G.2. Approve Performance Review for Building Official Joel Hoistad
Joel Hoistad was hired on September 14, 2020, as the new building Oficial. Staff recommends
Council approve the Annual Performance Review for Building Official Joel Hoistad.
G.3 Approve Annual Performance Review for City Clerk Michele Lindau
Michele Lindau was hired by the City of Hugo as a part time employee in 1997 and approved as
a full-time employee on May 1, 1999. On January 1, 2008, Michele became the new City Clerk.
City Administrator Bryan Bear recommends Council approve the annual performance review for
City Clerk Michele Lindau.
G.4 Approve Tobacco License for Hugo Gaz, LLC, DBA Speedway
Hugo Gaz, LLC has purchased the Speedway gas and convenience store located at 14815 Forest
Boulevard North. The previous owner had a license to sell tobacco products, but the license is
not transferrable. The new owner of Hugo Gaz, Muntasir Elisa, has applied for a new license.
Staff has received the completed application and fee. Staff recommends Council approve the
license to make retail sales of cigarettes and other tobacco products.
G.5 Approve Special Event Permit for Hugo Legion for Craft Show/Octoberfest on
Saturday, October 5, 2024
The Hugo American Legion Post 620 has applied for a Special Event Permit for their annual
Craft Show and Oktoberfest Celebration to be held on Saturday, October 5, 2024. This event
requires a Special Event Permit approved by Council because there will be about 200 people in
attendance, alcohol sold outdoors, and music outside until approximately 9 p.m. This event has
been held successfully for the past few years. Staff recommends Council approve the Special
Event Permit for the Hugo American Legion Post 620 in accordance with their application and
conditions in the memo.
G.6 Approve Lawful Gambling Exempt Permit for Ducks Unlimited on Sunday, October
6, 2024, at Sal’s Angus Grill
Ducks Unlimited, Roseville Chapter 209, has applied for a Lawful Gambling Exempt Permit to
hold bingo and a raffle at their event on October 6, 2024, at Sal’s Angus Grill, 12010 Keystone
Avenue North. Applications need to be approved by the City prior to being issued by the State
Gambling Control Board. Staff recommends Council approve the Lawful Gambling Permit for
Ducks Unlimited.
G.7 Approve Pay Request No. 6 to Arnt Construction for 159th Street/TH61 Roundabout
Arnt Construction Company has submitted Pay Request No. 6 in the amount of $36,209.06 for
work certified through August 8, 2024, on the TH61/159th Street Roundabout Improvement
Project. The project is substantially complete at this time and the retainage has been reduced to
1%. Staff recommends Council approve payment to Arnt Construction Company in the amount
of $36,209.06.
G.8 Approve Renewal of Mining Permit for Mike Atkinson
The Mining Permit for Mike Atkinson on his property located on the south side of 147th Street
between Irish and Hyde Avenue expired on August 2, 2024. Atkinson has applied for a renewal
of the permit for another two years. For the past several years, the site has been used to stockpile
material, with no mining activity taking place. When the permit was renewed in 2012, the
Council allowed Mike Atkinson to move forward with the Mining Permit renewal process
without all the conditions being met until the time mining operations began again, due to the cost
of meeting those conditions. The requirements not being met are to biannually provide a
topographic map of the site, calculation of stockpiled material, amount of granular material left
on site to be mined, and a reclamation plan. Staff has found very minimal activity on the site to
require those conditions be met for the renewal of his permit. Staff recommends Council
approve the Mining Permit for Mike Atkinson for property located on 147th Street North with the
condition that all requirements in the permit be met when mining activity begins again.
G.9 Approve Resolution Approving Encroachment Agreement for 16180 Finale Avenue
North
Brooke Feyen and John Finney have requested an encroachment agreement to allow construction
of a fence within a drainage and utility easement on property located at 16180 Finale Avenue
North. The Senior Engineering Technician has reviewed the location of the fence and is
comfortable with the request. Staff recommends Council approve the resolution approving the
encroachment agreement for 16180 Finale Avenue North.
I.1 Declare Cost to be Assessed and Set Public Hearing for 2024 Street improvement
Project (125th Street and Dellwood Ridge)
On April 15, 2024, the City of Hugo awarded the Contract for 125th Street and Dellwood Ridge
Development Street Project to Dresel Contracting, Inc. The project is nearing completion. As
part of the public improvement process, in accordance with the requirement of state statutes
Chapter 429 for assessments to benefitting properties, the City needs to declare the costs to be
assessed and conduct the assessment hearing. Staff has prepared two resolutions for Council
consideration. The first resolution is a resolution declaring the costs to be assessed and ordering
the preparation of the proposed assessment roll for 125th Street and Dellwood Ridge
Development Street Project. The second resolution is a resolution calling the hearing on
assessments for the 125th Street and Dellwood Ridge Development Street Project to be set for
October 7, 2024. The total project cost is $2,877,000. The portion to be assessed is $258,500.
Staff recommends Council approve both resolutions.
M.1 Schedule HBA Business Breakfast for Tuesday, September 10, 2024
Staff recommends Council schedule a meeting to attend the Hugo Area Business Association
Business Breakfast on September 10, 2024, from 7:30 – 9 a.m. at the Blue Heron. The HBA is
hosting a public service roundtable to include the Washington County Sheriff, Hugo Fire
Department, Hugo Public Works, and Fairview Ambulance Service.
M.2 Reminder – Joint Workshop with Planning Commission on Thursday, September 12,
2024
A joint workshop has been scheduled to discuss the solar ordinance related to solar farms and
residential zoning text amendments on Thursday, September 12, 2024, at 6 p.m. in the Oneka
Room at City Hall.
M.3 Hopkins Schoolhouse and Heritage Center Fundraiser on Saturday, September 14,
2024
The Hopkins Schoolhouse Committee will be holding a fundraiser on Saturday, September 14,
2024, from 5:30 – 9:30 p.m. There will be wine and beer tasting, dinner, magic show, and
raffles. The event will be held at the Pede Pedersen Pavilion.

