Minutes for the Planning Commission Meeting of Thursday, July 11, 2024 Chair Kleissler called the meeting to order at 7:00 pm. PRESENT: Andress, Arcand, Derr, Granger, Kelly, Kleissler, Lessard, Petty ABSENT: None STAFF: Rachel Juba, Community Development Director Max Gort, Associate Planner Pledge of Allegiance. Approval of Minutes for the Planning Commission Meeting of May 9, 2024 Commissioner Derr made a motion, seconded by Commissioner Andress, to approve the minutes for the Planning Commission meeting of April 11, 2024. AYE: Andress, Derr, Kelly, Kleissler, Petty NAY: None. ABSTAIN: Granger, Lessard Motion carried. Public Hearing: Ordinance Amendment—Solar Farms Associate Planner Gort presented background on the history of the city ordinance relating to solar farms, and the current directive from the City Council to proposed an ordinance amendment that would prohibit their construction within the city. The solar energy systems ordinance was adopted in 2016, which outlines rules and regulations for accessory solar, which provides solar energy for individuals to use on their own property, and solar farms, which distribute solar energy to off-site users on a larger scale. There was one solar farm project approved in 2018 on 165t" Street that drew significant negative feedback from the community, primarily concerned with aesthetics and character of the area. Due to rising interest in solar farm development, the City Council and Planning Commission decided to review the ordinance relating to solar farms in 2023. The Ordinance Review Committee (ORC) convened and recommended several revisions to the performance standards, including increased setbacks, a maximum size of the solar array, and landscaping requirements. The City Council adopted these revisions in 2023, and a solar farm was proposed on Everton Avenue with the new development standards in place. The Everton Avenue solar farm proposal was heard by the Planning Commission at its April 11, 2024 meeting with a public hearing, and drew significant negative feedback from the community— largely the same concerns that were heard in 2018. The Planning Commission recommended approval of the proposal, but the City Council found that the solar farm would not meet the character of the area, and denied the request on May 6, 2024. The City Council discussed the direction for the ordinance, and wanted to get feedback from the community about prohibiting the July 11, 2024 PC Minutes Page 2 future development of solar farms, primarily asking community members whether they would want to live next to one. The City Council directed staff to draft text amendments to the ordinance that would prohibit the development of solar farms, and hold a public hearing with the Planning Commission. Gort presented two draft text amendments, the first of which amends the definition for solar farms with clarifying language, and the second of which prohibits their development in any zoning district within the city. Staff recommended that the Planning Commission hold a public hearing and take all comments, and to discuss the solar farm ordinance based on the comments received, before making a recommendation to the City Council. Commissioner Granger asked if staff was intending for the Planning Commission's recommendation to be the text amendments as presented. Gort responded that staff does not have a specific recommendation for the text amendments, but that the Planning Commission can make any recommendation based on their discussion. Chair Kleissler asked how the public hearing was noticed. Gort responded that the notice was published in the Citizen newspaper and on the City website, but that residents did not receive a notice in the mail since the city's application was not tied to a specific property. Chair Kleissler opened the Public Hearing at 7:12 PM. John Udstuen, 15190 Everton Ave N, stated that he is opposed to allowing solar farms within the city, comparing solar farms to a factory being placed next to houses. Udstuen stated that he wants to continue to allow accessory solar, and protect future development potential on large parcels. Arnie Triemert, 15220 Everton Ave N, stated that he wouldn't want to live next to a solar farm. Mark Lutz, 8112 157th St N, stated that he wants to allow property owners, such as himself, the opportunity to construct a solar farm to earn supplemental income, and thinks they are a good fit in the agricultural areas of the city. Jimmie Gregoire, 16720 Henna Ave N, stated that he lives next to the existing solar farm on 165th Street and had been vocal in his opposition to it. Gregoire stated that he wants to continue to allow property owners the opportunity to develop solar farms, but feels that much larger buffers from view on adjacent property should be put in place, suggesting a minimum lot size of over 40 acres. John Lutz, 8050 157th St N, stated that he and his brother who spoke previously are working with a developer to construct a solar farm as a way to supplement the income from their farm, and see it as a way to keep their acreage intact without needing to subdivide and sell smaller parcels or construct more disruptive uses such as a feedlot. Lutz said that he thinks the Planning Commission should evaluate solar farm proposals on a case-by-case basis, reviewing how many people are impacted, rather that prohibit them completely. Commissioner Andress asked what he meant by impact, Lutz said that he meant the number of people who had a visible sightline. July 11, 2024 PC Minutes Page 3 Daniel Baack, 6662 Lacasse Dr in Lino Lakes, asked about state directives for providing renewable energy, and stated that he wants the city to continue permitting solar farms as a way to generate renewable energy and for farmers to be able to supplement their income. Ben Krull, 15350 Everton Ave N, stated that he