G.2 Approve Letter of Resignation from Community Development Inter Phoebe Brown Community Development Intern Phoebe Brown has submitted her Letter of Resignation. Phoebe has taken a position with Ramsey County as an Environmental Resource Specialist. Staff recommends Council approve the letter of resignation for Phoebe with her last day being Wednesday, April 16, 2025. G.3 Approve Donation to the Hugo Fire Department from the Hugo American Legion The Hugo American Legion would like to donate $1,500 to the Hugo Fire Department from pull- tab proceeds for equipment. All donations to the Fire Department must be approved by the Council. Staff recommends Council approve the donation of $1,500 to the Hugo Fire Department. G.4 Approve Ordinance Amending the Solar Ordinance At its February 3, 2025, meeting the City Council heard an update on the Ordinance Review Committee’s (ORC) recommendations for revisions to the solar farm ordinance. The City Council authorized staff to begin drafting text amendments based on the ORC’s recommendations. The proposed ordinance amendments include revisions to the performance standards for solar farms, changes to the zoning districts where solar farms are allowed, and a clarification to the definition of solar farms based on a recommendation from the City Attorney. Staff recommended approval of the proposed ordinance amendments to the Planning Commission, who held a public hearing at its March 13, 2025, meeting and took comments from the public. Following discussion, the Planning Commission voted unanimously to recommend approval of the proposed ordinance amendments to the City Council. Staff recommends Council approve the ordinance amending the Solar Ordinance and the summary ordinance for publication. G.5 Approve Ordinance Amending the Parking Ordinance City Code currently restricts parking of vehicles and trailers on City streets to a time limit of 72 hours, with the intent of prevention long-term storage of such equipment on public streets. The City has received complaints detailing the long-term storage of trailers on public streets, and the City has had difficulty in enforcing the intent. At its March 3, 2025, meeting, the City Council authorized staff to work with the City Attorney to begin drafting text amendments to clarify the ordinance’s intent. The proposed ordinance amendments include restricting on-street parking of trailers to period of 24 cumulative hours over a seven-day period and stating that a trailer moved less than three tenths of a mile from its original location will be considered to have remained parked. Staff recommended approval of the proposed ordinance amendments to the Planning Commission, who held a public hearing at its March 27, 2025, meeting. Following discussion, the Planning Commission voted unanimously to recommend approval of the proposed ordinance amendments to the City Council. Staff recommends Council approve the ordinance amending the Parking Ordinance. G.6 Approve Shores of Oneka 5th Addition Final Plat and Development Agreement M/I Homes is requesting approval of a final plat and development agreement in order to plat the remaining 52 single family lots on an outlot in The Shores of Oneka Lake development. The lots meet the minimum lot standards and requirements outlined in the regulations for The Shores of Oneka Lake PUD. Staff recommends approval the resolution approving the Final Plat and Development Agreement for The Shores of Oneka Lake 5th Addition. G.7 Approve Resolution Approving Variance for 4938 121st Street North Julie and Greg Manning have requested a variance to allow for the construction of a 2,336 square foot attached garage and car port, where an attached garage of 1,678.25 square feet is allowed by ordinance. The applicants have indicated that they would build a larger attached garage in place of any accessory buildings. The applicants have agreed not to construct any accessory buildings on the property as a condition of approval for the variance. There are practical difficulties in that the lot is surrounded by all sides by other parcels, and the proposed variance meets the spirit and intent of the ordinance with there being several buffers between the proposed garage and the view of the road and any adjacent parcels. Staff recommended approval of the variance to the Board of Zoning Appeals and Adjustments, who held a public hearing at its March 13, 2025, meeting and considered the request. Following discussion, the Board voted unanimously to recommend that the City Council approve the resolution approving the variance request for 4938 121st Street North. G.8 Approve Resolution Approving Encroachment Agreement for 4789 162nd Way Christopher and Tina Haglund have requested an encroachment agreement to allow construction of a fence within a drainage and utility easement on property located at 4789 162nd Way North. The Senior Engineering Technician has reviewed the location of the fence and is comfortable with the request. Staff recommends Council approve the resolution approving the encroachment agreement for 4789 162nd Way North. G.9 Approve Access Easement Agreement for Property Located at 12895 Ethan Avenue North The property owner at 12895 Ethan Avenue North, Robert L Merch Revocable Trust, is requesting an access easement over City owned property for an existing driveway to access the home. The driveway has been in place for decades to access the home. The driveway crosses City owned property along Ethan Avenue. In review of recorded documents with Washington County they have stated that a vague access easement is in place, however it was not created with a separate access easement. The property owner is asking to formalize the access easement, since there is no other way to access the property. Staff recommends approval of the access easement agreement, subject to City Attorney review and approval. I.1 Approve Resolution Receiving Bids and Awarding the Contract for Beaver Ponds and 2025 Street Improvement Projects Bids were received for the 2025 Beaver Ponds Area Street Improvement Project and the 2025 Street Improvement Project on March 20, 2025. The bids included an alternate for Ferrara Avenue which is a private drive at the request of the HOA. They elected not to pursue moving forward with the project. Staff recommends Council approve the resolution awarding the contract to the low bidder, Northwest Asphalt, Inc. for the base bid, in the amount of 2,077,019.43. The engineer’s estimate was $2,267,961.00. M.1 Metro Cities Annual Meeting on Wednesday, April 23,2025 Council has been invited to attend the Metro Cities Annual Meeting will be held on Wednesday, April 23, 2025, at 5:00 pm at the Roseville Skating Center. The meeting will include a social hour, guest speaker Steve Grove, CEO and Publisher – Star Tribune, and a brief meeting to elect members and officers to the Metro Cities Board of Directors. Staff recommends Council schedule this as a meeting if they wish to attend. M.2 Schedule League of MN Cities Annual conference on June 25-27, 2025 The League of MN cities will be holding their 2025 annual conference at the Duluth entertainment Convention Center on June 25-27, 2025. Staff recommends Council schedule as a meeting if they wish to attend. M.3 Vacancy on the Brown’s Creek Watershed District Watershed District Manager Larry Odebrecht has resigned his position on the board and a vacancy has been created. The county is seeking an individual to serve a partial term through October 21, 2027. Statute requires County Boards select watershed district managers from an aggregate list of qualifying nominees submitted by townships and municipalities. Anyone interested in being on the Brown’s Creek Watershed District Board can contact Hugo City Hall. Application deadline is April 18, 2025. M.4 Vacancy on the Carnelian Marine St. Croix Water Shed District The term of office for Kristin Tuenge with the Carnelian Marine St. Croix Watershed District expires on June 21, 2025. The county is seeking an individual to serve as a district manager. Statute requires County Boards select watershed district managers from an aggregate list of qualifying nominees submitted by townships and municipalities. Anyone interested in serving on the Carnelian Marine St. Croix Watershed District Board can contact Hugo City Hall. Application deadline is April 22, 2025. M.5 Schedule Performance Review for City Administrator Bryan Bear Bryan Bear has been employed with the City since May 3, 2004. Bryan served as the Community Development Director until being appointed the City Administrator on November 7, 2011. Hugo Yellow Ribbon Network Annual Report – Chair Chuck Haas Prior to this meeting, the Hugo Yellow Ribbon Network held a 15th-anniversary celebration in the Oneka Room, where there were several display tables. Hugo YRN Chair Chuck Haas presented Burger Night Sponsor Certificates of Appreciation to those present, including the Hugo Fire Department, Centerville Lions, St. John’s Men’s Club, Washington County Sheriff’s Office, Bald Eagle Sportsman Association, Xcel Energy, and Blaze Credit Union. Also receiving certificates but not present were Acres for Life, Mueller Memorials, and Honor Fitness. A plaque was awarded to the Burger Night Sponsor of the Year, Oneka Ridge Golf Course. Chuck thanked the Council and staff for their support. Mayor Weidt commented on Hugo being known all over the world due to the fantastic job of the Hugo YRN. He thanked the volunteers and sponsors and congratulated them on 15 years of service. Weidt called for a short recess. Washington County Assessors Update - Appraisers Dan Squyres and Tyson Terry Council Meeting Minutes for March 17, 2025 Page 2 of 8 Washington County Residential Property Appraiser Tyson Terry provided the Council with an update on the County and Hugo property assessments in preparation for the Local Board of Appeals and Adjustments meeting on April 3, 2025. He discussed the assessment year timeline, the color coding of tax statements, and the quintile review mandated by Minnesota law for assessing properties. There will be about 1,500 property reviews to complete this year. He said the goal of an assessor is to equalize values and ensure they are fair and reasonable. He noted that April 3 is the time for Hugo property owners to appeal their proposed taxable value for 2026. There were 220 “arm’s length” residential sales in 2024. Tyson explained these were sales that took place in a competitive and open market, helping to determine the sales ratio and adjust values accordingly. The historical average sales price had increased to $405,100 from $300,311 over the past five years. While the volume of residential sales has declined, the average sales price has remained stable. Tyson reported that, according to the Minnesota Realtors Association, the median sales price of a single-family home in Hugo was $493,145, which was close to the Washington County average and about $75,000 higher than in the Twin Cities. The number of days on the market dropped significantly when interest rates were low last year. Hugo properties were on the market for an average of 30 days. Over the past five years, the price paid for homes had on average not been below 100% of the asking price. Lender-mediated sales have declined across the county. A large portion of recent sales in Hugo consisted of newly constructed homes. There were 170 new construction starts in Hugo in