F.1 Special Event Permit for Brats, Bags, and Baskets Fundraiser for the Food Shelf on
September 20, 2025
The Hugo Lions Club is requesting approval of their Special Event Permit to hold an event at
Lions Park on September 20, 2025. All proceeds will go to the Hugo Good Neighbors Food
Shelf. Hugo Lions member Jason Schwieger and Food Shelf volunteers Jeff Fiedler and Kris
Greene will present to Council information on the event and request Council co-sponsor the
event by waiving the special event permit fee and allow use of the Lions Volunteer Park and
Pede Pedersen Pavilion on that day. Staff recommends Council approve the co-sponsorship and
the Special Event Permit for the Brats, Bags, and Baskets Fundraiser for the Hugo Good
Neighbors Food Shelf.

G.2 Approve Annual Performance Review for Public Works Mechanic Steven Garcia
At its June 6, 2023, meeting, Council approved the hiring of Steve Garcia as the new Public
Works Mechanic beginning June 7, 2023. Public Works Director Scott Anderson recommends
Council approve the Annual Performance Review for Public Works Mechanic Steve Garcia.
G.3 Approve Annual Performance Review for Public Works Worker Riley Hollerback
At its June 6, 2022, meeting, Council approved the hiring of Riley Hollerback as a Public Works
Worker beginning on June 30, 2022. Public Works Director Scott Anderson recommends
Council approve the Annual Performance Review for Public Works Worker Riley Hollerback.
G.4 Approve Annual Performance Review for Public Works Streets Lead Worker Tom
Smith
Tom Smith was hired by the City of Hugo on June 26, 2000, as a Worker in Public Works
Department and promoted to Streets Lead Worker on April 17, 2023. Public Works Director
Scott Anderson recommends Council approve the annual performance review for Public Works
Worker Tom Smith.
G.5 Approve Hiring of Public Works Seasonal Employee Eli Johnson
With the vacant Public Works position, Staff recommends hiring former seasonal worker, Eli
Johnson, to help with maintenance activities until a full-time employee is hired to fill the open
position. Eli Johnson worked as a Public Works Seasonal for the past two summers while
attending college. He is interested in helping Public Works until we fill the position.
G.6 Approve Donation to the Hugo Fire Department from the Hugo American Legion
The Hugo American Legion would like to donate $1,000 to the Hugo Fire Department from pull-
tab proceeds for equipment and training. All donations to the Fire Department must be approved
by the Council. Staff recommends Council approve the donation of $1,000 to the Hugo Fire
Department.
G.7 Approve Special Event Permit for Tough Mudder on June 28-29, 2025
Tough Mudder has applied for a Special Event Permit to hold a two-day endurance sport event at
Wild Wings Game Farm on June 28-29, 2024. Tough Mudder is a for-profit company that has
held events in the US since 2010 and elsewhere in the world since 2016. This will be the ninth
year the event has been held at Wild Wings. A Special Event Permit approved by Council is
necessary because there will be an estimated 5,800 people on site on Saturday and 1,500 on
Sunday. There will also be impacts to public streets, use of an amplified sound system, and
alcohol served. Staff recommends Council approve the Special Event Permit for the Tough
Mudder on June 28-29, subject to the conditions in the staff memo.
G.8 Approve Temporary Liquor License for Tough Mudder on June 28-29, 2025
The Hugo Lions Club has submitted a temporary liquor license application to serve beer and
seltzers at the Tough Mudder event to be held at Wild Wings Game Farm on June 28-29. Staff
recommends Council approve the temporary liquor license for the Lions Club for Tough
Mudder.
G.9 Approve Temporary Liquor License for Brats, Bags, and Baskets Fundraiser for the
Food Shelf on September 20, 2025
The Hugo Lions Club has submitted a temporary liquor license application to serve beer and
seltzers at the Brats, Bags, and Baskets fundraiser event to be held at the Lions Volunteer Park
on September 20, 2025. Staff recommends Council approve the temporary liquor license for the
Lions Club for Brats, Bags, and Baskets fundraiser.
G.10 Approve the Capital City Regional Firefighters’ Association Reciprocal Fire Service
Agreement
The City currently has Mutual Aid Agreements with all Washington County fire departments,
White Bear Lake, Centennial Fire District, Lino Lakes, and the DNR. In addition to this, Hugo Fire
Chief Jim Compton, Jr., is requesting on behalf of the Capital City Regional Firefighter’s
Association to enter into a Reciprocal Fire Service Agreement designed to formalize mutual aid
capabilities between the 33 fire departments in the Association. This agreement represents a
collective effort to streamline and strengthen the regional response framework by enabling
departments to request and provide mutual aid under clear, standardized terms. It was developed
with input from several municipal attorneys representing member departments and was created in
alignment with the League of Minnesota Cities’ information memo, “Considerations in Mutual Aid
Agreements”. Basically, this agreement would allow the City of Hugo to utilize resources from fire
departments that are outside our normal Auto/Mutual Aid response if needed. The Hugo Fire
Department believes this agreement will greatly enhance the Department’s ability to support one
another and serve communities more effectively during times of need. Staff recommends council
approve the Capital City Regional Firefighters Association Reciprocal Fire Service Agreement.
G.11 Approve Resolution Approving Encroachment Agreement for 6230 157th Street North
Ryan and Sarah Swenson have requested an encroachment agreement to allow for the
construction of a fence within a drainage and utility easement on property located at 6230 157th
Street North. The Senior Engineering Technician has reviewed the location of the fence and is
comfortable with the request. Staff recommends that the City Council approve the resolution
approving an encroachment agreement for 6230 157th Street North.
G.12 Approve Resolution Approving Encroachment Agreement for 4670 Empress Way
North
Jack and Nicole Morrisette have requested an encroachment agreement to allow for the
construction of a fence within a drainage and utility easement on property located at 4670
Empress Way North. The Senior Engineering Technician has reviewed the location of the fence
and is comfortable with the request. Staff recommends that the City Council approve the
resolution approving an encroachment agreement for 4670 Empress Way North.

