F.1 Good Neighbor Days Recap – Lions Member Carrie Schwieger The Hugo Lions Club held Good Neighbor Days on June 7-9, 2024, for the first time at the new Lions Park and Pede Pedersen Pavilion. The Hugo Lions Club would like to provide Council a recap of the event. G. 1 Approval of Claims Staff recommends Council approve the Claims Roster as presented. G.2 Approve Resolution Approving Preliminary Tax Levy for 2025 At its August 29, 2024, Midyear Budget Workshop, the City Council listened to a presentation from Finance Director Anna Wobse highlighting revenues and expenditures to-date as well as projections for the 2025 fiscal year. City Engineer Mark Erichson also presented to the Council an updated 5 Year Street Capital Improvement Plan and discussion was had about future unfunded infrastructure projects. It was the consensus of the Council that the 2025 preliminary levy revert back to following the flat tax rate policy in order to provide additional funds for future infrastructure projects. The total proposed 2025 property tax levy of $12,847,855 will move the urban tax rate to 39.190% of tax capacity. Staff believes this levy is sufficient to fund the operating and capital budgets in 2025 and meets the objectives of the City Council to begin funding future infrastructure projects and recommends the City Council approve the Resolution Approving the Preliminary Tax Levy Payable in 2025. G.3 Approve Pay Request No. 4 Dresel Contracting for 125th Street and Dellwood Ridge Streets Improvement Project Dresel Contracting, Inc. has submitted Pay Request No. 4 in the amount of $219,282.52 for work certified through August 30, 2024, on the 2024 125th Street/Dellwood Ridge Neighborhood Improvement Project. The first layer of asphalt has been placed along Heather and Upper Heather Avenues and restoration work has begun. City staff has inspected the work and recommends Council approve the payment to Dresel Contracting, Inc. in the amount of $219,282.52. G.4 Approve Resolution Creating a New Special Revenue Fund The City of Hugo has received miscellaneous revenues from the State of Minnesota in the form of Public Safety Aid and Local Affordable Housing Aid. These funds need to be accounted for separately from other already established funds for tracking and reporting purposes. Generally Accepted Accounting Principles (GAAP) and the Governmental Accounting Standards Board’s (GASB) Statement Number 54 provide special revenue funds to account for and report the proceeds of specific revenue sources that are restricted for specified purposes. Staff recommends that Council approve the Resolution Creating a New Special Revenue Fund to Account for Miscellaneous Revenues Received from the State of Minnesota. The new special revenue fund will be created and named the State Revenue Fund to track and report on miscellaneous revenues received from the State of Minnesota that need to be accounted for separately. J.1 Approve Preparation of Feasibility Study for 2025 Road Projects City Engineer Mark Erichson will review with Council proposed capital improvement projects. Staff recommends Council approved the resolutions authorizing staff to prepare a feasibility study for the 2025 Beaver Ponds Area Street Improvement Project and the 2025 Duck Pass, Palmes Long Lake Estates, and Ingersoll Avenue Neighborhood Improvement Project M.1 Reminder – Joint Workshop with Planning Commission on Thursday, September 19, 2024 The Council has scheduled a joint workshop with the Planning Commission on Thursday, September 19, 2024, to discuss the solar ordinance related to solar farms and residential zoning text amendments M.2 100th Year Birthday Celebration for WWII Navy Veteran Jerry Saunders on Saturday, September 28, 204 The Council has been invited to attend the 100th birthday party for Jerry Saunders on Saturday, September 28, 2024, at 2 p.m.at the Good Life Senior Living in Hugo. Adjournment MINUTES City Council-Midyear Budget Review Hugo City Hall Thursday, August 29, 2024 6:00 p.m. Mayor Weidt called the meeting to order at 6:00 p.m. PRESENT: Klein, Miron, Petryk, Strub, Weidt ABSENT: None STAFF PRESENT: City Administrator Bryan Bear, Finance Director Anna Wobse, Fire Chief Jim Compton, Public Works Director Scott Anderson, Community Development Intern Phoebe Brown, City Clerk Michele Lindau Finance Director Anna Wobse began by saying the City had not yet received the tax breakdown from Washington County, so numbers may be slightly different from what will be reported on the preliminary levy. Current numbers estimated a 2% decrease in the market value, and changes to the Homestead Market Value Exclusion Program increased the maximum exclusion amount, reducing taxable market values by $34,650,000 from last year. Council had been on a flat tax policy but has deviated the past two years because of higher property values. Staff prepared the budget using the same tax rate as last year. Wobse recommended to continue using the contingency budgeting technique for expenditures. Without unforeseen events, there would be a general fund surplus for the street CIP or equipment purchases. The $200,000 earmarked in previous years