F.1 Yellow Ribbon Network Update - Chair Chuck Haas Chair Chuck Haas will provide an update on recent activities of the Hugo Yellow Ribbon Network. G. 1 Approve Claims Roster Staff recommends Council approve the Claims Roster as presented. G.2 Approve Jeff Maas as New Public Works Utility Lead Worker The City Council, at their July 7, 2025, meeting, gave authorization to hold interviews and select an internal candidate to fill the position of Utility Lead Worker for the Public Works Department. Staff is recommending the promotion of Jeff Maas to the position of Public Works Utility Lead Worker. This position would be pay grade 6 (non-exempt) and Jeff would begin at the maximum step of the salary matrix. Jeff has been a valuable member of the Public Works Department since 2006. He is very capable and has many years of experience with an emphasis on municipal utility infrastructure G.3 Approve Advertisement for Vacant Public Works Worker Position With the recent resignation of a Public Works employee, there is one open position in the Public Works Department. Staff requests Council approval to advertise externally for the vacant Public Works Worker position in the Public Works Department. G.4 Approve Appointment of Jordan Fahey to the Planning Commission On June 30, 2025, Council held interviews to consider applicants to fill vacant commission positions. After discussion, Council selected Jordan Fahey to fill the vacant position on the Planning Commission. Staff recommends Council appoint Jordan Fahey as a new Planning Commissioner. G.5 Approve Minor Subdivision for Barton Guthrie – 8991 130th Street North Barton Guthrie is requesting a minor subdivision of a 40-acre parcel located at 8991 130th Street North, splitting it into a 30-acre parcel and a 10-acre parcel. At its July 10, 2025, meeting the Planning Commission held a public hearing, and considered the request. No one spoke during the public hearing. The Planning Commission voted unanimously to recommend approval of the minor subdivision to the City Council. Staff is recommending the City Council approve the resolution approving a minor subdivision for property located at 8991 130th Street North. G.6 Approve Ordinance Amending the Fence Ordinance Section 90-227 of City Code outlines requirements for fences and requires approval of a Conditional Use Permit (CUP) for placing a fence within a drainage and utility easement. Staff has been requiring that residents constructing a fence within an easement request an Encroachment Agreement from the City Council instead of a CUP, whether or not the easement has any public improvements, which lengthens the approval process for a fence. Staff is proposing amendments that are intended to streamline the process for approving fences. At its meeting on July 10, 2025, the Planning Commission held a public hearing and considered the request. No one spoke during the public hearing. The Planning Commission voted unanimously to recommend approval of the ordinance amendments to the City Council. Staff is recommending that the City Council approve the ordinance approving amendments to the fence ordinance. G.7 Approve Special Event Permit for the Wilson Tool Company Picnic on August 9, 2025 Wilson Tool has applied for a Special Event Permit for their annual company picnic to be held on Saturday, August 9, 2025, from 11 a.m. to 4 p.m. at Hanifl Fields. This is a private event and free of charge to Wilson Tool employees and their families. Approximately 900 people are expected to attend. There will be catered food, alcohol, and activities. There will also be amplified sound for announcements. Council approval is required for any event that serves alcohol, has amplified music, and attendance of over 200 people. Staff recommends Council approve the Special Event Permits for Wilson Tool’s company events. G.8 Approve Temporary Liquor License for Hugo Lions Club for the Wilson Tool Picnic on Saturday, August 9, 2025 The Hugo Lions Club has applied for a Temporary Liquor License to serve alcohol at the Wilson Tool Picnic on August 9, 2025. The Club has provided the completed application, application fee, and proof of Liquor Liability Insurance for the event. Staff recommends Council approve the Temporary Liquor License for the Wilson Tool Picnic on Saturday, August 9, 2025. J.1 Discussion and Approval of Revised Remote Attendance Policy At its October 20, 2014, meeting, Council adopted a Remote Attendance Policy to allow a council member to use “Skype” for the purpose of attending a City Council meeting from a location other than the Council Chambers. Legislation over the past 11 years, and specifically during COVID, has amended the law on remote meeting attendance. In addition, a new law enacted during the 2025 Legislative Session has made changes to the Open Meeting Law and eliminated the “open and assessable” location rule for remote meeting attendees. Staff reviewed the City’s policy on remote attendance and is recommending Council consider revisions to comply with State Statute. Staff will review