believes Hugo residents do not want solar farms and that the only people proposing them are not Hugo residents. Nathan Dull, Minnesota Land and Liberty Coalition, stated that he believes prohibiting solar farms is too extreme, and mentioned uses that are more disruptive to neighbors than solar farms. Chair Kleissler asked the Planning Commission and staff to address some public comments. Commissioner Petty asked if the existing solar farm project on 165th Street had screening requirements, Juba said that they had a landscape plan that exceeded the screening requirements at the time, and that the plan would meet the current ordinance standards with the 2023 revisions. Commissioner Granger asked if there are any other cities in Minnesota that prohibit solar farms, Juba says yes. Daniel Baack returned to the podium and asked if the question could be brought to a referendum. Juba said that the city only puts items that are required to be decided via referendum on the ballot, and that ordinance discussions are not one of those topics. Baack stated that the sample size present at the public hearing may not be entirely representative and asked if the Planning Commission would consider wider reaching methods of soliciting community feedback, Chair Kleissler responded that the public hearing process is intended to serve that purpose. Chair Kleissler closed the Public Hearing at 8:03 PM. Commissioner Petty commented that nobody can truly speak for all residents of Hugo, including the Planning Commission, that there are much more disruptive uses with greater impacts to neighbors allowed on agricultural property, and that she would not mind living next to a solar farm. Petty stated that there is room for a discussion for revising the ordinance to address concerns before prohibiting solar farms. Commissioner Andress stated that he has a problem with prohibiting solar farms when the city has made efforts for natural resource conservation, and stated he has family members in situations where the ability to construct a solar farm could be financially beneficial. Commissioner Lessard said that the greater than 40-acre minimum lot size proposed during the public hearing, with the 5-acre solar array placed in the middle, would be too large, stating that it could prevent the property from being subdivided. Commissioner Granger said that the minimum lot size doesn't matter so much as how close the solar farm could potentially be located to adjacent property. July 11, 2024 PC Minutes Page 4 Commissioner Arcand said that the current ordinance and its revisions went through a long and intensive process and weren't rushed, and that he would prefer to live next to a solar farm compared to a more disruptive use. Commissioners Lessard, Petty, and Arcand all stated that they would prefer to revisit the ordinance before prohibiting solar farms. Commissioner Kelly stated that there could be places within the city that the community is more comfortable with solar farms. Commissioner Granger stated that the review process with the Everton Avenue solar farm proposal did its job since there were multiple bodies reviewing it, and the proposal was ultimately denied. Commissioner Derr stated that the last time the Planning Commission considered prohibiting a use was with short-term rentals, which was due to extensive community complaints without any feedback in the other direction. Derr stated that solar farms are much less disruptive than short-term rentals and other allowed agricultural uses. Chair Kleissler said that the Planning Commission was able to hear several different perspectives including some that they hadn't heard before. Kleissler stated that she personally would not want to live next to a solar farm, but recognizes that property owners don't own their view. Commissioner Granger stated that of the comments they've heard there has been a balance of those in favor of the prohibition and those against it, but points to the small sample compared to the community as a whole. Commissioner Petty stated that while the representative sample size is small, that the viewpoints expressed were different enough from each other that she felt the Planning Commission could make a sufficiently informed decision. Chair Kleissler asked about viewpoints from Xcel Energy or the city's planning consultants at Landform. Juba stated that Landform hasn't been involved with this discussion topic, but that Xcel's representative, Mike Wilhelmi, spoke at the 2023 workshop. Wilhelmi stated at the workshop that while they're required to accept solar energy systems to interconnect into their distribution system, that they prefer larger utility-scale systems over the small-scale systems that third-party developers propose. Commissioner Lessard asked if the smaller systems make a sizable difference for renewable energy generation, Juba said that Xcel Energy would be better suited to answer that question. Commissioner Derr stated that he thinks there's some room for more restrictions that could effectively address community concerns. No further discussion. Commissioner Petty made a motion, seconded by Commissioner Granger, to recommend denial of the text amendments as presented, and to recommend a joint workshop with the Planning Commission and City Council. Respectfully Submitted, Max Gort, Associate Planner Agenda Number: D.1 CITY OF HUGO PLANNING AND ZONING APPLICATION STAFF REPORT TO: Hugo Planning Commission FROM: Rachel Juba, Community Development Director SUBJECT: Fenway Land Company—PUD Amendment, Preliminary Plat, and Site Plan for an apartment development to be known as "Oneka Fields" DATE: July 16, 2024, for the Planning Commission meeting of July 25, 2024 ZONING: Planned Unit Development(PUD) LAND USE: Low Density Residential (LD) DEADLINE DATE: August 26, 2024 (60-days) 1. DESCRIPTION OF REQUEST: The applicant is requesting approval of the following requests: • A PUD amendment to The Shores of Oneka Lake PUD plan to include the subject property. The property is Outlot C, The Shores of Oneka Lake. • A preliminary plat for 5 - 12 unit apartment buildings on one lot. • A site plan 5 - 12 unit apartment buildings and associated improvements. 