for flat tax rate stabilization would not be in the 2025 budget. Keeping the 2024 tax rate, the total levy for 2025 could not exceed $11,997,855. This would be a 2.6% decrease from the 2024 levy. Anna explained there were three outstanding bond issues the City totaling $15,145,000 or $889 per capita, which was under the statewide average of $1,936 per capita. The non-general fund tax levies totaled $1,859,964. A contribution of $500,000 was added to the Street CIP last year but would not be added this year. There was a need to figure out how to fund trails, which would require further discussion. The Equipment Levy was set at $300,000, Stormwater Levy at $278,788, and the Parks Improvement Levy will remain at $92,000 unless otherwise directed, The Firefighter’s Relief Levy was set at $29,176. General fund operations made up the largest part of the levy. There were 26 regular full-time employees and three vacant positions. Staff had used the League of MN Cities online salary survey to compare Hugo to 13 other cities of similar population, and found that, excluding the City Administrator’s wage, Hugo averaged -2% below others. A salary adjustment was included in the budget for a 3% cost of living and a 2% salary matrix increase resulting in a total increase of $140,500 to the General Fund. Health insurance went up 13.4%, but there was no change in deductibles. 2024 was the first year with the full-time fire chief. All remaining officer positions in the Fire Department were funded for as well as the continued retention program. The City received $703,253 in 2024 as a one-time public safety aid payment that needed to be used for public safety. This was placed in a special fund to pay for a new deputy position for five years. Estimating revenues conservatively at $956,116 resulted in a General Operating Levy at Minutes for Midyear Budget Review on September 30, 2023 Page 2 of 3 $9,140.036. Totaling all levies, the proposed 2025 levy totaled $11,997,855. Anna talked about fiscal disparities saying Hugo receives more back than it contributes, and the City’s proposed distribution will increase 14.45% equaling $1,015,758 Anna talked about the tax impact of the proposed levy. The median valued homestead of $389,400 after the market value exclusion would see a tax of $1,380 at the proposed 36.522% rate. This would decrease the tax from 2024 by $116. Hugo’s tax rate had always fallen near the middle in comparison to other cities in Washington County, but it was noted that some other cities charged for other services. Hugo does not collect any additional fees. Residents would see a decreased tax bill from Hugo, but other districts collected taxes, so overall taxes may increase. City Engineer Mark Erichson provided information on the 2025 Street CIP. The CIP is evaluated each year by working with the Public Works Department to determine what the condition of the roadways are. The City was waiting for MnDOT to finish their rating on the bridges to see if they qualified for funding. If needed, street projects would be rescheduled to accommodate an upcoming bridge project if necessary. Mark shared costs associated with each project saying some will be state aid eligible for reimbursement. He shared discussions had with Lino Lakes regarding Elmcrest Avenue due to the expected increase in traffic when Otter Lake Road in Lino Lakes is constructed, saying there may be cost sharing with Lino. There were also concerns regarding 165th Street, partly due to the size of the project and lack of development to help pay for it. Council discussed the CIP and were concerned about unfunded road projects, two bridge repair projects, and trail maintenance. No money was budgeted for Elmcrest Avenue or 165th Street, and those roads were anticipated to be highly traveled with the construction of Otter Lake Road. There were questions about the safety of the bridges, specifically Fable Hills Bridge. Erichson responded that the structural integrity was there, it was getting very costly to maintain the decking. Aging trail networks had not been identified for improvements, costs, or funding. There was discussion about reverting back to following the flat tax pate policy and the 39.403% tax rate. It was noted the budget as presented could fund the projects identified on the current CIP until 2029, but they were rough estimates and did not include other anticipated projects. Anna stated that by following policy, $800,000 could be added to the Street Fund. Council members expressed desire to keep the proposed tax rate but were concerned the City would be getting further behind. The normal rate would allow the City to address upcoming unfunded needs and prevent a huge rate increase if they waited. Council members commented on the need for safe, decent roads. The proposed budget would keep the City functioning as usual, but the sacrifice would go to the street fund. There was discussion on amending the assessment policy, which had been in place since 2013. Road projects had increased significantly, and this was part of the equation to add stability to the fund in the future. It was noted that the fund currently had a healthy