these revisions with the Council and recommend Council approve a revised Remote Attendance Policy. M.1 Schedule 165th Street AUAR Open House on Wednesday, July 30, 2025 At its April 21, 2025, meeting the City Council authorized staff to move forward with the 165th Street Alternative Urban Areawide Review (AUAR). The AUAR will analyze multiple development scenarios including land use, infrastructure, environmental assessment, and costs. The AUAR will include public engagement and will inform the 2050 Comprehensive Plan. Landform and WSB have been working on land use and road design options. A public open house is scheduled for Wednesday, July 30, 2025, from 5 to 6:30 pm. Staff recommends Council schedule this as a meeting if they choose to attend. N. Presentation of 2024 Audit Report – Smith Schafer & Associates Jill Schultz from the independent accounting firm of Smith Schafer & Associates was in attendance to present a recap of the audit of City finances for the 2024 fiscal year. She began by explaining that the audit determined that the City’s finances are accurate as presented. The State Auditor establishes the areas that are required to be tested. The audit found nothing in noncompliance and there were no exceptions noted during the audit. Jill reviewed governmental funds saying property tax revenue made up the largest part of governmental fund revenues. Intergovernmental revenue was lower than the previous year, Council Meeting Minutes for July 7, 2025 Page 2 of 9 primarily due to the receipt of ARPA funds the prior year. Investment income improved in 2024 due to favorable market conditions. General government expenses increased by 8%, mainly due to higher contract engineering and other professional service fees. This category has shown a steady upward trend each year. Public safety expenses rose by 11%, attributed to an increase in the Washington County Sheriff contract and having a full-time fire chief for the entire year. Highways and streets expenses increased by 5%, primarily from enhanced maintenance activities, including siren repairs, street lighting, and concrete work. Park maintenance expenses decreased by 8%, mainly due to reduced personnel costs. Jill displayed a pie chart illustrating that the majority of expenses were for public safety and general government functions. The distribution remained similar to previous years. Jill explained the purpose and benefit of general fund reserves and referenced the 2008 tornado as an example of why maintaining strong reserves is important for timely response to emergencies. The City’s reserve balance was approximately 69% of total expenditures. The State Auditor recommends a reserve level of 35–50%; Hugo's reserve is about 50% of the next year’s budget. The five-year debt service showed a slight decrease. Capital project activity dropped in 2024. Significant projects were done in 2021 and 2022, particularly the Public Works facility and Lions Park. Jill talked about Enterprise Funds, which included water, sewer, and related construction fees saying they fluctuate from year to year, and the revenue increase was fairly the same as last year. Jill concluded by saying the City was issued an unmodified audit opinion with no Minnesota legal compliance exceptions. The Annual Comprehensive Financial Report was posted on the City’s website and available in the Finance Directors office. Approve Annual Performance Review for Public Works Worker Jeff Maas Jeff Maas was hired by the City of Hugo on July 24, 2006, as a Public Works Worker. Approve Hiring of Mason Libke as New Building Inspector After conducting interviews for a new Building Inspector, Community Development Director Rachel Juba had selected Mason Libke to fill the position. Adoption of the Consent Agenda approved the hiring of Mason Libke as the new Building Inspector at Pay Grade 7, Minimum Step with a start date of July 7, 2025. Approve Hiring of Mike Perron as New Public Works Worker After conducting interviews for a new Public Works Worker, Public Works Director Scott Anderson had selected Mike Perron to fill the position. Adoption of the Consent Agenda approved the hiring of Mike Perron as the new Public Works Worker at Pay Grade 5, Step 3 with a start date to be determined. Approve Resignation of Utility Lead Worker Rick Fox On Wednesday, June 18, 2025, Public Works Utility Lead Worker Rick Fox verbally submitted his resignation from his position at the City of Hugo. Adoption of the Consent Agenda approved the resignation of Rick Fox effective June 18, 2025. Approve Internal Advertisement for Public Works Lead Utility Worker Position The position of Utility Lead Worker became vacant following the resignation of Richard Fox. Since his departure, Public Works Director, Scott Anderson, had several current Hugo Public Council Meeting Minutes for July 7, 2025 Page 4 of 9 Works employees express interest in the position. Staff requested to advertise internally to fill this position. If no qualified internal applicant was found, staff would advertise outside of the