G.2 Approve Hiring of Public Works Summer Seasonal Positions Staff is requesting Council approval to hire seasonal employees for the Public Works Department. In the 2025 General Fund Budget, Council approved funding for seven seasonal employee positions. There are five seasonal workers who will be returning from last year. Staff has interviewed new potential hires and are recommending approval of two new seasonal employees. Seasonal Public Works Employees assist with mowing, garbage/litter removal, park maintenance, boulevard maintenance and general Public Works maintenance. Staff recommends Council approve the rehiring of last year’ s seasonal employees Adler Siebenaler, William Heise, Beck Rogers, Jacob Weierke, Kristofer Bower and hire the two new employees, Allison Siebenaler and Matias Evert. G.3 Approve Special Event Permit for Blacksmith Lounge 2025 Events The Blacksmith Lounge, 17205 Forest Boulevard North, has applied for a Special Event Permit for their 2025 events to be held between Memorial Day and end of September. Events include four auctions, seven car shows, one motorcycle swap meet, and one White Bear Lake Hockey fundraising event. A SEP approved by Council is required because there will be alcohol served outside and there may be up to 200 people in attendance. Staff recommends Council approve the Special Event Permit for the Blacksmith Lounge. G.4 Approve Off-Site Gambling Permit for Merrick, Inc. for Good Neighbor Days Bingo Merrick, Inc. is requesting an Off-Site Gambling Permit to conduct Bingo during Hugo Good Neighbor Days on Saturday, June 7 and Sunday June 8, 2025. Lawful Gambling Permits are issued by the MN Gambling Control Board after approval of the City. Staff recommends Council approve the Off-Site Gambling Permit for Merrick, Inc. to conduct Bingo during Good Neighbor Days. G.5 Approve Resolution Declaring Approval to Modify the Municipal State Aid Street System Per State Aid Rules, a City is allowed to add and/or remove mileage annually, provided it meets necessary criteria. In an effort to maximize the construction needs of Hugo’s MSAS system and with the goal of strategically using the annual available allotment of State Aid funds to the City, staff is recommending modifications to the system. The recommended modifications are to add both 159th St N from TH61 to Goodview Ave N and Goodview Ave N from 159th Street to Oneka Lake Blvd while at the same time revoking Farnham Ave. N. from 149th St. N. to Oneka Pkwy N. Staff recommends that Council approve the resolution declaring approval of modifications to the MSAS for the City of Hugo and direct staff to submit per MNDOT requirements. G.6 Approve Quote for 2025 Dust Control Project The City of Hugo currently applies dust control to approximately 23 miles of gravel roads located within its municipal boundaries, and the City’s General Budget accounted for a dust control project in 2025. As in past years, staff would work with May Township to cost share for the application of dust control on the shared portion of Keystone Avenue. Two quotes for dust control were received and opened on April 11, 2025. The low quote was from Envirotech Services at $1.49 per gallon. With City Council approval, staff would coordinate with Envirotech Services to deliver and place a total of 109,000 gallons of calcium chloride in two separate applications, once in mid- June and again in mid-August. Staff recommends Council approval of the quote from Envirotech Services for calcium chloride for 2025 dust control. G.7 Approve Resolution Approving Encroachment Agreement for 6260 157th Court North Danielle and Marcus Haug have requested an encroachment agreement to allow for the construction of a fence within a drainage and utility easement on property located at 6260 157th Court North. The Senior Engineering Technician has reviewed the location of the fence and is comfortable with the request. Staff recommends that the City Council approve the resolution approving an encroachment agreement for 6260 157th Court North. G.8 Approve Letter of Support for Comcast’s Application for the BEAD Grant Comcast is applying for a Broadband Equity Access and Deployment (BEAD) grant from the Minnesota State Broadband office to provide service to eligible locations in Hugo. They believe there could be as many as 260 eligible locations that are unserved or underserved (speeds less than 100/20 Mbps). Comcast believes the BEAD application will provide the necessary resources to the residents of Hugo as part of an application to serve areas in Washington County. Staff recommends Council approve the letter of support for Comcast’s application for the BEAD grant. I.1 Approve Purchase of Playground Equipment for Oneka Lake Park At the meeting of March 3, 2025, the Council approved reconstruction of Oneka Lake Park and authorized Flagship Recreation to draft concepts for a new playground. The Parks Commission held a neighborhood meeting on April 16, 2025, and gathered input on two playground designs and eight color schemes. The Parks Commission is recommending approval of the purchase and installation of playground equipment and pour-in-place surfacing from Flagship Recreation in the amount of $282,052 at Oneka Lake Park. J.1 Discussion on 165th Street AUAR Study At its January 27, 2025, goal setting meeting the City Council directed staff to bring forward a scope of work for a corridor study for 165th Street. There is increased interest in development along 165th Street and there are constraints for development in that area due to road improvements, utility extension, land use and natural resources. Staff put together a scope of work for an Alternative Urban Areawide Review (AUAR) that will analyze multiple development scenarios including land use, infrastructure, environmental assessment, and costs. The AUAR will include public engagement and will inform the 2050 Comprehensive Plan. The consultants proposed to work on the study are WSB and Landform. The total cost of the study is $167,324. Staff recommends the City Council authorize staff to move forward with the AUAR. J.2 Approve Resolution Authorizing an Application for the Washington County Pre- Development Grant for 165th Street AUAR Study Washington County Community Development Agency (CDA) provides the opportunity for