the past year, which was more than most cities except Cottage Grove and Woodbury. Countywide, there were 1,122 new construction starts, with Hugo accounting for 14% of them. Commercial sales had declined over the past two years. He provided information on median home values, stating that they increased by 5% from last year and are now equal to the 2023 value of $408,700. Tyson reviewed the historical class adjustments, pointing out that the residential class adjustment decreased by 4% last year and increased by 3.4% this year. He said he believed the County had a solid grasp on values and that the market is stable. He concluded his report by comparing closed sales data from the past three years, which showed that the Twin Cities average declined by 31.8%, while Hugo saw a decrease of 19.1%. This indicated that Hugo did not experience as significant a decline as other cities. Over the past year, Hugo saw a 21.5% increase in closed sales, indicating that people were moving to the city. Hugo Fire Department Annual Report – Fire Chief Jim Compton, Jr. Fire Chief Jim Compton presented the Hugo Fire Department 2024 Annual Report. He began by providing a breakdown of the 27 total staff positions, stating that there was a vacant lieutenant position. The department responded to 411 calls in 2024, with 23 of them being mutual aid calls. There were 56 alarm calls, which was a reduction compared to 2023, and he attributed it to the reclassification of gas leaks and carbon monoxide issues. There were 125 fire and service calls last year that resulted in $85.6 million in fire losses. Eleven of those calls were for structure fires in Hugo. This was the fifth year assisting M Health Fairview with major medical calls and lift assists, and the department responded to 178 medical calls in 2024. There were also 29 motor vehicle accidents. Compton noted that trends showed an Council Meeting Minutes for March 17, 2025 Page 3 of 8 8% increase in call volume, which was standard for the industry, and he predicted call volume would continue to rise with the City's ongoing growth. He talked about their new Urban Logiq software from the State Fire Marshal that tracks calls and will help the department focus its efforts and provide better public education. Data showed that December had the highest number of calls, while June had the least. Additionally, 57% of calls occurred between 8 a.m. and 6 p.m., with Wednesdays and Fridays being the busiest days of the week. In 2024, the department spent 3,360 hours in training. Most of the department has completed active shooter training, and there was one house burn on the north end of Bald Eagle Lake. Operational improvements in 2024 included the first full year with a full-time fire chief, three firefighters completing probation, and three new probationary firefighters being hired. The department also purchased a new grass truck and upgraded some battery-powered tools and scene lighting. Compton shared information on leadership development, community involvement, and the $14,187 received in donations during 2024. He provided updates on the AED initiative and discussed improvements to the Insurance Services Offices (ISO) rating, which could lower property owners’ insurance costs. Other improvements included a kitchen and office remodel, allowing daytime responders to perform their remote work from the station. Goals for 2025 included creating a truck committee, working with the City’s Building Department on the future of the fire marshal position, discussing staffing models, and hiring more paid-on-call firefighters. There was a question about whether the department had responded to any electric vehicle fires. Compton responded that they had responded to lithium-ion battery fires but not specifically to electric vehicles. He added that they hope to track this data with the new records management system. Weidt said he was impressed by the AED program and shared past experiences that had given him a great appreciation for them. M Health Fairview Annual Report – District Chief Kevin Kane District Chief Kevin Kane presented the M Health Fairview Annual Report. He reviewed data from the past five years for the overall Northern Region, which showed that in 2024, they had 4,782 requests. In 2024, there were 341 instances where mutual aid was given to cities outside the region, and they requested mutual aid 176 times. He provided a breakdown of the acuity of calls as they came into the center. The average emergent response time was 7:48, and the combined time was 8:40 on average in the region. In Hugo, there were 963 emergency calls, with 37 of them requiring mutual aid into Hugo. The emergent response time in Hugo was 7:15, and the combined response time was 7:40. He provided a breakdown on call type saying the highest percentage of calls were categorized as "sick person," meaning the exact nature of the emergency was unknown when the call came in. He showed the heat map, which helps determine where to position ambulances. He noted that the fire station location works very well. Council Meeting Minutes for March 17, 2025 Page 4 of 8 Kevin explained that M Health has been providing service to Hugo since June 2020 and has participated in extensive community outreach. They attend Fridays with Firefighters, Good Neighbor Days, and Night to Unite, as well as providing assistance with live burns, medical direction, education, and training, all free of charge. These programs also allowed firefighters from other cities to attend. He echoed Fire Chief Compton’s comments on the AEDs, saying it has been a testament to their training and teamwork, resulting in positive outcomes. Mayor Weidt commented that it has been a great partnership, and it was good to have a team that works together for the benefit of the community. Presentation and Approval of Donation to Hugo Fire Department from Hugo Firefighter Relief Association – President Chief Dave Jensen Over the past several years, the Hugo Firefighters Relief Association has held various events to raise funds to purchase equipment for the Hugo Fire Department. Most recently, they hosted an annual golf fundraiser that has helped raise over $28,000. The Relief Association wished to donate $40,000 to the Fire Department to contribute to the fund for purchasing a training prop. All donations to the Fire Department required Council approval. Hugo Firefighters Relief Association President Dave Jensen presented a check in the amount of $40,000 to the City, stating that this was the largest donation the Relief Association had made in a long time. Petryk made a motion, and Strub seconded, to approve the donation from the Relief Association in the amount of $40,000 for the purchase of the training prop. All ayes. Motion carried. Approve Special Event Permit for Hero Gravel Classic Bike Ride on August Fred Stori from the Chilkoot Velo Cycling Club of Stillwater had applied for a Special Event Permit for the Hero Gravel Classic Bicycle Ride to be held on August 23, 2025. The event would be a 50-mile bicycle ride on gravel and paved roads beginning and ending at the Bavarian Hunter Gasthaus Restaurant in Stillwater. A Special Event Permit approved by Council was necessary because there may be up to 300 people participating. Adoption of the Consent Agenda approved the Special Event Permit for the Hero Gravel Classic Bicycle Race on August 23, 2025, subject to the conditions in the staff memo. Approve Hugo Fire Department Purchase of a Taylor’d Series 12 Training Prop The Hugo Fire Department requested to purchase a Taylor’d Series 12 Training Prop for in- houses and on-site training. This Prop was not included in the Fire Department budget. The Department had contacted several charitable gambling associations for donations, and the Relief Association had donated $40,000 towards the purchase. Adoption of the Consent Agenda approved the purchase of the Taylor’d Series12 Training Prop from Taylor’d Systems LLC in the amount of $61,800 using funds from the City of Hugo Fire Department Donations Account. Approve Purchase of 2025 Ferris Zero Turn Mower for the Public Works Department The Hugo Public Works Department requested to purchase a mower for maintenance of the City’s expanding parks and public facilities. The purchase of a Ferris zero turn mower with an EZ dump hopper had been discussed with the Finance Department and funds were available in the 2025 CIP Budget. This mower would be purchased through the MnDOT Cooperative Purchasing Venture. Adoption of the Consent Agenda approved the purchase of a Ferris ISX330 60” zero turn mower with an EZ dump hopper from L.T.G. Power Equipment for $22,857. Identify and Approve Expired Fire Department Gear as Surplus Equipment Eligible for Donation The Hugo Fire Department had 16 structure fire jackets, 21 structure fire pants, 29 sets of wildland gear (coat and pant), 15 helmets and 19 pairs of structure fire boots that no longer met industry standards for fire departments in the United States and thus had no resale value. The National Fire Protection Agency standards required the above-mentioned gear to be retired and neither the Hugo Fire Department, nor any other City Department had any use for the expired gear. The Fire Department requested to donate their expired gear to a nonprofit that would be able to send the turnout gear, helmets and boots to impoverished countries around the world where it would be used by firefighters who could not afford turnout gear and in countries that do not have NFPA standards. In order for the Hugo Fire Department to put their expired gear out for donation, City Council needed to declare the gear surplus. Adoption of the Consent Agenda identified and approved 16 expired structure fire jackets, 21 expired structure fire pants, 29 sets of expired wildland gear (coat and pant), 15 expired helmets and 19 pairs of expired structure fire boots as surplus equipment eligible for donation. Approve Resolution Approving Encroachment Agreement for 16168 Empress Ave North Council Meeting Minutes for March 17, 2025 Page 6 of 8 Kelly and Abraao Franco had requested an encroachment agreement to allow construction of a fence within a drainage and utility easement on property located at 16168 Empress Avenue North. The Senior Engineering Technician had reviewed the location of the fence and was comfortable with the request. Adoption of the Consent Agenda approved RESOLUTION 2025- 7 APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW CONSTRUCTION OF A FENCE WITHIN A DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT 16168 EMPRESS AVENUE NORTH. Approve Resolution and Cooperative Construction Agreement for the MNDOT, Washington County, and City of Hugo Washington County applied for Local Partnership Program funds from MNDOT for improvements to Trunk Highway 61 from 140th Street N (County State Aid Highway 8) to Frenchman Road (County State Aid Highway 8). The County coordinated this application with the City of Hugo and was successful in receiving funds. The project included grading, bituminous mill and surfacing, drainage improvements, ADA improvements and signal revisions. The project included minor widening and improvements to the signal and turn lane operations. The City costs were related to signal modifications on the local legs of the intersection, minor adjustments to watermain gate valve boxes, and repainting the signal systems which had been the responsibility