North
Andrew and Julia Giesen have requested an encroachment agreement to allow for the
construction of a fence within a drainage and utility easement on property located at 14225

fence and is comfortable with the request. Staff recommends that the City Council approve the
resolution approving an encroachment agreement for 14225 Geneva Avenue North.

North
Gracie and Justin Chavez have requested an encroachment agreement to allow for the
construction of a fence within a drainage and utility easement on property located at 15519
Goodview Trail North. The Senior Engineering Technician has reviewed the location of the
fence and is comfortable with the request. Staff recommends that the City Council approve the
resolution approving an encroachment agreement for 15519 Goodview Trail North.
G.16 Approve Resolution Approving Encroachment Agreement for 6240 157th Street North
Kathryn and Mitchell Fiega have requested an encroachment agreement to allow for the
construction of a fence within a drainage and utility easement on property located at 6240 157th
Street North. The Senior Engineering Technician has reviewed the location of the fence and is
comfortable with the request. Staff recommends that the City Council approve the resolution
approving an encroachment agreement for 6240 157th Street North.
G.17 Approve Authorization for Amendments to the Fence Ordinance
Section 90-227 of City Code outlines requirements for fences but does not have a process for
placing a fence within a drainage and utility easement. New residential developments in the City
of Hugo are required to dedicate easements for drainage and utility purposes around the
perimeter of single-family lots. When a resident is constructing a fence on their property line,
they are almost always going to be locating the fence within the easement. Staff has been
requiring that residents constructing a fence within an easement request an Encroachment
Agreement from the City Council, which lengthens the approval process for a fence. The
agreement allows the resident to construct a fence within the easement, and states that if the City
needs to perform construction work within the easement that the fence may be removed at the
owner’s expense. Staff has identified a need to codify that a fence placed within an easement
may be removed at the owner’s expense, which would streamline the approval process by
permitting encroachments administratively. Staff is requesting authorization from the City
Council to work with the City Attorney on drafting text amendments to the fence ordinance, and
to hold a public hearing on the text amendments with the Planning Commission.
G.18 Approve Resolution to Close the Coronavirus Relief Fund and Transfer Investment
Income
The Governmental Accounting Standards Board (GASB), along with the City’s auditors,
recommend closing fund accounts when the intended use of those accounts no longer exist. As
of December 31, 2024, all Coronavirus Relief Funding has been expended and properly reported.
Investment income remained in the Fund and according to United States Treasury guidance,
interest earned does not need to be remitted to the Treasury nor used for specific program-related
expenditures. This investment income is not restricted for any specific purpose and therefore can
be transferred to any fund designated by the City Council. Staff recommends that Council adopt
the Resolution to Close the Coronavirus Relief Fund and Transfer Investment Income to the
Street CIP Fund.

Staff recommends Council schedule this as a meeting if they choose to attend.

Performance Review Summary
To Be Read At The Upcoming City Council Meeting
On May 5, 2025, the Hugo City Council met in Executive Session for a routine annual
performance evaluation of the City Administrator, Bryan Bear. This is a summary of that
meeting given in accordance with Minnesota Statutes.
The Council noted that Mr. Bear’s work for the City has exceeded expectations in all categories
of evaluation and that under his leadership, City staff and departments have done an excellent job
of delivering cost-effective planning and services and amenities to the residents of the City of
Hugo. It was requested that he continue to innovate and identify efficient approaches to continue
to be service-oriented and innovative in his service to the residents of Hugo. Council thanked
Mr. Bear and the entire internal staff of the City departments of the City for their work in this
regard.

Hugo Good Neighbor Days June 6-8, 2025
The Hugo Lions Club will be holding their annual Hugo Good Neighbor Days Community
Festival June 6-8, 2025, at the Lions Volunteer Park. Lions Member Chris Clausen introduced
himself saying he was the Vice-President of the Lions Club and 2025 Good Neighbor Days
Committee Chair. He talked about changes to the layout and some new events that will be taking
place this year. The beer tent will be moved 25 feet back to allow more space in front of the band
for attendees. Bands will be Coyote Wild and Six to Midnight. Again, this year there will be
Hugo’s Got Talent, skateboard demos, fireworks, bingo, craft fair, and the rib fest. Some new

events were the Nickle Dash sponsored by Premier Bank and Yoga on Sunday morning.
Miron made motion, Krull seconded, to co-sponsor the event by waiving the Special Event

Shayla Denaway was hired on May 11, 2009, as the Economic Development/Parks Intern. On
May 3, 2010, Council approved promoting Shayla as the new Parks Planner. Adoption of the

Approve Annual Performance Review for Parks Lead Worker Rick Kieffer
Rick Kieffer was re-hired by the City of Hugo as a Public Works Worker on May 31, 2005,
returning after a short period of time in the private sector. In April 2023 Rick was promoted to
Public Works Parks Lead Worker. Adoption of the Consent Agenda approved the annual
performance review for Public Works Parks Lead Worker Rick Kieffer.