balance, but at the end of five years, it will have dropped way down. It was generally agreed a workshop was necessary to discuss strategies to budget for it. Minutes for Midyear Budget Review on September 30, 2023 Page 3 of 3 It was understood by Council they could set the preliminary tax rate higher and could back down from it, but not increase it. The budget had been prepared at the lower tax rate, and if it was going to return to the higher rate, it was agreed by Council there needed to be an explanation for it. It was agreed to set the budget at the higher rate for approval at the next Council meeting, hold the workshop and decide to continue to deviate from the flat tax rate policy or go back to following the policy for the 2025 levy. Discussion on Urban and Rural Tax Rates City Administrator Bryan Bear introduced the new Community Development Intern Phoebe Brown. Phoebe explained that the MN Statute that allowed for Hugo to establish different rural and urban service districts with different municipal tax rates. When the Village of Hugo and Oneka Township consolidated in 1971, these two districts were created due to the separate services received in each district. To be in the Rural District, three requirements needed to be met: unplatted; not developed commercial, industrial, or urban residential; and not benefiting from City services. One exception was, since 1987, the County moved any rural parcel that had been platted into the Urban Service District. Statute also allowed for establishment of a benefit ratio, which is the percentage of the tax capacity rate, currently set at 90%. The Urban rate was 36.7% with 6,134 parcels. The Rural rate was 33.06% and under 1,400 parcels. It was also noted that many parcels in the Rural District were enrolled in the Green Acres and Rural Preservation Program, which provided property tax relief for qualifying farmland. Abolishing the two separate tax districts had been discussed in 1978 and in 1986 arguing they both benefitted equally from general fund services. Rural residents argued they did not receive the same services; it took longer for emergency services to reach them, and it would harm agriculture, destroying the rural character. It was also argued that rural areas received services such as dust control and ditching projects. Options were discussed such as amending the policy to equalize the districts, change the benefit ratio, or reclassify certain parcels. It was agreed a workshop should be held at a later date. Approve Special Event Permit for Hugo Legion for Craft Show/Octoberfest on Saturday, October 5, 2024 The Hugo American Legion Post 620 had applied for a Special Event Permit for their annual Craft Show and Oktoberfest Celebration to be held on Saturday, October 5, 2024. This event required a Special Event Permit approved by Council because there was expected to be about 200 people in attendance, alcohol sold outdoors, and music outside until approximately 9 p.m. Adoption of the Consent Agenda approved the Special Event Permit for the Hugo American Legion Post 620 in accordance with their application and conditions in the memo. Approve Pay Request No. 6 to Arnt Construction for 159th Street/TH61 Roundabout Arnt Construction Company had submitted Pay Request No. 6 in the amount of $36,209.06 for work certified through August 8, 2024, on the TH61/159th Street Roundabout Improvement Project. The project was substantially complete at this time and the retainage had been reduced to 1%. Adoption of the Consent Agenda approved payment to Arnt Construction Company in the amount of $36,209.06. Approve Renewal of Mining Permit for Mike Atkinson The Mining Permit for Mike Atkinson on his property located on the south side of 147th Street between Irish and Hyde Avenue expired on August 2, 2024. Atkinson had applied for a renewal of the permit for another two years. For the past several years, the site has been used to stockpile material, with no mining activity taking place. When the permit was renewed in 2012, the Council allowed Mike Atkinson to move forward with the Mining Permit renewal process without all the conditions being met until the time mining operations began again, due to the cost of meeting those conditions. The requirements not being met were to biannually provide a topographic map of the site, calculation of stockpiled material, amount of granular material left on site to be mined, and a reclamation plan. Staff had found very minimal activity on the site to require those conditions be met for the renewal of his permit. Adoption of the Consent Agenda approved the Mining Permit for Mike Atkinson for property located on 147th Street North with the condition that all requirements in the permit be met when mining activity begins again. Approve Resolution Approving Encroachment Agreement for 16180 Finale Avenue North Brooke Feyen and John Finney had requested an encroachment agreement to allow construction of a fence within a drainage and utility easement on property located at 16180 Finale Avenue North. The Senior Engineering Technician had reviewed the location of the fence and was comfortable with the request. Adoption