HomeMy WebLinkAbout1974.02.28 PC Minutes SPECIAL MEETING - PROPOSED ZONING ORDINANCE FEBRUARY 28, 1974 The meeting was called to order at 8:05 P.M. by Chairman Larry Ehret. Planning Commission members present: Peloquin, Rosenquist, Ehret, Johnson, Spitzer, Norden and Leroux. City Council members: Craver, Leroux, Martin, LaValle and Lease. Also present were City Attorney Johnson and City Planner,-Dale. Carl Dale presented his proposals for the zoning map to the City Council and Planning Commission. Mr. Dale corrected his statements made in items 1 and 2 of his memo dated February 25, 1974. He did not realize the City Council had not adopted the Comprehensive Municipal Plan. Mr. Dale suggested that the City Council adopt the Comprehensive Municipal Plan as soon as possible and that it was a very simple procedure. He also stated that what ever size the Planning Commission suggested for the minimum lot size as long as it was above 2-* acres it does not change the Comprehensive Municipal Plan.and does not have to go back to the Metro Council. Mr. Dale suggested within the sewer district we stay with 5 acres for legal reasons. - Its the common minimum lot size used today. - Anything over 5 acres does not need approval under subdivision. Spitzer corrected Mr. Dale and said it is 5 acres and over that does not come under subdivision unless a road is involved. Mr. Dale said we had until July of this year to come up with a lake shore ruling before the B&R comes out with their own regula- tions governing lake shore. Mr. Dale suggested 20 acre minimum for conservancy and said that it orwould be up to the property owners to prove that their property should not be in the conservancy. He said the conservancy maps are not that accurate and suggested every three years we take a very comprehensive review of the plan to amend the conservancy district. Mr. Dale said there was no 5 year program so he expanded it to include it in the 10 year program. The Metro Council' s recommendation to switch the southern and north districts to promote growth in the south does not effect the plan. Mr. Ehret read letter from Carl Dale and asked Attorney Johnson if he had any comments. He said he didn't but he said he checked his records and could not find a recommendation from the Planning Commission to the Ci.tp Oouncil to adopt the Comprehensive Plan. . -2- Spitzer said the recommendation had been made to the City Council but that he would make it again. Motion made by Spitzer, seconded by Rosenquist, that the Planning Commission recommend to the City Council to adopt the Comprehensive Municipal Plan with due note being taken to the recommendations made by the Metro Council and will be considered for further study. Members for: Peloquin, Rosenquist, Norden, Ehret, Johnson, and Spitzer. Motion carried. Motion made by Spitzer, seconded by Johnson, that the Planning Commission recommend to the City Council that they approve the proposed Zoning Ordinance and Zoning Map, as presented by Carl Dale, with the following modifications: With the property west of the sewer service line designated as "A" be changed to "RR", minimum lot size in the Agricultural Zone be changed to ten (10) acres, and all other minimum lot sizes noted in the proposed Zoning Ordinance and Zoning Map stay the same. Members for: Peloquin, Rosenquist, Norden, Leroux, Johnson and Spitzer. Motion carried. Mr. Johnson stated the sewer line is a fixed line but is not a cast and concrete line. Mr. Dale suggested writing the reasons for the decision on the minimum lot sizes for future legal actions. Peloquin felt the people east of the sewer line zoned agricultural not R residential were being handicapped. Ehret said the people on the west side would have to go through subdivision with additional cost and the land on the east has always been valued higher than land in the west. Laval l e felt they have not solved the problem they started out to solve and that people would still sell land along the road and not develop land off the road. Mr. Johnson said according to the Comprehensive Plan objective was to keep the area as open and green as possible ana discussing development is con irary to the Comprehensive Plan. Mr. Johnson said use of land passes on with the land when it is sold. Egret read the definition or Rural ktesiaentijal. Carl Dale suggested that the Public Hearing be a joint hearing with the Planning Commission and City Council. It was the consensus of the members to have a joint mee 4i ► .