Council attended the workshop held by Washington County to review the plans for the Highway
61 Visioning Study. The long-range plan would guide the vision for a future expansion of the
highway and jurisdictional transfer plan from MnDOT to Washington County. The workshop
concluded at approximately 6:30 P.M.

Approve Claims Roster
Adoption of the Consent Agenda approved the Claims Roster as presented.
Approve Letter Granting Permission to Unbury Urn at Walker Cemetery
Staff had received a request from Denise Goiffon on behalf of her mother, Kitty, for permission
from the City to unbury and remove her son’s urn and headstone from the Walker Cemetery. The
urn was buried there by the father of Dennis Goiffon after Dennis’s death in 2009. The family
wanted to relocate the urn and headstone to the St. John’s Cemetery. Staff had confirmed the
headstone was on the City owned cemetery property approximately 18-20 feet within the south
and west property lines. Hugo City Code required written approval of the City prior to any
disinterment taking place at the Walker Cemetery. Adoption of the Consent Agenda approved
the letter granting permission to Denise Goiffon to unbury Dennis’s urn from the Walker
Cemetery.
Approve Pay Request No. 3 to Dresel for the 125th/Dellwood Ridge Project
Dresel Contracting, Inc. had submitted Pay Request No. 3 in the amount of $371,765.77 for work
certified through July 31, 2024, on the 2024 125th Street/Dellwood Ridge Neighborhood
Improvement Project. The final layer of asphalt had been placed along 125th Street and work
continued along Heather and Upper Heather Avenues. City staff had inspected the work and
recommended approval. Adoption of the Consent Agenda approved payment to Dresel
Contracting, Inc. in the amount of $371,765.77.
Approve Development Sign Criteria and Resolution Approving an Encroachment
Agreement for Schwieters
Schwieters Properties had requested approval of development sign criteria and an encroachment
agreement to locate freestanding signs within the right of way of Fenway Boulevard North.
Development sign criteria allowed for flexibility for multi-tenant buildings and campus
developments. The locations had been reviewed by staff and staff was comfortable with the
locations. Adoption of the Consent Agenda approved RESOLUTION 2024-31 APPROVING
AN ENCROACHMENT AGREEMENT TO ALLOW FREESTANDING SIGNS WITHIN THE
RIGHT OF WAY ON FENWAY BOULEVARD NORTH subject to City Attorney review and
approval.