Hugo Public Works organization. Adoption of the Consent Agenda approved staff to conduct interviews with internal candidates who are interested in the Utility Lead Worker position. Approve Transfer of Ownership of AED to the Hugo Fire Department from the Hugo Good Neighbors Food Shelf The Hugo Good Neighbors Food Shelf had an Automated External Defibrillator (AED) Unit it wanted to donate to the Hugo Fire Department. The Department would take on the responsibility of maintaining as they do all other AED’s in City buildings and vehicles. All donations to the Fire Department needed to be approved by Council. Adoption of the Consent Agenda approved the donation from the Hugo Good Neighbors Food Shelf to the Hugo Fire Department. Approve Hugo Firefighter’s Relief Association Request for Increase in Lump-Sum Pension The Board of Trustees for the Hugo Firefighter’s Relief Association had formally requested City Council ratification of an increase of $500 per year of service in their lump-sum pension benefit. The Finance Department reviewed this request and found it to be financially feasible and consistent with the Pension Fiscal Policy adopted in April 2012. Adoption of the Consent Agenda approved the Board of Trustees request for a $500 increase in their lump-sum pension benefit and corresponding change to their bylaws. Approve Hugo Firefighter’s Relief Association Request to Ratify the Interest Rate for Deferred Members The Office of the State Auditor recently issued guidance stating that, in order for deferred members to be credited with interest, the rate must be approved by a relief association’s board of trustees and ratified by the affiliated municipal governing board. To be in compliance with this mandate, the Hugo Firefighter’s Relief Association had voted to maintain the 5% interest rate earned by deferred members as currently stated in the bylaws and has formally requested City Council ratification of the interest rate. Adoption of the Consent Agenda approved the 5% interest rate for deferred members. Approve Revisions to the Hugo Firefighter’s Relief Association Bylaws The Hugo Firefighter’s Relief Association Board of Trustees recently participated in a training session presented by Ed Hoffman from the Minnesota State Fire Department Association. Best practices were reviewed, and updates were provided on state statutes. The current bylaws were reviewed to identify omissions, corrections and statute updates needed. Sections were revised to reflect statutory changes, language updates were made, and officer salaries were increased. The Hugo Firefighter’s Relief Association voted to approve the bylaws as presented and formally requested that the City Council ratify the revisions. Adoption of the Consent Agenda approved the revisions to the Hugo Firefighter’s Relief Association Bylaws. Council Meeting Minutes for July 7, 2025 Page 5 of 9 Approve Donation from the St. John’s the Baptist Men’s Club to the Hugo Fire Department St. John’s the Baptist Men’s Club requested to donate $500 to the Hugo Fire Department. All donations to the Fire Department needed to be approved by the City Council. Adoption of the Consent Agenda approved the $500 donation. Approve Reduction in Letter of Credit for Watercrest of Hugo 1st Addition The Watercrest of Hugo 1st Addition had substantial work completed to date, and Artemis Development Company, LLC. had requested a reduction in the letter of credit. The current letter of credit for the Shores of Oneka Lake Project was in the amount of $1,454,987. Staff had inspected the work completed to date and recommended Council approve the reduction in the letter of credit to $145,498 based on the value of work remaining to be completed. Adoption of the Consent Agenda approved the reduction in the letter of Credit for Watercrest of Hugo 1st Addition. Approve Resolution Approving Encroachment Agreement for 4801 142nd Street North Anthony and Andrea Liebhard had requested an encroachment agreement to allow for the construction of a shed within a drainage and utility easement on property located at 4801 142nd Street North. The Senior Engineering Technician had reviewed the location of the shed and was comfortable with the request. Adoption of the Consent Agenda approved RESOLUTION 2025- 24 APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW CONSTRUCTION OF A SHED WITHIN A DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT 4801 142ND STREET NORTH. Approve Resolution Approving Encroachment Agreement for 15539 Goodview Trail North Caitlin and Nicholas Frucci had requested an encroachment agreement to allow for the construction of a fence within a drainage and utility easement on property located at 15539 Goodview Trail North. The Senior Engineering Technician had reviewed the location of the fence and was comfortable with the request. Approve Resolution Approving Encroachment Agreement for 6209 157th Street North Anthony and Judith Straquadine had requested an encroachment agreement to allow for the construction of a fence within a drainage and