pre- development grants to cities for area studies, such as the proposed 165th Street AUAR. The AUAR meets the pre-development grant criteria for increased growth for economic development and will provide planning recommendations through analysis of land use, infrastructure, and natural resources to inform development in the area. The 2040 land use along 165th Street is residential, commercial and industrial. Staff recommends applying for a pre-development grant to evaluate a number of key elements to facilitate the development of this area. Staff recommends approval of the resolution authorizing submittal of the Washington County CDA pre-development grant application in the amount of $40,000, which is the maximum grant amount allowed. M.1 Reminder – Metro Cities Annual Meeting on April 23, 2025 The Council has scheduled a meeting to attend the Metro Cities Annual Meeting on April 23, 2025, at 5 p.m. at the Roseville Skating Center in Roseville. M.2 Reschedule City Administrator Performance Review to May 5, 2025 Due to a schedule conflict, staff recommends Council reschedule the City Administrators performance review to from April 21, 2025, to May 5, 2025. Washington County Sheriff’s Department Annual Report and Introduction of New Washington County Deputy Michael Nunan - Sheriff Dan Starry Sheriff Dan Starry was in attendance with Chief Deputy Doug Anschutz, Commander Sara Halverson, and Sergeant Matt Wieland. Wieland introduced Deputies Isaac Robbins and Michael Nunan and explained that there were currently three deputies out on leave. Council Meeting Minutes for April 7, 2025 Page 2 of 7 Michael Nunan provided the Council with his previous work experience as a deputy, saying he had served in St. Paul Park, Le Sueur, and Henderson. He started with Washington County in January. Starry provided a report on activities at the Sheriff’s Office. He began by explaining the price per capita for Hugo was $104.62, which was considerably less than other cities. Under the Hugo contract, the City receives the full breadth of the Sheriff’s Office. He talked about CrimeView, new software that pulls data from the dispatch center. This helps them spot trends and understand crime patterns. He discussed the increased number of thefts from vehicles in parking lots and cautioned residents to ensure valuables are hidden and doors are locked. Starry reported on the 9,784 service calls the Sheriff’s Department received, which was 7% more than in 2023. The Department issued 561 tickets in 2024 but had many other traffic stops that involved education and/or a verbal warning. There were 272 cases assigned to the investigation’s unit, 118 of which were assigned to Detective Jaring. Arrests and motor vehicle accidents remained about the same as in 2023, and mental health/persons-in-crisis calls had declined. He attributed this to their new system that embedded a crisis communicator and a coordinated response team, which are able to meet needs quickly. He encouraged people to call 911 if they ever see anything suspicious, no matter the time of day, and warned of the continuing fraud tactics being used. Accomplishments during 2024 included the seizure of over $4.1 million in drugs, the arrest of five men recently involved in human trafficking, two national awards received by the K9 Unit, and the positive interactions children have had through the DARE program. He provided a reminder that April 13–19 was National Public Safety Telecommunicators Week, May 4–10 was National Correctional Officers Week, and May 11–17 was National Law Enforcement Week. He invited the Council to attend the Law Enforcement Memorial Ceremony at the Courthouse on May 15, 2025, at noon. He thanked the Council for their continued support, and Mayor Weidt expressed appreciation for all the experience their team brings to Hugo. Update from Washington County Commissioner Fran Miron Washington County Commissioner Fran Miron was in the audience. Mayor Weidt asked him to give an update on activities at the County. Commissioner Miron began by saying they appreciate the leadership of Sheriff Starry and that the Sheriff’s Department has the full support of the Washington County Board. The County will be working on improvements to Highway 61, and more information can be found on their website. At the last County Board meeting, they honored Adam Josephson, who recently retired from MnDOT. The County is beginning the budget process, keeping in mind that there are many uncertainties due to reduced state and federal funding. Miron said he believed the County had done a good job maintaining a healthy level of reserves. Council Meeting Minutes for April 7, 2025 Page 3 of 7 Miron spoke about the North Environmental Center, which recently opened to serve the northern part of the County and encouraged everyone to bring their hazardous waste there. He also mentioned the free product room and said he was happy they were making use of materials rather than discarding them. He talked about the wood waste site on 165th Street, saying he appreciated the process they have with the property owner. More information can be found on the County’s website. Approve Donation to the Hugo Fire Department from the Hugo American Legion The Hugo American Legion had requested to donate $1,500 to the Hugo Fire Department from pull-tab proceeds for equipment. All donations to the Fire Department needed to be approved by the Council. Adoption of the Consent Agenda approved the donation of $1,500 to the Hugo Fire Department. Approve Ordinance Amending the Solar Ordinance At its February 3, 2025, meeting the City Council heard an update on the Ordinance Review Committee’s (ORC) recommendations for revisions to the solar farm ordinance. The City Council authorized staff to begin drafting text amendments based on the ORC’s recommendations. The proposed ordinance amendments included revisions to the performance standards for solar farms, Council Meeting Minutes for April 7, 2025 Page 4 of 7 changes to the zoning districts where solar farms would be allowed, and a clarification to the definition of solar farms based on a recommendation from the City Attorney. The Planning Commission held a public hearing at its March 13, 2025, meeting and took comments from the public. Following discussion, the Planning Commission