G. 1 Approval of Claims Staff recommends Council approve the Claims Roster as presented. G.2 Approve Annual Performance Review for Finance Director Anna Wobse Anna Wobse was hired as the City’s Accounting Clerk on October 27, 2008, and has worked in accounts payable and payroll functions. In March 2018, Council approved Anna as the new Finance Coordinator and in October 2021 as the new Finance Director. City Administrator Bryan recommends Council approval of the annual performance review for Finance Director Anna Wobse G.3 Approve Daniel Koch as New Historical Commissioner There are vacant positions on the Historical Commission for a regular member and two associate members. Daniel Koch had met the Hugo Historical Commission at their display during Good Neighbor Days and had since been attending meetings and applied to be on the Commission. The Commission requested Council formally appoint him as a regular member. Staff recommends Council approve Daniel Koch as a new Historical Commissioner with a term ending December 31, 2024. G.4 Approve Donation to the Hugo Fire Department from the Hugo American Legion The Hugo Lions Club would like to donate $1,000 to the Hugo Fire Department for equipment and training. Donations to the Fire Department must be approved by the City Council. Staff recommends Council approve the donation of $1000 from the Hugo American Legion to the Hugo Fire Department. G.5 Approve Partnership Agreement between Washington Conservation District and Members of EMWREP-Lower St. Croix Water Education Program In March 2016, Council first approved membership to the East Metro Water Resource Education Program (EMWREP) as part of the SWPPP educational component. This was an agreement between Washington Conservation District and Members of the EMWREP with common objective to educate citizens about water resources, stormwater, and groundwater management. This partnership allows the City to more efficiently deliver water resource education and meet the MS4 permit education requirement. This agreement was renewed for another three years in both January 2019 and January 2022 and will expire in January 2025. Staff recommends Council approve the agreement between Washington Conservation District and members of the EMWREP in the annual amount of $3500 for another three years. G.6 Approve JPA with Washington County for Mass Emergency Notification System (Code Red) The City’s current Joint Powers Agreement with Washington County for Code Red will expire on December 31, 2024. The new agreement will go into effect on January 1, 2025, and will remain in effect until one or both parties terminate the agreement. Beginning in 2025 there will no longer be an annual fee. Staff recommends Council approve the JPA with Washington County for the Mass Emergency Notification System (Code Red). G.7 Approve Resolution Appointing Election Judges for the 2024 General Election The Hugo City Council must pass a resolution approving the appointment of election judges for the General Election on November 5, 2024. Staff has prepared a resolution with a list of 57 judges who have signed up to work the General Election and have completed the required training. Staff recommends Council approve the resolution appointing election judges for the 2024 General Election. G.8 Approve Resolution Approving Minor Subdivision on Jefferey Avenue-Craig Anderson Craig Anderson is requesting a minor subdivision of an unaddressed parcel located on Jeffrey Avenue North. The request is to split the 20-acre parcel into two 10-acre parcels. At its September 26, 2024, meeting, the Planning Commission held a public hearing and considered the request. No one spoke during the public hearing. After discussing the request, the Planning Commission voted unanimously to recommend approval of the minor subdivision request. Staff is recommending approval of the resolution approving the minor subdivision request for the property located on Jeffrey Avenue North. G.9 Approve Resolution Approving CUP for Accessory Apartment at 17200 Keystone Avenue-Scott and Leann Neamy Scott and LeAnn Neamy are requesting approval of a conditional use permit (CUP) to allow for the construction of a 900 square foot building addition to be used as an accessory apartment, for the property located at 17200 Keystone Avenue North. Accessory apartments are allowed as a conditional use in the Agricultural zoning district. At its September 26, 2024 meeting, the Planning Commission considered the request and held a public hearing. No one spoke during the public hearing. After discussing the request, the Planning Commission voted unanimously to recommend approval of the CUP. Staff is recommending approval of the resolution approving the CUP request for an accessory apartment at 17200 Keystone Avenue North. G.10 Approve Ordinance Allowing Tobacco Shops as Permitted Use in Central Business District At its meeting on Thursday, September 26, 2024, the Planning Commission held a public hearing and considered the text amendment. There was one person to spoke during the meeting that asked if they could sell CBD products. Staff stated they would need to be legal products to sell CBD related items. The Planning Commission discussed parking and how Washington County conducts compliance checks. After discussion the Planning Commission unanimously recommended approval of the ordinance approving the text amendment. G.11 Approve Ordinance Amending the Controlled Shooting Area Map At its June 3, 2024, meeting, Council authorized staff to draft an amendment to the Shooting Ordinance to update the Controlled Shooting Area Map. This map was adopted as part of the Shooting Ordinance in May, 2010, and identifies areas in the City where there are restrictions on shooting. Staff has amended the map to expand the controlled shooting area to include properties that have since been developed with neighborhood homes and parks. Staff recommends Council approve the amendment to the Shooting Ordinance revising the Controlled Shooting Area Map. G.12 Approve Reduction in Letter of Credit for Meadows at Hugo 2nd Addition Meadows at Hugo 2nd Addition has had significant work completed to date and Centra Homes, LLC is requesting a reduction in the letter of credit. The current letter of credit for the 2nd Addition is in the amount of $1,008,735. Staff has inspected the work completed to date and recommends reducing the letter of credit by $907,862 based on the value of work remaining to be completed. The remaining value of the letter of credit will be in the amount of $100,873, which is 10% of the original amount. Staff recommends Council approve the reduction in the letter of credit for Meadows at