of the City of Hugo. The total project cost was estimated to be $1,404,541.91, with the City of Hugo being responsible for $47,588.95. Adoption of the Consent Agenda approved the MNDOT agreement that outlined the City, County, and State responsibilities and approved RESOLUTION 2025-8 APPROVING THE STATE OF MINNESOTA DEPARTMENT OF TRANSPORTATION AND WASHINGTON COUNTY AND CITY OF HUGO COOPERATIVE CONSTRUCTION AGREEMENT. Approve Cooperative Agreement Between the City of Hugo and Washington County for Construction Cost of TH61 Through the Local Partnership Program Washington County applied for Local Partnership Program funds from MNDOT for improvements to Trunk Highway 61 from 140th Street N (County State Aid Highway 8) to Frenchman Road (County State Aid Highway 8). The County coordinated this application with the City of Hugo and was successful in receiving funds. The project included grading, bituminous mill and surfacing, drainage improvements, ADA improvements and signal revisions. The project included minor widening and improvements to the turn lane operations. The City costs were related to signal modifications on the local legs of the intersection, minor adjustments to watermain gate valve boxes, and repainting the signal systems which was the responsibility of the City of Hugo. The total project cost was estimated to be $1,404,541.91 with the City share being $47,588.95. Adoption of the Consent Agenda approved the Cooperative Agreement Between the City of Hugo and Washington County for Construction Cost of Trunk Highway 61 through the Local Partnership Program. Sketch Plan for 5311 165th Street North Capstone Homes had submitted a sketch plan to develop parcels of land totaling 38 acres, with approximately eight acres of wetland, on property located directly north of The Meadows development and south of 165th Street. The proposal included 90 single-family, slab-on-grade, two-story homes on 50-foot-wide lots. Community Development Director Rachel Juba presented the plan, which showed the location of the lots, ponding areas, and road connections. Streets were shown to connect to the south, and two streets would connect north to 165th Street. There Council Meeting Minutes for March 17, 2025 Page 7 of 8 were two approximately one-acre intersecting properties on 165th Street that were under separate ownership. There was no homeowner’s association proposed as part of this development. Juba explained that the parcels were designated as Medium Density (MD) Residential in the 2040 Land Use Plan. The developer proposed a net density of three units per acre, which met the MD requirement. The current zoning on the properties was Future Urban Service, and it would need to be rezoned to Planned Unit Development because the applicant was requesting flexibility on lot widths, lot sizes, and setbacks. The proposal included 50-foot lots where 80 feet was required, 6,500-square-foot lot sizes where 10,400 square feet was required, and reduced setbacks, including a 7.5-foot side yard setback where ten feet was required. Juba stated it was likely they would need flexibility on the impervious surface requirements. The development was expected to have higher standards in exchange for this flexibility. The developer intended to provide scenic views by preserving natural features as much as possible, providing high-quality architectural homes, and creating outlots to reduce impacts on natural resources. Juba discussed the proposed streets in the development and the improvements needed for 165th Street. The 2040 Comprehensive Plan identified 165th Street as an urban-section minor collector road with a future trail connecting to Hardwood Creek. As a collector street, six lots shown on the plan had driveways on 165th Street that would need to be eliminated. Additionally, a long, straight road running north and south would need to be analyzed to determine what traffic- calming measures were needed. Juba reviewed several options for improvements on 165th Street, saying there would be a study beginning this spring to help determine how to move forward. Staff recommendations included submitting a phasing plan, reconfiguring the long north/south road, removing or relocating the six lots with access to 165th Street, reconsidering lots in the Met Council interceptor, incorporating an off-road trail system, enhancing the landscape plan, and evaluating stormwater reuse. Juba reviewed comments made by the Planning Commission at their meeting on February 27, 2025, and the Parks Commission at their meeting on February 19, 2025. In addition to staff’s recommendations, comments were made that the development would be served by other parks, so there would be no required land dedication, but a park dedication fee would be required. There was also a desire to see staggered building setbacks, a one-story product, and more creativity in the layout. Petryk asked about the ownership of the outlot since there would be no HOA. Juba replied that the City would typically take over ownership, but it had not yet been discussed. Land Project Manager Tom Bakritges, representing Capstone Homes, introduced himself and property owner Mary Munger. He said he had been working on this project since last August, and his aim was to balance affordability with environmental stewardship. He reiterated much of what Juba presented and was agreeable to the suggestions made. He discussed projects he had completed in other cities and said the key to this project was that there would be no HOA. He explained that the high water table would not allow for basements and that he did not believe a water reuse project would work on this site. He said water reuse and 165th Street were two of the remaining issues. Council Meeting Minutes for March 17, 2025 Page 8 of 8 The Council had questions about the one-level product, price range, the two existing lots within the proposed development, and whether the lot widths between homes would allow for emergency access. Bakritges replied that he could include some one-level homes. The prices would range from $390,000 to $430,000. He said the numbers would not work if the two existing lots were incorporated. The homes would be located 15 feet apart, which would allow for emergency access. He said none of the homes would back up to each other, and he offered to give the Council a tour of the developments he had completed in other communities. He stated his goal was to have the lots ready by fall. Weidt said the direction from staff and the commissions was good and told the developer to continue working with staff. The Council generally agreed with the comments from the Planning Commission and the Parks Commission and had nothing more to add. Sincerely, Phoebe Brown Memorandum To: Bryan Bear, City Administrator From: Max Gort, Associate Planner Date: April 2, 2025 for the City Council meeting of April 7, 2025 Re: Ordinance Amendment – Solar Farms 1. PLANNING COMMISSION MEETING UPDATE: At its meeting of March 13, 2025, the Planning Commission held a public hearing and considered the proposed ordinance amendments. There were five people who spoke during the public hearing. Three of those five are involved in a solar farm application that was incomplete before the current moratorium went into effect. These three people primarily spoke against the requirement for locating a solar farm on a central portion of the property, stating that this requirement would make the project more expensive and may create issues with farming the rest of the property. The fourth person said that the requirement for central location may be difficult on some lots, and stated that he wanted to ensure solar energy generation would still be allowed. The fifth person stated that she was concerned about potential noise being generated by solar farms, and asked about the City’s process for determining if a solar farm has been abandoned by the operator. The Planning Commission discussed the proposed ordinance revisions and comments heard during the public hearing. The Planning Commission generally felt that the requirement to locate a solar farm on a central portion of the property would reduce the visual impact that solar farms have on neighboring properties, and that the language had enough flexibility for locating a solar farm on a particular property. The Planning Commission unanimously recommended that the City Council approve the ordinance amendments. 2. BACKGROUND: In 2016, the City Council adopted an ordinance regulating the use of solar energy systems. The ordinance includes rules for accessory solar energy systems, which provide solar energy for on- site use and are accessory to the primary use of the property, and solar farms, which distribute solar energy to off-site consumers and are the primary use of the property. Solar farms are currently permitted in the AG, LA, RR, and FUS zoning districts , all other zoning districts only in the floodplain, and on parcels greater than 10 acres in size. Additionally, solar farms require an Interim Use Permit (IUP), and have specific performance standards and criteria of approval. The first solar farm project was approved in 2018, which drew negative feedback from the community related to aesthetic characteristics and setbacks from property lines. In 2023, the Planning Commission and City Council amended the ordinance due to an increased interest in solar farm development and related feedback from the community. G.4 2 The Ordinance Review Committee (ORC) convened to draft revisions to the ordinance, which included: • An increase in minimum setbacks from property lines from 50 feet to 100 feet • A minimum setback from public rights-of-way and dwellings on adjacent property to 200 feet • A limit of the size of the solar array to five acres • A requirement that trees at least 6 feet tall at the time of planting be provided for screening • A requirement that solar farm applications include a vegetation establishment and management plan • A requirement that ground areas within the solar array not occupied by equipment be planted with deep-rooted, native, pollinator-friendly plantings The ORC’s revisions were adopted by the City Council on July 24, 2023. With the new ordinance in effect, the City received an application for a solar farm on a vacant 12-acre property on Everton Avenue. During the public hearing at the April 11, 2024 Planning Commission meeting, several neighbors spoke in opposition to the project, primarily with concerns that the proposed solar farm would not be compatible with the present character of the surrounding area. The Planning Commission recommended approval of the solar farm IUP, but the City Council denied it, due to the character of the area case made by the neighbors. Following the denial of the Everton Avenue solar farm project, the City Council directed staff to draft a text amendment that would prohibit solar farms. At its July 11, 2024 meeting the Planning Commission held a public hearing on the text amendment. There were 4 people who spoke in favor of prohibiting solar farms, 4 people who spoke against prohibiting solar farms, and 4 letters received by the City that were all against prohibiting solar farms. The Planning Commission and City Council decided not to prohibit solar farms at that time, and instead held another workshop to discuss the ordinance. The workshop held on September 19 , 2024 resulted in direction to reconvene the ORC to consider revising the ordinance. 