voted unanimously to recommend approval of the proposed ordinance amendments to the City Council. Adoption of the Consent Agenda approved ORDINANCE 2025-541 AMENDING CHAPTER 90 – ZONING AND LAND USE AS IT RELATES TO SOLAR ENERGY SYSTEMS and the summary ordinance for publication. Approve Ordinance Amending the Parking Ordinance City Code had restricted parking of vehicles and trailers on City streets to a time limit of 72 hours, with the intent of prevention long-term storage of such equipment on public streets. The City had received complaints detailing the long-term storage of trailers on public streets, and the City had difficulty in enforcing the intent. At its March 3, 2025, meeting, the City Council authorized staff to work with the City Attorney to g text amendments to clarify the ordinance’s intent. The proposed ordinance amendments included restricting on-street parking of trailers to period of 24 cumulative hours over a seven-day period and stated that a trailer moved less than three tenths of a mile from its original location will be considered to have remained parked. The Planning Commission held a public hearing at its March 27, 2025, meeting. Following discussion, the Planning Commission voted unanimously to recommend approval of the proposed ordinance amendments to the City Council. Adoption of the Consent Agenda approved ORDINANCE 2025-542 AMENDING CHAPTER 90, ARTICLE, SECTION 90-253 AS IT RELATES TO PARKING OF VEHICLES AND TRAILERS ON PUBLIC STREETS. Approve Shores of Oneka 5th Addition Final Plat and Development Agreement M/I Homes had requested approval of a final plat and development agreement in order to plat the remaining 52 single family lots on an outlot in The Shores of Oneka Lake development. The lots met the minimum lot standards and requirements outlined in the regulations for The Shores of Oneka Lake PUD. Adoption of the Consent Agenda approved RESOLUTION 2025-9 APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR M/I HOMES OF MINNEAPOLIS/ST. PAUL, LLC, FOR THE SHORES OF ONEKA LAKE 5th ADDITION. Approve Resolution Approving Variance for 4938 121st Street North Julie and Greg Manning had requested a variance to allow for the construction of a 2,336 square foot attached garage and car port, where an attached garage of 1,678.25 square feet was allowed by ordinance. The applicants had indicated they would build a larger attached garage in place of any accessory buildings and agreed to not construct any accessory buildings on the property as a condition of approval for the variance. The Board of Zoning Appeals and Adjustments held a public hearing at its March 13, 2025, meeting. Following discussion, the Board voted unanimously to recommend that the City Council approve the variance. Adoption of the Consent Agenda approved RESOLUTION 2025-10 APPROVING A VARIANCE TO ALLOW CONSTRUCTION OF AN ATTACHED GARAGE AND CAR PORT THAT EXCEEDS AREA REQUIREMENTS FOR THE PROPERTY LOCATED AT 4938 121ST STREET NORTH. The Senior Engineering Technician had reviewed the location of the fence and was comfortable with the request. Adoption of the Consent Agenda approved RESOLUTION 2025-11 APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW CONSTRUCTION OF A FENCE WITHIN A DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT 4789 162nd WAY NORTH. Approve Access Easement Agreement for Property Located at 12895 Ethan Avenue North The property owner at 12895 Ethan Avenue North, Robert L Merch Revocable Trust, had requested an access easement over City owned property for an existing driveway that had been used to access their home for decades. The driveway crossed City owned property along Ethan Avenue. Review of recorded documents with Washington County indicated that a vague access easement was in place, however it was not created with a separate access easement. The property owner was asking to formalize the access easement, since there was no other way to access the property. Adoption of the Consent Agenda approved the access easement agreement, subject to City Attorney review and approval. Approve Resolution Receiving Bids and Awarding the Contract for Beaver Ponds and 2025 Street Improvement Projects City Engineer Mark Erichson provided some details on the bids received for the Beaver Ponds Area Street Improvement Project and the 2025 Street Improvement Project. The Beaver Ponds area project would be an urban roadway mill and overlay. The bids included an alternate for Ferrara Avenue, which was a private drive at the request of the HOA, but they elected not to pursue moving forward with the project. The 2025 street project would be a rural roadway reclamation and would consist of streets in the Duck Pass and Long Lakes Estates neighborhoods, as well as Ingersoll Avenue. For efficiency, both projects were bid together. Bids were received on March 20, 2025, and ranged from $2,007,019 to $2,204,901. The engineer’s estimate was $2,267,961. Staff recommended the Council approve awarding the contract to the low bidder, Northwest Asphalt, Inc., for the base bid in the amount of $2,077,019.43. Erichson commented that the City had worked with Northwest Asphalt in the past and looked forward to working with them again. Erichson explained the assessment policy, stating that property owners with the urban roadway overlay project would pay $2,100 per unit. Those with the roadway reclamation project would pay $3,400 per unit. Vacancy on the Carnelian Marine St. Croix Water Shed District City Administrator Bryan Bear informed Council the term of office for Kristin Tuenge with the Carnelian Marine St. Croix Watershed District was to expire on June 21, 2025. The county is seeking an individual to serve as a district manager. Anyone interested was asked to contact City Hall. Each year, the City receives an allocation based 50% upon its population and 50% upon the construction Needs of its roadways. To receive funding, the City can designate up to 20% of its local streets to receive MSAS funding. The City has a total of 23.88 miles eligible to designate. Per State Aid Rules, a City is allowed to add and/or remove mileage annually, provided it meets necessary criteria, if a letter request is submitted. If the proposed route is accepted by the State Aid office, a formal council resolution adding it to the system is