Approve Resignation of Public Works Worker Miquel Souffrant
Public Works Worker Miquel Souffrant had accepted a job offer elsewhere and submitted his
resignation from the City of Hugo’s Public Works Department. Adoption of the Consent Agenda
approved the resignation of Miquel Souffrant effective April 29, 2025.
Approve Advertisement for Public Works Worker
The resignation of Miquel Souffrant had created a vacancy in the Public Works Department.
Adoption of the Consent Agenda approved the advertisement for a new Public Works Worker.
Approve Advertisement for New Building Inspector
As part of the Community Development Department, the Building Department included a
Building Official, Building Inspector, and Building Department Receptionist. There was another
Building Inspector position in the budget. With the retirement of Terry Hagstrom and the steady
number of building permits and inspections remaining, staff recommend Council approve filling
the remaining Building Inspector position. Adoption of the Consent Agenda approved
advertisement for a new Building Inspector position.
Approve Donation to the Hugo Fire Department from the Hugo America Legion
The Hugo American Legion requested the Council accept their donation of $1,000 to the Hugo
Fire Department from pull-tab proceeds for equipment and training. All donations to the Fire
Department needed to be approved by the Council. Adoption of the Consent Agenda approved
the donation of $1,000 to the Hugo Fire Department.
Approve Donation to the Hugo Fire Department from Terry and Carol-Lynn Spawn in
Memory of Harley Ogata
Terry and Carol-Lynn Spawn requested Council accept their donation of $100 to the Hugo to the
Hugo Fire Department in memory of Harley Ogata. All donations to the Fire Department needed
to be approved by the Council. Adoption of the Consent Agenda approved the donation of $100
to the Hugo Fire Department.
Approve Special Event Permit for New Life Church Spring Outdoor Service on June 8 and
Fall Festival on October 26, 2025
David Streitz on behalf of New Life Church had applied for a Special Event Permit to hold
outdoor events on Sunday, June 8 from 9 a.m. to 9 p.m. and Sunday, October 26 from 2 p.m. to
5:30 p.m. A Special Event Permit was required because they would be using an amplified sound
system during the events. Adoption of the Consent Agenda approved the Special Event Permit
for New Life Church for outdoor events on June 8 and October 26, 2025.

Approve Temporary Liquor License for Lions Club for Good Neighbor Days June 6-8, 2025
The Hugo Lions Club had applied for a Temporary On-Sale Liquor License to serve alcohol at
Hugo Good Neighbor Days on June 6-8, 2025. Adoption of the Consent Agenda approved the
On-Sale Liquor License for the Hugo Lions during Good Neighbor Days subject to receipt of the
appropriate Certificate of Liquor Liability Insurance for the event.
Approve Ordinance Repealing Ordinance on Solar Farm Moratorium
The City Council had adopted interim Ordinance 2024-530 on May 20, 2024, placing a
moratorium on new development of solar farms and directing a study to be conducted, and
adopted Ordinance 2024-536 on October 21, 2024, extending said moratorium until May 20,
2025. The City had completed the study of the ordinance, and adopted Ordinance 2025-541 on
April 7, 2025, amending the ordinance as it relates to the definition of solar farms, the zoning
districts where they are permitted, and performance standards for solar farms. Staff had found
that with the newly adopted Ordinance in place, the need for the moratorium had ended.
Adoption of the Consent Agenda approved ORDINANCE NO. 2025-543 REPEALING A
TEMPORARY MORATORIUM ON NEW DEVELOPMENT OF SOLAR FARM SOLAR
ENERGY SYSTEMS.
Approve Resolution Setting Public Hearing for Legacy Christian Academy Conduit Financing
City Finance Director Anna Wobse informed Council the City was approached by Taft Law, the
City’s Bond Counsel, to act as a Conduit Bond Issuer for Legacy Christian Academy. The City
of Hugo has no plans to issue bonds this year. The City has acted as a Conduit Bond Issuer in
the past for Noble Academy & Minnesota Autism Center.
Wobse explained that Conduit Bonds are Revenue Bonds issued by a governmental agency on
behalf of the actual borrower, who is typically a private nonprofit 501(c) (3) entity. The bonds
would be tax-exempt bonds which can help lower borrowing cost. The actual borrower, not the
issuer, is responsible for interest payments and principal repayments. The issuer is not a
guarantor of conduit bonds or obligated to repay the bonds if the borrower fails to make the
payments. A city is allowed to issue $10 million in Conduit Bonds annually. The current
request would not exceed $6 million. The City of Andover cannot act as the Conduit Bond
Issuer because they have already issued bonds for another Borrower. The City would receive a
fee of ½ of 1% of the bond principal. Legacy Christian Academy would be the actual borrower
and solely responsible for repaying investors. It would not constitute a debt of the City or affect
the City’s credit rating. The borrower would be responsible for on-going reporting requirements.
Council had questions on risks to the City, whether it would limit the City on borrowing capacity
and how much work would it create for employees. Wobse and City Administrator Bryan Bear
explained it would not appear on the balance sheet, only in the audit report. Staff would need to
check in with the borrower annually. There would be no risk to the City, and Hugo could partner
with another city if Hugo needed to borrow money and had reached the $10 million annual cap.

explained there would be no obligation to the city, and it would save the borrowing organization
up to 2 percent. The investors would not have to pay tax on the income they receive so it would
be a significant savings.
Petryk made motion, Miron seconded, to approve RESOLUTION 2025-16 CALLING FOR A
PUBLIC HEARING ON THE ISSUANCE OF REVENUE BONDS AND AUTHORIZING
THE PUBLICATION OF A NOTICE OF HEARING (LEGACY CHRISTIAN ACADEMY
PROJECT).