3. ORDINANCE REVIEW COMMITTEE DISCUSSION AND RECOMMENDATION: Over the course of several meetings, the ORC discussed potential revisions to address community concerns. Solar farm proposals often have the location of a solar array near the edge of a large property and closer to adjacent dwellings, rather than being located centrally. The ORC determined that community feedback may be better addressed with revisions that guide the placement of the solar array towards the center of the property, no matter how large the property is. Additionally, the ORC discussed the zoning districts where solar farms are allowed, and determined that the permission of solar farms within urban zon ing district exclusively in the floodplain was no longer needed. 3 The ORC recommended the following revisions to the performance standards for solar farms: •Increasing the minimum lot size for solar farms from 10 acres to 20 acres. •Increasing the minimum setback from any principal structure on adjacent properties from 200 feet to 400 feet. •Including language that would require solar farms to “be located, insofar as possible, on a central portion of the property in order to minimize visual impact on adjacent properties and dwellings.” •Removing solar farms in the floodplain as a permitted use within urban zonin g districts. •Amending the definition of a solar farm to clarify that it is capable or intended to distribute electricity for off-site use. 4. STAFF RECOMMENDATION: Staff recommended that the Planning Commission recommend approval of the proposed text amendments to the City Council. 5. PLANNING COMMISSION RECOMMENDATION: The Planning Commission unanimously recommended that the City Council approve the ordinance amending the solar energy systems ordinance. (2) Performance standards for solar farms. Solar farms shall be erected and maintained to meet the following standards. a. Solar farms shall be located on a minimum lot size of 10 20 acres within the Long Term Agricultural (LA), Agricultural (AG), Rural Residential (RR), and Future Urban Service (FUS) zoning districts. Solar farms may also be located in any other zoning district only in the floodplain, as long as all other conditions are met. b. Solar farms shall be 100 feet from all property lines, 200 feet from all public road rights-of-way, and 200 400 feet from any principal structure on adjacent properties. c. Solar farms shall be located, insofar as possible, on a central portion of the property in order to minimize visual impact on adjacent properties and dwellings. dc. Solar farms shall be limited to a size of 5 acres, measured by the exterior edges of the solar array. ed. Ground mounted solar energy systems shall not exceed 15 feet in height at any point when oriented at maximum tilt. fe. Solar farms shall be enclosed by approved perimeter fencing or adequate vegetative buffer for screening. The primary form of buffer for screening shall be at least 6-foot tall vegetation. Exception may be granted if the natural landscape provides screening from all public right of ways and neighboring properties. gf. All ground areas within the perimeter fencing of a solar farm that are not occupied by equipment or access paths shall be planted with deep rooted, native pollinator plantings. hg. Solar farm applications shall include a vegetation establishment and management plan which shall be reviewed and approved by staff. ih. The owner/ operator of the solar farm shall provide the City with evidence that the solar energy system is functioning properly. This shall be provided at any time deemed necessary by the City. ji. The owner/operator shall submit a decommissioning plan for the solar farm to ensure that the owner/operator properly removes the equipment and facilities upon the end of the project life, abandonment, expiration, or termination of the interim use permit. If the solar energy system remains nonfunctional or inoperative for a continuous period of 12 months, the system shall be deemed abandoned and shall constitute a public nuisance. The owner shall remove the abandoned system at their expense after a demolition permit has been obtained within 90 days after notice has been given. Removal includes the entire structure including transmission equipment, structures Ordinance 2025-XX Amended Solar Energy Systems Ordinance and foundations, and the restoration of soil and vegetation. The owner/operator shall provide a current-day decommissioning cost estimate, and shall post financial security in a form acceptable by the City. This estimate must include an inflationary escalator, in an amount determined by the City, which will allow the City to remove the solar farm from the property after the 90-day period has elapsed. SOLAR ENERGY SYSTEMS ORDINANCE 2025-XX AN ORDINANCE AMENDING CHAPTER 90 – ZONING AND LAND USE AS IT RELATES TO SOLAR ENERGY SYSTEMS TITLE: An ordinance adding to and amending Chapter 90, Article I. – IN GENERAL, Section 90-1. – Definitions, Chapter 90, Article IV. – Zoning District Regulations, and Chapter 90, Article VI. – REQUIREMENTS FOR SPECIFIC USES AND PERFORMANCE STANDARDS, Section 90-278. – Solar energy systems. THE CITY OF HUGO ORDAINS: The City Council of the City of Hugo does hereby amend Chapter 90, Article VI, Section 90-278, to revise the following sections of Chapter 90 ZONING AND LAND USE, Article I IN GENERAL, Section 90-1 DEFINITIONS Amend the definition of Solar Farm to read as follows: Solar Farm means a solar energy system that is composed of multiple solar panels where the primary land use, whether by footprint or visual impact or both, of the parcel is for a solar array. A solar farm produces energy for wholesale to subscribers, or is capable of producing, or is otherwise intended to, produce energy beyond that which is necessary solely for on-site use. The City Council of the City of Hugo does hereby amend Chapter 90, Article IV Zoning District Regulations to amend of the following Sections: Sec. 90-93. – Long-term agricultural district (LA). (2) Performance standards for solar farms. (a) Solar farms shall be located on a minimum lot size of twenty acres within the Long Term Agricultural (LA), Agricultural (AG), Rural Residential (RR), and Future Urban Service (FUS) zoning districts. (b) Solar farms shall be 100 feet from all property lines, 200 feet from any public road rights- of-way, and 400 feet from any principal structure on adjacent properties. (c) Solar farms shall be located, insofar as possible, on a central portion of the property in order to minimize visual impact on adjacent properties and dwellings. (d) Solar farms shall be limited to a size of 5 acres, measured by the exterior edges of the solar array. (e) Ground mounted solar energy systems shall not exceed 15 feet in height at any point when oriented at maximum tilt. (f) Solar farms shall be enclosed by approved perimeter fencing or adequate vegetative buffer for screening. The primary form of buffer for screening shall be at least 6-foot tall vegetation. Exception may be granted if the natural landscape provides screening from all public right of ways and neighboring properties. (g) All ground areas within the perimeter fencing of a solar farm that are not occupied by equipment or access paths shall be planted with deep rooted, native pollinator plantings. (h) Solar farm applications shall include a vegetation establishment and management plan which shall be reviewed and approved by staff. (i) The owner/ operator of the solar farm shall provide the City with evidence that the solar energy system is functioning properly. This shall be provided at any time deemed necessary by the City. (j) The owner/operator shall submit a decommissioning plan for the solar farm to ensure that the owner/operator properly removes the equipment and facilities upon the end of the Ordinance 2025-XX Amended Solar Energy Systems Ordinance project life, abandonment, expiration, or termination of the interim use permit. If the solar energy system remains nonfunctional or inoperative for a continuous period of 12 months, the system shall be deemed abandoned and shall constitute a public nuisance. The owner shall remove the abandoned system at their expense after a demolition permit has been obtained within 90 days after notice has been given. Removal includes the entire structure including transmission equipment, structures and foundations, and the restoration of soil and vegetation. The owner/operator shall provide a current-day decommissioning cost estimate, and shall post financial security in a form acceptable by the City. This estimate must include an inflationary escalator, in an amount determined by the City, which will allow the City to remove the solar farm from the property after the 90-day period has elapsed. PLANNING COMMISSION MEETING UPDATE At its meeting of March 27, 2025, the Planning Commission held a public hearing and considered the proposed ordinance amendments. No one from the public spoke during the public hearing. The Planning Commission discussed the proposed ordinance amendments, and there were a few Commissioners who felt that there should be a determination of how to measure whether a trailer has moved at least three tenths of a mile from its original location. Staff will continue to work internally to determine a method for measuring that distance. With the recommendation of determining a method of measurement, the Planning Commission unanimously recommended that the City Council approve the ordinance approving amendments to the parking ordinance. 2. BACKGROUND: City Code currently restricts the amount of time that vehicles and trailers may be parked on any city street to 72 hours, during the months that the winter parking ordinance is not in effect. Section 90-253 (g)(1)(b) currently states that “no person shall park any vehicle or trailer on any street within the city for an excess of 72 hours.” The intent of this ordinance is to allow for reasonable and temporary parking of vehicles and trailers on city streets, while not allowing the public street to be used as long-term storage. The City received complaints relating to boats and trailers being stored on city streets long-term. The current ordinance is not explicit in its intent to prevent long-term storage of equipment on city streets, and the City has found difficulty in enforcing this intent. Additionally, the long-term storage of vehicles and trailers on public streets creates disruptions to maintenance operations such as street sweeping, and in some cases, damage to city streets will occur. At its meeting of March 3, 2025, the City Council authorized staff to work with the City Attorney on drafting amendments to the Prohibited Parking section of the Parking and Loading ordinance. Within the same ordinance section, there are standards for parking large recreational vehicles. G.5 2 Staff has drafted text amendments that include the following: • Removing trailers from the 72-hour timeframe under Sec. 90-253(g)(1)(b) to allow for vehicles to be parked on city streets up to 72 hours, but not trailers. • Prohibiting parking of trailers on all public streets, except while being loaded or unloaded, for a cumulative 24 hours during a seven-day period. • Language stating that a trailer parked on public streets must be moved at least three- tenths of a mile within the seven-day period, or will be considered to have remained parked by the City. 3. STAFF RECOMMENDATION: Staff recommended approval of the proposed ordinance amendments to the Planning Commission. 