RESOLUTION 2025-52 <br /> APPROVING FINDINGS OF FACT FOR REZONING KWIK TRIP,INC. FOR <br /> PROPERTY LOCATED NORTH OF 159Tu STREET NORTH AND EAST OF <br /> FOREST BOULEVARD NORTH <br /> WHEREAS, Kwik Trip, Inc. has requested reclassification of the zoning from Planned <br /> Unit Development (PUD) to General Business (C-2). The property is legally described as <br /> follows: <br /> OUTLOT B, The Shores of Oneka Lake, Washington County, Minnesota. <br /> WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br /> Hearing and recommends approval, and; <br /> WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from <br /> PUD to C-2; <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request <br /> by Kwik Trip, Inc. have requested reclassification of the zoning from Planned Unit <br /> Development (PUD) to General Business (C-2), based on the following findings: <br /> 1. If the comprehensive plan amendment is approved, the zoning will be in compliance <br /> with the comprehensive plan. <br /> 2. The buildings and site are arranged to accommodate the proposed use in regards to <br /> parking, access, and building placement. The proposed zoning classification is <br /> appropriate for the property because there are no topographic, environmental, or <br /> cultural limitations of the site. <br /> 3. The property is adjacent to and is accessible from 159th Street, which is designated as <br /> a Minor Collector in the 2040 Comprehensive Plan. The property can be adequately <br /> served with the accesses proposed. The property is served by city sewer and water. <br /> 4. The property is immediately adjacent to commercially-zoned property, and across <br /> 159'h Street from residentially-zoned property. The proposed zoning classification <br /> will buffer noncompatible uses with the street between them, thus minimizing the <br /> impact on neighboring properties. The access is proposed on 159a' Street which is <br /> classified as a Minor Collector road in the 2040 Comprehensive Plan. 159a' Street is <br /> designed to accommodate and has the capacity for additional traffic. The proposed <br /> zoning will not have unreasonable negative impacts on the neighboring properties. <br /> 5. No floodplain areas are proposed to be impacted with the project. <br />