utility easement on property located at 6209 157th Street North. The Senior Engineering Technician had reviewed the location of the fence and was comfortable with the request. Adoption of the Consent Agenda approved RESOLUTION 2025- 26 APPROVING AN ENCROACHMENT AGREEMENT TO ALLOW CONSTRUCTION OF A FENCE WITHIN A DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT 6209 157th STREET NORTH. Council Meeting Minutes for July 7, 2025 Page 6 of 9 Approve Quote for Gravel Contract Staff received quotes for class 5 modified gravel to be placed on our rural gravel roads. Staff received 3 quotes: Dresel Contracting, Miller Excavating and Arnt Construction. Dresel Contracting provided the low quote of $15.60 per ton delivered price. The City will need approximately 5,600 tons for a total contract of $87,360.00. The roads included in this year’s re- graveling project are: Fiona Rd, 140th St and 147th St. Adoption of the Consent Agenda approved the contract with Dresel Contracting to provide class 5 modified gravel at $15.60 per ton. Public Hearing on the Issuance of Educational Facilities Revenue Bonds – Legacy Christian Academy At the May 5, 2025, City Council meeting, the Council adopted a resolution calling for a public hearing on a proposal to Issue Educational Facilities Revenue Bonds in an amount not to exceed $6,000,000, on behalf of Legacy Christian Academy (the “Borrower”), a Minnesota nonprofit corporation organized under the laws of the State of Minnesota. Finance Director Anna Wobse explained the bond proceeds would be used to finance the acquisition and improvements of a currently leased pre-k through12 educational facility located at 3037 Bunker Lake Blvd NW in Andover. The Borrower agreed to pay the City of Hugo an issuer’s administrative fee of ½ of 1% of the principal amount of the bonds. Taft Law, the City’s bond counsel, had reviewed this request and found it to be a proper use of the City’s bonding authority. The City would only be serving as the bond issuer and would have no obligations for repaying investors. Wobse recommended Council open the public hearing and adopt the resolution approving the issuance and sale of the bonds. Rachel Lochner from Taft Law and Jake Mulvihill, the Head of School were in attendance to answer questions. Miron asked Anna to remind them why the City has the ability to issue the bonds. Anna explained the City has $10 million annually in bonding authority and has not used, nor plans to use, any this year. Jake thanked the Council on behalf of the families and students for considering this bond offer, Rachel reiterated that all costs and fees were being paid by the borrower. Weidt opened the public hearing. There were no comments, and he closed the public hearing. Miron made motion, Strub seconded, to approve RESOLUTION NO 2025-27 RESOLUTION APPROVING THE ISSUANCE AND SALE OF AN EDUCATIONAL FACILITIES REVENUE NOTE, SERIES 2025 AND AUTHORIZING THE EXECUTION OF DOCUMENTS RELATING THERETO (LEGACY CHRISTIAN ACADEMY PROJECT). Council Meeting Minutes for July 7, 2025 Page 7 of 9 Highway 61 Construction Update Washington County, in partnership with the City of Hugo and MNDOT, are making improvements to TH 61 between Egg Lake Road and Frenchman Road. Construction is scheduled to begin on July 7, 2025, with TH 61 remaining open to traffic except for a two-week period. TH 61 between Egg Lake Road and Frenchman Road will be closed for a two-week period that is currently scheduled to start July 28th. The detour is extensive and shown on the Washington County Construction Newsletter. City Engineer Mark Erichson explained the improvements would include lengthening turn lanes. Replacing a large culvert, making pedestrian improvements. The City has entered into a cooperative agreement with the State for the City’s portion of some of the signal improvements. The widening and shoulder replacement on west side of TH61 will necessitate a full closure. Some of the work was being done that week and traffic will be shifting lanes next week. The week of July 28 will be the most disruptive part of the project with the closure of TH61 from Egg Lake Road to Frenchman Road which will help shorten the project time. Mark talked about the significant detour that will take traffic to the freeway. The road will be open to business and residents, but no through traffic will be allowed. Fire Chief Jim Compton and Washington County Sergeant Matt Wieland have been involved in the discussions on lane closures. The sheriff’s office will be present during the first few days to see that things go smoothly. It is realized people will find other routes, and there will be some cut-through traffic. The detour will be posted in advance of the July 28 closure. Business and residents have been notified. There is information on the project website and people can sign up to receive project notifications. They are also coordinating with mapping applications as well. As per City Code, City construction hours are 7:00 a.m. to 7:00 p.m. Monday through Friday and 8:00 a.m. to 5:00 p.m. on