4. PLANNING COMMISSION RECOMMENDATION: The Planning Commission recommended that the method of measuring whether a trailer has moved a distance of three tenths of a mile be determined. In order to expedite the prompt and efficient removal of snow from the streets of the city it is unlawful for any person to stop, stand or park any vehicle or trailer or permit the same to stand on any street within the city between the hours of 2:00 a.m. and 7:00 a.m. from November 1 until March 31 of the following year. At all times of the year it is unlawful for any person to stop, stand or park any vehicle or trailer or permit it to stand on any public street within the city between the hours of 2:00 a.m. and 7:00 a.m. after a continuous or intermittent snowfall, during which there has been an accumulation of two inches or more of snow on any street, until the snow has been plowed or removed to the full width of the street. b. No person shall park any vehicle or trailer on any street within the city for an excess of 72 hours. c. Parking of trailers is prohibited on all public streets, except while being loaded or unloaded for a cumulative period not to exceed 24 hours during any seven-day period. d. For the purposes of the time limitations outlined in subsection (c) of this ordinance section, any vehicle or trailer moved a distance of three-tenths of a mile or less during the seven-day period shall be deemed to have remained parked. e. Vehicles and trailers may be parked in the front yard, provided it is kept on an established driveway, and is entirely on the equipment owner's property. f. Within any residential zoning district, parking of any vehicle or trailer exceeding 9,200 pounds licensed gross vehicle weight on any property or public street is prohibited, except under the following conditions: 1. Vehicles lawfully delivering goods, products, or services to a property may be parked for a reasonable period of time on the property or adjacent street to deliver such goods, products or services. 2. Vehicles used in construction activities may be parked or stored on the site of such construction activities for a reasonable period of time to complete the work. Parking of these vehicles on a city street is allowed only by permit issued by the city engineer. 3. Vehicles primarily used in the conduct of agricultural activities may be parked on the property where the agricultural activities are undertaken, or the farmstead of the vehicle owner. g. Any vehicle parked in violation of these sections more than two times in any 30-day period may be towed pursuant to Minn. Stat. § 169.041. Violation of this section shall constitute a petty misdemeanor with a fine of $50.00. WITNESS: The Shores of Oneka Lake 5th Addition 2 WHEREAS, the City Council of the City has, by Resolution Number 2022-33 on June 6, 2022, approved the preliminary plat for a major subdivision as proposed by the Developer to be known as "The Shores of Oneka Lake" ; and, WHEREAS, the City Council of the City has, by Resolution Number 2022-32 on June 6, 2022, approved the PUD general plan for a major subdivision as proposed by the Developer to be known as " The Shores of Oneka Lake” ; and, WHEREAS, the City Council of the City has, by Resolution Number 2025-____ on April 7, 2025, approved the final plat for a major subdivision as proposed by the Developer to be known as " The Shores of Oneka Lake 5th Addition" (hereinafter referred to as the "Plat"); and, WHEREAS, the Plat proposed a development of an approximately 6 acre parcel of land into 26 residential lots; and, WHEREAS, it is the policy of the City to enter into development contracts as contemplated in Minnesota Statutes §462.358, Subd. 2(a); and, WHEREAS, the parties hereto desire to set forth their respective rights and obligations of the parties to this Agreement. NOW, THEREFORE, in consideration of the premises and of the mutual promises and conditions contained herein, it is agreed by the parties hereto as follows: A. GENERAL ENGINEERING CONDITIONS; 1. Escrow for City Costs and Fees. Developer shall, contemporaneously with the execution of this Agreement, deposit with the City an escrow as outlined in Exhibit C to cover the cost of legal fees, engineering and construction observation fees, administrative expenses, and other costs related to this Plat, including the Highway 61 roundabout improvements construction. All fees and costs incurred by the City in connection with the Plat shall be charged against said escrow account which shall remain in effect until the expiration of the warranty period for the Plat, as defined in paragraph 7, in all events said fees and costs shall be the responsibility of the Developer and shall be paid on demand. Any funds remaining in the escrow account after the completion of the warranty period shall be refunded to the Developer. In the event that the escrow account herein is depleted, Developer agrees to post additional funds to replenish the account and to cover projected City costs. Specifically, Developer agrees that the escrow account shall maintain a balance of no less than $5,000.00. Developer shall be entitled, upon request, to an itemized statement of all costs and fees charged against this escrow account. The Shores of Oneka Lake 5th Addition 3 2. Development Plans. In accordance with the policies and ordinances of the City, and subject to all City resolutions and approvals in connection herewith, the Developer shall construct the proposed improvements (hereinafter referred to as the "Improvements"). All Improvements shall be constructed and installed pursuant to the terms and conditions herein set forth in accordance with the plans approved and listed on Exhibit A, subject to all City resolutions and approvals listed in Exhibit B, subject to final approval by the City, and in accordance with City standards and requirements including those listed herein. In addition, all public street, utility, and storm drainage improvements shall comply with the City’s adopted specification book and the reasonable direction of City staff. 3. Authorization to Proceed with Construction. Developer agrees not to commence any grading, utility or street work within the Plat until the following are completed: 1) Construction plans are approved by the City and distributed. 2) Pre-construction conference is held. 3) Notice to Proceed is issued. 4. Construction Observation. The City, for its benefit, will provide staff of its choosing to provide construction observation for the Improvements outlined in this Agreement. All costs associated with construction observation and inspection will be the responsibility of the Developer. The Developer shall allow City staff and City consultants access to the Plat to allow for this work to occur. 5. Miscellaneous Requirements. a) Property Corners: All property corners as identified on the Plat must be monumented with iron surveyor's pipes by the Developer prior to final project acceptance, as defined in paragraph 7 of this Agreement. b) Drainage Easements: Drainage easements shall be dedicated on the Plat so as to cover any wetlands and stormwater ponding areas located below the 100-year high water levels. c) Soils Testing: Soils inspection and compaction testing by a registered professional engineer shall be accomplished on all lots where filling is required, in accordance with the approved Grading, Drainage, and Erosion Control Plan. A minimum of one (1) compaction test for all developed lots shall be obtained for every two (2) foot increment of fill that is placed. A summary of all inspections and compaction tests for all developed lots shall be provided to the City upon completion of the grading and shall be provided for a respective lot prior to the issuance of a building permit for such lot. d) Private Utilities: All private utilities that are installed, including electricity, telephone, natural gas and cable television, shall be installed underground. e) Mailboxes: Developer shall coordinate mailbox locations with the The Shores of Oneka Lake 5th Addition 4 United States Postal Service. f) Street Lights: Street lights shall be installed within the Plat according to the Street Lighting Plan, which will first be approved by the City Engineer. Developer shall also submit its Street Lighting Plan to the applicable power company for its review, comment and approval. The installation of the street lights shall be coordinated with the applicable power company so that the street light system is installed, constructed and operated in such a manner as will harmoniously exist with other street lights within the area. g) Working Hours: Construction activity, including equipment startup and fueling, can only occur between the hours of 7:00 a.m. and 7:00 p.m. Monday through Friday; 8:00 a.m. and 5:00 p.m. on Saturdays; at no time on Sundays or holidays. h) Street Sweeping: Developer shall sweep and/or otherwise clean all streets, as needed, within and adjacent to the -Plat as a result of construction activities associated with the Plat until final acceptance of the Improvements. If the streets are not maintained in a manner acceptable to the City, after reasonable notice to the Developer the City will arrange for the street sweeping at Developer’s cost. i) Placement of Bituminous Wear Course: The bituminous wear course can be placed on all streets once all of the following have occurred: 1. A Certificate of Occupancy has been issued for at least 75% of the lots or a cash escrow in the amount of $10,000 has been deposit with the City which will be held until 75% of the lots have received Certificates of Occupancy. At the City’s discretion, the wear course may be placed prior to having 75% occupancy. If applicable, the warranty period shall be extended an additional one (1) year for a total of two (2) years from final acceptance. In no case shall the wear course be placed with less than 50% occupancy. 2. The base course on all streets has been in place for at least one full freeze-thaw cycle. 3. City staff or its assignees have visually inspected all roadways and curb within the Plat, and any repairs necessary as a result of said inspection are complete and written approval issued. 6. Project Completion: The Improvements listed herein on Exhibit A, including street, sanitary sewer, storm sewer, and municipal water, shall be completed subject to the approval of the City in accordance with the approved plans. All Improvements shall be substantially completed to the reasonable satisfaction and approval of the City within twelve (12) months of the execution of this Agreement. Substantial completion shall consist of all work with the exception of placement of the bituminous wear course and completion of the final punchlist. The Developer The Shores of Oneka Lake 5th Addition 5 shall be excused from the strict completion date set forth herein if written notice is received from the Developer of the existence of causes over which the Developer has no control which will delay the completion of the work and approved in writing by the City. In that event, the City may extend the date or dates herein specified. 