MINUTES OP PROCEEDINGS OP THE HUGO PLANNING COMMISSION APRIL 24, 1974 The meeting was called to order at 8:15 P.M. by Chairman, 4arry Ehret. Members present were: Spitzer, Johnson, Ehret and Peloquin. Also present were Bill Schwab, City Planning Consultant, and Irene Leroux, City Council Member. Motion made by Spitzer, seconded by Peloquin, to approve minutes of April 9. Motion carried. QYDE REHBEIN - AMENDED SPECIAL USE PERMIT A letter was submitted to the Planning Commission from the City Council requesting additional conditions for the amended special use permit. Mr. Rehbein submitted a letter relinquishing any claim to extraordinary damages in the event a service road is built in front of his property. Motion made by Peloquin, seconded by Spitzer, recommending approval of the amended, special use permit with the following conditions: 1. That an agreement with Clyde Rehbsin ;be consummated by Clyde Rehbein relinquishing any claim to extraordinary damages in the event that atsome later date a service road is constructed in treat_ of his property. Extraordinary damages refers to insoni►ea.snees such as traffic noise, congestion, damage to commercial suitability, etc. , but does not include the yams of real property. 2. The amended special use permit is recommended to tbe issued on the addition of the building to be used as a display facility for Northway Construction and Lighting business. 3. Site plan be submitted to the City Council showing the entrance to the property and the parking facility for not less than 20 vehicles is provided. 4. The number of permanent employees at this site with the present sewer system should not exceed twelve. Members for: Peloquin, Ehret, and Spitzer -- Johnson - No. Motion carried. HERBERT PECAN - AMENDED SPECIAL USE PE$MIT Motion made by Spitzer, seconded by Johnson, recommending approval of Peckman's Amended Special Use Permit subject to the following conditions: -2- 1. An addition of ?5 feet of drainage field be provided for the sewer system. 2. Specifications for the building shall conform to the building code for commercial structures. 3. The site shall conform to the site plan as presented including setbacks, parking facilities and vehicle access. 4. The site as shown shall be completed within a period of 18 months. Members fors Peloquin, Ehret, Spitzer and Johnson. Motion carried. RICHARD VAIL - SUBDIVISION Mr. Ehret read letter from Mr. MaMier of the University of Minnesota. Mr. Spitzer stated that this subdivisi©ndi as presented, does lot conform to the Comprehensive Plan as adopted by the City Council. Motion made by Spitzer, seconded by Peloquin, that the Richard Vail's Subdivision be transmitted to the City Council recommending that it be denied on the grounds that it does not conform to the Comprehensive Plan. There appears to be difficulty of on-site sewer system that has not been resolved. The Planning Commission has expressed its desire not to consider this application as filed any further. Members for: Peloquin, Ehret, Spitzer and Johnson. Motion carried. Motion made and seconded that the meeting adjourn at 9:30 P.M. Motion carried.