Hugo 2nd Addition. G.13 Approve Reduction in Letter of Credit for The Shores of Oneka 3rd and 4th Additions The Shores of Oneka 3rd and 4th Additions have had significant work completed to date and the developer is requesting a reduction in the letter of credit for both the 3rd and 4th Additions. The current letter of credit for the 3rd Addition is in the amount of $3,567,600. Staff has inspected the work completed to date and recommends Council approve the reduction in the letter of credit to $356,760 based on the value of work remaining to be completed. The current letter of credit for the 4th Addition is in the amount of $738,905. Staff has inspected the work completed to date and recommends Council approve the reduction in the letter of credit to $81,267 based on the value of work remaining to be completed. H.1 Proposed Assessments for 2024 125th Street and Dellwood Ridge Neighborhood Street Project On April 15, 2024, City Council awarded the contract for the 2024 125th Street and Dellwood Ridge Street Improvements Project to Dresel Contracting. At the September 3, 2024, regular Council meeting, the Council adopted a resolution declaring costs to be assessed for the 2024 125th Street and Dellwood Ridge Street Improvements Project and scheduled the assessment hearing on the proposed assessments for October 7, 2024. The Notice of Assessment Hearing has been published in the official newspaper and mailed to the owners of each parcel described in the assessment roll at least two weeks prior to the hearing. As part of the assessment hearing, staff will give a PowerPoint presentation identifying the improvements, costs and detail payment options. Staff recommends Council approve the resolution adopting assessments for the 2024 125th Street and Dellwood Ridge Street Improvements Project. I.1 Recap of Workshop on Solar Farms and Residential Zoning Text Amendments A joint workshop was held on Thursday, September 19, 2024, with the Planning Commission to discuss the solar farm ordinance and residential zoning text amendments. Staff will provide Council a recap of that meeting. J.1 Recap of Waters Edge Community Meeting A meeting was held with the Waters Edge residents on Wednesday, September 2, 2024, to discuss public safety issues. The meeting was attended by Mayor Tom Weidt, Councilmember Phil Klein, and members of staff. Staff will provide a recap of that meeting. M.1 Reminder – Hugo Citywide Bus Tour on Saturday, October 5, 2024 The Council has scheduled the Hugo Citywide Bus Tour for Saturday, October 5, 2024. The tour will begin and end at the North Star Elementary School. Bus will begin loading at 9:45 a.m. for a 10 a.m. departure and return at approximately noon for lunch. M.2 Reminder - Hugo Fire Department Open House on Saturday, October 5, 2024 The Hugo City Council has scheduled a meeting to attend the Fire Department Open House on Saturday, October 5, 2024, from 11 a.m. – 3 p.m. M.3 Schedule Neighborhood Meetings for 2025 Street Project for Tuesday, October 22, 2024 Staff is requesting Council schedule neighborhood meetings for the 2025 street improvement projects to be held on Tuesday, October 22, 2024. The meeting to discuss street improvements in the Beaver Ponds Development area will be held from 6-7 p.m. The meeting to discuss street improvements in Duck Pass and Palmes Long Lake Estates Developments and in the Ingersoll Avenue North neighborhood will be held from 7:15 – 8:15 p.m. Both meetings will take place in the Peder Pedersen Pavilion. Staff recommends Council schedule these meetings. M.4 Schedule Board of Canvass for Tuesday, November 12, 2024 The Board of Canvass is required to meet between 3-10 days after the General Election. Hugo City Council acts as the Board of Canvass. The General Election will be held on November 5, and the Board must meet between November 8-15 to canvass the results. Staff recommends Council schedule the Board of Canvass meeting for Tuesday, November 12, 2024, at 6 p.m. in the Council Chambers. M.5 Schedule Holiday Party for Thursday, December 5, 2024 Annually, Council holds a holiday party in appreciation for staff and commissioners. Council Meeting Minutes for September 16, 2024 Page 2 of 5 Good Neighbor Days Recap – Lions Member Carrie Schwieger The Hugo Lions Club held Good Neighbor Days on June 7-9, 2024, for the first time at the new Lions Park and Pede Pedersen Pavilion. Lions Club President Carrie Schwieger provided Council a recap of the event. Also attending the meeting were Vice President Chris Clausen and Lions Members Pede Pedersen and John Kelly. Carrie said this was the 48th year of Good Neighbor Days, and she had been in charge of organizing it. In preparation, members of the Club visited other fall festivals. New this year was Pickleball, Hugo’s Got Talent show, and Fingerboarding demonstrations. Returning events from last year were the Ribfest, Parade, Kidfree Zone, Cornhole Tournament, live music, and fireworks. There was also 35 craft and business fair booths, and they hoped to collaborate with the Hugo Area Business Association on that next year. In the pavilion building they had Bingo and the Historical Commission display. For next year, they needed to work on access to the building to keep it locked at certain times and have handouts because the Historical Commission was getting a lot of questions. It was acknowledged that parking was a challenge, and they would be talking about increasing the use of the free shuttle next year. The organizer for next year’s event would be the current Vice President Chris Clausen. Carrie said they made around $70,000 that goes into their operating fund and is used for Food Shelf and Yellow Ribbon donations, school scholarships, emergency relief, senior dinners, and random requests that are voted on by the Club. Approve Resolution Approving Preliminary Tax Levy for 2025   At its August 29, 2024, Midyear Budget Workshop, the City Council listened to a presentation from Finance Director Anna Wobse highlighting revenues and expenditures to-date as well as projections for the 2025 fiscal year. City Engineer Mark Erichson also presented to the Council an updated five-year Street Capital Improvement Plan, and a discussion was had about future unfunded infrastructure projects. It was the consensus of the Council that the 2025 preliminary levy revert back to following the flat tax rate policy in order to provide additional funds for Council Meeting Minutes for September 16, 2024 Page 3 of 5 future infrastructure projects. The total proposed 2025 property tax levy of $12,847,855 would move the urban tax rate to 39.190% of tax capacity. Staff believed this levy was sufficient to fund the operating