required prior to May 1st. In an effort to maximize the construction Needs of Hugo’s MSAS system and with the goal of strategically using the annual available allotment of State Aid funds to the City, we are recommending the following modifications to the system (illustration attached): • Revocation of Farnham Ave N from 149th St N to Oneka Parkway N o Segment Length: 0.35 miles • Addition of Goodview Ave N from Oneka Lake Blvd to 159th St N o Segment Length: 1.07 miles • Addition of 159th ST N from Goodview Ave N to T.H. 61 o Segment Length: 0.14 miles While the annual allotment that Hugo will receive from State Aid will fluctuate each year based on gas-tax revenues received by the State, and by relative apportionments for population and the Needs of all State Aid cities throughout the State, the proposed revisions are anticipated to result in the City maximizing its available designation mileage, which will in turn maximize the State Aid Needs dollars that are allocated to the City. It should be noted that, year to year, there is no guarantee that the annual allotment received by any city will increase. MnDOT State Aid staff approved the requested proposed revisions on April 2, 2025. The City Council must now pass a formal resolution to finalize the proposed routes and submit that resolution to MnDOT’s State Aid office prior to May 1, 2025. This will be used in the calculation for our 2026 allotment. It is the City Engineer’s recommendation that City Council approve the attached resolution and direct staff to submit per MnDOT requirements. The City of Hugo currently applies dust control to approximately 23 miles of gravel roads located within its municipal boundaries. WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”) along the northerly, westerly, easterly, and southerly portion of the Owner’s property, which is legally described as: Lot 43, Block 2, The Shores of Oneka Lake 3rd Addition, Washington County, Minnesota; and, WHEREAS, Owner is desirous of constructing a fence partially within the easement area; and, WHERAS, the City will permit the placement of a fence in the area described herein subject to the terms and conditions hereof. No plantings, trees, permanent improvements or structures other than the fence may be maintained or placed in the easement area. 3. Owner shall maintain the fence in good repair and shall not permit it to be expanded, lengthened or to impair the City’s easement or its rights thereunder in any respect. 4. The encroachment granted to Owner herein is subject to the existing easement rights of the City as granted in various easements. 5. The City will notify Owner if it requires removal or relocation of the fence or any part of it. Thereafter, Owner shall remove the fence according to the direction of the City and if Owner fails to do so, the City may enter upon the land and remove as much of the fence as required and cast it upon the adjoining lands. In such an event, the City shall not be liable to Owner for any costs, loss or damage whatsoever, and may assess the property for all of its costs incurred in removing the fence, and Owner waive all formalities, requirements and defenses arising from or relating to Minnesota Statutes Section 429 relating to or arising from the work done by the City. 6. To the fullest extent permitted by law, Owner agrees to release, defend, protect, indemnify, save and hold harmless the City, its agents, directors, employees, shareholders and contractors against any and all claims, costs and liabilities, including the costs of defense for damages, injury or death arising from or in any way connected to the installation, maintenance, repair, removal and/or presence of the fence, regardless of whether such harm is to Owner, the City, the employees or officers, guests or invitees of either or any other person or entity, except Owner shall not be liable under this paragraph for loss or damage to the extent resulting from the negligen ce of the indemnified parties. 7. The permission granted herein is limited exclusively to the proposed fence within the specified portion of the easement area of the City’s Easement. Owner shall not alter the grade or permit such alteration anywhere upon the land upon which the City has reserved its easement rights without proper express written consent of the City. 8. Owner shall, at all times, use their best efforts to conduct all of their activities on said Easement in such a manner as to not interfere with or impede the operation of the City’s Easement and related activities in any manner whatsoever, and shall follow the direction of the City. 9. Sincerely, Tom Weidt Mayor CITY OF HUGO PARKS COMMISSION REPORT TO: Bryan Bear, City Administrator FROM: Shayla Denaway, Parks Planner SUBJECT: Oneka Lake Park Playground Replacement DATE: April 17, 2025 for the meeting of April 21, 2024 1: INTRODUCTION: At the meeting of March 3, 2025, the Council approved reconstruction of Oneka Lake Park and authorized Flagship Recreation to draft concepts for a new playground. The Parks Commission held a neighborhood meeting on April 16, 2025. The Parks Commission is recommending approval of the preferred playground equipment and installation of pour-in-place rubber surfacing. Other planned improvements to Oneka Lake Park will include painting the picnic shelter, asphalt trail repairs/ sealcoating, and landscaping improvements. At a future meeting, Council will be provided estimates of this work for consideration. Construction is likely would start mid-August and go through September. 2: RESIDENT INPUT: At the Parks Commission meeting of April 16, 2025, a neighborhood meeting was held to discuss the playground replacement at Oneka Lake Park. Emily Maloney, with Flagship Recreation, presented two different equipment options and eight color scheme options. Both equipment options included a substantial 2-5 year old structure, a 5-12 year old structure, several swings, and independent play options. Residents were asked to vote following a question and comment period and their preferences were clear. Residents asked questions about the surfacing and expressed dissatisfaction with the wood chips that the playground currently has. Use of the open field, preservation of existing trees and the construction timeline were also discussed. 