Saturdays, with no work on Sunday or holidays. Mark explained the contractor was requesting an extension of the working hours on Saturdays during the road closure. Specifically, they are requesting that working hours be extended to 7:00 a.m. to 7:00 p.m. on Saturdays to limit the duration of the closure. Miron made motion, Strub seconded, to grant the contractor’s request to extend construction hours per suggestion of the staff. All Ayes. Motion carried. Lions Volunteer Park Veterans Memorial Sub-Committee At the meeting of February 1, 2021, Council approved the overall site plan and preliminary designs for Lions Park. The plan included a future memorial in the southeast corner of Lions Volunteer Park in honor of Hugo Veterans. Future planning of the memorial was anticipated to involve the Hugo American Legion, and they would like to begin its planning. Parks Planner Shayla Denaway explained planning efforts would include operation, fundraising, and design of the memorial. At their meeting of June 18, 2025, the Parks Commission informally discussed the memorial and the establishment of a Memorial Sub-Committee. The Council Meeting Minutes for July 7, 2025 Page 8 of 9 sub-committee will make recommendations to the Parks Commission who will make recommendations to the City Council. It was anticipated that the memorial would be constructed in 3-5 years. Commissioners Andrew Reding and Cathy Arcand volunteered to be on the subcommittee. Five representatives of the Hugo American Legion have volunteered: Dave Fleming, Marcy Brake, Bill Juergens, Paul Christianson, and Carley Brake. DATE: July 11, 2025 for the City Council Meeting of July 21, 2025 ZONING: Rural Residential (RR) LAND USE: Large Lot Residential (LL) REVIEW DEADLINE: August 3, 2025 1. PLANNING COMMISSION MEETING UPDATE: At its meeting of Thursday, July 10, 2025 the Planning Commission held a public hearing and considered the request. No one spoke during the public hearing. The Planning Commission voted unanimously to recommend approval of the minor subdivision to the City Council. 2. DESCRIPTION OF REQUEST: The applicant is requesting approval of a minor subdivision to create two lots out of a 39.75 acre lot. The lots created would be two parcels that are 29.75 and 10 acres in size. 3. CONTEXT: A. Surrounding Land Use and Zoning The surrounding properties to the west, east, and south are zoned Rural Residential and are occupied by agricultural uses and single-family homes. The property to the north is zoned Agricultural and occupied by a farm and single-family home. B. Natural Characteristics of Site The property is has some rolling terrain that gradually slopes towards a small portion of Long Lake that lies in the southeast corner of the property. There are some wetlands in the southern portion of the property. Guthrie Minor Subdivision 4. ANALYSIS: A. Level of City Discretion in Decision-Making The City has limited discretion in approving or denying a minor subdivision application. The City’s discretion is limited to whether or not the proposed subdivision meets the standards outlined in the Comprehensive Land Use Regulations. If it meets these standards, the City must approve the subdivision. B. Consistency with Ordinance Standards Minor Subdivision Request Lot Size The Agricultural zoning district requires a minimum lot size of 10 acres with a 300-foot minimum width and a minimum depth of 480 feet. The two proposed lots will meet these requirements. Utilities The property is currently outside of the Metropolitan Urban Service Area (MUSA), which means the property is not eligible to receive City sewer and water. Services are not currently available to the site or planned for the site in the future. Any parcel proposed to be future home sites and would need a new well and septic system. The applicant has submitted a soil test indicating that there is sufficient space on the new parcel s that is suitable for a septic system on both proposed parcels. The locations have been approved by Washington County. Grading and Wetlands A grading plan will have to be submitted to the City prior to the issuance of a building permit for the proposed lot. The applicant shall demonstrate the building sites will comply with the City’s regulations regarding building elevation related to groundwater. A permit will need to be obtained from the City for the location of the new driveway. Prior to the issuance of any building permit the applicant shall demonstrate that the proposed home and buildings will not impact any wetlands. Stormwater management Prior to the issuance of any building permits the applicant shall demonstrate that the proposed parcels meet the Rice Creek Watershed District Rules regarding stormwater management and erosion control. Guthrie Minor Subdivision Streets The proposed parcels have access to 130th Street North, an existing County State-Aid Highway. At the time of application for a building permit, the applicant shall apply for a driveway permit as well as obtain necessary access permits from Washington County. Sidewalks/Trails