SUBJECT: SPECIAL USE PERMIT FOR DAY CARE CENTER
REQUESTED BY MR & MRS JAMES SMITH

The request is for a special use permit to allow the use of a portion of the
Smith residence as a child care center. According to the proposal, there would
be facilities for a maximum of eighteen (18) children and the child care center
would be licensed in accordance with State regulationspertaining to this type of
facility. Not being to familiar with child care centers, I feel we should leave
the space requirement, per child, up to the licensing agency since they must
have set minimum standards.
• The site in question is approximately seventeen (17) acres in size and since
these children would be supervised I do not feel there would be a detrimental
effect on surrounding land uses. The site plan that was submitted shows both
shelter belt plantings that were done in 1973 and some additional ones proposed
for 1974. This would help to provide privacy to the surrounding land owners
and should adequately protect their interests. If during the public hearing specific
points are brought up regarding intrusion of privacy by surrounding land owners
we could evaluate their concerns at the time of the public hearing anddetermine
if additional security or screening measures are necessary.
I also looked at the septic system design to determine its adequacy for such an
undertaking as is proposed. Your building inspector provided me with the soils
information he had available on the site and a copy of the permit that was issued
for the system. In reviewing this material it appears that the permit was issued
for a single family structure and did not take into consideration the possibility of
a child care center. The existing system has a 1200 gallon septic tank with
250 feet of drainfield. This is adequate for the single family residence but does
not meet the requirements for an additional eighteen (18) children under the .child
care center proposal. We feel that an additional two lines, '24 incheswide, 75
feet in length, should be added to the existing drainfield system and an additional
1000 gallon sealed septic tank should be added to the system in series with the
existing septic tank.

It is my recommendation that the Hugo Planning Commission recommend approval
of this project with the following conditions:
1. A current copy of the license for a child care center be on file with
the City Clerk.
2. The present sewer disposal drainfield system be expanded by adding
an additional 1000 gallon septic tank in series with the existing tank
and two additional drainfield lines be added, each one being 75 feet
in length placed in trenches 24 inches wide.
3. This special use permit shall be null and void if at any time these
facilities do not have a current license from the State Public Welfare
Office for the operation of a child or day care center.

MINUTES OP PROCEEDINGS OF THE HUGO PLANNING COMMISSION
MARCH 12, 1974
The meeting was called to order at 8:07 P.M. by Chairman Larry
Ehret. Members present were: Johnson, Norden, Ehret, Peloquin
and Rosenquist. Leroux arrived after meeting was adjourned.
Also present was Bill Schwab, City Planning Consultant.
Motion made by Rosenquist, seconded by Peloquin,to approve
minutes of February 27 meeting with the correction on Page 2,
paragraph 2, changing the word ba to to. Motion carried.
EVERGREEN HILLS 4TH - RICHARD VA I L
Request for Subdivision of 4.2 acres into 4 lots.
Mr. Schwab expressed his concern over soil boring tests and
he asked Mr. Vail how he planned to compensate. Mr. Vail
stated he planned on filling with rock and using seepage pits.
Mr. Schwab felt seepage pits were not desirable.
Motion made by Johnson, seconded by Peloquin, to table the
matter of the Evergreen Hills 4th addition until the 27th of
March until the Planner has a chance to review the matter for
a recommendation.
Members fors Peloquin, Rosenquist, Ehret, Johnson and Norden,
Motion Carried unanimously.
Motion made by Johnson, seconded by Norden, to schedule a Public
Hearing for Richard Vail's Evergreen Hills Addition #4 for the
9th of April at 7:30 P.M.
Members fors Peloquin, Rosenquist, Ehret, Johnson and Norden.
Motion carried unanimously.
RI CHARD VAIL'S SUBDIVISION-MINOR
Motion made by Peloquin, seconded by Norden, that the matter of
a minor subdivision be taken up by the Planning Commission.
Motion carried.
Mr. Vail submitted an application to subdivide 100' off of Lot 7
Block 2, Evergreen Hills 2nd Addition.
Motion made by Johnson, seconded by Rosenquist, to approve to
Richard Vail ' s minor subdivision contingent on minor subdivision
fee for such.
Members for: Rosenquist, Peloquin, Ehret, Johnson and Norden.
Motion carried.

Mr. Schwab stated that it is not a buildable lot so a parkland
fund is not needed.
SMITH CHILD CARE CENTER
Mr. Schwab submitted his recommendations for the proposed child
care center. Mr. Schwab felt the present septic system was in-
adequate. The Building Inspectors report was also discussed.
THOMAS CREVER
Thomas Orever, Building Inspector, questioned the Planning
Commission about a parcel of property measuring 257' wide and
seven acres total. Mr. Schwab stated that because they do not
have the 300' frontage on the road, a minor subdivision is
required.
Motion made by Rosenquist, seconded by Peloquin, to adjourn the
meeting at 9:00 P.M.
ROBERT SEVERSON
Mr. Severson planned on purchasing 1.1 acres of property and wanted
to know the Planning Commissions opinion on his proposal.

RESOLVED : that the Planning Commission of the Village of
Hugo hereby approves and adopts the comprehensive plan
of the Village as developed and prepared by the
Planning Commission .
FURTHER RESOLVED : that in order that the Comprehensive
Plan shall at all times be current with the needs of the
Village of Hugo and shall represent the best thinking of
the Council , Planning Commission , and boards , commissions ,
and departments in the light of changing conditions , the
Planning Commission shall annually review the Plan and
recommend extensions , changes , or additions to the Plan
which the Commission considers necessary. Should the
Commission find that no changes are necessary, this
finding shall be reported . This review procedure shall be
timed so that any proposed amendments to the Comprehensive
Plan shall be reported to the Council for its consideration
along with the regular annual report of the Planning
Commission .
FURTHER RESOLVED : that the Planning Commission shall
incorporate all plans , maps , data , charts , improvement
• proposals , and other materials not originating from the
Planning Commission into the Comprehensive Plan as it
deems necessary and desirable. All developments or
development plans approved by the Village Council which
are not in conformity to the Plan shall be considered as
amendments to the Plan and shall be so noted by the
Planning Commission.