3: PLAYGROUND REPLACEMENT PROPOSAL: The proposal from Flagship Recreation totals $150,000 for the play equipment (state contract pricing), concrete container border, and installation. In addition to purchasing the equipment, the Parks Commission is recommending installation of pour-in-place rubber surfacing (PIP). This would total $133,000 and include installation. PIP is being recommended due to the site constraints, large park service area/ increased use, longevity and accessibility. The existing playground container regularly holds water and maintaining adequate engineered wood fiber depths is difficult. Grading the site to provide better drainage was investigated by staff. The work would be extensive and would likely necessitate removal and replacement of many of the trails, concrete pads, trees and potentially the picnic shelter. The cost of the alternative and longer period where the park would be closed for construction led staff to recommend Pour-In-Place rubber surfacing. If engineered wood fiber surfacing is preferred, the estimate for Flagship Recreation to install it with geotextile fabric is $14,000, in addition to the playground equipment estimate. Staff could be directed to gather estimates for the additional sitework which would be required. 4: PARKS COMMISSION RECOMMENDATION: The Parks Commission is recommending approval of the purchase and installation of playground equipment and pour-in-place surfacing from Flagship Recreation in the amount of $282,052 at Oneka Lake Park. 5: ATTACHMENTS 1. BACKGROUND: The 165th Street corridor is primarily gravel between Highway 61 and Elmcrest Avenue. The road will need improvements, including paving, due to development pressures, anticipated increases in traffic volumes and the need for traffic from the south to have better connections to a collector street. East of Highway 61, there is also pending development. While this road section is paved, there is a need to extend the City’s sewer and water infrastructure to this area. The 2025-2029 Streets CIP has 165th Street between Highway 61 and Elmcrest Avenue. Although there is a temporary solution for paving 165th Street, the 2040 Comprehensive Plan identifies 165th Street as an urban section minor collector road (pavement, curb, and gutter) from Elmcrest Avenue to Highway 61 with a future trail making connection to the Hardwood Creek Regional Trail. There have been questions about whether the design of the road should be reevaluated. With the development of the comprehensive plan there was a high-level analysis of land use and projected infrastructure improvements that guides development. This is a growing area and the infrastructure needs to be improved and extended for development. There are many natural resources that reduce the area that can be developed and makes it hard for certain infrastructure improvements. The work for the 2050 Comprehensive Plan will start next year, but there is likely some work that needs to be completed earlier due to increased development interest. There are a few items that have also been identified that influence land use planning, road design, and sewer and water planning. First the Met Council stated that they are not planning a fixed line transit corridor along Highway 61 and that transit in the area will likely be mirco transit or transit on demand. The 2040 Land Use Plan guides land at the intersection of 165th Street and Highway 61 for Industrial, High Density Residential, and Mixed Use (50% high density residential and 50% commercial). With this change the land use and infrastructure should be evaluated and will not be planned for a transit corridor. There are other areas for land use and infrastructure that should also be evaluated with an environmental assessment and natural resource constraints. Second, there have been questions about water supply in the area. The 2040 sewer and water plans anticipate eventually serving eastern Hugo in the future, outside of the Metropolitan Urban Service Area (MUSA). In other words, the size and capacity of the utilities planned in this area can accommodate serving eastern Hugo with City sewer and water. This puts some burden J.1 and J.2 2 on the City, since we pay for the oversizing costs for development, which is very expensive. The planned sewer and water utilities should be evaluated to determine the range of planning and if there is another way to plan for future sewer and water that could reduce expenses. At its January 27, 2025, goal setting meeting the City Council directed staff to bring forward a scope of work for a corridor study for 165th Street. Staff put together a scope of work for an Alternative Urban Areawide Review (AUAR) that will analyze multiple development scenarios including land use, infrastructure, environmental assessment, and costs. An AUAR can satisfy State regulations for environmental review of certain types of development and extension of sewer systems. Completing an AUAR allows future development in this area to be “pre- approved” from an environmental review by the State, so development in the area does not have to go through this process with each development application. The AUAR will include public engagement and will inform the 2050 Comprehensive Plan. The consultants proposed to work on the study are WSB and Landform. The total cost of the study is $167,324. Grant Opportunity Washington County Community Development Agency (CDA) provides the opportunity for pre- development grants to cities for area studies, such as the proposed 165th Street AUAR. The AUAR meets the pre-development grant criteria for increased growth for economic development and will provide planning recommendations through analysis of land use, infrastructure, and natural resources to inform development in the area. Staff recommends applying for a pre-development grant to evaluate a number of key elements to facilitate the development of this area. 2. STAFF RECOMMENDATION: Staff recommends the City Council authorize staff to move forward with the AUAR. Staff recommends approval of the resolution authorizing submittal of the Washington County CDA pre-development grant application in the amount of $40,000, which is the maximum grant amount allowed. Minnesota Rules 4410 require environmental review for certain types and sizes of