There is a proposed trail in the 2040 Comprehensive Plan along 130th Street North. Prior to the issuance of any building permit, the applicant will need to demonstrate that the proposed trail will not be impacted. Park Dedication and Open Space A park dedication is required of all land subdivided for residential purposes. The applicant will not be dedicating parkland with this project, and would therefore be responsible for the parkland dedication fee, currently set at $3,400 per lot. The applicant is only responsible to pay for the creation of one lot. 5. STAFF RECOMMENDATION: Staff is of the opinion that the requested minor subdivision meets the City Code requirements and guidelines outlined in the 2040 Comprehensive Plan. Staff recommended approval the minor subdivision, subject to the conditions listed in the resolution, to the Planning Commission. 6. PLANNING COMMISSION RECOMMENDATION: The Planning Commission voted unanimously to recommend that the City Council approve the minor subdivision request, subject to the conditions in the resolution. On May 29, 2025, representatives from the Department conducted observations on Parcel 3503121120001 and verified the soil and site conditions. Based on the findings submitted by designer Josh Putt, each proposed parcel appears to have 10,000 ft2 of suitable soil for wastewater treatment. It should be noted that the soil testing conducted for this lot was preliminary and only for the purpose of determining suitability of this lot to support long -term sewage treatment. PLANNING COMMISSION MEETING UPDATE At its meeting of Thursday, July 10, 2025, the Planning Commission held a public hearing and considered the request. No one spoke during the public hearing. The Planning Commission voted unanimously to recommend that the City Council approve the proposed amendments to the fence ordinance. 2. BACKGROUND: Section 90-227 of City Code outlines requirements for fences, and requires approval of a Conditional Use Permit (CUP) for placing a fence within a drainage and utility easement. New residential developments in the City of Hugo are required to dedicate easements for drainage and utility purposes around the perimeter of single-family lots. Some of these easements have public improvements, such as underground utilities, or provide access to a public outlot for maintenance purposes. When a resident is constructing a fence on their property line, they are almost always going to be locating the fence within the easement. Staff has been requiring that residents constructing a fence within an easement request an Encroachment Agreement from the City Council instead of a CUP, whether or not the easement has any public improvements. The Encroachment Agreement request lengthens the approval process for a fence, and the proposed amendments are intended to streamline the process for residents. The purpose of requiring the Encroachment Agreement is to allow for the city to access an easement and remove the fence if necessary. In most cases, where there are no public improvements located in an easement or an easement isn’t providing access to a public improvement, there will not likely be a need to remove the fence. However, in the cases where an easement is used for public improvements, the city has an interest in dictating the fence’s location with respect to the improvements and requiring that the resident request an Encroachment Agreement to be approved administratively by the Public Works department. In addition to items relating to placing fences within easements, staff identified a number of items within the ordinance that should be updated to better reflect administrative practices. The ordinance states that fences require a permit issued by the city building official, but the cit y has not been requiring or issuing fence permits. The ordinance also has a table that outlines setback and height requirements for fences that could be simplified, including removing requirements for zoning districts that no longer exist. G.X 2 At its meeting of June 2, 2025, the City Council authorized staff to work with the City Attorney on drafting amendments to the fence ordinance. Staff has determined that the goals of the Encroachment Agreement process could be met by requiring them only wh en a public improvement is present within the easement. Staff has drafted text amendments that include the following: • A statement that any fence placed within an easement may be removed in the event that work needs to be performed within the easement. • A requirement that any fence placed within an easement where public improvements are located, or access to public improvements is located, must receive administrative approval from the Public Works department, and be recorded at the county. • Removal of the requirement that a fence receives a permit from the city building official. • Simplifying the height and setback requirements table to better reflect current zoning districts. 3. STAFF RECOMMENDATION: Staff recommended that the Planning Commission recommend approval of the proposed text amendments to the City Council. 