Approve Resolutions Approving a Comprehensive Plan Amendment, Rezoning,
Preliminary Plat, Site Plan, Conditional Use Permit, Variance, and Final Plat for
Frenchman Place 5th Addition
HW1, LLC, c/o Summit Management, LLC, had requested a comprehensive plan amendment to
change the land use from Commercial (COM) to High Density Residential (HD) on property
located south of Rosemary Way and west of Everton Avenue. The applicant had requested to
rezone the property from General Business (C-2) to Medium Density Multiple Family
Residential (R-5). The applicant requested approval of a site plan and conditional use permit
(CUP) for an 89-unit three story approximately 100,000 square foot apartment building including
attached and detached parking garages. The footprint of the building was approximately 46,000
square feet. The applicant requested a CUP for the apartment use. Apartments were allowed in
the multi-family zoning district with a CUP. The applicant requested a preliminary plat of the
property to have the apartments on a separate parcel from a proposed public park. The applicant
requested a variance to allow the apartment building to be 39 feet in height, where 35 feet was
allowed by the ordinance. At its August 8, 2024, meeting the Planning Commission held a public
hearing and considered these requests. There was one person that spoke during the public
hearings with concerns and questions about additional traffic on to Rosemary Way and as it
circulates to Victor Hugo Boulevard and Everton Avenue. The Planning Commission agreed that
the use was a good fit in this location and met the criteria for approval of the requests. The
Planning Commission unanimously recommended approval to the City Council for the requests.
Adoption of the Consent Agenda approved RESOLUTION 2024-32 APPROVING A
COMPREHENSIVE PLAN AMENDMENT CHANGING MAP 3-1, 2040 LAND USE PLAN,
and RESOLUTION 2024-33 APPROVING FINDINGS OF FACT FOR REZONING HW1,

Approval of Wetland Replacement Plan for Frenchman Place 5th Addition
HW1, LLC, c/o Summit Management, LLC, had proposed to develop a 13-acre property located
west of Everton Avenue and south of Rosemary Way to be known as Frenchman Place 5th
Addition. The property had 4.09 acres of wetlands on site. The development would result in .43
acres of wetland impact. The applicant had proposed to replace the impacts to the wetland basin
though the purchase of wetland credits from an approved wetland bank. The applicant met all of
the rule requirements for wetland impact sequencing and replacement. Adoption of the Consent
Agenda approved the wetland replacement plan, subject to final Technical Evaluation Panel
issuance of the Notice of Decision for the wetland replacement application.

City Administrator Bryan Bear reminded Council they had scheduled the Midyear Budget Workshop
for Thursday, August 29, 2024, at 6 p.m. in the Hugo Council Chambers.
Cancel or Reschedule Monday, September 2, 2024, Council Meeting
The first regular Council meeting in September on September 2 falls on the Labor Day holiday.
City Administrator Bryan Bear recommended Council reschedule that meeting.

September 3, 2024

Schedule Joint Workshop with Planning Commission for Thursday, September 12, 2024
At its July 15, 2024, meeting the City Council directed staff to hold a workshop to discuss the
solar ordinance related to solar farms. City Administrator Bryan Bear informed Council that staff
would also like discussion on residential zoning text amendments at the workshop and include
the City’s consultant Landform to lead the discussion.
Klein made motion, Strub seconded, to schedule a joint workshop with the Planning Commission
for Thursday, September 12, 2024, at 6 p.m. in the Oneka Room at City Hall.