and capital budgets in 2025 and meets the objectives of the City Council to begin funding future infrastructure projects. Adoption of the Consent Agenda approved RESOLUTION 2024-39 APPROVING PRELIMINARY TAX LEVY PAYABLE IN 2025. Approve Pay Request No. 4 Dresel Contracting for 125th Street and Dellwood Ridge Streets Improvement Project Dresel Contracting, Inc. had submitted Pay Request No. 4 in the amount of $219,282.52 for work certified through August 30, 2024, on the 2024 125th Street/Dellwood Ridge Neighborhood Improvement Project. The first layer of asphalt had been placed along Heather and Upper Heather Avenues and restoration work had begun. Adoption of the Consent Agenda approved the payment to Dresel Contracting, Inc. in the amount of $219,282.52. Approve Resolution Creating a New Special Revenue Fund The City of Hugo had received miscellaneous revenues from the State of Minnesota in the form of Public Safety Aid and Local Affordable Housing Aid. These funds needed to be accounted for separately from other already established funds for tracking and reporting purposes. Generally Accepted Accounting Principles (GAAP) and the Governmental Accounting Standards Board’s (GASB) Statement Number 54 provided special revenue funds to account for and report the proceeds of specific revenue sources that were restricted for specified purposes. The new special revenue fund would be used to track and report on miscellaneous revenues received from the State of Minnesota that need to be accounted for separately. Adoption of the Consent Agenda approved RESOLUTION 2024 – 40 CREATING A NEW SPECIAL REVENUE FUND TO ACCOUNT FOR MISCELLANEOUS REVENUES RECEIVED FROM THE STATE OF MINNESOTA Approve Preparation of Feasibility Study for 2025 Road Projects At the Midyear Budget Workshop, staff was directed to hold a workshop to discuss the street CIP and funding. This meeting has been scheduled for Monday, October 28, 2024. City Engineer Mark Erichson suggested Council be ready to take the next step to prepare for the 2025 projects. The proposed 2025 Capital Improvement Project included roads in the Beaver Ponds Development and streets in Duck Pass, Palmes Long Lake Estates, and the Ingersoll Avenue neighborhood. Erichson explained the process would benefit from having them handled separately but the projects should be done at the same time for better bid results. He said if the Council approved it, there would be two separate neighborhood meetings to explain project and get feedback. Respectfully Submitted, Michele Lindau, City Clerk MINUTES City Council & Planning Commission Joint Workshop City Hall Conference Room Thursday, September 19, 2024 6 p.m Mayor Weidt called the meeting to order at 6:00 PM COUNCIL PRESENT: Weidt, Miron, Klein, Strub, Petryk PLANNING COMMISSION PRESENT: Petty, Arcand, Lessard, Andress, Kleissler, Derr, Granger ABSENT: Kelly STAFF PRESENT: Community Development Director Rachel Juba, Associate Planner Max Gort, Consulting City Planner Kendra Lindahl, Community Development Intern Phoebe Brown Solar Farm Discussion Associate Planner Max Gort presented background information on solar farms in Hugo, including the history of the City’s ordinance, feedback toward Hugo’s first solar farm and other proposed projects, and an overview of ordinance revisions, a tabled text amendment prohibiting solar farms and the 2024 moratorium. Gort explained the Metropolitan Council’s position on solar farms, which seeks to protect solar access but discourage solar installation on “prime farmland.” Gort explained that staff believe the current ordinance keeps visual and other impacts low, but community members are concerned about the impact to the character of the area regardless. Gort presented a few options to the Council and Commission, including leaving the ordinance as-is, sending the ordinance to the Ordinance Review Committee to discuss more revisions, and bringing the tabled amendment prohibiting solar farms to the City Council. The Council and Commission discussed possible changes to the ordinance. They discussed increasing to a 20-acre minimum requirement, and whether restrictions could be put in place to discourage solar installation close to neighboring houses or on prime farmland. The Council and Commission directed staff to send the ordinance back to the Ordinance Review Committee to consider a 20-acre requirement and other changes that might help maintain neighborhood character. Residential Zoning Standards Discussion Consulting City Planner Kendra Lindahl presented on residential zoning standards, including a discussion of housing types, district uses, and multi-family design guidelines. Lindahl addressed the need to update the code for usability, eliminate uses without definitions, decrease reliance on PUDs, and update design guidelines. Lindahl discussed considering creating a new district with smaller lot sizes and raising the building height maximum from 35 to 45 feet. The Council and Commission discussed how the building height maximum impacts multi-family design, where apartments and mixed-use should be allowed, and how smaller lot sizes may or may not impact affordability. Lindahl explained that the next step in this discussion is a meeting with developers on October 29th. PARTIES This Agreement is made and entered into by Washington Conservation District, hereinafter referred to as HOST, and members of the East Metro Water Education Program (EMWREP), hereinafter referred to individually as a PARTNER. A PARTNER is defined as an entity that executes this agreement, and this Agreement provides for the withdrawal or addition of PARTNERS to EMWREP. Eligible PARTNERS include counties, watershed organizations, lake improvement districts, and municipalities within the Twin Cities East Metro and Lower St. Croix Watershed of Minnesota. B. PURPOSE WHEREAS, the PARTNER and the HOST have a common objective of educating the citizens of the East Metro and Lower St. Croix Watershed about water resource, stormwater, and groundwater management in order to improve water quality; and WHEREAS, the PARTNER has identified a need for education assistance; and WHEREAS, counties, watershed organizations, lake improvement districts, and municipalities within the East Metro and Lower St. Croix Watershed have education components in their respective watershed management plans; and WHEREAS, 25 communities in Washington County and 5 communities within the Lower St. Croix portions of Anoka, Chisago and Isanti Counties are required to obtain a Municipal Separate Storm Sewer System (MS4) Permit from the Minnesota Pollution Control Agency (MPCA), which requires nonpoint source pollution education; and WHEREAS, the