4. PLANNING COMMISSION RECOMMENDATION: The Planning Commission voted unanimously to recommend that the City Council approve the proposed amendments to the fence ordinance. Attachments: 1. (a) It is unlawful for any person to construct or maintain a fence, except in conformance with this chapter. (b) Fences are allowed as an accessory use in all zoning districts of the city. No fence shall be constructed in the urban development area or on a parcel of land ten acres or less in size in the rural residential zoning district without a permit issued by the city building official. (b) All fences shall be located entirely upon the property of the person owning the fence, except line fences used for agricultural purposes. (c) All fence owners shall maintain the fence in a state of good repair and appearance, and not allow the fence to become a safety hazard or nuisance. The city building official may order the removal or rep air of any fence that is unsafe, seriously dilapidated, blocking drainage, or in any way poses a threat to public health, safety, and welfare. (d) No fences shall be placed in a public road right-of-way, except temporary barriers authorized by public safety personnel, the city engineer, or the city maintenance supervisorpublic works director. (e) .As to any fence (or any structure or landscaping), or any part thereof, installed or present within a public easement, the city may remove the fence (or order it removed at its own discretion) in the event that work needs to be performed within the easement free of any claims of cost, loss or damage. The city and any agent of the city shall be held harmless for any and all claims for damage to the fence, or part thereof, arising out of or relating to work performed in the easement, including but not limited to the removal of the fence or any part thereof. The city is not responsible or liable for the costs of repair, reinstallation or restoration of any fence or part thereof removed from the easement. (f) Fences (or any structure or landscaping) may not be placed within a public easement where public improvements are located, or where an easement provides access to a public improvement, without first receiving approval of an encroachment agreement by the public works director or other designee, along with proof that the agreement has been filed with the record for the property in the office of the County Recorder or Registrar of Title. (g) That side of the fence considered to be the face or facing as applied to fence posts, shall front abutting property (good side out). This shall not prohibit construction of wire or cable fences used to control livestock in conformance with common agricultural practices. (h) No person shall construct or maintain any fence that is connected to, or charged by, an electrical system, except low-amperage systems used for livestock control in agricultural, long-term agricultural, and rural residential zoning districts. (i) The following fencing materials are allowed in all zoning districts: (1) Chain link. (2) Decorative masonry or block. (3) Wrought iron. (4) Brick. (5) Natural stone, dressed, or undressed. (6) Wood of proven exterior durability such as cedar, redwood, or treated wood. (7) Plastic fencing manufactured to look like wood fencing. In this case, the intersection shall be considered the edge of the curb or travel portion of the roadway. Where one or more of the streets has a speed limit in excess of 35 miles per hour, such setback requirement shall be 30 feet or as may be necessary for traffic and pedestrian safety. (l) No fence over three feet high shall be constructed within ten feet of the ordinary high-water level of any lake or waterbody listed in section 90-137. THE CITY OF HUGO ORDAINS: The City Council of the City of Hugo does hereby amend Article VI REQUIREMENTS FOR SPECIFIC USES AND PERFORMANCE STANDARDS, Section 90-227 FENCES. Removing items under Subsection (b): (b) Fences are allowed as an accessory use in all zoning districts of the city. No fence shall be constructed in the urban development area or on a parcel of land ten acres or less in size in the rural residential zoning district without a permit issued by the city building official. Amending items under Subsection (d), (e), (f), (j) and (o) to read as follows: (d) No fences shall be placed in a public road right-of-way, except temporary barriers authorized by public safety personnel, the city engineer, or the city public works director. (e) As to any fence (or any structure or landscaping), or any part thereof, installed or present within a public easement, the city may remove the fence (or order it removed at its own discretion) in the event that work needs to be performed within the easement free of any claims of cost, loss or damage. The city and any agent of the city shall be held harmless for any and all claims for damage to the fence, or part thereof, arising out of or relating to work performed in the easement, including but not limited to