MINING PERMIT
(ATKINSON PIT)
Pursuant to the provisions of Ordinance No. 90-247 of the City of Hugo, Washington
County, Minnesota, entitled "Mining and Excavation" a Mining Permit is hereby issued to:

for a period to expire on July 1, 2026, unless sooner terminated. Permit approval is subject to the
provisions of said Ordinance and compliance with the following conditions:
1. All applicable provisions of the City of Hugo Ordinances governing mining shall be
complied with.
2. The scope of the Mining Permit shall be limited to mining, washing, screening,
temporary storage, and hauling away accumulated, granular material. Mr. Atkinson
may maintain a total of thirty thousand (30,000) cubic yards of stockpiled material
on site. Said stockpile shall include all material mined from the site and all other
material (including recycled material) brought to the site. At no time shall the total
amount of stockpiled material exceed thirty thousand (30,000) cubic yards.
Applicant shall, on a bi-annual basis, provide to the City a calculation, from a
qualified person, attesting to the amount of stockpiled material on site. Additionally,
Mr. Atkinson shall, on a bi-annual basis, report to the City as to the amount of
granular material left on-site to be mined. Applicant shall also, bi-annually, provide
a topographic map to the City of the site, which map shall depict the then existing
topography of the site. Lastly, the applicant shall provide, on an biannual basis, an
estimate of the material removed from the property.
3. No topsoil or overburden shall be removed from the site (see #19).
4. Haul roads shall be 147th Street, from existing north entrance of the Atkinson's
gravel pit, easterly to Irish Avenue; and Irish Avenue between 147th Street and
County Road 8A. Any exception to these routes must be approved by the City
Council.
5. Dust control on all City streets shall be by the use of water or calcium chloride, as
directed by the City Engineer.

6. The inspection fee to cover the inspection costs shall be based on actual costs
incurred or as set by Council resolution.
7. No change shall be made to the reclamation plan approved by the City for this site
without prior consent of the City Council. The permit holder shall maintain on
deposit with the City cash or other acceptable security in the amount of $17,500.00,
for the purpose of insuring compliance with the reclamation plan. Such deposit will
be released by the City upon acceptance by the City Engineer of the reclamation
work, or the money may be used by the City to perform the work if the permit
holder has not restored the site within one (1) year of the termination of this permit.
8. Temporary changes to this permit, made necessary by acts of nature or other
emergencies, may be made by the City Engineer.
9. Inspections to ensure compliance with the Mining Permit will be done by the City
Administrator, and he may request the assistance of such other persons or
organizations, as he may deem necessary.
10. Any violation of the terms or conditions of this Mining Permit may be grounds for
immediate termination in accordance with the City Ordinance.
11. Haul roads shall be inspected periodically by the City Engineer, and maintained by
the contractor, in accordance with the Engineer's recommendations. The City
Engineer will have the authority to temporarily close a haul road for use by the
permit holder if the road is in such disrepair that it is, or may become, a hazard to the
public.
12. A maximum speed of 45 mph shall be maintained by the contractor's gravel trucks
when operating on the designated haul roads. The permit holder’s trucks shall
maintain a maximum speed of 30 mph when school is in session.
13. Any additional limitations or specifications for the haul roads, which shall be
deemed necessary for health and safety reasons by the City Engineer and City
Attorney, may be established.
14. The hours for the mining operation shall be 7:00 a.m. until 6:00 p.m., Monday
through Saturday.
15. There shall be no trucking or hauling in of materials before 7:00 a.m. or after 7:00
p.m., except as noted herein, without an amendment to this Mining Permit.

16. The sight distance along the haul routes shall be improved at the expense of the
permit holder according to the requirements of the City Engineer.
17. An updated contour map of the site is to be filed with the City Engineer, when
requested.
18. All existing trees and natural vegetation bordering the pit area shall be left
undisturbed.
19. All topsoil in the pit area shall be stockpiled and used only for site restoration
purposes.
20. Sewer facilities on the site shall be of the portable, chemical holding-tank type.
21. No blasting shall be permitted on site.
22. Nuisances on site are to be abated pursuant to Chapter 46 of the City Code (junk
vehicles, illegal dumping, etc.).
23. Applicant shall refrain from mining below grade closer than fifty (50) feet to the
boundary of any zone where such activities are not permitted, or closer than fifty
(50) feet to the boundary.
24. Inspections are to be conducted on-site.
25. The Applicant shall carry liability and property damage insurance, with minimum
limits at $1,000,000.00 to any one person and $1,000,000.00 for any occurrence,
naming the City of Hugo as an additional insured.