2. CONTEXT: A. Surrounding land Use and Zoning The other additions to The Shores of Oneka Lake PUD lie to the south and east of the site. The properties to the west are zoned PUD and General Business (C-2) and are vacant and include businesses. The property to the north is zoned Single Family Detached Residential (R-3) and is vacant. Page 2 B. Natural Characteristics of Site The property is generally flat and does not include any wetlands. It has a small portion of floodplain along the ditch to the south and east. C. Environmental Assessment Worksheet(EAW) Due to the size of the project, the previous applicant was required to complete an Environmental Assessment Worksheet(EAW) for the proposed development on this site. The purpose of the EAW is to identify potential environmental impacts for a specific development and to determine whether or not a more extensive Environmental Impact Statement(EIS) is required. Environmental impacts include impacts to surface waters, natural areas, utilities, transportation systems, historic sites, noise impacts, etc. The EAW for the proposed development of this site was completed in February 2006 and distributed to various agencies for public comment. The City Council reviewed the EAW and the comments received at their May 1, 2006 meeting and determined that an EIS was not needed for the project. Since this plan is similar, but smaller, a new EAW will not be required. However, as this project progresses, staff will need to ensure that the assumptions of the EAW are still valid. 3. ANALYSIS: A. Level of Discretion in Decision Making The City has relatively high level of discretion in approving a PUD. A PUD must be consistent with the City's comprehensive plan. The City may impose reasonable requirements in a PUD not otherwise required if the City deems it necessary to promote the general health, safety, and welfare of the community. The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the subdivision regulations in the City Code. If it meets these standards, the City must approve the preliminary plat. The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. B. Consistency with Ordinance Standards Planned Unit Development (PUD)Amendment and Site Plan In May of 2022, the City Council approved a PUD general plan for The Shores of Oneka Lake. The approved plan included 218 residential lots. The housing types are proposed to be a Page 3 combination of single family homes, villa homes, and twinhomes. Recently, there was a PUD amendment to change some of the undeveloped twinhome lots in the carriage home lots, which are a detached residential product. This brought the approved total residential units to 219. The PUD general plan showed a concept of this property that included 100 units of apartments. The apartment units were not formally approved at that time, since the developer did not have final plans for the apartments. It was noted that a PUD amendment and PUD final plan would need to be reviewed and approved, with a public hearing,prior to development of the property for apartments. The proposal for Oneka Fields includes a five apartment buildings with 12 apartment units in each building. This is a total of 60 apartment units. This will bring the total units for The Shores of Oneka Lake PUD plan to 279 units. The project will be managed and maintained with services such as lawn care and snow removal. The project will be served and provided access from private driveways. The plan includes a good land use transition from the other development additions with the location of the ditch and stormwater ponds. Density The PUD ordinance allows for internal transfer of density and a variety of land uses for a planned development project. The applicant is proposing a mix of single family, villa, carriage, twinhome, and apartment units in the development with the PUD amendment. The maximum development density for a PUD in the zoning district is 4 units per 1 acre. The applicant is proposing a residential net density of 2.75 units per 1 acre, which fits the requirements of a PUD. This is calculated for The Shores of Oneka overall PUD general plan. The proposed density meets the ordinance standards. Lot and Building Standards The applicant is proposing the following setbacks: Minimum building setback from 25 feet street right-of-way Minimum building setback from 20 feet private driveway Minimum building setback from 15 feet exterior property lines Minimum setback between 60 feet buildings Minimum parking setback from 10 feet street right-of-way Maximum building height 35 feet Page 4 Minimum lot area to be covered 52% by impervious surface Development Phasing The developer is proposed to construct the buildings at the same time to be completed in 2025. Landscaping/Signage/Lighting Section 90-272 of the Hugo City code requires that all for apartment construction, all areas not covered by building, parking, driveways, or impervious storage areas shall be landscaped and maintained in accordance with Section 90-181. Section 90-181 outlines those landscaping requirements. The ordinance requires 60 deciduous trees, 60 coniferous trees, 47 ornamental trees, and 235 shrubs. The applicant is exceeding the landscape requirements for the project. The applicant is showing the parking areas and greenspaces to be landscaped. In addition the applicant is showing a landscaped location for a monument sign at the entrance of the project. A sign application shall be reviewed and approved by staff prior to installation. The