7. Project Acceptance: Final project acceptance will be considered by the City Council once the following have been completed: (a) All Improvements are installed according to the approved plans. (b) All punchlist items are completed. (c) All Record Drawing information has been provided to the City to its satisfaction. (d) Escrow account for City costs and fees is current in accordance with the provisions of this Agreement. (e) The City receives confirmation via lien waivers that contractors or other parties have been paid for the work completed. (f) The City receives a written request from the Developer to accept the Improvements. 8. Record Drawing Requirements and Engineer’s Certification. Following completion of all development activities and prior to the release of security and acceptance of Improvements, the Developer and/or their assignee shall provide to the City "as-built" plans for the Improvements listed on Exhibit A. This information shall be provided to the City in the following formats: (a) 1-set mylar drawings (22” x 34”) for all Improvements. (b) 1-set paper drawings (22” x 34”) for all Improvements. (c) Individual Adobe.pdf (or approved equivalent) for all plan sheets and the final plat. All Record Drawings shall include the following information: (a) All bench marks shown on plans (bench marks shall be top nut of hydrants). (b) Swing ties to all gate valves shown on plans (ties should be to manholes, catch basins, hydrants or other permanent objects. (c) Swing ties to curb stops shown on plans (ties should be to manholes, catch basins, hydrants, property corners or other permanent objects). (d) Top of casting and invert elevation for all structures. (e) All pipe sizes, material type, pipe classification, grades and lengths (f) All horizontal and vertical curve data in the appropriate location on the plans. (g) Televised report of the sanitary sewer with videotape. (h) Swing ties to any manhole or catch basin outside the roadway area. The Shores of Oneka Lake 5th Addition 6 (i) A text file including the x, y and z coordinates (based on Washington County’s coordinate system) for the following: 1. All curb stops 2. All hydrants 3. All gate valves 4. All manholes located outside of the roadway 9. Construction Warranty and Financing of Improvements. The Developer agrees to construct the Improvements described herein at its own expense and in accordance with City specifications. The Developer shall engage at its own expense a registered, professional civil engineer to prepare plans and specifications for the Improvements and shall submit the same to the City for review and approval. The Developer represents and warrants that all of the Improvements made as a part of this development shall be guaranteed to be properly functioning as designed for a period of not less than one (1) year following acceptance of the entire project by the City. In the case of any material or labor that is supplied and that is reasonably rejected by the City as defective or unsuitable, then the rejected materials shall be removed and replaced with approved material, and the rejected labor shall be done anew to the reasonable satisfaction and approval of the City at the sole cost and expense of the Developer. In any event, none of the warranty periods expressed herein shall begin to run until all of the Improvements within the Plat have been approved and accepted by the City. The Developer’s engineer shall certify that grading within the Plat was completed in accordance with the approved Grading, Drainage and Erosion Control Plan before the City issues any building permits. The Developer shall remain ultimately responsible for accurate grading of all lots and shall correct any deficiencies in grading that may be discovered until the certificate of occupancy is issued for the applicable lot or the Developer is released from its obligation under this Agreement as outlined in paragraph 7 above. 10. Signs. The Developer shall prepare a plan for all regulatory, directional and street name signs to be within the Plat. The plan shall be reviewed and approved by the City’s public works department. Upon plan approval, the City’s public works department shall install all public signage within the Plat. The installation of all private signage shall be the responsibility of the Developer. All costs related to the installation of public signage shall be the responsibility of the Developer and will be deducted from the Developer’s escrow account. The Developer shall post funds as outlined in Exhibit C prior to the City’s public works department beginning the installation. 11. Drainage Easements. a) Work within Easements: No improvements, landscaping, or grading, other than Improvements shown on the approved plans, shall be permitted in dedicated drainage easements without the prior written permission of the City and any regulatory agency having The Shores of Oneka Lake 5th Addition 7 jurisdiction. b) Maintenance Responsibilities: The Developer and its successors in interest, including all individual homeowners, shall be responsible for routine maintenance of all storm water management ponds, wetlands, and drainage areas within easements dedicated to the City on their property. Routine maintenance shall include litter removal, mowing and maintenance of the property adjacent to pond or wetland areas. In the case of drainage swales, routine maintenance includes the removal of obstructions from the swale as necessary to maintain proper drainage in addition to the aforementioned items. The City shall be responsible for non-routine maintenance of storm water ponds within the easements, including pond dredging, maintenance of the storm water inlet(s) and outlet(s) pipes, and erosion control at outlet and inlet locations. Such maintenance shall be completed as deemed necessary by the City. 12. Wetland Signage: Permanent signage shall be placed along wetland edges as outlined in the City’s General Specification and Standard Details Manual or approved equal by the City. 13. Lowest Floor Elevations. All minimum floor elevations shall comply with Section 90-171 of the Hugo Zoning Ordinance, the City’s Comprehensive Stormwater Management Plan, or the approved Grading, Drainage, and Erosion Control Plan, whichever is more restrictive. Except as may be specifically allowed under Exhibit A, no building shall be constructed on any of the lots herein unless the lowest floor elevation is at least three (3) feet above the 100-year flood elevation or four (4) feet above the high groundwater elevation, whichever is greater, for the subject property. Additionally, the lowest floor elevation shall be specifically referenced and designated, for each lot, on a certificate of survey, which survey shall be provided to the City before any building permits are issued for any lots within the Plat. 14. Landscaping. All disturbed areas within the Plat shall be landscaped in accordance with the approved landscape plans, the City ordinances, and the City’s General Specification and Standard Details Manual. All landscaping shall be complete, established and growing within sixty (60) days of issuance of a Certificate of Occupancy, except that, if the certificate of occupancy is issued between the dates of October 1 and May 1, then the landscaping required herein shall be complete, established and growing no later than July 1. All front yards, side yards and back yards shall be fully sodded. All landscaped areas shall be tilled or otherwise worked mechanically in order to loosen compacted soils and shall contain at least four (4) inches of black dirt containing no more than 35% sand. Unless specific arrangements are made and agreed to by the City, all landscaping installed within the Plat shall be maintained by the Developer and its successors, including all individual homeowners or the homeowners association which is required to be formed by the Developer pursuant to the agreement. All areas, other than proposed street areas, disturbed by grading activities on the site shall be seeded. Seeding shall be immediate upon completion of grading activities or as directed by the City The Shores of Oneka Lake 5th Addition 8 Engineer. Seeding shall be completed as follows: a) All areas shall be restored with a minimum of four (4) inches of adequate topsoil prior to seeding. b) Upland areas shall be seeded in accordance with the grading, drainage, and landscape plans listed in Exhibit A. The rate of application shall be one hundred (100) pounds per acre. Areas seeded shall be mulched with Type 1 mulch at a rate of two (2) tons per acre. All mulch shall be disk anchored. c) Wetlands, wetland replacement areas and storm water ponding areas shall be seeded with MN/DOT Seed Mixture 25B, or as required by the permitting regulatory agency. The minimum rate of application shall be thirty (30) pounds per acre, or as recommended by the supplier. d) All seeded areas shall be maintained for the term of this Agreement. Upland areas shall be mowed as necessary or as directed by the City Engineer. e) All disturbed areas within the development shall be maintained to limit vegetation growth to less than ten (10) inches except designated natural areas or designated open spaces as shown on the approved plans. 15. Safe Rooms. The Developer shall require all builders to offer a safe room as an option to any and all potential homebuyers. All safe rooms offered and built within the City must meet or exceed FEMA requirements and standards. B. ESCROWS, CHARGES AND UTILITY OVERSIZING: Developer shall pay the escrows, fees and charges listed on Exhibit C. C. SPECIAL PLANNING REQUIREMENTS: The Plat shall be built and maintained in accordance with the planning requirements listed on Exhibit A hereto, and any miscellaneous requirements listed on Exhibit B hereto. D. ADMINISTRATIVE REQUIREMENTS: 1. Miscellaneous Provisions. Developer specifically understands that this Plat approval is given subject to the following requirements: a) Expiration. The final plat documents for the Plat, which is the first phase of The Shores of Oneka Lake preliminary plat, have been submitted to the City Council within one hundred twenty (120) days of preliminary plat approval. The final plat must be recorded with the Washington County Recorder (and the mylar "hardshells" must be fully executed) within sixty (60) days of the City Council motion giving final plat approval, unless such deadline is The Shores of Oneka Lake 5th Addition 9 extended by the City Council in its sole discretion, or else said approval shall be null and void. All fees relating to this subdivision shall be paid by the Developer, including the cost of recording documents with Washington County. b) Recording. The Developer shall record this Agreement with Washington County simultaneous with the recording of the Plat, and shall forward confirmation of recording of the Plat and this Agreement to the City prior to the issuance of building permits. All applicable conditions of Plat approval must be met before any deeds are stamped for recording and prior to the recording of the Plat at the Washington County Recorder's Office. Plat approval shall be contingent upon compliance with the approved plans for the Improvements and upon compliance with this Agreement. c) Model Homes. The Developer shall be entitled to two (2) building permits, subject to final approval by the Community Development Director, and under the following conditions: • The plat shall be recorded at Washington County • The Development Agreement shall be executed and recorded at Washington County. • All corresponding documents shall be reviewed and recorded per