projects, including those which could be proposed within the study area surrounding 165th Street in the City of Hugo. In anticipation of development in this Study Area, which totals approximately 900 acres (see attached Location Map), the City of Hugo is proposing to complete an Alternative Urban Areawide Review (AUAR), which allows for review of multiple development scenarios based on proposed land uses. An AUAR is an acceptable alternative form of environmental review to an EAW or EIS and thus will allow future development within the Study Area to be “pre-reviewed” and comply with environmental review requirements . An AUAR will analyze the development scenario within the Project’s boundaries (Study Area). The scope of work below outlines development, distribution, and adoption of the AUAR. In addition, preparation of the AUAR will also include a traffic study and utility master plan. SCOPE OF WORK Up to three (3) development scenarios will be described and reviewed as part of the AUAR development. It is assumed that one scenario will conform to the current Comprehensive Plan. Up to two (2) additional land use development scenarios will be developed as described in Task 2 below. The City of Hugo will serve as the RGU for the AUAR. WSB will prepare the AUAR and associated studies on behalf of the City and assist with distribution, comment response, and finalization of the document for City Council consideration. The scope of work below outlines the associated tasks . 1. Meetings and Project Management Upon authorization, WSB will initiate a kickoff meeting with the City to review Project needs and develop a schedule for AUAR development. Following the kick-off, WSB and Landform will meet with the City periodically to provide updates on the progress of the document (up to 3 meetings). The schedule for these meetings will be determined at kickoff. In addition to internal meetings, this task also includes preparation and attendance at up to two (2) Planning Commission and City Council meetings to review the Draft AUAR prior to initial distribution and Final AUAR for adoption. For the Traffic Study, this task includes up to eight (8) hours of agency meetings. This task will also include general project management and correspondence with the City. 2. Develop Land Use Alternatives WSB will coordinate with Landform to develop three (3) land use alternatives for the AUAR analysis. Of the three alternatives, one will be based off the city’s adopted 2024 Comprehensive Plan. Landform will work with staff to schedule an open house in June/July to gather public Ms. Rachel Juba April 14, 2025 Page 2 feedback on the three alternatives and then summarize feedback and make recommendations for consideration by the Planning Commission and City Council. Landform will prepare materials for the meetings, including maps and handouts. Based on Council direction , Landform will finalize the three land use alternatives for inclusion in the AUAR. 3. AUAR and Mitigation Plan This task involves preparation and distribution of the draft and final AUAR. WSB will also prepare the documentation ordering the development of the AUAR for the City of Hugo based on the timelines in Minnesota Rule 4410. Once the AUAR is formally ordered, the City has 120 days to adopt the Final AUAR and mitigation measures. To meet this timeframe, WSB will begin compiling the information outlined below into the Draft AUAR and Mitigation Plan, based on the guidance provided by the Environmental Quality Board (EQB), with the intent that the Draft AUAR is complete within 1 month of the formal order. This task assumes one round of review with City staff and up to two revisions of the document based on those comments. WSB will distribute the Draft AUAR to the public, required agencies, and provide the needed public notice for the 30-day comment period. An electronic and paper copy of the AUAR will be provided to the City for use on their website and to have available for public review at the city offices. Additional paper copies will only be provided as required by the EQB distribution list. The following items will be reviewed and outlined as part of the Draft AUAR and Mitigation Plan: Existing Condition Assessment Cover types and land uses within the study area as well as the immediate surrounding area will be described and the potential for impacts from development will be evaluated. Given the developed nature of the Project study area, the assessment will be completed via desktop evaluation and review of other existing documents provided by the City. Traffic Analysis As part of this task, the impact on traffic from the different land use scenarios will be evaluated and discussed. A Traffic Study will be conducted (see Task 4) and summarized in the AUAR. A discussion of potential mitigation measures will also be included in the AUAR. Permits and Approvals Each development scenario will be reviewed and a list of required approvals and permits will be developed to guide future planning efforts. Land Use Landform will prepare the language related to the land use alternatives and identify approval needs and mitigation strategies as they relate to land use. Geology, Soils, Topography, and Landform Analysis A desktop assessment of the area will be completed and supplemented with any existing data or reports available from the City (geotechnical reports, etc.). Potential impacts to these resources, and suggested mitigation measures, will be outlined in the AUAR document. Water Resources Assessment This task would include a summary of the Water and Sewer Infrastructure Study developed for the Study Area (see Task 5) as well as an assessment of surface water, groundwater, and stormwater needs for each development scenario. Stormwater analysis will be completed using desktop data and information available from the City and will not involve modeling of proposed conditions. Potential impacts to these resources, and suggested mitigation measures, will be outlined. Ms. Rachel Juba April 14, 2025 Page 3 Potential Contamination Assessment Available studies and desktop data will be reviewed to assess the potential for contaminated materials or hazardous waste within the Study Area. This will include the potential for encountering contamination during construction as well as handling