PARTNER agrees it is in its best interest to define its respective responsibilities and obligations; and WHEREAS, the PARTNER agrees that collaborative efforts are needed to more effectively and efficiently deliver water resource education and meet MS4 permit education requirements; and WHEREAS, the PARTNER requests assistance from the HOST to implement the policies specified in MINN. STAT. §§ 103A.206; and WHEREAS, the HOST is authorized to enter agreements to provide such assistance pursuant to MINN. STAT. §§ 103C.331, SUBD. 3 and 7. NOW, THEREFORE, the PARTNER agrees as follows: C. TERM OF CONTRACT The term of this agreement shall be from January 1, 2025 to December 31, 2027 unless extended or terminated earlier as provided herein. D. MEMBERSHIP STRUCTURE In accordance to the program goals of collaboration and partnership, entities may become a PARTNER by signing the Signature Page at the end of this Agreement. A new PARTNER shall apply to the HOST and sign a separate contract and its signature page shall be attached to the original document. The HOST will coordinate with each PARTNER, update the project budget, and distribute it to each PARTNER. 2 Each PARTNER will assign a member to the EMWREP Steering Committee. This Committee will assist the EMWREP Coordinator and HOST to prepare the Annual Workplan, Annual Budget, and Annual Report. A Membership Summary will be included in the Annual Report prepared by the HOST. E. SCOPE OF SERVICES The HOST will perform for the PARTNER the services and furnish and deliver work products generally described in Exhibit A, attached and made part of this agreement. Services for a specific PARTNER will be defined in the Annual Workplan developed as described in Exhibit A. PARTNER-specific services will constitute approximately 15% of the total Annual Workplan. Eighty-five (85) percent of the total Annual Workplan will be committed to shared, multi-jurisdictional benefit educational activities. F. COST In full consideration for services under this agreement, the PARTNER shall provide its portion of the annual costs to the HOST in accordance with the executed Signature Page at the end of this Agreement. The total annual budget for the program is as shown in Exhibit B with contributions outlined in Paragraph G. If all PARTNER contributions total less than the Total Budget, educational material expenses not otherwise paid for will not be incurred. PARTNER’s annual contribution may be increased from the amount stated in the Signature Page at the end of the Agreement only with approval of PARTNER’s governing body. G. FUNDING STRUCTURE Each PARTNER is suggested to contribute annually in accordance with the following funding structure. County or SWCD (Population > 100,000): $16,300/year County or SWCD (Population < 100,000): $8,000/year County or SWCD partially within the Lower St. Croix watershed: $1,600/year Small Watershed Districts (Taxable Market Value < $1 Billion): $16,000/year Medium Watershed Districts (TMV $1-5 Billion): $24,500/year Large Watershed Districts (TMV >$5 Billion): $32,000/year Watershed Management Organizations and Lake Improvement Districts: $8,000/year Large MS4 Cities (Population > 5,000): $3,500/year Small MS4 Cities (Population > 5,000): $900/year An annual COLA/infllation adjustment of 4% will be added for year 2 and year 3 of the agreement. In-kind matches from existing educational staff from within partner organizations are also encouraged. The WCD shall provide $16,172.82 of in-kind match to the program per year. As shown in Exhibit B, PARTNER contributions will be reviewed and adjusted on an annual basis, as needed. H. PAYMENTS 1. The services in Exhibit A provided by the HOST will be billed in accordance to Exhibit B. Invoices will be sent on a quarterly basis and will summarize the work performed. Invoices are payable within 60 days. 2. Office supplies, in-house reproduction expenses, and transportation are included in the overhead noted above. Out source reproduction, special bulk mailings and other direct costs beyond the actual current budget as established in accordance with the Annual Workplan (the combined contributions of each PARTNER) noted in Paragraph F are to be reimbursed at actual cost with prior approval from the PARTNERs. 3 I. EQUAL EMPLOYMENT OPPORTUNITY- CIVIL RIGHTS During the performance of this Agreement, the HOST agrees to the following: No person shall, on the grounds of race, color, religion, age, sex, disability, marital status, public assistance, criminal record, creed or national origin, be excluded from full employment rights in, be denied the benefits of, or be otherwise subjected to discrimination under any program, service, or activity under the provisions of and all applicable federal and state laws against discrimination including the Civil Rights Act of 1964. J. STANDARDS The HOST shall comply with all applicable Federal and State statutes and regulations as well as local ordinances now in effect or hereafter adopted. Failure to meet the requirements of the above may be cause for cancellation of this contract effective the date of receipt of the Notice of Cancellation. K. DATA PRIVACY All data collected, created, received, maintained, or disseminated, or used for any purpose in the course of the HOST’s performance of the Agreement is governed by the Minnesota Government Data Practices Act, Minnesota 1984, Section 13.01, et seq. or any other applicable state statutes and state rules adopted to implement the Act, as well as state statutes and federal regulations on data privacy. The HOST agrees to abide by these statutes, rules and regulations and as they may be amended. L. AUDITS, REPORTS, AND MONITORING PROCEDURES The HOST will: 1. Maintain records that reflect all revenues, cost incurred and services provided in the performance of the Agreement. 