HomeMy WebLinkAbout2024.08.19 RESO 2024-34 Apartment Plat Site Plan CUP RESOLUTION 2024-34 APPROVING A PRELIMINARY AND FINAL PLAT, SITE PLAN AND CONDITIONAL USE PERMIT FOR HWI,LLC, C/O SUMMIT MANAGEMENT, LLC, FOR AN APARTMENT BUILDING ON THE PROPERTY LOCATED SOUTH OF ROSEMARY WAY AND WEST OF EVERTON AVENUE WHEREAS, HW1, LLC, c/o Summit Management, LLC, has requested approval of a site plan and conditional use permit for an 89 unit apartment building on the property legally described as; OUTLOT B, Frenchman Place 2nd Addition WHEREAS, the Planning Commission has reviewed said preliminary plat, site plan, and conditional use permits at a duly called a public hearing on August 8, 2024, and recommends approval subject to the conditions listed in this resolution. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the preliminary plat, site plan, and conditional use permits. for HW1, LLC, c/o Summit Management, LLC with the following findings and conditions: 1. Approval is contingent upon City Council approval of a comprehensive plan amendment, rezoning, and variance. 2. All items on the Engineer's memo and "red-line" detailed engineering comments that have been sent directly to the developer's engineer dated August 5, 2024 shall be met. 3. The development shall be consistent with the plans submitted on July 11, 2024 and as amended by this resolution. 4. The plans shall be revised to include only 89 apartment units. 5. Prior to the installation of any signs, the developer shall obtain a sign permit. 6. The developer is responsible for obtaining all local, State, and Federal permits. 7. Prior to the commencement of grading the Technical Evaluation Panel shall approve the wetland impact including purchase of wetland credits. Prior to subdivision and the issuance of a building permits: 8. Park dedication shall be satisfied by dedication of land. The total buildable acreage of land is 1.8 acres. a. A trail easement shall be dedicated along the south property line of the plat. b. The applicant shall grade, construct trails, and landscape the park area. c. Final grading and layout of the trail and landscaping within the park shall be reviewed and approved by staff prior to installation. Resolution 2024-34 Page 2 9. All SAC and WAC (connection and trunk) fees per the fee schedule shall be paid. 10. Stormwater trunk fee per the fee schedule shall be paid. 11. The lighting plan shall be revised based on staffs comments. The lighting plan shall be reviewed and approved by staff. Decorative lighting shall be added to the walls of the building. 12. The developer shall provide cut-sheets for the pole and wall mounted light fixtures and they will need to be reviewed and approved by staff. Shields shall be added to the lights to reduce glare. 13. Cross access agreement shall be reviewed and approved by staff for all common elements. 14. The plans shall be revived to include the following, and shall be reviewed and approved by staff: Landscaping 15. The landscape plan shall be revised for review and approval by staff to include the following: a. The required amount of landscaping per City Code Section 90-181. b. Include foundation landscaping behind the garages for the apartments. c. Screen the trash enclosure on all sides with evergreens. d. Landscaping shall be added to screen any ground mounted mechanical equipment. 16. The developer shall revise the landscape plan to be reviewed and approved by staff. Architecture 17. Add cast stone to the elevations to meet the intent of the design guidelines, specifically the corners and main entrance points. 18. The internal air conditioning unit vents shown on the plans shall match the color of the adjacent siding or stone. 19. The developer shall provide details on the locations and colors of the gutters and down spouts. 20. The applicant shall submit building materials for review and approval by staff. 21. The developer shall revise the architecture plans to be reviewed and approved by staff. Resolution 2024-34 Page 3 Prior to issuance of a Final Certificate of Occupancy: 22. All improvements for the plan shall be installed and constructed. 23. All required landscaping shall be fully installed. 24. Drainage and utility easements shall be dedicated to the City over the stormwater management facilities and wetlands 25. All roof top and ground mechanical equipment must be screened from view of adjacent properties. Staff shall review and approve the locations. All ground-level mechanical units shall be low profile and located to the side or rear of the building and shall be screened from view of adjacent properties. Staff shall perform an inspection when equipment is installed to ensure compliance with City code.