CONSENT
Dean Atkinson has read the foregoing Mining Permit and the conditions, and hereby accepts
said Mining Permit as conditioned, and agrees that said conditions are reasonable, and to abide by
said conditions throughout the term of the said Mining Permit, unless and until modified by action
of the City Council on the following described property:
The SW 1/4 of the NW 1/4 of Section 23, Township 31 North, Range 21 West, Washington
County, Minnesota.
This Permit is being issued pursuant to Council authorization on September 3, 2024. Said
approval is subject to full compliance with conditions of the permit and is subject to review by the
City Council at any time with possible revocation for failure to comply with the conditions set forth
herein.

CONSENT AND DISCLOSURE
Mike Atkinson acknowledges that he read and understands the foregoing Mining Permit
("Atkinson Pit") ("Mining Permit"). Mike Atkinson states that he is executing the Consent included
in the Mining Permit as a necessity for him to continue his business. By executing the Consent
included in the Permit, Mike Atkinson is not waiving his legal right to bring legal action to
challenge the validity of Ordinance No. 95-301 (An Ordinance clarifying the City Ordinances
regarding the Operation of Rock Crushers within the Agricultural District of the City) as the
Ordinance limits crushing and processing of recycled asphalt and concrete on the subject property,
or to challenge the permit, or any past permits.

WHEREAS, the City Council has fully considered the request for the encroachment
agreement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO, MINNESOTA, that it should and hereby does approve the encroachment
agreement on property located at 16180 Finale Avenue North.

ENCROACHMENT AGREEMENT
THIS AGREEMENT is made this 3rd day of September, 2024 by and between the CITY OF
HUGO, a Minnesota municipality (hereinafter “City”) and, Brooke Feyen, a single person, and John
Finney, a single person, (hereinafter “Owner”), and their successors in title.
WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”)
along the northerly, westerly, easterly, and southerly portion of the Owner’s property, which is
legally described as:
Lot 6, Block 6, Meadows at Hugo, Washington County, Minnesota; and,
WHEREAS, Owner is desirous of constructing a fence partially within the easement area;
and,
WHERAS, the City will permit the placement of a fence in the area described herein subject
to the terms and conditions hereof.
NOW, THEREFORE, in consideration of the premises and for good and valuable
consideration, the receipt of which is acknowledged, the City will permit the encroachment on its
easement as set forth herein and subject to the conditions set forth below:
1. Owner and their successors in title may install and maintain a fence within the
Easement, and the fence shall be constructed in accordance with the plans on file with the City of
Hugo.
2. No plantings, trees, permanent improvements or structures other than the fence may
be maintained or placed in the easement area.
3. Owner shall maintain the fence in good repair and shall not permit it to be expanded,
lengthened or to impair the City’s easement or its rights thereunder in any respect.
4. The encroachment granted to Owner herein is subject to the existing easement rights
of the City as granted in various easements.
5. The City will notify Owner if it requires removal or relocation of the fence or any part
of it. Thereafter, Owner shall remove the fence according to the direction of the City and if Owner
fails to do so, the City may enter upon the land and remove as much of the fence as required and cast
it upon the adjoining lands. In such an event, the City shall not be liable to Owner for any costs, loss
or damage whatsoever, and may assess the property for all of its costs incurred in removing the
fence, and Owner waive all formalities, requirements and defenses arising from or relating to
Minnesota Statutes Section 429 relating to or arising from the work done by the City.
6. To the fullest extent permitted by law, Owner agrees to release, defend, protect,
indemnify, save and hold harmless the City, its agents, directors, employees, shareholders and
contractors against any and all claims, costs and liabilities, including the costs of defense for
damages, injury or death arising from or in any way connected to the installation, maintenance,
repair, removal and/or presence of the fence, regardless of whether such harm is to Owner, the City,
the employees or officers, guests or invitees of either or any other person or entity, except Owner
shall not be liable under this paragraph for loss or damage to the extent resulting from the negligence
of the indemnified parties.
7. The permission granted herein is limited exclusively to the proposed fence within the
specified portion of the easement area of the City’s Easement. Owner shall not alter the grade or
permit such alteration anywhere upon the land upon which the City has reserved its easement rights
without proper express written consent of the City.
8. Owner shall, at all times, use their best efforts to conduct all of their activities on said
Easement in such a manner as to not interfere with or impede the operation of the City’s Easement
and related activities in any manner whatsoever, and shall follow the direction of the City.
9. This Agreement shall run with the land and inure to the benefit and be binding upon
the parties hereto, their heirs, successors and assigns.
10. Owner shall be responsible for the costs of recording this Agreement with the
Washington County Recorder.