2. Agree that the County, the State Auditor, or legislative authority, or any of their duly authorized representatives at any time during normal business hours, and as often as they may deem reasonably necessary, shall have access to the rights to examine audit, excerpt, and transcribe any books, documents, papers, records, etc., and accounting procedures and practices of the HOST which are relevant to the contract. The annual audit conducted for the Washington Conservation District that includes EMWREP activities. M. INDEMNITY No party to this Agreement agrees to be responsible for the acts or omissions of another, its agents, officials, contractors or employees within the meaning of Minnesota Statutes section 471.59, subdivision 1a. Each PARTNER and HOST will hold harmless, defend and indemnify all other parties to this Agreement, their officers, board members, employees and agents for any and all damage, liability, cost or claim (including reasonable attorneys’ fees) to the extent it is the result of its negligent act or of another action or inaction that is the basis for its liability in law or equity. The PARTNER agrees to provide proof of contractual liability insurance upon request. This paragraph does not constitute a waiver or otherwise diminish, any statutory or common law defense, immunity or limit on liability any PARTNER or HOST may enjoy as against any third party. N. INDEPENDENT CONTRACTOR It is agreed that nothing herein contained is intended or should be construed in any manner as creating or establishing the relationship of co-partners between the parties hereto or as constituting the HOST as the agent, representative, or employee of PARTNER organization for any purpose or in any manner whatsoever. The HOST is to be and shall remain an independent contractor with respect to all services performed under this Agreement. 4 The HOST represents that it has, or will secure at its own expense, all personnel required in performing services under this Agreement. Any and all personnel of the HOST or other person, while engaged in the performance of any work or services required by the HOST under this Agreement, shall have no contractual relationship with the PARTNER and shall not be considered employees of the PARTNER. O. MODIFICATIONS Any material alteration or variation shall be reduced to writing as an amendment and signed by the parties. Any alteration, modification, or variation deemed not to be material by written agreement of the HOST and the PARTNER shall not require written approval. Contract extensions will be handled as a material alteration. P. MERGER It is understood and agreed that the entire agreement of the parties is contained here, except as modified during the term of the Agreement by a writing under Paragraph O above concerning a non-material change, and that this contract supersedes oral agreements and negotiations between the parties relating to this subject matter. All items referred to in this contract are incorporated or attached and deemed to be part of the contract. Q. TERMINATION This Agreement will commence when executed by HOST and all PARTNERS and will continue until terminated. The Agreement will commence with respect to each additional PARTNER on that PARTNER’S execution of a signature page acceding to the terms of the Agreement. This Agreement will terminate immediately upon completion of the activities enumerated herein and the program duration expires. Any party to this Agreement may withdraw participation on an agreement-year basis with 60 days written notice to HOST prior to the annual anniversary date of the Agreement, with the actual termination date falling on the anniversary date. Pro-rated contributions will be returned to the terminated or terminating PARTNER. The HOST will promptly notify all PARTNERS of any PARTNER’s termination. Termination by any one PARTNER will not constitute the termination of this Agreement. If HOST determines that PARTNER termination has resulted in inadequate funds to deliver the work products generally described in Exhibit A, the HOST will terminate the Agreement effective the anniversary date unless adequate funds can be procured. Termination by the HOST will constitute termination of this Agreement in whole and pro-rated contributions will be returned to each PARTNER. R. OWNERSHIP OF DOCUMENTS AND INTELLECTUAL PROPERTY All property of the HOST or a PARTNER used, acquired or created in the performance of work under this Agreement, including documents and records of any kind, shall remain the property of the HOST and the PARTNER providing the property. The HOST and PARTNERS shall jointly own and each party has the individual right to use, sell, license, publish, or otherwise disseminate any product developed in whole or in part during the performance of work under this Agreement. Hire, employ and supervise Water Resource Educators that will successfully serve the education needs as prescribed herein. 2. Obtain financial reimbursement from each PARTNER as prescribed in this agreement. 3. Work in good faith to achieve the goals identified in this agreement. 4. Maintain a strict accounting of all financial transactions. 5. Develop and disseminate annual summaries of accomplishments and budgetary analysis to EMWREP partners. 6. Provide office space, office furniture, computer, transportation, and phone. Equipment purchased by the HOST will remain the property of the HOST following the term of this agreement. Develop annual plan of work with the EMWREP Steering Committee. Workplan will reference MS4 education programs and PARTNERS water and education plans. 4. Implement annual work plan, including planning, implementing, evaluating, and reporting on such anticipated activities as presentations, workshops, in-field training, demonstration projects, and published materials. 5. The County agrees to enter into a contract for the purchase of sufficient minutes annually for  the System.     2. The County will develop a policy related to the use and maintenance of the System.    2 3. The County will assign an employee as the System administrator.    4. The County agrees to train the Emergency Communications Response Center, hereinafter  “ECRC”, personnel in the operation of the System.     5. The County will periodically test the System to ensure it is operating properly.    6. The County will monitor the number of minutes used by all agencies to ensure there is sufficient  minutes available in the event of an emergency.      CITY’S RESPONSIBILITIES  1. The City will conform to the policy developed by the County related to the use and maintenance  of the System.    2. The City’s representative will be responsible for notifying the County’s ECRC for emergency  notifications. Emergency notifications are defined in the policy as those that are related to  public safety or public health.      3. The City’s representative will be responsible for determining the content of any emergency  notification message, in addition to the geographic area the message is to be sent.     4. The County’s ECRC personnel will assist in preparing emergency notifications and will be  responsible for initiating the call procedures through the System at the direction of the City’s  representative.     5. The City’s representative has the option to send general notifications through a web‐based  server, or the City’s representative may contact the ECRC to send general notifications on their  behalf. General notifications are defined in the policy as those that are for the purpose of public  notification and do not meet the criteria of an emergency notification.     