HomeMy WebLinkAbout1974.02.12 PC Minutes MINUTES OF PROCEEDINGS OF HUGO PLANNING COMMISSION February 12, 1974 The meeting was called to order at 8:07 P.M. by Chairman Larry Ehret. Members present were: Spitzer, Norden, Ehret, Leroux and Peloquin. Also present were Irene Leroux, City Council Member, and Bill Schwab, City Planning Consultant. Motion made by Spitzer, seconded by Paulson, to approve minutes of January 23, 1974 meeting. Motion carried. Motion made by Spitzer, seconded by Norden, that the secretary post a copy of the minutes on the bulletin board for the public. Motion carried. Larry Ehret read a letter received from the Attorney General's office to the City Attorney regarding their view on 20 acre zoning. LITTI & SONS CONSTRUCTION COMPANY Jerry LaMetti represented the LaMetti & Sons Construction Company for an informal hearing with the adjoining property owners. Neighbors present were Messrs. Oaruth, Indykiewicz and Ducharme. The neighbors were asked if they were in agreement with changing their property to industrial. Mr. Indykiewicz objected to having just a portion of his property zoned Industrial. He would prefer to leave his property zoned residential so he could some day put in a trailer court or develop it in some other way. Motion made by Spitzer, seconded by Peloquin, recommending we submit one copy of this proposed zone to the City Engineer for purposed of approving the legal description of a roadway which will be 40 feet off of the East side of Mr. Caruth property, 40 feet off of the west side of Mr. Ducharme property and 40 feet off of the west side of Mr. La..Met.ti property; and further to submit the map to Carl Dale for inclusion of that area enclosed by the dotted line but truncated on the south side by the LaMetti property in an industrial zone. Members for: Leroux, Norden, Ehret, Peloquin and Spitzer. Motion carried unanimously. • • -2- JUNE SMITH Mr. Ehret read the application for Special Use Permit to operate a day care center. Motion made by Spitzer, seconded by Leroux, that these documents by submitted to Bill Schwab for his review and a public hearing by set for the first meeting of March. Members for: Leroux, Norden, Ehret, Paulson and Spitzer. Motion carried unanimously. Mrs. Smith stated their home has been inspected by the statelHealth and Fire Inspector. The Health Inspector's report was submitted as part of our records and the Fite Inspector' s report should be received by the time of the Public Hearing. They have applied for a license from the State Welfare Department. Mr. Burkard stated the fee for a Special Use Permit to operate a day care center is X50.00 instead of X25.00. BUR-LAR MINING A letter was submitted to the City Council from Mr. Richard Bury, President of the Bur-Lar Mining Company requesting renewal of a Special Use Permit for But-Lar Mining Company. Mr. Bury stated his intentions to discontinue any mining operations, to remove the existing pile of gravel and return the land to its normal use. Motion made by Spitzer, seconded by Peloquin, that the Planning Commission recommend that the Bur-Lar Mining Permit be renewed subject to the same conditions that the permit was renewed last year. Members for: Leroux, Norden, Ehret, Peloquin and Spitzer. Motion Carried unanimously. THOMAS LAVAL LE Ehret read letter submitted by Mr. LaValle requesting renewal of his mining permit. Motion made by Spitzer, seconded by Leroux, recommending the approval of the mining permit for the year of 1974 with the additional condition that the 1000' and 500' area be kept free of water during the spring and that the 1000' area be filled to specified grade no later than July 1, 1974. Members for: Leroux, Norden, Ehret, Peloquin and Spitzer. Motion carried unanimously. -3- CLARENCE LAOKTORIN Mr. Lacktoriu requested rezoning from industrial to residential of 10 acres of his property. Motion made by Spitzer, seconded by Norden, that the matter of Lacktorin property adjacent to the railroad track be tabled until such time that the proposed zoning ordinance be considered in its entirety. Members for: Leroux, Norden, Ehret, Peloquin and Spitzer. Motion carried unanimously. Bill Schwab suggested that when Carl Dale brings in the map, we make sure that this area is zoned residential. CITY COUNCIL MEMBERS Mayor Creverand Council Members Lease and Martin discussed the Oak Vista Estate Subdivision. The Council Members made the following statements. - They objected to the Planning Commission recommending approval of the preliminary plat because it is a completely different plan from the original one, i.e. Hadley Avenue not extending through to County Road 10 - Mr. Lease said there was no five year improvement plan and the City can only enforce roads within a subdivision. - They would like to see a written agreement for the home owners association and also a cash settlement for the park land fund. ---The City roads would not be able to handle the traffic from this subdivision. - Not within the new zoning plan. The Planning Commission stated their hands were tied because there was no moritorium approved by the Council as requested by the Planning Commission a year ago. Irene Leroux stated the City Attorney stated that a moritorium was not legal without a termination date. Mr. Spitzer stated he wished the Council would approve the comprehensive plan and the moritorium so the Commission would have something to work with. -4- WHITE BEAR ROD AND GUN CLUB Mr. Perron represented the White Bear Rod & Gun Club and he submitted a letter he received from the Rice Creek Water Shed. The Rice Creek Water Shed approved the permit application with the suggestion that annual reclamation of the lead shot be in- corporated into the final design. The managers discussed the possibility of providing a cover of sand in the impact area to facilitate the reclamation of the lead shot. Mr. Ehret read the letter regarding test results. Mr. Spitzer stated the test results were incomplete because sound levels were not obtained for the south boundry. Mr. Spitzer said all they needed before making a decision was for Mr. Perron to get the person who did the test to pinpoint the locations where.+'the person stood when shooting and where the sound ley is were taken. Mr. Spitzer asked what the time lapse is between shots normally. Mr. Perron stated approximately 15 to 20 seconds. Mr. Spitzer said for shots shot simultaneously you have to add 3 dbs. The test results were within the levels set by the PCA. Mr. Perron stated most shooting is done between 6:30 and 8:00 P.M. and rare occasions go until 9:00 P.M. Mr. Perron was asked if they intended to install lights. He said they did but they are rarely used. He was asked what that light level would be and he said it would be about the same as. a football field. Mr. Schwab said there was no request for lighting or for renting out the club on the request and if they wanted them they should be requested now. Mr. Spitzer stated they had promised the interested property owners in the area a public meeting, Mrs. Peltier was asked if she would inform these people of the next meeting. Motion made by Spitzer, seconded by Norden, that we table the matter of the White Bear Rod and Gun Club until ,,the..next meeting. Motion carried unanimously. HARDWOOD CREEK ESTATES Motion made by Spitzer, seconded by Leroux, that that the Mugg's property request for a subdivision be tabled indefinitely.