the Development Agreement. The development fees per Exhibit C shall be paid. • The building permit shall be for model homes only. • Building permits will be allowed at the end of an existing dead-end road. • All public utilities are installed adjacent to the model homes. • The construction entrance shall be stable and approved by the City Engineer. • The City will not snow plow the construction road. The developer will be responsible for the snow plowing. • Gradations (3 minimum) on the aggregate base placed on the roadway adjacent to the model homes will be performed 48 hours before pavement installation. Material must meet Class 5 or salvaged/recycled material meeting Class 5 gradation per MnDot Specification 3138. Aggregate base that no longer meets Class 5 gradation must be replaced before pavement is installed. • No Certificate of Occupancy for model homes or other homes shall be issued until all public improvements, including first lift of bituminous pavement, per the final plat construction plans have been constructed and inspected. Other Models Homes and Homes Constructed for Sale No other model homes may be constructed or utilized until at least one (1) lift of bituminous has been installed from said model home lot providing access to a public street or roadway outside of the Plat. No certificate of occupancy shall be issued for any model or other home until all necessary public improvements and utilities have been installed and the utilities have been successfully tested. Prior to this, and at the time that a model home passes final inspection, a model home may only be used by Developer’s, authorized builders, staff or realtors for purposes of showing the models to potential buyers. No model home may be used until landscaping conforming to City ordinance and paragraph 14 of this Agreement has been installed except that, if the certificate of occupancy is The Shores of Oneka Lake 5th Addition 10 issued between the dates of October 1 and May 1, then the landscaping required herein shall be complete, established and growing no later than July 1. d) Sales Trailers. The Developer may be entitled to a maximum of one (1) temporary sales office (sales trailer) for this and all subsequent phases of the development for a period of time not to exceed nine (9) months. Upon receipt of an acceptable site plan, a sales trailer may be approved by the City Community Development Director prior to the first model home being available for showing. The trailer is subject to the issuance of a building permit, shall meet all applicable building codes, shall be fully skirted, shall be suitably landscaped, shall contain sufficient parking for the size of the office, and shall have safe and suitable access to a paved, public roadway. The trailer shall be removed, and the site shall be restored within seven (7) days following the date that a model home passes final inspection. e) Deviations. No material deviations from the approved Plat shall be allowed unless approved in writing by the City. Approval herein is also given subject to full compliance with the conditions of approval and findings adopted by the City Council in connection with the approval of the development. f) Certificates of Survey. A certificate of survey shall be provided to the City Building Inspector for each lot at the time a building permit is requested for the lot. Attached to the certificate of survey shall be an erosion control plan for the lot showing location and type of all erosion control measures to be used on the lot, and spot elevations, tree preservation plan shall be submitted for each home site. g) Outhouses. The Developer shall provide on-site a sufficient number of portable outhouses to be available for the persons who will be working on-site until Improvements are accepted according to the plans in Exhibit A. h) Property Owners Association. When required as a condition of approval outlined in Exhibit B, the Developer agrees to form a property owners association, membership in which shall be mandatory for all of the lots within this development. The property owners association shall be responsible for maintenance and repair of all common elements as listed in the property owners association documents within this development and the same shall be maintained in good condition in accordance with all City ordinances and reasonable directions of the City. Developer agrees to provide a copy of the property owners association documents to the City prior to the recording of the final plat. In the event of failure or refusal of any property owners association to so maintain or repair the common elements then the City may, with seven days written notice and without regard to the requirements or formalities of Minn. Stat. §429 perform the work and assess each of the lots within the plat for the cost of the work. i) Intentionally deleted The Shores of Oneka Lake 5th Addition 11 j) The property owners association documents shall advise owners of all lots of the requirements of this Agreement as follows: THE LAND WITHIN THIS PLAT, INCLUDING THE LAND CONVEYED HEREIN, IS BOUND BY RESTRICTIONS IN A DEVELOPMENT AGREEMENT. SAID DEVELOPMENT AGREEMENT IS ON FILE AT THE OFFICE OF THE WASHINGTON COUNTY RECORDER. k) Developer acknowledges that a separate development agreement will be entered into at the time of final plat approval of subsequent phases in the development. That development agreement will address, among other things, necessary improvements to be made, financial guarantees to be provided, and the amount of the development fees to be paid by the Developer. l) Developer shall remove all tree waste, junk, miscellaneous debris, junk vehicles, and any other personal property from the Plat which does not comply with the City Zoning Ordinance until final acceptance of the Improvements. E. DAMAGES AND DEFAULT: 1. Developer agrees to pay liquidated damages to the City if any lot has a real estate closing occur before all public improvements within the Plat are certified as being substantially completed by the City. Specifically, Developer agrees to immediately pay to the City liquidated damages in the amount of Ten Thousand Dollars ($10,000.00) for each lot closing which occurs in violation of this paragraph. The City shall be authorized to retain an appropriate percentage of the financial guarantee referred to in paragraph 4 as security for payment of any liquidated damages owed to the City. Model Homes are exempt from this section. 2. Developer agrees to pay liquidated damages to the City, in the amount of Five Thousand Dollars ($5,000.00), if the Developer encroaches upon any City road right-of-way or utility easement not permitted on the plans without first obtaining a written permit from the City expressly authorizing said encroachment. The City shall be authorized to retain an appropriate percentage of the financial guarantee referred to in paragraph 4 as security for payment of any liquidated damages owed to the City. 3. Events of Default. a) Events of Default Defined. The following shall be "Events of Default" under this Agreement and the term "Event of Default" shall mean, whenever it is used in this Agreement, any one or more of the following events: 1. Subject to unavoidable delays, failure by Developer to commence and complete construction of the Improvements pursuant to the terms, conditions and limitations of this Agreement. The Shores of Oneka Lake 5th Addition 12 2. Failure by Developer to substantially observe or perform any material covenant, condition, obligation or agreement on their part to be observed or performed under this Agreement. b) Remedies on Default. Whenever any Event of Default occurs, the City, subject to any rights of third parties agreed to by the City pursuant to this Agreement, or otherwise by written, executed instrument of the City, may take any one or more of the following: 1. The City may suspend its performance under the Agreement until it receives assurances from Developer, deemed adequate by the City, that Developer will cure their default and continue their performance under the Agreement. Suspension of performance includes the right of the City to withhold permits including, but not limited to, building permits. 2. The City may initiate such action, including legal or administrative action, as is necessary for the City to secure performance of any provision of this Agreement or recover any amounts due under this Agreement from Developer, or immediately draw on the financial Letter of Credit, as set forth in this Agreement. 4. Enforcement by City; Damages. The Developer acknowledges the right of the City to enforce the terms of this Agreement against the Developer, by action for specific performance or damages, or both, or by any other legally authorized means. The Developer also acknowledges that its failure to perform any or all of their obligations under this Agreement may result in substantial damages to the City; that in the event of default by the Developer, the City may commence legal action to recover all damages, losses and expenses sustained by the City; and that such expenses may include, but are not limited to, the reasonable fees of legal counsel employed with respect to the enforcement of this Agreement. F. THIS AGREEMENT: 1. Release of Agreement. This Agreement shall run with the land and may be recorded against the title to the property. After the Developer has completed the work required of it under this Agreement, at the Developer’s request the City will execute and deliver to the Developer a release. 2. Warranty of Title. Developer warrants and represents to the City that it is the fee owner of the land described herein, except for a portion of the property, and that it has authority to execute this Agreement, with consent from the other fee owner, and agree to the The Shores of Oneka Lake 5th Addition 13 conditions hereof and to subject the land hereto. Developer also represents and warrants that the use for which this development is sought will not violate any restrictive covenants applying to the property. 3. Binding Effect. This Agreement shall be deemed to be a restrictive covenant and the terms and conditions hereof shall run with the land described herein and be binding on and inure to the benefit of the heirs, representatives and assigns of the parties hereto, and shall be binding upon all future owners of all or any part of the subdivision, and shall be deemed covenants running with the land. Reference herein to the Developers, if there be more than one, shall mean each and all of them. This Agreement shall be placed of record so as to give notice hereof to subsequent purchasers. The cost of said recording shall be borne by the Owner and charged against the escrow account. 4. Restrictions on Transfer/Indemnification. Developer agrees to defend and hold the City, and its officials, employees and agents, harmless against any and all claims, demands, lawsuits, judgments, damages, penalties, costs and expenses, including reasonable attorney's fees, arising out of actions or omissions by Developer, their employees and agents, in connection with the Project. No transfer or assignment of this Agreement shall be made without City approval and any assignment or transfer without such approval shall be void. 5. Incorporation by Reference. The final plat is approved to allow the creation of 52 lots, in accordance with the plans and application received by the City on March 13, 2025, except as amended by this resolution. 