RESOLUTION NO. 2024 –
A RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT
FOR THE 2024 125th STREET AND DELLWOOD RIDGE STREET
IMPROVEMENTS PROJECT
CITY OF HUGO, WASHINGTON COUNTY, MN
WHEREAS by a resolution passed by the council on September 3, 2024, the City Clerk, with the
assistance of the City consulting engineer, was directed to prepare a proposed assessment of the cost of
2024 125th Street and Dellwood Ridge Street Improvement Project, improving the following:
Road reconstruction for the Dellwood Ridge neighborhood
Full depth reclamation on 125th Street; and
WHEREAS the clerk has notified the council that such proposed assessment has been completed and
filed in her office for public inspection,
NOW, THEREFORE, IT BE RESOLVED, by the City Council of the City of Hugo, Minnesota, as
follows:
1. A hearing shall be held at 7:00 P.M. on October 7, 2024, in the city hall located at 14669
Fitzgerald Avenue North, Hugo, MN 55038, to pass upon such proposed assessment. All persons
owning property affected by such improvement will be given an opportunity to be heard with reference
to such assessment.
2. The city clerk is hereby directed to cause a notice of the hearing on the proposed assessment to
be published once in the official newspaper at least two weeks prior to the hearing, and she shall state
in the notice the total cost of the improvement. She shall also cause mailed notice to be given to the
owner of each parcel described in the assessment roll not less than two weeks prior to the hearing.
3. The owner of any property so assessed may, at any time prior to certification of the assessment
to the county auditor, pay the whole of the assessment on such property, with interest accrued to the
date of payment, to the City of Hugo, except that no interest shall be charged if the entire assessment is
paid within 30 days from the adoption of the assessment. An owner may at any time, thereafter, pay to
the City of Hugo the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must be made before
November 15 or interest will be charged through December 31 of the succeeding year.

A RESOLUTION DECLARING THE COST TO BE ASSESSED AND ORDERING
PREPARATION OF PROPOSED ASSESSMENT ROLL
FOR THE 2024 125th STREET AND DELLWOOD RIDGE STREET
IMPROVEMENT PROJECT
CITY OF HUGO, WASHINGTON COUNTY, MN
WHEREAS estimated costs have been calculated for 2024 125th Street and Dellwood Ridge Street
Improvement Project consisting of the following roadway improvements:
Road reconstruction for the Dellwood Ridge neighborhood
Full depth reclamation on 125th Street
The estimated cost for such improvements is $2,877,000. That portion of the project that is
assessable is the roadway improvements with estimated costs is $258,500; and
NOW, THEREFORE, IT BE RESOLVED, by the City Council of the City of Hugo,
Minnesota, as follows:
1. The portion of the cost of the roadway improvement is hereby declared to be $2,877,000;
and the portion of the cost to be assessed against benefited property owners is declared to
be $258,500.
2. Assessments shall be payable in annual installments extending over a period of 10 years,
the first of the installments to be payable on or before the first Monday in January 2025 and
shall bear interest at the rate of x percent per annum from the date of the adoption of the
assessment resolution.
3. The city clerk, with the assistance of the city engineer, shall forthwith calculate the proper
amount to be specially assessed for such improvement against every assessable lot, piece or
parcel of land within the district affected, without regard to cash valuation, as provided by
law, and he shall file a copy of such proposed assessment in his office for public inspection.
4. The clerk shall upon the completion of such proposed assessment, notify the council
thereof.