plan shows location for lighting for the project. The lighting generally meet the ordinance standards, however a final plan shall be reviewed and approved by staff. Park Dedication/Openspace With The Shores of Oneka PUD general plan the project dedicated land and fee to satisfy the park dedication requirements. The land dedicated is the upland areas of Outlot G along Oneka Lake, which now includes a public trail. The proposed land dedication of 3.89 acres satisfied 40.5% of the requirement. The remaining would be satisfied with payment of 59.5% of the fee ($3,400 per unit). The fee for each unit is $2,023 totaling $121,380. This development is in Neighborhood Park Service Area 10 which is served by Oneka Lake Park, the future park currently called the Bernin Property and the public boat launch on Oneka Lake. Oneka Lake Park and the Bernin Property are immediately south of the development. The previous park dedication expands the city park properties and provide opportunities for a more expansive open space and trail network. The Parks Commission anticipates additional planning of the park properties as this property develops. The developer is also providing a recreation area for the apartment residents as required by ordinance. The area includes, landscaping,picnic tables,benches, and playground equipment. Streets/Access The roundabout at TH 61 and 1591h Street will serve as the primary access for the development and is open to traffic as of late last fall. Two access points into the site are proposed with one Page 5 being located on 159th Street and the other being located on Goodview Avenue. Minor modifications along with signage comments have been requested as part of the plan comment process. Parking The City Code requires two spaces per unit plus one stall per five units. The site plan shows single stall garages for each unit. The applicant has indicated that one parking stall per unit would be provided in the garage and a second in the driveway. Driveways are required to be a minimum of 22 feet long and must be dimensioned on the plans. Additionally, 24 guest parking stalls are provided where 12 are required. This meets the ordinance requirements for number of units. No parking will be allowed on the private drives and the apartment contracts should include language to this effect. As noted in the Multi-Family Development Design Guidelines, garages should remain open for vehicle parking and the contracts should address that as well. Sidewalks and Trails The trail along 159th Street will be extended to the north with the development. Staff recommends the developer evaluate whether internal sidewalks should be provided for the development. Grading, Drainage, and Water Re-use As part of the Shores of Oneka Lake development, the planned stormwater management for this site was accommodated already in the development. We have confirmed the assumptions for the site at the time of initial design are in accordance with current plans. In fact, the site contains less impervious coverage than previously anticipated. The site is meeting water quality requirements primarily through water reuse for onsite irrigation. The applicant will need to submit the water reuse plans for the development for review. The retaining wall proposed will be the responsibility of the development without City maintenance responsibilities. Utilities The sanitary sewer and watermain will be connected to stubs provided in a previous phase of this development. The construction plans correctly show a watermain being extended along 159th Street. Watermain is also looped through the development from Goodview Avenue to the watermain constructed within 159th Street. Wetlands There are no wetland on the property. Page 6 Management of the Apartments A management company is proposed for the development. The developer is responsible to own/operate/maintain community areas, landscaping, retaining walls, and the water re-use system. The management company should also provide for restrictions on outdoor storage, parking (no boats, campers, or trailers) in order to keep the community looking orderly and well maintained. Building Architecture and Materials All apartments are required to comply with the City of Hugo Multi-Family Development Design Guidelines adopted December 19, 2005. The general intent of the design guidelines is to improve the overall quality of development and to avoid monotony in new developments. The applicant has provided architectural elevations of the buildings and an electronic material sample board to show the type, color, and materials used in all proposed external surfaces. The buildings are two-story and meet the building height requirements. As proposed, the development generally meets the design guidelines: • Building Mass: Units should be articulated to break up the building mass. Rooflines and building faces should be broken up at least every 50 feet. The buildings are well-designed with good articulation to the building face to provide interest and variety. The roofline is broken up by gables and dormers. • Monotony: to the extent possible, developments should limit the number of units that are adjacent to each other with the same color, materials or design. The developer is showing all five buildings with the same exterior. The materials are a mixed of lap and board and batten vinyl siding in white and grey, with grey stone and white flat panel accents. Staff encourages the applicant to expand the palette and provide additional colors to for variety to eliminate monotony within the project. • Four-sided design: Buildings are required to be designed in a manner where they look like the same building on all sides. The applicant is proposing a building that has been designed in a manner so that all sides of the building look generally the same. There are no unfinished