Re: Special Event Permit for Brats, Bags, and Baskets Fundraiser for the Good Neighbors
Food Shelf on Saturday, September 20, 2025
1. BACKGROUND:
The Hugo Lions Club is requesting a Special Event Permit to hold an event at the
Lions Volunteer Park to raise money for the Hugo Good Neighbors Food Shelf. This
will be the first year the event has been held. A Special Event Permit approved by
Council is necessary because there will be over 200 people in attendance, alcohol
served, and amplified sound.
2. DESCRIPTION OF EVENT:
The Brats, Bags, and Baskets Fundraiser event will consist of children’s activities, a
cornhole tournament organized by the Hugo Lions Club, a silent auction inside the
Pavilion, and grilled bratwursts and hotdogs along with other food items available for
purchase. All proceeds will go to the Hugo Good Neighbors Food Shelf.
Estimated Attendance – Approximately 300-400 people are expected to attend
throughout the day.
Times – The event will run from 11 a.m. to 5 p.m. Additional time before and after
the event will be needed for setup and teardown.
Public Health Plans – One porta potty and wash station will be rented and located
near the cornhole tournament where the beer will be served. Bathrooms are available
inside and outside of the Pavilion. The Lions Club will be supplying additional
garbage cans to be placed around the event area. Trash will be placed in the
dumpsters located on the southwest corner of the pavilion.
Emergency and Security Plans – Staff feels there is no need for emergency and
security plans. The Washington County Sherrif and Hugo Fire Department personnel
are planning to be attending the event for community engagement.
Admission Fees – There will be an entry fee for the bags tournament and fees for
some of the children’s activities. Food and beverages will be available for sale.
Silent auction items will be paid for by check or through Venmo to the Food Shelf.

Food and Alcohol – The Hugo Lions Club has applied for a temporary liquor license
for the sale of beer and spritzers. Wristband will be used to identify those 21+ years
of age. Beer sales will be in the same location as the bag tournament. There are no
plans to fence off the area for alcohol consumption, but there will be signs around the
area stating “no alcohol permitted beyond this point”. Bratwursts and hot dogs are
being donated by Grundhofers Old Fashioned Meats. There will be 1-2 grills for
cooking. Chips, drinks, and cookies will also be available for purchase. Culver’s is
donating custard to be sold onsite from 12-3 p.m.
Traffic and Parking – Staff believes there is adequate parking in the parking lot and
along the streets around the park.
Request for City Services – The applicant is requesting to use the City’s electronic
sign for advertising for the event and will coordinate with the Public Works Director
for placement. The applicant is also requesting to use the Pavilion and tables for the
silent auction items. Hugo Fire Department personnel and truck will be there to
collect food donations for the food shelf while conducting community engagement
with a fire prevention message.
Other Permits Necessary – A food permit from Washington County is necessary for
the grilled food.
Music/Amplified Sound – Amplified music will be played through a speaker system
and there may be a DJ.
Tents or Structures – There will be small tents in the cooking area and in the
children’s activity area. In case of inclement weather, the Hugo Fire Department will
lend the applicant the use of their large tent.
Signs, Banners, Balloons – There will be sponsorship banners and signs for the
silent auction and children’s activities. There may be a balloon arch for the children’s
area.
3. REQUIREMENTS:
The applicant has provided the City the completed permit. In accordance with this
permit, the applicant shall conduct the event as described above in addition to the
following:
Prior to the Event
1. The applicant will request Council co-sponsor the event by waiving the special event
permit fee and allowing use of the Lions Volunteer Park and Pede Pedersen Pavilion.
2. The applicant will obtain the temporary liquor license.
3. The applicant will obtain a Special Event Food Stand Permit from Washington
County.
4. The applicant will ensure all tents are securely staked.

During the Event
5. The applicant shall conduct the event in accordance with the approved plans
submitted with the application.
6. The applicant and all on-site vendors shall comply with all applicable federal, state,
and local laws, rules, regulations, and ordinances related to the event.
7. IDs will be checked to verify age for alcohol sales and wrist bands worn for persons
21+ years of age. All alcohol and liquor laws will be adhered to.
8. No alcohol is permitted to be brought on site or taken off site.
9. Garbage cans will be checked regularly and emptied into the dumpster if necessary.
10. In case of an emergency situation, weather or otherwise, the applicant will follow
instructions from the Washington County Sheriffs Department and/or the Hugo Fire
Chief including the cancellation or postponement of the event.
After the Event
11. All garbage shall be removed from the event and parking areas and properly disposed
of at the close of the event.
12. All signs and items in the park related to the event will be removed immediately after
the close of the event.
4. CONCLUSION/RECOMMENDATION:
Staff has worked with the event organizers who have agreed to the above requirements.
Staff recommends Council approve the Special Event Permit for Brats, Bags, and
Baskets subject to the application materials and the conditions in this memorandum.
Minor changes to this permit may be approved by City staff. Changes staff deems to
be significant will require Council review and approval.

Special Event Permit Application
Procedures for processing special event permits are found in Hugo City Code Chapter 90, Section 90-37.2.
Any individual or organization holding an event or temporary use of a property which includes erecting temporary structures,
offering food/beverages, or affecting traffic or parking requires a special event permit. Outdoor events, tent sales, employment
fairs, celebrations, or similar special events are subject to this ordinance and require a special event permit.