the removal of the fence or any part thereof. The city is not responsible or liable for the costs of repair, reinstallation or restoration of any fence or part thereof removed from the easement. (f) Fences (or any structure or landscaping), may not be placed within a public easement where public improvements are located, or where an easement provides access to a public improvement, without first receiving approval of an encroachment agreement by the public works director or other designee, along with proof that the agreement has been filed with the record for the property in the office of the County Recorder or Registrar of Title. (j) Barbed wire and cable fences are allowed only in the agricultural, long-term agricultural, rural residential, and future urban service zoning districts, except up to four strands of barbed wire may be used to top fencing at least six feet high in the industrial and restricted industrial zoning districts. Razor or ribbon wire is prohibited in all zoning districts. Background: Minnesota Statute 13D.02 allows for meetings to be conducted by interactive TV under certain conditions. An advisory opinion released in 2012 by the Information Policy Analysis Division (IPAD) has determined that a city council member can attend and participate in a meeting from a remote location using Skype,technology if the requirements of the State Statute have been met. Policy: A member of the Council, Commission, or Board will be considered present at a meeting from a remote location using Skype, or similar interactive media,technology if the following requirements have been met: 1. All members of the body participating in the meeting, wherever their physical location, can hear and see one another and hear and see all discussion and testimony presented at any location at which at least one member is present. 2. Members of the public present at the regular meeting location of the body can hear and see all discussion and testimony and all votes of members of the body. Public comment will only be allowed at the regular meeting location. 3. At least a quorum of the body is physically present at the regular meeting location. 4. All votes are conducted by roll call so each member's vote on each issue can be identified and recorded 4.5. The Presiding Officer must be present at the regular meeting location. 5. Each location at which a member of the body is present is open and accessible to the public. 6. Notice of the meeting shall be provided at each of the locations where a member is participating. The timing and method of providing notice depends on whether the meeting is regular, special, or emergency.provide notice of the regular meeting location and the fact that members may participate in the meeting by interactive technology and will contain all the information needed for the public to monitor the meeting remotely, including meeting links and/or access codes, as applicable. For the purpose of remote attendance of regular meeting, the meeting will be considered a special meeting, which is any meeting at a time or place different from that stated in the Council’s schedule of regular meetings. The posted notice of a special meeting will comply with the following requirements. The timing and method of notice of the regular meeting location is the same as for in-person council meetings and depends on whether the interactive technology meeting is a regular, special, or emergency meeting. 7. Notice will be posted by the City Clerk at the regular meeting location. a) Notice will be posted at the remote location by the remote attendee. b) Notice will be posted at least three days prior to the meeting. In calculating the number of days for providing notice, the first day the notice is given should not be counted, but the last day should be counted. But if the last day is a Saturday, Sunday, or a legal holiday, that day is omitted from the calculation and the following day is considered the last day. c)a) The notice will specify the time zone for the meeting time at both locations. 8.7. Remote meeting attendee will be responsible for all costs related to technology and devices needed to meet the above requirements. 8. If at any time a quorum of the governing body at the regular meeting location has determined the method of attendance by interactive online media has proven to be disruptive or troublesome to meeting proceedings, the remote attendee will no longer be considered in attendance and will not be permitted to participate in discussion and voting. Reasons to dismiss the remote attendee could be poor quality video or audio, excessive lag time, etc. 9. The minutes must reflect the names of any members appearing by interactive television technology and state the reason or reasons for it. 10. Pandemic or state of emergency meetings may be held entirely remotely. If applicable, method of receiving public comments will be determined prior to the meeting. 11. Any changes in Minnesota State Statute may void or amend this policy. Adopted by the Hugo City Council on July 21, 2025.