sides. Each elevation contains doors, windows, and gables. Additionally, material treatments are applied to all four sides equally. • Building materials and design: Buildings are required to be constructed of high-quality materials and a variation of building materials and accent materials are to be used. The Page 7 design guidelines require at least 25% of the building to be higher quality materials (other than lap siding). The plan shows approximately 10% stone on the front and rear elevations and 10% stone on the side elevations. Staff recommends the applicant meet the intent of the guidelines by adding stone to each elevation of the buildings. The plans do not show downspouts or gutters. These must be designed integral to the building and must be submitted for review and approval by staff. Final color palettes, physical material samples, and revised building elevations shall be reviewed and approved by staff prior to the issuance of a building permit. Preliminary Plat Lot Size The primary plat will be one lot for all of the units for the buildings. Drainage and Utility Easements Drainage and utility easements for the sanitary sewer and watermain are shown correctly on the plans. 4. CONCLUSION: Staff has reviewed the PUD amendment, preliminary plat, and site plan for consistency with the standards outlined in the City Code and finds that the application is consistent with all the standards. 5. RECOMMENDATION: Staff recommends approval of the amendment to the preliminary plat and PUD, subject to the conditions listed in the resolution. ATTACHMENTS: 1. Location map 2. Resolution 3. A PUD amendment is approved to allow the construction of 60 apartment units in five buildings on one lot,in accordance with the application and plans received on June 7,2024, and revisions received on June 27, 2024, except as amended by this resolution. 2. The plans must comply with The Shores of Oneka Lake PUD approvals in Resolution 2022-32, except as amended by this resolution. 3. The plans must be revised to comply with the City Engineer's memo dated July 22, 2024, and redlines comments provided to the applicant. 4. Prior to the installation of any signs, the developer shall obtain a sign permit. 5. The developer is responsible for obtaining all local, State, and Federal permits. 6. The PUD amendment includes approval of the following building setbacks: Minimum building setback from 25 feet street right-of-way Minimum building setback from 20 feet private driveway Resolution 2024- Page 2 Minimum building setback from 15 feet exterior property lines Minimum setback between 60 feet buildings Minimum parking setback from 10 feet street right-of-way Maximum building height 35 feet Minimum lot area to be covered 52% by impervious surface 7. Guest parking shall comply with the Americans with Disabilities Act as may be applicable. 8. No parking will be allowed on the private drives. 9. The private drives must comply with City standards for private drives. 10. The plans must be revised to show snow storage areas on the plans. 11. No signage is proposed at this time. Should signage be desired, the applicant must apply for a sign permit with details ensuring compliance with ordinance requirements. 12. The developer is responsible to construct/own/operate/maintain community areas, landscaping, retaining walls, and the water re-use system. 13. With The Shores of Oneka PUD General Plan the project dedicated land and fee to satisfy the park dedication requirements. The land dedicated is the upland areas of Outlot G along Oneka Lake. The proposed land dedication of 3.89 acres satisfied 40.5% of the requirement. The remaining would be satisfied with payment of 59.5% of the fee ($3,400 per unit) which totals $441,014. The fee for each unit is $2,023. Prior to issuance of building permits: 14. Final Plat and Development Agreement shall be executed and recorded. 15. All development fees shall be paid. 16. The architectural plans must be revised to address the following: a. Final elevations of the buildings shall be reviewed and approved by staff prior to the issuance of a building permit. b. The applicant shall add stone to meet the intent of the Multi-Family Design Guidelines. c. The applicant shall expand the color palette to provide additional colors for the buildings to eliminate monotony within the development. The applicant will work with staff to finalize the design and color palette. d. The applicant shall provide a final color palette and physical material sample for City review and approval. Resolution 2024- Page 3 e. All ground-level mechanical units shall be low profile and located to the side or rear of the building and shall be screened from view of adjacent properties. f. The gutters and drainpipes shall be integrated into the building design and shall be reviewed and approved by staff. 17. The lighting plan must be updated and submitted for review and approval by City staff. BACKGROUND: Hugo City Code allows for lot line setback exceptions for several typical house features such as window wells/egress windows, decks, porches, and air conditioners. In reviewing this section of the code we have found that the allowance for a window wells/egress windows in the side yard to encroach 2 feet into the setback requirement does not meet building code. Building code requires a window well/egress window to have an opening of at least 3 feet. This issue has come up in a few building permits over the last year. 2. STAFF RECOMMENDATION: Staff recommends the zoning code text amendment to align with the building code. Staff recommends the Planning Commission hold the public hearing and take all comments. Staff recommends that the Planning Commission approve the text amendment for exceptions to yard regulations related to window wells/egress windows. Attachments: 1. Red-lined Text Amendment 2.