Reciprocal Fire Service Agreement
THIS CAPITAL CITY REGIONAL FIREFIGHTER’S ASSOCIATION RECIPROCAL FIRE SERVICES
AGREEMENT (“Agreement”) is made this 2nd day of June 2025, by and between the members of the Capital City
Regional Firefighter’s Association (“Association”) who have executed this Agreement and the City of Hugo,
hereafter collectively referred to as the “Parties” for mutual assistance in firefighting services.
WHEREAS, the said governmental units desire to make available to each other their respective fire-fighting equipment
and personnel in the case of emergencies, and each of said municipalities has legal authority to send its firefighting
equipment and personnel into other communities.
NOW, THEREFORE, in consideration of the mutual promises and agreements contained herein and subject to all
applicable statutes, rules and regulations, the Parties agree as follows:
1. It is agreed that the Fire Department of the City of Hugo shall provide mutual aid to any of the Fire Departments
listed as members of the Association and who have executed an Agreement in this form. This Agreement shall be
in effect when approved by the governing body and signed by the appropriate persons for the governmental unit.
A list of all members of the Association signing this Agreement shall be furnished to each member of the
Association. A list of current Association members is attached as Appendix A to this Agreement as “Capital City
Regional Firefighters’ Association Region 1 Members”.
2. Any Fire Department of a governmental unit wishing to withdraw its membership from the Agreement, may
do so by notifying every member department in writing at least thirty (30) days prior to termination of its
membership in the Association.
Purpose:
The intent of this agreement is to make equipment, personnel, and other resources available to each Party who has
signed this Agreement upon its request to the other Parties who have signed the Agreement. It is the intent of the
parties that this Agreement does not constitute a joint powers agreement under Minnesota law.
Definitions:
1. “Association” means all municipalities and independent nonprofit firefighting corporations that are members of
the Region 1 Minnesota State Fire Department Association.
2. “Party” or “Parties” means one or more local government units or non-profit firefighting corporations that is a
member of the Association who has signed this Agreement to provide assistance to other Parties.
3. “Requesting Official” means the person designated by a Party who is responsible for requesting assistance
from other Parties.
4. “Requesting Party” means a Party that requests assistance from other Parties, normally the fire department of
the jurisdiction in which an incident requiring assistance occurs.
5. “Responding Official” means the person designated by the Party who is responsible to determine whether and to
what extent that Party should provide assistance to a Requesting Party.

6. “Responding Party” means a Party that provides assistance to a Requesting Party.
Authorization:
Each of the Parties participating in this Agreement hereby authorize their respective Fire Departments to respond to and
receive mutual aid services pursuant to the terms of this Agreement and to otherwise take such actions as are needed to
provide and receive assistance as provided herein.
Procedure:
1. Request for Assistance. Whenever, in the opinion of the Requesting Official, there is a need for assistance from
other Parties, the Requesting Official may call upon the Responding Official of any other Party to furnish
assistance.
2. Response to Request. Upon the request for assistance from the Requesting Party, the Responding Official may
authorize and direct its personnel to provide assistance to the Requesting Party. Whether the Responding Party
provides assistance and, if so, to what extent shall be determined by the Responding Official.
3. Recall of Assistance. The Responding Official may at any time recall such assistance when in his or her best
judgment or by an order from the governing body of the Responding Party, it is considered to be in the best
interests of the Responding Party to do so.
4. Command of Scene. The Requesting Party or their designee shall be in command of the emergency scene. The
personnel and equipment of the Responding Party shall be under the direction and control of the Requesting Party
or their designee until the Responding Official withdraws assistance. In the event an emergency occurs in or
crosses the boundaries of more than one jurisdiction, a joint command of the affected jurisdictions should be
established.
Charges to the Requesting Party:
1. Subject to the terms below, the Requesting Party agrees to compensate the Responding Party as outlined in this
Agreement. The charges incurred by the Requesting Party will include the actual costs of salaries, overtime,
materials, supplies, and other necessary expenses. Equipment cost will be at the rates specified in Appendix B.
2. A Responding Party shall not charge for assistance provided to the Requesting Party of this Agreement for the
first twelve (12) hours of such assistance. If assistance provided under this Agreement continues for more than
twelve (12) hours, the Responding Party may submit to the Requesting Party an itemized bill for the actual cost
of any assistance provided after the initial twelve-hour period, including salaries, overtime, materials and
supplies and other necessary expenses; and the Requesting Party will reimburse the party providing assistance
for that amount. Such compensation is not contingent upon the availability of federal or state government funds.
3. Invoice to the Requesting Party. Within ninety (90) days of the return to the home work station of all labor and
equipment of the Responding Party, the Responding Party shall submit to the Requesting Party an invoice of all
charges for assistance provided under this agreement as described in paragraph 2 above. Payment of any undisputed
amount shall be paid to Responding party within 30 days.
Discretionary Assistance:
1. Providing assistance is entirely at the discretion of the Responding Party. The agreement to provide assistance is
expressly not contingent upon a declaration of a major disaster or emergency by the federal government or upon