hazardous materials that may be stored onsite during or following construction. Fish, Wildlife, Plant Communities, and Sensitive Ecological Resources Assessment Information from desktop analysis will be used to assess the potential for the Project to impact these resources and identify any necessary mitigation measures. This will include a review of both state and federally protected species and potential habitat. No onsite surveys are proposed with this task. Historic Properties and Visual Impact Assessment Information from the State Historical Preservation O ffice, Office of the State Archeologist, and other readily available public data will be used to determine if there is potential to impact culturally significant or historic properties, parks, or if there will be visual impacts to the surrounding viewshed. This task does not include a Phase I Cultural Resource Study nor on- site survey. Based on our understanding of the site and proposed development, we do not expect there will be visual impacts per the AUAR guidelines. Noise Analysis The AUAR will include a desktop assessment of potential noise impacts resulting from the Project. A detailed noise study is not proposed. Air Quality, Climate Resiliency, and Greenhouse Gas Assessment WSB will provide a climate adaptation and resiliency assessment and greenhouse gas (GHG) and carbon footprint assessment. These assessments will use publicly available information to evaluate the sustainability, climate adaptation, and resilience implications of the Project and assess the potential GHG impact per guidance from the Environmental Quality Board (EQB). These impacts may include temperature, heat islands, precipitation, flood risk, cooling degree days, and other potential sources of vulnerability including socio-economic risks. The GHG analysis will consider Scopes 1 (energy and emissions produced by development), 2 (energy and emissions produced for development), and 3 (supply chain emissions), as well as emissions type. Best practices and experience drawn from other projects will also inform the analysis. Cumulative Potential Impacts WSB will review other recent past or reasonably foreseeable future projects within proximity to the AUAR Study Area and determine whether those projects could combine with development within the Study Area and result in cumulative potential effects. This s ection will also outline whether any cumulative potential effects can be reasonably planned for and mitigated, or whether they would combine to create a significant environmental impact. Final AUAR and Mitigation Plan This task will involve revising the AUAR document and mitigation plan based on the comments received during the 30-day review process and responding to these comments. This task assumes that the comments will not require additional significant analysis as part of the AUAR. This task assumes one round of review by City staff and one document revision based on City comments. Ms. Rachel Juba April 14, 2025 Page 4 Distribution Of Decision Once distribution of the revised Final AUAR has been authorized, the agencies will have 10 working days from receipt of the revised AUAR to review the final document. If no objections are filed, the City can adopt the AUAR document and mitigation plan. WSB will distribute the AUAR for the second 10-day objection period. WSB will prepare the final documentation for the City to adopt the AUAR. Once adopted, the AUAR will cover the required environmental review for the development scenarios and document outlined mitigation measures. WSB will submit the documentation to the EQB and agencies once the AUAR is adopted. 4. Traffic Study WSB will complete a traffic study for the165th Corridor from Elmcrest Avenue to Ingersoll Avenue. The impact on traffic from each land use scenarios will be evaluated and discussed in the AUAR. A discussion of potential mitigation measures will also be included. The following outlines the subtasks that will be completed: Data Collection WSB will conduct traffic counts at the following five intersections: 1. Elmcrest Avenue 2. Fenway Avenue 3. TH 61 4. Harrow Avenue 5. Ingersoll Avenue The counts for the AUAR will include turning movement counts at the identified intersections. The intersection turning movement counts will be collected using video cameras and analysis will include AM peak (6-9AM) and PM peak (4-7PM) hours. Traffic Forecasts Based on the existing traffic volume data collected, traffic generation forecasts for the three development scenarios will be developed using the following information: • City of Hugo Comprehensive Plan • Otter Lake Road Extension Study • TH 61 Corridor study • Everton Area AUAR • Webb Development EAW Traffic Analysis Traffic analysis will be conducted based on the forecasted traffic volumes on the impacted roadways for the existing condition and each development scenario. A Synchro/Sim Traffic network will be developed for the study area. An operational analysis will be performed at each of the five study intersections and other potential future intersections to determine intersection delay, level of service (LOS) and queuing. Traffic Study Documentation WSB will develop a study document including the background, methodology, supporting figures, tables, and graphics. The document will summarize the findings and include recommendations for each development scenario. The study will address several different corridor typical-sections including 2-lane rural, 2-lane rural with off-street trail/pedestrian facilities, 2-lane urban, and 2-lane urban with off-street trail/pedestrian facilities. Ms. Rachel Juba April 14, 2025 Page 5 Preliminary Engineering WSB will prepare concept plans for the corridor typical sections and intersection improvements as well as cost estimates for the different alternatives. This task will also include a cost and funding analysis. 