2. The development shall substantially comply with all plans and conditions of the PUD and preliminary plat approval granted by the City on June 6, 2022. 3. Development standards shall comply with Resolution 2022-32 and 2022-33, and as amended. 4. The developer shall comply with all conditions outlined in the City Engineer’s memo dated May 16, 2024, and revisions required in “redlined” comments from the City Engineer. 5. The developer shall design and install a stormwater re-use system for irrigation of the individual lots. 6. The developer shall establish a property owners association for the development to own/operate/maintain common elements, monument signage, landscaping, and the water re-use system. The property owners association documents shall be reviewed and approved by staff prior to recording the plat. 7. The landscaping planned for the plat shall be installed in one phase. The developer shall take proper precautions to protect the trees as the homes are being built. 8. Each home shall include a minimum of 2 parking spaces within the driveway. The driveway widths shall be a maximum of 24 feet at the right of way line. 9. Staff will continue to work with the applicant on the street lighting plan. Exact locations of the street lights shall be reviewed and approved by staff prior to installation. The Shores of Oneka Lake 5th Addition 18 10. When needed, a Letter of Map Revision will need to be prepared and submitted for FEMA approval so that the existing floodplain boundaries and elevations can be revised per the plans. 11. The developer shall obtain all necessary local, state, and federal permits. 12. The property owners association shall be responsible for maintenance of all development signage (if any) and landscaping within the outlots, common space, and the 159th Street roundabout. 13. Prior to recording the final plat: a) The developer must obtain all necessary stormwater management and wetland conservation act (WCA) permits from the City. b) The developer shall pay $52,598 ($2,023/lot) in full to satisfy the required cash in lieu of parkland dedication requirement. A portion of the Park Dedication was previously satisfied by dedication of 3.89 acres of upland on Outlot G. c) The developer shall pay the sewer and water trunk fees for each lot at final plat. The City’s SAC and WAC fees will be paid at the time building permits issued. d) The applicant shall provide copies of the property owners association documents/covenants for City review and approval. A copy of the document shall be filed for recording with the final plat. e) A stormwater reuse agreement shall be reviewed and approved by staff and recoded at Washington County. f) The developer shall enter into a development agreement, shall agree to complete all improvements, and pay all fees as required by the agreement. 14. Prior to the issuance of building permits: The Shores of Oneka Lake 5th Addition 19 g) The applicant shall file the final plat, development agreement and associated documents with Washington County. Proof of recording shall be provided to the City. 15. Prior to the issuance of Certificate of Occupancy: h) All public improvement required with the development agreement shall be installed. The Shores of Oneka Lake 5th Addition 20 EXHIBIT C ESCROWS, FEES AND CHARGES a) Escrow for City Costs and Fees. The Developer shall deposit sufficient escrow with the City as outlined in Section A. 1. The required beginning balance in the account is calculated at $________________. This sum is calculated to be four percent (4%) of the estimate of the required Improvements to be installed to serve the development, plus $5,000 which is the minimum balance required in the account. b) Cash Escrow or Letter of Credit. The Developer shall provide a financial guarantee to the City, in the form of a cash escrow or letter of credit, in the amount equal to one hundred twenty-five percent (125%) of the estimated amount of the required Improvements. BOARD OF ZONING MEETING UPDATE: At its meeting of March 13, 2025, the Board of Zoning Appeals and Adjustments held a public hearing and considered the request. No one spoke during the public hearing. Following discussion, the Board agreed that the applicants met the criteria to approve a variance, and unanimously recommended that the City Council approve the variance request. 2. DESCRIPTION OF REQUEST: The applicants are requesting a variance is to allow for the construction of a 2,336 square foot attached garage and car port, where 1,678.75 square feet is allowed by ordinance. The garage is proposed to have an area of 1,920 square feet, and the car port is proposed to have an area of 416 square feet, totaling 2,336 square feet. ANALYSIS: A. Surrounding Land Use and Zoning The surrounding properties are zoned R-1 and are classified as Very Low Density (VLD) in the 2040 Land Use Plan. The surrounding properties range from one to ten acres in size and are occupied by residential homes. B. Natural Characteristics of the Site The site has some slight sloping terrain with the highest portion of the property in the west- center. The applicants are proposing to construct the house and garage at this portion of the property. The property has some existing large trees and wooded areas that will provide screening from adjacent properties and view of the road. 5. VARIANCE STANDARDS: The Board must review the requested variances with the standards outlined in Section 90-38 of the land use regulations. Staff used these standards to review the variance request and finds the following: (1) Law. The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term “Practical Difficulties” as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and; Attached garages are allowed in the R-1 zoning district, and are allowed to be 1,000 square feet plus 25 percent of the amount by which the footprint of the house building exceeds 1,000 square feet in size. In this case, with the house proposed to be 3,697 square feet, the attached garage would be allowed to have a size of 1,678.75 square feet. There are no accessory buildings currently on the property, but this property would be allowed to have two accessory buildings with a maximum combined size of 1,500 square feet. The applicant has stated that they do not have the desire to construct any accessory buildings, and would not construct any accessory buildings in the future as a condition of approval of the variance. The applicant is proposing to use the property in a reasonable manner. Manning Variance – 4938 121st Street North Page 3 3 b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and; The property is unique in that it is surrounded by other parcels on nearly all sides, with a long driveway connecting the property to 121st Street North, creating a large buffer between the property and the view of any nearby road. The house is proposed to be constructed in the west-central portion of the property – the highest location on the property. There are several wooded areas on the property creating a visual buffer from neighboring properties. The applicant has stated that constructing a larger attached garage would be preferred to constructing accessory buildings with associated driveways, which would produce a more substantial impact to neighboring properties with buildings being closer to them, and would require additional tree removal and driveway construction. It is in staff’s opinion there are unique circumstances because of the location of trees and the unique position of the property and house location. c. Character of Neighborhood. The variance, if granted, will not alter the essential character of the neighborhood. Attached garages are common in the R-1 zoning district. The applicants are proposing to construct a larger attached garage with a car port, rather than construct a number of accessory buildings with associated driveways. The property is separated from view of the road by another property to the south, and the garage will be screened by the existing tree cover. The applicant has agreed to not construct any accessory buildings as a condition of approval for the variance request. It is in staff’s opinion that the requested variance will not significantly alter the essential character of the neighborhood. It is in staff’s opinion that there are practical difficulties in meeting the size requirements for an attached garage (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City’s Comprehensive Plan. The spirit and intent of the attached garage ordinance is to not have the attached garage dominate the look of the front of the house. The proposed attached garage will be screened from view of adjacent properties by existing trees, and the view from the road is buffered by the property to the south. The applicant has agreed to not construct any accessory buildings as a condition of approval for the variance request. It is the staff’s opinion that the requested variance would not make the attached garage and car port dominate the exterior of the house, and that precluding accessory buildings on the property Manning Variance – 4938 121st Street North Page 4 4 would create less of a visual impact than an attached garage. The requested variance is keeping with the spirit and intent of the ordinance. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. Attached garages are permitted in the R-1 zoning district. (5) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. The property is not located within a FEMA designated floodplain. (6) Septic and Well Compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The property will be served by municipal sewer and water services. 6. CONCLUSION: It in staff’s opinion that the applicant meets all the criteria necessary to approve the variance request, with the condition that no accessory building shall be constructed on the property in the future. 7. STAFF RECOMMENDATION: Staff recommended approval of the variance request to the Board, subject to the conditions in the resolution. 8. BOARD OF ZONING RECOMMENDATION: The Board unanimously recommended that the City Council approve the resolution approving the variance request, subject to the conditions in the resolution. Minnesota Statute 103D.311 requires that the County Board select watershed district managers from an aggregate list of persons nominated by the townships and municipalities that are within the watershed district. The county will aggregate the names of nominees from all the lists submitted by the townships and municipalities for the board’s consideration. If the aggregate list of nominees contains at least three names, the county must appoint a manager from the list of township and municipality nominees. In making the appointment, the county must also consider the statutory requirement that managers be appointed to fairly represent the hydrological areas of the district. If the aggregate list contains less than three nominee names, or if appointing a nominee from the submitted lists will not allow for fair representation of the various hydrological areas of the district, the county board may appoint any individual who resides within the watershed district and is otherwise eligible to serve. If you wish to submit a list of nominees for consideration, your list should be addressed to Chair Commissioner Stan Karwoski and sent to me prior to April 18, 2025.