receiving state or federal funds.
2. It is the express understanding of the Parties that the first priority of the Responding Party’s fire department
personnel is to provide fire protection within its respective jurisdiction. It is understood that the assistance
contemplated in this Agreement shall be provided only if the fire department personnel requested to provide
assistance can provide such assistance without jeopardizing the fire protection services within its respective
jurisdiction.
3. This Agreement is intended to authorize requests for assistance only in emergency or other specifically requested
situations. Nothing in this Agreement shall be construed as authorizing request for assistance for routine activities.
Workers’ Compensation:
Each Party shall be responsible for injuries or death of its own personnel. Each Party will maintain workers’
compensation insurance or self-insurance coverage, covering its own personnel while they are providing assistance
pursuant to this Agreement. Each Party waives the right to sue any other Party for any workers’ compensation
benefits paid to its own employee or volunteer or their dependents, even if the injuries were caused wholly or partially
by the negligence of the other Party or its officers, employees, or volunteers.
Damage to Equipment:
Each Party shall be responsible for damage to its own equipment. Each party waives the right to sue any other Party for
any damage to its equipment, even if the damage was caused wholly or partially by the negligence of any other Party
or its officers, employees, or volunteers.
Liability:
1. For the purposes of the Minnesota Municipal Tort Liability Act (Minn. Stat. Ch. 466), the employees and officers
of the Responding Party are deemed to be employees (as defined in Minn. Stat. § 466.01, subd. 6) of the Requesting
Party.
2. The Requesting party agrees to indemnify and defend against any claims brought or actions filed against the
Responding Party or any officer, employee, or volunteer of the Responding Party for injury to, death of, or
damage to the Party of any third person or persons, arising from the performance and provision of assistance in
responding to a request for assistance by the Requesting Party pursuant to this Agreement.
3. Under no circumstances, however, shall a Party be required to pay on behalf of itself and other Parties, any
amounts in excess of the limits on liability established in Minnesota Statutes, Chapter 466 applicable to any one
Party. The limits of liability for some or all of the Parties may not be added together to determine the maximum
amount of liability for any Party. No Party waives any immunities or limits on liability it enjoys under Minnesota
Statutes or common law.
4. The intent of this subdivision is to impose on each Requesting Party a limited duty to defend and indemnify a
Responding Party for claims arising within the Requesting Party’s jurisdiction subject to the limits of liability
under Minnesota Statutes, Chapter 466. The purpose of creating these reciprocal duties to defend and indemnify
is to simplify the defense of claims by eliminating conflicts among defendants, and to permit liability claims
against multiple defendants from a single occurrence to be defended by a single attorney.
5. No Party to this Agreement nor any officer of any Party shall be liable to any other Party or to any other person
for failure of any Party to furnish assistance to any other Party, or for recalling assistance, both as described in
this Agreement.

6. Failure to provide assistance will not result in liability of a Party.
General Provisions:
1. Amendment. Any amendment to this Agreement must be in writing and will not be effective until it has been
executed and approved by the same Parties who executed and approved the original Agreement, or their successors
in office.
2. General Compliance. Both Parties agree to comply with all applicable federal, state and local laws and regulations
governing any services provided under this Agreement.
3. Non-Discrimination. Both Parties agree to comply with the provisions of all applicable federal and state statutes
and regulations pertaining to civil rights and nondiscrimination including, without limitation, Minnesota Statutes,
Section 181.59.
4. Severability. Should a court of competent jurisdiction rule any portion, section or subsection of this Agreement
invalid or nullified, that fact shall not affect or invalidate any other portion, section or subsection; and all remaining
portions, sections or subsections shall remain in full force and effect.
5. Assignment. This Agreement is not assignable without the mutual written agreement of the Parties.
6. Entire Agreement. This Agreement constitutes the entire agreement of the Parties and supersedes all prior
communications, understandings and agreements relating the subject matter hereof, whether oral or written.
7. Data Practices. The Parties agree that they will abide by the Minnesota Government Data Practices Act and all
other statutes or provisions of law related to data practices, data management and records retention. Each Party
shall remain the exclusive responsible authority for its own data management for responses to data requests and
for all aspects of records retention for any and all data that is collected, created, received, maintained or
disseminated by the Party as a result of any activity arising out of this Agreement.

WHEREAS, an application has been filed by Ryan and Sarah Swenson that requests

as follows;

WHEREAS, the City Council has fully considered the request for the encroachment

ENCROACHMENT AGREEMENT
THIS AGREEMENT is made this 2nd day of June, 2025 by and between the CITY OF
HUGO, a Minnesota municipality (hereinafter “City”) and, Ryan Swenson and Sarah Swenson, a
married couple, (hereinafter “Owner”), and their successors in title.
WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”)
along the northerly, westerly, easterly, and southerly portion of the Owner’s property, which is
legally described as:
Lot 46, Block 2, The Shores of Oneka Lake 3rd Addition, Washington County, Minnesota; and,
WHEREAS, Owner is desirous of constructing a fence partially within the easement area;
and,
WHERAS, the City will permit the placement of a fence in the area described herein subject
to the terms and conditions hereof.
NOW, THEREFORE, in consideration of the premises and for good and valuable
consideration, the receipt of which is acknowledged, the City will permit the encroachment on its
easement as set forth herein and subject to the conditions set forth below:
1. Owner and their successors in title may install and maintain a fence within the
Easement, and the fence shall be constructed in accordance with the plans on file with the City of
Hugo.
2. No plantings, trees, permanent improvements or structures other than the fence may
be maintained or placed in the easement area.
3. Owner shall maintain the fence in good repair and shall not permit it to be expanded,
lengthened or to impair the City’s easement or its rights thereunder in any respect.
4. The encroachment granted to Owner herein is subject to the existing easement rights
of the City as granted in various easements.
5. The City will notify Owner if it requires removal or relocation of the fence or any part
of it. Thereafter, Owner shall remove the fence according to the direction of the City and if Owner
fails to do so, the City may enter upon the land and remove as much of the fence as required and cast
it upon the adjoining lands. In such an event, the City shall not be liable to Owner for any costs, loss
or damage whatsoever, and may assess the property for all of its costs incurred in removing the
fence, and Owner waive all formalities, requirements and defenses arising from or relating to
Minnesota Statutes Section 429 relating to or arising from the work done by the City.
6. To the fullest extent permitted by law, Owner agrees to release, defend, protect,
indemnify, save and hold harmless the City, its agents, directors, employees, shareholders and
contractors against any and all claims, costs and liabilities, including the costs of defense for
damages, injury or death arising from or in any way connected to the installation, maintenance,
repair, removal and/or presence of the fence, regardless of whether such harm is to Owner, the City,
the employees or officers, guests or invitees of either or any other person or entity, except Owner
shall not be liable under this paragraph for loss or damage to the extent resulting from the negligen ce
of the indemnified parties.
7. The permission granted herein is limited exclusively to the proposed fence within the
specified portion of the easement area of the City’s Easement. Owner shall not alter the grade or
permit such alteration anywhere upon the land upon which the City has reserved its easement rights
without proper express written consent of the City.
8. Owner shall, at all times, use their best efforts to conduct all of their activities on said
Easement in such a manner as to not interfere with or impede the operation of the City’s Easement
and related activities in any manner whatsoever, and shall follow the direction of the City.
9. This Agreement shall run with the land and inure to the benefit and be binding upon
the parties hereto, their heirs, successors and assigns.
10. Owner shall be responsible for the costs of recording this Agreement with the
Washington County Recorder.
11. The fence shall be constructed with chain link so as not to impede drainage through
the swale along the southern portion of the property.

APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW
CONSTRUCTION OF A FENCE WITHIN A DRAINAGE AND UTILITY
EASEMENT ON THE PROPERTY LOCATED AT 4670 EMPRESS WAY

WHEREAS, an application has been filed by Jack and Nicole Morrisette that requests
approval of an encroachment agreement to allow construction of a fence within a drainage
and utility easement on the property located at 4670 Empress Way North, legally described
as follows;
Lot 16, Block 5, Heritage Ponds, Washington County, Minnesota.
WHEREAS, the City Council has fully considered the request for the encroachment
agreement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO, MINNESOTA, that it should and hereby does approve the encroachment
agreement on property located at 4670 Empress Way North.

ENCROACHMENT AGREEMENT
THIS AGREEMENT is made this 2nd day of June, 2025 by and between the CITY OF
HUGO, a Minnesota municipality (hereinafter “City”) and, Jack Morrisette and Nicole Morrisette, a
married couple, (hereinafter “Owner”), and their successors in title.
WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”)
along the northerly, westerly, easterly, and southerly portion of the Owner’s property, which is
legally described as:
Lot 16, Block 5, Heritage Ponds, Washington County, Minnesota; and,
WHEREAS, Owner is desirous of constructing a fence partially within the easement area;
and,
WHERAS, the City will permit the placement of a fence in the area described herein subject
to the terms and conditions hereof.
NOW, THEREFORE, in consideration of the premises and for good and valuable
consideration, the receipt of which is acknowledged, the City will permit the encroachment on its
easement as set forth herein and subject to the conditions set forth below:
1. Owner and their successors in title may install and maintain a fence within the
Easement, and the fence shall be constructed in accordance with the plans on file with the City of
Hugo.
2. No plantings, trees, permanent improvements or structures other than the fence may
be maintained or placed in the easement area.
3. Owner shall maintain the fence in good repair and shall not permit it to be expanded,
lengthened or to impair the City’s easement or its rights thereunder in any respect.
4. The encroachment granted to Owner herein is subject to the existing easement rights
of the City as granted in various easements.
5. The City will notify Owner if it requires removal or relocation of the fence or any part
of it. Thereafter, Owner shall remove the fence according to the direction of the City and if Owner
fails to do so, the City may enter upon the land and remove as much of the fence as required and cast
it upon the adjoining lands. In such an event, the City shall not be liable to Owner for any costs, loss
or damage whatsoever, and may assess the property for all of its costs incurred in removing the
fence, and Owner waive all formalities, requirements and defenses arising from or relating to
Minnesota Statutes Section 429 relating to or arising from the work done by the City.
6. To the fullest extent permitted by law, Owner agrees to release, defend, protect,
indemnify, save and hold harmless the City, its agents, directors, employees, shareholders and
contractors against any and all claims, costs and liabilities, including the costs of defense for
damages, injury or death arising from or in any way connected to the installation, maintenance,
repair, removal and/or presence of the fence, regardless of whether such harm is to Owner, the City,
the employees or officers, guests or invitees of either or any other person or entity, except Owner
shall not be liable under this paragraph for loss or damage to the extent resulting from the negligen ce
of the indemnified parties.
7. The permission granted herein is limited exclusively to the proposed fence within the
specified portion of the easement area of the City’s Easement. Owner shall not alter the grade or
permit such alteration anywhere upon the land upon which the City has reserved its easement rights
without proper express written consent of the City.
8. Owner shall, at all times, use their best efforts to conduct all of their activities on said
Easement in such a manner as to not interfere with or impede the operation of the City’s Easement
and related activities in any manner whatsoever, and shall follow the direction of the City.
9. This Agreement shall run with the land and inure to the benefit and be binding upon
the parties hereto, their heirs, successors and assigns.
10. Owner shall be responsible for the costs of recording this Agreement with the
Washington County Recorder.
11. The fence shall be constructed with chain link so as not to impede drainage through
the swale along the southern portion of the property.

1.DESCRIPTION OF REQUEST:
The applicants are requesting an encroachment agreement to allow construction of a fence within
a drainage and utility easement on property located at 6240 157th Street North. The Senior
Engineering Technician has reviewed the location of the fence and is comfortable with the
request.
2.CONCLUSION/RECOMMENDATION:
Staff has reviewed the request and recommends that the City Council approve the encroachment
agreement for the property located at 6240 157th Street North.

APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW
CONSTRUCTION OF A FENCE WITHIN A DRAINAGE AND UTILITY
EASEMENT ON THE PROPERTY LOCATED AT 6240 157th STREET NORTH
WHEREAS, an application has been filed by Kathryn and Mitchell Fiega that requests
approval of an encroachment agreement to allow construction of a fence within a drainage
and utility easement on the property located at 6240 157th Street North, legally described
as follows;
Lot 45, Block 2, The Shores of Oneka Lake 3rd Addition, Washington County,
Minnesota.
WHEREAS, the City Council has fully considered the request for the encroachment
agreement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO, MINNESOTA, that it should and hereby does approve the encroachment
agreement on property located at 6240 157th Street North.

ENCROACHMENT AGREEMENT
THIS AGREEMENT is made this 2nd day of June, 2025 by and between the CITY OF
HUGO, a Minnesota municipality (hereinafter “City”) and, Kathryn Fiega and Mitchell Fiega, a
married couple, (hereinafter “Owner”), and their successors in title.
WHEREAS, the City has an easement for drainage and utility purposes (the “Easement”)
along the northerly, westerly, easterly, and southerly portion of the Owner’s property, which is
legally described as:
Lot 45, Block 2, The Shores of Oneka Lake 3rd Addition, Washington County, Minnesota; and,
WHEREAS, Owner is desirous of constructing a fence partially within the easement area;
and,
WHERAS, the City will permit the placement of a fence in the area described herein subject
to the terms and conditions hereof.
NOW, THEREFORE, in consideration of the premises and for good and valuable
consideration, the receipt of which is acknowledged, the City will permit the encroachment on its
easement as set forth herein and subject to the conditions set forth below:
1. Owner and their successors in title may install and maintain a fence within the
Easement, and the fence shall be constructed in accordance with the plans on file with the City of
Hugo.
2. No plantings, trees, permanent improvements or structures other than the fence may
be maintained or placed in the easement area.
3. Owner shall maintain the fence in good repair and shall not permit it to be expanded,
lengthened or to impair the City’s easement or its rights thereunder in any respect.
4. The encroachment granted to Owner herein is subject to the existing easement rights
of the City as granted in various easements.
5. The City will notify Owner if it requires removal or relocation of the fence or any part
of it. Thereafter, Owner shall remove the fence according to the direction of the City and if Owner
fails to do so, the City may enter upon the land and remove as much of the fence as required and cast
it upon the adjoining lands. In such an event, the City shall not be liable to Owner for any costs, loss
or damage whatsoever, and may assess the property for all of its costs incurred in removing the
fence, and Owner waive all formalities, requirements and defenses arising from or relating to
Minnesota Statutes Section 429 relating to or arising from the work done by the City.
6. To the fullest extent permitted by law, Owner agrees to release, defend, protect,
indemnify, save and hold harmless the City, its agents, directors, employees, shareholders and
contractors against any and all claims, costs and liabilities, including the costs of defense for
damages, injury or death arising from or in any way connected to the installation, maintenance,
repair, removal and/or presence of the fence, regardless of whether such harm is to Owner, the City,
the employees or officers, guests or invitees of either or any other person or entity, except Owner
shall not be liable under this paragraph for loss or damage to the extent resulting from the negligen ce
of the indemnified parties.
7. The permission granted herein is limited exclusively to the proposed fence within the
specified portion of the easement area of the City’s Easement. Owner shall not alter the grade or
permit such alteration anywhere upon the land upon which the City has reserved its easement rights
without proper express written consent of the City.
8. Owner shall, at all times, use their best efforts to conduct all of their activities on said
Easement in such a manner as to not interfere with or impede the operation of the City’s Easement
and related activities in any manner whatsoever, and shall follow the direction of the City.
9. This Agreement shall run with the land and inure to the benefit and be binding upon
the parties hereto, their heirs, successors and assigns.
10. Owner shall be responsible for the costs of recording this Agreement with the
Washington County Recorder.
11. The fence shall be constructed with chain link so as not to impede drainage through
the swale along the southern portion of the property.

RESOLUTION 2025 - ___
RESOLUTION TO CLOSE THE CORONAVIRUS RELIEF FUND AND
TRANSFER INVESTMENT INCOME TO THE STREET CIP FUND
WHEREAS, the City of Hugo maintains a fund accounting system that segregates cash
according to the source and intended use; and
WHEREAS, it is necessary to create fund accounts as needs arise, and to close fund accounts
when those needs no longer exist; and
WHEREAS, the Coronavirus Relief Fund was established in 2020 to track the $1,148,713.00
received in CARES Act Funding, and was used again in 2021 and 2022 to track the
$1,668,411.91 received in ARPA Funding; and
WHEREAS, as of December 31, 2024, all Coronavirus Relief Funding has been expended and
properly reported; and
WHEREAS, the Governmental Accounting Standards Board (GASB), along with the City’s
auditors, recommend closing fund accounts when the intended use of those accounts no longer
exist.
WHEREAS, investment income in the amount of $86,380.48 remained in the Fund; and
WHEREAS, per United States Treasury guidance, interest earned does not need to be remitted
to the Treasury nor used for specific program-related expenditures; and
WHEREAS, the investment income is not restricted for any specific purpose and therefore can
be transferred to any fund designated by the City Council.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Hugo authorizes
the closure of the Coronavirus Relief Fund and the transfer of all remaining investment income
to the Street CIP Fund.