TERM OF AGREEMENT  The term of this agreement shall begin on January 1, 2025, the date of the signature of the parties  notwithstanding. This agreement will remain in effect until such time as one or both parties terminate  the agreement as provided herein.    TERMINATION  The County may cancel this agreement with or without cause at any time upon giving a thirty (30) days’  written notice to the City Administrator or designee.     The City may cancel this agreement with or without cause at any time upon giving a thirty (30) days’  written notice to the County Sheriff or designee.     3 COST AND PAYMENT  The minutes purchased by the County annually will be used for all emergency notifications at no cost to  the City.    The County will monitor the number of minutes available. If the number of minutes available becomes  insufficient, the County, at its discretion, will bill the City for general notification minutes used at a rate  of $0.25 per minute. These funds will be retained by the County for the sole purpose of purchasing  additional minutes. The City shall pay the County within thirty (30) days of being invoiced.     INDEPENDENT CONTRACTOR   Nothing within this agreement is intended or should be construed in any manner as creating or  establishing the relationship of co‐partners between the parties or as constituting the City as the agent,  representative, or employee of the County for any purpose or in any manner whatsoever.     ASSIGNMENT  The City shall not assign any services contemplated under this agreement.    AUDITS, REPORTS, RECORDS, AND MONITORING PROCEDURES/RECORDS AVAILABILITY & RETENTION   Pursuant to Minnesota Statute Section 16C.05 Subdivision 5, the City will:  1. Maintain all books, records, documents, and accounting procedures and practices that are  related to and/or relevant to this agreement.     2. Agree that the County, the State Auditor, or legislative authority, or any of their duly authorized  representatives at any time during normal business hours, and as often as they may deem  reasonably necessary, shall have access to and the right to examine, audit, excerpt, and  transcribe any books, records, documents, and accounting procedures and practices that are  related to and/or relevant to this agreement. The City agrees to maintain these records for a  period of six (6) years from the date of the termination of this agreement.     INDEMNIFICATION  The City agrees it will defend, indemnify, and hold harmless the County, its officers, and employees  against any and all liability, loss, costs, damages, and expenses which the County, its officers, or  employees may hereafter sustain, incur, or be required to pay arising out of the negligent or willful acts  or omissions of the City in the performance of this agreement.    The liability of the parties under this agreement shall be governed by Minnesota Statutes Section 471.59  Subdivision 1a. Each party to this agreement shall be liable for its own acts or omissions and shall not be  liable for the acts or omissions of any other party to this agreement.     INSURANCE REQUIREMENTS  The City agrees that in order to protect itself, as well as the County, under the indemnity provisions set  forth above, it will at all times during the term of this agreement, keep in force the following insurance  protection in the limits specified:     4 1. Maintain membership and participation in the League of Minnesota Cities Insurance Trust or  commercial general liability insurance with contractual liability coverage in the amount of the  City’s and County’s tort liability limits set forth in Minnesota Statute Section 466.04 and as  amended from time to time.     2. Automobile coverage in the amount of the City’s and County’s tort liability limits set forth in  Minnesota Statute Section 466.04 and as amended from time to time.     3. Request for a minor subdivision for the property located on Jeffrey Avenue North. DATE: October 2, 2024 for the City Council meeting of October 7, 2024 ZONING: Agricultural (AG) REVIEW DEADLINE: October 22, 2024 1. PLANNING COMMISSION MEETING UPDATE: At its September 26, 2024 meeting the Planning Commission held a public hearing and considered the request. No one spoke at the public hearing. After discussing the request, the Planning Commission voted unanimously to recommend approval of the minor subdivision request, subject to conditions in the resolution. 2. DESCRIPTION OF REQUEST: The applicant is requesting approval of a minor subdivision to create two 10-acre lots out of a 20-acre parcel. The property is not addressed, but is generally located west of Jeffrey Avenue North and north of 152nd Street North. 3. CONTEXT: A. Surrounding Land Use and Zoning The surrounding properties to the north, east, south, and west are zoned Agricultural and are developed as agricultural or residential homes. B. Natural Characteristics of Site The property has some sloping terrain with a steep drop off nearing a pond in the rear. There are approximately 8.5 acres of wetland on the property. 4. ANALYSIS: Anderson Minor Subdivision A. Level of City Discretion in Decision-Making The City has limited discretion in approving or denying a minor subdivision application. The City’s discretion is limited to whether or not the proposed subdivision meets the standards outlined in the Comprehensive Land Use Regulations. If it meets these standards, the City must approve the subdivision. B. Consistency with Ordinance Standards Minor Subdivision Request Lot Size The Agricultural zoning district requires a minimum lot size of 10 acres with a 300-foot minimum width and a minimum depth of 480 feet. The two proposed lots each be 10 acres in size, with a lot width and depth that exceed the minimum requirements. Utilities The property is currently outside of the Metropolitan Urban Service Area (MUSA), which means the property is not eligible to receive City sewer and water. Services are not currently available to the site or planned for the site in the future. The parcel proposed to be future home sites and would need a new well and septic system. The applicant has submitted a soil test indicating that there is sufficient space on the new parcels that is suitable for a septic system as well as an alternative septic location. The locations have been approved by Washington County. Grading and Wetlands A grading plan will have to be submitted to the City prior to the issuance of a building permit for the proposed lot. The applicant shall demonstrate the building sites will comply with the City’s regulations regarding building elevation