APPROVING A CONDITIONAL USE PERMIT FOR SCOTT AND LEANN NEAMY TO
CONSTRUCT AN ACCESSORY APARTMENT FOR THE PROPERTY LOCATED AT
17220 KEYSTONE AVENUE NORTH
WHEREAS, Scott and LeAnn Neamy have requested approval of a conditional use permit to allow
the construction of a 900 square foot building addition, to be used as an accessory apartment, at
the property located at 17220 Keystone Avenue North.
WHEREAS, the property is legally described as follows:
The North Half of the North Half of the Southeast Quarter of the Southeast Quarter of
Section 1, Township 31, Range 21, Washington County, Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit to
allow the construction of a 900 square foot building addition to be used as an accessory
apartment, subject to the following findings:
I. The use is permissible by law.
2. The spirit and intent of the ordinance is to allow for living facilities dedicated for the use
of persons living separately from others in the building, while maintaining a single-
family residence as the primary use of the property. The existing building has an area of
2,710 square feet, of which 1,798 square feet is occupied by the house. The proposed
building addition is approximately 900 square feet, so staff is considering its footprint to
be accessory to the existing building. The proposed building addition will not dominate
the appearance of the property or the house it is attached to. The requested accessory
apartment is keeping with the spirit and intent of the ordinance.
3. The use will not substantially alter the residential character of the property, which is a
typical use in areas that are zoned and guided as Agricultural. The City's Comprehensive
Plan identifies this area as Agricultural. The proposed use is compatible with the City's
comprehensive plan and the character of the surrounding area.
4. The proposed use has adequate drainage, water supply, and utilities.
5. The property has adequate road access from Keystone Avenue North.
6. The site is not located within a floodplain area and the project is not proposing any
impacts to floodplain.
7. The site is not located adjacent to the public waters.
8. The site is not located in the shoreland overlay district.

9. The project is not proposing any wetland impacts.
10. The applicant shall be responsible for all necessary state and local permits.
11. Prior to the issuance of a building permit, the applicant shall obtain a septic permit from
Washington County.
12. The site is screened by some trees between the existing house and the road. The house
and proposed building addition will be set back approximately 750 feet from the road,
and the proposed building addition will not dominate the appearance of the property from
the view of the road.
