent directly to the applicant's engineer dated May 6, 2024, shall be addressed. 9. The applicant shall obtain a Notice of Decision from the Technical Evaluation Panel (TEP) for wetland modification. 10. The applicant shall obtain approved plans and permit from the City of Hugo as approved by the City Engineer. 11. The applicant shall obtain approved plans and permit from Browns Creek Watershed District. 12. The applicant shall obtain approved plans and permit from the Minnesota Pollution Control Agency for the septic system. 13. The applicant shall obtain applicable approved plans and permit from the Minnesota Department of Natural Resources and Department of Health for the wells. Prior to Building Permit Approval: 14. The applicant shall obtain approved plans and permits from Washington County for the accesses and required improvements to CR 57 and CR 7. Required easements shall be dedicated for right-of-way for CR 57 and CR 7. 15. The lighting plan shall revised to decrease the amount of light poles. The plan shall be revised to include lights with dimmers,motion sensors, and timers. The applicant shall provide a lighting plan of how the lights will be managed on the property. A final lighting plan and management plan shall be reviewed and approved by staff. 16. The building materials shall be reviewed and approved by staff. 17. A development agreement shall be executed and recorded against the property. All fees in the development agreement shall be paid. Prior to issuance of a Certificate of Occupancy: 18. All required road improvements shall be complete and functioning on CR 57 and CR 7. 19. Drainage and utility easements shall be dedicated to the City over the stormwater management facilities and applicable utilities.