related to groundwater. A permit will need to be obtained from the City for the location of the new driveway. Prior to the issuance of any building permit the applicant shall demonstrate that the proposed home and buildings will not impact any wetlands. Stormwater Management Prior to the issuance of any building permits the applicant shall demonstrate that the proposed parcels meet the Rice Creek Watershed District Rules regarding stormwater management and erosion control. Anderson Minor Subdivision Streets The proposed parcels have access to Jeffrey Avenue North, an existing County Road. At the time of application for a building permit, the applicant shall apply for a driveway permit as well as obtain any necessary permits from Washington County. Sidewalks/Trails There is a proposed trail in the 2040 Comprehensive Plan along Jeffrey Avenue North. Prior to the issuance of any building permit, the applicant will need to demonstrate that the proposed trail will not be impacted. Park Dedication and Open Space A park dedication is required of all land subdivided for residential purposes. The applicant will not be dedicating parkland with this project, and would therefore be responsible for the parkland dedication fee, currently set at $3,400 per lot. The applicant is only responsible to pay for the creation of 1 lot. 5. STAFF RECOMMENDATION: Staff is of the opinion that the requested minor subdivision meets the City Code requirements and guidelines outlined in the 2040 Comprehensive Plan. Staff recommends that the Planning Commission open the public hearing and take all comments. Staff recommends approval the minor subdivision subject to the conditions listed in the attached draft resolution to the Planning Commission. 6. PLANNING COMMISSION RECOMMENDATION: After considering the request and holding a public hearing, the Planning Commission voted unanimously to recommend approval of the minor subdivision request, subject to conditions in the resolution. Accessory Apartments are allowed as a conditional use in the Agricultural (AG) zoning district. The applicant has stated that the purpose of the accessory apartment is to provide care for a family member. 3. CONTEXT: A. Surrounding Land Use and Zoning Page 2 2 The properties to the north, west, and south are zoned and guided as Agricultural and consist of large lots occupied by single family homes and agricultural uses. The properties to the east are located in May Township and are zoned Rural Residential. B. Natural Characteristics of Site The site is approximately 10 acres in size, and the property owner also owns the adjoining 10 acre parcel to the north. The property has some sloping terrain with the house being located on the highest point of the site. There is some wetland on the eastern portion of the property that will not be impacted by this request. There are also a number of trees that provide screening from view of the road. 4. ANALYSIS: A. Level of City discretion in decision-making The City’s discretion in approving or denying a conditional use permit is limited to whether or not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets these standards, the City must approve the conditional use permit. B. Accessory Apartment Performance Standards 1. Accessory Apartments must comply with the city building code and the rules of the county health department. The applicant must obtain a building permit if the CUP request is approved. Prior to the issuance of a building permit, the applicant must obtain any necessary permits from Washington County. These are included as conditions in the CUP. 2. The structure in which an accessory apartment is located must be owner-occupied. The accessory apartment is proposed to be attached to an owner-occupied single-family home. 3. No separate driveway or curb cut shall be allowed for an accessory unit. The accessory apartment will be served by the existing driveway. 4. There shall be no more than one accessory apartment within any single-family structure. The applicant is not proposing any additional accessory apartments. 5. The accessory apartment may not be located in or above a garage or other accessory building except in the agricultural zoning district. Page 3 3 The accessory apartment is proposed to be located within an at -grade building addition to the existing single-family home. 6. The accessory apartment must contain its own toilet, bathtub or shower, and kitchen facilities. The applicant has indicated that the accessory apartment will contain its own kitchen and bathroom facilities. 7. The accessory apartment must not require a variance to any building setback, height, or maximum impervious surface standard established in this chapter. The proposed accessory apartment does not require any variances. B. Conditional Use Permit General Standards The Planning Commission must review the application for a conditional use permit with the standards provided in Section 90-37 in the City Code. Staff used these standards to review the application and found that the request meets the applicable standards as follows: 1. The proposed use is permissible by law. An accessory apartment is only permitted in the Agricultural zoning district by a CUP, but is otherwise permitted by law. 2. The proposed use is keeping with the spirit and intent of the ordinance. The spirit and intent of the ordinance is to allow for living facilities dedicated for the use of persons living separately from others in the building, while maintaining a single family residence as the primary use of the property. The existing building has an area of 2,710 square feet, of which 1,798 square feet is occupied by the house. The proposed building addition is approximately 900 square feet, so staff is considering its footprint to be accessory to the existing building. The proposed building addition will not dominate the appearance of the property or the house it is attached to. The requested accessory apartment is keeping with the spirit and intent of the ordinance. 3. The proposed use is compatible with the City’s Comprehensive Plan, and the character of the surrounding area. The use will not substantially alter the residential character of the property, which is a typical use in areas that are zoned and guided as Agricultural. The City’s Comprehensive Plan identifies this area as Agricultural. Page 4 4 4. The proposed use has adequate drainage, water supply, electrical, gas, and sewage treatment facilities. Staff does not foresee any problems with utilities or drainage. Prior to the issuance of a building permit, the applicant must obtain a septic permit from Washington County. This is a condition listed in the CUP. 5. The proposed use has adequate road access. The use has adequate access onto Keystone Avenue North via the shared driveway on the adjoining parcel to the north. 