of the Consent Agenda approved the RESOLUTION 2024-36 APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW CONSTRUCTION OF A FENCE WITHIN A DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT 16180 FINALE AVENUE NORTH Council Meeting Minutes for September 3, 2024 Page 4 of 5 Declare Cost to be Assessed and Set Public Hearing for 2024 Street improvement Project (125th Street and Dellwood Ridge) On April 15, 2024, the City of Hugo awarded the Contract for 125th Street and Dellwood Ridge Development Street Project to Dresel Contracting, Inc. As part of the public improvement process, in accordance with the requirement of MN Statutes Chapter 429 for assessments to benefitting properties, the City needed to declare the costs to be assessed and conduct the assessment hearing. City Administrator Bryan Bear informed the Council that the project was nearing completion. Heather Avenue and Upper Heather Avenue were complete through the first lift of asphalt, and restoration and seeding would be taking place the following day. On 125th Street, the reclamation project had both layers of asphalt complete, and the crews were out that day doing gravel shouldering. The total project cost was $2,877,000, and the amount to be assessed was $258,500. Assessment rates were applied according to the City’s Assessment Policy. For the complete reconstruction of Upper Heather Avenue and Heather Avenue, the assessment would be $5,200 per unit. For the reclamation and overlay on 125th Street, the assessment would be $3,400 per unit. Bear recommended Council approve the resolution declaring the costs to be assessed and ordering the preparation of the proposed assessment roll for the project and the resolution calling for a public hearing to be set for October 7, 2024. At the mid‐year budget workshop it was the consensus of the City Council that the 2025 preliminary tax levy provide for additional funds to help fund currently unfunded future road, bridge, and trail maintenance projects. Using preliminary tax capacity data provided by Washington County, the total proposed 2025 property tax levy of $12,847,855 will move the urban tax rate to 39.190% of tax capacity. These taxes are used to make principal and interest payments on general obligation bonds issued by the city. The total levy for debt service in 2025 is $997,855. General Operating Levy The levy for general operating purposes is $9,140,036. This levy is used, along with non‐property tax revenues, to fund general government, public safety, public works, and other city operations. This levy is needed to balance the general fund with no structural deficit (i.e. transfers from other funds). The proposed tax levy provides for a salary matrix adjustment, a cost‐of‐living adjustment, step increases, and health insurance premium coverage for eligible employees for the 2025 calendar year. Street Capital Improvement Program Levy First instituted in 2006, this levy is used to defray a portion of the city’s share of street reconstruction projects. The proposed levy for 2025 is $2,010,000, which is a $350,000 increase over the 2024 levy of $1,660,000. This would be an $850,000 increase over the historical Street CIP levy of $1,160,000. Additional dollars are being proposed to help fund currently unfunded future road, bridge, and trail maintenance projects related to Hugo’s aging infrastructure. These funds will allow us to continue improving our network of streets and trails without the need to issue additional debt. Equipment Purchasing Levy This levy is needed to replace big ticket equipment items in the Public Safety and Public Works Departments that have exceeded their useful life. These items include plow trucks, pickup trucks, dump trucks, and firefighting vehicles. New equipment prices are ever increasing and in order to be able to fund future Public Safety and Public Works equipment the proposed levy for 2025 is $300,000. Storm Water Improvement Levy This levy is needed to fund water reuse projects and improvements to our drainage systems, including the repair and/or replacement of catch basins. Eventually funds will be needed to maintain our system of drainage ponds. This levy is in the amount of $278,788. 2025 Proposed Tax Levy Page 3 Park Improvement Levy First instituted in 2007, this levy is used to finance capital improvements to the city’s neighborhood park system. The proposed neighborhood park improvement levy for 2025 is $92,000. Fire Relief Levy This levy is used to accumulate funds to meet the city’s future pension obligations for the Hugo Firefighter’s Relief Association. Taxes are levied in an amount equal to the PERA employer percentage as applied to total fire department wages and salaries. These funds are placed in a special revenue fund and can only be used to make mandatory contributions to the pension fund. The levy for 2025 is $29,176. Certified Property Tax Levy The total amount of property taxes to be certified to the county for inclusion in the truth‐in‐taxation notices amounts to $12,847,855. Fiscal Disparities Fiscal Disparities is a program designed by the state legislature to distribute a portion of growth in commercial