5. Water and Sanitary Sewer Study Water Demand Projections WSB will calculate the projected water demands for each of the three (3) development scenarios. Additionally, WSB will review the projected water demands against the planned water supply, storage, and distribution capacity in the Comprehensive Water Supply Plan, identify any additional improvements, and prepare cost estimates for those improvements. Sanitary Sewer Study WSB will complete a broader sanitary sewer study, which will include how the 165th Street area would be served in two trunk sanitary layout alternatives including (1) the current Comprehensive Plan, (2) serving District O only via its trunk sewer and diverting Ultimate District U flows north through District Q. Each of the two trunk sanitary layout alternatives will take into account the highest wastewater flow from the three (3) development scenarios to be conservative. The second trunk sanitary layout alternative will include the sewer sizing and conceptual layout for that alternative. The results of the sanitary sewer study will be summarized in a separate technical memorandum including figures and cost estimates for each alternative. COMPENSATION The estimate to complete the work described herein is $167,324 to be performed on an hourly basis, as summarized below. Invoicing will be monthly in accordance with our current (2025) Rate Schedule. *assumes 3 development scenarios. If additional development scenarios are added, a fee amendment will be necessary. SCHEDULE Work on the project will start upon acceptance of this agreement and authorization of the City. AUARs generally take approximately 9-12 months to complete, from authorization of work through adoption of the Final AUAR. An estimated schedule is attached, and a detailed schedule can be developed following contract authorization. If the project goes on hold for more than ninety (90) days during our contracted work, additional fees may be required. ACCEPTANCE This letter represents our entire understanding of the project scope. If the City of Hugo agrees with the scope and fee defined herein, WSB will start work outlined in this proposal per our 2025 Rate Schedule. April 8, 2025 Rachel Juba City of Hugo 14669 Fitzgerald Avenue North Hugo, MN 55038 RE: 165th Avenue AUAR – Planning Scope of Work Dear Rachel, The City is initiating an Alternative Urban Areawide Review (AUAR) for screening potential Environmental Impacts. The AUAR project is being led by WSB with support from Landform. We are pleased to provide this proposal to create the referenced documents for the development. Work Plan The following scope of work would be provided by Landform to complete the AUAR document. Task 1: Develop Land Use Alternatives Landform will develop three land use alternatives for the AUAR analysis. This will include the following steps: 1. Landform will complete an existing conditions analysis of natural resources, topography, transportation systems, views, nearby amenities and desired land uses. 2. Landform will develop three land use alternatives, one of which will be based on the adopted 2024 Comprehensive Plan. 3. We will meet with staff and WSB to review the alternatives and revise the land use alternatives for a public open house (three meetings). 4. We will work with staff to schedule an open house in July to gather public feedback on the three options developed by staff. We will prepare materials for the meeting including maps and handouts. Landform staff will attend the meeting to present the options, answer questions and gather feedback. 5. Following the open house, we summarize the feedback and make recommendations for consideration by the Planning Commission and Council at a joint meeting. 6. Based on Council direction, we will finalize the three land use alternatives for inclusion in the AUAR. These will be the basis of the analysis by WBS to complete the AUAR. Task 2: AUAR Document The purpose of the AUAR is a screening tool for environmental issues and provides a review and summary of onsite and nearby resources and potential impacts. 1. Landform will prepare the AUAR document language related to the land use alternatives and will coordinate with the WSB on the final document draft. The analysis will include implementation items that need to be incorporated into the 2050 Comprehensive Plan. 2. If requested by staff, Landform will attend the City Council meeting with WSB to answer questions when Council is requested to order distribution of the AUAR for comments. Landform will coordinate with WSB to assist with mitigation strategies and a response to comments related to land use elements to be incorporated into the final document. The mitigation strategies may include items that will be incorporated into the 2050 Comprehensive Plan. 4. Landform will attend the Planning Commission and City Council meetings where the final AUAR is reviewed and adopted. Compensation Landform will complete this scope of work according to the Master Service Agreement with the City of Hugo. We propose that the service phases for this project be provided on an hourly basis with an estimated budget. Any changes to the project scope or estimated hours to complete the work will be communicated to the City in a timely fashion. Landform will not proceed with additional services or services outside of the scope of work contained in this letter without approval from the City. We have estimated the level of effort required to perform the scope of work described herein and have summarized for you below: Summary of Fee A summary of line items is provided below. Sincerely, Landform Kendra Lindahl, AICP Principal Planner RESOLUTION 2025-___ RESOLUTION AUTHORIZING SUBMITTAL OF AN APPLICATION FOR FUNDING FROM THE WASHINGTON COUNTY CDA PREDEVELOPMENT FINANCE FUND WHEREAS, the City of has identified a proposed project within the City that meets the Washington County Community Development Agency (CDA) Predevelopment Finance Fund’s purposes and criteria; and WHEREAS, the City has established that the property in consideration has been zoned and/or guided for future development accordingly and the proposed project is a high priority of the city; and WHEREAS, the City supports the proposed project scope of work and hereby supports the application to the Predevelopment Finance Fund; and WHEREAS, the City has the legal authority to apply for financial assistance; and WHEREAS, the City is supportive of enhancing economic development opportunities that will serve to create jobs, enhance the tax base and improve the lives of Washington County residents. NOW THEREFORE BE IT RESOLVED that the City of approves the application for funding from the Washington County CDA Predevelopment Finance Fund.