6. Technical Evaluation of Floodplain. The use is not located within the floodplain. 7. The proposed use should not increase the potential for flood damage. The use is existing and does not obstruct the floodplain or increase the potential for flooding. 8. The proposed use will not damage or reduce the benefits the public receives from public waters. The use does not damage or reduce the benefits from any public waters. 9. The use of watercraft on public waters. The use does not involve the use of watercraft. 10. All structures shall be screened from view of public waters. The use is screened and is not visible from any public waters. 11. Wetland impacts. The use does not impact any wetlands. 12. All state and local permits shall be acquired for the conditional use. The applicant will be responsible for obtaining all state and local permits. 13. Adequate screening and buffering from non-compatible uses and public rights-of-way. There are some trees that act as a screening measure between the existing house and the road. The house and proposed building addition are set back approximately 750 feet from the road, and Page 5 5 the proposed building addition will not dominate the appearance of the property from view of the road. Staff finds that the request meets all of the requirements necessary to approve a Conditional Use Permit. 5. CONCLUSION/STAFF RECOMMENDATION: Staff finds that the proposal meets all the requirements necessary for the City to approve a conditional use permit. Staff recommends that the Planning Commission approve the CUP subject to the conditions in the CUP and the resolution. 6. PLANNING COMMISSION UPDATE: At its meeting on Thursday, September 26, 2024, the Planning Commission held a public hearing and considered the text amendment. There was one person to spoke during the meeting that asked if they could sell CBD products. Staff stated they would need to be legal products to sell CBD related items. The Planning Commission discussed parking and how Washington County conducts compliance checks. After discussion the Planning Commission unanimously recommended approval of the text amendment. 2. OVERVIEW: There has been a request of the new property owner of 14815 Forest Boulevard North to locate a tobacco shop in the former Premier Bank location attached to the convenience store. This property is located in the Central Business Zoning District (C-1), which allows a wide variety of retail sales of merchandise, including convenience stores, restaurants, and drive-through businesses. However, tobacco shops are listed specifically in the General Business Zoning District (C-2) and the City Code states: “Where a land use is stated as a principal, accessory, or conditional use in any zoning district, that use shall not be permitted in any other zoning district where it is not specifically allowed as a permitted, accessory, or conditional use.” Therefore, currently a tobacco shop is not allowed in the C-1 district. It is unclear to staff why the C-1 district does not list tobacco shops as a permitted use. 3. ANALYSIS: Tobacco shops because of the nature of operations relates to convenience stores, restaurants, and drive-through businesses which are allowed in the C-1 district. Convenience stores are allowed to sell tobacco products with licensing. Permitting tobacco shops in the C-1 district has not been considered until the recent proposal. It is in staff’s opinion that a tobacco shop would be an Page 2 2 appropriate use in the C-1 district. The use would be compatible with the retail-based uses permitted in the district. 4. PLANNING COMMISSION RECOMMENDATION: The Planning Commission discussed parking and how Washington County conducts compliance checks. Improvements for the 2024 125th Street and Dellwood Ridge Street Improvements Project include the following:  Road reconstruction for the Dellwood Ridge neighborhood  Full depth reclamation on 125th Street At the September 3, 2024 regular Council meeting, the Council adopted a resolution declaring costs to be assessed for the 2024 125th Street and Dellwood Ridge Street Improvements Project and scheduled the assessment hearing on the proposed assessments for October 7, 2024. The Notice of Assessment Hearing has been published in the official newspaper and mailed to the owners of each parcel described in the assessment roll at least two weeks prior to the hearing. As part of the assessment hearing, staff will give a PowerPoint presentation identifying the improvements, costs and detail payment options. Staff recommends the Mayor open the public hearing to take all comments and Council approve the resolution adopting assessments for the 2024 125th Street and Dellwood Ridge Street Improvements Project. Staff has prepared a resolution adopting the assessments for the 2024 125th Street and Dellwood Ridge Street Improvements Project for your consideration in accordance with the requirement of state statutes Chapter 429 for assessments to benefitting properties. Mark Erichson, PE City Engineer Attachment cc: Bryan Bear, City Administrator, City of Hugo Scott Anderson, Public Works Director, City of Hugo Liz Finnegan, Senior Engineering Technician, City of Hugo RESOLUTION NO. 2024 – RESOLUTION ADOPTING ASSESSMENTS FOR THE 2024 125TH STREET AND DELLWOOD RIDGE STREET IMPROVEMENTS PROJECT CITY OF HUGO, WASHINGTON COUNTY, MN WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment against abutting property generally located along 125th Street N from Goodview Avenue N to 122nd Street N, Upper Heather Avenue N from 125th Street N to Heather Avenue N, and Heather Avenue N from 125th Street to 120th Street. The improvements include reclamation and repaving of the existing pavement along 125th Street and reconstruction of the existing roadways along Heather Avenue N and Upper Heather Avenue N including installation of new concrete curb and gutter, storm sewer and drainage improvements, and repaving of the roadway. NOW, THEREFORE, IT BE RESOLVED, by the City Council of the City of Hugo, Minnesota, as follows: 1. Such assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January 2025, and shall bear interest at the rate of 5.1% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2024. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city finance director, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and may, at any time thereafter, pay to the city finance director the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The city clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes.