and industrial tax values to cities in the seven‐county metropolitan area. Historically, the City of Hugo has been a “winner” in that we receive more value from the pool than we contribute. Washington County has certified the payable 2025 amount of $1,015,758, an increase of $128,244 from the previous year. This amount serves to lower the total property tax dollars paid by residents of the city. Pay 2025 Proposed Certified Property Tax Levy $ 12,847,855 Less: Fiscal Disparities $ (1,015,758) Local Portion of Levy $ 11,832,097 Taxable Market Value and Tax Capacity The county tax department has released a preliminary estimate of taxable market value and tax capacity data for next year. The county estimates a decrease in the total tax capacity of 3%. These numbers will most likely change when the county releases “final” numbers prior to the budget adoption meeting scheduled for December 2, 2024. 2025 Proposed Tax Levy Page 4 Tax Rates The total proposed 2025 property tax levy of $12,847,855 will move the urban tax rate to 39.190% of tax capacity. The tax on this homestead will decrease as follows, largely due the to the changes in the Homestead Market Value Exclusion Program’s maximum exclusion amount: Pay 2025 Percent Change City Tax on Median Value Homestead: Median Taxable Value Prior to Exclusion $ 389,400 -5.01% Market Value Exclusion $ (11,504) Median Taxable Value After Exclusion $ 377,896 -7.74% Tax Capacity $ 3,779 Net Tax $ 1,481 -1.00% Dollar Change $ (15) 2025 Proposed Tax Levy Page 5 Maximum Tax Levy The preliminary tax levy adopted by the Council on September 16, 2024 can be decreased (but not increased) following the budget and tax levy public hearing in December. Thus, the preliminary levy needs to be set at the maximum amount that the Council determines is appropriate. Conclusion The proposed tax levy provides for a balanced operating budget while meeting the Council’s objectives to begin funding future unfunded road, bridge, and trail maintenance projects. The urban tax rate will move to 39.190% of tax capacity, which will provide additional funds for currently unfunded infrastructure projects. Staff has reviewed recent road rating data that is currently being completed in 2024 and have developed an updated 5-year Capital Improvements Plan that City Council had reviewed as part of the August 29, 2024 work session. Attached is the draft map highlighting the proposed capital improvements as well as the associated costs for years 2022-2026. We have worked closely with Finance Director Wobse regarding long term financial planning. Another Council work session is scheduled for this fall to further evaluate the full 5-year CIP and associated funding needs. Staff is recommending moving forward with the Capital Improvement Plan Project(s) identified for 2025 in the draft Capital Improvement Plan as the public improvement process is lengthy. Staff is recommending that these projects be go through separate public improvement processes due to differences in types of construction, and locations. Staff is requesting authorization to prepare feasibility studies for both the 2025 Beaver Ponds Area Street Improvement Project and the 2025 Duck Pass, Palmes Long Lake Estates and Ingersoll Avenue Neighborhood Street Improvement Project. If authorized, staff will notify residents of this effort and coordinate early informational meetings about the proposed project. Tom Weidt, Mayor ATTEST: Michele Lindau, City Clerk Proclamation City of Hugo Honoring Jerome "Jerry" Saunders for his Exemplary Military Service and Celebrating His 100th Birthday WHEREAS, the City of Hugo profoundly appreciates the sacrifices made by our veterans in defending the freedoms we cherish, and believes in recognizing them for their bravery, service, and commitment to our nation; and WHEREAS, Jerome "Jerry" Saunders was born on September 28, 1924, in St. Paul, Minnesota, where he grew up and spent much of his life contributing to the community; and WHEREAS, Jerry valiantly served as a seaman during World War II, where he was stationed in England for six months to prepare for the D-Day invasion of France, playing a vital role in driving a landing ship tank (LST) during the historic landings on Normandy Beach; and WHEREAS, after his military service, Jerry married his beloved wife, Marilyn, and together they raised three children—Dean, Steve, and Debra—while living on St. Paul's West Side; and WHEREAS, Jerry worked diligently for 35 years as a wholesale milk driver for the Minnesota Milk Company, demonstrating his strong work ethic and commitment to providing for his family and community; and WHEREAS, communities are enriched by the presence of individuals like Jerry Saunders, who embody our living history and have contributed so much to our society, making the celebration of his 100th birthday an extraordinary and joyous occasion; NOW, THEREFORE, the Hugo City Council, on behalf of the citizens of Hugo, do hereby honor and thank Jerome "Jerry" Saunders for his distinguished military service and lifetime contributions, and extend heartfelt congratulations to him on this momentous occasion of his 100th birthday.
